take a minute and and catch your breath. Okay, I'm sorry. You guys do this. >> And it was at this moment that she realized that her career was over. Today, we have two very powerful women who are in a position of authority and they get arrested after thinking they are untouchable. Let's start with the first case, which is a police officer who showed up to work completely drunk. Hey, Marine. Take a deep breath. >> Take a minute and and catch your breath. Okay. >> I'm sorry to let you guys do this. >> Let's not jump to conclusions, okay? Let's just start with one thing at a time. Okay. So, what happened earlier? >> A lot. >> Okay. What's a lot? >> Some breakup. >> Mhm. >> Even before that break up with my baby daddy and >> Mhm. >> It's been a lot. >> I understand. >> I don't tell a lot of people a lot of stuff cuz I don't like them to know. >> I understand. It's It's your personal life. Okay. Obviously, I can slow the alcohol. Okay. >> I'm not going to deny either. >> I know. I'm I'm not asking to. Okay. I just I have to get through everything. All right. >> I can smell the alcohol. I can see your eyes are I see you've been crying, but I can also see that they're a little bloodshot and watery. All right. >> Um, did you have any alcohol? >> Yes, >> you did. Okay. What did you drink? >> Two tall boys. What? How far? Uh >> the 24 oz. >> 24 oz. Two of them. Okay. How long ago did you drink those? >> About 6:00. >> 6:00. Okay. And when did you have your last drink? Do you know? >> About 6:30. >> 6:30. >> Yes. >> Okay. So, just to give you guys more context, she was drinking. She was fighting with her boyfriend. And even though she lives over an hour away from the police station, she still decided to drive drunk to work. Now, this is mind-blowingly insane. I mean, what was going to happen exactly? She was going to do her shift while she's drunk. She was going to arrest people for DUI while she is committing that exact same crime. I mean, the hypocrisy here is astonishing. That is something else. >> Not on me. I know. I should have known better. >> That's okay. >> Sorry. Um, so you had two tall boys around 6:30 prior to coming to work. Okay. >> Yes. Did you >> throughout the day? I I listen to people >> throughout the day as well. So would that be more than just two the two tall boys? Okay. Overall, what would you say you drank? >> Maybe >> a six-pack. Okay. When did you start drinking? >> 11. 11. Okay. And you and you had your last one around 6:30. >> And was it a a six pack of 24 oz? All six of them? >> No, no, no, no. Just um the T 24 oz and then between then and there like the >> Okay. And then when did you leave for work? >> I honestly don't know. >> You don't know? Okay. Where were you driving from? >> My home, >> which is Okay. So, and then you drove to the office. >> Okay. >> Um, >> I didn't want to, but I had a readiness to >> Okay. Um, would you do field sobriety tests? Would you be willing to do those? >> You will? Here's what we're going to do. Okay. We'll go over here. We'll try to stay on the sidewalk here since it's a little bit level. All right. >> We'll just go right here. Huh? Go ahead over here and face me. Okay. Try to keep your hands down at your sides, heels, and toes together. All right. You have any serious brain injuries? >> No. >> Any issues walking, turning, or balancing? >> Adjust the six pins and the plate in my right knee. >> In your right knee. Okay. How long ago was that injury? >> 2016. >> 2016. Okay. But you're been okay since. You've been relatively healthy. >> Relatively. >> Okay. I know you're cold. Try to get through this. Hands under your sides. All right. >> You see my finger? >> I'm going to have you follow my finger with your eyes only. Try to tilt your head up for me a little bit. All right. Just follow my finger with your eyes and your eyes only. You understand? So, to be honest, I'm not too crazy about the babying that he's doing. He's talking to her in such a baby voice. But I will give credit where credit is due. I am glad that her co-workers did the right thing and launch an investigation because it would have been so easy just to look the other way. And I know a lot of people talk about the thin blue line and that sometimes police officers give each other preferential treatment. In this case, it did not happen and they need to be commended for that. They did the right thing. And that's why I love body cams because they bring accountability. In this video, the body cam is simultaneously exposing a bad police officer and the good police officers that sounded the alarm. Okay, go ahead and face the car. All right, see my flashlight? Go ahead and put your left foot on my light. You can begin when you're ready. 1 2 3 4 5 6 7 8 9 1 2 3 4 5 6 7 8 >> Okay, for this next test, I'm going to have you stand with your heels and toes together, hands down at your sides. Stay in this position and tell you to move. Okay. No, you can begin when you're ready. 1001,002003 >> Make sure to look down at your toe. 1005 100678 100901 2012345 2016201223 2024 20 can stop. >> Let's go ahead over there and have a seat. Yeah. And >> all right. So here the officer turned off his body cam and went to talk to his sergeant. Now I don't think there's anything suspicious about that because in the end they ended up arresting her. Now, if they would have let her go without any charges, then this moment would have been suspicious. But at this point, I don't think it's that noteworthy. Maybe it's just part of their protocol that when they talk to their sergeant, they turn off the body cam. Oh, by the way, the next segment features strobing lights. So, just be careful if you're photosensitive. >> All right, Marissa. Okay. Yeah, I will I will talk to them in a minute. Just give me a couple minutes. Okay. Um I know they're going to we're going to try to figure out if your kids your kids and everything you're