After the encounter, the suspect was arrested and charged with theft of services and he was also banned from all Red Lobster locations. Customer thought he could talk his way out of paying at the airport. On February 25th, 2025, [music] police responded to a restaurant at Tampa International Airport after staff reported a man refusing to pay for his meal. Here's what happened when the officer stepped in. How you doing? How you doing? Good. Guess you got to pay your bill? I'm about to get the guy who's going to pay it. Who's the guy? Beavis man. Okay, where's he at? I'm about to go get him right now. You want to walk with me? You can't leave the restaurant. You got to identify yourself and let them know who you are. But you can't just can't leave without it. So, let's walk back inside and we'll talk in there. Let's talk. No, we're talking right here. Hey, we're talking right here. How much? Pay the check. I was just about to say, how much do you want to see? I'm not I can give something as collateral. Your ID. And then if I could give my ID, can I give a key? This isn't a negotiation. No, you got to pay your bill. It is not. >> It is. No, you're wrong. So, Not so, it is not. Copy. I just saw him. What you're saying now doesn't matter. This is not our first day here. I understand that. You you have enjoyed a product I have. and you haven't paid for it. I have. And No, no, there's no there's no anything else. There's no anything else and I'm just letting you know. What's your What's your first name? Nope. Won't be doing that either. Nope. It was 50 something dollars. He's trying to leave the bar without paying. He said he's got a buddy. And his buddy is nowhere here. He's arguing and He doesn't want to pay his bill. He said he's got a buddy down there who's going to help him pay the bill, but All right, where's your buddy at? Because I still got to get contact. So, you don't have a friend here, do you? No, we don't. We both know that. You do? Yeah. Okay. I have many. Do you have one here to pay your bill? No, cool. Y'all get him. He'll He'll come here. That's true. That's what I'm saying. Let me Let me go get my friend. >> [laughter] >> Call him. No, go get him. Go get him. He'll come pay it and I'll walk out. With multiple officers around him, the suspect finally starts explaining his side of the story. Please give me that. Okay, so listen, before you say anything else. All right, listen to me. No, no, no, no, no. Listen to me. I'm going to work with you if you work with me, all right? So, there I have the receipt, right? >> Yeah. I don't even know how much it cost. It cost It cost Whatever it cost. Whatever it cost. Okay. It will get paid. Okay. I told him that before I ate anything. I said, "Look, I have a friend." Him. Okay. I said, "Look, I have a friend who once I'm finished eating, he's going to come pay for it." Mhm. And we going to be good. Is that so? All right. Okay. He said, "Yes, I'll take your word for it." Then he said, "Do I need a license?" I said, "No, I'm not going to give you my license, but you can have my key." Okay. Cuz if you have my key, I can't drive away. Okay. He said, "Okay, I'll take your word for it." With that, they served me the food. I ate my food. So, I'm upholding I'm upholding my part, he's upholding his part. Okay. So, y'all should get on him. No, that's correct, because you're just not going to talk. You're not upholding your part. You're not upholding your part. >> I I don't want to hear that. Well, it doesn't matter what you want. What are you What are you guys here for? Why are you here? I'm flying out. Where? Where's your ticket? Don't have one. Okay, you don't have You have no business here. >> No, they're going to They're going to give it to Yeah, to me when I So, pretty much you came here to rip the place off, get a free meal out of it, and take off. All right. Look, that's all I'm talking That's what? That's all I'm talking about. That's all I'm talking about, Thomas. That's the only topic. Yeah. So, The suspect tries to take control of the situation, but the officers quickly remind him who's actually in charge. Y'all can escort me. No, no, no, we're not going to escort you anywhere. Hold on. Listen, you're not going to determine what happens here. No, you're either going to pay this bill I can stay right here. Okay. Y'all go get him. Okay. Because I'm upholding my part, he needs to uphold his. That's not our responsibility to do that, okay? You came to this business to to eat, and I And you have to pay what you have to pay. Now, if If me talk, we can work with you, but you keep talking over me. I appreciate You keep talking over me and we're not going to get anywhere. I I negotiated it. We're not negotiating anything. The manager The manager agreed I don't care about the manager. You're talking to me right now. Okay, I'm I'm ta- I'm ta- >> That's the manager. I'm