You're going to call the cops and she's going to murder one of us tonight. She will, I swear on my life she will. You okay? Yeah. My mom, she just up and left after after her my mom started attacking me. She just left. And I think IT'S HER RIGHT NOW BUT SHE LITERALLY LEFT ME What's your name? A mother calls 911 afraid of her own daughter. But when officers arrive, it's not the mother they find in danger. It's her daughter locked outside in the cold with nowhere to go. And by the end of the night, only one of them would be leaving in handcuffs. I need you to calm down, okay? We'll help you get We're going to get through this, okay? NO, MY MOM WHY WOULD MY MY MOM LEFT me all This all started cuz she was yelling at me and my brother. Come on, let's go over here before we get run over. I have little siblings but no one is going to see who is on my head. That's her right there. I'm pretty sure. Okay, so what happened? Can you tell me what happened, please? So, this all started because we were at a babysitter's house cuz we were at school. Uh-huh. That's how even her she's not even here anymore. Because we were two She comes from school and we're at a babysitter which is my stepdad's Um Not my stepdad's. My mom's brother My My brother's dad. Okay. We stayed at their house because she was at school. Okay, cool. She comes back all aggravated and yelling at me yelling at me, my brother, and my little sister. And she's She was yelling at us then and then everything was fine and then she was like, "Don't let it Don't let Go to sleep. Don't let Go to sleep." So, I'm waking her up yelling and screaming and I had her buckled at this point in time. This is one. Okay. She's just out because she's a toddler and she's just doing whatever she's doing. And um she gets out and my mom brake checks so hard goes flying from the backseat to the the middle cuz we have a van, obviously. Okay. She goes flying to the middle and I can't make a composure. I was just like, "Oh my god, why would she do that?" But I was in my head because I don't WANT HER TO YELL AT ME ANYMORE. SO, my mom my mom at this point is yelling and frustrated with all of us. And then And then we got here and we don't have Obviously, the doors are all like you can't even go try the The doors are all like because my stepdad has the keys and he's at work I think in Montgomery. Mhm. And then she was She's yelling at us till then I kept telling her, "I don't want to get in the car with you because you're yelling and I I don't want to keep yelling at you." So, me and my brother we go in the garage and we're chilling cuz we don't want to be around our mom because the way she's acting. All right, hey you. Hi. Hi, Deputy Vickery. Hi. Sorry. Um yeah, kind of run me through what's going on. So, we got home. Okay. I wasn't able to get in. We just moved here literally yesterday. Okay. Um Where did you guys move from? We were on the other side of West Aurora. >> Oh, okay. So, we just moved here because our lease was up over there this Saturday. Um she had She was starting to get mad. She was saying that I was neglecting her how that I was neglecting allowing her in the house which I tried to open the doors. It's my son. Um couldn't get in. I called my husband. He said he's at work. He said that he will come as soon as he can. He should be on his way home right now. Well, then she started to get mad, was getting frustrated saying that I don't love her which is her normal story with that. Okay. I told her I said, "You're getting really mad. Go Go for a walk. You know, use your coping skills." She's got behavioral issues. I was sitting in the car with the two youngest ones though cuz I have a 3-month-old back here, too. Okay. Um I had the windows down. I was talking to them while trying to keep the two youngest one warm while they were just out just walking around playing. Mhm. Well, then she said that I wasn't letting her in the vehicle. I said, "You can come in the vehicle." I asked my son, I said, "You guys want in the vehicle?" He got in the vehicle. She said, "I don't want to get in the vehicle with you. I don't like you." Okay, then fine. Just stay out there. I had the window down. Mhm. Then she started to come up to the vehicle and then she started to get louder and was reaching in the window. I said, "Ellie, you're on you know, you're on your level. Go step away. Go walk." "No, I don't have to." Well, then that's when she started to threaten. I have it on recording if my phone if she hasn't record or deleted it. Then she threatened to beat my and my my sister's. When this was happening I was telling her to get out. Then she started to reach in the vehicle and then uh she got back out. I was able to put the window up just to try to create a barrier so she's not you know, continuing. She went up to the front of my car, hit the front of my hood multiple times and then beat on my window about three times. Okay. At that point I had already locked the doors. She had went around the vehicle and tried to open up this door here from the outside. Realized it wasn't opening. She Somehow, I don't know what happened but she was able to get in the back door over here. >> Okay. And then she was reaching in trying to unlock the door. So, every time she tried to unlock it, I was locking it because she was reaching in from the back here. Mhm. So, then as she tried to get out to open up this door, I was trying to shut this door. Okay. And then that's when uh I told her I said, "No." And then uh that's when Yeah, that's when she tried to grab the baby and he he was able to grab the baby from her while I was trying to reach to grab