You don't have a phone with you? Okay. Is this door unlocked? Okay. How long have you been here? Um like I think like an hour. An hour cuz he went to go and train someone just for like hour 30 minutes. Okay. All right. Did you talk to your mom today? Um yeah. All right. And you don't you don't have a cell phone? Um I currently left it at my mom's. Oh, your mom's okay. Is there a phone in the house? There's no phone in this house either? All right. Do you know who the people are who live on the other side of the house? Have you ever met them? No. Okay. All right. We're going to talk to your mom real quick. Okay. Do you have any siblings? Any brothers or sisters? Um I have one that went to college. Went to college. Okay. And what was your So, we're just here to come check on you. Okay. We just come to make sure everything's okay. She was a little she was a little concerned. She just wanted us to check on you today. And is there is everything okay at home? Yeah. Everything's okay with you and your dad. She says she's fine. Even made herself breakfast that morning. Officers are impressed but still concerned. Do you feel safe? Yes. You stay. Do you typically stay home sometimes? Because he his job is personally to train people. Mhm. Um because they don't let like people going to the gym like under 14. All right. So I have to stay here. Okay. Do you know what gym he trains at? Um Planet Fitness. Planet Fitness. Okay. All right. Um he just took You take an Uber over there. Okay. And no cell phone, huh? Okay. All right. We're going to close this door. We're going to come back and talk to you in a second. Okay. All right. And how old are you? How old? We already went over this. Yeah. You were born in 2015, right? Yeah. Remember I told you now you don't you don't ever have to lie to us cuz we're just here to make sure you're okay. Okay. Does your dad tell you to say that if someone shows up? Um, no. Well, I just Like I said, yours is about as old as my son. So, sounds like you know how to make breakfast. You know how to take care of yourself. It's pretty good. She made a Captain Crunch pancakes. Captain Oh, yeah. Put syrup on them. Yes. Crunch berries or just regular Captain Crunch? Captain Crunch. Just Captain Crunch. Who made them? You made them? Was your dad here? Did you make pancakes for him, too? Yeah. Yeah. Okay. You're supposed to go back with mom tomorrow. Sunday. Um, no. Tomorrow. Where's your dad? You don't go back sometime tomorrow, Sunday? Where do you go to school? Um, Fairview. Fairview. Fairview. Where's that at? Being eight and home alone with no way to reach help in an emergency is not considered safe. They call her mother to come to the home while trying to contact the father. You school tomorrow? Um, Monday, Labor Day. Oh, it's a holiday coming up, huh? Get three days off. All right. So, this officer may have already explained it to you in that, too. But fact that you're 8 years old. You're a little bit too young to be home by yourself with no way to call anybody if you needed anything. You don't have a phone or anything. One time at my mom's I stayed home. Yeah. I told you the importance of at least if you had a phone or something like that if there's an emergency. That's why it's important. I do have a phone in the house. So now you do have but with no service. Oh no service. Okay. Does it have Wi-Fi? Do you do you I do have Wi-Fi. Do you text people on your phone? I cannot. You cannot. Okay. Is your dad's number on your phone? No. Is your dad's number written down anywhere? Like on a piece of paper on the fridge or anything? No. Okay. And your dad took an Uber? Yes. Okay. So, I just talked to your mom. All right. So, we got to figure out Can I have you hanging out here by by yourself? All right. So, I talked to your mom. Your mom's going to come. She's in route. She's going to come over. Okay. And try to get a hold of your dad in the meantime and figure out what's going on there. You think you went to Planet Fitness? Yes. Yeah. Okay. He went to Planet Fitness to Transport. All right. Do you know what time he left? Um, not exactly. How about roughly like an hour ago? Um, 2 hours ago. An hour and 30 minutes. An hour and 30 minutes. He said he would be back in an hour and 30 minutes. Hour. Despite her ability to take care of herself, the officers still insist that she should not be left alone no matter what. Okay. I just went doing my daily routine shower. Yeah. Yeah. I can tell you took a shower. Your hair's still wet. Okay. Yeah. It's not that we don't think I'm sure you're you're able to take care of yourself and everything here, but you are a little young though. 8 years old, not 13. I knew you weren't 13 when you told me you were 13. Well, that's good that you're self-independent. You can take care of yourself. Like I said, it's just uncomfortable knowing that something goes wrong, you don't have anyone contact. Okay. All right. So, we're going to uh you get mom back on the phone and see how long it's going to take her. She said about 45 minutes, but Okay. She's calling to see if any further. Do you uh do you ever stay with anybody else in Santa Fe? Do you have any aunts or uncles or cousins or no? Just an espanol. All right. Is it your mom's family in Espanola? Yeah. Okay. All right. We're going to stop by. Eventually, the father returns. How's it going? Good. You kind of Hey, we got called to do a welfare check for your daughter. Oh, yeah. They said they were concerned about her. I guess you guys had a dispute with mom yesterday, right? So, we came by earlier and we were talking to her now. Is she here by herself? Well, uh, they were here, but I just went she just grabbed something so she could give me this just right down the road. So, I'm now here with her, sir. Oh, is it her birthday? Yeah, that was just a friend just right down the road that she wanted to pick this up. So, I just said, "I'll be right back." Okay. But the people that I live that are our landlords were actually here when she was pregnant. They were here earlier. Yes. All right. Yeah. So the issue is that she's eight. When we knocked on the door, she told us she was 13. Why? Yeah. Cuz she probably knew not to say she was eight. Okay. So we were talking to her now and I mean she's in the house. Every obviously everything's okay with her for sure. But yeah, but she is too young to be left alone in the house, right? There's no specific age, but she's since she's a juvenile and she's under the age of 12. Okay. So 12. Yeah. The state. Well, it's it all depends on individual, but age's too young, especially if they had no phone, no way to contact anyone. Okay. So, cuz she doesn't have a cell phone or anything. She does. She does have a cell phone in the house. Yes. She showed me a cell phone. Is it just Wi-Fi though? Yes, it's connected to Wi-Fi. She's able to call connect. So, you can contact her. She can contact you. That's like I was right down the road just getting this. That's why when I I didn't think it was a big deal to come cuz she was right down the road. Yeah. So, but you had the phone. What's that? You weren't at Planet Fitness? No, I'm not at Planet Fitness. Okay. They said that you were out training somebody. What's that? They said you were out. She thought you were out training somebody. Somebody picked you up. No, train someone. This is She is a trainee, but this is to her. Yeah, she just started. So, we told her, I mean, the biggest thing is, yeah, she's still a little young. She seems very self-independent. She makes herself breakfast and cleaning up. So, that's good that she has all that stuff for sure. I appreciate you and everything. literally right down the road. But officers still explained that legally there's no specific age set, but children under 12 should not be left alone, especially if they can't contact someone in case something goes wrong. Everything's okay. Um, so 12 years old is well, it's all there's no specific law on it. So, as far as 8 years is way too young to leave a child alone in the house. Okay. So, yeah, even to go out for a while, there's it's it's considered child endangerment. Okay. cuz they there has to be an adult with them at that age. Especially if something happens, they need to call somebody. There needs to be somebody with them. It's just the whole thing that you don't want to be liable as a parent. That's the biggest thing. Something did go down, she did walk out, something happened to her, then it would be, you know what I mean? Child neglect and so that's something we don't want to happen. Of course, and I wouldn't want to predict either, but I know my daughter too and I know how intellectual she is. I know how advanced she is. It's the only reason why I would come down. Yeah. Um, but no, everything's