The video you are about to see is intended to provide an overview of the facts as we currently understand them about an officer involved shooting that occurred on January 6th, 2025 around 6 p.m. near the intersection of East Marlin Street and South Fowler Street in Hobbs, New Mexico. New Mexico State Police conducts thorough use of force investigations, which typically requires investigators to interview multiple witnesses, view numerous hours of video footage, and analyze a significant amount of forensic evidence. The incident happened around 6:00 p.m. after White Dodge Charger passed an NMSP patrol unit traveling at approximately 60 mph in a posted 35 mile per hour zone. The two NMSP officers in the unit activated their emergency lights and the Dodge Charger eventually stopped near the intersection of Marlin and Fowler. The driver of the Charger, 28-year-old Jesus Rubio, immediately opened the driver's side door as one officer exited his unit. The officer drew his duty weapon and gave Rubio verbal commands, ordering him to remain in his car. Rubio ignored the officer's commands and exited the vehicle with his right arm concealed behind his back. As one of the officers ordered Rubio to show his hands, Rubio stepped towards the officers and swiftly extended his arm in front of him, bringing his hands together in a manner that suggested he was holding and pointing a firearm at officers. Based on Rubio's actions, both NMSP officers fired multiple rounds from their duty weapons, striking Rubio. Officers approached, handcuffed Rubio, and patted him down. As officers were about to render aid, emergency medical services arrived. rendered aid and ultimately transported Rubio to a local area hospital. When Rubio arrived at the hospital, he succumbed to his injuries and was pronounced deceased. No weapons were found at the scene. No officers were injured during this incident. It is important to note that the camera lens is fixed and does not capture everything seen or experienced by the officer. When activated, both audio and video turn on. The bodywn camera has a buffer of video without audio for 30 seconds prior to activation. This feature is designed to capture incidents that happen suddenly where an officer doesn't immediately activate the camera. All NMSP patrol units are also equipped with INCAR dash cameras. These cameras have a buffer of video without audio for one minute prior to activation. This video is from the perspective of the incar camera. Stay in the car. Stay in the car. Lift your hands. It is also the subject of an internal investigation by the department which is standard procedure. The investigation may take up to a year to complete. Our understanding may change as evidence continues to be analyzed and reviewed. The New Mexico State Police acts solely as a factfinder in its cases and does not determine whether the actions of an officer are justified in these incidents.