her, too. Mhm. And then he put her He put her towards the back of the car and then that's when she started That's when she started to swing at him and then I was on the phone with the the the dispatch and then that's when I was climbing all over the seat trying to get her off of him and then that's when she was swinging at me. Okay. All I wanted to go I have school tomorrow. I said I needed my medication for my night so I could sleep. I need to take a shower and I need to sleep so I can get ready for school tomorrow because that's what everybody else is doing. That's what I need to do. That's my brother needs to do. That's what she needs to do. She needs to grow up and get ready for bed and everything before she needs to do in the morning. And she Where's Where's your brother at? He's not even here. She left with every other kid but me. Okay. And didn't even say where she was going. She just up and left. As soon as I took the phone from her and I started walking away because she was coming after me, she up and left. Okay. Was it physical? Did you guys hit each other or just screaming? >> I got into the car, right? Yeah. Well, I'm I'm sitting in the door cuz I actually have an issue to speak with an alcohol therapist and I'm pretty sure there's such thing, right? Mhm. She's saying, "Oh, no, that's not such thing. That's not such thing. Not a such thing." And she she calls her my my stepdad and tells him that, "Oh, I'm over here being aggressive and hurting her and everything." All I'm doing is standing in the window and then she's like, "Oh, you're not my child. We So, you're bad." And she said this the last time we had an issue. And so, she keeps on bringing that [ __ ] up. Keeps bringing it up. Stepdad's already been closed by the court and everything that was told not to be mentioned again. Mhm. And then I'm in the car and I'm She's like, "Oh, she's going to hurt my baby. She's going to hurt my baby." I was like, "All right, here, Mom." Because I I'm picking up the I'm like, "Here, I'm not going to hurt my baby." Snatches her away from me and then pretends that I'm going to I'm going to hurt her and everything. My mom is yelling at me and at this point she's on the phone with you guys lying to you guys and talking about, "I'm hurting them and everything." So, when I get in the My brother is like, "I don't [ __ ] care. I don't [ __ ] care. I don't [ __ ] care." "Oh, I hate you and everything. I'm I'm going to hurt you and everything." So, I say that stuff in in retal- retaliation because you're not going to tell me you're going to kill me and then expect me to to be okay with that. I'm going to say the same thing back to you. Mhm. And at this point my brother is getting up, getting mad, and getting physical. Starts pushing me. So, How old is your brother? He's 10. Oh, okay. And at this point I'm I'm I'm I'm hitting him, too, and then he starts kicking me in the head and he starts kicking my mom in the head not knowing that's her. Mhm. And I'm over here trying to get a grip and I I'm not going to lie. I mean, I'm I'm not going to lie. Like I know that this was bad on my end but I'm a juvenile. I don't This all started because I wanted I I wanted an alcohol therapist I knew I was getting anxiety. She was like, "You don't have a right to talk to them." And I was like, "But the court said I have a right because I DON'T HAVE I CAN'T have a phone by the court but I can have my phone." And she was like, "Well, I'm not letting you talk to them and you can't talk to them." And she was like, "By whose phone?" When she uh brake checked, where was she at? Was she close by home or She She was over by the gas station. Okay. We've had safety issues with her that we don't trust her being by herself with anybody right now. Okay. Yeah. How's your kid in the back? He says that his side of his face is hurting. I'm Can I open the door? Yeah, of course. I just didn't want her to get in so I didn't Yeah, let's see him. Yeah, did she hit you or She saw me like multiple Can I see your other cheek? She She She did She got him pretty good and then she went She went after me when I was trying to get her off. She's She's right now under juvenile court right now, too, for the same things but the violence towards myself. Can we take a picture of your kiddo's face? Here, you can come outside so they can take a picture. And then we'll put you back in and close the door so you're not too cold. Yeah, no, of course. And I I will say I did as fast as I could get out of the driveway when she took off with the phone. So, I will apologize. My My daughter was sitting like this but just because I I didn't feel safe with her there. Oh, I understand. Sure, it was an emergency. Emergency situation. Can I get your kiddo's names? Start with Want to give And you you do want to pursue charges against your 15-year-old? Yeah. She This time it was on my my son. She cannot keep doing this. Do you want EMS for him to go and check him out or Uh no, I think I'll I'll wait for dad to get home and wash them and then I'll take them. Okay. Do you have any injuries to yourself or Just Just for like she right here is where she I don't know if there's anything there and then I broke my nail trying to I'm just going to shine a light. Just like right here. I I feel like a little right here. It looks a little red, yeah. Let me take a picture of that. What was she in the JJC prior to this? Uh Recently, she was just in there for attacking myself again. Okay. How long does he take to get home? Does he get home pretty fast like It just really depends I guess. I mean yes, I don't know. Police had a conversation with her step