He uh he kind of disappeared. >> Um went all the way up to New York, back to Florida. He's like not there anymore. Just kind of like fell apart. Um and today my mom called me while I was at work saying that my uncle just appeared at her house, just walked up with nothing. And she knows that he has animals. Give me one second. Let me get him some water. >> All right. actually. >> Okay. I just want to get him wet a little bit cuz I know he's hot. >> Yeah. So, come on. I know. There you go. Give me a give me one second. I think I have some more water. >> Nobody have a bowl or anything? >> Yeah. >> Is this your car, sir? >> Yeah, it is. >> Okay. So, this is registered to you. You're Mr. Mr. >> Is that correct? >> Okay. >> Are you thinking? >> Yeah. >> Okay. Um, do you have your driver's license on you? >> Yeah. >> Hi, Morgan. Morgan, here's your wallet. >> Thank you. >> Where you going? >> Right here. >> She's in the back for what? Your dog? >> Yeah. >> Okay. Give him a minute. It's in the back of my car. There's AC on in there. Okay. Okay. Can you get the dog water? >> Yeah, he's good. >> We can give the dog water, but I have to talk to him first. >> Yeah. Yeah. >> Uh he might try and run out. He has a leash on. >> Good boy. >> Uh K9 Charles said don't let him drink too too much water. Okay. >> Okay. Take a brush on it. >> Pour a lot of it over him to try and cool him down. >> Wait, wait, wait. I know. I know. Just a little bit. Just a little bit. I don't want you sick. >> Okay. Okay. That's it. Come back in. Come back in. Come on, baby. Come on. Come on. >> Uh, can somebody stay with him over there? Can someone help me get the dog back in the car? >> Come on, baby. >> Oh, no. Make him jump in the car with the water. Take the water in the car. Come on. Come on. Come on. Come on. Come on. Get in here. Come on. Come on. One more time. Come on. Come on. Come on. Come on. >> Got it. >> Thank you. >> Of course. >> Okay. Uh, do you go by Martin or Mr. Which one do you prefer? >> Martin. >> Martin. >> Martin. So, I do just have to talk to you before I ask you any kind of questions or anything like that. I have to let you know of your your rights. Okay. So, before we start, I'm required to warn you before you make any statement that you have the following constitutional rights. Okay. So, my name is Officer Garrick. I work for the city of West Palm Beach Police Department. All right. >> So, after I tell you each one of these, just reiterate back to me with a verbal yes or no whether or not you understand. Okay. You good with that? >> All right. So, you have the right to remain silent and not answer any questions. Do you understand? >> Question. You understand? You have the right lawyer of your choice for you question. You understand? You understand? Must be freely given question. You understand must be free. You understand? So, with that being said, um, what I'm going to have you do is just sign this. This is not admitting to anything. This is your signature on here just means that you understood everything that I read to you. Okay. >> Do you have an extra pen? >> Okay. So, that being said, I do just have a couple of questions. Um, the dog that was this this vehicle, this is your vehicle, correct? >> Okay. And so, the dog that was inside the vehicle, that's your dog, correct? What's the dog's name? >> Mr. Bojangles. >> Mr. Bojangles. >> You know how old uh >> three. >> Mr. Bojangles is >> three. >> How long have you had him for? >> Since he was a puppy. Uh >> 10 weeks. >> All right. And what time today did you park the car here? Do you remember? >> Remember last night I parked the car? Okay. >> So on the night of the 4th you parked the car. Today's the 5th. >> Yeah. >> Okay. >> 6th. >> No, today's the 5th. >> Okay. >> Today's May 5th. So last night you parked the car. >> Yeah. >> And then where'd you go after you left the car? >> I searched for him. >> You searched for who? >> Mr. Boangles. >> Okay. >> And uh I fell asleep somewhere out there. >> And uh >> when around when do you think you fell asleep? >> Uh 12:00. 12:00 like at night? >> No. No. 12:00 in the afternoon. >> Okay. So, you fell asleep at around noon? >> Yeah. >> And so at noon, Bojangles was still in the car. >> Yeah. But I >> And then you had fallen asleep somewhere else. >> Yeah. I looked for the car. I couldn't find it. Um, I booked for like 2 and 1 half or 3 hours. >> And you were looking last night or this this morning? >> Uh, this morning. >> Okay. So, when when did you leave him in the car is what I'm trying to ask. >> Last night. >> Last night. So, you left him last night? >> Yeah. >> And then where did you go last night? >> I looked for him last night and then uh I gave up. I looked. So I was >> So maybe maybe I'm phrasing it wrong. When you left him in the car last night, where did you go to >> cuz you say that you looked for him last night, but you >> right. But where where did you leave him in the car to go to? Cuz you obviously left him