And Bobby, I don't even think saw the You didn't see the car? >> No, I I asked him if he saw it. He didn't. Yeah, >> he said he said 310. I talked to him. So, she was parked at the 7-Eleven like this. I'm like, "That's a little weird." And then when she came out, she back like obviously this car is all messed up. There's no headlight or anything. She made this illegal left right here. But when I'm talking to her, I saw the bag right here. Yeah. By the cigarette box. >> Yeah. Right by the cigarette. So, I was waiting for that, but as soon as she bent over, I saw the full bag. So, I just had her hop down just thing. >> Yeah, she has more heroin in there, but she seems out of it. I don't know if she was just shooting up there or something. There's a straw right here. >> There's no come back. >> Yeah. You think she's on the other? >> I think she might be. I'm trying to get this straw. I dropped it. I went underneath here, but I'm It looks like it's cut. I stopped her here. She pulled into here. So, she must have been here before. So, this same woman was in the bathroom. >> I didn't um saw her car. I just I was over that side. >> Yeah. >> And she was trying to open the >> You saw this. Did you just see the woman that we had? >> The gym jacket. Yes. >> So, she tried to open the bathroom and I just went like I don't know. She was saying like, "Open the where I'm like, I don't know. And then she was like, >> where I'm supposed to go bathroom? And then I just mind my business. >> And then she grabbed the garbage can and like place it where we couldn't see it. >> Yeah. >> And she It really smells, right? >> Which garbage pail? >> I have no idea, but I'm guessing it's like maybe this one here. >> One of the garbage over there. It really smells. The >> one over there. Okay. Can I get your name now? You noticed her? >> You saw her out here with the officer? >> No, I have no idea about this. >> No, forget about the car. The woman. Where did you >> While the officer was speaking to the woman, you noticed that it's the same woman that used the bathroom? >> No, I have no idea about her. But the lady told me that she saw that girl. >> Which lady? >> The one that just came? >> The one that came in this one? >> Yeah, she told me about the car. I have no idea. >> All right. This woman in this car right here that has the door open here >> saw her use the bathroom in there or you saw her use the bathroom? >> I I >> That's what I mean. So, but what I mean is you just happened to see her with the officer just now? >> Yeah, I was like on the corner and I saw her like here. >> Okay. >> And now again, you see her back here while she was talking to the officer and you're able to confirm that that's her. >> Do you understand what I'm saying? Forget about the car. >> No, no, no. Yeah, I know. She hasn't seen nothing. >> Yeah. Yeah. So, that lady that we were just with is the same woman that was in here earlier and and used the bathroom in the in the uh door. >> Good night. >> Thank you. I appreciate it. >> Did you hear that? >> Allegedly, she was here earlier. Went in here, tried to use the bathroom. The bathroom door is locked. She defecates in the garbage pail in there. When you're back here, this woman is watching you and confirms that the woman that you're with, she have a jean jacket on. >> Yeah. >> Is the same woman that defecated in the bathroom. >> In the in the garbage. >> Supposedly this woman saw it also. >> Hi. >> Hi. >> Did you see something going on in there before? >> No. No, sir. I come. >> You just got here? >> Yeah. Yeah. Okay. Okay. Thank you. >> Maybe we have to have >> How are you, sir? >> How are you? >> Did you see a woman in here before? Use the bathroom in a toilet in a garbage pal by any chance? >> No. >> No. Okay. I just got here, too. >> Very good. Thank you. And so we had spent the day soaking the rags and the teeth right out the truck. >> I'm not seeing anything. >> What's that? >> I mean, one of the garbage pal smells, but I don't see any defecation sitting at the top of the garbage pail. And nor am I fishing around for it. That would be two in one. >> Yeah. She thought it was that gar over I mean, there's a stench in there. Could be dirty laundry. It could be could be the the incident itself, but it's not like it's sitting right there on the top. So, I mean, you can always ask her when we're in there, she wants to she used the garbage pail as a bathroom, we can take some action on it, but at first glance, there's not it's not just sitting right on the top. Nor did this guy see anything over her. So, >> what's that? >> She has a phone. >> She has a what? I'm sorry. >> No. Uh I don't know if you heard no uh filming reports for 15, >> but I mean there's tape on the bumper and uh >> I mean it could have happened tonight and she taped it just before you stopped her, but Yo, I'm going to call for a hook no matter what. I mean, this is not safe a safe vehicle to be operating. Not at If we put her