telling you I am telling you what's going to happen. You're not telling me. >> I am telling you cuz if you refuse to pay this bill, you're going to jail tonight. >> I never said I was going to refuse. Okay. So, if you let me talk so let me talk No. If you let me talk, I'm not I'm not going to let you talk cuz you're not listening to me. So said that he told him gave him the stuff. He said that his friend is bringing everything here. >> Yeah, to pay the bill. So, but if you let me speak, we can we can figure this out. Here's what I'm willing to do. If you're going to go look for your friend, you're going to keep talking over me and I'm just going to shut up and we're going to deal with the other way. Talk with him. >> I'm not talking with him. I'm talking with you. Are you going to listen to me? Talk with him. No. I'm not talking with him. No. Talk with him. >> want to find your friend Talk with him. >> No. I I made a deal with him, not you. >> I don't care what you made a deal with him or not. And I don't care what you got to do with him. >> should. I don't. You really should. All right. Well, so you're you're Listen, as of right now, you're not free to leave. You're going to stay right here, okay? You understand that? Talk with him. >> You're not free to leave, so stay right here. Don't go anywhere. Despite the officer's patience, the suspect suddenly escalates the situation, making things worse for himself. Yeah. 1031 Hey. All right. Well, he's getting arrested, so The manager has confirmed that the All right. Well, you guys are going to have to prosecute now cuz he's under arrest. All right. We're prosecuting. I was changed. I was on the phone with him. He changed. He went to go talk to him and tell him not to go anywhere and then he started walking away. Perfect. So, we're not to go move him back over here. >> Yeah, he's being detained and he's trying to leave. I mean, I can keep guessing. Y'all almost put me on my flight to Singapore. No. >> No. No, I didn't. Yeah, you didn't let me talk. That's the only reason I came here for the phone. He came to eat, too, and he didn't pay for it. I did come to eat too. It was very it wasn't good actually. Yeah. It's unfortunate cuz you got to pay when you come in or you got to have credit. Or or you have to communicate which I did. No. So on my part >> you weren't mistaken so so badly I guess. You have a car right there? Yes. What's the deal? We Are we Do you have chargers or Yeah, they he said he will. They're going to press charges? Hello. Hi. So we need to know before we continue on with what we're doing here. If you guys are not going to press charges then we're not going to do anything about it, okay? If you If you're going to press charges then we can get him for theft but that's totally up to you guys. We don't have the authority to to to prosecute. All righty, oh here you go. Just let me know what's what's going to happen. All right. 27 12 status? Yeah, I'll talk to my lawyer. I'm not going to show you again. Lean against the car. Lean against the car. Stop. Lean forward and relax. Feel where you want to feel. Get Get inside of the car for me. Yeah, that part. Watch your head getting in. Put it on. There you go. Teamwork makes the dream work. Let's see. Let's go. Now that the suspect is in custody, officers move to speak with staff about the incident. >> Oh [ __ ] here I am right now. I think so. We'll just see. I would assume. No, no, this is the the waiter or the bartender or whoever it is. I don't think it was him. It was It might have been somebody else here. Hey, who who was the waiter that Okay. Yeah, so did you Did were you uh the waiter for Yeah, yeah, for him? Okay, can you just tell me what happened? Basically exactly what she what she was saying to you guys. We're just repeating the same thing to me. He sat down and he said that guy from the NBA, this reporter guy that he was talk talking to, was coming back to pay for his food. So, he sit down, he goes, "I want the most expensive drink. I want the most expensive food." And that's basically what he enjoyed. Some people like, "Hey, So, did he he told you that before you ordered the food that someone was going to come and pay for it? Okay. All right. Um clearly, I don't think that's happening cuz we I tried to even give him a chance to go find this person, but he's he wasn't having it. So, No, but I would rather even ask him for his ID. He was >> Yeah. So, yeah, that's what we were going to do. I said, "Hey, look, that was what I was going to say is, hey, give me your ID, we'll go walk find this guy." Cuz sometimes it's, you know, people are telling the truth, but he didn't want to do that either. So, um this this is my corporal right here. He's my supervisor. He's going to give you a piece of paper. Just write down exactly what you told me on there, and uh we're going to use that as a as a