Frank boyadium. >> You could just hang out in the car until you get that valley home and family medicine. >> Yep. >> Hello. >> Hello. Officer Carpenter, Pullman Police. So, I'm stopping you because you did not stop at the stop sign coming off Monroe on the stadium. That was a roll. All right. Can I see your driver's license, registration, insurance, please? >> So, 100% don't have my wallet on me. I was just dropping friends off really quick. Um, I have my registration, but you could look up my license. >> Do you want to grab your registration for me, please? This should be deeper. identification. Um, do you know where the ex is there like a expiration on here? >> Oh, okay. This should be the crown. >> All right. And do you have your current insurance as well? >> Yeah. I just want to make sure I'm giving you the right three in here. What's your last name? It's Sarahi. S E R R H I N I. >> All right. And your first name? >> Somewhere? >> S or sorry, Kareema. K A R I M A. >> Okay. And what's your middle name? >> Hassania. H A S S A N I A. And your date of birth? 1029 2003. And what state is your driver's license through? >> Washington. >> And what's your address here in Pullman? >> In Pullman, it's 615 Northeast Campus Street. >> All right. And a good phone number for you? >> 2064 0135. >> All right. And how much have you had to drink tonight? >> I Okay. Would you step out of the vehicle for me, please? We can just come on the sidewalk right up here. You blow my finger, please. Go hard. So, I'm getting an odor of alcohol. So, how much have you really had to drink tonight? I've drank prior in the night, but not anytime recently. >> Okay. When do you think you had your last drink about? >> Probably within two plus hours ago. >> Okay. >> Yeah. >> Would you be willing to take some voluntary field sobriety tests? >> Yeah. >> Okay, let's do that. Actually, right here is probably the flattest that we're going to get. >> Okay. >> Would you turn my lights down one more notch? Thank you. Turn that down so it's not quite so bright. Yeah. >> All right. Pullman 458 testing. Okay, let's just scoot this way a little bit just so it's a little flatter here. Okay. Any drugs at all today? Prescription medications? Anything like that? Okay. Do you wear contacts? >> No, ma'am. >> Okay. Have you ever had a traumatic brain injury? >> Been diagnosed with a concussion? >> Concussion. >> Okay. Can you hold that for me, please? Okay. So, while I'm walking you through these, I am evaluating you both on your ability to follow my instructions and on your performance on the tests. So, I'm not trying to trick you. If you have questions, if you want to see something again, please just let me know and I'm happy to demonstrate it or answer your questions. Okay? All right. So, for the first test, I'll have you stand with your feet together, arms down by your sides for me. Thank you. All right. And I'm going to have you look at the tip of my pen here and follow the tip of my pen with your eyes and only your eyes. Okay? They don't move your head at all. All right. Tilt your chin down just a little bit for me, please. All right. I always hate that part cuz I'm short. Okay. So, for this next test, I'm going to put you into a starting position. I'll tell you when you're there, and then I'll have you stay in that starting position while I explain the rest of the test. Okay. H. >> Sure. Let's get this way a little bit. All right. So, I want you to imagine a straight line coming out from in front of your left foot. Okay. And can you put your foot on that line for me? And then your right foot in front of your left foot touching heel to toe. >> Do you want me to? >> Yes, please. Okay. Nope. I'm just going to put you into that starting position and then I'll explain the rest of it. >> Okay. >> All right. Right. So again, straight line coming out from the front of your left foot. Right foot in front of your left foot touching heel to toe. All right. And put your hands down by your sides for me, please. All right. So stay in that position until I begin. Okay. So when I tell you to begin, you're going to take nine heel to toe steps down that imaginary line. When you reach step number nine, you'll leave your lead foot planted and take a series of small steps around your lead foot with your back foot and take nine heel to toe steps returning back down that line. I'm going to demonstrate that for you in just a second. So, your first step will be step number one. This is a continuous test. So, once you begin, complete the entire test as I instructed. Okay. Make sure you're looking down at your feet and leave your hands by your sides. Okay. All right. I'm demonstrate that for you. All right. So, your first step will be step number one, two, three. Leave that lead foot planted. Take a series of small steps around that lead foot with your back foot. [snorts] And then one, two, three. I did three for demonstration purposes. You're going to do nine. Do you have any questions? >> No. >> Would you like to see that again? >> No, you're fine. >> Okay. >> Can you get back into that position for me? >> Perfect. Okay, you can go ahead and begin. [snorts] >> Just turn around it. >> Just do the whole thing as I instruct. >> Okay. Okay. So, I'm going to demonstrate this one while I explain it. All right. So, when I tell you to begin, actually, I'll have you stand with your feet together, arms down by your sides again for me, please. Thank you. Okay. When I tell you to begin, you're going to lift one of your feet either or you pick at least six inches off the ground. You're going to lock your knees so your legs are straight and your foot is parallel to the ground. And you're going to look down at your raised foot. Obviously, I'm not going to do that for safety reasons, but you'll look at your raised foot. Leave your arms by your sides. >> While looking at your raised foot, they'll count out loud. 1 10 1 2 1 100 3 and so on until I tell you to stop. Okay. >> Okay. >> All right. Give me just a second. Okay. Maybe. Perfect. All right. You can go ahead and begin. >> 1002 100345 [snorts] 1006 1007 1008 1009 100 179 2023 125262728 >> All right, you can stop. >> Okay, so the last one's just a voluntary breath sample. Doesn't replace the value of any test I