Let's separate them. Sir, if you stick around, we'll talk to you at the end of the evening. Just let her get out of the way. Stay right there. Yes. Take a seat. Hey, can you read this Miranda real quick? Do we got first? Yep. I wasn't going to ask him much. I was just going to get the Miranda out the way. You guys are employees Husband and wife. Husband and wife, okay. All right, hold on a second. Um All right. So we'll go into whole detail on everything that kind of happened and I'm going to get a statement from you here in a second. Um did you guys just come running up here right after? Yeah, we heard slamming and then help from her so we came rushing back. >> don't mind going to the front of the store and then talking with the officers as they arrive, I appreciate it. We'll get a statement from each one of you. So I know this just happened obviously and everything's going on. Um can you describe exactly kind of what happened? >> Oh, yeah. Okay. So my husband had my grandson out here and he had given him chocolate. He had chocolate in his mouth so I was like let me go in here and grab a wet paper towel. Okay. And when I walked in, I was like I'm going to get the restroom. So I went into the restroom and literally as soon as I walked into the stall, I heard the door open behind me but like Yep. right. And when I came out, he was standing right at the corner. And I said, "What are you doing in here?" And he said, "Women's." And I said, "Yes." And he immediately came at me and took me by the throat and my mouth and just shoved me against the wall and I started screaming like a maniac and just swinging at him. >> Okay. So he was hitting my hand and choking me and I'm like totally just trying to cover my mouth and I was biting and pushing him off and he was telling me to shut up. And yelling at me that he's not doing anything as he's choking me and I got up towards the I was screaming bloody murder cuz I knew my husband was like out here somewhere. >> Yeah. Um and I was trying to make it to the door and I got close enough to the door and he like flung me back again and he was on me and my husband heard me and he came tearing in and that's when he got him. But he was on me when in the door. Okay. When he was grabbing you, was that like the hand like this actually just squeezing your neck? neck and mouth Neck and mouth to keep you quiet. Yes, so he was shaking How did you interpret that? Do you believe he was trying to rape you? I don't know what the hell he was trying to do. I don't know but it wasn't a friendly altercation. Did he grab any of your And I know these details are uncomfortable. I'm not Did he grab any of your breast, your crotch, anything of that? >> I recall, no. Okay. I was his his knee came up at one point but other than that, I think that was honestly I don't know. I think that was to contain me but I was a wild woman in there so Yeah. Did you strike him at all which is perfectly fine. >> not. Okay. I was Just trying to defend yourself. Yeah, you're trying to You're trying to defend yourself. >> off of me. What I was trying to do more than anything was trying to get him off my mouth so I could scream because I knew that he would hear me. if There was no one else inside there. It was just them. No. Okay. I started off immediately yelling help but then just started yelling bloody murder for my husband's actual name. Good. Sorry. But it was I mean They are I believe we'll be walking out to them. Initially >> Um the when he slammed me against the back and it Yeah. You can clear 99. If I get another unit over here, just I don't know if we have a scene in the bathroom. If I get one over here. >> That's what I'm saying. Yeah. Yeah. He he got mad and he was trying to cover my mouth. I'll get your statement in one second, sir. Yeah, yeah. Oh, how's that? Um we're going to have medics still check you out. Just make sure you're okay. Right now you got a lot of adrenaline so I want to make sure you're not injured in any kind of way. I know I'm not but I understand. Yeah, I understand. Um as soon as another officer comes here, we'll walk over. Okay. Okay. Well, you did the right thing on that. >> I'm I'm terrified cuz my grandson was with me. Like I can't imagine having gotten away with him for him to see that. So you heard the bathroom coming behind you. Like he wasn't in there originally but he What would you have done? >> Yeah, nobody was in there when I walked in. Okay. And I walked into the second stall cuz the first one was out of order. So just walked in and like I said, I heard the door open right behind me. I know he was strangling you. Did he punch you at all? No. >> but he was just holding you down. >> He was this and this is what he was trying to do to me. Okay. And I I don't think he realized this is what was out here, right? Um I don't know what to say to you. Yeah, no you're right. I don't think he struck me struck me other than my neck and It all happened