It was New Year's Evening. Cold streets of Farmington, New Mexico, and two cars heading toward each other, unknowingly on a collision course. In the first car, a white Hyundai accent, was Felia Yazi, a mother clearly under the influence. In the front passenger seat sat her husband, Mikonis Roberts. He had no valid license and was intoxicated himself. In the back seat, five innocent children. Kaimar, 11, Angelo, 6, Mikulan, 4, Sarah, two, and little N just 7 months old. The family was heading home after a New Year's party. But instead of joy, that carried recklessness, danger, and five lives at risk. Coming from the other side, a gray Dodge van driving it was Shayen Denny, a mother of four, just trying to get home safely with her kids. For her, it was supposed to be a regular evening, but then in a split second, everything changed. The Hyundai turned sharply out of a parking lot and slammed into Shayen's. The impact was hard, violent. Doy Shayen stumbled out of her van in shock and saw the Hyundai's driver door open. Felli Yaji, clearly drunk, staggering, panicking, and dragging five children away from the seat. But the real question isn't whether Yazi goes to jail. The real question is, how does a mother gamble her children's lives like a game of Russian roulette? Because this wasn't just a crash, it was a wakeup call. Robert, they're all over the [ __ ] road. That's why there's so many. Oh, it's disabled. 4304. 4304. Start Hensley if he's available, please. 4332. We have a report for that. This guy's trying to take off, too. He was inside the vehicle, too. That guy right there. All right. Stay right here. And that's the driver. Can you guys give us a minute, please? You're not helping. Hi. Come here. Okay. Who's this man? I don't know. Okay. Come here. I'm Sergeant Burns, Farmington PD. Are you hurt? Um, yeah. I'm hurt because they're they're accusing me of running to some into somebody over there. Okay. Take your hands out of your pockets, please. My keys. These are your keys? Yeah. Just hold on. It's in my pocket right now. Okay. And and and I'm sorry. Just stop. Stop. Stop. Put all that stuff back in your pocket. I appreciate you sticking around, man. Do me a favor. Just turn around and put your hands behind your back for a minute. Okay. Just stop. Stop. Stop. Ready. So, look. This is for your safety and my safety. Do you understand? I don't know what's happening, but I'm going to try to figure out what's going on. And I don't want there to be any confusion or any misunderstandings. Do you understand? Okay. So, just let me figure out what's going on. And then we're going to take it from here. Okay. Are these Okay. Okay. Thank you. Okay. You almost killed the family. Stop. Hey, sir. You want to be in handcuffs, too? Yeah. Put him in handcuff. Let me do my investigation, please. Don't [ __ ] let him stay in the other van. Thank you. Just relax. So, I have another officer that's going to come and talk to you, okay? And get a statement and figure out what's going on. Okay. Okay. So, I want you to come on over here. Come on over here. That's my husband right there. And this is your husband? Yeah. He was driving uh and then he called me over. My kids are in the house over there. Okay. And so they're by themselves. Officer Estrada, you seem to have a lot of information with what's happened. Correct. Okay. Listen, please speak with him for 2 minutes. And figure out what's happening. Officer, please. Do you live here? Yes, I do. Where do you live? And what's your address? 3101. 3101? Yeah. My kids are in there right now. How old are your kids? My oldest is 11. 11. And then how old is your youngest? She's seven months. Seven months. Yes. I need to get back to him. Okay. This wasn't me. This was him. Okay. And so we're going to figure this out here and look this way. No. No. No. I need my wife. We need to figure out what's going on. He's resisting. I'm not Hey, which is yours? And my husband he was driving the car. Which vehicle? He was driving the car. The car is your vehicle. Yes. Okay. Mhm. And then for some reason and they said that you left and came back. No, I didn't. So you never left the crime? No. You never left the No, I came over here real quick when he called me. Okay. My husband over there. He's right there. But sir, I need I need to get back to my kids. They're probably really crying. And And come on over here with me. Come on over here with me. 56. No. Yeah. Officer, I need to get back to my kids. Okay. Listen, we're going to get you over there, but this is an accident investigation. Yeah, well, I'm not part of it. Okay. Well, we're going to figure that