Just to let you know, this is a felony. Is it? Yes. Because I had somebody trying to come into the window and I just wanted to check the window from the inside. Please do, sir. I have him detained for burglary second right now. Great. You got some ID for me? I do, yes. Just let you know my body cam's on, it's recording audio and video. So, when I roll up, it looks like you're trying to get into that window. Okay, yeah. Um So, Matches let's let's just break through all the the BS right here, okay? And let's talk about what's going on. Because I don't think it that it's extremely malicious, but it's probably something silly and stupid and you feel embarrassed about it. And now that I'm involved and I'm taking a very serious role, cuz that's my job, I got to get I got to cut through it and figure out what's going on. Yeah, I get um bored and kind of antsy. I like to do silly things for attention, so I tried to open that up, but I knew it wasn't going to work and tried it anyways. Okay, so what is it that's that's in there? Is that somebody's room or It's uh I she said it was a janitor's closet sort of thing. Um I wasn't looking to go in or like even if I got it open, I would just close it right back up. So, the window is partly popped open there. Partly open, but securely locked from what I can see. Is that window supposed to open? I'm not sure. It doesn't look like it. Yeah. So, here's what I'm going to do. I'm going to try and figure out what's going on here. I've got another officer en route that's going to come and hang out with you while I go down on the other side and figure out what's going on. Got you. So, once I get figured out what's what's happening here, then we'll get it resolved. Can do. But, just to let you know, I know you say you like to do silly things and that kind of stuff. This is a felony. Is it? Yes. Oh, [ __ ] This is burglary. I did not. So, anytime you try to get into a space, a building, if it's a room, then it's a then it's a residence. If it's not, it's commercial. So, anytime you try to get into a space that you don't have a right to get into, it's called burglary. So, that's a felony. Okay? So, now I got to do something. I'm not inclined to take you to jail for burglary or anything like that, okay? But, I do have to figure out where we're at and what I need to do. At at the very minimum, what I'm very likely to do is just call an RA and let them know. And then you can talk to the RA about it and and figure this out. Can I have you take your hands out of your pockets cuz I don't know what's in them. Sorry but No problem. Um yeah, just keep your hands out there for me until my other officer gets here and then we'll figure it out. All right. Hello. This here is Officer Cunningham. He's going to hang out with you for a second until I figure out what we got on the other side of this window and uh Do you want me to go? See what we need to do. I'm just going to check it real quick. This gentleman here as I was coming by was opening up that that lower window. Got you. Are you a student here? Uh I am, yes. Awesome. Do you mind just stepping up here for a moment? Sure thing. Thank you. I appreciate your cooperation. Yeah, I don't need to see any face. Police department. What can I help you with? Yes. Is this your room? Yes. And is that your bedroom back there in that corner? Yep. Do you know what room Is that somebody's bedroom or Oh. This is a bathroom and these are my bedrooms back there. Why, what's up? Okay. Because I had somebody trying to come into the window and I just wanted to check the window from the inside. Please do, sir. So I don't want to I don't want to interrupt you, but it was this back corner this back corner. So there's not another room off of the kitchen? here. There's nothing on that side. There's this side, but I these are This This is the window right here. This one? Yeah. Someone was trying to get in? Uh yeah, somebody was trying to open that window. Uh so I I I don't believe it was malicious. He was talking to his friends up there so I don't know what happened here. So he was trying to pry it open. Very very weird. So that's That makes me aggressively uncomfortable as the director of the building. Me, too. Well, thank you for He He's a student. Would you like to come out and talk to him? Cuz I have the on-call RA in route. I would rather not, but I would really like them to write a report about it. The RA on call is in route. Oh. So we've got an RA coming. Oh, wonderful. So I feel that his his actions were not malicious cuz I'm talking to him and stuff. I think he was just goofing around. His friends were there so he was just horsing around. It was a dark room because of the um the color on there the tinting on the windows. Uh-huh. He He thought that this was a custodial closet. No, that's that way. Yeah. Still not appropriate. So yeah, exactly. So I have him detained for burglary second right now. Great. But I don't really want to hit him with a felony. Right. So that's why I was having housing come in cuz I figured having housing take care of this was probably a lot more appropriate unless I'm looking at a real, you know, burglar trying to maliciously get into somebody's space. Right. Which I thought that was. But, regardless, he will be made aware of just how Thank you. stupid his activity was this evening. But, we'll take care of this, and you don't want to pursue burglary, do you? Cuz it's It's more up to you because it's your residence. It's okay. I think this will be enough. We've had issues with noise back here. And but I suspect this will be enough. Okay. And I'll I'll have my supervisor be the one to have the conversation. Excellent. Excellent. All right. Thank you very much. You, sir, are