cuz I have no weapon I'm we don't know that you do know that and this is why African-Americans have issues with law don't start that what's your problem you you're calling 911 and I'm standing right here what have I do put down the damn phone in a surprising turn of events a simple welfare check by the Los Angeles Police Department turned into a big legal battle Slade Douglas a 48-year-old man who lives by himself was at the center of this intense situation Douglas who has been dealing with mental health issues and chronic pain accidentally got the lapd's attention with his outspoken social media posts he was sharing his frustration and pain but these posts were misunderstood as calls for help this led the police to check on him that night officers Jeremy wheeler and Jeffrey yaban showed up unexpectedly at Douglas's home hi Doug douglas douglas Mr slay yes how you doing all right we got a call from uh was it the veterans I don't know what they call for can we come in and talk to you for a minute yeah okay is there anyone else in the house no so I'm just going to make sure nobody else is no please no no no no hold on I asked you no all I'm to ask you to leave cuz this is my house okay as the officers moved through his home Douglas protested saying he had rights and rejecting the officer's baseless claims that they were there for his safety you just can't walk around let me ask you just a couple questions the veterans people they they were concerned okay regarding a couple things one was which that you were threatening to commit suicide that's okay so what I'm here for is just to make sure you're not going to do something like that you understand so if you need our help that's what what I'm here for okay so we're not here to mess with you bother you well you do understand if you just walk in my place and you just automatically start walking around and I know y'all wear body cams as well I'm ex law enforcement too if you just come in my place like that and you just start walking around you have to have my permission to do that he asked them to leave but they ignored him and the situation quickly got worse the officers threatened to handcuff him if he didn't do what they said making the situation even more tense so I don't appreciate that you can't violate my rights because you got to call to help okay so you're not you're not helping me if you just come you automatically start b sir it was more for like officer safety no it's not officer safety because I I didn't even have to let you in right so no don't say right cuz it's about my safety because you're in my domain and if you're here to help me you can't say well my safety is cuz I have no weapons obious we don't know that you do know that because I'm asking you to leave please leave I'm asking you so to leave you don't feel know I'm asking I'm asking you to leave please leave I'm asking you to e my residents the tension reached its highest point when Douglas tried to call 9011 for help believing that the officers were unlawfully entering his home and mistreating him the officers told him to put down his phone wrongly accusing him of making the situation worse Douglas did not agree to their unfair demands which led the officers to directly threaten to handcuff him if he did not cooperate if you answer this question I'm ask I'm asking you to leave my res I'm about to put you in handcuffs sir if you do that that's your choice okay turn around put your hands why would you put me in handcuffs what turn around put your hands right on your back what have I done you're going to listen to what I said you're going to put down the phone you're calling 911 and I'm standing right here but what have I done put down the damn phone turn around and put your hands behind your back put your hands behind your back why cuz you know what you're calling 911 we're standing right in front of you ask to leave my residence I'm not leaving your place now turn around put your said you came here to help I'm not doing that now put your hands behind your back you're calling 911 right in front of us because I asked you to leave my res we can't leave be determined you know this the officers would not leave and kept insisting on staying even though Slade was clearly upset this was a serious misuse of their power you know exactly what I'm talking about if you were law enforcement then you would understand okay and this is why African-Americans have issues with law don't start that don't start that that's a bunch of I asked you to leave and you use profanity at someone that's okay I could use that oh really for someone who you concerned about doing something to themselves hey you know what when you're not listening to commands what did you do that wasn't a command a command for me to ask you to leave my residency you command us to do I can ask you to leave if you're not why are you here you were here to help me and I we are here because somebody wanted us to shck and I and I told you I was fine and then you start exacerbate my condition why you put your hand up like for me not to speak you can't help a person if you don't want to listen to what saying if I ask you to leave because you're exacer my disability which clearly you're aware I'm a person with a disability because you already observe number one you see a sign right here that's saying that number two how do I know what that is yeah what is that oh well how do you what do you how do you know I don't have one you could but guess what if you had one and you came in my residency and I you're the victim here right you're the victim here right well you guys are VI are victimizing me and now I'm in cffs well