witness statement. Um it's very simple. Anything that's general, like they we can do that. Later on, we can put that in. Person who don't worry about it, we'll do the case later. I got cameras over here. Cameras over there. You need to pay the bill. If you don't get paid, you got kicked out of the airport. You make this pay, you got kicked out of the airport for 2 years. You're not allowed to come back in the airport. You're from out of the airport, you got to go there. And if you no worry, they they call. Yeah, but Okay. Yeah, we could kick him out all day, but it just makes no sense. Just before closing things out, the officers [music] check the suspect's car, and what they discover takes things in a different direction. Well, that's why he was hungry. Well, yeah. The trunk is incredibly hard to open. I want to see what this is. Okay. Ooh, a little fishing uh what is that? Crab trap? Okay. What is Oh, you already see that one. Look at that one. That's a cord. Some hot sauce. You got some some toiletries in here. Keep You got some Bics in here. Some pretzels. There is no waiting inside or outside if the customers who are actively waiting here believe your order is not ready for immediate pickup. >> I mean could Technically that's in its original packaging. Would you say that? But I'm saying like can't you buy that at like The one that I just The one that I just had the other day was in the same type of packaging but it was open. Okay. All right. So it's just miscellaneous clothing and just food items. Yeah. These are just submitted for destruction. Yeah. I don't know if we have any evidence since we started doing this weekend. Yeah. It's Hey let let me give you a call back. I'm doing something right here real quick. Yeah. Are you off? Yeah. The suspect found out the hard way that theft isn't something he can slip out of. In the end he was charged with fraud, resisting arrest without violence, and possession of illegal substances. Customer walks out on a Red Lobster bill, doesn't make it far. On July 15th, 2024, officers in Secaucus, New Jersey were called to a Red Lobster after a woman refused to pay her bill. Here's how they handled the case. My camera's activated. You're not leaving. >> Activate the camera. I'm going to Yes, he's weird. I don't care. Okay. So you can do what you got to do. All right. You're not leaving. Do what you got to do. You're not leaving. Do what you got to do. Okay. Do what you got to do cuz I I mean I am cuz I told him I was going to get money for it. He said no. So then I'm not going to do it. That person >> The restaurant staff begins to walk away, but even with the suspect already cuffed, the officer still needs a statement. The case isn't over just yet. Yo. Hey. Yeah, I need somebody. Why am I here? 40, have somebody respond down here forthwith. Search her bag. She's already searched. Search her. Search her. 40, just confirm me you need them. You have your air pods? I got to get the I didn't even get the whole story. Did she pay for any of it? Nothing. She said it was How did she get the food to the officer? At this point, officers wrap things up and begin escorting the woman to the patrol car. All righty. What car do you want her in? I don't care. It just doesn't matter. The suspect was ultimately charged with resisting arrest and theft [music] of service. Customer thought treating two women to lunch sounded like a good idea until the bill came. In this next case, officers from Vero Beach, Florida were called to a restaurant after a man and the two women he was with refused to pay their bill. When the officers arrived, they find the alleged suspect already sitting outside, waiting. Listen to how he tries to explain himself. These two ladies met them at the Walmart. One lady knows Vero Beach >> Okay. uh brought them out here and I reached in my pocket, my card was missing. So, I know I left my card at Walmart. All right. Well, if you knew that when you came here and you didn't have a way to pay your bill >> Sir, sir, no. I was at CVS a minute ago. Your card, you think it's at CVS now? CVS or Walgreens. That's where I went. I got into a case. I do not. >> You got your ID with you? Palm City. All right, how about your card is in Palm City? My cards are my wallet. It's in Palm City, but your card is at CVS here in Vero. Yes. How did that happen? >> Social security card. No, no, credit card. Credit card is social security card. Do you have your ID with you? Uh do not. It's in Palm City. I got jumped, guys. I was in the If you got jumped in the middle of a car, why did you come to this restaurant and order food and drinks? >> Oh, sir, you don't understand. You're missing the whole point. I had no idea I did not have my card on me, so I reached in my freaking pocket and went to my backpack and realized it wasn't in there. Clean clothes, everything clean. How about you Do you have your phone on you? What's that? Do you have your phone on you? I have to get a T-Mobile Did you say he had something to do with Ocean Grill the other day? And he did the same thing over there? I guess he did. All right. All right, let's let's see what you ordered here. The man insists the women were supposed to pay, while the women say it was his responsibility. However, for the staff, it all comes down to one thing. They ate without paying. 