is this is a contempt of court so I will do the report and I will forward it to the prosecutor and the prosecutor I'm sorry your prosecutor whatever Court this is out of and I didn't pay attention to that pierce will yeah and I understand you believe that it fits RCW it does not it does and so I'm not going to charge it but I'm gonna do the report so the judge can deal with it no it doesn't it doesn't okay it's also a requirement in the parenting class to have that warning in it okay like I said because it specifically references this rcw2 okay RCW 9A 40.072 which doesn't require a finding of contempt for them to be found in uh for custodial interference which is a misdemeanor okay so you drove all the way over from Tacoma to find out the oh oh no it was worse than that I met Miller Sylvania right now I was playing at North Sylvania have my kids for the whole month of July so we're going to be at North Sylvania a bunch of state parks and everything else for the month so there goes my plans for the month position so um here's the thing let me explain why this doesn't fit the the RCW okay it's still contemptive plant and I'll do that report so you have that with you I have to be able to show a tent to withhold the children from you where she's offering in those texts if you want to come here in person and drag them out of here you can do that I'll ask for an officer to stand by but so but that's that's not what that's a that's the violation of the order the orders and violation of the parenting plan it's violation of the order which is contempt to court which is a violation of the okay because she has to bring him here it doesn't say I have to I unders I understand that that's the contempt part no no but that's still a violation of violation of so the the it's still willful because you can't just say because that's because now she's not forcing them to stay there no it's clear in the messages that she's detaining would not be uh they don't want to go and I can't force them detaining would be not allowing them to but they're they're minors they're minors she has the ability to she doesn't have to no it's always when we call custodial interference with him okay um so let me get your case number okay um and I will give you a card with a case number on it give that to I assume you have an attorney for your court stuff no all the prosec okay so uh like I said I found an abuse you take that Collective with holding the children making false allegations abuse I've been dealing with this for years okay so uh take to get the copy of that report um you'll be able to get that through our office um should be able to email at request it or call and they can email it to you fax it whatever you need them to do they'll send it to you um and go from there so to a custodial interference can you kind of tell me what's going on yeah yeah this morning that the children refused to get in the vehicle I informed him I asked him he didn't really talk much to them he told them they didn't have a choice to hung up the phone um then I kept trying to get the kids to get in the car uh they still didn't get in so I called my lawyer and was like look I need help on what to do and so then I took a break to give them breakfast and then went back to trying to get them in the car and when that didn't work I emailed him again asking if he could try talking to them because they still were not getting in the car he refused and said he would see me at noon at this point it was about 10 10 30 and even if I had managed to get them in the car right then I still would not have made it at noon uh so then I told him that he could come here to come get them or we could reschedule because maybe he can convince them to get in the car but he refused that as well so I'm not withholding them okay all right uh real quick can I get some information from you man yes sir uh what last name is on your driver's license now do you have a pen handy I'm gonna give you the kids number yes just one moment okay okay do you have any questions for me uh I don't know I just I'm not sure why he I already told him he I didn't tell him he couldn't have the kids right the the problem is per the parenting plan you're responsible to have them here at noon so I understand but I'm not going to physically put my hands on my kids to shove them in the car when they are very tall and they said no okay and and I'm not involved in this other than to document that this is what happened and then the attorneys take care of it in court okay so all right okay okay I I just I always call to make sure that later they they can't nobody can say well I was five minutes away I had a flat tire or whatever she's I did confirm she's not coming um she applied it but she didn't say it well she said I'm not going to go Hands-On with my kids to drag him into the car and if if he doesn't want to come over or whatever and try to talk to me or whatever so anyways so I'm gonna uh I'll go up the report and you can get a copy of it okay that doesn't make sense and and I'm not technically in this other than to document it so I don't really have an opinion either way so but with the amount of uh dangerous and and the only thing I see with that is she did say she would call for an officer standby which we do those all the time but that's the hearing or there that's not my not my place um oh uh
