You're being arrested for driving while intoxicated. Turn around back. >> Okay. Do me a favor. Go and turn around for me. Okay. We're under arrest for DUI. >> The bank account might be impressive, but the law doesn't check your [music] balance before making an arrest. These rich Karens think cops can't touch them because of their money. Driving a Porsche didn't [music] change the outcome. Police respond to a restaurant parking lot after receiving a report [music] that an intoxicated woman backed her Porsche into a legally parked vehicle causing minor damage. When officers arrived, they confirmed that a crash has occurred and begin gathering information about what happened. >> The damage is only the license plate. >> Okay. You need license, registration, insurance, and all that stuff. >> It's only All right. Come on. I could just freely go home hopefully. >> You what? >> I could just like freely go. >> Yeah. I just need your registration and insurance for the car. >> It's all in the car. >> Yeah, you can get it. >> You like frozen. >> I don't drive. So, I wasn't planning on driving. I like came out because I saw it crashing. 9601. >> Wait, your car was crashed into >> 31. Saw it outside. >> Huh? >> I saw that like I was driving >> this car back into that car, right? >> Um I saw that it got crashed into it and then I came out to leave. >> Okay. Well, we still need all your stuff to do an accident. >> Just confirming vehicle 2 is Mike 34 uniform echo whiskey. Do you not know where the stuff is? >> Uniform. Whose >> car is it? But I just like purchased it like maybe a few months ago. Do >> you have car insurance? >> Yeah. >> Is it I mean I don't know where you keep it. >> I don't know where I put it to be honest. >> What did they say? >> She backed into the back car. I was just I the only thing I asked him was to confirm that. >> I think this is probably my this is like the best I have, but I'm barely I'm like a very secure person, so I like to like have everything. Wait, so I don't understand. You're saying that somebody else got in this car and moved it? >> No, I'm saying that like everything was fine and then we were like heading back home and then my friend was going to drive home and then everything >> Well, where's your friend? in that car. She >> She backed into that car. >> Yeah. >> Well, where's she at? >> As they question the woman about the collision, she gives several different explanations about who was behind the wheel. >> Well, it's fine. I I died, but I'm going to take responsibility. >> Who's driving the car? >> Who really did it? Who was driving this car? >> Me. >> Okay. Well, why are you saying your friend? >> I'm going to take responsibility. >> Oh, I don't understand why. Are you driving or is there somebody else driving that's in a bar? >> No one. >> No one was taking responsibility. So, >> who was in this car and backed into that car? >> Neither me or my friend to be honest. >> Well, somebody got in this car and it moved. So, who was in the car? >> Um, me or my friend, but neither Russ or something. Okay. Yeah, myself. >> There's only one answer. Somebody was in the driver's seat of this car and backed into that car. Okay. Who is in the driver's seat of this car? Okay. >> Yeah. >> I don't understand why you're being >> You're in the car. >> No. >> And I'm heading back home. >> I don't understand why it's a hard question. It's not a hard question. >> It is a hard question because if you actually ask for an answer, >> I don't even understand what you're trying to tell me. >> I think it becomes complicated because I'm also a doctor and then it makes myself complicated. So, I don't want to be like, >> "Okay, step over here. It makes things more complicated because I don't want to like >> Yeah. >> All right. Come over the sidewalk. >> Well, you're not being honest with me. [laughter] But I >> [snorts] >> These bouncers know whose car this is the view. >> Yeah, they don't know. They don't know. It >> is very cold. >> It's very cold. I always drive. I always park right here every single weekend. So >> So if they have cameras here, >> I mean, she said she she was trying to get out and she backed into it. Officers continue trying to determine who was driving the Porsche as the woman's story keeps changing. [music] She also begins admitting that she had been drinking. >> We just need to figure out whose car that is. >> Um I actually go home every weekend. It's like this is like a normal thing for me. So, >> okay. >> We're just doing the car accident right now. >> Yeah. >> And you I'm trying to decide if you said you if you were driving and you back in his car or you say your friend was. So, I need your answer of what's going on. >> I mean, I don't think that like anything happens. So, >> it's just minor. That's why I don't understand why you don't tell me either, too. >> How do you not understand? >> There's probably a camera right here. And if you're not honest, then >> I definitely didn't do anything wrong. I just think that like >> Oh, look. Somebody backed into that little car right there. >> It was not me. >> Was it this car >> for that damage? No, definitely not. H >> How do you think so? >> For me, for that damage, cuz it had to be extreme. >> No, it doesn't. >> Well, there's a mark right on your bumper. >> Oh, well then maybe maybe you're right then. >> Okay. How much did you have to drink? >> I had two martinis and I wasn't planning on driving home, so I was going to stay here and Uber. So, >> Well, then how' the car move? >> My friend. See, you keep saying that. Who was in the car driving? If you're not honest, then we're going to move further here. >> I'm not going to tell you. >> Well, somebody was in this car and drove into that car. >> I know. And I'm not going to tell you who. >> That looks worse on me. >> We can go about this a couple different ways. >> Oh god. >> Um, >> they only really escalate from here. >> Yeah, I know. I'm a dentist. I do teeth. I'm in this area, so I really can't I don't want to look bad. So, >> what what do you mean you don't want to look bad? >> Somebody drove into that car. >> I know >> it's a minor accident. All would be in an accident report. But with you being dishonest with us, >> I know >> then there we can escalate things. So, this could be over in 2 minutes or we can go get a camera and figure out who is driving. >> Just say it was me. The officer tells her there are different ways the situation can be handled, but explains that avoiding the question will only make the investigation more difficult. >> We're going to look at the cameras if I mean, was it you or was it not you? >> It was me or my friend. It was one of the two of us. So, >> how do you not know? >> There's a lot of things going on. >> What I mean, so this is like a traffic offense. >> Yeah. getting into a criminal offense. >> No, it's definitely not criminal. >> It is if you lie to us about a basic