34 blues. Oh, he always means trespass if he can't figure out a way to do this. He's going to go over to the jail. All right, you know. Yeah, especially if he if he came in doing this on purpose. You know. Yeah. Give me a phone number. I'll call you. I'll hold on to this for now. So, where did you where did you lose your wallet? Well, I got jumped four nights ago. At Lenox Hospital. I got billed for Okay. Let's move on from there. Let's move on from there. Where's your wallet? My wallet? Okay. They stole my wallet and they stole my cell phone. Four days ago? I went to T-Mobile. I told the girl to get it. And you think it's where? No, I don't. Not 90 Not 94.99. Okay. Sir, I make 40 I was Navy. The suspect keeps talking, but the officer already understands the game he's playing. He knows the suspect has pulled the scheme before. So, he's saying he did it a week and a half ago at Ocean Grill. Yeah, he did the same thing at Ocean Grill last week? What's that? >> He did the same thing at Ocean Grill last week? >> No, that was 2 weeks ago. Oh, it was 2 weeks ago. I'm sorry. But, you did the same thing. So, you went somewhere, had some drinks, had some food, and didn't have a means to pay. Which is called defrauding. I was on the beach. The bag belongs to the ladies. This bag or the food? The food. Oh, interesting. Thank you. No problem. All right. Let me take care of the check. How? Right now, how are you going to do it? >> My son is in Seattle. What's that going to do? He'll pay it. >> All right. Get Get your phone. I tried calling him. I don't have a cell phone. He's not answering. Your answer Your answer to this was calling your son, but you already tried to call your son. He's not going to answer. You're giving me I think this is all a bunch of baloney. It's not a bunch of baloney. I think it's a bunch of baloney. Honestly, John. We have to figure a way John Mag Day work P&L. And what's his number? >> And what's his name? John Mag. Okay. We'll see if John wants to pay your bill. The officers agree to call his supposed son, and if he's willing to pay, this doesn't have to go further. Whether he ends up at the station now depends on his contact's response. Hi John. I am out with a friend of yours, John Maluxe A. All right. Are you aware of him? Do you know him? He's two black girls and some white girls. Ay ay ay. They came with him? Yeah. I am the police. I'm with Vero Beach Police Department. All right. So, he's at he's at Bobby's on the Beach right now, and somehow he doesn't have money to pay his bill, and this is the number that he gave us to try to keep him out of jail today. Is this kind of the thing that he's been doing? Okay. Okay. Yeah, he's done this before in the past. Like he went he went to a restaurant. It seems like he went in with the intention of not paying a bill and not having the ability to pay the bill. Yeah. Mhm. I mean that that that's up to you. This is the Yeah, this is the number that he that he gave me that wanted to settle up a $95 tab. Yeah. Yeah, two orders of wings, a burger, $34 in booze. Yeah, a couple Bombay's, couple Coors, couple glasses of Merlot he probably bought for some of the ladies in there. Bentley's restaurant, huh, in the Keys? At this point, officers begin uncovering more lies from the suspect. Okay. He's claiming he was a cop somewhere as well. He's claiming he was a police officer sometime in his life. Yeah. Just just from being homeless? Yeah. Yeah. Yeah. All right. Well, Yeah, it's been tough. Okay. All right. Well, we're going to All right. All right. Well, we're going to see what we can deal with here, but it seems to be that's what's going to happen. All right. I appreciate it. The call didn't go as the suspect claimed, and the details shared by his friend only made things worse. That's a good friend of his. He said he at some point in his life at some point in his life was a restaurant owner down in the Keys. He said he's never been a cop. He's been homeless for a while, but he was he he did have money, and he owned a place called Bentley's down in Key in Islamorada. But he says this is what this guy's been doing. He says he's a heavy drinker, and he claims to be bipolar. But uh he it's saying it seems like he came in with the with the intention of eating and not paying his bill. He was with these two broads with him. Yeah, and then he went in with them or >> Yeah. He drove them in, yeah. So, they're not they're not on