Louis Park Police Department on May 20th 2020 a First Amendment auditor was filming in the vicinity of the St Louis Park Police Department's premises when officer hins approached him officer hins was concerned about the auditor's filming and alleged that filming the cops activities poses a threat to their safety watch how the confrontation unravels h what's going on not much just walking around videotaping the police department is not a good idea why you guys are friendly people we are but why are we doing this why wouldn't we cuz it's a security issue for us is it it is I don't think so it requests to show his driver's license or ID himself however filming in public is a First Amendment protected activity for those who don't know the US Constitution's First Amendment grants citizens the rights of freedom of speech and freedom of the press the auditor argues that he cannot identify since he hasn't done anything wrong observe how officer hints is about to get humbled cuz I want to make sure you're not doing something that's a problem for our law enforcement community so in order to detain somebody you have to have a law that you're investigating correct so which law are you what I'm concerned I'm a state representative who happens to be in my district okay I don't have State anything else but I'm I'm well I'm being polite just engaging you in conversation don't need to be rude but I'm not you don't have to be but I'm I'm here just as an observe these are officers from the Little Rock Police Department on September 26th 2016 several officers were conducting a traffic stop in Little Rock Arkansas John Walker an attorney and state representative noticed the scene across the street and began filming the officers as they proceeded with the stop which ultimately led to the driver's arrest the officers seemingly disturbed by being filmed approached Mr Walker to ask about his intentions watch how the interaction is about to get filthy this happened to me by the way observed some policemen in pan blood arresting a few black boys 10 years ago you pull up the P Walker versus pan BL M and they arrested me to just watch oh I'm not you have total right to do exactly what do you do you understand the circumstances of our I don't know I don't know I just want to see it but five cops for one man no well actually five cops for one man well what's going on is both the young officers that you see over there are in training and there's only four of us if you if you count us there's only four there were five no there's only been four both me and both me and this officer are training all right they're in training so we ride double that's fine or there' just be two of us all right now in this particular stop this gentleman was pulled over because he doesn't have tags on his car okay so a quick check to see why he hasn't tagged his car led to a warrant that he had for his arrest that's why he's in that car he's been treated with nothing but respect from the get go I'm not questioning that I see I see I see tra stopped or in a way but it's not necessary well if you read if you read the traffic laws that's an emergency vehicle so it's allowed to par for a better view the officers asked them to leave when Mr Walker refused to comply despite exercising his first Amendment right to film as a Citizen watch how the officers responded how you say last he got a right to be here now Mr Walker and Mr Shakur were arrested with Mr Walker being informed that he would be charged with interfering with government operations the following day the police chief issued an apology letter to Mr Walker stating that he should not have been arrested that the charges against him would be dropped and that an internal investigation had been initiated however Mr Walker stated the arrest to be unlawful and refused to accept the apology as the charges against Mr Shakur had not been dropped a few days later the charges against both men were dismissed the outcome of the internal investigation remains unknown but if you think chesmore probably just took a grade two test you're about to meet another cop who was probably allowed onto the force by mistake you know rashim Edwards was unable to provide a valid form of ID during the traffic stop Mr Edwards fled on foot toward a field where a youth sports practice was taking place a deputy pursued him and after a short chase Mr Edwards attempted to pull out a firearm he had on his hip in the process he fumbled the weapon causing it to drop to the ground Watch What Happens Next there'll be a dirt bike I'll be excuse me don't touch me T you yeah you just did you just BMP me on the 8th of March 2023 a popular First Amendment auditor visited the Buchanan County Courthouse while going around this public building he met Sergeant Chris chesmore who apparently had no idea how the Constitution works for what what did I do wrong you told to leave they move for what what crime let's go what crime did I do I'm here to get papers what you say no you could look right here Pap excuse me didn't you already get your papers I think you need to slow your roll right now slow my rle yeah come on down here come on down here for what come on I committed no crime come on I'm here to look at papers get papers see what services you provide now well you could tell all day but I followed the law come on I followed the law I'm going to continue getting my paperwork you hear the you he come on what did I