good to go. She was just given this for me to get our goodies cuz she just weren't getting it. All right. All right. So, just give heads up. It's got to be documented report and everything. Okay. So, there'll be a police report document in that we contacted her here and we contacted you. Okay. Cool. All right. So, yeah, mom mom called. She said that she dropped her off yesterday or the day before and they got things got heated. Uh, so they tried to drop my daughter off there on COS uh right by the um it's like an oil place. It has fencing all around it now. Pet Boys. Yeah. She pulled over on the corner of the street and tried to have my daughter get out of the car right there in the middle of traffic. Why did she drop right over there? I'm not here. She was here, but I told her that I was at Planet of Fitness yesterday waiting to come back. And I said, "When you come into town, let me know and then we can meet cuz I'm at the gym. Obviously, I'm not leaving the gym until you come and then we'll do our own thing." Okay. But regardless, her her boyfriend is the problem. During the conversation, the father talks about previous issues with a child's mother and her boyfriend. Doesn't matter what goes on, he always throws his two cents in and he just needs to sit in the seat and shut his mouth, but he's the one that causes the problem. So, he's the one who will run his mouth when you are around. Yeah. When you're not around, he don't say, right? But here's the thing. If this guy is driving and he has my daughter in the car and he pulls out in the middle of the road to let her out, the doors open. and they're yelling at me, waving their hands. She has her seat belt off and there's traffic, dog. So that's why I popped off and I said, "Pull the door." I said, "Go around, you idiot." I said, "What are you doing here, bro? How are you going to let my kid out in the middle of street on you know?" Well, I've been hit three times here in the city while while walking. Okay. And I've all three times been left for [ __ ] So I know exactly what it's like out there. So when he did that, they pulled over. I control that vehicle. That was your choice to do that. And then they came up with this whole hoax saying that, "Oh, we weren't going to let her out. We would never do such a thing." Why was she unbelted halfway out the seat and from the middle seat and the other kid with his legs getting out of the vehicle and you're saying you're not going to drop off my daughter in the middle of the street? Yeah. So yeah, I popped off and I get off. That's what it was about. Yeah. And I talked to her and I said, "Are you okay?" I said, "Cuz this has happened before when we lived at the old old place." And then he brought the cops. And I'm like, and he still ran his mouth and you guys aren't around. You don't see the boyfriend. He's a coward. And so I stand my ground and I stand up for her cuz she doesn't have a voice to say it on her own. And her mom, chooses. This is also Judge Madrid's daughter, my ex-wife. Mhm. That's I'm dealing with and have been for eight years. I got the [ __ ] the stick and I'm still keeping my cool as much as I can. But once this piece came through and he's starting to treat her differently, yeah, I'll put him in his place and I'm [ __ ] but I won't do anything to lose her. All right. So, in the event they will envelop it to make it sound horrific. It's clear the situation is part of a bigger conflict between the parents and the child is caught in the middle. But that's they're they're two narcissists working together and they all they want to do is make us miserable. All right. They don't give a about how they make you personal. So, I completely understand um with her. I know what I can and can't do, but also I don't even know, but it's kind of a gray area anyway. It is. In the event, I know she's solid. Just like we said, more than likely, I could tell you trained your daughter very well. She's very She could take care of herself. And I mean, but it's just one of those herself. Yeah. Which like we said, it's just one of those things. It's almost mental. I think if something does happen because of the age and that goes to court and it looks an 8year-old left out here, got hit on the street, it'll just look bad. You know what I mean? So, we get that. So, like we said, it'll just be documents. It's just going to be a documented report. So, it's not a problem for me. Yeah. I'm all Now we know what to do in the future. Yeah. Yeah. I'm sure that phone there, if she does, you have another phone. I have my phone. My cell phone. She has her cell phone and her the iPhone. Most of the time she actually carries the Tik Tok watch which is video. So that way it has GPS and it has everything. So she squared away on all communication level. If anything pop off. That was the biggest thing is we talked to her. We didn't have your number. So we had no choice but to call mom. Okay. She gave us your number. We could call you right away. So but I told her we're here to help protect. So how did you know her mom's phone number? She called. That's That's how the wife got us because without the airspace, she just wanted us to just make sure she was okay and everything. So, did you do you think mom possibly knew you weren't here? I have no idea. Had you communicated with her at all? Nope. No. Ever since last night, there's been no communication, no indication of what we're doing or itinerary. They're in Albuquerque doing okay. She can't Your daughter can't text her on like Wi-Fi or anything? She has the phone. She can call and text. So, she can call and text in there. So, that Yeah, possibly. Okay. When I go in, I'll see her. Well, I'll just ask her and see what what what went on and that's all that she'll be honest and she'll tell me what's up. Well, it's the mom that's the he's a liar. The officers don't make any arrests, but do file a report to document the visit. They stress the importance of communication tools and supervision when leaving a child at home. She's two faced. So, unfortunately, that's what we're doing. Yeah. But I appreciate you guys having that bond of trust with your daughter. Of course. That's my main thing. Well, I fought long and hard if knew what I went through just to be in this just just my daughter's life. You know what's up. You have respect for it, too. And then you realize and sometimes people like Kobe went through it years on years and he finally won. Well, I don't have millions of dollars, but I'm [ __ ] it penny by penny with no help. And that right there, I don't even need to brag cuz that's what a dad does. Exactly. So, I completely understand it and I apologize for No, there's no apologies. It's our job, man. No, thanks for talking to us and explaining to us what's going on. Of course. So, we'll get back. You better understand the circumstances cuz this has been a riff and it's starting to now be. So, you guys might be present more often. Yeah. Because of him, not because of her and her I've actually that's the one that I'm going with. Yeah. When he's around, he says the right thing and he just keeps on that's it. I've got two moment you straight up and at that point. We've already come to the point where I said anytime, any day. He says, "I know you could me up, but I'll meet you." Yeah. There's a line. Don't let him in. Yep. Yeah. Birthday presents for her. But yeah, home girl. She hooked it up. But, uh, yeah, that's what they've been trying to do. Like I say, their goal is to try to, you know, get a wife. Okay. All right. We're going to talk basic with her in that. Take it easy. All right. Be careful. In the end, no one went to jail, but the child came out looking like the only grown-up in the room. Number four, mom arrested for DUI. Toddlers discovered alone and unsupervised. Police respond to a minor traffic crash at an intersection. When officers arrive, they speak with the woman involved. Crash, please. Hey, uh, do you have one that's, uh, more current? I know you dropped one. Is that No. Um, thank you. I'm so sorry. Um, what what is that one? This one is from Dece June of December of 24. And do you have one in your name, too, or no? No, this is my husband's. Yeah, I saw the name. Let me let me take a look at the other cards. Um, um, this is my husband. Okay. Can you want to see if he can send you a picture? Um, I'll give it back to you for now. Yeah. No, no. Is he at home? He's not. I I don't have my park like my phone with me at all. Okay. All right. Okay. All right. Just sit tight for a minute. I I can give you my like I can get like the phone. What do you mean? Number for him? Yeah. Yeah. Go ahead. You want me to tell him that you're okay and I just need the insurance? Yeah. Okay. Yeah, I can do that. Okay. All right. So, I'm