out. from over there and we're going to figure that out and we're going to figure out what happened. Okay. Okay. But I I got to get to my kids and that's understandable. But I need to figure out what's happening and kind of go from there. Well, it wasn't me that was over here. I was with my kids over there. Okay. And that's fine. And I heard you and you've said that numerous times. Please. My baby, she's only seven months old. She's probably really crying. Okay. Then is there any other adults inside? No, just my 11year-old. Okay. Come on. Here. Come on over here and grab a seat. No, I don't want to get a seat. Okay. What's your first name? Oh, you want to know my first name now? Why are you angry? Because my kids are by themselves over there. Okay. What is your first name? You're not going to tell me your first name? Okay. Follow me back over there. Come on, please. Officer, Robert, do you understand why you're in handcuffs? Because you're uncooperative. No. And that's why you're in handcuffs. No, I wasn't even a part of this right here. Okay, officer. Okay. I was not part of this, but yet I live over there. Okay. So, we're going to figure out what's happening. And until we figure out what's happening, you're going to stay with me. And you're not going to go anywhere. You're just going to stay with me. Go with me. My babies, please. No. Yes. My babies are probably crying. They probably are. Yeah. But I don't want to do this to them. And you left them. You chose to come over here? Yeah. To take my husband over here. Okay. Oh, come on, officer. Please. He was the one in the accident, not me. That's my car right there. So, we're going to figure this out. Why are you pulling away from me? I'm not pulling away from me. You think that you're in a position to fight me? No. I am a grown man. Whatever. And I outweigh you by almost twice your weight and you're handcuffed. Do not decide to make poor decisions and fight with me. I'm asking you to cooperate with me for my babies. Okay, we're going to figure out what's going on. Well, let's go there and figure this out. No, figure it out right here. And what number did you say that you were in? Hold on to her, please. Don't let go of her. She's going to try to get away. [Music] Li A driver. Sergeant, thank you. No problem. I apologize. I get kind of excited sometimes. No worries. Okay. Did you witness the accident? I didn't. I just put the driver under uh basically citizens before she tried to take off again. And so that was a woman. Yeah. So where were you when this happened? I was home. I live I live right down the road. I live on their property. Uh she's my the driver of this van is my cousin. Okay. I got I was the only other means to get here. There was another guy that was over here for a while. I've seen it happen. He was in the parking lot over here. I think he left already. He was parked over here. But um and so how do you know that she was the driver? She came walking up basically, what happened to my car? What happened to my car? And then she goes, "I was just pulling out over here and this [ __ ] [ __ ] cut me off." Like I So you admit to me that you were driving. She uph. I'm shutting off. Okay. And then and then where was the guy and who had the guy? He he was with the guy. So I came down with him. This is my wife. And we came down together. And the guy was getting out of the passenger seat when we showed up. And then he tried walking over here. So I walked over there with him. He he told me that she had ran off that way. She took off. The driver was driving the female. He said she took off that way. So I walked over here with him and he acted like he was going to the bathroom and then he tried taking off stealing him or bringing him back over here. Okay. Um have you spoken with officer Estrada? Negative. Or no sir. Okay. Um, I'll get you to talk with Officer Agrim real quick and he'll get all your information and then an additional quick statement and then we'll get you guys out of here. Is this thing drivable? Yeah, I think it's driving. Okay. [Music] Do any of these kids need medical attention? Uh, not that I'm aware of. I believe. Or are all the kids okay? You need any medical? They seem like they're all right. Okay. They were all buckled up. So, it looks like that telephone pole got the brunt of the hit. Yeah. Yeah. Okay. Give us a couple minutes, please. Right behind you. Mhm. preemptive strike. This this pole wasn't placed too long ago. Fresh. I think I think these got hit. Huh? I think got hit, right? You know, and but I wonder how worried we are about this pole. Well, that and what purpose? It's still p serving and why they that holds that pole. Right. Right. And it just got we just got that stupid cable wire going across. But I think for I assume you seen all the bottles in there. I haven't even looked yet, sir. Okay. floorboard of the passenger or driver. How's it going? Uh, there you go. Look at you. Okay. Um, and let Estrada do this inventory with you. [Music] Uh, okay. Have you started on the toe? Yes, I just need the inventory. Okay. 306. What apartment are you in? Last name. 3101. 