through some psychophysicals and determine that she's uh under the influence, then we'll just call brothers and tell them to hold it for a 12 hour. >> Just do them at headquarters then, right? >> What's that? >> Psychophysicals cuz she's already Do you want to do them here? >> I'd rather do them here. >> I mean, we're not going to have her do a walk and turn in the uh in the booking room. >> Yeah, they usually when they do the deal, they usually do in that hallway right there. I'll do it here. >> I would just do it here. We can take her out. Three of us are here. I'll ask her to go through a couple of determination, but I said we hooked her car no matter what. It's not a safe operated vehicle. Well, number one, there's no report. So, >> it's filming though. It doesn't mean it >> another or she hit somebody or something and did it herself and you drove away and then >> I mean, if I saw that car on crash, I would immediately call for a hook. I would let >> Yeah. I mean, the hood is barely latched on. The the one side of the hood is completely unlatched. Yeah, correct. 275 Ocean. >> Can we get a 17 for this vehicle? >> It's unable to be safely driven. And then we can call a DR. >> Yeah. >> After you do the uh zeros on the box. Yeah. Do it right here. You do it right here. How about up here? I'm going to put you through some deal. I'm going to uncuff you and I'm going to put you through some field sobriety test, right? Cuz it to me it looks like you're under the influence. You can barely keep your eyes open. Um I'm just going to put you through some test. Either way, you are under arrest for possession of heroin, but I'm going to put you through fuel soiety test. All right. Just come right in front with this officer. Come right here in front of my vehicle. You just lean against the bumper for one second. I'm going to turn these lights off. Sit here. Just >> lean against it. Yep. I'm going to turn these lights off so you're not blinded. 302 [Applause] might have been Sandy passenger seat. >> Yeah. What was that last part you broke up? Just >> here. >> Put your feet together. >> Arms straight down at your sides. >> All right. Do you have any issues with your eyes? >> Yeah. >> What's wrong with your eyes? you go in that room. >> Um, sometimes they um they like shake a little bit. >> They shake. All right. Anything else? >> And when I cross my eyes, >> I have a hard time crossing my eyes. And what? >> I have a hard time crossing my eyes. >> All right. Yeah, you're not going to have to cross them. All right. Just keep your feet together, arms straight down at your sides. I think Sammy Davis hangs out with Richard Scott. Scott makes sense. Yeah. >> All right. Look, look right at me. Don't look at the light. >> Do you see the the tip of my pen right here? >> Yes. >> When I move the tip of my pen, I want you to follow with your eyes and eyes only. All right? Do not move your head. Do you understand? >> Yes. Keep looking at it. All right, I'm going to go out twice. All right. Okay. All right, just come right over here. Do you have any issues with your legs? Anything that affects your walking or balance? Any injuries? >> Um, not >> not getting right now. No. >> All right. So, what I want you to do is stand right here. >> Okay. >> Facing this way. You're going to use this line right in front of you. All right. Okay. >> Put your left foot on the line. Put your right foot in front of your left heel to toe. Arm straight down at your sides. Don't do anything until I tell you to. Do you understand? >> Yes. >> When I tell you to do so, you're going to take nine heel to toe steps as it or while you're walking on this line. Just like this. One 2 3 and so on until you get to nine. Once you take your ninth step, keep your front foot planted. Take a series of small steps to turn around and take nine heel totoe steps going back in the same fashion. While you do that, look down at your feet. Count your steps out loud and keep your arms by your side. And once you start the test, don't stop until you complete it. Do you understand? >> Yes. I am shaking cuz I'm a little cold. >> All right. Just give it your best shot. Do you have any questions? >> Um, so when it gets to nine, pin it and go back. >> Correct. You're going to keep Well, you're going to keep your front foot planted. A series of small steps to turn around, then go. You understand? >> No. All right. Just like this. So, say this is your ninth step, right? Keep your front foot planted. Take a series of small steps to turn around. >> Okay? >> And one, two, three, and so on until you get to nine. >> Do you understand now? Yes. Any other questions? >> No. >> All right. Go ahead. 