dad to ensure if he knew about the ongoing dispute and told him they will try to sort it out till he arrives. Yeah, so he's saying that he already told your mom that if she wants the key that he she can go over and get it. >> Yeah, she refused. Okay and or you guys could just wait in the van or go somewhere for the meantime and he's he said he's about to get out pretty soon. >> Yeah, she refused. And then she's not letting me in the van. When she was telling me "Oh, you can go in." I heard the door lock. I was not going to even try to battle it. At that point I could have told her "It was locked." So you guys were not even try. I got you. I got you. Okay. Let me let me talk to my partner over here, okay? So what I have was yeah, she does admit that she got into a tussle with her 10-year-old brother but she's saying that she doesn't know if she hit mom. She feels that if mom got hit it was by accidentally by the 10-year-old and maybe her when they were fighting each other. After hearing both sides, officers determined this wasn't a crime. She didn't intentionally hit her mother. It was a sibling fight that got out of hand. The daughter would not be arrested. But when they broke the news to the mother, she didn't take it well. Not by a long shot. Hello. Are you mom? Yes. Okay. I know you got a lot going on here so I'll I'll make it quick. I understand that there was a little bit of a tussle between brother and sister. Yeah, she went to attack him. She got in like a punch or two in and I was on the phone with dispatch >> Yeah. and I tried like reaching over to get in the middle and then that's when she got me on my face and then she got another couple in on him and then that's when she grabbed my phone and ran out. Okay. So I she can't be doing this. This is now the second time in like a month's time and she's in the juvenile system for this already. Okay. What do you mean she's going She's she indicated here before we had to leave Well, I was sitting here on the other side on the phone with the police. And they they walked in on her. Um and then have you been giving her the support that she needs like cuz she's saying that she needs that she would want to talk to therapist or something like that? So she set for her first therapy appointment on Monday with her DCFS worker helping me get with it. She has her psychiatry appointment on Friday. She has her court on Friday. Um her uh glasses appointment is next Saturday because again I work but I go to school. I take care of kids. That's the only time I can take her. Um and then for the ear nose the ear hearing that she just did today, I just got the papers so I going to call tomorrow to set up a hearing thing. So I'm not being supportive but yet I'm I'm doing everything. I followed everything that the court has given me the past three years to this day. I have never once neglected her. Never. Not even verbally like she's saying? >> No, I haven't I have not done anything. So you haven't called her dumb? No, I haven't. >> You haven't called her crazy? No. You haven't said that He did call her crazy today. Okay. So Okay. Um They're just brother and sister. They do it all the time. >> And that's what I'm saying. I don't really want to get anybody in trouble cuz they're brother and sister. They're both little. Right. Um she's saying she's So what you're telling me and what she told me is basically they're the same thing. She's saying that she don't she did she didn't if you did get hit it was probably either cuz of her or cuz of your son. Um on accident. Um that she wasn't swinging directly at you nor your son was. >> No, she she put her hands right across here and went for me. Okay. And then that's when my son jumped in. Because he's he did this the last time she attacked me. Mhm. So he's trying to be protective. She she goes for me first. >> Mhm. Always. Okay. Her her little brother. Two little kids fighting. It wasn't fighting and I understand that you think that way but it wasn't fighting. She came after us. She did she came after us. And I don't feel safe so I'm sorry so I want her escorted to Mercy. I'll take her to Mercy then because she needs to be evaluated. She's not safe in my house. You're going to put her back in my house and she's going to murder one of us tonight. She will. I swear on my life she will. Okay, has she attempted it before? She has attempted to murder herself. She has overdosed herself. When we lived in Batavia she ran through the house with a knife and I was on the other line or on the other side of a door talking to the police and she was stabbing through my door. She is unsafe. I'm telling you she is going to murder one of us. And she was going to attack us. I don't understand. I have recording of her saying she was going to harm us. Right before she went after him. She said that she was going to harm you. She she said on my life she said this. On my life. On all my kids' life. And she tried to delete the video. I can't get the volume to play but this is where she said that. And then you guys think I was being hurt. This is her the whole time. And I was being calm the entire time. She threatened me right there. It was the one where she threatened to harm myself and my sister. This is from today. This is from right now. She threatened us and you're still going to allow her to be in my home? Again, everything's going to be documented and DCFS is going to know about it, okay? I'm leaving. I have the right to leave. Yeah, you do. >> whole family does but her. Okay. Unfortunately if if she is she's 15 and she's left here overnight then you can get in trouble, okay? Just so you know. That's