What does your mom do during the day? >> Well, I'm not sure. I'll be at school. >> Does your mom work? >> Not right now. >> Has she been arrested before for what? >> On April 26th, 2022, officers were dispatched to a home after a woman called to report a hit and run collision. She thought she was the victim, but the more officers asked questions, the more they could see and smell that she just turned herself in. Hey, do you mind if I come in? >> Yeah, go ahead. >> I was on the bypass. >> Okay. >> Um coming to pick up my daughter cuz she did drop off over here on the bus and I pick up my daughter. The guy in the van. >> You were on which loop were you on? >> On the outer or the inner? >> Like >> were you were coming from North Avenue? >> Yeah. a guy in a white guy in a van sideswiped my car >> or whatever and I told him to follow me. You know what I'm saying? Because I we was on the bipad and traffic was bad. >> But um I I lost I guess I lost him somewhere in traffic. But um >> So were you merging onto the loop? >> Yeah, I was merging on to the loop and somehow he sideswiped my car. >> Did you have a yield sign? >> No, it didn't have a yield sign. You know, like when you just merging on to the bypass. >> Yeah. >> And it got that that lane that you know, ends. >> So here's So cars are going straight. You're coming up this way and the car went like that. >> Yeah, absolutely. That's how Yeah. >> Okay. >> My daughter um I'm her own transportation as far as chicken was and dropping off at school. >> Do you have do you have your license on you now? >> No, I absolutely I don't have a license. I just got pulled over last year. >> So you don't have a license? >> Um not at this moment. I just went and got my ID this morning just so I can have some kind of proof of identification. >> What's your first name? >> T. >> So it's how you spell Tanda? What's your date of birth? >> 1987. >> So you're unlicensed. >> Um, as of right now until I go to court. Like I said, I didn't leave this thing. I told I mean he was following me, but I guess he might. >> So here's the here's the thing. Okay, >> that's fine. >> I'm going to submit this. This the report's going to be submitted as a hit and run. >> Okay. I mean I >> Go ahead, Central. Well, I didn't. I'm telling you the truth. You can contact him and he'll tell you I told him to follow me. You know what I'm saying? Just so we could get off the highway. I didn't want to get hit no more. You know >> for I have a name and did a breath swing already. Okay. So, here's >> you going to submit this as a hit and run. Why? >> Because that's that's what that's what the report is cuz he hit you and he ran. >> Yeah. I mean, but I don't know. I mean, I don't think he I don't know if he might have called the police or not. Have y'all got anything? >> Oh, okay. So that might be >> So it has to be submitted as a hit and run. >> Oh, okay. >> Okay. Um, here's the problem. >> I know. >> You You're driving without a license. >> Yes, sir. >> Go ahead, son. >> Damn. >> No, never mind. You do have a license. >> I do. >> You have a valid license? Yeah. You have a valid driver's license. You're fine. The second issue is is that you're probably going to be held at fault. >> Why? >> You were coming in, right? >> Okay. That means that you were trying to merge into the loop. >> Yeah. >> You have to yield to them. >> But I did. That That's my thing. I did. >> You did. So he he got out of his lane and hit your car. >> Yeah. Like Okay. You know when you merge onto the lane. >> So I'll draw it out. Okay. Let me draw it out. Okay. So let's say here's the loop. Okay. That's one lane. All right. >> This is the merge, right? So you go this way. So you're coming up. So this is you right here. >> Mhm. >> So that's you. So me, you know, merging over, he somehow came in and hit me. >> Okay. >> Yeah. >> So he somehow came into that lane and hit you. >> Yeah. >> Okay. >> Absolutely. >> 4 to 5. Can you head my direction, please? >> Or whatever. And like I told >> How long ago was this? >> What? About how long I pulled? About 10 15 minutes ago. >> You called me at 442. >> Okay. >> Possible signal one. Because I said I thought maybe he was calling stuff. Like I told him I told him to follow me. >> Okay. >> Or whatever. I mean he was in a van on I want to say a true [ __ ] van or something like that. >> So how long ago was this? >> Not even 30 minutes ago. >> Not even 30 minutes ago. >> Probably about 30 minutes ago. >> You were in the merge lane and he was on the loop already. That's the thing. Unfortunately, I can't determine fault just because I