wrapping up most of the paperwork right now, but I got some questions and stuff I want to talk to you about. Okay. Can you turn the car off for me? Yeah. Okay. All right. So, you're coming from Prairie. From Prairie. And that's where you live. Yeah. Okay. And you have kids at home? I do. Okay. How old are your kids? Two and three. Who's with them right now? My husband. Your husband. Okay. You said he was at work, but he's at home. Yeah. He works from home. Oh, got it. Okay. Does he know that you left? Yeah. Okay. All right. Uh, what were you doing before you came out here? You're at home. Okay. What were you doing at home? With my kids. Just with the kids today and the family. Okay. Have you had anything to drink today? No, sir. No. Any Do you recreationally smoke marijuana or anything like that? No. Nothing. Do you take any prescription medication? No. I mean, what prescription? Like anything that Do you take anything? No. Like anything that they tell you to be careful if you're driving or operating heavy machinery? Nothing like The officer asks her to perform a series of sobriety tests. All right. Um, what's your highest level of education? Um, bachelor's. Bachelor's degree. So, you have college? Yeah. Okay. So, I'm going to ask you to do two things for me. Okay. The first one, I want you to say the alphabet for me. I want you to start at E and I want you to end at W without singing. Okay. E F G H I J K L M N O P Q R S T V W X Y Z. Okay. All right. And then for counting, I want you to start at the number 67 and I want you to count backwards down to 43. Okay? 67 66 65 63 64 63 62 61 60 69 58 57 56 59 54 53 52 52 51 50 49 58 57 56 59 54 53 52 51 50 49 48 57 46 49 Okay, 48 47 45 44 43 42 41 4 All right. Do you remember what I asked you to stop at? I don't 43. Okay. All right. What I'm going to do is I'm going to have you step out of the car. Okay. Come stand here for me real quick. This is my uh my burn officer. He has my other burn officer. He's our community service officer. So, he's just he's here just in case cuz didn't know if there was injuries. Step right here for me. So, I'm just going to face me. Just stand just like this. Put your feet and heels together and your hands on your side. Okay. Do you wear any glasses or contacts? Nothing. Do you have any eye injuries or abnormalities? Okay. So, what I'm going to do is I'm going to take my finger and I'm going to move it from side to side. And I want you to follow it with your eyes and your eyes only. Okay. So, don't turn your head. If you need to blink, you can blink. Okay. So, I'm going to start out. Just look at my finger. Just a tip. Officers guide her through physical coordination tests and she continues to have difficulty completing them properly. Don't turn your head. There you go. All right. Can you see my finger clearly? Yeah. Okay. All right. That's just to help you so you just kind of get an idea on how it feels. Okay. All right. And now we're going to go up. Keep your chin flat for me. There you go. Okay, we'll try that again. Don't move your chin. All right. All right. So, what I want you to do is I want you to stand face this way for me. Stand just your hands and heels together just like this. Hands straight down at your side. Okay. What I want you to do is I want you to take your right foot and I want you to put it heel to toe just like that. Okay. Sorry. This is just instructions for me. Okay. So, stand just like I am now. Your right foot. You're going to put your heel on your left toe. Don't Yep. You're just hold it like this for me. Okay. Alyssa. Step back for me. Oh, no. We're not going to start yet. I'm going to give you instructions and I'm going to show you how to do it. Okay. You understand what I'm saying? Just stand there. Just watch me. Don't do anything. I'll tell you when to move. Okay. Okay. You understand? Yeah. Okay. Feet together like mine. Go ahead and move. Her behavior, slurred speech, glassy eyes, and confusion makes officers more suspicious. Now, put your right foot in front of your left foot and just hold that position. Yep. Stand just like that. Hands down at your sides. Okay, just put your hands at your side like that. Just stand just like that. Okay, just hold it. When I say begin, you're going to take nine heel to toe steps in the straight line right in front of you the width of your foot. You're going to count your steps out loud in the following manner. One, two, three. When you get to nine, you're going to take a series of small steps back and you're going to do nine heel totoe steps back. Okay? It's okay. Take a deep breath. So, just like this. Don't start yet. Don't start looking at me. Don't start yet. Just like this. You're going to go one, two, three, all the way until nine. Keeping your lead foot on the line. A series of small steps. Look at my foot, please. Just like that. And then turn around to do nine. One, two, nine. Right. Once you start, don't stop. You're going to look at your feet while you walk and count your steps out loud. Do you understand? Yes. Okay. You may begin. So funny. 2 3 4 5 6 7 8 9 1 2 3 4 7 6 8 9 All right, thanks Thank you. All right, one more. Okay, you want your feet like just don't just just like this? Yep. You want to put your hands in your pocket for a second? I know your hands are cold. No, it's okay. Sure. All right, stand just like this. Finally, the officer subject her to the one leg test. Begin. You're going to pick a foot, either foot of your choosing. You're going to raise it 6 in off the ground. You are going to look at your toe of the raised foot. You're going to count out loud in the following manner. 100,00 one 1002 1003 and so on until I tell you to stop. Okay. All right. Are you ready? All right. Let me begin. 1. Okay. Just pick your foot back up and keep going. 100,002 100,000 9 10 11 I'm okay. No, no, it's okay. No, it's okay. No, no, no, no, no, no. It's okay. Okay. Are you hurt? Nope. I'm not hurt. Go and put your hands in your pocket for me. No, it's okay. No, put your foot back down. We're done with that. We're done with I have a question for you. Okay. I'm going to be very honest with you. Okay. Have you had anything to drink today? Nothing. Zero. Okay. Have you taken any anything that's in Have what? What you have? I have I have like mabilizers and I have So, you're on medication right now? Yes. Cuz I can see it in your eyes. Okay. I took a and I took other earlier and I am so sorry. What are your other earlier? You have a what do you take that for? Anxiety. And how about depression? Depression. Eventually, she admits to being on prescription medications, including mood stabilizers and pills for anxiety and depression. Do you have any of those on you right now? No, I don't. When's the last time you took your meds? Um, noon. How often are you supposed to take? Um, take like at noon. And is I take you, but I took it at like 11. Okay. 11. In the morning, right? Yeah. Okay. All right. What I'm going to have you do, this is for alcohol only. Okay. What I'm going to do is I'm going have you take a deep breath and you're going to blow it up like a balloon and you're going to blow until I tell you to stop. Okay? I don't want to do that. You're going to refuse? Okay. Cuz I'm going to tell you that I can I smell alcohol as soon as I talk to you in the car. Okay. Your speech is slurred. Your eyes are glassy. I'm getting a lot of eye movement on my gaze and I stagmus. Okay. I would like for you to do this. Are you refusing to do this? This thing's not going to go to court at all as far as that part. It's a prelim preliminary portable test. Okay. It's just to help us gauge where you are at. If you're like a 0.07 0.08, right? Because you're having conversations with us, but I do smell it too. Okay. And it is noticeable. So, if we're maybe I mean it depends on what it gives us a better accurate reading. Otherwise, if we don't have an accurate reading, we have to go off of what we see. And we have a strong odor. You're you know, as you saw the test, we're not exactly one for one the best. So, this gives us a better understanding at where you kind of are at. That's why it's I would say it's beneficial if you did, but the ball's in your court. Okay. So, can you give me what if I did and what if I didn't? So, I have to make if you don't do it. If I don't do it. No. No. If I don't do it, what then I make a decision based on what happens next based on what I've observed with my perception of the odor of alcohol, your eyes, and the test that you conducted for me with your counting and the alphabet. This just is part part that helps me make a decision. Okay. Okay. Are you willing to do it? If I don't, if I'm not willing to do it, what are my options? Well, he'll have to make a choice whether or not