you're in cffs now because of way you're acting the officers said their actions were Justified because they thought Slade had called them for help however Slade said he never made such a call which caused confusion about why they were there in the first place this misunderstanding did not excuse their actions especially since it was clear that their presence was not helpful but harmful despite his repeated requests for the officers to leave they ignored him and continued to cross the line why I ask not to touch my why are you grabbing me I'm not doing but I asked you not Rel okay that's you stand right there no you cannot why not cuz you on custody right now you okay you know what you can you can call up whoever you talk to and tell them explain to them sir would you please step on my rug please that's a very expensive rug who who says I want to step on your rug why are you acting like your shoes yes they okay good you can put them on you have ID with you uh I do but I need to get it I can't get it and where's your ID would you please remove your hands off of me no I will not resist no I will not no I will not and I recommend you don't resist so put your shoes on why would I resist so you y'all can that's what y want to do anyhow what's your problem you you know what we came here because you called for help I didn't call you I didn't call you who did you call I did not call you who did you call I didn't call you who do you think they're going to call I don't know obviously I wouldn't have want them to call you all well they did okay okay and now you're you're in custody because you're under a mental evaluation okay and the body cams are working too absolutely absolutely during the search Douglas kept asking to see his identification but the officers wouldn't let him get to his things this made him worried about his privacy and rights being violated the situation got worse when the officers asked him if he had any weapons even though Douglas had already told them he was unarmed where's your ID do you want your ID I can't get it cuz then I'm not going to allow you to go through my things here okay so you don't own any weapons I already showed you that I had no weapons told you that I don't know that okay you don't know anything because I could go looking for anywhere that you might have a weapon if you're going on a 5150 hole I shouldn't be on a 5150 hole that's that's an abuse of authority to put someone on a 5150 hole who has show no sign are these your keys to your apartments or [Music] and I I don't believe you were law enforcement the way you acting I I don't I can't believe you're a law enforcement either if you found this video insightful please like share and subscribe for more interesting case like this the way the officers treated Douglas was rough and didn't show any respect for his physical and mental health he asked many times for the handcuffs to be loosened because they were causing him pain and discomfort on his arms but the officers ignored his quests get up get out you can speak to me in a different tone you don't need to screw and don't say that I am cuz you claim you supposed to be helping me it's the right right and it's not that as Loose as the positioning on my arm what are you talking about I have a okay you aware that I'm a disabled veteran are sure I have Ser ridic off you see there's plenty of room there no it's not about the room it's a positioning on my arms well how do you want your arms I I need this cup to be removed so from the front you know what the cups wouldn't be on you if you weren't acting the way you are whatever acting by exercising my constitutional check your cups okay it's not the cffs it's the positioning of my arms I requested that's how the LAPD hand can also you so that's the purpose of asking for a reasonable accommodation and that was the reasonable the reasonable accommodation is to reposition my arm because it's exactly reposition it how I need it in the front because it's exacer that's not how we do that's not how we do our hand thing about asking for a reasonable accommodation is a policy exception no we don't have a policy exception everyone comp Douglas's situation got more difficult when he tried to explain his Urgent health needs he kept asking for medical help and said it was urgent he also asked for a supervisor and more oversight but these requests were delayed making things more complicated the officers asked him about his medication and personal details but he refused to share them feeling that his privacy was being invaded we don't are you gonna help me with the Handcuff no I'm ask something I want to talk to you for a second my arm is dougas dougas I don't want to talk to you cuz that's what we I don't want you to be in hander you have I need medical atten I need could you take me to get medical attention yes you will get medical attention I need it immediately okay I've asked for a reasonable accommodation for the last 15 minutes you requested a supervisor I called one no now he's taking them to I need I request an accomodation as well and California Disability are refusing to do thatas you don't if you don't need if you don't need medical I said I need medical attention I don't know why you would say something different than what I just said I need medical take any medication I'm not answering that question I need medical exension immed okay what's your birthday I'm not answering that question all they're going to need this information I'm already what you mean they going to need it you already got me in coach now [ __ ] they going to find it out I answer any of your questions you don't want to answer any of