wasn't there and I don't have the other party, right? I'm just telling you. I'm just letting you know what the insurance might say. Okay. Now, I've got another officer. He's much more experienced with traffic stuff. He's on his way right now. He's going to come talk to us and you're just going to let him know the story and everything and then we're going to just go from there. Okay. Do you understand what's going on? Why are you crying? >> Cuz I'm upset about my car and not on top of that. >> So, the thing is another thing. So, another thing is >> your insurance company had doesn't have somebody that they can hold accountable. they can hold accountable because that other person's insurance isn't going to be on the report. No one's going to be on the report. It's just you. >> And when you got home, what' you do? >> I got on the phone with the police cuz like >> you got on the phone as soon as you got home. Correct. >> As soon as I got here, I called them. I was telling them the situation. I told him I told him to follow me or whatever. I said I might have missed him somewhere back there. I thought maybe he was calling the police cuz he was still You know what I'm saying? >> So he stopped. >> Yeah, he stopped. He literally stopped on side of the road. got out everything asked me was I okay and everything and I was like yeah I'm fine or whatever I said but um just follow me you know to this near end you know so um I can go get my daughter or whatever I said and then we can call the police from there so just get off the highway cuz like I said car was swiping by so I'm like [ __ ] I don't want to get hit no more >> 14 okay that's your dad's insurance on the vehicle sir >> let's go back up to the front let's wait for that other officer Can I talk to you real quick? Do you mind if you just stand by? I'll >> Were you in the car? Then what happened? >> She's on her way to come get me. >> So when your mom picked you up, what did she say? >> She like she called me first. She was like, um, this man just like swiped in the car. And I mean, I'm on my way to get you, but I have to get this figured out first. She's holding your What does your mom do during the day? >> Well, I'm not here. I'll be at school. >> Did your mom work? >> Not right now. >> So, you weren't in the car? >> No. >> Okay, that's fine. That's perfectly fine. Thank you. I appreciate it. It's unfortunate that he didn't stop. Um, next time if anything like that happens again, just go ahead and um just stop on the loop. >> I I I should >> just stop on the loop and call. >> But it was just so >> I understand that. But when I tell you I I was scared my car going to get hit again because it was the traffic like that. Like Yeah. >> Beautiful home you have. >> Oh, this is my mama's house. >> Oh, like I said, I just become pick up my daughter. >> Where do you all live at? >> Um I just come pick her up from school, you know. >> Play sports. >> Yes. Trap. >> All right. Let me ask you a question. Have you had anything to drink today? >> No, I've been >> Cuz I could I could smell it all your breath. No, I really I No, like maybe or something like that. >> What did you How much did you drink? >> I might have drank a beer or something like that, but I don't went to the DMV pl everything like that. I like I said, I have really not had >> Okay, cuz I'm standing right here and I can smell it all. >> I understand, but I haven't no pay a bill. So that that's on everything. >> Okay. Um, were you operating that vehicle after you had that beer? I mean, yeah, but like I said, I a beer with my auntie before I dropped her off and came this way or whatever. I I haven't really No, I I just got up this day at 1:00 and handled my business. I had a couple things to do. I went to cash my check and stuff like that. >> So, were you about to go home after this? After this, you go home and have my daughter just text me. I can show you the check and told me she was ready and whatever, whatever. But no, I mean like I said that that wasn't an issue right now like serious business. That's why like I told you I I would have called or anything like that if I knew I was anything. That's on everything. >> Well, I mean you you still called just cuz even though you didn't know >> I didn't feel No, I called because at the end of the day I didn't want to be held accountable for >> Okay. Yeah. damage vehicle saying that that's why I call >> regardless other any situation. >> Hold tight for me. I'm going to go talk to this officer right here. Okay. >> She said she admitted to having a beer this morning. Um but a beer this