to arrest you or or arrest you. She continues to deny any alcohol use, but officers clearly smell it and tell her as much. Will she agree to take a breathalyzer test? Let's find out. If he will arrest me, but if I not saying that's a guarantee guaranteed answer, it depends on his choice and what he wants to do as a primary officer. If I if I was I'm not the one here. Here's here's the thing. I genuinely want to know here. How about this? I'm not the one making the decision decision. Okay. But I'm his backup officer. If I was in his position, I would arrest you if I don't have a PBT accuracy. If I don't have an accurate number, so like obviously we have problems if we're like 0.1, right? Like triple the limit. We have problems. I don't think you're there. I can only see and observe based off the fact that I see a hand. Okay. Does that make sense? No, it doesn't. So this gives us an accurate reading as far as that hand. Melissa. Okay. It's cold out here. I know you're cold. I know they're cold. I need an answer. Yes or no? Yes. All right. Here. [Applause] You want to any point press charges on him or not? Okay. I've got admission. I'm going to observe these ones also. Well, he admitted he didn't pay for those. Wow. And there's a there's a security on this. Okay. Um yeah because the thing is I saw her with the same t-shirt walk in saw her and we just have discussion receipts. Yeah. All the easy stuff I know what he got but everything else he just came with that I don't know what. Okay. So if you want to communicate with him to get those receipts you can send you those receipts or I have receipts. I didn't know you got it. Okay, sweetie. Just take you and go. Yeah. For now, everything stays until we can sort everything out. Thank you. No, with that one. But how long you guys So, I'm sorry. How many days? Till Tuesday. We leave Tuesday morning at 6:00. So today, Friday, Saturday, Sunday, Monday. So 5 days ago. Um, so then you guys went into is it a Hello Kitty store over here? That's right at the backpack to come across the street for and that's where everything happened. Okay. So why did you take the backpack out? I should have I should have left it in there. I came to get her card out of her little Wolverine um fanny pack. Okay. So my daughter's in the store. She said, "My fanny pack's there. I just got it, went across the street. So, who's with the stroller? My husband was supposed to be with the stroller. My 15-year-old used the restroom. So, I got back. He's gone. My 15-year-old standing there with our stroller. Okay. And then, so you left the store with the backpack to get her card, her backpack or her backpack. Where was your purse at? Your your coach purse? That was on me. Okay. So, that has money in it. Why wouldn't you pay for it? Because she's paying her own money. She's had water bottle sales, chocolate sales. She wants to spend her money. That's our money for competition. Does your daughter have a phone? Oh, yes. Okay. And you had a phone? So why wouldn't you call your daughter to come into the store? My daughter's with you. She explains that some items were supposed to be purchased by her daughter using her own money, but no receipts can be found for most of the items. She was with the So why wouldn't she go out to get her money? my dad walk the store right here by the door when she was standing by the door as she watched me look for everything. I'm talking to my kid about where their dad is when they get there because he's not there. So, as I'm having the conversation with the backpack, then they come up to me and this is not she was buying more stuff. She was holding more stuff in the store that she was going to purchase, too. So, it wasn't just the backpack she was going to buy. What? So the the distance of what maybe 10 ft. You didn't feel comfortable enough leaving your daughter in the store? No, she stayed in the store. Well, that's what I'm saying. I'm sorry. You didn't feel comfortable enough to let her go to the stroller where your older son was at? No. I wanted to make sure all my kids I did not I didn't see him there. That's why I walked across cuz it was only my four-year-old, my three-year-old, and my 15-year-old son. So, I didn't see him. Do you Do you ever leave your daughter alone with your No, my 15-year-old. Yes. Okay. So, she was with my babies. Okay. But if you saw him with the stroller, like you just said, he was standing there the stroller with the babies. Then why would you feel comfortable letting your daughter walk to the stroller to get I don't I'm just trying to understand then cross the mind just go across get her thing and come back all the stuff she wanted. So I was like you just slipped up and you just forgot to put the Yep. Okay. All right. So tell me about all the other property that was on the stroll. Like I said, everything was there. I've been into Moles. I went into Crusty Burger. I ordered my son this. My husband's by myself with my daughter. So, what he did? I Did you buy that today? They had the receipt for this. Yeah. But did you buy that today? Yes. Okay. So, you bought that today. The receipt for that is in your bag. No, they already showed it. They took it out. Yeah, I know. Cuz I found it in your bag. Okay. Um Why wouldn't the receipts for the other merchandise be in your bag? This is all I bought. Okay. So, where did the We all have our own menu. Like I said, I don't know. My husband was by himself. While trying to piece the story together, officers find more inconsistencies in the stroller cuz I walked Okay. My husband was standing with the stroller with all my kids. I walked across the thing looking for my husband that had the stroller and he was gone. That's why I told my oldest son where I'm not asking about the backpack anymore. I'm asking about all the other merchandise that was found in the stroller. I know. So that just you were never with your husband in any other store that So why don't why are there any receipts for that? There might be. He said the everything ET he has receipts for which he's looking for right now. But he said that he took two backpacks is what he told me. So I'm not right now. All I did was take two backpacks. Okay. How much money did he bring with him today? How much did he bring with him today? Maybe $1,000 in cash or card? Cash. So every time he went into a store, you guys What? What did you do? What did he do? I do. What did you do? Walk my kids around and see what they want. We only been in two stores. Okay. So you were So like you said, none of the cameras of the stores will show you with him at any point. No. Okay. Um, I mean that's a lot of merchandise and a lot of that stuff has the security tax still on it. Did you not think that was weird why it had security? I didn't look at anything he bought. He was like all excited. I bought this for so and so. I bought this for so and so. Did you find it weird that I thought that he had money? He bought it. Did you find it weird? So I didn't think any of it at all. Did you find it weird that he brought the merchandise to you not in bags? They were in bags. Well, when we were standing out here at the restroom, he walked up and none of the merchandise he had in his hand was a bag. When he walked up, I didn't see what he walked up, but every other time he's walked up to me, he had bags. Police work closely with loss prevention to gather all the details of the theft. So, real quick, just so can I hear what I'm going to um you saw her in the stroller walk in with the stroller and all those bags? No, no, the stroller was over at the restrooms when I first clocked her. I was walking up uh from uh north deeper into the park approaching the restrooms and the I was in the street approaching restroom on my left. So the only thing you saw her take from the store was that back. Yes. So what I saw is I saw her with the stroller. I saw her leave the stroller across the street walk from the stroller into the store. Since I had observed there was a lot of merchandise in the store. I thought I'd walk just walk in that store as well just to observe what she did. I observed her approach the display for the backpack. So sling the back over back over her right shoulder. transerver exit the stroller without paying and go directly back to the stroller. When she was at the stroller, she took possession of it, tried to bag up the backpack that she had not paid for in a bag that was hanging from the stroller. Gotcha. Um, so when you went, so you said you you left the store, you walked over to the restrooms um to check on your kids. Well, not to the restroom, to my stroke, but I was by the restroom. Right. So you walked over there um and you were to check on the kids, right? Well, to get the card out of my my her card out of her