3101. Thank you. Are you taking this 47 investigation? Yeah. Okay. I'm doing the crash. Okay. So, here's the keys to the car. There's open containers. Do you want Hensley to go in there and do this inventory with those or would you like to see those? I'll do it. Okay. Cuz I have where he was. Okay. Yes, sir. Hey, I'm out on this crash. Can you dispatch medics to 3101 apartment number reference for children need to be checked on complaining of injury? I'll take care of it. Don't worry. And so were they inside yet? One of them is bleeding toward the face. The other one complaining of injury. Okay, I got it. Yeah. Would it be easier if he was just detained in the back of a car for a couple minutes? I I don't know. I don't know what we're doing. Um I'm thinking that here possibly. Um, open container in vehicle or some sort of possession charge. How many kids are inside? Uh, there's five. Five kids. Yeah. How many kids were in the vehicle? All of them. All of them were in the vehicle. Okay. Um, this is Officer Algram. We're going to stand you up. We're going to get you padded down and put you in the back of a cop car for a minute, okay? Until we can figure out what's going on. You got any weapons or anything like that on you? No. I think I have a shoot in my pocket though. Which pocket? The uh back left side. Wallet. And where were you seated when the crash took place? Passenger side. Passenger side. Yeah. Front, rear, front. Front passenger. Okay. Yeah. I'm on permission, so I don't want to drive. You're on probation? Yeah. Okay. Um just I saw these in here. I'm just removing them to see. Oh, that's um ashes from um traditional Nahu me. I got you. And uh that's just um that's and I and I understand what that is. So I'll just I'll leave that with you. You want to see it? Yes. No. No. No. I I I understand. I I got you. So we'll leave with you. We got a car right over here. We're just going to sit you in the back. Um 4 6 4 613. Medic not to go to the crash. It's going to be the most north and east. Is your unit unlocked? Okay. And go unlock your unit and I'll stay with her for just a minute. Thank you. Would you like to sit down for a minute? No. Okay. I want to see my kids. Can I see my kids? No. Why? Cuz your kids are injured. My kids are not injured. Okay. How many kids were in the car? There was no kids in the car. My husband No, I'm not lying. My husband called me and said he was in a car accident over here. Mhm. I am honest. Sir Burns. Officer Burns. I am. I wasn't in the car. Okay. I don't believe you. Why? Well, that's your judgment, not mine. That's right. Yeah. Well, you don't need to judge like that. Okay? Because my kids need me. They probably do. They need me. Officer Burns, don't take me. Don't take me away from them, please. So, stay with Officer Young. And my suggestion is that you stand over there away from this curb. Okay. Okay. So, do that now. Somebody's up there with 3101. Um, three or four kids. I think the youngest is 7 months old and then one of the children is bleeding. Other than that, I I don't know, sir. Um, Detective Bla is over there with the kids. The trespass was issued on 12212. It's good for 12 months. He's speaking with one of the witnesses. He's doing the tow. Um, take pictures of the telephone pole and all the damage. Um, and then forward that to Estrada. There should be that little barcode stamp tag on the deals. CDC. Thank you. pretty much. You want to know what I saw when I pulled up? The husband was over there with one of the other guys and they were pulling him back and then she was over here kind of approaching this way. She handed me the keys. She's been denying all the time that she was in the crash and she's saying that she was in the apartment. Um, and ran out here when the husband said that he was in the crash. Um, and I talked with him for just a second before we put him in the back of the cop car. He was like, "No, I was in the front passenger. He's on probation for something." So, okay. So, I'm waiting to see if there's open containers in that front passenger seat, then he'll go. And so, he had a bottle in his pocket. Okay. So, he's