at 11:00 a.m. on a Wednesday officers responded to a Dollar General store in reference to an employee theft these are the events that followed hello how you doing good how are you yes she's in there know anything about it yeah so this is his district manager I've been working with him validating that the deposits and aditt it to the bank she just admitted she needed get money for family emergency so you can go talk to her if you want and uh how many deposits six deposits six separate deposits mhm oh she was supposed to make like the cash deposits to the bank and she didn't she kep the money okay and when did it start like what is it she said in May so between May and now you guys are compress charges on her yeah made that decision I'm sorry Al made that decision the company require us DM and us to okay prosecute yeah if they can't pay back and she can't pay back so we give up all option here um and you guys have like some kind of a record that she was supposed to make that yeah the bank the bank deposits here the validation from the bank yeah she's you we are how you doing good what's going on no you don't know they said they weren't going to have you bir no I said that I didn't know what where I was going to go right that's so I'm waiting for the reply but right now you have to talk to him Miguel has no idea cuz he's never been in one of these with me so he knows that it was a possibility that the police was going to get called but it's a requirement one of the two like I told you when we were talking but I'm still waiting for the phone call back okay well I'm not going but they're saying around six deposits around $133,000 okay um so uh he just ass me that he I wasn't going to go to jail he doesn't know that's what I was telling you when you told me to get out of the you ex me out of the conversation I would have corrected him because I I told you from the beginning so if you couldn't pay back that that would be all right I'm going to speak to her we G to go opportunity to speak for your so if you choose to or not um I just did they told me I wasn't going to go to jail I'm sorry they told me I wasn't going to go to jail okay well I'm I'm here now so you know they have their accusations um so I have to address them um but since you're accusing this a statement here that she wrote All right well I'll look at that later um so NE tricking me at this point uh because you're accused of crime in know for me to get into it further with you I have to uh basically uh advise you of your rights before that uh you do have the right to remaine can we do this outside Miguel please can we do it outside she walk out I do what outside you're going to arrest me are is he going to harest me yeah you want me to finish reading your rights or can we just do the outside please so if you don't allow me to finish reading your rights go ahead you have the right to remain silent anything you say can will be used against you and the court of law okay you do have the right to an attorney if you cannot afford one w't be appointed for you without a charge okay now if you do decide to speak to me and at some point you change your mind you're free to do that you can uh the qu all questioning will be stopped at that point okay now um knowing understanding your Miranda Right do you wish to speak to me about this matter like answer your questions yeah about uh yes say yes okay so uh what's uh what's going on with this deposits they're basically saying that there was six deposits I don't know the exact amounts but uh you were supposed to make uh cash deposits to the bank and you didn't is that well I had to pay's fre will my brother's Free Will and everything okay so is this something that the store manager does like do cash deposits to the bank oh yeah yeah all the manages there okay so how all do you do that like how long do you guys hold that cash in every day supposed to go to the bank so every day you go to the bank withit yeah okay and uh when did this start when did you first uh inspector justed to did in April six times is called and uh what would you say the average amount was um they vary sometimes went 15 the deposit went 1500 3,000 and how busy we were okay so you're only saying that it was four deposits not six hello do you agree that it was around $133,000 or um I don't know like 10 all right so saying from what you recall was like four deposits about 15 yeah I don't know the exact tool they have it she said she has it okay and how did they find out or how did um she said she's investigating for two weeks okay um let me see what she wrote did did you write the statement you did so you guys like Ian you have anything to present me like okay this deposit was supposed to be for this much I was trying to get that don't want you making any phone calls right now we figure that out later so those six one two three your last the 31 the 15 22 25 those last four there and this one also is missing so which which one are you saying that delete the last one the last four 1500 yeah like from the 22 11 to the 14 she says yes 11 to 4 that happened in April or is what they call rolling deposits so they'll just take it and then pay it back whenever they're able to to so they don't have it so they keep taking the deposit from the next day to pay that one it keeps going and going until they lose track so what they say if I make agree make payments if they they won arest me who said that toise would does do investig support don't have so for those with the so the the one for the the N hasn't been PA you're saying so what you're owning up to is the this one this one this one and that one not that one or that one okay all right so are you able to email this whole thing or okay um give me a well this is a felony amount we we can't do a court date for a felony amount he Prim me I was he's said you're not going to go to jail I promise you said if I agree if I agree to pay it back so I'm the investigator to support me to be a witness of the conversation so he can't make promises or anything like that unfortunately so um during the course of your investigation ma'am did Miguel make that statement that if she provided a statement and agreed to restitution that she would not be placed under arrest so I was actually leave the room okay she wanted to speak to him one but you're the one but you're the one conducting the investigation so he's he's a supervisor for her yeah I overse the stores when it comes to cash okay okay okay can we call Miguel back in here do you have a way okay unforunately he's not allowed to make those decisions I understand ma'am but you guys if you're conducting an investigation as a sub law enforcement type entity then you should know that you cannot make that type of a statement because now you've put her under durest and well even if he did it unfortunately you've tainted your own investigation if you're the one in control then you should have never agreed to leave the room and that's what I need to get very clear because because I'm not going to trample over her civil rights because somebody else did my brother's just I he just told me I I would understand that regardless of what statements are made right that is for you to dispute with a lawyer as far as we are concerned you have now committed the act of Grand Theft that is a felony we have no choice we must make an arrest and we must take you in they are the representing the business and they are requesting that we take law law enforcement action against you that is our position on it okay regardless of whether we think that their investigation went right or wrong as far as we are concerned we are going to conduct our investigation in the proper order okay work youand yeah okay yes can she's going to do her thing yeah I was trying to at least she was willing to corporate yes I was assuming that L prevention was going to take take that into consideration and accept you know like a deal you know yeah but it look like she yeah unfortunately okay those those kind of so because of that um do you have ID so we can just document that we spoke with you and that that statement she's she's alleging that that statement was made and um so as far as we are concerned um we can't accept any of this because it was all done under duress and all and under a false pretense she was coerced essentially you you've made false uh pretenses that she wouldn't go to jail and we have nothing to do with that but as far as you're we just need to document that this is the allegation that she's making and that we properly read her Miranda and we let her know that anything that she states to us at after this point you know Canon will be used against her so I just did your ID and that was all no I going to Prov my ID I don't have to hav't Comm any crime you're part of the investigation as the authorized representative and as her supervisor who bought her in here you are now part of the investigation you're going raise your tone I'm not raising my tone at all sir I've only SP I'm not afraid but I'm not going to provide my ID because I hav I know I know thew problem I'm I'm happy that and 22 one two three yeah the other ones I them okay well the the amounts that the charges go is anything over 5,000 between 5 and 20,000 so whether it's 6,000 or 10,000 it would be like the same Bond supervising manager you know for his information he does not want to comply he's not under any charges so not going to force him to just I'm just going to notate that when I asked him he said yes that he made that statement thinking and and he's claiming that the Lost prevention lady lied to him as well whatever the case may be uh if he's not going to cooperate and provide a statement then I can't uh prove any of that we're not using any of that yeah yeah I mean we definitely should notate though that she made the statement you know uh I'll put my supplement in if you want me to do it you know okay she was charged with one count of felony Grand Theft she was sentenced to 60 months of Probation and ordered to complete 75 hours of community service attend an anti- theft course and a vital