might ask you to take in the future. You said you had your last drink about 2 hours ago. Have you had anything to eat since then? Okay. All right. Have you ever taken one of these before? So, you're going to wrap your lips around the tube kind of like a straw and blow into it steady kind of as hard as you can for as long as you can until you hear it beep when she folds it out of your mouth there. >> Nope. It's totally voluntary. It just gives me the best estimate of where you're actually at cuz you said you drank 2 hours ago >> and so this is the best estimate that we get of that. you're willing to go ahead and take a deep breath and go. >> Um, so what happens if I refuse a propizer? Is there any? >> So, it's totally voluntary, but right now get given how cold it is. I'm trying to determine if you're doing poorly on some aspects of the the test because of the weather or it's because of the alcohol. And this is the only thing that's not affected by the alcohol >> or not affected by the weather, I'm sorry. And it's solely by any alcohol that you've consumed. So, that's why I was I was asking. That one is loud. >> Yeah. >> Yep. But ultimately, it's up to you. >> I understand that, but also, I mean, I would hope that you would not think that I was intoxicated. >> Well, your eyes looked like you were potentially intoxicated and then yet you missed some steps on the walk and turn. And so, I'd like to see how much of that is the weather and how much of that is what you had to drink. I understand that. So, yes or no? >> I guess what are my options? >> You can take the breathalyzer or you can not take the breathalyzer. But as of right now, I think you're impaired by something. >> Okay? >> You know, whether that's alcohol or contributed to by drugs like marijuana or something else like that. But right now, I I think you're potentially impaired. So, you can either do the PBT and that gives me the best estimate of where you're actually at and if you're being honest with me, or I have to make my decision about whether or not you go to jail for DUI solely based off of what I've already seen. >> Okay. >> At this point, I think >> just have to make a decision. I'm going. Okay. All right. Maybe [bell] it's doing its internal test. So, it's showing all zeros right now. All right. So, big deep breath in here. See, it says blow. So, big deep breath in. Big deep breath in. All right. And blow out as hard as you can. Blow harder. Blow harder. Blow harder. Blow harder. Blow harder. Blow harder. Blow harder. Keep going. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Perfect. All right. And you can watch it with me. It doesn't Oh, it doesn't go up. It just Yeah. You said you were just picking up a friend, >> correct? >> Where's she supposed to be going? [snorts] >> I'm just taking the front literally just down the street just to the All right. So, 136. So, that's a lot more than two drinks. >> All right. You said you had a couple of drinks about two hours ago. Correct. >> All right. But a 136 is a lot more than that. So, you are under arrest for DUI. Go ahead and turn around. Put your hands behind your back for me, please. >> Just relax your arms. >> Relax your arms. I'm just going to pull this sweater off of your wrist here. >> Audio and video recorded. The time is 024 hours and it is January 25th. Let's move away here real quick. Let's go this way. >> Thank you. All right, let's do that. >> I am going to read your constitutional rights. You have the right to remain silent. Anything you say can be used against you in a court of law. You [snorts] have the right at this time to talk to a lawyer and have him present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before questioning if you wish. You can decide at any time to exercise these rights and not answer any questions or make any statements. Do you understand the rights that I've read you? >> Can you tell me yes or no? I don't. >> Okay. Um, we have to move your car. Um, or have it towed. If you give me permission, I'm happy to drive your car into the parking lot and park it. >> What would you like? >> What about my roommate and my farm? How are they going to get >> Well, um, where's home for them? >> Okay, I will talk to them about that. So, do do I have permission or do I need to tow your car? >> Please. >> Okay. So, I have permission to drive your car. >> Okay. >> Is there anything you want out of your car? Your phone or your wallet or your keys? >> Please. >> Where is it? In the car. >> Should be plugged in. My friend should be able to grab it. Should be just in the front. >> Okay. So, phone. >> Okay. >> And I assume you want your car keys. >> Well, she'll be driving. >> Yeah, I'll bring those. >> Yeah. >> Somebody asked us to lock him in his car the other day is why I asked. So, all right. We're going to go to this first car here on the passenger side. Okay. Do you have anything sharp in your pockets? Anything that's going to poke, stick, or cut me? Okay. Here. Take a step back away from that curb. I don't want you to fall. Go ahead and widen your stance for me, please. Widen your stance a little [snorts] bit further, please. Thank you. Go ahead and search. Can you widen your stance for my body camera? >> I've got mine on. >> Okay, cool. All right. Back of the hand. Okay, switch sides. There you go. >> There we go. It's been a while. Let's see that side. I'm going to get this unlocked. Look at that. >> All right. So, you are being audio and video recorded in the vehicle as well. Okay. Go ahead and have a seat. >> I'm going to be taken and for how long I'm going to be there. >> I'm sorry. What was that? >> Can I ask where I'll be taken in for how long I'll be there? >> Yeah. So, I'll explain the whole process on the way. >> Okay. Just feed in there for me, please. Like I said, I'm not going to keep anything. I'm not tricking you. There's no mystery. I'll tell you exactly where we're going in just a second. Have you ever been arrested for DUI before? >> Okay. Thank you. >> Question. >> Yeah. How does it work when it comes to like getting her out or like how does that work? >> So, it depends on if she's been arrested for DUI before or not. If she hasn't, then we will release her from our holding facility, which is downtown Pullman, within 