this bill or anything. >> well, they are. But, he he ordered it. >> He ordered everything, yeah. Yeah. He was sitting at the table with them. Yeah. Just going and bothering people in the restaurant, too. And it's just the two ladies, not the three? No, the two I don't know the one in the white. >> Yeah, okay. All right, well. I'm going to go talk to my partner here and Take him downtown. It looks like that's where he's going to wind up going today. >> I appreciate it. Yeah. Sad, but Yeah, it is what it is. The guy is a nut. Yeah, if he keeps doing it. And I was in this business for 15 years, so I know it. And that's what I would see see was the fake was the uh Somebody would find a credit card or a stolen credit card. They know it gets turned off. Yeah. They don't care. They would come in. Here you go. And I we ran the same old steel uh cash registers down in Palm Beach. >> All right, yeah. And uh they'd come in, drop the card, we'd put the card with the hard check. And they'd ring the tab up. They'd say, "I'm going out for a smoke. You got my You got my card, right?" Yeah, I got your card. And they'd leave. And we'd swipe the card, it says declined. It's all right. Let's take him Take him out. Let's go. >> Yeah, I don't want to He's getting trespassed either way as well. He's not going to be allowed back here. With no one stepping in to pay, the suspect is now left to deal with the consequences of his repeated dine and dash attempts. We'll come in and let you know we're all done. Appreciate it, Bobby. >> this, sir? Well, your friend doesn't want to pay your tab. Okay. So, listen. Uh can I go and get my card? I don't think so. I don't know where it is. Yeah, can you take your backpack off? I told you What's in your backpack? Sweet. What's that? What's in your backpack? Guns, weapons, everything. >> I mean, you said you said there wasn't. I do. So, I'm trying to take your word on that. Clean clothes. Okay. Is that it? And stand up for me. Hands way your No, I do not. Go ahead, put your hands behind your back. It's actually put your hands behind your back. Thank you. >> Yeah, I got it. I got it. I used >> You do this? Yeah, well. All right, well. I did this as a young man. Understandable, but you know, this is this is a situation here that it seems like you knew about. I did not know that. You knew when you ordered your food. >> know that, sir. And there's somebody in there from the Ocean Grill that said that the week and a half ago the same thing happened. No, I had two guys in there. I just got All right. Well, what we're going to do is we're going to put you in the back of the car. Okay. You taking him? Uh I got to get him out of the car. Huh? I got to get him out of the car. Yeah. We're going to put you in the back of my car once I get my breaking tools uh No problem. >> moved to the back. You can sit if you want. I'm good. Where's Ethan? Ethan's going to get it. Sitting out there with two other people. Oh, Bobby wants him gone. He's got no way to pay. His friend His friend said that uh he's not going to pay for it. The suspect now claims he can find his card, but at this point even the officers are struggling to take him seriously. I will make uh You're telling me You're telling me your card right now is at Walgreens or CVS or CVS? >> Yes. You're in Viera? Yes. >> If I call them right now, they're going to say they found your card. I hope they did. That's the last chance I'm going That's the last chance I'm going to give you. Okay. I'm going to call them once. You can call He said he doesn't want to pay for it. How about My son. It's my son. He's there. What's his first name? Jason. Okay. All right. Well, I'm going to clean my backseat out for you. To wrap this case up, the officers speak with the two women the suspect invited after telling them he would cover the bill. Hi ladies. Hello. Do you know this guy John over here? Yeah, he invited us to lunch. >> He invited you guys to lunch? Yes. He just we was at Walmart. Yeah? And he invited you here from Walmart and said come on down to Bobby's with us? >> put us on the bus and we came over here. With him? >> Yes. Okay. And I don't even know And that's why we don't even know him. You don't even know him, huh? That's not good. That's not good. That's never good to come over here. Okay. Is this your Uber here? Yes. All right. Well, I think I can let you ladies go. Thank you so much. Cuz another patron paid for our ride. Okay. That's very nice of them. Okay. I didn't want to bring him to the men's room with All right. Lift your left leg up. Lift this one up. Hold on. I'm just trying to help you. 5 miles today. Sweat and run. I didn't go 5 miles. Comfortable in the Chargers, I'll tell you that. All right. Yeah, the uh Nice dents on them. Yeah. And scratches on them. Yeah, the friend said he was bipolar and I asked Bobby, I said I said you could trespass and send