many police officers misus their position and seem to forget that legal systems are in place to prevent them from overstepping while carrying out their duties however some officers cross these boundaries and violate citizens rights but what happens when these citizens decide to take legal action against them here are some cases of idiot cops who actually got sued how we doing good not too bad are these your vehicles yeah well this one isn't those two are okay so what's going on with them they don't have any registration on them I just I just bought that one and that one I took the head off of let's start with the case of three officers who falsely charged a citizen and ultimately got sued on March 10th 2020 a citizen named Josh was leaving his residence when he was apprehended by Officer Malta from the right City Police Department right in front of the sidewalk by his home the confrontation arose because officer Malta noticed two cars in the driveway without license plates and began inquiring about the vehicles this is my I'll get a cover for him um I'm placing ordinance stickers on all of them I'll get a cover for can't do that that's not how it works okay you put your on fine okay then you're going to be cited for it hey put your stickers on off the give I'll just issue citations officer Malta goes on to lie over his radio to his co-workers to create an emergency response claiming that Josh had threatened him although Josh had flicked him off which isn't a crime this false accusation prompted another officer detective beard to locate Josh's van and pull him over without activating his dash cam or wearing a body body camera 48 can you copy of V okay I'll take my time one George 6 48 103 where you at pull up here 104 try and get a stop on that uh GMC Suburban it just left it's on Sam wise now that's clear he wasn't a fan of me being here is it his residence I believe so he wanted to flip me off and threaten me to get off the property to an officer I need your driver's license Pro you need a reason to pull me over I just gave you that for what threat I didn't make any threat to any officer I have't no I am not cuz I did not break the law so you're not going to give me your driver's license of proof of insurance is that correct for what I just told you for what threat okay I'm not going to keep going through threatening an officer is not a crime I didn't threaten to do anything to him a crime yes fpp flipping an officer off is not a crime a threat to an officer is I'm not going flipping an officer off is not a crime flipping an officer off is not a crime it's a constitutionally it's a constitutionally protected activity right hop out or I'm going to break your window it's a constitutionally protected activity to flip an officer off that's fine you can flip him off you can't make threats to him I didn't make what threat what threat chance I'm going to break what threat okay first tell what threat I made to him what threat what threat I'm going break your window what threat did I make to him what threat did I make to him driver's license get out I will here's my here's my thing out of the car Josh was arrested without any probable cause and spent 5 hours in jail before being released he was cited for disorderly conduct failure to comply and resisting arrest in the officer's reports they failed to provide a proper clarification of the exact threats Josh allegedly made claiming that he used profanity towards officer Malta however body cam footage did not support these claims all Josh had done was give officer Malta the middle finger which is legal and protected by the Constitution another officer officer Haney wrote in his report that officer Malta had used profanity but neither the body cam footage nor the CCTV footage from Josh's neighbor showed any evidence of this all three officers involved lied at the scene and in their reports to substantiate a false claim against Josh violating his rights over a simple gesture a week later Josh went to file a complaint against the officer's missconduct where he met with the police chief here's what transpired one thing I'll say is that uh to begin I am going to be voiding all the charges all the summonses that were issued to you awesome I've also spoke with the to company and theyve agreed to refund the expense you had $400 they charged me $400 and you will be refunded every penny of that so let me explain to you why so first and foremost what we have here is a Sydney ordinance that has been on the books for some time that shows that the officers were acting in good faith in accordance with the city ordinance at the time another city ordinance okay it sure I knew he had a right to be on my property well this is this is specifically the manner in which why they placed you under arrest not specifically the derc vehicle ordinance so this is ordinance labeled disorderly conduct if you recall getting that ticket from the arresting officers and the subsection of the ordinance that they used to place you under arrest was this language here whenever I reviewed this case I believe that same gestures are constitutionally protected you can't make laws that go above and beyond the an opportunity goe I'm very emotional about this well and I can I can tell and I understand so this was on the books this was the ordinance that they enforced that they used to place you under arrest okay when I had the opportunity to review the case I agree with you that I believe this is in