in here so the um strangulation and then holding her quiet so we're going to zero nine on him. So I don't know what we all have in there. If there's anything Was any anything disturbed in there besides him just holding you down or was that right in the stall area? >> where he did it. Let's Let's check that out real quick. Yeah. No one else is in there. When I when I came around, the reason they heard it is cuz like he slammed me against the wall which is his so it made the So when you came out >> I came out of the bathroom and he was standing right here. Mhm. Closer than you are and I stopped immediately and said, "Well, what are you doing in here?" And he said, "Women's." And I said, "Yes." Like and I started to go and he immediately came at me and I tried to go around him and he threw me by the back into this which is what made the loud sound. Okay. And I started screaming and it was a wrestling match cuz he just kept coming at my face, which is where he probably got my eye, and shoving my head against the wall to shut me up. Okay. And it was a tussle and I was able to kind of wiggle away and get over there and he threw me back again. >> Who was the first one to come in? Was that your >> Oh, my husband. Yeah, cuz that's who I was screaming for. Okay. Um if you don't mind, I'll get some photographs. Yeah, absolutely. Absolutely. >> We'll come out here and have you get checked out by the medics, okay? Um I got the victim's rights form out there with Harris. I was trying to look for uh victim's statement forms, too. Um but I'll I don't Do we don't need to hold this thing, do we? You don't need what? Do we don't need to hold this or anything? I don't think so. There's nothing on here, but I'd still get pictures. Nothing was done in that manner. She Basically, her husband came in before anything actually happened except for the assault. >> Okay. Okay. We're going to have uh her get checked out by the medics just real quick physically and then uh we're going to walk out to them real quick and then I'm going to get a statement from you, sir, if that's okay. If you want to stay with her for a little bit, that's perfectly fine. >> I just Yeah. Okay. We'll walk out um to the medics real quick. Are you good with him? But as investigators reviewed the footage more [music] closely, they noticed him near the restroom area shortly before the incident. Sometime later, he was seen walking near the bathrooms, briefly moving away, then returning moments later while looking around the area. As soon as the victim entered the restroom, a few seconds later, he entered the [music] restroom. Within moments, screams rang out, loud enough to draw the attention of employees and the victim's family. What's your name? Kaiser. I I literally when I went in there, I thought maybe she slipped on a wet floor and twisted her knee or something. Yep. And when I walked in there and saw that, it was like first of all, I didn't even know what's going on, right? >> I know. The um What and I didn't I didn't see him walk in behind her. Well, you're busy doing other stuff. I was with my grandson. He had He was going to get wipes to clean him up. Why would you Why would you look Why would you Yeah, exactly. Unfortunately for her, I know, but it's going to be hard. As a result of it all? Yeah, 100%. It's He's got all his teeth. Yeah. Probably has some bumps and bruises. Yeah. And that's all he's got. He's a lucky guy. Lucky guy. Yeah, it's something else. We uh I just don't I don't get I don't get what gets into people. And how much Reasonable, all right? How How much do you think he would walk into a restaurant hearing like that? In broad daylight. >> In broad daylight, middle of the afternoon, parking lot has cars in it, and try to pull that off? I don't know. I don't know. I don't know at all. Um I guess that's why there's mental hospitals, right? Yeah, but whether it's a mental issue or some people are just what they are. You got You got to tick off. I guess. Right? She went inside Were you watching the child then? Is that right? No. Or where were you? Well, my son My son and I had the grandson in my aisle. Okay. So, you see that on camera. Right. Go plowing in there and he's on her. Now, on her, is she laying down or is she just on like up against the wall? >> the over the sink counter. Okay. Um What's her back up against the >> Yeah, she was back like this over the sink counter. Okay. And he's He's on top of her. On top of her. Can you see what he was doing at that time? His hands were on her neck. Okay. Yeah. Hands were on her neck. Was another one on her mouth or not? Uh Or was I wouldn't say that. It might have been even both. Okay. Yeah. Officers carefully photographed each injury, documenting how the marks developed over time. All injuries were recorded, along with her statements, preserving a detailed account of the violence she endured. This is all the initial stuff. I know this is >> else with them.
