opted not to pursue the vehicle and instead notified dispatch a short time later she was found outside a hotel she's going southbound towards uh sh 4583 when not going to pursue hands up drop the she received citations for fleeing and alluding police reckless driving obstructing a peace officer resisting a peace officer and speeding 51 mph in a 35 m per hour Zone she was released on a $2,000 cash Bond hey everyone it's Trent prior deputy sheriff Patrol sergeant and K9 Handler and I have definitely been in this type of situation before where I had pulled somebody over for a very basic vehicle code violation they had a tail light out ran a stop sign whatever I pulled them over go to approach the vehicle and they just take off I've actually had it before where I had somebody do that I got into a Pursuit with them caught up to them placed them under arrest and that person admitted to me the only reason reason that they took off was just because they were afraid of cops and didn't want to deal with that interaction they didn't have anything else illegal going on no warrants no drugs no weapons nothing however I will say the vast majority of the time that somebody does that they do have one or more of those things warrants drugs weapons suspended driver's license Etc and in this case in particular obviously the officer had every authority to stop this vehicle for doing 16 miles an hour over the speed limit and when his partner arrived and they reapo the vehicle and the officer or ordered the driver to step out of the vehicle and she refused to do so she did just commit a brand new crime so this dates back to a 1977 United States Supreme Court ruling which is known as Pennsylvania versus men's stating that officers have the legal authority to order you out of your vehicle at any point in time during a traffic enforcement stop even if they do not have Reasonable Suspicion they cannot search your vehicle for any reason however what's notated in the officer's report later on is that he detected an odor emitting from the vehicle which is probably why he was having the driver and passenger exit the vehicle so that him and his partner could search it and see what they had going on because in the state of Illinois it is still illegal to transport even if you're over the age of 21 unless it is in a sealed odorless container so the odor of RA is still a crime there which is really strange because they also have another law stating that law enforcement cannot search your vehicle if there is an odor of burnt because that can indicate that you had smoked it prior to getting into your vehicle and you're not necessarily in possession of it in an unsealed container inside of your vehicle now when the suspect took off and the officers did not initiate a Pursuit I was actually kind of surprised the only reason I could think of that they did not pursue the suspect is because a lot of departments and agencies in the United States over the last five years have changed their Pursuit policies where in some cases they're not allowed to pursue people unless it is a serious Criminal violent or felony offense so lower level crimes like infractions and certain misdemeanors for their policy they are not allowed to pursue somebody they just radioed into dispatch and their partners and let them know the general direction of where the suspect was going now the officers located the suspect but they never located her family member who was the front passenger in her vehicle when she took off so we don't know if she had handed something off to him whether that's drugs weapons or something else prior to officers locating her or she simply just took off because she was afraid of the cops and she had claimed that her cousin had been involved in a shooting involving law enforcement at a prior incident and if that's going to be the case that means she just stacked on a whole bunch of new crimes when she had been stopped for something fairly basic and she did admit to having a blunt containing inside of her car but that's not really a big deal these days either and also to comment on her claims that the officer was being aggressive or having an attitude with her I will agree with something that he said to her during the interrogation process where he said if you have an issue with something that I did don't fight it on the street fight it in court and I agree with that 100% because no good is ever going to come of it if you're trying to start something or escalate it on the side of the street it always ends bad so definitely take that up in court or take that up with their Administration and that's going to be it for this video see you guys in the next one [Music]
