This is the moment he was sentenced. >> Uh there was a negotiated sentence and uh that negotiated sentence was an adjudication of guilty on count one of the information by the state of Mr. Rodarte, which is a count for second-degree murder, that involved a sentence of 40 years in prison with credit for time served since August 5th, 2017. Uh in connection therewith the state had agreed to drop counts two and three uh with the imposition of court costs and a public defender's fee uh and we had a waiver of the pre-sentence investigation report as well. Uh we had determined restitution so with that said um Mr. Rodarte, I'm going to sentence you to the negotiated sentence in this case, which is to reiterate an adjudication of guilt on count one of second-degree murder and in connection with that adjudication of guilt, I will sentence you to 40 years in the Florida State Prison. You will receive credit for time served since August 5th, 2017.
