So, as I'm driving through this dust cloud, this vehicle just swerved off the road pretty severely. Um, we're going to go stop them. Make sure they're not driving under the influence 19. Traffic >> 19. I'll be Mount Charleston and rodeo with Nevada 212 Zebra Robert George dark and color sedan 19 >> recording five Five. Copy. Hello, Deputy Gunningham. Knight County Sheriff's Office. The reason I stopped you swerving and you swerved all the way off the road back there. >> I did. I dropped my phone. >> Okay. Have you had anything to drink tonight? >> I had one beer. >> Okay. Yes, >> there's this. Let me grab my registration. >> Where are you coming from? >> My friend's house. Literally just right there on Calvatada. And as I pulled out, I dropped my phone. >> Okay. >> So, she admitted to having some alcohol. Um, we're gonna get her out on field sobriety test and see where she's at. She does have a little bit of slowed slurred speech. Um, once I get her out of the vehicle, I can check her eyes, see a little bit better, see if I smell alcohol on her breath. It is windy, so it does make hard sometimes. Um, but based on the driving pattern, it's pretty bad. South 19, one out, Nevada. >> South 192 is negative one for the valid class D. Charles expires one of 29 with negative restrictions. >> Copy. Thank you. All right. Would you mind stepping out of the vehicle for me, please? >> All right. >> So, based on the driving pattern, >> your speech is a little slow. >> So, would you be willing to do >> I'm having an issue. Can you show me action control? >> Just hang out right here. >> They're not on patrol. I no >> they're a documentary. >> I don't care. >> I can they can have you blurred out. So >> I don't care. I don't want a part of this. >> Okay. So he's in a public space. He has the right to do it. So >> to filming? >> Yeah. Is this public space? He can. But we can talk to him afterwards. >> Yeah. >> All right. Um so just hang out here. I'm going to grab a clipboard with all the stuff on it. All right, if you mind, we're going to walk over here. That way, we're not in the middle of the road and that way we don't get hit. Just go right down the street. All right, this will work right here where it's nice and flat. >> I'm one woman. That's necessary. So, uh, on DUI, we do secondary units because one's observing, one's testing. It's not like anything works. So, all right. [snorts] So, you said how much alcohol? >> I had about one beer. >> Okay. Okay. Do you have any injuries? >> You have epilepsy? Sensitive to flashing light? Any medications you take? You smoke marijuana? Okay. Any illegal drug use? >> No. >> Okay. Um, let's see. Any recent accidents? >> No. >> Okay. All right. Are your shoes, clothes comfortable? >> Yeah, I am wearing Crocs, bro. >> Like some I've seen people go hiking in Crocs. >> Absolutely. >> So, they're good. All right. All right. I'm going to administer a series of tests to determine whether or not you're impaired. My evaluation will be based upon how well you follow the instructions and how well you perform the test. Understood? All right. Go ahead and do me a favor. Go ahead and come where it's nice and flat. Feet together. Hands at the side. And so what I'm going to have you do is I'm going to have you follow the tip of my finger with your eyes and your eyes only. Continue to follow until I tell you the test is over. Understood? Can you see that? >> Yeah. >> Okay. >> Eyes only. >> You go so far from the peripheral. >> That's the goal. >> Okay. Okay, >> at Charleston the rodeo status. >> Go for >> All right, the next will be the walk and turn test. So, we can use this line right here where you see the dark spot in the road. That way, it's easy. >> Okay. >> All right. So, what I'm going to have you do is place your left foot on the line. Take your right foot, place it heel to toe in front of your left. Go ahead and have your hands down by your side, watching your feet. Maintain this position until I tell you otherwise. Okay. >> Okay. >> So, what you're going to do is you're going to take nine heel to toe steps. Arms at the side, watching your feet, and counting out loud. It's going to look like one 2 3 4 5 6 7 8 9. When you get to the end, you're going to leave your lead foot planted. Take a series of small steps. Return back down the line. Nine heel to toe steps. Counting out loud. Watching your feet. Hands at the side. >> Okay. >> Understood. >> Sure. >> All right. You guys >> if it makes you feel more comfortable. >> All right. So, let Yep. >> Am I good to go? >> Yep. Go ahead and begin. 