question. >> You're not lying. You guys >> You are lying. You're saying I don't know if I was driving or somebody else was driving >> cuz I can't remember. >> You guys are asking a lot of questions. >> It's It's We're just trying to figure out who is driving this car that backed into that car. It's not a hard question. >> Excuse me. Are you afraid about getting a ticket or something? >> I am. Yeah, cuz I'm like a dentist in this town. It's like very >> It's a minor accident. We don't write tickets for this. >> Just do SFSU. I'm going to ask >> you. >> Just uh just call it out. >> Get contacted for that. >> Straight state trooper. So like >> Okay. Um, >> I have negative uh contact information for the owner of >> my best friend Francis. >> I'm going to take her over there for SFSD. I just don't want any foot traffic getting in the way. >> Okay. >> All right. Come across the street with me. Okay. >> Just go right over here towards this car. All right, that's good right there for now. >> You can come towards me. Face me. All right. >> My really good friend is a state trooper in Margate. >> Okay. >> Look, we're beyond all that. >> Yeah. So, at this point now with you saying, you know, you were the one driving and everything like that, I just want to check to make sure that you're okay to even operate. >> Because of her admission and the circumstances of the crash, officers begin standardized field sobriety tests. >> What's that? >> You want to go back here? >> This way. Then >> this way. >> All right. All right, I'm just going to run you some through some tests, okay? To make sure that you're going to drive, okay? >> Do you have any issues with uh your eyes? >> Any recent head injuries? Anything affecting your balance, your ability to walk, anything along those lines? >> Are you wearing contacts right now? >> Yes. >> Okay, I'll keep that in consideration. Okay. >> Can you see the tip of my pen? >> Yes. >> Okay. I want you to follow the tip of my pen with your eyes, your eyes only. Do not move your head. All right. Let me know when you check 64772262 0782 with bouncers at 75. Be sure to get the tax come back to we're going to try to look at the owner >> comes back to you. um out of Burgine. >> Same thing. Again, no issues with your balance. No issues walking, nothing like that. Wearing you got heels on them. Okay. >> Heels. Correct. >> Are you comfortable with walking in them? >> Sure. >> Okay. All right. So, the next test is going to be the walk and turn test. Okay. So, what I want you to do, stand with your feet together. >> All right. Arms down your side. All right. You're going to take nine heel toe steps out in front of you. You're going to take a series of small steps, turn around, take nine heel toe steps back. Okay. I'm gonna demonstrate it to you. I want you to maintain that position until I tell you to begin. Okay? >> It's gonna look like this. Okay? You take your real quick >> for the starting position, right? Hands down at your side. >> Just pay attention. Hands down at your side. Put your right foot in front of your left foot with your heel touching your toe. Okay? Arms down at your side. Right foot in front of your left foot with your heel touching your toe. maintain that position until he's done instructing you on the >> All right, I'm going to demonstrate the test for you. Okay, >> so again, your left foot in that line, right foot in front of that touching heel to toe. You take a tears of nine steps heel to toe down that line. Okay, that imaginary line out in front of you. Okay, so look like this. One, two, three. When you get to that ninth step, keep that front foot planted. Take a series of small steps rotating yourself around that foot. You're going to take nine heel toe steps back in that same manner. Okay? 1 2 3. So on and so forth until the test is completed. Okay? You're going to keep your you're going to look down at your feet the entire time. You're going to count out loud keeping your arms down to your side. And once the test begins, do not uh stop until the test is complete. Do you understand? >> Get back into that starting position. >> Just as I just as Officer Mazy instructed you. right foot in front of your left foot with your heel touching your toe. >> She struggles to follow the instructions, so the officer explains the walk and turn test several more times after she starts the exercise incorrectly >> with your heel touching your toe. >> Do you want him to explain the instructions one more time? It's very important. >> Do you understand? >> I can I can reexlain if you want me to. And I'm not talking about right. >> You're taking All right, get back in that starting position. Okay, so arms down to your side with your left foot on that imaginary line. That right foot in front of in front of your left foot touching heel to toe. Okay, you're going to take nine heel toe steps along that imaginary line. Once you get to that nine step, you're going to take that series of small steps as I demonstrated to you and you're going to take turn around, take nine heel toe steps back again. You're going to look down at your feet. You're going to count out loud, keeping your arms down at your side. wants to test store it. >> Where you going? >> Did you demonstrate it? >> I did. Arms down to your side. You're going to look down your feet. You're going to take nine imaginary I'm sorry, nine steps along that imaginary line. Once you reach that final step, again, keep that front foot planted. Take a series of small steps. Turn yourself around. You're going to take nine heel toe steps back along that imaginary line. >> All right. Next comes the one leg stand test. Do you think she'll do any better this time? Did you demonstrate heel to tips? >> Yes. >> I freeze to death. >> Next test, >> it's cold. >> Next test is going to be the one leg stand. You're going to lift it approximately 6 in off the ground. All right? It's about the height of a soda. Again, that foot parallel to the ground. Okay? Not like this, pointing up like that, parallel to the ground. Okay? You're going to count in the following manner. 