here in the car, right? >> I didn't know the car was here, >> right? Okay. But where did you go when you left? >> Uh, you know, >> I'm not from from around here. um way far that way. I wasn't sure where I left him. >> Okay. Did you leave him here for any specific reason? I mean, like, were you going somewhere to get food and you got lost? You were uh going to go get water for him or something? >> No. >> Okay. So, what reason did you leave him here in the car? >> He's fine in the car for like an hour or so. >> Mhm. Um, that's when I started to listen. >> Okay. Did you call police and ask for help? >> Frankly, the police, um, they're not a lot of help. Uh, >> okay. Did you ask anybody for help? >> No. >> No. Okay. Did you leave him any kind of water, food, anything like that in the car? I walked him uh and I gave him water. >> What did you put the water in? >> Uh cup. >> Cup? >> Yeah. >> What kind of cup? >> I have it in the car. >> You don't need to get it. That's fine. I'm just asking if you remember what kind of cup it was. >> No. >> No. How? So, it was like a small cup. Big cup. Like a jug. >> A big cup. >> All right. And so you you said last night around what time did you leave here? >> This was Sunfest last night and uh >> um what what's the question? >> Around what time last night did you leave him in the car here? >> And you said that you left last night. What time was that? >> I left him in the afternoon. Late afternoon. >> You told me that you left him last night. I said I was looking for him last night. >> Right. So, how would you have been looking for him last night but didn't leave him? Obviously, you would have had to leave him if you were looking for him. Correct. >> Yeah. He was in the car, >> right? >> Uh so I was looking for at for him. >> Mhm. And then you couldn't find him. Correct. >> I couldn't find him. And so I gave up. >> I uh fell asleep. >> Mhm. at around 12 in the afternoon. >> No. Uh last night and at six o'clock this morning, I started to look again. >> Okay. Where So from 6:00 until you came back over here in the car, where were you? >> Where was I? >> Yeah. >> Uh at my sister's house. >> Okay. And when you got to your sister's house, did you mention anything about the dog? >> Yeah. >> Okay. Did you guys come look for the dog? We were We were on our way. >> You were on your way? >> Yeah. >> Okay. >> All right. Is there anything else that you want to tell me? Anything else you feel is relevant to my investigation? >> No. >> No. >> No. You know, um, my heart is broken, you know, from leaving and and >> Okay. Have you ever has this ever happened before? >> No. >> No. All right. stay with my partner for just a minute. Okay. I'm going to talk to uh this is your sister, right? >> Yeah. >> Okay. >> Okay. I do just have a couple of quick questions for you. Um what time did he get to your house earlier today? >> Was it right when you called? >> Yeah, ex exactly when I called you. uh 1:30. >> So around 1:30 in the afternoon. Okay. Did he mention anything about not knowing where his dog was? >> He said he didn't know where he put the car and I said, "Well, where's the dog?" He goes, "In the car." And I didn't know. I his his his mental state is kind of >> so I thought well maybe he doesn't really have the dog. >> Okay. >> So I didn't know what to make of it. He thought that the dog the car got impounded cuz he told me that he left at city place and he went back there to look for it and it was gone. >> Okay. >> So but I don't know if he was really telling me truth or anything. So I I just don't know. >> Okay. >> All right. Yeah. I mean his story with me is kind of all over the place as well. Um, unfortunately based on everything that I have, he is going to be placed under arrest for animal neglect. Um, or animal cruelty. Forgive me if I misspoke. Um, but animal care is going to come take the dog. um because they have an emergency vet services that they're going to take him to because unfortunately I would love to give him to you guys and you guys be able to hold him and you know whatot. But if something happens to the dog, if he doesn't get taken to the vet right now and god forbid he's suffering from some kind of heat exhaustion, heat stroke or anything like that and the dog passes away, that now falls on me for not intervening and calling animal care. So they're sending somebody out. They're going to take the dog and then he'll get um whenever they come out here, they'll get his information. Um and then >> because you want to know something when um he told me that he thought they didn't let the the dog in the car, I said, "Well, animal care and control got the dog." You know, that's what I thought >> because I truly didn't know, you know, where the and that the car got impounded. Animal care and control were coming and get the dog, >> right? >> But the arrest thing I didn't know about. But >> yeah, >> he's not going to like physical jail, is he? He is. >> Yeah. It's a It's a misdemeanor, but