a very lucky young man this evening. That is a residence. Oh. And I spoke with the resident, and they do not feel like pursuing burglary charges this evening. Cuz I explained that you were young and being stupid. And that this will probably correct your behavior, and it will be taken care of locally through the housing department. Whereabouts is it that you live? Uh I live just over there. I can give you the exact address. So, you don't live on campus? I don't live on campus. Okay. Um but you are an active student. I am, yeah. Do you have any questions? Uh nothing about this situation, no. Okay. Excellent. I I think that a big part of our job, besides just making sure that the enforcement stuff is done, is to do some education so that you understand why. So, if you had questions, I would prefer that you asked, as opposed to going, "Oh, that was a near miss. I'm glad I'm going to be going." But, you know, sometimes people still have questions. You're the RDI call? Yeah, my name's Lily. Lily? I am Sergeant Bailey and this is Officer Cunningham and this is Mr. And we're wearing body cameras and they're on. Thank you. Appreciate it. And Hey, can you back away from your window, please? Thank you. I was I was cruising by and Mr. McKinnon was down at this window fiddling around. Got you. Uh as I drove up, he stood up. I stopped, contacted him. Mhm. These are his friends up in the window that are watching what's going on. Okay. And he said that he was outside fiddling with the window to see if he could get it open and um he was just bored. Interesting. Uh I explained to him that this is actually burglary when you're trying to Yeah. open up or make entry into a room and I found out that that is a residence. Mhm. Um one of your employees Mhm. and so uh I I spoke to that that person and they were not inclined to uh pursue burglary charges. Okay. So um I felt that maybe it would be better to have this handled through residence Sure. and student judicial rather than the through the legal Sure. aspects of it. Makes sense. So I will be completing a a small report Okay. for uh documentation purposes. Of course. Um but I thought That's helpful. I would leave it in your your great hands. Thank you. Sure. Appreciate you. So So do you understand that? I understand this, yes. Yeah. So we're not dealing with you, but you will get probably contacted by the Dean of Students who in a lot of respects here is much worse than talking to us. Because we're just we're like, you know we're here to make sure that nobody's hurting each other. He's here to make sure that the school runs properly and they handle and dole out discipline as they see fit according to the code of conduct that all the students signed. But then again, his discipline is going to be a lot lower level than ours. Well, we would send you to court for. All right. What do you mean you're bored? I was waiting for my boyfriend to come back. He was in his room getting some pens. Okay. I'm going to move my car before we wind up with another car in the circle. Okay. Thank you. You can clear I'm done. Okay. It was Thank you. Did you think it was a room? Did you think it was a hallway? It was Thank you. Did you think it was a room? Did you think it was a hallway? My friend's friend told me it was a janitor's closet. Okay. And since I don't live here and didn't know what that room was, I believed it. Got you. Do you live on campus? I don't. I live just off campus by by the the hedge. Okay. Are you a freshman? I am. Yeah, so just for your info, that's a professional staff member's room. That's not even an RA. That's somebody at my level's room. And they just texted me to let me know that you tried to break into their window. So, that doesn't look really great, right? So, since you're not a residential student, this will probably go through student conduct. Just as a piece, I took a picture of your ID cuz I'm going to write a report on my end. And then somebody will probably contact you. Just so you know, within the residence life policies, it is prohibited to climb through windows. You are only allowed to enter and exit through doors. Does that make sense? Okay. In the future, I really advise you to just wait for your partner and never climb through a window again because it could lead to this as well. And I can guarantee you if it wasn't on campus, it would have led to a lot more than them just walking away. Yeah, you most likely probably would have been arrested. If if I wasn't able to contact them or them, Yeah. I'd be taking you to jail. Yeah. So, um I'm not sure what it looks like. I got to be honest, I've never had anybody try to break into professional staff members apartment. Um even if that wasn't your intent, that's definitely what we're dealing with right now. Um so, at this time, I do ask that you leave campus. This time, since you're going to go through the student conduct process, we're not worried about trespassing tonight. Um and it'll go through that process anyway. I do ask though, and I'm advising you to not be in this area. Um I will let the RA know that you're not meant to be in this area. If they see you, you will be documented again. Um that's just so that people can rest easy tonight and know that nothing else will happen. Does that make sense? Yeah, I fully intend to make tracks. I get it. Any questions for me? Um no, I'm very sorry to have disturbed you, both of you. It's okay. Um I will let you go. Um and then somebody will be in contact probably tomorrow or the next day. Got you. Thank you. All right, you got your ID back? Uh I do, yes. Okay, no questions of me either? Um not this time, no. All right. You have a safe evening. And stay out of trouble. Yes, take care. I shall.