conflict with the First Amendment okay okay that that is protected speech because of that all subsequent actions following the traffic stock regardless if you were guilty of them or not are not going to be enforced because I do not believe that they had a constitutional right to stop people get pounds of marijuana from around a court for unconstitutional stops so again I understand that you're an argumentative individual I I am I'm not an argument of individual I'm a very polite person I have seven kids I have been violating my rights before I knew what my rights were you can look on my record I've never had a speeding ticket I've never been arrested like my my whole the whole point here and the reason why I've called you the reason why I wanted to reach out to you is that your your point here of of your ability to make obsene gestures toward police or protector in the First Amendment as the police department we agree with you this subsection of the ordinance we've already address this with our legal council that represents the city and this ordinance will be amended to remove anything that's in conflict with the First Amendment okay as such you will be the standing case law that amends this for all future contact and this ordinance will be amended to where this will never happen again we've spoke with the toe company we've told them our position and we are having your total toe Bill completely refunded to you as well he was an ass that guy sure well I understand we spoke with him as well and he doesn't sound as though he got along with you very well either but hopefully now we can put this whole issue behind us um again I I have no reason to suggest the officers didn't act in good faith because that ordinance was on the books that ordinance is going to be amended okay and all charges against you yeah this is actually on eode 360 it's it's public record you can pull for up and view it what proof do I have that my charges are going to be dropped sure so um they're not being that you're saying this so oh okay that's fine perfect yeah um well is that all the proof you would like I mean we could send you a letter no just good doal yeah so uh prior to even calling you the actual hard copies of the tickets were stand from red and void uh inside of the computer system I voided all of those out okay so they're it's as though they're not going to make it to the court a little bit deescalation training cuz beard was hot I mean he came in hot hot so to address that with you um in the event they did have a lawful contact with you the subsequent actions of failing to comply I would have allowed to stay yeah I know I know if I if you had a reason to pull me over I know I have the ID and stuff I'm not I know my rights sure so what I will say is I also know my first my fourth my eighth was was violated I know my rights were violated mhm okay so what is it that you would like to have happen moving forward I I don't really know yet like I haven't really crossed that bridge my focus was getting these charges dismissed okay and we have had addressed this prior to seeing things pop up on Facebook um we were working on this at the end of last week we spoke with everybody on Monday I believe it was so we've been in the process of working on this and I think and and one of your officers called I'm a legal marijuana grower one of your officers called my landlord he called me and said that uh I was illegally growing over my limit I know my limit I'm allowed to have six on six nonflowering six flowering six seedlings I only have six non-flowering right now and he said I was growing and distribution to my to my landlord what what the hell was that about drove off next thing I know I'm getting pulled over MH yes and the position of the police department is that while that was in the city ordinance at the time that that gesture is protected by the First Amendment and that's what was used to stop you so therefore all subsequent action uh is not going to be enforced how long have you been in the department uh this is my fourth day back after being gone for 5 years I used to hold this position here okay and I know you just got elect recently congratulations than he's been here for a decade he's he was just recently the police chief yeah so I was here I was formerly Lieutenant here I spent 5 years of another agency and this is my first week back in this position I am taking care of the car sure I'm going to get well you got my again I'm I'm just now getting settled back into this position Chief canivan has just been recently appointed to this position we're here to work for you Josh you're a citizen of this city you've got my card if you have issues give me a call okay okay and work through things together you know it's it's not US versus you it's us serving you that's the whole that's what it's supposed to be but then the dude called my lawyer my landlord and I don't know anything about that if you please call me we find out I get the number CU I chief Lieutenant Matthew did a good job reviewing the incident and found that no threats had been made against the officers as they claimed ultimately voiding all citations against Josh however he did not address the multiple Lies by the officers who had fabricated false claims to criminalize Josh as he mentioned that the officers had been acting in good faith according to the city ordinance at the time there was no mention of any disciplinary action for the officers involved