fine. I'll take the trouble then. I'm sorry but I I'd rather be safe somewhere far from her. I don't feel safe with her in my home and if you guys don't realize that that's the case then her safety for my son and my kids and my family, I'm sorry but I will not be within 100 ft of her and I'm going to go and get an order of protection for my family and I'm going to the full extent for this because this is multiple times now. She attacked my son and you guys don't believe it but she did. She came in the door. She attacked my son. My son defended himself. >> said I don't Nobody said I didn't believe. No, but you guys are allowing her to stay here. Can I speak to a sergeant, please? I Okay. Because I'm sorry. This is multiple times and if you guys look up at her track history it's multiple times with her. Multiple. It's I'm sorry. She's not safe. And I I'm I'm sorry. She can't stay here. She can't. So does she have Again, does she have any other family? >> Ask her. She she says I'm not her family. She says nobody here is her family. Then who is her family? So do you don't know if she has any >> her saying you know I mean she I mean you're telling us you don't know whether she has other family. No, I'm saying she doesn't she doesn't say my family is her family. She disowns my family. >> Okay, I'm going to ask again. Does she have family in the area? >> Not whether she thinks We're not asking you in the area. If she wants to go to Missouri then fine. Take her to >> No, I'm just I'm just saying I'm just saying for the night so things cool down. No, nobody wants her because of how she is. Even if she stays in her room. No, my my my daughters that's that's their bedroom too and I'm sorry but no. She cannot She cannot stay in my house. She Her bedroom is on the other side of house and so is my son's and no. No, she cannot. She She can stay in the garage or whatever. She cannot be in my house physically. Okay. You uh I got it. What are we doing here? Okay. Thank you. >> going to want to talk to sergeant. Um No, not right now but I will call back to you. Yeah. She doesn't like the answer. So Thank you. Okay, ma'am. You want Fine. Okay, then she needs to go to Mercy. I'm sorry but she does. Mhm. And she she was out of control and I'm sorry. She needs to go to mercy. Mercy for? For her behavior. I'm sorry. That's your solution for the night? If I have to sit here all night, I will. I will sit there until I feel safe and I'm in public with her there. I will be safe. I I want to take her. I'm sorry. I feel safer that way. She's not going to stay around my family. I'm sorry. I'm sorry. I'm sorry. Okay, we're not going to play this game. I'm You need to act like a reasonable adult right now. You stop. I am not talking to him. All right. She's invoking her fifth amendment. You Hey, you asked for EMS, didn't you? I need to know if what's going ON WITH YOUR CHILD to take them to the Your cards for her are right there. Amendment rights. I do not wish to speak with you. Okay. She's not law enforcement, ma'am. She's not law enforcement. >> I'm not law enforcement, so if you want your child to go to the hospital, I need to talk to you. How about we can take her for neglect? Please do. Really? You want to be arrested. All right, where's the dad? Where's the dad in this whole situation? >> him now. Are you calling dad? Oh, wait. That's stepdad. I will call him back. 630-5122. Okay. I'm Yeah, cuz I'm not going to take a kid anywhere. Patient discharged. I'll just call you. Cuz that's kidnapping and that ain't going to happen. She's kind of unbalanced. You said that I was neglecting my kids. I will fight for that cuz I did not neglect my kids. Um not quite sure. Are you going to give me any information on your daughter or not? I'm revoking my rights. Okay. You're You're revoking them? If you're revoking them, that means you're going to speak. >> No, I'm I'm saying I'm not speaking. Okay, so you want What am I doing here then for your daughter? Why did you call EMS? >> [gasps] >> I did not call you. Ma'am, you told us you wanted EMS. >> Okay, I'm going to send your daughter back inside for the evening then. I will I'm not staying. You guys said that you're going to arrest me for neglect. Please do. I'm I'm telling you to please do because you said that I neglected my child. Please do. >> Because you are. You You have an issue right now. >> Please take me then because you said that I'm neglecting my child. Do you realize how unreasonable and unrealistic you are? >> you have right now is I can't release this child back to the person that won't speak to me cuz I cannot further verify this is her mother, so you're going to have to call DCFS >> Okay. >> and have DCFS take custody of the child. >> Perfect. We'll do that. I'll bring her up to the office right now. Because there is absolutely no other thing that I can do. We can take her to the hospital and the hospital can have contact DCFS and DCFS will take custody of the child. Jessie M. Olizaba was charged with contributing to the dependency and neglect of a minor and child endangerment. Her daughter, who had reported ongoing neglect, was taken into protective custody after authorities determined the home environment was unsafe. She was initially held at the Kane County Sheriff's Office, where she was provided food and supervision before being released into the care of a social services organization. The younger and other minor children present in the vehicle were also not charged and were taken inside the home by their stepfather. The case was documented and referred to child welfare services for further investigation and follow-up.