1 2 3 4 5 6 7 8 9 1 2 3 4 5 6 7 8 9 Okay. All right. Last is the one leg stand. So, you can have your shoes on or off if you like. >> Okay. >> So, same thing, feet together, hands at the side. So, what you're going to do is you're going to raise a leg of your choice, >> either one, and you're going to raise it approximately six inches off the ground with the foot parallel to the ground. You're going to keep your arms and legs straight, watching your raised foot, counting out loud in the manner of a 10001,002,0003 and so forth until I tell you to stop. >> Okay, >> understood. >> All right, >> you may begin. 1,000 1,002,000 3,000 4,00056,0007,000 8,000 9101 2012 134 2015 2016 21223 Three. >> You can stop. >> Four. >> All right. Would you be willing to do a preliminary breath test? >> Straw up before. Keep blowing until I tell you to stop harder. Keep going. Keep going. Gone. Gone. Gone. seems about right. >> What said that seems about right? >> Yeah. All right. So, you're not over the legal limit. You're a little bit more than half. All right. Do you have somebody that can come pick you up? >> My friends live right there. I literally just pulled out of their driveway. >> Okay. Because there's my concern. I understand. You said you dropped your phone, but you are showing signs of intoxication. I personally don't feel safe letting you back on the road. So, if you can have someone come pick you up, it'd be awesome. >> Okay. Literally, just right there. Cool. >> Do I need to sign anything or do anything else? >> No, you're good. >> Thank you. >> Yeah, she failed all three, but it just you can just tell it was close but not instructions. >> Yeah, not that just >> Yep. Watch out. Watch out. Holy [ __ ] 19. The vehicle almost hit me coming head on. This vehicle almost struck me head on. I'll have it stopped at Dandelion Homestead. Plate will be Nevada Robert Ida X-ray. King Ida X-ray blue Toyota Tacoma. >> Hey, get out of the vehicle. >> I'm sorry, sir. >> Get out of the vehicle. >> Hey, put it in park first. Put it in park. What's up, dude? >> You've been drinking? >> No. >> And why are you driving like that? You almost hit me coming head on. >> Yeah, I thought I thought I did. >> Okay, so why why why did that happen? >> I was going to to My temper. >> Okay. Tell me about your temper. You said your temper. >> Yeah, my temper. Sure. >> Go ahead. >> I really didn't mean to. >> Negative. All right. Be honest with me. How much have you had to drink in the last couple hours? Go ahead. No. Uh, go ahead. I also have the PBT. All right. I can smell the alcohol on your breath. >> There's no alcohol on my breath. >> Would you be willing to do field sobriety test? >> Yes, sir. I would. >> Okay. >> All right. Do you have an ID on you? >> Sure. >> Where's it at? >> All right. Just go ahead and come back to my vehicle. Don't worry about it. Sure. All right. Just stand right there for me. All right. I'll be right back. So, this individual almost hit us head on. Um, he was all over the road. I could smell alcohol in his breath. So, he's willing to do field sobriety tests. So, we're going to go ahead and get him started there. >> Just let's stand out of the road. That way we don't get hit by a car. >> All right. What's your name, bud? >> Oats. >> All right. You have any injuries? >> No. >> Okay. You have epilepsy? Sensitive to flashing light? >> No. >> Okay. You taking any medications? Uh, no. >> Illegal drug use? >> No. >> Okay. Marijuana and you consumed any alcohol? >> No. >> Okay. Were you in a collision? >> No. >> Okay. All right. Are your shoes and clothes comfortable? >> Excuse me. >> Are your shoes and clothes comfortable? >> Yeah. >> Okay. All right. I'm going to turn down my lights. >> Are you able to stand up straight? >> Yes, sir. Okay. All right. Here's what I want you to do. I want you to go and stand right here where it's nice and flat. Oh. Okay. All right. So, what we're going to do is we're going to do the horizontal gaze and stagmus. I'm going to administer a series of tests to determine whether or not you're impaired. Your eval my evaluation will be based upon how well you follow my instructions and whether or not the tests were performed exactly as I demonstrate them. Understood. >> Thank you. >> All right. So, we're going to do the horizontal gaze and stagmas test. Do you have any contacts in >> you wearing contacts? >> Yeah. Do you have contacts? >> Yes. >> Okay. Are they hard or soft? >> No. >> Okay. All right. Go ahead. Place your feet together. Feet touching. Okay, >> feet touching, hands at your side, and you're going to follow the movement of my finger with your eyes and your eyes only. Continue following my finger with your eyes until I tell you the test is over. Understood? >> Yes, sir. >> All right. So, it's going to be eyes and eyes only. >> No, no, no, no, no, no. Stand right on spot. All right. Can you see that? >> Yes. >> All right. Follow the tip of my finger with your eyes and your eyes only. Okay. Go and keep your eyes open and up. All right. Follow the tip of my