6 hours. >> Um, typically on a night like tonight, it takes about 6 hours to get through all the paperwork with other calls and stuff, but she'll be released without bail. Um, and she'll have her phone so she can make a call to somebody to come pick her up. Okay. Okay. So, we're going to the Pullman Police Department holding facility. Okay. And if you're being honest with me that you've never been arrested for negative. If you've never been arrested for DUI before, then you'll be released from our holding facility within six hours, okay? With no bail. All right? And you'll have your phone. So once you get released, you can call a friend to come pick you up. 458 name Go ahead and widen your seat. Okay. So, um the driver has been arrested for DUI and she's given me permission to move the vehicle. Um for me to move the vehicle, I need you guys to get out and then I'm happy to work with you guys to see how we can get you home safe. >> Yeah, that sounds good. >> Okay. So, if you with you guys being out of the car, I just ask that you stay over here. And did you need anything else out of the car? Okay. >> She I'll grab it for her. >> Yes. Could you would you put it I don't know how it moves like when it comes to movement. >> Well, so my plan was to put it in this parking lot right here. >> Could you put it in Willow's place cuz I know somebody that lives there. >> Um >> is that okay? >> It to Saturday. >> Okay. >> Um and I have to move it pretty close cuz I can't go wandering off. >> No, I'm saying like right here at Willow's place. >> Yeah, I understand. But um just because you know somebody that lives there doesn't mean it's not going to get towed. Okay. What? 5847. Was there anything in addition to the phone? coming. Thank you. Yes. >> Does she get her keys? >> No. Um the keys will go with her. >> Okay. For sure. >> So, um now are you guys able to get a ride home or what's the the plan? >> Um >> not guaranteed. >> Where's home for you? >> Different places. >> Yeah. >> Okay. Where's the different places though? I live back on campus. >> Where? >> Um back on campus around Greek Row. >> Where on Greek Row? >> Um like right across the street from G5 this morning. >> And where do you live? >> Okay. Okay. So I if you guys want I can give you a ride. >> Thank you. So, since we're pointed towards Timberline, I'll take you home first. Okay. >> And then I'll take you. Is it um 1920 or 1405? >> 14. >> Okay. >> All right. You guys don't have any weapons or anything like that? >> No. >> Okay. >> Are we both in the back seat? >> Yeah, cuz the front seat is my >> office. >> Um, >> that's fine. I'm just >> um It doesn't go all the Well, it does go all the way through, but there's >> seat belt first. That's fine. >> So, just be careful. >> Okay. Do we need to put them on or we >> Yeah, they're just opposite. So like you you're going to put yours on like you're in the passenger seat and you're going to put yours on like you're in the driver's seat. >> Why buckle at the bottom or not? >> So they're already buckled, right? >> Uh just put them on. >> So they Oh, they >> Okay. Thank you. >> You're welcome. Pullman 447. I'm going to be providing a courtesy transport for two subjects, two places. Beginning mileage 4589.0 and we'll be in route to 1405 Northeast Mormon. Pullman 47 out. Any mileage? Good. 4 5 0 8 97. >> No, it's warmed up a little. It's now 13°. >> I can certainly feel it outside. Pullman 458 arrived. Ending mileage 80.8. Will you grab her? Will you hold on to these, please? Thank you. Oh, and that. Thank you. Watch your hair here. Get your All right, you can go ahead and step out. [snorts] Watch out for the door here. Okay, we're going to walk this way towards this door. [snorts] Perfect. Here and towards the wall on the right so that the door doesn't whack you. Towards the wall on the right. This way. Towards the wall. There we go. All right. And right through here. How much time you got left? >> Uh, I'm have to restart my observation period. She just >> Okay. >> You care if we kind of set in. >> No, you're good. Do what you got to do. >> All right. Have a seat in that brown chair for me, please, Karma. Thank you. >> All right. Uh, if you want to grab a tote and put it in there. [laughter] >> Karima, sit down. Karima, sit down, please. I can't breathe. [laughter] Try to take some deep breaths. [crying] Can we please get into it? >> Sure. There you go. Right here. Tissues. There you go. Here. I'll help you out. [laughter] I can't breathe. Karina, >> try to try to slow your breathing down. [snorts] I don't know. Can I please [snorts] >> The sooner we get through this stuff, the sooner you get out of handcuffs. So embarrassing. [laughter] >> Well, Karema, the sooner [snorts] we get through this, the sooner you get out of handcuffs. >> What do you need me to do? Just >> we just got to go through the paperwork. Please, just tell me. Ask me whatever you want. Okay. [snorts] So, the first thing I need to do is take a look in your mouth. Okay. Open your mouth. Okay. [snorts] Lift up your tongue for me. Okay. Tilt your chin down. Thank you. Any foreign substances or anything like that in your mouth? >> All right. All right. So now I need you to make sure you're not bringing anything up to your mouth, okay? Or putting your hands near your mouth. That's why you have to stay in handcuffs for that part of the process. So now I have to read you a lot of things. Okay, some of that I've already read you before, but we're going to read it again. First is just your rights. You have the right to remain silent. You have the right at this time to an attorney. Anything you say can and will be used against you in a court of law. If you are under the age of 18, anything you say can be used against you in a juvenile court prosecution for a juvenile offense and can also be used against you in an adult court criminal prosecution if the juvenile court decides that you are to be tried as an adult. You have the right to talk to an attorney before answering any questions. You have the right to have an attorney present during the questioning. If you cannot afford an attorney, one will be appointed for you without cost if you so desire. You can exercise these rights at any time. Do you understand these rights? I need a