going um just ported out and then in the area. He said he was on probation for something. So, I don't know if they ran him or not. Okay. Did I yet? Uh she refused to give me your name and I just stopped asking. Okay. So, that that's helpful for cold. That's cold damage. Well, and so not all that damage was caused by that minivan on the car. And that wasn't all caused from that minivan. And that minivan wasn't that beat up. I mean, I I took pictures of the way. Well, it might have crumpled just right because [Music] and and even this telephone pole and or this box and [ __ ] I took pictures either way. I don't I don't I don't care either way. I'm just let I don't either. I don't think that's from Okay. I mean, just a quick look, but if you look at it, everything's going and you're my guy. And so if if that's what you're saying, then that's fine. If if you're saying it's all from the minivan, that's fine. It was a ways out. Yes. No. And they got out of here pretty quickly. Um but they pulled a car seat out of this back seat. 100 milesPH. Pensley, what do you need, sir? Um, nothing else. We couldn't get the driver's name. Is that correct? Uh, we're going to have that before we leave here pretty quick. I'm just sitting there blocking them. Okay. Thank you. [Music] Um, I don't know if you want to pull your car around. I don't know if it'll make a difference. Um, start to think about how this guy is going to drag this thing. We might need to block um this road. um when he pulls it up onto his flatbed. So, we'll have to evaluate that and think about what we're going to do there. So, if we do need to block it for a minute, um we might just go down to that intersection and block it there and then block it at that first one, whatever that one is, and kind of take it from there. I wasn't driving that car over there. God. How are you, sir? Good seeing you. Good. Did you see any of what happened? No. I uh heard was like a little thump. I was in I live in the next building over and next I know I saw the light. It's like wonder what's going on. Next thing I know I I'm getting ready to leave or my brother's getting ready to leave. I saw the smoke. She was like, "No, that's what's going on." So, I came over and check on her, thinking that she might have tried crossing the street, but she was laying down. Did you hear anything? Heard a thump, but that was all I heard. Okay. All right. Thank you, sir. Oh, no problem. If you want to go see what playa needs in 3101, please. Thank you. Yeah, please. He said 3101. Mike. Yeah. Yeah. He's going to go. They're checking right now. They got medics going up to make sure they're okay. Okay. 607. Wait, what? Yes, sir. Okay. Okay. And then the youngest is seven months. Okay. Um, is a 12-year-old a smart 12-year-old? Is he confirming? Well, potentially we can. Um, I need to confirm what the probation item is on this. Um he he had a he's got a little open bottle of booze in his pocket. Um but we can sight him for that and then kind of handle it other ways if need be so we're not babysitting all shift. Yep. Yep. Okay. Okay. I have Young walking over to you right now. Cool. Thank you, sir. Bye. one through 25 4304 4304 Did the male half get run on this incident out here. I don't believe so. Okay, I'll get working on that. Thank you. You're welcome. Burns to young. if you could uh bring me a set of keys for your unit, please. Miss will continue to refuse. We're going to have no trouble. They put you in the seat and then also charge you. I'm not taking the handcuffs off you because you're under arrest. Why? Why? Why? Why am I under arrest? What the heck? I'm not under people. I need it unlocked so that I can talk with that guy. Did you get me a breathalyzer test? No, you didn't. I'm about to ask you if I can. Oh, yeah. You can because I'm not drinking. It's unlocked. He's going to he's going to read all that to you and explain all that to you in just a second. Yeah. Okay. Did you look at those open containers? Not yet. Would you like to do that or and maybe let her calm down for a minute? You're doing a fine job. Hey, I'm trying. It's a mess. Sir, I'm Sergeant Burns, Farmington PD. What's your first name? Just go ahead and stay in here. We're not done yet. M I K. M I K. O N US O N U S Roberts. Roberts. Yeah. And then your date of birth, Mexico, Arizona. Okay. Do you have a driver's license in Arizona? You have one on you. Perfect. My wife, huh? He's angry. She's probably been angry before though, right? Yeah. But I don't get why she's huh pissed off now. You what now? I don't get why she's that mad now. Well, she's intoxicated, right? Yeah. Okay. She