your plate this is Officer Daryl Jones from the Lawrence Township Police Department on November 12th 2019 a resident of Indianapolis named Aaron Blackwell and his cousin Daryl Cunningham were shopping at a Nordstrom Rack store when they observed officer Jones and a security guard allegedly following them inside the store after both individuals bought items worth $1,000 from the store they noticed get your driver's license out a civil servant off duty off duty pulling people over at nordstom parking lot ain't nobody pulled you over you stopped well if you ain't over you don't need to see no license stop you jumped out and stopped me no I said show me your driver's license you jumped out and sto I said show me your ID you jumped out and stop me sir argue with it's not argue okay we just had it's just one question what was the reason for you jumping out on this suspicious Behavior what like what exactly what was the suspicious Behavior buying buying a bunch of shoes at no coming back around to look at me you jum going to do you jumped out the car first you jumped out the car first that's why we came back driver's license out it's the last time I'm going to tell you cuz you ain't got to do nothing he can't even pull you over out there he's not he can't pull you over get your driver's life let's go we going to wait for backup sir yeah authority over you or you don't have no authority over me me ask we want super authority over me supervisor I don't have a supervisor out oh you're you're you're a self-c contracted civil servant is that what you're saying I don't answer a question to you we'll wait you don't even ask what your name is Officer no you can't even tell us that no are you really an officer of the law yep Pro we don't have any proof that you are because you have a shirt that says driver's license out what is your proof that you're you're even legal to pull what you shut up I'm not talking to you what is your proof I'm being calm you don't have to yell and spit in the car do now you're spitting bodily fluids on us yeah there you go better get your driver's license out that's all right Officer we're we're we're complying you have to suspect him of doing something suspicious Behavior I got these guys were inside there they got a bunch of stuff and uh then they WR their mouth to me they were leaving to triy to make sure I didn't get their lights in plate and then he didn't want to show me id off officer shman no they didn't steal items we bought a bunch of items they bought a bunch of stuff but when they were sitting right here I was trying to get their license plate he hollers out the window you're not getting my plate and he takes off so I went to get him then he comes back and he stops here so I asked him for driver's license officer Jones demanded ID without Reasonable Suspicion likely making the detention illegal his lack of reasonable suspicion rendered his actions unlawful despite his claim of suspicious Behavior to justify the demand for identification watch how the encounter concludes as officer Jones remains inflexible H it's all on video that's not what happened what infraction did he commit nothing at all officer that's suspicious behavior I'm want an ID okay what what was suspicious about it because he was calling me out in my car what did I call you sir I didn't call you anything I asked you I asked you what was you trying to get my license play for that's what I asked you okay well and then I came back to really see what was going on that's why we stopped in front of the store with my haard was on and he jumped out we have't on record he jumped out and told me to stop and started asking us for ID and all this and that he said we was looking suspicious of how you we was in the same story he was in we were shopping he just SE I'm a loyal customer here okay I shop here all the time the thing is he asked for my license for what reason that's all we asked them officer that's all we asked him what what infraction or what crime do you suspect us of committing and then we asked him for a supervisor he said you're not getting a supervisor hang hang tight for me for just one second yes sir so we didn't get your name we never got your name officer hey officer yes gentlemen officer okay so when we we first came in here right so he comes here all the time sure I'm his cousin okay okay so we came in here he bought some things for his daughter we bought a few pair of shoes the girl at the counter knows him well they had a nice conversation but the whole time this guy is standing in there staring at us right okay and I don't want to be the first one to say he profiling us or whatever whatever you know or whatever but it is what it is sure so I go back in there I take the uh take the little carts back in there I'm like cuz this this uh security is really beaming on us for some reason so I take the carts back in and the girl we had left one of the bags so she's like I'm glad y'all came back cuz you left a bag so we grabbed the bag when I come out we fire up a cigarette we bloating everything up and this dude is just staring at us then he pulls his notebook out mind you he was in the store the whole time until we came out out okay so when we first got here he had pulled up aide us so we basically got here at the same time so when we come out he comes out sure gets in his car right so once he gets in