verbal yes or no, please. [snorts] I have read or have had read to me the above explanation of my constitutional rights, and I understand these rights. I understand my constitutional rights. I have decided not to exercise these rights at this time. Any statements made by me are made freely, voluntarily, and without threats or promises of any kind. >> If I have the right to an attorney, then wouldn't I have the right to one now? >> If you want one, yes. >> Yes. >> Okay. We'll wait till she's done in there with her attorney and then we'll get you on the line with one. Okay. Unless >> get the number. >> Yeah. >> Okay. >> Walk in and get the number. [clears throat] >> She's talking right now. >> Okay. Is Sandy the first one on call? I can't. >> Well, we'll call the first or second one on call and then I just need to get a number. Wait, can you can you say that again? Sorry. >> [snorts] >> All right. So, how do we do this? Let's see if he answers. If he answers, I'll put you in one of the cells with him so that I can't hear your conversation. Hello, this is connect. >> Hi, this is Officer Carpenter with Pullman PD. I am here with >> Kamari. She was just arrested for Kareema, I'm sorry. Uh Karma and she was just arrested for DUI and wanted to speak to an attorney. >> Absolutely. Yep. I'd be happy to speak with her. >> Okay, let me So, we have somebody in the interview room. So, I'm going to put her in actually one of our holding cells so that I can't hear the conversation. >> Sure, that'd be great. Thank you. >> Yeah. Okay, Karima, this way, please. All right. So, I'm going to leave this in here. Okay. Just knock on the door when you're done or pop your head in the door. Okay. Problem solving. >> Yeah. >> Shocked. I'm going to assume you. >> No. Then she was hesitant about the PBT and I was like, "That's fine, but it's 12° outside and right now I'm telling you you're impaired, so you can do the PBT or not. But the only way I know if it's a cold or if it's you is this this machine should go 136. >> Yeah, >> I think she might be. I'm really bad at math is the thing. >> Where did I even put my thing with her name on it? I said it somewhere. Oh, it's right here. born in 03. >> I think she thought her little stunt was going to get her further than it did. >> Jokes's on you. I have teenage daughters. [snorts] It is gone. [snorts] >> Jordan didn't want his own DUI. >> Take all the drugs. >> Ah, >> well, he will, but I think it was so close to three. >> Don't you all get off at three? I like >> Yeah. Take it now while you're young and don't get woken up at the crack of dawn by small humans. >> Exactly. Yes. >> Oh, it's >> [snorts] >> Oh, >> so you have to be good cop >> pretty much. Yeah. Get >> [snorts] [snorts] >> out of his spot. Show me you can get out of the other ones. So, got to do these ones. >> Will you just kind of keep a line of sight on her? Make sure she doesn't start doing nothing crazy. Not you. Have a seat. So, the time you're in the room, did you put anything in your mouth at all? >> Side the other side. >> You say you don't shoot back or anything like that. Filthy habit your constitutional rights again. Constitutional rights. You have the right to remain silent. You have the right to attorney. Anything you say against adult decided as an adult attorney before answering any questions attorney attorney for you without cost if you so desire you can exercise these rights at any time. Do you understand these rights? >> I have to me explain my constitutional rights. decided not to exercise at this time of >> I understand my constitutional rights and decided not to exercise these rights at this time by me freely voluntarily without any You still understand your rights? >> So read over these again boxes. Check the top. for one RW4612 or RW4614 driving you as a test of your breath which consists of two separate samples of your breath taken independently Determine alcohol concentration. [snorts] [applause] Licastriving for at least 90 days to 21. indicates the alcohol concentration under breath is 0.08 Earlier in violation of R61502 influence 4614 physical control [snorts] for under the age of 10 to 21. The test indicates the alcohol driver qualified person not driving commercial at the time suspended or removed your commercial driver at the time [snorts] this test or submit to this The test indicates alcohol concentration of you will be disqualified by the department from driving commercial vehicle. I have two station the time that I second 15 minutes machine got to do it and then go through the test. Um, same thing for this breath test that we did for PBT in the field. Take a big deep breath, bring your lips on the straw, and then you'll blow out into the tube for about instead of 3 to 5 seconds, it's like 8 to 10 seconds. So, they'll blow up out immediately, but you got to blow enough And what is the address for? >> Uh 059 C August. So the address I'm putting up here is that you want it set to >> I don't No, I don't want >> 15 Main Street. Number sign 30, I think. O R O I L Washington out of three universities in the four >> just because it has a small university. So, okay. What makes it >> demographic? >> All the hippies. >> Hippies did not make a demographic [ __ ] >> But like I'm I'm confused. You say you got >> the fact that you're questioning it proves my point. >> I think the fact that I live there I can speak the most on it. >> It's okay. You can It's okay to be privileged. It's honestly it's okay. It's not a bad thing. I'm not saying it is. >> Just accept it. >> I'm just saying. >> I'm just saying black stuff. It's okay to accept that you're not >> just accept it. It's okay. I was about to wrap it up. Maybe go home early. I have to be back here at 2:30 for basketball. >> Oh, you too? >> Yeah. >> Do two hours of shift adjusting. >> Shift adjusting. >> Yeah. Since it overlaps, it goes until 7 or 7:30. Yeah. Our shift starts at 5. So, I come in >> two hours before the game. Work the four hours of the game and then work my last three hours. Ew. >> I don't mind it, but it should be better. >> My husband was like, I'm okay with it, but that's a 17our day. Like, yeah, I played myself cuz I have to be here like 2:30, get to the game by 3, and then I work till 7 a.m. >> I get off at 7 