family back on there. Oh, that's right. Yeah. And then once I saw the dad was missing, I'm like more focused on where why do you need my kid and where did you go? Okay. So, why did you put the backpack inside the merchandise bag? I sat it on top. Look, it was sitting on top. I had not put it anywhere. I was more worried about why my kids were not being watched by my husband. He has my 15-year-old there, but he can't handle two little babies that long. Okay. So, tell my son I'm going to the restroom and then leave. It's wrong. So, the Op security is saying that you were trying to put it into the merchandise bag. No, I had it on top. Like I said, the bag was open. I put it on top. I'm talking to my son like, "Where's your dad?" Blah, blah, blah. Left my daughter in the Hello Kitty store before I start to go back in there with her. Why did you set the backpack on top? I don't know. I shouldn't have. It was just like a like a fasting. As the investigation unfolds, the woman repeatedly denies any wrongdoing, claiming she's never stolen a thing in her life. Like I said, I've never stolen an apple in my So the So the bag the bag was open and you put the bag on top. It wasn't open. It was on the thing. I sat it on top the bag. So the bags are closed hanging over and I sat it right there. So you basically rested the Hello Kitty backpack on top of the bag like that. It wasn't a Hello Kitty bag. It was a ET backpack. Oh, the ET whatever the backpack was cuz there's another Hello Kitty one in there. So the bag is closed hanging on the stroller and you put the backpack on top. Yeah. Like I said like this. I'm going to stuff telling my son, "Where's dad?" He's like, "I don't know. He's not in the restroom." We took off. And I'm like, at that point, I'm more worried about where the hell is. I was going to walk. Y'all give me two more minutes and see me walk right back inside cuz that's how I am. I've never stolen anything in my whole life. Not even Is he still out there? her husband or counterpart investigatively. Okay, that's understandable. Just because I was getting the same sense that maybe he was doing more of the stealing, but I observed her steel. I still think she she I think she's she's a part of it because she she stole one of he was making security. All right, copy. It wouldn't be in the report because they only stopped the line. Yeah. Yeah. So, how does that work? Are you guys going to press because he didn't observe him? That's the problem. So, he would only be able to do it on the person. He's texting her right now trying to We have showing up. There's no personel here. No, no, I'm just saying. I don't know how you guys operate. So, the other guy, too. He wants to come with us. Like, no, dude. Stay out there with the kids. But the evidence says otherwise. Over $1,100 worth of merchandise is recovered. Much of it children's items. Some already bagged, others still with tags. Who was actually stealing? They caught her. But yeah, he's like taking a mission pretty much for everything. He was walking away from the group. Yeah, they had the tags and I don't know what they're going to do. I don't know if they're going to do both or one or we're just going to go on her. Okay. Because we don't want to do both. Yeah. Yeah. Unfortunately, she's the one [Music] of these hoodies. Yeah. Yeah. Every single one of these hoodies still has hang tag. How much is the hood? Can you just show me the hang tag that you would take off? Yeah. I got it. Not everything. I got the party requesting. [Music] That's what he was carrying, right? carrying this um one of these. That's the one that And then this is the one that that that way he observed her to remove and take out and attempted. And then what were those key chains that took out of her bag? That way I can just cut and paste. There's a couple here and there a few right here. Yeah, those were all the ones that I The woman is arrested and charged with grand theft. The children are released to the father. Number two, neglectful mom's day goes from bad to unthinkable. Officers respond to a call from a medical facility after staff report a child has been left alone for over 30 minutes. Here's what happens when the officers arrive. That we at first we could not find where she was. We even came outside to ask a little girl what car and she said she didn't come. She came by taxi. We didn't realize mom had been sitting out on the bench. So I come over to her. I said, "Do you realize you've left her for the last 30 minutes? We don't know where you've been. You weren't in the bathroom." She had our key. And then she told me, "Hold on. I'm on the phone." And we're like, "What?" And like we just took her now. Like she does not even care that we Is that Yeah, that's her. Uhhuh. Where's um where's the problem? Is we have her? No, I asked um I called to make sure somebody could talk to her. We don't have any. No, there's no there's nobody on you get one of the girls that has the girl. Maybe if you want to say the other girl. Is it one of your girls Spanish or No, she doesn't speak Spanish. I can grab Ariela. Or if not, I have a girl that's with the little girls. She's she can speak uh Spanish. Okay, I can get Ariel out if you want. Like she doesn't even matter that we've had her. Like I literally took her back inside. Yeah. Um to make sure that she's okay. Cuz at some point I figured what happened if this is not really her mom and they've kidnapped her, you know, kid trafficking. I don't know. I mean, for her not to care, like even that guy was sitting there. He's like, "Something's wrong with her." Where's the little girl now? We took her back into the office into the conference room. Okay. I said to her, "What are you doing?" She's like, "No, I'm on the phone." And I'm like, "But this is your child." How old is the little girl? The little girl's like maybe five. She does speak English. So, if you want to come up over here, let me talk to her. She'll talk here. Yeah. Yeah. The woman's up there. She on the second floor. She's by the main street, I think. Um, the woman in the blue pants is going to be a translator stairs. You go up the stairs. I'm going to stay here. Okay. Eventually, they spot the woman sitting outside, showing no concern. She's calm, distracted, and seems uninterested in the situation. That's my mother, I think. And is this this isn't like somewhere where someone bring a kid, right? Like, so she's not confused right now? No. So, she came into our office needing assistance. I said, "Hey, you need the urgent care now." So, I just want to She did come downstairs. She just asked for the kids. Okay. You want you want to Well, I mean, do you have to I mean, because what's going on? Like, why why is your daughter you outside and your daughter's in the building by herself? She said that the kid was never by herself, that she left the kid with her and then with someone else, another lady. Well, so she said she knows you, but she's not your friend. No, she didn't even leave the kid with me. That's not who I who was left. she was left with her. Okay. But either way, like they don't work for her to for her to just be a them to be babysitters. Like that's her child and she's leaving her child with a stranger. Yeah, she's ones. Okay. No, excuse me. The mother says she came in because her daughter had a dog bite, but the girl shows no signs of injury. The woman also claimed she needed to use the bathroom and that's why she left her daughter alone. So, I'm going to talk. Hang on. Do you speaking Spanish? No, she's going to talk for me. Police? No. No, I speak English. So, I need Okay, I'm going to translate literally that she came because she wanted to go to the bathroom, but she couldn't get her daughter card to remove her from the school. Mhm. And yeah, so she said she lived in South Carolina and she came to Florida two weeks ago. Uhhuh. and her daughter started school today. So, she stopped here because she wanted to go to the bathroom. See? Okay. Does she know where her daughter is at now? She said the kid is with her. She says that she must let the daughter Wait, wait. Get my hand out of that. I'll say child in Spanish. She wants to know what's going on. Child, I'm sorry. arrested her child. The problem is she has no idea where her child is. The problem. While the officers continue their investigation, the woman starts acting erratically. She's not making any sense. Does she ever ask if she has no excuse? She's walking. She doesn't have a car. We have a female. No, Mimi. Not every year. Mommy. [Laughter] No. It's probably not. Yeah. It's a It's a bake pen. Is Devon 94? No. Okay. cuz I saw she went over there to the bedroom. She's on. Bring her down, sir. [Music] Yeah, we'll take this one because Wiggly worm. All right. She