him on his way. He was like for Chargers. I said like I said I would I would No, no, no. You're good. Um Yeah, I was I don't know. I I he's homeless. I think he's He is. He said he's he's homeless. The guy on the phone said he might have actually owned a restaurant down in the Keys called Bentley's at some time. He said he does have money or he used to have money, but now he's homeless. He jumps back and forth and he says he does this pretty often. >> I mean he And usually they Ocean Grill >> Ocean Was it Ocean Grill or was it Citrus Grill? The waitress here said Ocean Grill. She said she worked there. And there was that Jason I don't know if it's him or not, but he had to go with the server for the guy who ran out. He did the same thing with this trespassing though. I didn't I was working. That's why Bobby said screw that. I'm not I'm not charging pass him. So, I'll hit him with either theft or defrauding an innkeeper. >> Yeah, it's probably easier. Nice nice easy misdemeanor. >> Yeah, easiest one I can do. Yeah. I got Bobby's information. I don't It all ends with the suspect being charged with theft of services. Drunk customer left the cafe without paying. Police were waiting outside. On November 22nd, 2024, officers were called to a cafe after staff reported that a woman refused to pay her tab. Here's how officers handled it. >> [cheering] >> Hello. Hi, miss. Hi. Is your name Ava? Yes. You coming You coming from the bar tonight? Yes, I I am. Can you Stay in your car. Okay, you want to lower your radio for me? So, do you have your driver's license on you? Yes. You have any guns or anything in your purse, do you? No guns. No guns? No, sir. Okay. So, where are you coming from tonight? I just came here from the restaurant. You were where? Over here at the restaurant, the the restaurant over here. Okay. Uh Angry Moon Cafe. You were in the Angry Moon Cafe? Yes. Were you in the cigar bar? Yes, I was. You were? Yes, I was. Okay. And uh there were some people that uh wanted me to leave there because uh I shouldn't tell you that, but um Ma'am. Knowing he won't get much from the suspect, the primary officer has his partner keep an eye on her while he speaks with the staff to understand what led to the call. This is my partner right here. He's going to stay with you, ma'am. Hey there, ma'am. Raise your right hand for me. Swear to God you're going to tell me everything the truth, nothing but the truth? I swear. Okay. Cuz you're on camera, that's why we have to do that. So, tell me what happened tonight. Okay. So, um she came in. Hard for me to gauge exactly what time. I want to say about 5:00. She's been here for 2 hours now. Mhm. And uh she comes in. She's very polite. She seems absolutely sober and completely fine. You know what I'm saying? She gets the gag. So, she ordered a chardonnay from me. I brought it out. Everything was normal. She ordered another >> Just Just give me one second. So, so she came in around 5:00. Um yeah, she came in around 5:00 and she ordered a chardonnay. Everything's fine. Uh A little while later, she got another one from me and then she went into the powder room. She asked for my assistance. I put it on the score. She mentioned that she was a little expensive, whatever. I could already tell I was starting to read a little bit of a vibe off of her, but for no particular reason. Um she had told me that she was waiting for her friend to come. Then she ended up coming inside. She was sitting with another woman. And then Careful. eventually the friend shows up. They have a couple more drinks. She had four total over the span of like 2 and 1/2, 3 hours maybe. Which she seemed fine until she wasn't. And then I saw her walk into the humidor and ask one of the guys that was inside for something. It seemed like she was trying to basically get him to pay her bill. She was trying to negotiate some sort of deal. I'm not sure. So, I told her it's policy that when we leave, I'm just changing shifts. Naturally, I would close everybody's tab and I would go. The staff recall her being agreeable earlier, but officers are now dealing with a very different attitude and an undeniable smell of alcohol. So, I asked her, you know, at least if she couldn't do that, could I have a card or something to keep on file? She was like, "No, don't worry about it. This other guy is going to pay for my tab." No, he's not. Um I knew him. I knew that was not happening. The friend paid her bill. >> come in She seems very intoxicated right now. Did she come in intoxicated like >> No, she didn't seem intoxicated at all. >> Cuz like it's like you can really really smell it on her. I would say uh I have to say it felt like zero to 100. It seemed like she came in, she was fine. I didn't interact with her that much. And then hours passed. And I mean, yes, four glasses of wine, sure, but over the course of 2 and 1/2, 3 hours is an