nevertheless Josh filed a lawsuit against all the officers involved but this isn't the only time police officers have faced lawsuits as we see in this next case uh any specific location okay is this your son yes all right hey what's your name you can tell him your name this interaction unfolded at 6:00 a.m. on July 4th 2024 when a father identified as John and his autistic son went out for their regular morning walk while they were walking they were approached by an officer from the Wanga Police Department during the interaction after failing to provide identification to the officer another officer joined the scene here's how the interaction transpired what's your name Sir Johnny Johnny all right all right Johnny where you coming from I'm just walking around just walking around yeah all right enjoying this weather yeah gotcha gotcha well uh we checking up on you man you know just walk around what is the heck is this deal uh found it a little bit suspicious you know so what uh just to walking around walking around is a little bit suspicious uh I mean actually go ahead takech me not really but I mean it is pretty early in the morning just wondering what was going on that's what we do we get up early in the morning you got your ID on what do I need an ID for cuz I just asked you for it I don't need to show my ID okay if you don't give me your ID I'm going to take you to jail for failure to identify because I've identified that you've been walking around down here at 5:30 in the morning yeah we do that no you're not give me your ID I don't have my ID on me cuz it's at the house name and date of birth huh what's your name and date I don't know but you can't run I don't have this is a state where I don't have to show my ID you're going to do this in front of my son yeah turn around one of the offic offers then in front of Jon's 6-year-old child and without any reasonable suspicion or cause assaulted and violently detained Jon in an unlawful arrest are you serious yeah turn around this is my son let me bring my son home first no turn around now bro you need here let me videotape criminal activity it's going to be okay people that don't want to identify typically involved in criminal activity I've known this individual to be involved in theft in the city of Camp there has been no criminal activity okay listen to me but we were just walking and when you came up can you you hear what he said shut and listen for no shut up and listen Okay so I saw y'all walk down the alley yeah but I didn't do no criminal activity no I didn't I do nothing criminal walking with my son okay it's not criminal but we still have reasonable enough suspicion to identify you to give the ID I can no it's not a if the state is not a if you want to State it's not it's a state that you that they can ID you at any time it's not a this is not a shall ID state but once you're being detained and what was I being detained for criminal like we don't know what's going on but we can call it criminal activity that's not but I didn't do criminal activity for that thrown down like that fromont my but I did ask you what's your name and date of birth is I'm typically when a cop's out with somebody and they don't want to identify it leads us to believe that you are involved in more criminal activity than we need to so that's why you heard me saying what I was saying because I'm narating for the camera I'm not this is not my first day on the job okay and I'm going to tell you right now man I'm straight up with people if I tell you to do something you better be doing it does that make sense yeah it makes sense bro hey you know what maybe have to do you know what I'm saying like I why is he John and his six-year-old son were finally set free and the incident became public prompting a review by the Oklahoma State Bureau of Investigations prior to this incident there had been multiple complaints about the officer involved while we cannot confirm if any disciplinary action was taken against the officers the arresting officer has been demoted from his position although this arrest is sufficient grounds for these officers to be sued let's examine the actions of another officer in the next case that led to a [Applause] lawsuit right sir your driver he's the driver on April 27th 2020 following a minor traffic crash on Interstate 25 Denver police officers investigated the scene where they made an unlawful arrest of a 25-year-old black man keelen Hill on allegations that he interfered with an arrest here's what transpired you guys are okay yeah we're good we're good what happened well it's so weird honestly um I changed lanes I signaled and Chang Lanes a while back actually cuz I was looking for a safe place to pull over after it happened um and after I was in the lane he came between me and the car that was in the lane and I me he was like he was driving recklessly and just came like right between us you get you on that side yeah this side right here I'm right here you can right here knock this plate off and put a dent in the front which is mirr I think okay now where did this happen uh I don't know a couple about a maybe two exits back two two back I don't oh they right here yeah yeah yeah and uh when we did stop you know oh man he came out like a oh my God I thought he was going to punch him he was so he was very aggressive very aggressive and uh swearing at us yeah upset obviously so we we kind of tried to calm him down and say hey man this is what insurance