gets emotional when she's intoxicated. Yeah. Okay. She don't drink a lot anyway. She And then it's been so long since Yep. Um Yeah. So, let me see what's going on. What are you on probation for? Oh, DWI. DWI. And what in May? And what are the stipulations? What do you mean? And what was the directive? And what do they tell you? Like normally when you get arrested for DWI, they tell you no booze, no bars, no negative contact. Yeah. No booze. Uh do counseling, DD class. Um Okay. Here. And just so there's no no misunderstandings because you're not free to leave. You are actually being detained. I want to read you your rights. Okay. Listen to me. You're not in handcuffs, right? No. Okay. But you are in a cop car and I'm not letting you go because this is a police investigation. But you're not in handcuffs right now. Okay. So, you do have the right to remain silent. Anything you say can will be used against you in a court of law. You have the right to an attorney. If you can honor for an attorney, one will be appointed to represent you free of charge. If at any point in time during questioning, you choose to stop answering questions and request your attorney, you can do that. Okay. So, we're just trying to figure out what's going on. You got four kids inside. Yes. Okay. And the last thing I want to do and that and that's the problem. Okay. So, I want to work with you. I I want to figure out what's going on and take it from there and be a man and have you inside taking care of your kids. I really like that. Okay. So, give me a couple minutes and let me figure out what's going on. Okay. Okay. 4304. 29 locals out of Arizona. First I spell Mary Ida King Ocean Nora Union Sam last of Roberts 1847. All right. The car uh he said he's okay. He's just waiting with the kiddos until uh the dad gets released. Who's he? Uh, Officer Blazer. Okay. Detective Player. Detective Blazer. Okay. Um, see what Hensley needs for traffic enforcement. Um, put a vest on so you don't get hit. just for future knowledge. Um, whenever you have some, just roll down your window like six or eight inches, um, and then go. You know what I mean? Just in case we need to talk to him or something needs to happen. Thank you. Go ahead. Showing a magistrate probation item for your subject for DWI. No negative contact with law enforcement. No boos, no bars. Not to consume cannabis, cannabis products or synthetic cannabonoids without certifications from the licensed medical practitioner. Ignition interlock. No arrest without new warrant or new charges. file an affidavit -2927 out of Arizona is valid expiring in 2055 direct. Thank you. Um hang on to that for 457 please. He'll probably want that return as well here in a little bit or just put it in a stack of paperwork. Um there's four kids inside. Um so he's on magistrate probation for that DWI and stuff. He had that open container. As far as I'm concerned is we can cite him for that open container if we want to. It's a female laying in the parking lot and then do an affidavit for that so that he can stay with the little jacket if you want to. Um I don't sober is he? He's he's intoxicated. He's not a 3. Um I had a conversation with him about work, his kids. He probably shouldn't be driving, but I think he can He's just fine. Take care of kids. Yeah. Okay. Yep. He has his ID. Um, I just gave it back to him. I sent you a picture of it. Okay. So, is he just in a car? Yes, sir. I'll just kick him a site real quick. And and then he confirmed as well that she was driving. Um, and I don't even care about the site. I care more about the the probation violation and to make sure we do an affidavit on that. Um, so at least there's record in magistrate that he's violating his conditions. Yeah, please. It's a roadb block. They're not coming through here. Um, is that vehicle gone? He's got to clean up as soon as this roadway is clear. Let us know and we'll get out of this roadway. [Music] Just a second. Did you need something? You see you kids. Well, I can't really facilitate that right [Music] now. Give me just a minute. Okay. Huh? 648. Okay. That was Yes, sir. Yep. Is that hers? Yes. Can't go through it. That's a hard habit. Right. And the jail will will look through that. [Music] Thank you. Um and let's get these units out of the way. Um, do you have a deal with what you're gonna do with him? Yeah. I'm just gonna read her. Yep. Okay. And then get her move. I'll shoot you from the side once I'm done with it. Yes, sir. Um, so let's just park it right over here for now. Are you 98? I'm 98. Okay. Thank you, sir. 4 4304 4304 roadway is opened up. Um, whenever you get a street sweeper in the area, have them respond, please, and clean up some of this dirt. 332. 