100,00 1,002 10003 so on and so forth until I tell you to stop. Okay? All right. It's on my phone or it's on the >> It's in the car. >> Okay. What's your first name, miss? Sorry, guys. Just one sec. >> What's your last name? After she admits to drinking, [music] they begin standardized field sobriety tests. >> What's your first >> um you want to head over? >> What are your what are your injuries like? >> I didn't know I had any until someone told me. >> Okay. >> So, I don't feel anything. Yeah. >> Um, so I we're going to run you through a couple tests just to make sure. I know you told me you did have a little bit of tequila. >> Absolutely. I understand. >> Do you mind if we come over here and uh >> Can I just see what your knees look like? >> A little caught up. >> Not very gate worthy. >> That's the last of your worries right now, miss. All right. >> All right. Let's come over here. >> Just make sure she's okay walking here. Um, >> we're just going to run her through some tests before we get her on the squad. She's telling me she's not hurt, so >> she's got blood obviously on her from her knees, but >> we just want to run her through some test. Uh, she probably should be. >> Okay. >> Uh, we're going to go into the driveway. >> All right. Basically, just make sure you I know you said you only had one. >> No, no, I understand. I just What was that? >> No, all good. >> All right. So, the first test I'm going to do is just check your eyes. Okay. >> Um, >> just for a warning, I am blind in this side, not in this side. Um, I'm legal to drive. I just wanted to let you know. >> Okay. Um, do you wear like contacts or anything? Okay. Do you can you see if I put this Um, this light is for me basically to kind of I'm going to shine a little bit of a light, but can you see my finger up here? You can. >> Yeah. I just want to let you know in case it looks weird because I know like my superficial contacts look weird people. >> Okay. Now, is that Do you have colored contacts on right now? >> Yeah. >> Okay. All right. So, see the tip of my finger here? I want you to follow it with your eyes and your eyes only. Okay. >> During the eye test, the officer repeatedly reminds her to keep her head still and follow his finger using only her eyes. >> Just keep your head still as I come across your face. Okay. All right. Just follow my finger. Okay. >> Mhm. >> Keep your head still. >> She used to call her. Just keep your head still for me. >> I'm just with your eyelashes. It's hard. Are these uh >> Sorry, I got them done this morning. >> They do nice. >> Yeah. Thank you. >> They look good. All right. Here. Just again, keep your hands Put your hands at your side and just try to keep your head still for me. Okay. >> Receiving you Just follow that. Okay. >> You want to do the nice one? >> Yeah. >> All right. Miss, so I know you were in a crash, but just going to ask again. Your legs aren't significantly hurting you right now. >> No, honestly, they aren't. >> They aren't. >> They're singing a little bit because like, you know, there's >> But like I don't feel anything. >> Okay. All right. Very good. So, what I'm going to have you do is just walk this way a little bit. >> And you can face me. >> Actually, I'll come over here. So, she's got room to walk. No, you're good. >> I wasn't dressed for this occasion. >> It's okay. So, what you're going to do here is pretend there's a line in front of us. All right. You're going to place your left foot on that line. You're going to place your right foot in front of your left heel to toe. and you're going to place your hands at your sides. >> Next, officers administer the walk and turn and one leg stand tests while observing her balance, coordination, and ability to follow directions. >> So, >> don't judge me for what I'm wearing. >> No, it's okay. So, place your left foot on the line. >> You're going to place your right foot in front of your left, heel to toe. >> Yep. So, right foot in front of your left, heel to toe. Hands at your sides. Stay like that until I tell you to move. Do you understand? >> Okay. So, for this test, you're going to take nine heel to toe steps down the line, counting out every step, touching heel to toe on every step. Once you reach your ninth step, you're going to leave your left foot planted. >> You're going to turn around, leaving your left foot planted. You're going to walk back down the line. Take nine heel totoe steps back down the line. >> Nine and nine. >> Yes. So, I'm going to demonstrate before I ask you to do the test. >> So, for my demonstration, I'm going to take three steps. When you do the test, you're going to take nine. Do you understand? >> Yes. You know where your electric meter >> one >> panel? You're leaving your left foot planted? >> You want me to block off? >> One, two, three. Once you begin the test, don't stop until it's complete. >> Do you understand the test as I explained it to you? >> Yeah. >> Okay. So, get in the starting position. Left foot on the line. Right foot in front of your left. Heel to toe. >> Right foot in front of your left. >> Okay. You may begin the test. Once the walk and turn is finished, [music] the officer tells her there's one final exercise left, the one leg stand test. >> Okay. >> So, I'm going to have you I'm going to have you do one more test for me. Okay. >> This test is the one leg stand. What you're going to do while I explain it, you're going to leave your feet as close as you can together. You're going to place your hands at your sides again. Okay. >> So, it's a little embarrassing. Sorry. >> It's okay. So, place your hands at your sides. Nope. Nope. Nothing until I tell you to move. Do you understand? Just remain like this. Hands at your sides. Okay. For this test, you're going to take either foot of your choosing, lift it approximately six inches off the ground. I know sometimes it can be difficult to walk in them. Uh, so what I would like you to do, Jill, I'm going to put you in the starting or sorry, I just want to confirm. You can see we're going to use this line on the rope. You can see that. Okay. >> Okay. I mean, it might be easier to do it without it, but >> Oh, yeah. Like I said, like like I said, Jill, you have the option to do so if you want to. So, >> how do you guys think? >> Um actually, if you want to keep those off just for just for one more test, I think it would be better if you did like I'm not going to force you to keep the heels off. >> I feel comfortable having my shoes. >> Well, the next test requires you to stand on one foot. >> All right. >> So, you sure you still want to do it in the heels? Yeah. >> Like I said, at any time you have the option. You can be like, I don't want to do it with the heels. You can tell me that and we can do it without the heels. You're having some trouble staying the lanes? >> No. I'm so sorry. I was not trying to like >> Okay. Were you >> I don't know. I'm fine. And I was not >> trying to be anything other than going home. I'm sorry. >> Okay. Where you You're heading home right now. >> Yes, sir. >> Okay. Where you coming from? >> From my friend's Bill's house. >> Friend's house? >> Yes. >> Any drinks while you're there? >> No, sir. >> No drinks at all? >> No. >> Okay. >> Nope. >> Okay. Um, any medication, anything like that? >> No, >> not at all. >> No. >> Okay. Okay. Hang tight. >> Oh, wait. I'm sorry. I had one glass of wine. I'm I apologize. I did have one glass of wine. >> Okay. >> While I was at Bill's house. >> Okay. >> And that's it. >> I got you. >> I promise. >> Okay. Having trouble with her uh staying in the lane. >> Oh, okay. >> Could smell alcohol on her. Uh asked her if she had any drinks first. She's like, "No." She's like, "Oh, I did have one glass of wine." Okay. She's not driving well. Um, I'm