Hello, I'm San King County Sheriff Patrick Wro. At the Sanwaqin County Sheriff's Office, we understand that incidents involving the use of deadly force are profoundly challenging, not just for the people directly involved with it, but for our entire community. These moments can be deeply emotional, lifealtering, affecting families, neighborhoods, and of course, the public's perception of law enforcement. Every day, our deputies come to work prepared for uncertainty, knowing they may be faced with unimaginable decisions. Our greatest hope is that every call ends peacefully, that everyone, both our deputies and the public, return home safely to their loved ones. The use of deadly force is never the outcome we want. It is the last resort made only when there is imminent threat to the safety of our community andor our deputies. We recognize the concern and questions these incidents generate and we are committed to investigating them thoroughly but with compassion and the commitment to hold all parties accountable for their actions. You deserve the truth. We are dedicated to providing it as we navigate this unfortunate event together. Hello, my name is Heather Brent, public information officer with the San County Sheriff's Office. I will be providing you with an overview of the incident that occurred on April 7th, 2025. Shortly after 9:00 a.m. on April 7th, one of our deputies assigned to the community car program, which focuses on proactive neighborhood engagement, made contact with two individuals at East Side Community Park, also known as Delmare Park. This interaction followed recent community complaints regarding illegal dumping and homelessness in the area. The deputy approached the individuals after observing what appeared to be illegal dumping in the park. Upon contacting them, the deputy noted that their vehicle had expired registration and through further observation identified what appeared to be a rifle visibly located in the back of the vehicle. Following established safety protocols, the deputy asked both individuals to stop moving items inside the vehicle and to comply with his request. When asked for identification, the second individual became visibly upset. At that point, two additional deputies had arrived on scene to assist. During the encounter, the situation escalated. The suspect, later identified as Gregory Fitzgerald, attempted to flee, resulting in a physical altercation. Deputies attempted to use a taser to subdue him. However, Fitzgerald broke away and fled the area. During this confrontation, Fitzgerald made verbal threats, stating he had a gun and would shoot the deputies. Can you show me that online and show me online that Delvire 3221 02 Chevy out of Stockton with a release liability out of stock? I carry Okay. Yeah. So it's Yeah, for sure. Mhm. I got to get to work. Is that your guy's dog, too? Yeah. What's the dog's name? Daisy. Daisy. Daisy girl. Is What kind of gun is that? Pel. Okay. Anybody on probation? No. No. I'm not ready to go to work right now. So, here's this is what I got when I bought the car. And then that's the ticket that I got. Hey, man. You mind just putting that stuff down and hanging out? Just cuz I did see work right now. I understand that. But I just saw the uh what we call it there. I don't know. I just came here. I'm going to shoot you, [ __ ] A short time later, Fitzgerald was located on the rooftop of a home in the 5,000 block of Ardell Avenue. Deputies immediately surrounded the area, established a perimeter, and attempted to negotiate a peaceful surrender. It's important to note that deputies were acutely aware of their surroundings, which included nearby family homes and an elementary school preparing for student release. These community safety concerns greatly impacted decision-making during this incident. When deputies first made contact, they had no prior knowledge of Fitzgerald's identity or any criminal history. Over the course of nearly two hours, our team worked diligently to deescalate the situation through crisis negotiation. During this time, we were able to gather more information about the individual, including a warrant out of Missouri. Fitzgerald had plead guilty to seconddegree assault in February of 2015 after beating and setting another man on fire. He was sentenced to 15 years in prison, served eight, and was currently on felony parole with an active warrant for his arrest. He revealed that he had previously served time in prison, and made it clear, repeating multiple times, that he had no intention of returning, even if it meant losing his life. Throughout the standoff, Fitzgerald made continued verbal threats, repeatedly stating he was armed and indicating to deputies through gestures and hand movements that he had a weapon. Despite our ongoing efforts to bring the situation to a peaceful resolution, Fitzgerald repeatedly pointed what appeared to be a firearm at deputies and made direct verbal threats to shoot them. Members of our SWAT team positioned themselves on an adjacent rooftop on the parallel street, Carmelia Street, and a drone was deployed to safely monitor the suspect from above. All visual observations confirmed Fitzgerald appeared to be armed. What was the address of your emergency? Yeah, it's not a real emergency. Had a guy jump my fence. I hear sirens in the area. I don't know if the sheriff What's the address? Um, it's sloped, so he was left on top. I know he's laying prone or what? I thought we saw that tree move. Okay. Your [ __ ] ass. Well, you know we're not going away, right? I don't care. I'm not going down either. We're going to get you I'll stay up. I prefer you to come down nicely. Do you have a gun on you? Yeah. What kind of gun? This is a little one, but it's got enough shots on you guys. Okay. Well, I don't want you to use the gun. I don't want to use a gun on you either. Shortly after 11:00 a.m., Fitzgerald suddenly took a seated shooting stance, raised his arms in a manner consistent with aiming a weapon at deputies. Believing their lives and the lives of others were in immediate danger, a SWAT operator on the rooftop and two deputies on the ground discharged their weapons nearly simultaneously. Each acting in self-defense or in the preservation of the life of another. Fitzgerald was provided medical aid and transported to a local hospital where he later succumbed to his injuries. Don't do that. Just lay down and relax. Listen, if you want to take a break, just lay down and relax. Don't do that. It was black. It was black. Don't do that. There's no reason for that. That was something black. That happened in the drone. Why is the drone maring? Same black object. They can't confirm. Hey, lay down and take a break. Don't do that. Don't do that. Godamn. Shots fired. Sudden shots fired. Greg, lady, were you all right? No, he pointed something at us. In accordance with Assembly Bill 1506, the California Department of Justice, also known as DOJ, will assume the lead on an investigation into the actions taken in an officer involved shooting incident if the shooting is what the assembly bill defines as an unarmed person. An unarmed person is defined in that assembly bill as anyone who is not in possession of a deadly weapon. In this case, as you saw in the video, the suspect stated multiple times he had a gun, which obviously is a deadly weapon. He said he was going to shoot our deputies and held and brandished an object as if it was a deadly weapon, but the object turned out not to be a gun, as he had stated. Therefore, the Department of Justice team took the lead on this investigation. We are fully cooperating with the continue and continue to support the process of this investigation in any way that we can. As we continue to cooperate with the DOJ investigation, we ask for your patience and understanding. Both the Department of Justice and the Sanwaq King County Sheriff's Office are working diligently to uncover and present the facts of this incident in a timely and transparent manner. We want to thank the nearby residents and the school staff for their patience and cooperation during this difficult and evolving event. We understand the fear and the uncertainty these situations may cause and our priority throughout was protecting the community and resolving the threat as safely as possible. We also want to express our sincere gratitude to the California Department of Justice for leading this investigation into this incident and to AMR for their prompt and professional medical response. And of course to our dedicated dispatchers whose coordination and support were invaluable throughout this challenging situation.