laughs for no reason, appears confused, and even spits on an officer. Don't hit me. No. Yeah, that's what I was talking Oh, is that what it's unlocked? Sit down. Let me load. Let me load. There we go. Oh my god. All that dabbering was nothing. Literally was nothing. You know what is your advice? I know that this is crazy. I'm fine. I'm pregnant. I got pregnant in Ecuador. She's now saying that she's pregnant, but Well, I got a couple um Spanish speakers at the hospital. I know that. Now that the woman is secured in the patrol car, the officers gather more information from the hospital staff regarding the incident. So, does she come in for the baby or does she come in for her? So, mom, I work we work in the MRI department. She came in asking for assistance and the girl in the front desk doesn't speak English. So, hey Annie, can you help her out? So automatically she said, "Hey, my daughter got bit." I said, "Oh no, you need to go to the urgent care. Come on, I'll walk you over." Damian that I am decided to come today with the She brought this girl in for a dog bite and then she went to go use the bathroom and then she was gone for a half hour. Yeah. What happened? She has no idea where her kids are, but they were with the with the nursing staff. Drunk as high or all these. Yeah. She's definitely her eyes are and she starts randomly laughing. She looked at me. She kept looking at me. She follow her here. She's just wandering around all the building and stuff. Was she lost? She's gone sometimes. She'll just she'll be standing there like I'll be holding her and then all of a sudden she'll just start like Joker like laughing like not even Heath Ledger Joker like Jared Leto Joker. Got the girl. Where's the girl at? She's still with the nursing staff in the urgent care. So you're saying the girl had a dog bite? Yeah, but there's no mark. There's no mark cuz I said Yeah, there was no puncture. Okay. Okay. So, the phone is, she says, is her mom. Someone did try to call and they were saying like, "Where?" She said, "Where the are you? Where are you right now? We need to get you so we can go." And then when I said to her, "Well, who are you?" They hung up the phone before we could talk. That's not the child. We don't know. We don't know. We don't know that. And the little girl does state that it's her mother. Okay. Cuz the pictures you showed me, it looked like either it was a minivan or like a truck. It does actually. You can see. So, and that's that minivan's been just sitting there chilling and it's got a weird green one. Yeah. Yeah. Let's go. You can see what kind of Well, Jake, just look at the pictures cuz I think we might be able to see the color. And if it's the same guy. It's a guy, right, with a beard? Yeah, it's a Nissan. Is that a trader? Is that the van? No. The one in the picture is a Nissan, it looks like. As police try to get more information, a family friend arrives. He explains that the woman came from Venezuela about two weeks ago to escape domestic abuse. On you or on it? No, that's not a charge. That is a charge. Camera. Beon's in there making pro. They're making some seems like progress with like uh getting more information from the little girl about like a other name or um just like clarification on things you've already been told like where she lives and stuff. Yeah. Like she talking about a house. Okay. And the computer. He wants to explain what's going on. Speak English. Okay. Very good. He received her about 15 days ago from Georgia via Georgia. Um she advised him, you know, that she was coming to the States if she could come with him, if he could receive her. Yeah. Say like receiving. What's the deal with that? Um that's what we call for like political assign, you know, I'm Cuban, so it's it's a Latin term. It's Hispanic. Okay. Does mom have other children? Where she lived? How how long you friends? Seven Seven year. Seven years. Okay. that took her her information. He said what he's saying. She has passport. Okay. Passport. Can you can you take that out? I can't I can't take it out. Um what he was explaining is that he received her 15 days ago to help her in the sense of that she her husband in Venezuela was doing drug using her mentally and physically when she came here. They're they're um in their country they're news reporters. So the um he knowing her differently over there and today are two different people. She is not stably right right now. And he says it's it shows it's Yeah. It's a lot of issues and she does have brother and mom are in the other on on the phone in Venezuela here. Yeah. And mom and brother are saying also she suffers from anxiety and panic attacks. Yeah. And when she gets two and then she did advise that she smoked some coke. So, police also speak to others connected to the case, including the person who dropped him off at the facility to understand what led to the situation. They went to pick up from school. He asked a friend, which is a pastor, if they can pick Chloe up with mom. And when they went home, a neighbor's dog picked the girl. Okay. So, the pastor decided to bring Chloe and mom here. And as he's saying a little bit irresponsibly just dropped them off and left with mom not knowing the area. Oh my god. So since this morning she hasn't been acting right. When he received her uh from you know Venezuela was there like paperwork you know things like you know that sponsor that's no church. He's friends with her from Venezuela. They were both reporters out there. Okay. But the pastor that dropped them off, he's friends with him as well. Her brother saying that she came here over asylum. Political asylum. Yeah. Yeah. Not amnesty, right? Political. He wants to know what the next process is for DCF. It depends on what information DCF. There you go. But do you guys need me to stay to help with translating? I just need to I need to make a phone call. I got a kid probably saying, "Hey, mommy, where's my dinner?" Yeah. I mean, translation line. I don't mind. The kids in the pictures, they also live at the house. Did you ask Marvin about that? They've only been here 15 days. These are family and friends from the Carolas where they were at war. Yeah. So, how long So, what you being charged for? Battery on a law enforcement. Law enforcement battery uh arrest. Okay. So, how long do you think she would be in there for? Like if she didn't make B? She's eventually arrested and charged with child neglect, resisting arrest and two counts of battery on law enforcement. The child remains safe under the care of medical staff while child protective services are contacted. Number one, outrageous mom attacks employee while her kids stand and watch. Police are called to a bar after reports of a woman throwing items and arguing with staff. And what's worse, she did this in front of her kids. Here's what happens when the officers intervene. I just want everybody to go. We close the bars. It's over. I don't want football chart. Nothing. They didn't do anything wrong. It's just an escalated situation. She went and grabbed She went She went and grabbed a football. It escalated. It escalated. Nobody's in trouble. Okay. I just want to make sure that what happened is Yeah. So, she walked she walked behind the the football rolled over the bar. She walked behind the bar. Dale, no one's allowed to walk behind the bar. She went behind the bar. He got into her face, argued with her. I'm going to deal with that situation. Staff and the bar manager say they don't want anyone trespassed or charged. They just want everyone to leave peacefully and for the situation to settle. Um, she didn't do anything wrong. I just want the situation diffused. I don't want anybody in trouble. I don't want none of that. I just want it all to. And I think they were leaving and they were leaving anyways. But okay. No one's trespass. I was in trouble. I just want the situation to All right. Yeah, I was great. Yeah. I just We got phone calls. I'm out here trying to figure it out. So, I want to be sure that he took his job a little too serious. And when the car she's a manager, she'll take to her as well. There was no issue with the bartender. I had no issue. He didn't like that. The ball rolled and I went and grabbed it. That was it. Yeah. Nobody was in trouble. that you being called was necessary at all. I don't think you being called out was necessary. Yeah, that guy just cussed me out, too. So, that man over there. So, gota eat their whole meal for it. Everything's good. It's all good. He was upset about the fact that you had to be called. Yeah, fair enough. Don't mind. I'm not here to hurt nobody. I'm just trying to figure everything out. Okay. But take care of him now. They're leaving. He's leaving. He's finishing up his. He's leaving. They're