finger. Okay. Understand? Okay. Go ahead and follow tip of the finger here. All right. Follow that. Okay. How far you want me to go down? >> No. Yeah, I we're past the point. Go ahead and place your hands behind your back, sir. >> All right. You're under arrest for driving under the influence. >> Driving under the influence. >> Yes, sir. >> I have not You are exhibiting signs of extoxication, sir. You're not able to follow my finger. Not able to follow my instructions. You can't even stand still. >> All I did was >> 19. Show one in custody. >> All I did was drive home. All I did was drive home. >> Hey, are you willing to give me a blood or breath sample? >> Absolutely. >> Okay. You want to do breath? >> Is that okay? >> You're not going to get down to the jail and change your mind? >> Nope. >> Okay. I'm going to read you something. Oh my god, this is insane. All right, you're you're under arrest for driving under the influence. You're being requested to submit to evidentiary testing of your blood or breath to determine alcohol content or controlled substance. If you consent to a breath test, you must give two or more consecutive samples. If this is other than a first offense or it is believed you are under the influence of a controlled or prohibited substance or reasonable grounds exist to believe you've caused death or substantial bodily harm to another person, you're requested to submit to a blood test. You have the right to refuse chemical testing. If you do refuse to submit to chemical testing, I will apply for a search warrant to use reasonable force to obtain up to three blood samples from you. A refusal to submit to a chemical test or any portion thereof will result in the immediate suspension and subsequent revocation of your license or operating privilege for a year whether you're found guilty of the charge for which you're arrested or not. >> Okay, sir. What am I doing right now? >> Give me I'm almost done. You are further advised that any warning relating to having attorney present before answering questions does not bear on the issue of submitting to evidentiary testing. You do not have the right to speak to an attorney before testing. So, what that means is I'm asking you to either give me a breath or blood sample. You have the right to refuse. If you refuse, I will apply for a search warrant and you will lose your license for a year regardless. >> Okay. >> Sure. >> Okay. That make sense? >> Sure. >> All right. So, go ahead and we're going to go ahead and head back to my patrol car. Okay. We're going to come to this side. Oh, other way. My patrol car is behind you. Behind you, bud. Other way. There we go. There. There you go. Just hang out right here. >> Never ever ever All right, bud. Go ahead and have a seat. >> Are you taking me to jail? >> That's where we got to do the testing, bud. >> [ __ ] kidding. Little back pockets. This is the biggest joke I've ever seen in my life. >> All right, so you want us to tow it now? >> Joke. Uh, Charlotte, >> go ahead and get your foot in there. That way I don't close it on you. Thank you. >> Sure. >> Get that over your head so I don't >> Oh. Ow. Ow. Get these out of me. Get him out. >> Hey, we're like 2 minutes away from the jail, man. >> God damn it. [screaming] Oh my god. [screaming] Control 19. [screaming] >> He almost hit me coming head on. >> Yeah. >> Yeah. I like almost got in a really bad accident >> cuz he kept doing this and I'm like and I went last second and I was like this seems like the right place to go. >> Chicken. >> Yeah, it was we basically Yeah. >> dude. >> Yeah. >> Is he being combative right now? >> Uh he always does this. So he's always he's every time I've dealt with him he's resisted. He was cool with me on scene but every time he gets here you've dealt with him before. So, >> hey, what's up? Get your get the seat belt off over your head, man. >> All right, go and step out. >> If you lean back and get your right foot out. God damn it. I can't get out. >> You can get out. I believe in you. >> I believe in you. >> [ __ ] [ __ ] [ __ ] [ __ ] Ow. Ow. Ow. Ow. Ow! Ow! God damn it! This hurts! Ow! Ow! God damn it! [screaming] >> All right, come on. Sit up for me. [screaming] We have a phabotamist here right now. >> I think she's a phobotamist. Yeah. No, it's right. >> Yeah, cuz uh [screaming] >> this probably going to be a warrant. >> Oh god, it hurts. It hurts. Coming off. Get off >> again. >> What the [ __ ] Take a seat. Sit down. [screaming] >> Lean forward. >> Lean forward. [ __ ] >> I'm going to take your cuffs off if you lean forward. Lean forward. [laughter] [clears throat] [screaming] Oh, >> are you willing to do the breathalyzer, bud? >> No. >> Okay, sounds good. You're not willing to give blood? >> Blood? >> Yeah, blood draw. >> Why don't I give blood? >> It's the same