a.m. this morning. >> Yeah. It's actually nicer for the kids than swing shift is because they hate when I'm not home for bedtime and then I'm asleep when they get up in the morning. >> So, there are some benefits to it, but coming in halfway through my sleep time, not so much, >> right? >> Yeah. >> Okay. So this page series of questions can answer them not answer them best. Do you have any physical impairments? Do you limp at all? Are you sick or injured under the care of a doctor or dentist? >> I've never understood that one. regular or not? Are you diabetic, epileptic or taking a simple? You taking any medication, drugs in the last 24 hours, any prescription, non-prescription medication, any cocaine or marijuana? >> Why are those the two that they pick? Like there's this huge list of like coke, weed that covers it. >> Yeah. and they haven't updated it since then. >> Uh, do you have impaired vision? >> Do you wear lenses? Where do you work? Did you work today? How many hours of sleep did you get last night? Were you driving the vehicle? Is there anything wrong with you? >> Have you been injured or involved in any collisions the last 24 hours? Have you had any alcohol to drink since you were stopped by Sergeant Jordan? Or where were you going before Sergeant stopped? Without looking, what time do you think it is? What street or highway were you on? Direction of travel. Where did you leave from? What day is it? Do you know a city you're a county? What is today's date? Have you been drinking alcoholic beverages? What have you been drinking? Who were you drinking with? >> Where were you drinking? >> She done. What was the time of your last break? Do you believe your ability to drive was affected by alcoholic and or drug? >> Have you ever been arrested for the UI before? I wish you took a note prior to help your bail processes. That >> conversation doesn't sound like it's going well. >> Back in the Martinik days, he just yelled at him and hung up after he hung up on me. What do we mean? your treat like a trash. >> Yeah. >> Poor Martin comes and Mar's really mean to him and they come out. I'm like, I I told you I wasn't pretending to be nice. It's comparatively I'm phenomenally pleasant. I want a tablet version. >> Yeah. >> Yeah. Can you wipe under my eyes, please? >> Can you wipe under my eyes? >> So, I can't, but as soon as this is done, I assume he will let you do that. >> Sounds like a reason. >> Yeah. sample. >> We just can't have anything touching your face before this happens. >> Oh no. People much smarter than me decided them rules long ago. It really does. I've never gotten to scan something. >> Wow. Just brag about it. When it's legal, it scans. Oh, it doesn't even want to scan my card. >> My VAC card. Yeah, >> it gets so mad at me. Maybe I'm doing it wrong. You have any questions about the breast samples at all as far as what you have to do. >> If you have them, now is the time to ask because once it's ready for the breast samples, then it's time to go. >> Are they saved? >> Um, they'll be printed out and you'll Copy. Copy. Good. >> Go ahead and stand up. Okay. So, like I said, big deep breath in. Have your lips around the straw. 10 seconds. Okay. Whenever you're ready. Plenty of air. Keep going. Keep going. Keep going. You have plenty of air. Keep going. Keep going. Keep going. Halfway. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. >> Barely made it. So, a little bit better next >> second. We got to do two. I thought do one. >> Yeah. Two part of the consent warning. It says two separate samples. >> Okay. Okay. Okay. >> About five minutes in between the two though. It's real fun. >> Yeah. Yeah. >> Wait. Had somebody with one lung manage to do it once. >> I had my 79y old lady with asthma. She did it like fine. Okay. >> She's like, I'm used to breathing treatments. I'm fine. >> Every time somebody can't do it, I'm like, okay. I've had a 79y old. >> Yeah. I tell the one lung story. >> Yeah. >> But I mean, I guess he didn't like look inside to make sure he had one lung. He could have could have just had the two. >> What was their conviction? Well, we only do this for DUI. >> Okay. Or it could be worse. Could be the result. You got water system. Hit somebody on here. So, it's showing me how much air blow in. Show me the results. I don't know what the numbers are until you and I see at the same time. >> It's like a fun surprise. Yeah, it is. >> The only reason it has been allowed to go on this long is because I couldn't use the machine anyway. So, it would be unreasonable to cut it off. But once you guys are done, she's done. >> I recognize your defense strategy and talk to her until the alcohol wears out of her system, but that's that's a long time, dude. >> Oh, yeah. >> 136. >> Yeah. Home next door, >> huh? And she's teeny tiny little thing. >> Yeah. >> Are you doing better than her? >> I know I am. >> Okay. >> I'm just saying. >> I know my limit. So, >> kind of. >> I think you went past your limit today. >> I literally had two drinks. I'm experienced. I'm not a college kid. >> You live in McKe. >> I'm a college kid. >> Yeah. You said I'm experienced. I'm not a college kid. >> Huh? >> You said you weren't a college kid. I was like, wait a minute. >> I'm in college, but I'm not a college kid. >> Do you think only college kids you? >> No, I know that. >> Okay. My last two have been over 50. >> Yeah, that's alcoholism. Between 20 and 50, that's alcoholism. Like 20some, that's that's partying. 50 40 plus, that's alcoholism. >> What a 40-year-old can't have a couple of glasses of wine and then whoopsie daisy drive. >> You can drink all you want. You just can't drive that. >> Sure. It was poor timing on my part cuz I literally only had two cers. >> I said poor. >> Were they Were they like big IPA cers? Um, we only have three cers on tap. So I and I honestly don't know the ABB off the top of my head. So maybe the one that I picked was a little bit higher than our average beers. >> What bar do you work at? >> The Coug where I was drinking at. >> I I wasn't here for this conversation. >> She wasn't drinking or should be that clear. >> Yes, cuz it's highly illegal. So drinking and driving. >> I understand that. But also I was waiting before I started driving. >> Didn't wait long enough. >> That's exactly my point. >> Go ahead and stand up again. Round two. Same thing. >> That's why I'm here is cuz I didn't wait long enough. >> Big deep breath in. Blow whenever you're ready. >> Wait. >> That was a deep side >> of irritation. Plenty of air. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Halfway. Keep going. A little more air. Keep going. Keep going. Keep going. Good job. That was better than the first. >> Both of them were good. Do you want to lift like this or do you care? >> No, that's fine. >> I can do tonight. >> Uh once you get booked in. Yeah. >> What? What? >> Once you get booked in at in Kfax then? Yes. >> I have to go to KFax. >> Yeah. I told you this when we first got here. So, am I getting a ride back? >> Um, no. >> That is for you to figure out. Most people call friends, Uber, college, cab >> with no phone. You guys have my phone and my childhood as well. >> No, I don't. >> I have your phone. It goes in your property. You'll get it back once. The amount of people who are just iate with me because they're not allowed to have their phones in the holding cell. Astounding. >> If you want, I'm allow you to wipe your face with the tissue if you still want to. Otherwise, you have >> Yeah, I mean, you have to >> I had somebody ask me for a coloring book the other day. >> She thought it was cruel and unusual that there was nothing to do in there. Said, "No phone." She said, "Can I get a coloring book or something?" I said, "This is not a dentist waiting room." Oh, perfect timing actually. >> All right. Thank you. Okay. We're going to come right out here and you can have a seat in that chair again. >> Oh, you're fine. So these are >> the good >> somewhere. Where'd you find the good tubes? Did you use the last one? >> There's one. Oh, two. That'll do her. It is. >> In fact, this one's arguably more private. >> All right, KMA. So, same as before. I need to take a look in your mouth. Go ahead and open open wide. Okay, look. Chung up. Tilt your chin down and lift your tongue up. Thank you. So, because you went in there where I couldn't see you, I have to recheck. That's why we're doing this again. Promise I can't move. >> All right. So, I'm going to keep reading you stuff. Is there anyone All right. So, this next bit is kind of long. I'm happy to read it again if you don't understand it the first time I read it. Okay. Warning. You are under arrest for RCW4661502 or RCW4661504, driving or being in actual physical control of a motor vehicle while under the influence of intoxicating liquor and or drugs. Further, you are now being asked to submit to a test of your breath, which consists of two separate samples of your breath taken independently to determine alcohol concentration. [snorts] You are now advised that you have the right to refuse this breath test and that if you refuse, your driver's license permit or privilege to drive will be revoked or denied by the Department of Licensing for at least one year. And your refusal to submit to this test may be used in a criminal trial. You are further advised that if you submit to this breath test and the test is administered, your driver's license permit or privilege to drive will be suspended, revoked, or denied by the Department of Licensing for at least 90 days. [snorts] If you are age 21 or over, and the test indicates the alcohol concentration of your breath is 0.08 or more, or you are in violation of Oh gosh, I lost the spot. RCW4661502 [snorts] driving under the influence or RCW 466104 RCW4661504 physical control of a vehicle under the influence or under age 21 and the test indicates the alcohol concentration of your breath is 002 or more or you are in violation of RCW4661502 driving under the influence or RCW 4661504 physical control of a vehicle under the influence if your driver's license permit or privilege to drive is suspended, revoked, or denied, you may be eligible to immediately apply for an ignition interlock driver's license. You have the right to additional tests administered by any qualified person of your own choosing. Do you acknowledge I have read to you the above statement? >> Could you reread the last statement you made? >> You have the right to additional tests administered by any qualified person of your own choosing. >> The right to administer test so I can choose anyone to administer the tests? No, you have the right to any to additional tests administered by any qualified person of your own choosing. >> Oh, what would the additional test? >> This does not say. >> This would be if you wanted to have another BC performed by a qualified person somewhere. I've honestly never had had it come up. So if you wanted to try and have somebody else test your BAC in addition to this and what we do, you have the right to try and do that. >> And then how would that information be used? >> I have absolutely no idea. You would have to locate and >> you would have to locate somebody and ask them to perform that test. >> I have to look how am I supposed to locate anyone? Like I said, it's not something that I've ever seen be done, but if you know of a way to get a hold of a BAC lab or blood alcohol content or you wanted to have your blood drawn and have it tested by somebody that you chose, you could do that. >> Seriously, that's tight. That actually >> So, what would the point of that be? How would that be beneic beneficial? >> I don't know. >> So why is it in >> I don't know. I didn't write this. The state writes it. >> Can I read it? So, you're not doing another breathalyzer right now? >> We are. That's what this is. >> You are. Okay. You're asking if I want it from a different region. If that >> No, that is just telling you that you have the right to additional. Yeah. >> Tests administered by any qualified person of your own choosing. >> Gotcha. [snorts] >> Okay. Yeah. >> Will you now submit to a breath test? >> Yeah. >> It's the only option I really have. Um, is there a bond under my name? No. So, because you haven't been arrested for DUI before, you'll be released without bail and after about six hours. This is happening a lot. Is this something that we do a lot? Yes. It's really [ __ ] hard to see every time. [snorts] You know what? You didn't hit anybody and that we're not contacting you