morning wouldn't make sense for me to be able to smell it >> like from here to from here to where you are >> right now at 5:00 in the afternoon. >> So she told you that she drank before she >> she before she drove. Correct. >> She's not at her house. She was going to go home after we finished here. >> Where's her? >> In the back. >> Hey, I'm off. What's your name? >> Do you mind showing me your car if you don't mind? >> When does grandma get home? >> Um, tonight around 11. >> Oh, okay. >> Why am I in any kind of trouble? >> Well, I'm just taking a look at the damage and stuff cuz I got to I got to figure out what's going on. It didn't like intrude into the compartment at all. There's no heavy damage. It's just right here, right? >> Yes, sir. >> Okay. He didn't hit the back of you at all. >> Okay. >> Did anyone call in today into East Dispatch in reference to a hit and run that occurred on the loop around North Avenue? >> Took the mirror clean off. How much you had to drink today? >> Like I said, I might have drunk a beer. >> You just like one beer earlier? >> Yeah. >> Okay. >> I mean, but I said I I'm not here to deny nothing. >> Yeah. And I get you. >> I apologize. Yeah, >> at the end of the day I'm not in >> temple. Thank you. Nobody's cold. >> Enough. Nothing like that that I'm just >> Nobody's cold. >> Working my car. No [ __ ] like that. I swear like I didn't >> I get you. So, okay. So, you know about what time you had that beer? >> Um probably 2 three hours ago. >> Okay. You want me to blow whatever I I do that if that what y want. Is that okay with you? >> I mean that's fine. But what I'm talking Oh god. >> Well, you know, okay. So, you know, one of the only reasons I ask is, you know, I I do DUI enforcement is my biggest thing. Okay. And the reason that I'm out here is because there is a pretty strong odor of an alcoholic beverage coming off of you. And usually just drinking one beer, he ain't going to smell like alcohol that much. >> Especially there's like a big tall boy or something like that. Was it like a little 12 oz you had or was it like a >> 16 out beer? >> Okay. So, I mean like that big. >> Yeah. >> All right. Are you okay to do some fields exercises? Just make sure you're safe to drive. >> No, but why should I have to do all that? >> Uh, so the reason I'm asking is because you you've driven your vehicle. >> Well, well, I'm just I'm just I'm just explaining to you. >> I haven't did anything. >> I got you. So, I'm just explaining to you, okay? So, >> all this and that. Like, I >> So, ma'am, if you hear me out, hear me out, ma'am. >> So, here's the thing, okay? You do have your daughter. You You admitted to me that you had a beer, okay? That you drank a beer. Then you went to the DMV. Then you went here. And then you went to you went you came back. You came here to pick up your daughter. Okay. And then you were going to go home. All right. A beer at 12:30. At 10 10:30. What was it? 10:30. 12:30 about 2 3 hours ago that you said 1:30. >> A beer at 1:00 isn't going to produce the strong order that it's producing right now at 5:30 in the afternoon. I'm concerned for the safety of your daughter and your safety and those on the road. >> I want I can get some I can get my little brother to come take us home. >> But here's the problem. You've admitted to driving already. Okay. So, now we've been involved in an accident. What? >> Involved in an accident as well. Would you be able to do some field sobriety tests for us? If you're telling me you're not intoxicated, if we can do these tests and we can see. Okay. Is that okay? >> Yeah. So, that's biggest thing. I just want to take a look at your eyes and stuff like that. Just make sure that you're safe to drive. If you're safe to drive, then we got we got no issue. >> Exactly. >> Uh but it's just through certain evaluations and stuff that I have to determine that. Okay. >> So, you're okay to do those? >> Okay. It's completely up to you. That's your decision. So, I just want to make sure you're okay. All right. Um do you wear contacts or glasses? >> No. >> Okay. >> So, just put your feet together, your arms down to your side. I'm going to illuminate this red stylus for you. Okay. And I'm going to have you follow with your eyes and your eyes only. Don't move your head. Okay. So, just keep your head straight towards me and follow that with your eyeballs. So yeah, just track onto this red light right here. Okay. >> All right. Same thing just up and down. Okay. Would you be willing to take a little breathalyzer? Uh, like one of the little portable ones for what? >> So, I I just want