1 2 3 4 5 6 7 8 9 and 1 2 3 4 5 6 7 9 >> All right, put your feet together, arms by your sides. Okay. >> Don't do anything until I tell you to. Do you understand? >> Okay. >> Yes or no? >> Yes, sir. I I do. >> All right. When I tell you to do so, you're going to raise whichever leg of your choice, your left or right, it doesn't matter. You're going to put your foot approximately 6 in from the ground and parallel. Toe pointing straight out. >> Keep both legs straight. Keep your arms by your sides and look down at your foot. You're going to count out loud. 1 1,002 1,003 and so on until I tell you to stop. Do you understand? >> Okay. >> Yes or no? Uh yes. >> Do you have any questions? >> Starting from 1,00. >> You just say 1,00 1,002 1,003 and just keep going. >> Okay. >> Until I tell you to stop. Do you understand? >> Yes. >> Any other questions? >> No. >> All right. One second. >> All right. Go ahead. >> Okay. 12. >> Can I start over? >> Yeah. Keep going. >> Sorry. 1,00 1,002 1,003 1,004 >> Straighten your leg out. >> 1 5 1,0006, 107, 108, 109. Sorry. >> All right, you can stop. You can stop. >> Okay, >> put your hand behind your back. So, you're going to be placed under arrest, like I said, for the heroin, for paraphernalia, and for DUI. All right. influence. >> Yeah, I believe you're under the influence based off your test. All right, let's come this way. >> Are you a D um DR? >> I'm sorry. >> Are you a D? >> Am I a DR? No, but I don't need to be a DR to determine that you're uh under the influence, but I will be calling calling for >> I am very cold. >> Can I have a phone, please? >> Yeah, I'm going to grab it for you. Just have a seat. Uh, I am going to be calling for a DR cuz obviously I don't I don't smell alcohol on you. So, I don't think you're under the influence of alcohol. I think you're under the influence of a narcotic. So, I mean, we still have to have you blow into the uh the alco test. Just that's the protocol. Um, I assume you're going to blow zeros. Obviously, I could be wrong, but I don't smell alcohol. Again, I think it's something else. Um, if and when you do blow zeros, then I'm going to call for a DR. >> My clothing um are in two bags. right in front >> of um inside the laundry mat right there. A brown bag and a green bag. You >> want us to put it in your car? >> Yes, please. >> It's a brown bag and a green bag. >> Yes, please. >> It's right inside the door. >> Yes, please. >> All right. I'm going to make sure I'm going to bring it over here and make sure it's yours before I grab or before I put it in your car, though. >> Brown bag and a green bag. >> Yeah. I'm going to throw it in our car, but No contact needing to ra2 up that way. from the shet. The uh the weight I got you. >> Is it these? >> These bags. >> Yes. >> All right. I'm going to put them in your car for you. >> Yes. You got the You can throw it right in her bag here. Just bring this whole thing. Easy. Did you already call it demology? All right. Thank you. with the 450, too. >> Yeah, >> it's definitely good. >> Yeah, >> but there was a Yeah, definitely. There's a straw right on the side with all white residue. She probably just snorted. That's what my guess is. >> Will you see it on the seat when you uh >> So, I saw the empty bag um an empty heroin bag in the uh on the side of the door like right below the seat. >> That's when that's when I called you. And then when she leaned forward, she dropped something. Uh, I saw the full like the bag. So I was just I was >> Yeah. >> All right. Thank you. >> You guys can reset. Can you see if they have a female officer for a search as well while we're there? Also 101. >> Transporting adult female 41. My location to Neptune PD. Start mileage 211068. Camera on seat belt today. >> I'm sorry. >> No, it has to be towed. where >> it's going to be towed to brothers towing in Long Branch. I'll explain all that later. Either way, that car is we we had either even if you weren't arrested for DUI as well, >> it was going to be towed because that car is in no shape to be driven. >> I am I'm not really messed up. I have a little cold. >> All right. I mean, it's more it's more than it's not that >> you can fail on the eye test. Uh well, the eye test doesn't always or you're not always going to show indicators on the eye test when it comes to narcotics. >> Rey, >> all right. I mean, I understand it's it's not like it's summer, but it's 50°. I've had people that do are able to do it in 20° weather. That shouldn't really impact your ability to do the test. So, you were right here on the other side of this >> and you made a left. See, there's no left turn sign right there. You pulled out from there and you made a left onto West Park. And there's a sign right there, right? It's right underneath the stop sign that clearly says no left turn. I got you. What's up? Uh, I don't I don't know how your criminal history is. Have you been arrested before? Sorry, hold these up. 5 years ago, so I can't make any promises, but more than likely, yes, you'll be leaving on a summon. But again, it's not really up to us. It's uh it's all like, have you heard of bail reform? Yeah. So, we put everything into a computer and that basically them and a judge uh decide if you get released on the summons or not. But more than likely you will to what? Get released. Uh probably two 2 and 1/2 hours. But you are you're going to have to call a adult a sober adult to come and pick you up though. I'm sorry. All right. Yeah. Just cuz with the DUI, we have to have a form that uh we have to have a form that you uh that a sober adult signs cuz that we're releasing you to them. We'll talk about everything once let's just finish this and then when we get back to my police station, we can talk about everything. 