because you hit another vehicle or you hit a pedestrian. So, let's be grateful for that at this point and not speculate about other people's contact. So, this is your driver's hearing request form. So, if you want to apply for that ignition interlock driver's license, you have 7 days to fill out this form and return it to the Department of Licensing. >> I may also apply for [snorts] What's it called? Um I can't afford an attorney. So the one the state provides. >> Yes. So you were already on the phone with a public defender >> and then at your first court date that will be handled there. >> Okay. >> They make sure you have an attorney. You can't turn away from me. I have to be able to see your mouth. Okay. So, this is your initial court appearance. Pay attention to this. And this after you sign it, you will get a copy of this and I'll get one as well. So the 27th, so Monday at 3 p.m. in KFax, right, the KFax office, the address is right here at 300 p.m. Monday 3 p.m. KFax office. 27th 3 p.m. KFax office. Okay, that can't be waved, changed, modified for any reason whatsoever. And you do have to appear in person. >> Yep. Where were you born? >> Seattle. >> Are you a citizen of any countries other than the US? >> You put that in the past, please. Okay. So, we have seven minutes from the time that I checked your mouth until we can go through this process. >> What? >> The BAC. It's similar to the PBT that you took in the field, but it's two breath samples and it takes more air for longer. [snorts] But we've had somebody with one lung managed to complete it. So, it can be done. >> So, how long will I be here? >> Six hours. >> Do I get my phone? >> No. Do I get a call? No, this is not a jail. You're not being booked into the county jail. So, you don't get a phone call. If you are booked into the county jail, that is when they give you that phone call that you're obligated to. This is just a holding facility. >> So, I'll be in a holding cell for 6 hours and then you have my phone. Correct. >> Yep. We have your phone and your car keys. And where will my car keys be delivered? >> You will be provided with all of your property when you're released. >> Where did they they where do they take the car? >> The same place we parked your car when we talked about it earlier in the Pullman Family Medicine parking lot. Still parked there. And then you officer land gave him a ride home. >> What time is it? Almost 4 a.m. I have to be able to see your mouth. Thank you. Around what hour will I be? 6 hours from now. 10:00. Yep. a DUI stitch record. I believe they're permanent unless you ask and petition the court to have something taken off of your record after a period of time. I'm not sure how long that time period is before you can petition to have it removed. But unless you're planning to become a commercial truck driver, most jobs are not. >> It won't accept your law school if you have a [ __ ] DUI. Given the period of time between your DUI and your application to law school, I assume it's similar to becoming a cop. It's about 10 years. But at that point, they will take you. >> That point, what? >> At that point, they will take you, but that's a guess based on the amount of time that you have to have between a DUI arrest and becoming a cop. about 10 years, 5 to 10 years depending on the agency. Do you know anyone that's going on a DUI? >> Not a DUI, but I know that there are cops in my academy class who had gotten a DUI and had to wait a couple years to get in there. I just don't know anybody that works here particularly. Places that do backgrounds like that care a lot more about whether or not you've learned from the behavior than if it happened in the first place. respective. It is expensive, but you're sitting here instead of costing somebody their life. So, this is a better alternative than that. Do you guys have water? So, you can't put anything in your mouth until after this test is done. But after that, I will give you a cup and you can have water. >> I'm sorry. >> I have to be able to see your mouth, please. >> [clears throat] >> We have a minute left on this timer and then you'll be able to do this. Help me. >> [snorts] [snorts] >> Have to be able to see your mouth. >> [snorts] >> blankets, please. >> Yeah, you get a blanket and so handcuffs. >> As soon as this is done, we take the handcuffs off. It's just so we can guarantee that nothing touched your face or went in your mouth for the process. Sorry. So, this is just warming up and then I'll walk you through how to provide those breast samples again. And that's the last of it. I'll put you in a cell with a cup and a blanket. All right, go ahead and stand up for me, please. So, you're going to wrap your lips around the tube and blow out. Steady. Don't stop or suck in. I will pull it out when it's done. Otherwise, it'll count it as a refusal. Okay, big deep breath in and blow. Keep going. Keep going. Keep going. Almost there. Keep going. Keep going. Keep going. Almost done. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. All right. [snorts] You can sit back down if you'd like. That it has to do its internal tests in between the two. >> [snorts] [snorts] >> cream. I got to be able to see your mouth. Thank you. We're almost done. And when it's done, it'll print out results and you'll get a copy of those as well. All right, last one. It requires two. Big deep breath in and blow. [bell] Keep going. Keep going. Keep going. Almost there. Keep going. Keep [bell] going. Keep going. Almost. Almost. Almost. Make sure it took it. [snorts] Okay, you can take her out of handcuffs. I didn't say what it was. >> It will when it prints out. >> It will when it prints out. >> All right. So, this is again your initial court appearance and your promise to appear. So, Monday the 27th at 3 p.m. in Kfax. And I do need a signature from you right [snorts] there just saying that you will appear for court. And again, that is in person and it cannot be waved, changed, or modified. And you will get a copy of this so you know when to show up. Can you put that in the pass through? Thank you. Okay. So, I need all of your jewelry off and in the bin, please. I can't take all of them. I have a belly button piercing. >> Okay, you can take everything but the belly button