to confirm. Okay. So, that's just my biggest thing. Um, the way this works is uh a portable breathalyzer test. The amount that it shows isn't an admissible thing in court, if it even went to court, if there was an arrest made. It just kind of confirms the presence of alcohol in your out and your in your breath content for me. So, it's up to you. It's just something that I do just to make sure that you're safe to drive. Uh with what I'm seeing right now, it's kind of up in the air. I mean, you're not like drunk. Um >> I don't I mean I won't drive. I won't do nothing. I just go house my little brother. I'm sorry y'all. I just >> So you wear contacts or glasses? >> No, sir. >> Okay. You ever been to an eye doctor or anything like that? >> No. >> Okay. When I do this examination on you, your eyes kind of just track unequally, which isn't an indicator of impairment. Um, but it makes it difficult for me to take a look at your eyes. Cuz normally when I when I do this, both eyes will fluently track this way. And then when I come back, it'll track that way as well. What we look for is something called nestagmas. Nstagmus is an involuntary jerking of your eye because alcohol is a central nervous system depressant. And the first thing that gets depressed is your smooth muscles and that's your eyeballs is the very first. So you'll see a little jitter. So, with your eyes, when I go this way, one of them follows quickly and the other kind of slowly tracks behind. Uh, which isn't an indicator of impairment. So, I'm not calling you drunk or anything like that. I'm just saying that's why I was doing multiple passes. If you're okay with it, I'm going to have you do one more test just so I can feel safe letting you go there. Um, >> I get you. I get you. It's just um you've already driven with alcohol in your in your in your system. Cuz I'll be straight with you. I don't normally get this in detail with people about it until my investigation's over, but I'll I'll be straight with you. You wreak of alcohol for some reason. Like, you can really smell it coming off your breath. >> So, >> I mean, I drank last night. You know what I'm saying? >> Yeah. Well, I don't have it on me, but I'll go >> night. You know what I'm saying? >> Is it in your trunk? >> It's in my trunk. >> Okay. >> Be honest with me. Am I looking beer right now? >> Just based off of what I'm seeing, probably not. But I just I got to I got to go the extra mile. So, just be truthful with me. You just had the one beer as a 16 ounce and that's it. >> I mean, I drank last night. >> Okay. >> Um, I got home at around 2:00 in the morning. >> Whatever. Whatever. I woke up today. Yeah. >> Did you drink quite a bit last night? >> Yeah, I did. >> Okay. >> Um, >> what were you wearing last night? >> Um, I was wearing um >> You weren't wearing same thing? >> No, I had on a black shirt and some capri pants. >> Okay. >> Some blue jean capri pants. >> Okay. Thank you much. I'm going to just have you build into this. >> All right. So go ahead and form a tight seal around that and just blow for me. Okay. >> Like I'm up there. >> So okay. So the legal limit in Georgia is 08. Uh you're a 0.11. Okay. So you're above the legal limit. So 0.1 is what you blew at. So if it's all right with you, I'd like to uh continue just doing the exercises. So there's just something about your eyes. Um >> I just don't know what it is. I can call somebody come get my daughter or whatever. I just don't know. >> So I said I felt like I was doing the right thing when I called and stuff. >> And you and you were. I'm not saying you weren't. If you want to lock me up, just go ahead. It ain't nothing else I can do. >> Look, look, I'm I'm being straight with you, okay? I want to give you every opportunity to me to prove that you are safe to drive. So, >> I'm not trying to drive. I know. I know. >> Drive. I understand. Just listen to me. Please don't get upset with me cuz I'm trying to be as nice as I can to you. I'm not trying to be bad to you in any way. I like making every single situation that I'm in as absolutely fair as possible for the person that I'm dealing with because I understand you may have going a lot a lot going on in your life and I'm not in your shoes and I've never been in your shoes so I don't understand what it's like. So I'm trying to be as fair as I possibly can to you and I don't want to do you wrong in any way. The reason that we're here today is because you've already driven and that's just where we're at. Okay? So I I can't investigate through your eyes that well. Okay? Because when I look at them, they just