304 is arriving at 1011 >> 2173. You want to park in though? You want to park in though? >> Yeah. I'm going to move my car, park it, and then I'm going to meet you back inside. >> All right. You run it for me? >> I'm not running it, but I'm helping with the jail so you can start your in 20 minutes. >> Gotcha. Perfect. Thank you. I'll wait right there. So, wait. Oh, wait. Right here. >> Sorry. >> Just wait right there. >> Did you put anything else back here besides this uh rubber band? >> Huh? >> I didn't put anything back there. >> There's a rubber band right there. And it wasn't there before. >> Can I see it? >> It's right there. Maybe. Yeah, maybe it was. >> It was on you. All right. >> What's going on, man? >> What's right there? >> I don't know. I don't have a metal wire for my brother or anything. >> Well, there's something that's poking out right here. What is this? >> Oh, >> don't touch it. What is Oh, it's pepper spray cuz >> Why do you have pepper spray on you? >> Um, a guy impersonated a police officer yesterday. I mean, >> all right. >> Well, I'm going to grab that. Don't Don't touch it. >> Put your hand down. >> I'm not going to spray you. >> Well, I don't know that. So, don't touch it. >> I didn't do that. >> I don't know. >> Move your hands. All right. Just going to treat you like a person. Yeah, >> I am treating you like a person. >> Is it under your shirt? >> Yes. Well, it's under my >> It's the gray one. >> Just the gray one? >> Yeah. >> Um, you could probably pull it out from my necklace because I have a navy necklace on >> and you can probably pull it >> Well, I got it. Just wait right here. I'm going to put this in my car. Just want to just have a seat. Open your mouth. Lift your tongue. You're good. [Music] So 124. I'll have to watch you for 20 minutes. So just don't You're not going to be able to touch your mouth. >> Can I pull my hair out of my face? >> Huh? >> Can I pull my hair out of my face? Can you reach or no? If not, all right, I'll uncuff you when I'm going to cuff your So, just when I uncuff you, your one wrist, don't um touch your mouth or anything. Try not to burp, anything like that. >> Okay, >> that's just part of the thing we have to do. So, we have to watch you for 20 minutes. You're blowing to the Alcatest. Again, I obviously anticipate you blowing zeros. Uh so then I'm going to call for a DR to meet us at my police station, but this is just a formality. They won't come unless uh until you blow into the aquatest. So, I am going to have a female come and search you at my police station. So, if you have anything else on you, it's going to be found. >> At least it's not freezing in here. >> No, it is very cold outside. Where's your place? >> This is Neptune. Yeah. You remember what I told you? >> We have to come here because we don't have anybody certified working to operate the Alcatest. >> Oh, okay. >> Yeah. Like I said, once we're done here, then we're going to go to Ocean. Do you have the uh standard statement form by any chance? I think it's all in that. Gotcha. Yeah. You started that? >> Yeah. Uh 24. >> What's up? Yep. I grabbed your phone, your purse, your wallet. Can't remember what else. Your keys. Obviously, the car keys with the car, but your other keys. I don't know if you have house keys or whatever on there. The standard statement form. Can't remember when Casey ran the box for me like a month or so ago. I can't remember where he uh should be in the box right now. >> Gotcha. >> So where like in general or something new every day, believe it or not. So, did you go to 7-Eleven while you were uh waiting for your clothes or >> Um, I went there because I couldn't find cigarettes. >> Ah, >> I wanted cigarettes that because >> Gotcha. All right, Nicole, I got to read this to you. It's a little lengthy, so bear with me. All right. You have been arrested for driving while intoxicated. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and drive them while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath testing. Even if you agree to take the test, but that do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? >> Yes. >> Okay. >> No, you don't. By law, you don't have a choice. Believe it or not, some people say no, though. Yeah. Well, you get all these additional charges. What I mean, it's tickets, but 118 number of license which one5. >> Just keep your hand away from your face. >> I'm sorry. I'm sorry. I forgot about that. >> You're good.