his car I'm like it's obvious that I said cuz he's probably going to try to run your plate mhm we ain't worried about him running the plate but the point is ain't nobody dumb man you got to have some type of reason for running the plate you're a not necessarily we can we can run plates for any reason or no reason does have to have is he have to have what's called Reasonable Suspicion in order to make a stop on he has to have some sort of reasonable suspicion that a crime has been committed correct and at that point you know that that's why I asked him what suspicion you have to stop him and I heard you asking him that and and my thing was you just seen us buying these items and that's why when he was explaining to you you was like well lost prevention said they stole some stuff no that's not what happened you just seen us buy this stuff load it in our car what's what is making us suspicious then he said he said that's why I asked him that question when we asked him to identify himself is he supposed to identify himself we just asked him his name what's your name officer he was like I don't got to tell you my name and blah blah blah well can we see your supervisor he's he's supposed to identify himself as a law enforcement officer so I mean you can say I'm with Maran County Sheriff's Department okay the responding officer from Indianapolis Metro Police corrects officer Jones stating that there was neither a traffic infraction nor reasonable susp ion to justify stopping Mr Blackwell and Mr Cunningham Mr Blackwell and his cousin left the scene without any further action later officer Jones was fired from his position by the Lawrence Township Police and Nordstrom Rack following this incident if you think this was the only time idiot cops got exactly what they deserved wait until you watch this next case yeah do you guys think it's okay to go handson with someone for littering if I threw let me ask you this if I threw a cigarette butt right in front of you right now would you go hands on with me it's all going to depend on the situation well in this situation all right what are we doing right now asking you a question okay these other units investigating something right now no idea they came up and talked to us first this is Sergeant Michael Brown from the Hot Springs Police Department on November 10th 2023 a First Amendment auditor named Justin McKenry went to Hot Spring Police Department to follow up on an incident where an officer used Force against teenage girls over a littering offense watch how the cops at the police department cater to Mr McKenry oh I'm sorry I be asking if he was busy okay if if they're investigating or if they're doing something right now by law you're interfering in a governmental operation so youall need to interfering is a physical act so asking him a question is not interfering and I literally and Sir hold on let me finish let me finish and then y to let you talk and whenever I walked up here I asked him specifically hey are you busy cuz if you are I'll come back and he said no what's up so now we're talking I didn't just come bombard him I literally asked him are you busy and can we talk and he said yes but the units are here in the parking lot that they're taking care of an official business okay that's fine that's fine and they came up to me and and started talking to me first and then I came want to know if you were part of the call that they were up here on they that that was you're doing some more assuming sir you're doing some more assuming I have it all on video let me get out of your let me get out of your way we we don't want we don't want impede or anything we just ask questions you assumed that when they came up and talked to me is because they thought I was part of the call all that's assuming talking to that's assuming explaining to you that if they're out here they're on official business okay form in your car you're on official business you're always on official business it doesn't necessar I can't talk to are you on official business right now so if I so back to my question if I threw a cigarette down right now in front of everyone here would you go handson with me I know what this is in reference to yeah and I'm going to just tell you like this each situation is going to be handled okay so I'm not talking about that situation I'm talking about this situation if I pulled a cigarette be asked to pick it up okay let's say I didn't pick it up what happens still a class sa instrumenter you can still go to jail okay so if so if I don't pick it up and I walk away there's a lot of ifs in life okay I'm not going to if I'm just asking you a few questions conversation is finished you seem uncomfortable answering my questions to as far as that I don't recall right off hand and you swore not to oppose the constitution did you not would you look that up when next time you go in and remember yeah all right thank you awesome thank you can you quote me all of the the fourth and the Fifth Amendment or the 16th Amendment not by word but I can tell you what it's about I could do most of that yeah definitely what's the finished what's the five elements the First Amendment that's an easy one what's the five elements of the First Amendment I'll give you a hint this I'm going to give you a hint cuz I want you to get it right the acronym is wraps ra PPS I'm get make sure I'm out