piercing. >> I can't take these either. I don't know how. >> Okay, you can take all of the other stuff out. >> Okay. [snorts] Did you get everything back? >> Yep, you get everything back. >> Okay. >> Is there any particular reason I can't keep my jewelry? >> So, we can't let people in the hold cells with jewelry on because they either try to eat it or people have done all sorts of other crazy stuff with it. >> Yep. It's the same reason we have to take your jacket. >> What? >> Yeah. You'll get a blanket in there, though. We had somebody tried to strangle themselves with the string of their hoodie within the last week, so people don't get to keep anything with strings on it. It's a safety thing. >> It'll hold things. >> Yeah. It's actually a pretty common behavior. So everything that you have to take off is something that somebody else has already ruined for everyone a long time ago. There's your copy of that. Sure. >> You have the keys on you? >> Keys are in the bathroom. >> Okay. And your coat often in the bin as well as your shoes, please. We'll get you a blanket. and your bracelet, please. Please don't lose this. >> We won't lose it. It's all staying right in this bin. Nobody moves the bin. >> If you want to put it in your shoes so it's more secure, you can do that, too. We really should start keeping like plastic bags down here for jewelry cuz I hate that it's just flying around in there. >> You're going to get the same bin to grab your stuff out of when you get released. >> Yeah, right there. You could just put it in a if you want. [snorts] You can leave those out too because we'll have to secure it in a second. Okay, so these are your breath test results, right? So the legal limit in the state of Washington is a 0.08. You blew 0091 091 097098. And that's lower than what you blew in the field, which was a 136 because you were in there talking to the attorney for about an hour. And this is your copy here. All right. So, here's your blanket. He put a cup in the cell for you. So, you're going to go in cell A right there. >> And then, how does it work when I'm released? >> So, in about 6 hours, somebody will photograph you, fingerprint you, and hand you paperwork. And then you'll be released from here. And you'll be able to sit in the lobby, which is warm, and make any phone calls that you need to help get picked up so that you don't have to walk anywhere. I like your pancake. >> Thank you. >> All right. Right in there. I'm not going to take your socks. Please don't flood my holding facility by pushing them in the toilet. >> So, we're supposed to take your socks because people like to flood the >> toilet. >> Yeah. If you put them in the toilet, nobody will ever get to keep their socks again. Not going near that. >> You are good to go. Right in there, please. >> Yep. The one with the light on. >> Can I get shoes for a second? >> You can't wear any kind of shoes in there. >> No, just tissues. >> Oh, tissues. Um, yeah, you can have a tissue. >> Dogs. >> No, just All right. Yeah, it's kind of a weird key. Check the little Thank you. Perfect. >> Yeah, that works, too. All right, off we go. All right. Fingerprints, photographs, and paperwork, and you will be out of here. So, I need you with your back against that blue wall, please. We ready? Is the photo thing working? Just look straight ahead. Okay. And look at the red dot to the to your right. To your right. >> What? >> Look at the red dot on the paper towel dispenser. All right. And I'm going to do your fingerprints over here. Okay. So, I need the first four of your left hand. No. First four of your left hand. There you go. Okay. Your left thumb. No. You have to wait till it beeps. Okay. Right thumb. Right four. So now you need to roll your right thumb. So right in between these all the way. And then lift it up. Try it again. Try again. What am I doing wrong? >> I don't know. This thing's really picky. Okay. Right. index finger lower than that. Lower. There you go. That worked. Middle finger. Okay. A little lower. Okay. Pinky. Roll your left thumb. Let me try the other way. Okay, we'll call that one good. Okay, you can go ahead and sleep. One second. There we go. That should have other things on it. Okay. What were you saying? >> Yeah. Let me explain this paperwork to you real quick and then you can put it all back on. So, I just need a signature there saying that those are your fingerprints that I took. >> [snorts] >> And here saying those are your fingerprints that I took. That's all you're signing. [snorts] >> [snorts] >> All right. So, this is your criminal citation for DUI. It looks like a traffic ticket, but it's not. Right. So, your information's at the top. If there's anything that's not correct or changes, you need to get a hold of the court right away and let them know. It's your responsibility to make sure that they have correct information. If they send mail or try to get a hold of you and they can't, they'll issue a warrant for your arrest. Vehicle information is right there. What you're charged with is right here. My information, case number, citation number, all at the top if you need those. Court contact info is up here. So, in addition to that initial appearance on Monday, you will also hear from the prosecutor's office by mail within about 3 weeks of your arrest. And so keep an eye on your mail and that will have instructions as far as what to do next stepwise for court questions about your citation. I have questions. Yep. And call the court. And this is your copy. You get to keep it along with your copy of your breath results. And you can put all of your stuff back on. And the there's a lobby right out there. So, you can put all your jewelry and stuff back on in the lobby. Here is all of your paperwork. And again, your car is parked at Pullman Family Medicine in the parking lot. [snorts] And you can sit in the lobby for as long as you need to to make phone calls to try to get a cab to come pick you up. Careful. [snorts] Oops. [snorts] and then your paperwork is all right there. Okay, so that door right there, push on it, it'll let you through. There'll be a little hallway and then another door. That other door will lead out into the lobby where you're welcome to sit and take phone calls until you can find a ride.