outrage for most people. So, I don't really know when that happened, when she started getting aggressive. She started, you know, she was getting in my face a little bit when I was asking her to pay the bill. She didn't want to pay it. So, let me ask Yeah. Um let me ask you this question. What do you want us to do here tonight? Do you want her to pay the tab? And you want her trespassed? Pretty much it, yeah. Exactly. >> Cuz dispatch said you were you know, you were staying away from her. So, she she she to me seems like she shouldn't even be behind the wheel of a car. She's I couldn't agree more. She also did push me and hit me on the way out of the doorway. Okay. So, what would you like to do about that? Honestly, as long as she's not able to come back here, that is That's really all I want and for the bill to be paid. I think it's like $55 or something. It's not much. Okay. Her tab is $55? >> Yes. So, let me see we'll see if we can get her her tab settled and then we'll be able to run the the traffic for Thank you. That would be ideal for me. So. All right, let me write this down for you for you. Appreciate that. Armed with the staff's account, the officers approach the suspect once again. Now they let her know that paying the tab could end this here. Hi, you doing ma'am? Hello. Rough night tonight? No, not at all. Oh, okay. All right, these guys want to talk to you. >> hey listen, all right? You still got a $50 bill in there and you got to pay. All right? Do you have a credit card or cash you can pay for it? If you don't want to do that it's a misdemeanor petty theft and we don't want to do that, okay? All right. Okay. All right, miss uh Ava. It's Eva? Eva, yeah. All right, miss Eva. Do you still live on Swan Beach? I do. Okay, is that where you're going to head to? Uh no, I'm going to go to my boyfriend's place. Okay, where does he live? Uh he lives on uh right over here. Uh um gosh, um my god, you just dropped something on me. Um it's uh We just bought a place over in Yeah, over here. Just over here. >> Okay, so you were hanging out here at Angry Moon? Yes, I was meeting my girlfriend over here. Uh she wanted to come up here and that's why I'm at her Okay. Uh is this the only place that you went to or did you go somewhere else before this? Yes, I did. I I walked right over there but it was too busy so I walked over here. You went to uh Carmine's? Yes, I did. >> Okay, but this this was the only place that you were drinking at? Yes. Okay. What did you have to drink in there? Uh Chardonnay. Okay. Hey, see if I can get a receipt. Itemized. Um Chardonnay, how many of them? Uh I had one, two, and maybe three when we got to the but I had two outside So you had two outside and then two inside? I No, only one inside. >> Just one inside? So you had three total? Yes. Okay, how do you feel right now? Do you feel all right? I'm okay. Now what she says next to the officer's question will have you shaking your head. >> Yes. On a scale of 1 to 10, one being stone cold sober and 10 being drunk, where do you think you're at? Um I'm pretty stone cold sober because what you just did me through, I'm pretty stone cold sober, yes. >> do anything. I didn't put you through anything. >> no, but what what did she tell you here? >> So there was a disturbance here, they called in, said you were trying to skip out on your tab, that you pushed somebody, and that you stormed out, and they were worried that you were intoxicated, okay? So my concern is I'm a DUI officer. Those Those other officers, they handled all that initial complaint. Um I'm here because they witnessed you behind the wheel as you are right now. And in the state of Florida, this is called actual physical control, where you have the ability to drive the vehicle, okay? And we also believe We also believe as officers that you're also intoxicated, okay? So that's my That's me expressing the concern. That's why I'm now here, okay? So I want to make sure that's not the case, all right? So I'll like to do some standardized field sobriety exercises with you, okay? So let's go ahead and hop out. We'll come back over here. Um We'll go You see that open area right there? We'll go over there so there's no traffic. >> Watch your step. Yeah, watch watch coming down. We'll go right over here. Um Escort her so I can turn my camera on. Sure. Good. You said you wanted to ask something? No, I I I understand why this is happening. Let me just um let me turn on a piece of equipment of mine. Okay, so once again, I you know, I expressed the concern that you're under the influence, you weren't actual physical control of the vehicle as observed by this officer over here. >> exactly what's happening right here. Okay, so yeah, I'd like to do some standardized field sobriety exercises, all right? >> exactly what's happening here. Okay. I get everything what's happening over here. How she