You have asthma? No, I just can't breathe when I'm bent over. Okay. Okay. All right. Yeah. Right. But he gives a No. Here. Let's put this on. You guys just don't give about me away from me. You guys don't give a about me. You guys get down off me. You guys do not care about me. Get away from me. You do not care about me. You're the kick me in the back. You are kicked me in the back. You piece of No, he's pulling my hair. It's not like you going to, but I didn't. Stop. This fell on me, buddy. You Hey, caught another one. Congraters. I ain't done to you. You treat me like All I've ever done was pay my debts and you treat me like these guys are hurting me. I don't even know why I haven't done He was charged with driving under the influence, DUI, assaulting a law enforcement officer, assaulting a firefighter or EMS personnel, and resisting arrest, but is presumed innocent until proven guilty in a court of law. Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and canine handler. And there's obviously a lot of issues going on with this guy. I just wanted to state up front these officers stating one of the main reasons for the stop was his improper use of horn. and one of those officers saying he wasn't even sure if that was illegal or not. So, it is illegal. A lot of people may not know that, but it is actually a vehicle code violation to use your horn for purposes other than warning someone or some sort of safety issue on the roadway. Aside from that, when they finally get this guy stopped and they're trying to evaluate him and see what's going on, they automatically assume he's under the influence of an alcoholic beverage. He's DUI, which is definitely going to end up being the case. But the reason why they're asking him all these medical questions, specifically if he's diabetic, because somebody that's having a diabetic episode, they can exhibit signs and symptoms that are very similar to someone that's DUI. They can even provide a false positive on a breathalyzer test, but not a blood test. So, you just kind of want to make sure that you're going down that list of questions, addressing their medical history. Also, physical limitations as well, because you're going to be asking them to perform various field sobriety tests. And the main test that cops are going to be using is the horizontal gaze nestagmus, which where that cop is putting his finger in front of that guy's face and having him follow his finger, which he didn't listen to instruction whatsoever on that obviously, but you're looking for involuntary movement or bouncing of the eyeballs that are going to occur no matter what if you're under the influence of alcohol. And then also the walk and turn, onelegged stand, sometimes the finger to nose test. And with all these field sobriety tests, you're just looking to assess someone's physical and cognitive function as well as assess their ability to listen to instruction, balance, etc. So, this guy clearly has an issue with the walk and turn onelegged stand. And then, aside from not being able to follow instruction on that first test, these officers aren't really able to get into all the tests that they would normally perform. And sometimes that happens. Now, he's saying his limbs have been crunched, his feet are crunched. I don't know exactly what that means at all, but he what's clear is that he can't do it. So, when you have someone that's unable to perform FST tests, you're going to be looking at the totality of the circumstances there, which is going to be driving observations. That one guy in the motorcycle that pulled up that said, "This guy almost hit him." Stuff that you see before you pull them over, crossing the line, swerving, and then also once you're interacting with them, alcohol, the odor of an alcoholic beverage emitting from their person, bloodshot, watery eyes, slurred speech, unable to walk without falling over. those kinds of things before you're going to be able to justify placing somebody under arrest for that, which of course ultimately they did. And this guy had a whole bunch of excuses that are not relevant whatsoever as to why he was incredibly drunk and putting the lives of multiple people in the public in danger. But that happens sometimes when you're going to be arresting someone for DUI. They have excuses for why they're doing what they're doing, and they put all this blame on everybody else, and they can get combative and crazy. Every situation is different, though. And that's going to be it for this one. See you guys in the next one. [Music]