going to get her out and over here. Hey, Michelle. Hello. >> Do me a favor. >> Yeah. All right. Hey, do me a favor. Turn the car for me real quick. Okay. >> All right. I'm going have you step out with me real quick. Okay. We'll talk to you back here at the car. >> Okay. >> Just come around the backside here for me. >> All right. And we're going to step up on the curb here for me. >> Okay. >> Yep. up on the sidewalk here. So, Michelle, kind of explain to you, I stopped to have some issues from staying in the lane. Okay. >> Okay. >> Smell some alcohol on you right now. Okay. And I'm a little concerned about your driving. Okay. So, what I'd like to do is have you do some field spray test for me just to make sure you get your home. Okay. Okay. Agree with that? Okay. Hang out here with a minute for Officer Gonzalez so I can pull my car around here. Okay. Real quick this way on the sidewalk with me. >> The officer begins with the eye movement test, carefully explaining each step before asking her to begin. And do you have any other shoes? Are you going to be okay like maybe doing a walking test in those shoes or do you have tennis shoes with you or anything? >> I do not I don't think I have any other shoes. >> Okay. All right. Come on up here with me. All right. I'm going to have you stand kind of right here on the corner here for me. Okay. >> Okay. >> And come around face me this way. Okay. Thank you. What I'm going to have you do is go ahead and pull your glasses off for me. Okay. You don't need them. It's not a not a reading test or anything like that. Okay. Do you have any issues with your eyes? Any abnormalities? Anything like that? Nothing. Okay. So, what I'm do the first test I'm going to have you do is basically just an eye test, right? I'm going have you do uh you're just going to follow my finger. It's easy simple. Okay? And I'll tell you when we're going to start that. But so, first thing I'm going to have you do feet together kind of like this. So, you got your heels together and your toes together like that. There you go. Just like that. All the way together for me. >> Okay. >> And go and get There we go. Just keep your hands out at your side like this for me. Okay. So, just stay in that position while I explain to test you. Okay. >> So, what I'm going to do, I'm going to test your eyes. Again, this isn't a vision test. Just checking your eyes. Okay. >> All right. >> Can you see the tip of my finger here? Okay. >> Yes, sir. >> Okay. You see that? All right. >> Okay. >> Okay. Well, no. Uh, nois right now. That's a good thing. Okay. People's the same size. Okay. Steep your head straight for me. Oh, I'm sorry. >> You're good. >> Okay. Go ahead and rest your eyes just for a sec. Just just making sure that everything's working the way it's supposed to right now. Okay. That's a good thing. Everything's good right now. Okay. >> Okay. Just keep your hands down your side. >> All right. >> So, again, focus on the tip of my finger here for me. Okay. >> Okay. I'm not used to this. I'm sorry. >> I Nope. It's this >> this is not something I'm used to doing. I got you. I know it's a little different, but you just got to focus on the fitness. Okay. So, keep your head straight for me and then wherever my finger goes is where you watch. Okay. >> As the test continues, she struggles to follow the instructions, but the officer remains patient and calmly explains each step along the way. >> Keep your head straight for me. >> I'm sorry. That's okay. >> I know it's hard to see all the way. Just keep your eyes Okay, keep eyes tilt very tip here for me. Okay. >> All right. I'm sorry. I'm not used to doing this. >> It's okay. I get it. >> I've never done >> It's a little It's a little tough to do. Okay. Keep your eyes on the tip of my finger. There we go. I know it's out there. It's hard to see. Sir, >> keep your eyes on the tip of my finger. There we go. >> I've never done this ever. >> It's okay. >> For real. I've never done this before. Okay. >> I didn't even know we had to do this ever. >> Keep your head straight for me. That's fine. Just keep your head straight and then just your eyes. There we go. I'm not even sure what I'm supposed to look at. I'm sorry. >> Tip of my finger. Just the very tip again. >> I'm not okay. >> Yep. Just focus on that and wherever it moves, just keep your eyes on that supposed to do. You just keep your eyes focused on the tip of my finger. Okay. >> She continues having difficulty with the eye test. Do you think she'll do any better on the next exercise? Okay, go ahead. Rest your eyes just for one second. This time I'm going to go straight up. Okay. So, you still focus my finger, but it's going to go up this time. Okay. Instead, >> I'm just trying to like done this before and I'm not understanding. >> Okay. >> So, I'm just doing the tip of your finger. Is that all I'm doing? >> Just staring. And you've been doing great so far. I know it's okay. >> It's a little hard to sometimes keep focus on for that. >> Two minutes from my house. I don't understand this. >> Okay. Just tip of the finger again here. Okay. Just keep both eyes focused on that. >> We're going to go up this time. Okay. Okay. Go. Go ahead and shake your legs up and you Okay. Just take a break here for a second. >> Um, do you have any injuries, leg injuries, anything like that that would stop you from doing a walking test? >> No. >> I just >> I got you. And I had to explain to you why I stopped you and just my concerns. Okay. So, I appreciate you doing the test for me. >> Okay. >> Cuz I've never got a test like this, honestly. Ever. Um, so the walking test basically it's going to be walking out of line. Okay. Do do you feel comfortable doing that with your sandals or would you like to do it barefoot? It's totally up to you. >> I mean, what are we doing? >> Okay. Well, I'll explain and show you here in a second. I just want to make sure that those are going to be okay for you to you normally walk in those pretty well. >> I have walked in them before. Yes. >> Okay. Okay. Uh, what I'm going to have you do, okay, this way a little bit. >> The officer then moves on to the walk and turn test. Before she starts, he demonstrates the proper stance, explains how many steps to take, and shows her exactly how to turn around. >> Go and put your left foot on that line right in front of you. >> Okay. >> The line coming this way. Yep. And then put your right foot in front of it. Heel to toe. Just kind of like that. >> Okay. >> Okay. Nope. Hang on. Don't start for me. Let me let me explain it to you. You're fine. >> I'm sorry. >> That's okay. Just go ahead and put that left foot back on there first. >> There you go. And then your right foot in front of it, heel to toe. I don't know if I could do this ever. >> Okay. >> I've never done this. >> Okay. No, don't start yet. I got to explain the test to you. >> What am I doing? >> Yeah. You want to give her What's that? Yeah. Well, she