handles the field sobriety test makes it clear she doesn't fully understand what's going on, and it tells the officers everything they need to know. Okay, so do you have any medical condition with your eyes not corrected by glasses? Uh yes, I do have a problem with my eyes. What is it? Uh I I I don't see correctly. Okay, so that would be corrected by glasses. Correctly, yes. >> Okay, any any other issue with your eyes besides that? Uh I don't see uh uh I don't see. Do you wear contact lenses? No, but I don't see uh correctly. So, I I mean, you're asking me correctly, I'm asking you honestly, I don't see uh Well, I'm saying besides for for having to wear contact lenses or glasses, any because that's correctable. Yeah, but I don't see uh correctly close up. Okay. All right. Do you have any medical condition which prevent you from walking a straight line? No. Do you have any medical condition which prevent you from balancing on one foot? I don't think so. All right, perfect. So, if you would just go and stand right here in front of me. Right here. Right where I'm pointing. Why am I seeing that? That that line >> no, we're not We're ignoring that line. That line doesn't exist. We're not doing anything with that line. Just go and stand right here in front of me. Why? Cuz the line is over here. I'm not We're not using sorry. No, no, no, I'm sorry. The line is over here. >> Wait a minute. Time out. Are you Are you conducting these exercises or am I conducting? >> I am telling you the line is over here. The line is over here, okay? >> Okay, but we're not worried about this line. Actually, Miss Eva, come over here. No, the line >> You're grown up. No, why would I be You're grown up. Come here. Sorry? Come over here. Listen to simple instructions, okay? You're going to stand right in front of me with your feet together and your hands at your sides, just like this. Hands at your sides. Not at your sides, but behind your back. Not at your sides, like this. I have my hands at my sides. No, they're behind your back. >> I I I know exactly what you're looking for, and I have a lot of people in the government. >> try to have her perform a horizontal gaze nystagmus test, and it doesn't take much for them to get answers. Now, what she does next only takes things even further downhill. That's very interesting. Anyway, go and place your hands at your sides for me, please. I have my hands at my sides. >> No, they're behind your back. She's learning your words an awful lot. All right. I have a lot of people in the government, so I know exactly what you're doing. >> That's cool. You see this red light? I want you to follow this red light. Put your hands down. I want you to follow this red light with your eyes only, okay? Do not move your head. Do you understand me? Yeah. Don't move your head. Don't move your head. Don't move your head. Don't move your head. You're moving your head. Please don't move your head. All right. Do you Do you understand when I when I say "Don't move your head"? Do you know what that means? >> I understand what you're talking to me, but I have a lot of people in the government, as well, okay? So, we need to talk. No, we don't. No, we need to talk. >> So, you see this red light? >> Yeah. Follow with your eyes only. Do not move your head, okay? >> We need to talk. >> Don't touch me. Don't >> Don't Don't grab my partner. Put your hands on him? Okay. I'll give you I'll give you one more chance. Don't grab my partner. >> Right now. You put your hands on him, I'm going to give you a >> I need to >> out like All right. Ma'am. Stop it. Got it. This way. Got it. You okay? What is this? >> It's just cuz they're cold. They got pinched inside of the coat. Yeah. Yeah, sure. Loosen your hand. Loosen your hand. >> my ring off. Loosen your hand. I know, but don't take my We need to take your ring off. All right, but I know the ring you're taking me. >> Stop. Don't get hurt, okay? Relax. Relax. I know. You. It's nice. Yeah, loosen it. >> Wow. Yeah. Why are you acting like this? Because they're taking my jewelry. Yeah, got it. Got to ask you to empty your You can't wear it anyway. At this point, the test is called off and officers move to search her before taking her to the station. Let's go to jail. I can't wait for this. >> But you got to get searched first. Yeah. Okay. You care what side or not? Only thing is the coat off cuz I I want to feel around in there. All right. Do you want to check pockets? Yeah. Yeah, well, I got to go. Check pockets. Your pockets are good. Thanks. Hold on. Hold on. I'll check your waist. Ma'am, bring your arms up, please. Her rear pocket, inside pocket, coat pocket is going to be on my side. I got it, sir. Cool. You have to take Look at it. What is What is he asking? Uh but just a little stretch. He forced his watch on? No, it's it's just it's not it's it just it has a a It Can I Can I show you?