of the way ra PPS ion bother we're good right here I'm allowed to stand right here no sir you're not you're going to have to move from where he's investigating this not impeding anything sir this is what I'm fixing to tell you you're interfering with a governmental operation if you do not interfering from right here I'm not going to explain it to you any do you lieutenant this the lady he's working with do you have a lieutenant I a sergeant do you have a lieutenant Sergeant I do have a can I get him down here please no because you don't know what you're saying right now I can tell you you you need to move interfering is a physical you need to move you don't know the statute so I'm a sergeant you have a liutenant I do have a can I get him down here please no because you don't know what you're I can tell you you you need to move interfering is a physical you need to move you don't know the statue you need to move that's Assa that is assault I got it you need to move brother give me my phone and I'm leaving give me my phone yeah you're fixing to move okay give me my phone and I'll back up and I will give you your phone my phone and I'll leave Sergeant Brown instructs Mr McKenry to move away from the sidewalk however he refuses to do so he then tried to take away the filming equipment from Mr mchenry's hands and did not let it go until Mr McKenry removed from the sidewalk filming the cops can be deemed as lawful under the First Amendment for those who don't know the First Amendment of the US Constitution grants the rights to citizens of freedom of speech and freedom of the press observe how this interaction further takes an unlawful turn back up he just assaulted him in front of you you going to do something about jail he didn't Assa give me my phone you know what so you escalated to VI the reason I did if you will read the statute you're interfering to read the stat it's a physical act it's a physical act you just screwed up does not have to be phys screwed up you're getting a complaints on your record fine complaints you guys have the right to complain come on Serge trying to Hey sir I don't want your paycheck promise you I don't I don't need it this is all you guys can't parking parking FR you just screwed up man if you're going to rightfully we're going to stay on the sidewalk get somewhere you can lawfully record stay the I can lawfully record right here thank you Captain you're I'm so I'm very sorry look we're not interfering we're not going to say anything to anybody we're stand here and we're going to be quiet you just let your ego get ahead of you man I'm going to stay Sergeant m brown what's your uh badge number please my badge number is 16 16 and if you will read the statue it does not have to be physical it is it can be verbal no it can't you don't know the law verb I do know it I know it better than you you you don't even know the okay if if they're investigating or if they're doing something right now by law you're interfering in a governmental operation so y'all need to interfering is a physical act so asking him a question is not interfering sir this is what I'm fixing to tell you you're interfering with a governmental intering if you do not intering from right here I'm not going to here his his will be a better view if I can re Sergeant Brown also accuses him of obstruction Mr McKenry states that he was assaulted by Sergeant Brown when he tried to take his equipment away Mr McKenry warns that the sergeant could face criminal mischief charges for property damage Mr McKenry requests an apology and suggests that the situation could have been handled more appropriately however the sergeant Brown remains reluctant to apologize watch how the interaction ends I don't I don't appreciate you calling well I don't appreciate being assaulted and you're laughing at me about it no I came up here dude me and those first what time did anybody laugh you just did I have it on camera too do you want to watch you laughing do you want to watch you laughing you were saying that you were assaulted yeah so now we got two on two yes you did laugh I have it on film you want to watch you laughing at me saying I was assaulted did you find it well it's going to take a minute I got something we were having very a very good conversation very positive everyone was nobody was like mad that I was talking to them it was a fine conversation until Sergeant walks up then he immediately escalates the entire thing and no one's even getting in his face like we are backing up doing he's saying and then he still grabs my phone out of my hand and breaks it because I'm not leaving the entire premises I don't have to leave the entire premises I don't well that's what he broke my phone over and threatened threatened arrest on me for that's illegal too you can't ille you can't threaten arrest for something that's not illegal you can't go around saying I'm going to arrest you if you don't leave here you can but go to court no you can't it's private property if he says this isn't private property no I'm saying they can't you said they can't say that yes they can if it's private that's that's that's not the circumstance that's not this circumstance this circumstance is public this is public property how's it how's this actually operate so you hold it like this and that attaches right there see that's broken that is broken yes I do