leaving. Everybody's leaving. Bars are closed. Officers think the incident is done and are preparing to leave. But as they're walking away, the woman unexpectedly returns to the bar and slaps the bartender. What did she do? She punched him right in the face. Where's he at? He's inside. I don't want her to go to jail. Okay. I It wasn't me. I just Okay. Where's the bartender? He's inside. Does he want to press charges? Probably. I don't know. All right. Hold on. Yeah. You haven't come out here, ma'am. [Music] Got you. Walk out. doing stupid [Music] try to do this without in front of the kids. I know. I know. I know. There's nothing with you. He's right here. Stop going that way. Stop. I need you to come here with me. Okay. You Everybody's bing you out and now you're doing too much. What are you talking about? You're doing too much. Everybody's too I'm not going to do anything. Let me talk to her. Okay. Invisible. Go hang out with him. I got to talk to her. Okay. I got to go talk to her over here. Okay. Talking about Shut up. You got your ID on you? No. Yes. Shut up. So, what's going Why? Everything Everything was calm. No, he's sitting here flicking me off at the bar. Oh. So what? So why you have to go and punch him? I did not punch him. So the cameras and stuff and all. I didn't punch him. You won't go punch. I did not punch him. So if I go over there right now? Yes. If you go over there right now, I did not punch him. You understand? If you want to press charges, you'll go to jail. I didn't punch him. So what happened? I didn't punch him. I went to his face and we had an intera like a encounter. Officers try to talk to her and figure out what led to the assault. punch him in his face. There was no punching. No, I did not punch him. Okay. A thousand% did not punch him. Okay. And then the interaction of cuz my son's football went behind the bar. Like be for real. Cuz I went and grabbed my son's football. Why was that an issue? I'm not trying to be a bartender. I'm going and grabbing my son's football. Okay. He's had it out for me for whatever reason. The second I stepped to the bar. When I got here, the manager said she was going to take care of him. Right. So then as I'm walking out, he's flicking me off. So then tell the manager. Let the manager deal with it. What was she going to do? She can fire him. She can kick his ass out of here. She wasn't going to do that cuz she told me he the bar's closed and he's still serving drinks. She told me the bar is closed. Okay. Okay. But I'm telling you, and he's sitting there still serving drinks like bye. Who was it? Was it the guy in the white shirt? Dale. Dale. I don't know Dale. She's like, "Okay, the bar's the bar's done. Dale's not serving. Okay. And then I'm passing and it's like he got what he want and fixed me off. Why? For what? Well, he didn't get what you wanted or what he wanted. You're not being You weren't being arrested or you weren't being That's not what he wanted. You weren't being trespassed. He That's not what he wanted. What? He just want you to leave? He wanted me to be able to leave. Yes. He didn't want to be able to serve us. Okay. My son's football went behind the bar. I went to go grab it for anybody to like get it for you just like or did you just go back? No, it was no issue with him. And was that's what I was explaining to the manager. He wasn't an issue at this bar. My son's football rolled behind the bar right here. And he went this bar right here. The earlier in the day and he went and threw it kindly to my son like, "Oh, catch it." It happened to this bar. It's like absolutely not. You will never come behind here. Don't do that again. Okay. What happened? I'm not trying to overstep. I wasn't even That's why the first time it happened here, I'm like, "Do not get it. The bartenders will give us the ball." Yeah. She claims the bartender provoked her by flipping her off as she was leaving and insists she only acted in self-defense after being grabbed very prayfully to my son. But then the second time it went to get I went and grabbed it and gave it to my son and he's like, "Don't ever do that here. No one's allowed to come back here." I wasn't trying to overstep any boundaries. I'm sorry. And he kept going. But at no point when y'all were leaving did you guys get into a fist fight or the first time? No. Not the first time. I'm talking about now. When y'all were leaving? No. I did not punch him in the face. No. Okay. All right. Hang out here. I'm holding on to your ID until I finish everything up. Okay. Okay. All right. So, what happened? Um, there was a little discrepancy. I guess her kid dropped his ball for the third time behind the bar. And the first time I gave him back his ball at the tiki bar, he dropped it over there. I threw him the ball like it is with our kids, you know? Yeah. But then the ball came behind the bar again. And then she came shruting behind the bar and I said, "Hey." I said it nicely the first time. I was like, "Hey, just don't come behind. You're not allowed to be behind my bar." And then she wanted to run her mouth, whatever. You know, drunk people, bull. And she's running her mouth, running her mouth. And I'm like, "Hey, all I did was ask you not to come behind my bar. You're not allowed to be back here." Yeah. And then she wanted to go cussing and screaming and yelling and trying to throw drinks at me. And then they're leaving, whatever. And then here she comes back behind the bar and puts her hands on me. Absolutely not. What if I have put my hands on her? She mushed me in my head, hit me. No man, she hit you. She got on video. She mushed me and then hit me. Okay, you got on video. She doesn't get to put her hands on me, bro. And I don't really like causing problems for anyone. One was the guy that got in between. But if I put my hands on someone, bro. If I put my hands on someone, him, her, my grandma, you don't get to touch people like that. You don't get to spit at people. You don't get to defend yourself. So defend myself against a woman. She put her hands on me right to defend yourself. Well, I just say literally, bro. So, do you So, let me ask you this. Do you want her to go to jail? You want I do, but I do twice. I was right in between. I was in between of the I appreciate it, but you got to I got to ask him because he's the one that going to have to go. That's what he told me. I mean, we can. When asked if he wants to press charges, the bartender confers with co-workers, weighing the best course of action. Put her hands on you. You give her probation or something. I That's either she goes to jail or gets trespassed. It's up to you. One of the two or both. It's up to you, bro. It's either she goes to jail tonight. Go to you don't get to put your hands on people. Like absolutely not. That's your call, man. Do the right thing. Do the right thing. What is the right worth it? Is it worth it? Is she worth it? She's never coming back. You're never going to see. Is it worth you having to go to court? To court? That's Yeah, you're going to have to go to court. I could have gave her the one too about it. Good thing I was there cuz you wouldn't. I I Let me tell So the process will be she'll go to court or she'll get arrested tonight. She'll get released. There'll be a court date. You'll get subpoenaed by the state. You'll have to go to the court date with through the state. You'll have to talk to the judge. You'll have to talk to about all that. I just do not appreciate someone putting their hands on you. No. And that's fair. You never switch your hands on me. Not unless you're being sweet. You're like, I was not sweet. You're a trashy. Think about it this way. Either way, she's going to learn a lesson. Either way, so you make your decision. It's literally up to you, bro. What she should have been doing is that going back in front of her chill. Yeah, there you go. I appreciate you so bad right now. And then I got it. It's all good. I mean, I know she shouldn't be doing that and her being trespassed, you don't have to worry about it again. But and then if if he does want to diffused, I'm telling you. So, she's claiming that he flipped her flipped them off while they were No, we didn't. Okay. I'm just I just I had it all diffused. Where are they at? There. She's over by her car. I got her ID, so she's not going anywhere. And if she does, I got her I got I know where she lives. Yeah. Bad idea to just leave the scene. [ __ ] her. You're going to put your hand on. Oh my god. Just make a decision. I want to close this place down. Either way, she's trespassed. Okay. I don't know if that was obvious. Yeah. Though hesitant at first, he ultimately agrees, saying she crossed the line and shouldn't get away with putting her hands on someone. What do you