said she was okay with them on, but if you want you do you want to try Do you want to try it without the shoes? You think you'll be able to balance better without them or >> perhaps? I don't know. I've never done it before. Ever. I don't do balance beam. I've never >> done anything. You want to take your sandals off and do it barefoot? You can do that. It's up to you. >> I guess. I don't know. >> There you go. Left foot on. >> I've never done a balance beam where I have to do something >> and just stay like that. All right. Oh, go put your hands. Nope. All right. >> What is that? What we're doing? >> All right. We're going to put your left foot back on the line for me again. Okay. >> Left foot first. Yep. And then right foot in front of your left foot. >> And keep your hands down at your side for me. Just like this. like >> hands down at your side. >> Oh, I'm sorry. I apologize. >> Nope. That's okay. Oh, hang on. We don't We don't want to start yet. I got >> I could never do that. I don't think I could ever do that, honestly. >> You don't think you'd be able to do the walking test here? >> I mean, I don't think I could do that if I tried with my hands, but I don't think I could ever do that. >> Let me get you back here again in the starting position. Okay. So, put your left foot on that line for me first. >> I've never done anything like this ever. >> Okay. And then your right foot in front of that heel to toe and keep your hands down at your side and just stay in that position for me. Okay. >> I've never done that. >> Don't start walking till I tell you to. Okay. >> Oh, I'm sorry. >> Yeah, that's why. Just stay in that position. Basically, you're going to look like this. Okay. >> Oh, >> just keep your hands at your side. >> Even after the officer explains the instructions several times, she starts the test before being told, forgets parts of the instructions, and responds like this. >> So, we're going to stay just like that. All right. Go and get your feet a little bit closer together for me. Heel to toe. There we go. And your hands down at your side. >> So, when I do when I tell you to begin, you're going to take nine heel to toe steps. You're going to count each step out loud. >> I've never done this ever like >> Okay. Well, I'll explain it to you. I will thoroughly explain it to you. >> Okay. >> Uh you're going to take nine heel to toe steps. Okay. Kind of like you were doing, but not until I tell you to to start. Okay. >> Okay. >> You're going to count each step out loud. You're going to look down at your feet while you count and keep your hands at your side. Okay? And I'm going to show you how to do this, too, in a minute. Okay? When you get uh you're going to take nine heel toe steps. When you get that ninth step, you're going to pivot on your front foot and you're going to take several small steps and you're going to take nine steps back down the line. Okay? Until you're done with the test. Let me show you real quick. All right. Go and get back to that position for me. Okay? So, left foot, your right foot's in front of your left foot just like this. Go and do that for me. Okay? >> And then get your >> And then the right foot. >> Yep. And then hands down at your side. >> Okay. >> All right. And when I tell you to begin, I'm going to show you how to do this real quick. So, just watch how I do this. All right. When I tell you to begin, >> okay, >> 1 2 3 4 5 until you get to nine. >> Okay. >> On that ninth step, >> then whatever foot you have in front, you're going to pivot that on the keep it on the line. Take several small steps >> and then nine steps back. >> One, two, three, four, five. Until you're back to nine again. Okay. So again, >> where's the five and the nine? And that's the part I'm not understanding. >> It's it's nine steps down and nine steps back. So it's nine each way. Okay. >> Okay. >> All right. So now I explain it to you again. Go ahead and put your left foot on that line again. >> Hang on. Go ahead and get your foot right foot left again. >> Going one, two, like on the line. >> As the test continues, she keeps asking questions and struggles to understand what's expected of her, making it difficult to complete the exercise correctly. >> Straight up. Yep. straight up and down that yellow line directly in front of you. >> One, two, three, four. >> Okay, Michelle, let me have you need me to slide back in. I didn't tell you to begin yet. Okay, >> I'm I apologize. I'm just understanding what you're saying. >> Yep. >> Okay. >> So, does that make sense? >> So, I showed you going to take nine step. Go and put your left foot on that line again for me. >> Okay. >> Your right foot in front of it. >> Yes, sir. >> And your hands at your side. Okay. >> Okay. >> So, again, nine's heel to toe heel to toe steps down the line. Nine steps back. Count on each step out loud, looking down at your feet the whole time. >> So, I'm one, two, go ahead and begin. >> Four, five, six, seven, eight, nine, and then 10. And then turn around. Is that what we're doing? >> Well, if that's if you think that's what I showed you. >> One, two, three, four, five, six, seven, eight. >> Okay. All right. So, this last test is a balance test. Okay. So, uh, do you have any knee issues, leg issues, where you want to be able to balance on one leg for a short >> No, I've never done any of this for a It'll be a short period of time. Okay. >> Um, do you want to try that? You want to do this without shoes or with shoes? >> I don't know what we're doing, so I don't know. >> All right. Well, I'll tell you what. Uh, I maybe turn just a little bit this way for me. Face me this way. There we go. Feet together like this. Okay. Just stay right where you're at and face me. Don't Don't walk any further. Just angle. There we go. So again, toes, heels together like this. Again, hands down at your side. Okay? When I tell you to begin, you're going to lift either leg. It doesn't matter which one. Either foot of your choice, left or right foot. It doesn't matter which foot. Okay? You're going to lift that foot up directly in front of you, and you keep it level with the ground. You're going to count out loud looking down at that foot. 1,00 1, 1,002, 1,00 3, so on and so forth until I tell you to stop. Okay? >> Okay. >> So again, whatever foot that you want to pick up, it doesn't matter. That's your choice. Okay. >> Uh and I'm going to show you here real quick. Okay. And again, no injuries there that would stop you from doing any type of balancing test. Right. >> The officer then moves on to the final exercise, the one leg stand test. Once again, he carefully explains the instructions and demonstrates the proper technique. >> So again, when I tell you to begin either foot, it doesn't matter. Okay? I'm going to use my right foot just for an example, but you choose whichever foot you want. When I tell you to begin, you lift that about six inches off the ground and you