see what that is I'm not going to pretend it was $100 or anything it was literally 15 bucks at Walmart if I could get my money to replace that in an apology I'll sh I would love to shake his hand and just be out of here no complaints with a that's to to Sergeant brown people he would like to do that I mean I think I think that we all learned a little bit from this this incident and I think we can all be a little bit better and how we do it like I discussed with you about if we yes sir you know letting somebody disengage and and not trying to re-engage and and try to make them you know look bad in front of f so that's I'm not I don't mean to argue but I I promise you I wasn't trying to if he knew the answer then he doesn't look that I didn't know he didn't know the answer me and the other cops were having a really good conversation I saw that and then he came and escalated by assuming a bunch of things he didn't know and then now me and him are kind of having a not so good conversation and that's where that tone came from because he came in with a bunch of assumptions that he had no idea about that I was bombarding those coughs and I wouldn't leave them alone when literally you saw me ask if you're busy or not and I'll come back if you are I did see and so he assumed a bunch of stuff and now me and him are arguing because he's assuming stuff and I'm still trying to give him an easy question well right now we've we we've gotten through that right right you understand where he's coming from so far we'll see how it goes yes he understands where you're coming from right and we're all going to learn and we're going to try to be better right and like I said just try to understand what we what I talk to you about with that space and respecting when somebody says Hey and when they try to disengage okay now Sergeant Brown wants to take care of that that is entirely up to you all if you want to press anything further you are more than welcome to as well okay well an apology and handshake is good for me I don't do many handshakes I do a fist bump something but as far as what I was trying to explain to you interfering with a governmental operation is not always physical it can be refusing to comply with a lawful command and that wasn't a lawful command that wasn't a lawful command for me to get off the public is this public property right here I was well away from everything that was happening I'm just trying to explain to you what he's what he's tell well he needs to just be more chill with the public and not try to force your authority over everybody because you they said something you didn't like that's what happened that is what happened listen see instead of just saying stop doing this and stop you know throwing your Authority why don't you to say hey I think you could have come at me a little different why aren you saying that to him because you're not you're the one that's saying no he's the one that escalated it I'm trying to no I'm not done no whenever he came up to me he is the one that escalated everything why aren't you telling him hey when you talk to the public you could say it a lot nicer you could do this you could do that you're not doing any of that you're doing it to me he was just fix to your to your professional Sergeant he was just fixing to apologize in the new told him how he should come at you and that he should well no he wanted to justify his actions before he apologized so instead of apologizing he started on the rant about how he was justified doing what he was doing instead of just saying sorry brother I'm I'm sorry you feel that way I apologize if I I made you feel uncomfortable what about my equipment we will address that do you apologize for breaking my equipment and getting in my face as far as get being in the face you you had your camera within 12 in or less you walked up to me I was I I was I didn't move brother you got in my face it's on camera you getting in my face and that is why I call Hot Springs Police Department trash because you could have just apologized and we could be cool but you would rather hold your ego in your pants and walk in the police station can I get a a Complaint Form Lieutenant can I get a complaint for him hang thank you just fill this out here bring it back up here just leave this top part this is what we'll fill out but you'll need the top of complaint and then fill out all your information this is the affidavit part okay 104 thank you have a good night appreciate you you guys have a good day Mr McKenry went on to file a complaint against Sergeant Brown and submitted a claim for the broken equipment in response the police chief acknowledged that Sergeant Brown's actions lacked professionalism and issued a reimbursement of $23 for the damaged equipment if you think this was the maximum an idiot cop can get exactly what they deserve then you probably don't know about this next case hey let me see your hands B get on the ground get on the ground get on the ground right here me get on the ground you burgy shark get on the acute head injury and a bloody knot on his forehead and was transported to a nearby hospital for treatment Mr Gailard expressed that the reason for such excessive force could have been racial profiling following the incident of unnecessary excessive force officer Dukes was promptly fired and arrested he has since been charged with