he'll >> put it in a Wow. >> Yeah. >> So, >> cuz the other offic said that maybe not, but >> Yeah. So, he'll have to So, technically, cuz he doesn't he doesn't live with you guys, right? >> No. >> No. So, we could only really do that if he has an address where he lives in inside of our jurisdiction. And his address is not in our jurisdiction. His address is in Miami. >> Okay. >> So, sometimes we're able to do that with misdemeanors. However, with this one, we're we're not going to. >> Is the car registered to your address? >> Um, I think the plates are Yeah, I think the plates >> registered to your house, >> right? Does that make any difference? >> No. >> Okay. >> Not with this one, unfortunately. >> Okay. >> Okay. So, he is going to go to jail. All right. >> And then what happens? So, tomorrow he'll see a judge in the morning and then they'll they'll determine what his bail is and then it'll be on him or if if you guys want to help out. Um, you know, >> that's that's on you guys unfortunately if he doesn't have the means and you guys do want to help out. So, um, we don't >> he has the means. >> Yeah. We don't we don't set those numbers. That's all set by the judge and everything like that. Um, so I wouldn't be able to to give you that, but it is a misdemeanor, so he will see them in the morning. Okay. >> All right. Okay, Mr. All right. So, right now, you are being placed under arrest for animal cruelty. Okay. So, based on my investigation, I have enough to take you to jail. All right. So, just put your hands behind your back. >> You're kidding me. >> No, I'm not. >> What did my sister say? >> It was nothing that your sister said. That's a little tight. >> Which one? The right one. >> Um, >> cuz I can fit two fingers in there. >> Okay. >> Pretty good. >> All right. I'm going to take this watch off you in just a second. Okay. So, that'll loosen it up a little bit. >> I'll take these keys. >> Do I be hearing or anything like that? >> Yeah, you'll see a judge. It's a misdemeanor. Uh, are you guys staying here for a minute? Cuz I got to wait for animal. >> Uh, not sure. >> Um, >> can I throw him in the back of your car for just a second? >> Do you have anything on you that's going to poke me, stick me, stab me? Anything that I need to know about? Any narcotics, any knives, any guns, any drugs? Don't reach in your pockets. Just let me know if you have any of that. I don't think so. >> You don't think so? Separate your feet for me. >> All right. No necklaces or anything like that. >> Go ahead and have a seat for me. >> I'm getting a little slow. You're fine. You >> need any help getting in? >> No. >> No. >> We'll move you into my car in just a little bit. I just need to get you in here. So, for a second. >> Okay. >> All right. Your knees. Watch your knee. Your left knee. Let me just Mr. I got a question for you. Do you want your car to go to your sister's house? >> Yes. >> You want them to take it cuz they'll drive her her son, your nephew said that he would drive it over to her house. >> Uh let my nephew drive it. >> What? Let my nephew drive it. >> So you're okay with your nephew driving you? >> Yes. >> Okay. All right. Do you need anything from the car to go with you? Do you need your wallet or do you want that to go with them? >> Where's my wallet? >> Your wallet you put inside the car. >> I'll take my wallet. >> You want your wallet? >> Okay. >> What's that? >> It's a little tight. >> Yeah. Once Well, so what's going to happen is animal care is here. Okay. So, they have to take the dog. >> Okay. >> All right. They're going to call you once they once they check the dog out. So once the dog is determined to be okay to be released, so once they get the dog out of my car, you'll go into my car. My car's got a little bit more room. Okay. >> All right. So it'll probably be another 5 minutes that you're in. >> And then what happens then? >> What do you mean? >> So you'll go to you'll go to county jail for for tonight or until you see the judge and they determine what your your fees are or what goes forward. I don't determine any sentencing once I all I do is enforce the law. So this is an arrestable offense. Why am I Why am I being arrested? >> Because of how you left the dog. >> Okay. The dog was left for an extended period of time in the vehicle with no water, no food, no nothing. We had a call about a dog and I got here and the dog was clearly in distress. Okay. >> You had water? Uh >> there was no water when I was here >> twice last night. >> Okay. Well, it's also South Florida and it's extremely hot and sunny. Okay. So, for him to be in that car all day by himself with no water, no nothing. Okay. So, let me talk to them and then we'll uh we'll get you into my car. Okay. >> The mark on your face. What's that? The the bloody spot on your face. What's that from? >> That's from shaving. >> From shaving. Okay. >> You need any help getting out? You got it. All right. He was charged with animal cruelty.