keep it level with the ground. >> I thought you were doing this kind of thing. I'm sorry. >> Like a stor. No. So, you look down at the foot that's raised. Okay. 1,00 1,002 100,004 so on and so forth until I tell you to stop. Okay. >> It's not it's not a long it's not like a 5m minute test. It's not a long period of time. Okay. >> Okay. >> Okay. Do you understand those instructions? >> I think so. >> Okay. So, again, when I tell you to begin, you're going to lift either foot. It doesn't matter. Okay, about 6 in off the ground, you're going to point that toe out in front of you and you look down at the toe that's raised. You're going to count out loud 1,00 1 1,002 1003 so on and so forth until I tell you to stop. >> Okay. >> Okay. You understand those? >> Yes. >> Okay. Okay. Go ahead and begin. >> Hey, you want to slide over a little bit just to >> Okay. I feel like I'm on unlevel ground, but Okay. 1001 1002 1001 1002 1001 1002 1001 1002 I don't know I don't know what I'm doing exactly but >> okay go and keep going >> 10001 1002 100 1 2 1 100 1 2 100 1 >> Okay, Mosa, you you can go ahead and stop. Okay, so Michelle, I need some clothes of impairment from you tonight. Okay. >> Okay. So, would you be willing to do a a breathalyzer here on scene? >> No. >> You wouldn't be willing to do that? >> No. >> Okay. Do me a favor. Go and turn around for me. >> Okay. >> Okay. We're under arrest for DUI. >> Okay. >> May I put my shoes on? >> Absolutely. >> Absolutely. >> Give him just a second. >> Yep. The woman later pleads guilty to the DUI charge, bringing the case to an end. She's sentenced to 12 months of conditional discharge, ordered to complete alcohol treatment, and required to pay $2,500 in fines and fees. Mayor orders police officers out of their own station. Deputies respond to the Fort Valley Police Department after the mayor requests assistance serving trespass notices and escorting several members of the police department out of the building following the termination of the city's police chief. Here's what happens when they arrive. >> Okay. >> Hey. >> Hey. >> So power that I have. I'm asking you to leave this premises. I want you to call Colonel Helmer. Is he here today? >> No. >> Okay. Let him know to not come on these premises. You guys are he trespassing. We need all our equipment. We'll get that set up with you at another time. But what you have now, I want you to ask and he's going to escort you to your car. Can you also Where's the guy that cut the locks off our doors? >> Downstairs. >> Okay. Let's go get him, please. >> It was locks on what door? >> Right here. This is the chief. the chief assistant office and this was the chief's office right here. Now I asked Boston who cut these locks off the door. He said Lazar and I told him back these people got to get into the office. That girl been outside with that red hair. This is her office. She been outside since I got here. >> So this office belongs to who again? >> Amanda Smith. [snorts] She outside. >> What's her title? She's the uh the chief administrative assistant phone record. He was on the phone um disputing with somebody. They was very they they made statements saying they called GBI. Um all this just a lot of foolishness to give us push back on it. But we was able to get our attorney on the phone. >> Hi, this is the sheriff the door. >> Okay. >> All right. Just hang tight in here for me >> because um so Flores is basically in my opinion has been on the run since [snorts] January 15th. >> Okay. >> And it had been said that overnight they were moving boxes out. >> The mayor explains that locks have been placed on several offices overnight to protect records and city property after concerns about the former chief's management of department finances. prior to that date. >> Okay. >> Like he been moving boxes out. So I just didn't want any type of sensing information being moved out or to be shredded, you know, I wanted them to be able to get their personal belonging, you know, under supervision of someone that could be trusted. So I just know that he like these people are willing to do anything and they don't respect me. So I just came to see cuz I said how he's been here. This happened last night. So only a select few of people knew that the locks were on the door. So I could see, you know, no one just really working would think anything of it. But Bost been here. He knew. But his response was the people got to be in their office. Flores is not even here. So if you going to say that, you cut hers off. But why would you cut his off? He's not here. It's just no respect of authority or chains of command. >> So this is the administrative office. >> That's the administrative assistance office. That's the young lady that's been outside is not even in her office. She been outside since I got here. >> Okay. >> Before I before like me pulling up. So it's not like she's outside cuz she don't want to be in the building with me. She was already outside. >> So my thing is what was the urgency of her being in her office and she not even in her office and she respect me >> got >> in this city cuz that was a majority vote that made the decision to turn in Florida immediately last night. >> Okay. the reason for the lot being put on this office >> because she's his administrative assistant. >> Okay. >> So, she handles a lot of the business that she does that payrolls and you know we talk about account payables or how things I know she also works with account payables to make sure things get paid. So, I didn't want them to be doing anything forcing things because he he's he's already misused our city funds. We like I have a credit card documents, but he's used city funds to pay for personal items for his family. >> The mayor also explains that the locks were intended to prevent access to offices containing financial records and other important documents until the transition and leadership could be completed. >> Okay? >> And I cannot risk him playing with our money because we already in a deficit. >> Okay? So I just was trying to be in front of it but like this that are willing to do unethical things and we're here. He still going to have to leave. >> Come on. Let's finish this lady. Go ahead and get him up out of here. The sheriff is here. >> Come on out. This office 25 with me. Come on out. She fine. Okay. Come on sir. >> No. He cannot get the business. Go outside. Both of you all step outside, >> sir. >> No, don't do this to yourself. >> 205 325. >> Sure. >> Sir, can you please um >> You have your police chair here. >> Can you be being right over to the P with me? >> Where I am also uh 314 >> probably 1401. Don't do that. No ma'am. No ma'am. >> This this this to me. this too. >> Yeah, I I I know it's a lot going on, but one one one thing I don't want to happen is a lot of back and forth to ensue. >> You understand? Okay. And that's why the GBI is being called, sir. >> Okay. The the the