they don't track right. And that's not your fault. You you didn't do anything wrong with that. That's not something from drinking. That's just some people their eyes are work differently. >> I can't I mean just go ahead and do what you got to do. I don't >> Are you okay doing uh partaking in my investigation? I just need you to do some more field sobriety exercises. >> Like what? >> So like a walk and turn just part of the investigation. So are you okay to do that? So, from right here, what I'm going to have you do, don't start until I tell you to, but when I tell you to begin, you're going to take nine heel totoe steps along that line, just like this. >> 1 2 3 1 2 3 >> so on and so forth until you reach nine. Okay, I did like three or four. I just want you to do nine. And then, do you understand the instructions? >> Well, hang on just a sec. Don't don't begin just yet. Do you understand the instructions I gave to you? >> Yeah. >> All right. So, for for the exercise, make sure you keep your arms down to your side. Don't stop after you've started. And uh also make sure you don't use your arms for balance. And you can look down at your toe. It helps you balance a little bit. Okay. All right. Count the sets out loud for me. And whenever you're ready to begin. >> Oh, can I start over real quick? >> Yeah. Yeah, you can start over. >> 1 2 3 4 5 6 7 8 9 1 2 3 4 5 6 Okay, thank you. Keep your arms down to your side and you're just going to count one. Do you understand the instructions I gave you? >> Yeah. >> All right. You ready to begin? >> Yeah. >> All right. Go ahead. >> 1. >> Lift your foot up a little bit higher for me. >> You want to try again? What's up? >> Okay. Ah, >> okay. >> That's all right. Um, move on. Next one. >> Yeah, just follow Yeah, just follow the tip right there. That red light. Okay. >> All I'm going to have you do is you're just going to tilt your head back and you're going to close your eyes. And then from right there, whenever you tell me go, you're going to estimate the passing of 30 seconds. Okay? So, you just estimate 30 seconds going by. And then whenever 30 seconds is up, you just tilt your head forward, say stop. Pretty simple. You understand the instructions? >> Yeah. >> Tilt your head back, close your eyes, and whenever you say go, we'll start. >> Okay. Go ahead. >> I'm ready. >> Okay. All right. Okay. So, right now, just place your hands against each other. Okay. Just put your palms against each other. >> I'm on a rest. >> Yes, ma'am. Yeah. >> Could I call my sister real quick? Yeah. >> I'll let you call anybody you need to call. Just keep your hands back here for me. Damn. Put your palm against the other palm. It just makes it more comfy for you. I don't want to hurt you at all. >> Well, I get a bun today, y'all. >> Yeah. I got to run a driver's history on you to see if you've ever been charged with a DUI before. >> I have. I just got one last year. That's what I'm Okay. >> Um, so >> is that why you got your license taken away? >> But you just told me that. >> I said, "Is that why you had your license taken away?" >> Yeah. >> How old your daughter? >> 14. >> She's 14. Okay. She can stay here till grandma gets here. >> Yeah. >> Yeah. Let me um Can I call >> We can talk to her. Yeah. Let's just go ahead and we'll walk over to the car. Okay. Let's get your shoes on. All right. >> I need to Can I call my dad so I can get him to get my money and stuff to get me out? >> Let's go over here. Let's go this way. Huh? >> I'll be able to get out today. >> Uh that's up to him. >> I need to talk to my authority, y'all. >> We will. We'll I'll I'll get her I'll get her in a sec. >> What am I going to jail for, though? >> DUI. >> Y'all really think I mean like seriously now? >> Am you admitted to drinking? Okay. You know, I I actually can't have this conversation with you right now just because you are under arrest. >> I'm sorry. >> No, it's okay. All right. Sit tight. Okay. I'm going to go Yeah. I'm going to go talk to your daughter. All right. Your mom's under arrest >> for driving under the influence. >> Okay. >> Mhm. >> All right. I just wanted to let you know you're 14, you said? >> Mhm. >> Okay. So, you're able to stay at home by yourself. Do you want to talk to her? >> Mhm. >> You You okay? >> Yeah. You seem to be taking this like not as poorly as I would think. >> Is this common? >> No, not rude. But >> does she do that a lot? She she drinking as she goes driving >> past. I was doing nothing. >> I get you. Give me just a second. Let me read something to you. Okay. >> Go ahead. I know my rights. >> Wait, this