thing as a breathalyzer, just evidentiary testing. >> Please let me know. >> I'm taking that as a no. You don't want to do testing? >> Yes. I I don't want to do testing. >> Okay, sounds good. I'll get a warrant. >> Can I get your watching ring? Get your watch and your >> All right. So, we applied for the search warrant. It was granted from the judge. So, this basically means that I have the right to take his blood uh through reasonable means. So, we're going to go down. We're going to serve this warrant to him um and hopes that he's in compliance with the search warrant. Um if not, we will use a reasonable amount of force to take it from him. I don't want to be here anymore. >> Sounds good. >> Let me go get it. >> How's everything? >> Pull up cameras for booking and start active vlogs. Set that right there. >> Open pre-booking. >> Take your hand out of your cuff. When you do, you're going to put it on top of your head. Do you understand me? >> Nice to meet you. One, sir. Here's the copy of the warrant signed by the judge. >> What does this say? >> I can read it to you. >> Yes, sir. Go take a seat. Proof by affidavit and incorporated as if fully set forth herein, having been on this date before me by Deputy Cody Cunningham of the NY County Sheriff's Office, County of NY, state of Nevada, said affidavit being attached here to and incorporated herein by reference that there is probable cause to believe that certain property, specifically two blood samples taken approximately 1 hour apart, with each sample containing two vials to be tested for alcohol content is currently concealed within the body of Rodri. Allan Oats data have been described as a white male approximately 6 foot tall with blue eyes having Nevada driver's license 850 and as I am satisfied that there is probable cause to believe that set evidence is located as set forth above and based upon the avid David attached here to there are sufficient grounds for the issuance of the search warrant. Jud Judge Michelle Fiori, Justice of the Peace. May >> I have this? >> Yep. That will be in your >> N. >> We have a warrant to take your blood, sir. So, we're going to take your blood. >> My blood? >> Yep. >> You're going to get a blood sample. You're either going to go in that chair. >> I'm not going to give you my blood. [clears throat] >> Okay, cool. So, you're going to go in that chair, sir. >> Okay. I'm going to go. What the Who the [ __ ] do you think you are? Who the [ __ ] do you think you are? What a bunch of jackasses. You have no [ __ ] rights to do this. >> That was with the I and and I I I guarantee you I'm going to be suing you. >> Please do, sir. It's your >> Oh, yes. I'm going to be suing you. >> I got really good attorneys. God damn it. Shut that. move this on one side. >> Can you You're hurting me. All right. You're hurting me. >> If you stay still for just a few minutes, it'll be done and then they can let you out of the chair. Okay. >> Ah, god damn it. [ __ ] you cops. Go ahead and have a seat. >> So, we're going to do our second blood draw because it was past the time limit for when we got the first one. Um, we're required to get two separate blood draws and it gives us a calculation of where their blood alcohol content is as well as controlled substances. >> We're going to wait just >> sit there. You >> You're good. Just relax for a second. Relax for a second. >> We just have to do it at a specific time is all. All right, you can start setting up. >> All right, we're ready to go. >> There you go. >> Get your arm out again. Pump your fist. >> You okay? We're going to poke. >> Do whatever you say. [clears throat] >> Stay as still as possible. Okay. >> Mhm. 11:18. So, we stopped the DUI driver earlier. It was about 8:00 p.m. Um, and we're coming up on midnight now as the reports being completed. Um, due to the fact that I had to get a warrant and wait the time in between each blood draw and do all these different forms, um, this was about a 4hour process. So, I do enjoy doing DUIs because DUIs cause approximately 10,000 fatal accidents a year. And, uh, it's a pride of mine to take drunk drivers off the road. So having to spend 4 hours on it is kind of like a labor of love for me and uh I don't mind. So when we were getting ready to stop the vehicle, I noticed that it ran off the road on the opposite side and then it started to come into my travel lane headon and it was almost like this little game of chicken back and forth and I'm swerving and eventually I swerved to the right, he swerved to his right and we avoided each other. But that definitely got my adrenaline pumping because I'm thinking that I'm about to get hit head-on by a drunk driver. Um, thankfully that's not the case. Thankfully my training uh kicked in and I was able to avoid a serious accident. [music] >> [music]