first-degree assault and battery if you think this was the last idiot cop who got what the deserve then you probably aren't aware of this next case good morning sir what are we doing God bless homeless veterans huh God bless our homeless veterans this is me if I violate your rights I'm going be I don't know in trouble I guess but let me explain this to you sir yes sir all right I'm a that as myself all right I understand what you're doing that's fine M they don't want you here on City Pro property it's government run all right you understand that I hope you're getting all this cuz that way you can review it and understand it later now if you walked off the property you went somewhere else all right not on private property and did this it wouldn't be a problem you understand that do you understand that I'm engaged in con I'm engag yes or no it's a very simple question constitutionally protected activity so let me explain this to you freedom of speech and freedom religion care expain this again if they're trespassing let me explain this again you're trespassed okay I'll leave now you're done officer Wilder informs Mr Ray that he will get the mayor to tell him to leave the area however after some time he returns alone and states that Mr Ray is being trespassed the officers demanded Mr Ray's ID in response Mr Ray continued to assert his rights stating that he would not leave and emphasizing that he was engaged in constitutionally protected activity watch how the encounter progresses how long I got to get before you go anywhere else yes sir I have a right to be here okay let me explain the law to you again I identification all right you want my ID can I reach in my pocket you can reach in your pocket okay I'm going to step away from you a little bit cuz I want your ID can we go over there and do this so I'm off the property okay my ID is right here because I have a valid reason to be here and I have a valid reason to ask you for identification you don't care if I'm engaged in a constitution to protect activ you're a military V then go get your freaking lawyer and Sue the city if you think that's a violation I would rather not do not then do that because I tell you what you're not going to go anywhere with it you understand that I would rather not do that I would rather you respect my my constitutional protected rights especially being a v i i do I do very much every day trespassing me when you start becoming confrontational and telling me what I can and can't do guess what you're going to you're going to lose every time is it illegal because I know what my job is I know what the Constitutional says I know what the god-given right is you're not going going to tell me anything different you understand me now yes I you want to you want to get confrontational I can get confrontational just that simple I did 20 years in the military I collect the VA check for being disabled yes I understand that I don't have a problem you holding that sign and saying that but when you somebody tells you you have to leave and you can't do it in front of a city building guess what you got to go just that simple I'm not answering any more question good you told me to leave I'm trying to but you got my ID contact the mayor the city manager the City attorney and let them know what's going on before you guys follow through with this trespass he's trespassed me I tried to leave but he stopped me to get my my ID so I'm trying to comply with the trespass the uh I don't know if if he told you or not the way the call got reported to us was that you were out here soliciting for money holding a sign we don't know that until we come here and see what's going on well even if I was listening a still C right even if I was but I'm I'm standing here I told him multiple times God bless the homeless veterans that's what I'm doing he ask what are you doing God bless the homeless I'll wait yes sir go ahead thank you we have city ordinances in the city boering hand handling things like that right I'm not saying you were doing any of that stuff but we don't know that until we do our job and investigate right so after we read your sign we see you're not asking for money dri LIC you're just expressing your freedom of speech in a public place right yes um we can't have you boering though so in the city I don't know if you're familiar with the city ordinance or not if you if you stay stagnant or idle in a public place even in a sidewalk for 30 minutes or more that's a violation of a city ordinance here in Ocean Springs so do I am I trespassed yeah you're trespassed don't come back on the city property for how long for not for what you're doing if you got business here you can come back and do business but you can't just stand here and Hold sign Le bye if I don't leave what'll happen huh if I don't leave I'll get arrested yeah you get trespassed I thought I was trespassed already huh I if would I be arrested if I don't leave yes eventually another officer arrives on the scene and informs Mr Ray that he may be found guilty of loitering if he stays outside City Hall for more than 30 minutes Mr Ray was warned that he could face arrest if he does not leave the officers then returned Mr Ray's license and he subsequently left the scene it's unusual to see cops making fatal mistakes and then facing consequences for it if you enjoyed this video be sure to drop