332. [Music] 51 4305 1075 305 4305 contact public service is a 2015 purple Kia Optima was taken sometime within the last week. It has a tracker on it. He can see somewhere at 235 Grounding Parkway, but when he drives over there, he can't see the vehicle. You can show me 1062. You okay? Okay. What are we missing here? Um, street sweeper is going to come come up. Um, take pictures of the pole. Algrim got that. Um, Estrada is going to take the crash in the 47. We'll probably sight him. He had an open container in his pocket. Um, so we'll probably sight him and then he's on magistrate probation for DWI. No booze, no bars, no negative contact. Um, we'll see if he's willing to do a PBT. Algram, did I see that you add a PBT? Do you want to see if he'll submit so that Estrada can put that into his um probation affidavit when he writes that up? So, he'll give him a PBT and see if he submits and they're voluntary. Um, and if he denies it, then it's it goes one way or the other. Um, and then he'll be released with the kids. We have all the kids' names and dates of birth and schools and stuff like that. Detective Blair gave that information to me and I gave that to you. Okay. How did the house look? Cluttered. But and like a family of four. Um like a family of four live there. Oh, talk to Sanchez. Do we need to be having this conversation now? If it's okay, it's okay. Yeah, we're we're good to go on Wednesday for you guys again. Okay. You said we're good to go. So, we're going to we're going to be going forward with the the Oh, really? Okay. They don't have the w the witness isn't there or the victim's not there, but he said you don't eat the fish. Okay. 292. He's a lifelong drinker if he's acting like that. Is this a prelimin? Okay. Uhuh. 1856. So, he just had a PBT and that was a 292. What do you want to do with him with them kids? Well, and that's my initial concern. And I mean, he's three times over the legal limit. Um, and putting him with a seven-month-old. I don't like that. Do you have any family in town? Uh, no. They're like 2 hours away. Do you know what the legal limit is to drive? I wasn't driving. I know. I Oh, I know. I'm And that's not not what I'm saying by any means. And so it's 008. Yeah. Okay. So twice that.16 three times that 24. You're at a 292. So that's over three times almost four times the legal limit. And my concern, Mr. Roberts is you with four children and a seven-month-old and your ability to care for that seven-month-old. That's my concern. I'm okay. Yes. Well, I know you're okay because you're walking and talking and I feel like you drink every day and you drink a lot every day, but that's none of my business and I don't care. But what I know right now is that we just did a portable breath sample. Um, and it has ups and downs and it's probably not 100% right, but I bet it's pretty damn close. Um, and it just said that you're three times almost four times the legal limit. So, my concern is these four children and what to do with these four children and who to care for these four children. I can do it in the you guys can stay with me as well. Well, sir, that's not my job to stay with you all night long and babysit your child. Okay. So, I want to be there and and so I I want you to go with your kids and but I want someone sober to come and be with your kids also and stay with you. Do you have a phone? Uh, my phone was in the car. Okay. Do you have anyone that we can call to come and stay with you and your kids until you can sober up a little bit? Um, and that's my concern. I can call somebody, but we won't be here for like another hour or so. Okay. 2 hours. So, who are you going to call and where is their phone number? Uh you can try um only I can find the phone numbers and and and your phones and your phone is in your house. There's one in the car. There's one in the house. I can find the phone numbers in there. Yeah. Okay. Huh. You can follow me in the house. No, no, I will. I will. Give me a minute. Okay. Do you have a mun site for him? Okay. Um, let's pull him out. We'll have him sign that mun site. Is he going to get somebody come? Um, we're working on it. She agreed to blow. Okay. So, um, and and the female is going to be arrested for DWI. And then I think that the dad is kind of a, um, career alcoholic. He just blow a 292 on a PBT. And so my question is these children and his ability to care for these children. Well, and I'm working and and I'm working that angle, but everyone is at least an hour out. Um, and all of his phone numbers are in the house.