your questions I don't have to however officers Jeremy wheeler and Jeffrey yabona were not given immunity which means there could be more accountability for police actions this decision is important because it might encourage more people who have been mistreated by the police to seek Justice it could also lead to stricter rules for how officers behave all over the country so you would like me to call you an ambulance I need I need medical attention you would like me to call your ambulance that you guys I need okay can you tell me the I said it many times I requested a reasonable accommodation was 15 you got to say what you need I no I requested a reasonable accommodation you didn't Grant and as a result of that it exasperated I I do not put your hands up in front that's not going to happen excuse me your hands are not going to be placed in front of you okay that's not how we do things well well the whole purpose of a reasonable accommodation is to make a policy you're not even a superior officer you don't attention my exacerbation disability cical ridicul C5 and C6 due to the handcuffs and the abusive touching that you did as well on the element okay the case highlights serious Fourth Amendment issues the fourth amendment protects people from unreasonable searches and seizures requiring police to have a warrant based on Good Reason before searching in this case LAPD officers violated this right by entering slay Douglas's home without a warrant and using too much force even after being asked to leave however the discussion also raises concerns about Douglas's spine problems from past injuries which got worse after this incident there's mention of possible civil penalties for these violations which could lead to damages as high as $10 million I really could use some help douglas douglas will you listen to me for a second I have't okay you haven't been listening to I'm not here I'm not here to fight you argue with you already me for a second no I don't need to hear you you got me for a second I don't need you don't you don't need to talk to me I ask for accommodation you can't don't try to don't try to you know deviate from what y'all did up there it's okay you can say whatever you like I know I can you don't have to tell me I already know I can yeah how are injes how me he's got spine issues from uh previous injuries and and from you putting your hands on me addition okay know okay disabled military veteran during the incident the officers couldn't reach the VA representative who had made the call so they couldn't confirm Douglas's claims about his condition and needs this lack of confirmation made the situation even more chaotic Douglas became more upset because of how he was being treated and felt his rights were being ignored apparently this guy threatened to commit suicide over the phone then I hung up the phone so it generated a call with the VA called us get out here we get up to the apartment um he's in there um he opens the door for us he actually lets us in I hand uh after a few minutes um start just check and make sure nobody else is in there um we handcuff U handcuff of because he immediately gets iate starts calling 911 on his phone because now he's asking us to leave but it's like at that point I'm already there so put him in handcuffs um I'm not able to get a hold of the lady from the VA whoever puts whoever called it in I I have to try to find her extension somehow um but he he's just been completely IR the whole time um he's in handcuff he wants his handcuffs in the front I told him I cannot do that I made sure his handcuffs were loose enough they weren't restricting any any type of of uh issue with his hands or anything like that injuries from the military won't answer any of our questions won't work with us at in the slightest but that's where we're at well to us at this point he won't answer any of our questions to do anything but I and then after we got them in handcuffs anything I started making the phone calls uh meu says oh yeah okay we'll have a team at the station for you to meet us there uh but as far as um me verifying what he said with the VA I can't can't do that yeah right yeah me is going to meet meet us there at the station okay all right and unfortunately the officers could face serious legal consequences including charges of battery and false imprisonment battery means using Force illegally and false imprisonment means keeping someone against their will these charges show how serious the officer's actions were so what display you didn't let us finish our investigation you mean you no you that's no reason you put someone why because you was violating my rights we're not violating any rights how can you say that we did not conduct our investigation what was your investigation to see to see if you needed I indicated that that that I was good okay you didn't let us finish our investigation okay okay okay all right all right Stu in a key legal decision a judge refused to dismiss the case saying officers Jeremy wheeler and Jeffrey Yaba are not protected by qualified immunity this decision could lead to more accountability within the LAPD and highlights the need for changes in police practices Douglas's experience and the legal battle show how important it is to protect citizens rights from unlawful police actions as we reflect on the case of slade Douglas and his confrontation with the LAPD it's clear that this case touches on critical issues of personal privacy police Authority and legal rights now we'd love to hear from you what are your thoughts on this case share your opinions in the comments below until next time stay informed and stay engaged