GBI. >> Yes. >> In in reference to I don't know the entire situation. I got called by Locks. >> I Okay, >> I understand. >> And I'm here to take a report on LOS. As far as everything else, who was terminated, why they were terminated, >> we don't have any involvement. Understand? Um >> I didn't know people being escorted out the building. That's just unregard. I got called by lock. So I did. >> I have called for backup. >> Okay. >> Sir, you got your uh Sir, >> you have your identification. >> Uh can you provide to me? >> 051451026. >> You provide me your hard cop, sir? >> Yes. Deputies speak with the assistant chief who admits removing the locks but says he believed he was following direct orders [music] from the police chief. >> No, it's See, you go you go turn to something. It don't have to be um trying to >> Let me explain. Let me explain something to you. You damage city property. You understand that? >> You cut the locks off. >> I didn't damage city property. >> That's the question. Did you cut the locks off? >> Given a direct order from who? >> Chief. >> Chief who? Chief. >> From my understanding, your chief was terminated last night. Step four, >> what I was told, >> but I'm telling you based on from my understanding, >> I was giving direct order. >> Listen to me. >> From my understanding, your chief was terminated last night. You were not aware of that? >> I wasn't here last night. >> No, that's not what I ask you. Were you here? Were you aware of that? >> No, he was still the chief. That's why I was under the assignment. >> So, you were not aware. >> That's it. >> So, nobody told you anything about the chief being terminated last night? >> I said that's it. >> Let me explain something to you. >> I was going direct order. Okay, >> I'm not about to argue with you. >> Listen to me. I've been doing this long enough, okay? I'm giving you the common curse cuz you are another officer, right? But if you going to stand here and blatantly lie to me, >> I was giving direct >> because I understand that I'm past that I'm past that point. Listen to me. No, you listen to me. I'm chief for the next 30 days and I stopped to follow orders. That's it. Okay. >> I was told. Okay. He alleged that he was unaware that Flores was terminated last night or whatever. So, and I asked him, I said, "Did nobody told you that he was terminated?" He said he was adding our direct a directive from the chief. Then he mentioned something about 30 days >> the chief had >> that was a situation for the city administrator and that's fine. That's only what I >> I understand that sir, but at this point I would like for him to remove be moved from the premises as well as Boston and we can handle this with our attorney, but they need to remove the premises immediately and be considered trespassing if they come back. >> Okay. What about their employment? As the investigation continues, deputies [music] work through the legal questions surrounding the officer's employment status and explain why they can't immediately remove anyone from the [music] police department. >> We would have to We don't have an interim chief in place. I don't I always see it >> and I like I've always seen you. >> Yeah. So, that's what I'm saying. >> I understand that. >> Okay. Okay. So, let's let's talk about that at another time, but today I just want you to leave. >> So, as far as the locks, are we y'all pursuing charges or >> Yes. Not against him, but against the assistant. >> Well, he's the one cut the locks. >> Oh, okay. Well, no. >> Yeah, he's the one cut the locks. So, the assistant did not take any part in that. And he's a list that he received directly from the chief. >> Okay. Well, long as we have the report that he received. So BA didn't tell you Boston told you the chief. Okay. Well, long as we have a report that the chief eat. >> So he he's contacting all um one of our majors. >> Okay. So we can make sure everything is on our end is squared away as far as like people being escort that still employed with a because if they're employed here without being terminated unless that ter that employment is terminated they still have a job. You see what I'm saying? So him being an officer him being officer any one of these guys being officer they will have the right to be here because they ter they employment has not been terminated. They're not on suspension and they're not on administrative leave. >> So without those in play, neither one of these people being terminated. Now if it's a termination and then you say, "Hey, they need to be trespassed from the building." But without a termination and they been a city employee, that changes the entire situation. >> Okay. >> Okay. >> I'll go work on the termination while we wait for your major. >> Okay. So, and then now it's it's same thing with assistant chief Bostic as well. >> Yeah, that's what I'm saying. He's I feel like, you know, today he say he's willing to leave it. >> The mayor tells the deputy that based on her conversation with the city attorney, she believed the assistant chief could be trespassed from the property immediately. She says her understanding was that the city could notify him of any employment decision afterward. >> We're fine with that until we get things figured out and have a better conversation. But by state will be terminated today. >> Okay? >> Because I spoke with a city attorney and they they was told something different. However, disrespecting you in the chain of what's going on today, we can handle the termination. >> What what what were you told >> that we could have him trespassing and he would be notified on the response of how we move forward. But as of now, he could be transferred to >> once we get that. >> Yeah. Because he they are all still employees. Okay, we'll be back. >> Right. Okay. And again, his statement of course is on body cam. >> Um, which he stated he received a directive >> and he he mention he mentioned a 30 days a 30-day thing. >> No, he's a liar and a manipulator. >> So, he was terminated immediately. He was He's not even here. So, he's just get second information. But, he's that's he's a he's a monster. Okay. >> And this is what he do. He uses people to do his dirty work so it won't come back on him. Okay. So, he's going to leave on his own. >> He's going to leave on his own. >> Now, when >> and we have whenever we come to the interim, we'll have them to follow up on him. >> Okay. Like I said, with him still being lawfully employed. >> He's pretty much he has cuz he works here. So, he has a right to be here without a termination, administrative leave, and um >> suspension because, you know, I'm I'm not here to talk to you. >> Yeah. >> I mean, we've always had a friendly relationship. Right. Thank you. >> So, um, if like with BOS, you talk about termination. Once that is done, he's terminated, you all have all your property, whatever the case may be, >> and you still see fit the warrant