ain't this ain't your rights right now. This is calling. Can I get out today? >> Um, so since you've been arrested for DUI before, you cannot you'll have to see a judge in the morning. >> So, you sure you're you seem pretty indifferent about it. Uh, Tana, how old are you? >> I am 34. >> Okay. All right. Toana, the state of Georgia. Like I said, is this a common thing? >> I would say it's common though >> for her to get arrested. >> Not really. >> Has she been arrested before? >> Yeah. >> For what? It was like past things like her and my dad would get into >> Where's your dad at now? >> He probably work right now. >> Do you not stay with your dad? >> No, I lose grandma. >> You think grandma would be upset when he stayed here? >> No. >> She under the influence balcony. Okay. Do you need anything from us? You remember anything? I don't want to feel like a bad guy taking mama. You know what I mean? I'm just doing your phone. >> You want to talk to me at all? >> I need to talk to my dad or my mama or somebody, y'all. Are you okay? >> So, she's calling your dad. >> Yeah, she's going to get him on the phone, but are you okay to answer questions for me? >> Yeah. Go ahead. >> Okay. Is there any alcohol in your vehicle? Cuz I I have to search it. Uh incident arrest. There's nothing in there. >> Okay. So, was it was it just the the 16 oz beer is all you had today? >> Yeah, I cuz look, I'm just being straight with you, okay? >> I didn't lie to you. I said it's the only thing I had today. >> Okay. I ain't get home about 2 o'clock the morning or whatever like that. But other than that, I >> Do you think the stuff from last night could be still affecting you or >> It could be. >> Okay. How much you drink last night? >> Oh, I had about a eight pack. Um my homeboy 12pack. You know, I drunk couple of ML ultras. But that was last night. Like I said, I this morning. >> Okay. Well, and I appreciate you being honest with me. And it's possible that the stuff last night could be still affecting you. And look, I I'm not judging your character or you as a person in any way, shape, or form, okay? I'm just out here doing my job. And and I do appreciate you calling in cuz I mean, worst case scenario, if somebody was hurt in that accident, it's good that you called us and whatnot. And even if somebody wasn't hurt, um >> I'm being charged with a DUI just car like that don't even make sense just because I said I I mean, okay, >> I get you. I think she's calling your dad right now. And >> she's on the phone with him. >> She's she's on the phone. Did you Did you get him on the phone? >> Go ahead. >> Yeah, you can come right over here. >> I'm just out here doing my job. But when it comes down to it, just just be careful. I I don't want to see you die or nothing like that. You've been very sweet to me so far. And a lot of these situations I go into, it's just a constant screaming match and everybody wants to just be yelling with me. Ain't no reason to be yelling at each other. >> Come right over here and blow into this tube for me. You'll see this start picking up. >> So, where we're at right now is you blew 0.067 was the lower of the two. The other one you blew is a 0.71. That was the second one you gave. Your second breath was higher than the first. I don't know if that's because the alcohol is still settling or whatnot, but either way, you're under the per se limit. So, you don't get charged. So, there's two charges with DUI. DUI less safe, which just means that you had enough alcohol to make you a less safe driver, and that's determined through my testing and evaluation, or there's DUI per se. DUI per se is when you're above 0.08, and that's when you get a license suspension and stuff like that. Granted, your license already suspended, but the good news is I'm not going to be resuspending it. So, whenever that first suspension's up, you're not going to get a second one. And the DUI less safe is a lesser charge than the perse. So you'll still be charged with a DUI less safe because you were drinking alcohol and I determined that you were unsafe through my evaluations and then the ticket for driving on a suspended. Okay. >> Yes, sir. >> So you're not going to get that higher charge. Okay. >> Okay. >> All right. I appreciate you being sweet to me even in a gross. The suspect was booked for DUI alcohol, driving while license suspended or revoked, and reckless driving. On July 13th, 2022, the DUI charge was dismissed. The suspect entered to a no- low plea to the other two charges. She received 12 months of probation for each charge along with 40 hours of community