fine. >> You don't have anything on you? >> Yeah. >> I'm just going to check the >> I'm just going to check really quick. Okay. Yeah, that's fine. my earpod. >> Okay, >> so let's see what the article had to say about this situation. It says, "Back at the station, court documents showed that she blew more than twice the legal limit on a breath test. The Santa Fe Police Department said Officer Luhan's action do not align with their values and it has caused a stain on the entire profession. The job that our officers are entrusted to do have become more challenging following the incident. We have one less officer that's in the field serving our community. We face criticism as an agency. Now we all have to work harder to earn back that trust that was lost, said the Santa Fe Police Department Deputy Chief of Police Ben Valdez. The Santa Fe Police Department told the news agency that officer Luhan is currently on alternate duty status, which involves no contact with the public and includes administrative tasks. They expect to launch an internal investigation as the criminal case moves forward. And here's the thing, she's cooked. It's on body cam. She's getting fired. It's just a matter of time. Keep in mind, you have the presumption of innocence. You guys know the saying, innocent until proven guilty. But in this case, she blew double the legal limit. So, I'm sure she's going to get fired within the next couple months, but they do have to follow the proper procedure. I'm going to step up. I know it's a little bit of a step. I got you. Sit tight for a minute. Okay. All right, Marie. >> Yes. >> Listen to me about the tell you something important. Okay. You're under arrest for a DUI. Do you understand? >> Yes. >> Okay. You already agreed. Go ahead and look at me. Open up your mouth. Lift your tongue up. Perfect. >> I have your phone. Okay. Um, >> do you have my phone? >> Yeah. Who's with your kids right now? >> Uh, her dad. >> Both. All your all your kids are taking care of for the night. >> My daughter. Yeah. >> Okay. Um, I'll go and let them know. And so your your kid is with your mom. >> Her dad. >> Her dad. Okay. In Rio. >> Okay. Okay. I'll let them know and then we'll head to the office. Okay. Make sure you don't fall. Yeah. Just have a seat. You can stop. Come on. I'll have you stand there. I'll turn the light on and crack the door for you. Okay. So, like I said earlier, she was arrested for DUI. Now, even though at this particular moment she still has her job, trust me, it's not going to last long, the next case is very different because this judge not only got arrested, but she also got suspended without pay. Take a look at this. Well, Judge Rosie Speedelin Gonzalez runs a trauma-informed court that claims to handle low-level offenders with care instead of treating them like career criminals. But now the Bear County judge has threatened to fire her staff if they have any contact with people who used to work with her court. People named in the judge's no contact order have come forward. They described a case that investigates a judge whose behavior became erratic and aggressive toward defendants. >> Ray Fleo or Reflection Court is led by County Court 13 Judge Rosie Speedelland Gonzalez. It's an intense trauma-informed treatment program for firsttime domestic violence offenders. >> Kind of get down into that root cause of of what led them into the situation. >> Cynthia Garcia provided therapy to defendants while working for this nonprofit partner of the court, American Indians in Texas at the Spanish Colonial Missions. But what Garcia described as a dream work life balance was shattered last year. I mean, on paper, this court sounds like a good idea. You take firsttime offenders and you try to rehabilitate them without dragging them through the court system. On paper, it sure makes a lot of sense, but in practice, it looks like the complete opposite was happening. Luckily, we have some courageous whistleblowers who blew the lid on this entire situation. after she says the judge, who she's known for more than a decade and considered a personal friend, had a noticeable shift in behavior and began lashing out at defendants in court. >> I couldn't believe that they're being put on the record. >> Garcia detailed multiple incidents in an interview with KAT. Like one female defendant, >> she had a pregnancy scare. She, you know, thought it led to a miscarriage. So, the judge went ahead and and told her to invest in batteries and get basically a vibrator, less trouble, you know, and and that is what blew my mind the first time. >> Or an 18-year-old bered by the judge after his case manager found a video with sexual content on his cell phone, >> calling him a a poser. And, you know, this young man is homeless. He lives in a group setting. Um, he was triggered. He was shaking. It was ugly. >> Garcia's anguish reached a tipping point in mid July. >> In an email thread started by Garcia listing concerns about a participant, she says Speedelland Gonzalez responded harshly, telling staff to quote, "Stay in our respective lanes." And after writing that she was not singling anyone out, into the message by stating, "If you feel I am doing this, I need you to consider getting therapy." To me, it sounds like the one who really needed therapy is the judge. I mean, this is insane. Especially what she had to say about that woman who got pregnant. I mean, that is not your place to give her advice on what to do with her sexual life. That's insane. It's mind-blowing. I'm completely speechless. Luckily, this was brought up to light because this could have went on for years. >> And it really did, you know, appear to be directly at me. Garcia says she was called into her manager's office the next day and was told she was being removed from Rafleo Court. Her work hours slashed. Garcia eventually resigned from the nonprofit. >> So, it was