The following video provides information regarding a US Border Patrol involved shooting that occurred on May 16th, 2024 near Kimado, Texas. CBP is committed to being a leader in law enforcement accountability and transparency. A portion of this incident was captured on multiple agents bodywn cameras. That footage is being released today in compliance with CBP policy. CBP began issuing bodywn cameras in 2021 and continues to expand their deployment nationwide. Bodywn cameras are worn at chest level and capture a general perspective within the line of sight from that angle. The camera angle prevents viewers from seeing everything the agent or officer saw and experienced. Activation of the camera enables both audio and video. However, there is a continuous 2-minute buffer of video without audio prior to activation. This feature is designed to capture incidents that occur suddenly where an agent or officer does not immediately activate their camera. On May 16th, 2024, at approximately 4:24 p.m., a US Border Patrol agent reported footprints from a group of five to six individuals approximately 200 yd north of the border and 20 m northwest of the Eagle Pass port of entry. The agent used his service radio to notify other agents in the area as he tracked the group. At approximately 4:40 p.m., the agent advised over service radio that he could hear noises in the brush and was trying to determine if he had located the group. Approximately 10 minutes later, the agent broadcasted over service radio that he had encountered a combatant subject and requested assistance from other agents. The agent attempted to detain and place handcuffs on the subject. However, a struggle ensued and the agent was only able to get one handcuff on before the subject fled. The agent pursued the fleeing subject on foot while issuing commands for him to get on his knees. During the foot pursuit, the subject stopped on multiple occasions and swung multiple tree branches at the agent, striking the agent in the head and arm. While continuing to try to detain the subject, the agent used a collapsible straight baton and delivered several strikes to the subject's legs, but he did not comply. At approximately 4:52 p.m., the subject picked up a larger tree branch and swung it at the agent. The agent fired one bullet from his handgun, which struck the subject in his right leg. At approximately 4:53 p.m., the agent applied pressure to the gunshot wound. Approximately 5 minutes later, a Border Patrol Emergency Medical Technician or EMT arrived on scene and assisted with medical care. The agents continued to apply pressure to the wound and applied a tourniquet to the subject's right leg at approximately 5:00 p.m. The following are US Border Patrol radio transmissions from the incident. At approximately 5:12 p.m., the subject was transported in the bed of a service pickup truck to the Border Patrol agent EMT's vehicle with medical equipment for additional treatment until EMS could get to the scene. At approximately 5:25 p.m., EMS arrived on scene and transported the subject to a medical facility in Eagle Pass, Texas for additional medical care.