do wrong you guys can't this ain't Russia you can't just make up rules yourself what was your name in badge Buchanon County my name and badge and you haven't given me your name and bad because you're a public service did you forget doesn't matter it does did you forget he worked for me Sergeant chesmore seemed to have forgotten a lot more than who he worked for he also had no idea what rights the auditor had no constitutional law made it mandatory for the auditor to identify himself in that situation but of course chesmore didn't know this yeah that's what I thought why you being this way why are you Tyrant what's so funny little boy I don't know why can't you just respect our rights what's the First Amendment do you know didn't think so it's a shame that you guys swore an oath to uphold the Constitution yet you don't even know the First Amendment you like the Broncos no I like freedom is what I like apparently you guys don't you're still free aren't you uh not by you you want to be a little Tyrant hey get out get out of the public building I haven't hey hey he went up yeah cuz you're not going to and if you do guess what we'll have fun in court like we'll have fun in court guess what have you violated someone's rights of course you have but guess what you ain't going to violate Rights in the Constitution huh you didn't know that huh no you're educating I that's bad if I know your job way more than you imagine imagine swearing an oath to the Constitution that you don't know you want to know what happened when I came in here guess what I'm being so polite to everybody I go in here go in the clerks I ask them hey what what services do you guys provide here and you know what I got I got a passport information right here cuz this is what I'm looking for I'm here to go in all these offices and this guy right here he should not have stripes for one that's disgusting how you treat the public two he's yelling at me hold on hold on little man number two I'm in here to check out the public building public don't forget that and he's over here harassing me hey you already went up there no you got to leave get out of here no I don't have to leave ironic you're the one demean your us demeaning you yes really what's the first amendment what a shame what a shame answer your questions because you're a public servant did you forget guess what you this job right here is a lot you the public expects you to do your job correctly that oath that you swore actually means something you know how many men fought and died for these freedoms that we have and you're over here trying to give me a hard time for what why you give me a hard time because you work for me I did nothing wrong to you what have I done to you what have I done to you you're not giving us your name I don't have to what's the Fourth Amendment buddy is this a your first day on the job I mean come on you got to be better than this it's I mean Captain is this what you do you accept this Behavior neither of the officers had any idea what the amendment was they were probably completely confused by the question which is a total shame it wasn't until the auditor called the captain's attention that the situation was eventually resolved what do you need well I'm going to go I'm I just got here I'm going to each one of these buildings asking what services they provide I'm getting certain things like I just got a passport info cuz I'm going to fill it out and get a passport and I'm here checking out the building then I get harassed by this Deputy it's disgusting his behavior well check out the building exactly why couldn't we do that in the first place so you have no problem no exactly do you have a problem now Captain says it's fine yeah and he says it's fine because maybe you know he appreciates the Constitution he at least at minimum he understands it just don't interrupt or go back into any place that you're not exactly and I don't poor chesmore must have been taken aback by the captain's Revelation that the public building was in fact open to the public the level of his ignorance makes you wonder how low the requirements are to be a police officer if you think this was the last Deputy who got humbled by higher authority then you probably aren't aware of this next case these are officers from the tuila police department on August 22nd 2014 officer Frank and officer bamer responded to a call informing regarding a man in the Taquila UPS Freight yard Washington walking around yelling and dancing upon their arrival at the scene the cops met an individual named Mr Tara did not work there however he was being confronted by several of the workers from the freight yard watch what the deputies do to him when they confront him [Applause] BR boy your hands on your back your hands on your back up oh we sto and said hey going crazy officer Frank forced Mr doara onto the patrol car hood and slammed him to the pavement repeatedly punching him meanwhile officer bamer deployed his taser striking Mr Tara's stomach and thigh he was hospitalized for injuries including dog bites and was initially charged with assault but those charges were later dismissed he later went on to file a lawsuit against the Taquila police department and the officer involved the Taquila Police Department agreed to pay $100,000 in October which includes attorney fees as a settlement for this incident it's disturbing to see cops overstepping their bounds and then getting