want to do? Do what's right, dude. You can buy your co-workers, bro. I'm I'm on your side whatever way you want. Either way, she's never coming back. Think about your coworker. I don't care about never coming back or not. But like repercussions like this is a small town. Like if I make an example of her, they might make an example of me. Like I don't want to backlash. You know what I mean? Like what the I can deal with little Yeah. But she shouldn't get away with putting her hands on me, bro. And if we let her go then she got away with that. And that Well, the dad the baby daddy even said that to her. She said, "You done gotten away with too much and we might might be going into jail." after she was very But here's the thing though is has she done this before somewhere else? Well, I was going to I was going to double So, I was going to double check everything. Obviously, if she gets arrested for battery, which is that's what it's called, battery. If I if I arrest her for battery, I do a background check on her. If she's ever been convicted before, it actually turns from a misdemeanor to a felony. So, a second or subsequent offense after that, it starts it comes from a misdemeanor to a felony charge. Listen, Dale. She needs to listen. So, if you've been convicted one time of a battery charge and then and then I you get you get in trouble again. You ain't causing problems for anybody, bro. You ain't causing problems for anybody. You can't disrespect people like that, bro. Sorry, bro. No, you're fine. You guys You need do what you need to do with him. I mean, I'll get all his information after he if he wants to. You already have her? Yeah, I got her ID and everything. Yeah. So, I don't have her in the car. She's She's hanging out right now, but I know where she lives. So, I know. I told her not to go nowhere and I I'm pretty sure her husband's not is homeboy coming back. Best friend, you know, something I want to go to jail, bro. Go to jail. Meanwhile, the officers tell the woman that they have video footage and when shown the clip, it clearly shows her slapping the bartender. She still denies hitting him, but the evidence is there. All right, I'm going read something to you and I'm going ask you some direct questions. All right. side. So, I have video. Mhm. I have video of you swinging on him. Did not punch him. But you hit him. Didn't punch him. But you slapped him. You didn't punch him. Hands are open. Did you slap him? Got him out of my face. So, it wasn't You weren't getting him out of your face. People were getting him be getting you two separated. Mhm. And you reached around and trying to get defend myself. Absolutely. You want to see the video? You want to look at it with me? I'll look at it. I don't I'm not opposed to it. I still don't feel like I should be arrested for it, especially for something that he instigated. So, here's you coming around. Mhm. Arguing the same way he was to me. But you and then getting people get between you. Mhm. Right there. and then defending myself. There's people reaching towards me. Absolutely. As someone grab getting grabbed towards would react. I'm not sitting here trying to cause a bar fight. Okay. My son's football got put behind the bar. I went and grabbed it. That's not a crime. Nope. I grabbed it and he was offended that I went and grabbed it behind the bar. Now, if I knew that that was going to be an issue, I would have said, "Hey, my son's bar is behind the bar. the son's my son's football is behind the bar. Can you grab it? I didn't think it was an issue because earlier in the day that same thing happened and he playfully gave it to my son now. He was offended and continued to go on about it. You're not Don't disrespect me in front of my children when it's not even something that needs to be it. It wasn't an issue, especially earlier in the day. It's a football. I'm not trying to disrespect you. I'm not trying to overstep you. I'm not trying to be rowdy at your bar. Police explained to the woman that approaching someone to argue doesn't count as self-defense. Since she chose to go behind the bar and initiate physical contact, she's seen as the primary aggressor. I'm going cuz it was over. You came, you seen that it was over. We were walking and now he's waving and flicking me off. Now you're being antagonizing. I don't appreciate that. So, I went up to him to say that like, "Don't do that. You're here. You're still serving even though your manager said the bar is closed, but you still overstepped her and said, "You're going to serve anyways." And you're antagonized me while I'm walking out of your bar. I was no longer even going to be here. And when I went in his face, now everyone's grabbing me. Now I'm the issue. Yeah. I'm going to get defensive and feel like when people are grabbing me that I have to defend myself. Well, you got to understand that you going behind the bar coming to somebody that's just running their mouth. that even just running your mouth. It's defend myself. That's not defending yourself. Somebody running your their mouth is not def You can't defend yourself. I'm running my mouth, too. So, he was running his mouth. We're running. You left. You came You came around the bar and approached him while he was just running his mouth. It would have been It would have been a different story if he approached you and came towards you outside of the bar and then you smacked him. It's a different story. But now you you approach him. You You're the primary aggressor at this point because you come from that take you take that and I didn't just go over there and smack my I didn't smack No, you didn't. It It started off when people grabbed me. Now I'm defensive. But you're smacking. You smacked him because people are grabbing me. I don't know which way that's coming. So I didn't come over there and said boom, smack. So So here's the deal. I'm over there just defending myself and then people start grabbing me. Now I'm defensive. I don't know which way that's coming. It's a whole big commotion. Yeah. I didn't go over there to smack him. So, but they were trying to get you away or get you out of the bar and that's when you were that's when you you smacked him. Correct. I didn't I don't No, I'm not agreeing to me smacking him. Okay. Okay. Well, so here's the deal. We have the video evidence. We have the the witnesses there. I don't see your testimony. It's a it's a simple battery. Officers confirmed that her children witnessed the entire thing. They place her under arrest for simple battery based on the statements and the video. Domestic, so you have a bond. It's going to be $100. Me smacking him in that video. It's going to be It's going to be It's It's there. But I don't see it. Oh, I It's in there. Say it again. But I don't see myself smacking. It's there. And you're agreeing with that? Mhm. This is a video. This is This isn't edited. This isn't altered in any way. Crazy. And this is what's wrong with this country. See right here? One, two, smack. Smacked him. Didn't smack him. Yeah, you did. From the video and what the evidence has, that's you. I don't see that I'm smacking him. Okay. But anyway, you're being placed under you're being placed under arrest for for battery for simple battery. Okay. Go to Mar County Jail. He wants to press charges. He's the victim in this. You're being you're being And you're you're going to arrest good tonight? Yes. I'm going to arrest you tonight. No, I'm saying you're okay with that. Yes. It's not a subjective topic. It's not it's not if I'm okay with it or not. There's evidence to prove otherwise. If if the Florida state statute for battery, if you meet the criteria for the statute, you have to test under arrest. It's not if we're okay with it, if we could let you off with a warning, it's none of that. If you meet the criteria for the statute, okay, if you want to go to judge and say I was defending myself, well, if I'm arguing with him and he's on one side of the bar and I'm on the other and I and I feel I feel like I need to defend myself and I go around the bar and get into his face, I'm the aggressor. That's me going on the offensive. If I if you have to move forward towards your towards the person that's trying to hurt you, that's called going on the offensive. That's not being defensive. Okay? Pride or not. We have not about pride. You're not defending yourself if you're going around towards somebody. That's not how that works. Okay? That's just not how it it is. Okay? So, if he's standing there, we're not going to argue with this. Okay? We're done here. She ends up in cups, her actions recorded, and her children left to witness a moment that will leave a lasting impression. Some people just shouldn't be in charge of anyone, let alone a child.