hurtful cuz I you know I I put my heart into my work and it it was just the betrayal from somebody I I considered a friend. >> The behavior she gave was aggressive. when it did not need to be. >> Crystal ooa was a complex care manager for the center for healthc care services working in four courts including Rafleo. She also noticed a shift in the judge's behavior last year >> became very like no this is what I'm saying. This I'm the judge. I'm going to do this whether you all like it or not. It just was not appropriate especially it being a trauma-informed type of setting. ooa like Garcia months earlier was told in September she was being removed from Rafleo. Her employer went one step further terminating her last fall for what she described as not completing case notes in the appropriate amount of time. So at this point what we have is a power tripping judge and a very very toxic environment but there's still no crime being committed. However, that's about to change in just a moment because if this was the entire story, then this would have probably not made the headlines that it did. But it gets much worse. >> In late September, Speedland Gonzalez sent this email banning Rafaleo and County Court 13 staff from having any contact with OOA Garcia and two county employees who had recently resigned days apart. quote, "A breach of this directive will be grounds for removal from the team." Judge Speed Gonzalez declined our request for an interview. Asked about the specific incidents in court, the judge told us via email, "At this time, I will not be disclosing information regarding any individual or nonprofit vendor involved. Out of respect for process, privacy and the integrity of our partnerships, it is important that we allow the appropriate systems to function without speculation or distraction. >> So basically, she was deflecting. Now that was one incident. The next incident was a lot more serious. In this case, she allegedly handcuffed an attorney and then bered her because I guess she wasn't doing what she wanted. One thing's for sure, this has to be one of the most power tripping judges I have ever seen on the internet. >> A county court judge indicted, accused of having an attorney handcuffed and kept in a jury box. Judge Rosie Speedelland Gonzalez turned herself in this afternoon on both felony and misdemeanor charges. >> Case Investigates broke the story two weeks ago, and Dylan Collier continues to follow through now that the case has gone to a grand jury. Judge Rosie Speedeland Gonzalez's legal ordeal began December 17th, 2024. During an argument with defense attorney Elizabeth Russell inside County Court 13, Speedelland Gonzalez ordered Russell to be handcuffed. Court transcripts show the judge bered the attorney while she sat restrained in a jury box. Russell, who declined comment today, filed a criminal complaint. Earlier this month, KEAT Investigates exposed the incident and spoke with former employees who worked in Speedelland Gonzalez's court. They described the judge's behavior as increasingly erratic. So, what I find concerning is that this incident happened in 2024 and then still she had her job until 2026, which is a massive problem. That means that during this time there was a bunch of people that were being judged by someone that as they claim was an erratic judge that wasn't fit for the bench. So yeah, very concerning that it took that long for them to take action. >> The two-count indictment accuses Speedling Gonzalez of unlawful restraint by a judge, a secondderee felony, and misdemeanor official oppression. >> And Speedling Gonzalez did not respond to a request seeking comment. Records show she turned herself in just after noon and was released from custody around 2:00. >> All right. So, now that she's not in custody, Dylan, what ultimately happens to the judge moving forward? >> Yeah. She has an opponent in the March primary, which is now just over four weeks away. The state commission on judicial conduct could also move to suspend her, which we have seen happen. And luckily, that is exactly what happened because just a few days later, the same news station had another clipping where now the judge has officially been suspended. And it's very important to mention that the judge was suspended without pay because if she would have been suspended with pay, that would make absolutely no sense whatsoever. Luckily, it didn't happen. >> Been on it since the very, very beginning. And I'm just wondering if this surprised you in any way coming down today. Ernie, I'm surprised it took this long. We've had some case precedents recently in other counties uh in our viewing area. Usually, this suspension without pay comes within a day or two. This order comes on the heels of Speedling Gonzalez being charged with felony unlawful restraint and misdemeanor 2024 altercation with a defense attorney she had handcuffed in court. The order was made public this afternoon and is very direct. Speedling Gonzalez is suspended without pay and is barred from her court until the charges are dismissed, she's acquitted, or the commission issues a follow-up order. No official plans have been announced on how cases assigned to County Court 13 or the Raflejo Specialty Court will be handled. It's likely a visiting judge will sit on the bench for the time being and some cases could be farmed out to other misdemeanor courtrooms. Speed Gonzalez is on the March 3rd ballot. seeking re-election. Neither she or her criminal defense attorney responded to requests for comment on the suspension order. >> Hey, good luck with that reelection. I'm sure it's going to go so well. I'm sure that the taxpayers are going to be more than happy to reelect a judge that is currently facing a felony charge. Anyways, that's it for the video. Thank you so much for watching. I hope you guys enjoyed the show. If you did, make sure to subscribe.