to come trespass warrant, >> then you know, we'll be >> So, I want y'all to stay here cuz we about to go get >> Yeah, we're not going nowhere. We got our major coming. >> Okay. Deputies explained their legal reasoning to everyone involved, making it clear why they can't remove anyone from the building despite the mayor's request. >> But the reason why I called you, but everything was fine. He was everybody was fine. >> Councilwoman Eastman came over and heard the man start going back and forth about situation with Boston. And like I explained to them, other than the termination, we have no other knowledge of what else is going on over here. Um, we just came along. So >> that's that's ridiculous >> on >> on my end. They don't want to press any charges, man. >> Um, that that's why I stayed you. I'm going to treat you because >> that's why you told me what I told you and >> you you're still an officer and >> I'm be honest with you, this is a up situation. >> In order to experience this, you got to report stuff to have some sort of so Um, since you right here, this where we are. As far as removing people from the property, we we have no legal reason to do that because nobody has been terminated. Nobody has been suspended. Nobody's on administrative leave. So, you all are still city employees. You all have a right to be here. >> Now, once everything else run it course, whatever they decide to do, that's the citiz. Now at that point if somebody is terminated, suspended, placed on administrative leave, refuse to leave a property only then and then we can trespass you all from the pro but as of right now you all are still city employees and that hasn't been explained to the mayor. Okay. Okay. So that's where we are now. as far as the property deal with the locks on the door for whatever reason they were put up has nothing to do with the county but they were cut off this officer straightforward he was given directed by Chief Flores from his understanding a 30-day thing was in place I don't know I can't say but they don't she don't want to the mayor doesn't want to pursue charges against this young man >> because the officers are still city employees deputies determined they cannot [music] legally remove them from the building or issue trespass warnings at that time. >> They he say he's going to leave or whatever the case may be for the day. >> Now once it gets to the point to where somebody's terminated, suspended on administrative leave, then of course you have no rights to that particular time and a current trespass warning can be issued. But long as you all are still city employees, we can't do that right now. We can't escort nobody to prop. We're not going to escort anybody off the property that is a uh valued employee of the city of Fort Valley until we have termination in place, suspension, administrative leave, and that person refusing to leave the property or the city just say, "Hey, I want this person trespass." But we have to have something else in place other than somebody saying, "Hey, remove him from the property." And if even if that has to take place down the line, it's going to be done in a respectful manner because whoever it is, you're still officers, but before that, you're still a man, woman, whatever the case may be. And we going to treat you as such. We're not there yet. Hopefully, we don't have to get to that point because that that that puts that that causes a lot of friction. Here we are. We got two agencies supposed to be working together. We've been we've been called >> for something that's taking place or whatever the case may be and people want people to be escorted off the property. If it needs to be done, it's going to be done in a respectful manner. It's not going to be in a manner to where, hey, come on, you don't want to go, we going to lock you up, this, that, and the third. It's going to be done respectfully. Hopefully, it doesn't come to that point. Hopefully all this stuff can be worked out in in a respectful manner like grown folk, not employee grown folk. >> So we're all here. I have two personal items in my office. Am I allowed to get them or not? >> We don't make that call. We'll take care of that. >> Yeah, we Yeah, we we can't we can't make that call cuz it's not our property. It's not our building. The deputy explains that if employees eventually need to be removed, [music] it will be done respectfully and only after the proper legal steps have been taken. >> Yeah. He's in this department. >> Yeah. So, >> exactly. >> So, yeah, we we we don't have no involvement in that. Okay. Um we're just standing by for one of our department heads to arrive on scene. So, we'll have somebody higher ranking than us to say, "Hey, this is what it's going to be. is how I'm going to go about it. And it's it's it's a tough situation. Tough situation. But other things has to take place before we just come over here and say, "Hey, you got to go. We don't we're not there. We We don't have that." It went from damaged locks to people being escorted. I wasn't aware. We just got called about locks. And that same thing I told my lieutenant we got called about locks and then people want to be escorted off the build out the building whatever. So >> yeah, we just not gonna do that and and then not be right in doing that. And we pretty much know all these guys over here anyway. So it's going to be if it has to be done, it's going to be a respectful manner. It's not going to be to hurt anybody or whatever the case may be. >> Excuse myself. Am I okay? >> Yeah, I got all your information. I'm done with you. Um, if you want to go ahead and leave the premises like you agreed to do. >> Yeah. I'm going to I'm going to grab my stuff from downstairs. I have my personal computer, all that stuff. >> Yeah. Well, don't you know, we're not I'm not telling you have to go. >> And that that is why I told you when I got that's and I appreciate. >> Yes, sir. >> All right. Thank you, sir. >> Yes, sir. >> Hey, man. How you doing? >> Come on. Get that coffee. Come back. Who? What's up? You doing all right, man? >> Yeah. You You calm? >> I'm good. I'm good. >> An officer then speaks briefly with one of the department employees, acknowledging how complicated the situation has become. She points out that sensitive police records and evidence [music] are stored inside the building, making it important to carefully control who has access. >> Yeah, there's like a power struggle top going on right now. Plus, there's there's police information to run this police department >> in that cannot be >> I understand. >> I know you tell us. >> Yeah, >> believe me outside. >> Reports later indicate that the former police chief and former assistant chief plan to pursue legal action against the mayor and the city of Fort Valley over the circumstances surrounding their removal from the department. And that folks is what happens when money gets mistaken for immunity.