is for you know it's all right you know so you're in a lane other lane he wants to thread the needle he was trying to get right through yeah he saying it was totally my fault I ran into him and I was like no I didn't got your license and insurance on your Tru have to get a good cell phone number yeah uh insurance card yep hey Gary I need to get his ID bro I didn't get his ID dude so he tries to thread the [ __ ] needle between two lanes dude and he [ __ ] side swipes and he's being a dick he said they jumped out on him like he was going to fight him something I haven't it I called y'all because I was injured from and what did I just ask you I don't know where who injured me what injured me don't get in my face I can I can hear you I I don't know who injured me or what injured me I know I sustain some sort of injury what I'm sir I cannot determine that until I go to I'm not a doctor I'm not a doctor I'm not a doctor I don't know I just know I need to go to a doctor very soon okay what does your car have a cage does your car have a cage no okay these we got to do paper on them so we're done we're done which C you want to put them in I'm literally telling custody he had uh his left hand I had his right uh one of the paramedics held his head down that was not any one of us okay so he's he will not tell me if he's injured or not and if he's saying that he is or he isn't I we have to do something right CU I don't know if he's hurt because you guys cuffed him or he won't give me an answer so we're just going to do the paperwork okay so let's can we get off the highway and do this um do a to yeah I'd really like to not transport him in my car I don't have a cage we have to he's going to go crazy the key for the where are you going to put them you get a district car you can't drive them off the ramp yeah can you do that well yeah I can do that following this arrest Hill filed a lawsuit against the Denver officers alleging that they violated his constitutional rights by searching his car without cause and unlawfully arresting him using excessive force Hill also claims that he was treated poorly because he was black and that he was treated differently from others involved in the crash who were white but if you think this is the last idiot cop to get sued then you should see this next case he you Polo now it's name coming over my over it turns out that the citizen who got tased and was later forcefully arrested was the wrong person hey show me your ass clear the air start me some cars [Applause] go back in the house yeah I don't shoot this guy and so when I pulled up he walked out of the house and this guy was telling me like I said hey are you Polo and he's like I don't know what you're talking about leave me alone like he's calling you shoe he's like going like this like Sho Sho and I was like I'm trying to figure out why I'm here and he's like he called you not me now go deal with him and I was like I said something to him um I asked him like what is your name he made some comment I said what and he said how about you open up your ears and shut your mouth and I was like how about I said excuse me and then so I asked him for his ID and he was like man what you talking about leave me alone well in my mind that's the guy who has the gun and he had he had his body turned like this the whole time but wouldn't move at all he wouldn't move and I was like I said something to him I said how would you come over here said give me your ID and he's like no I'm going back in my mouth or going back in my house and I said come here right now and he said for what I said give me your ID I said I'm trying to figure out what's going on but the whole time he's going like this and then he got stepped towards me and started walking walking back in the house so I'm thinking he's going to go get either do something with the gun so I tased him right in the back and then that's when he he rode it for a solid 3 seconds then tripped up the stairs and that's when he slammed the door and that's when the barbs uh uh Barb I guess the the second Barb came out but one stuck in them and then he came back in the house and so I pulled my car to where I can get behind it cuz I don't know if he's going to come back out and try to shoot um and then he came back out but he was like still hiding behind the door so I was like he figure out where the 20 is if you can get them to hospital and I mean he's not he's fine now and Adam got the barbs out yeah put him I would say take him to the hospital the one wasn't even shirt had Adam count as a medical professional look Adam here I'm okay with that okay but the hospital needs to clear him before you can do anything if you can get him there um right over there and then uh talk to B about how to write it up we'll be good to go trication Fe for my life I think the way you described it is fine but make sure you exactly how you described it to me needs to be written down yeah he play himself in the doorway to keep one hand hidden yep was the disorder with a weapon a gun yeah the guy said he has a Glock and I pull up and he was an [ __ ] to me and the first thing I said is this why I'm here no I said the first thing he said to me I said is this him he was like yeah that's why we're here or that's why you're here and that's when he was like sh close your open your ears and shut your mouth and go over there then you talk to the yeah we've I've already talked to them [Applause] information is there certain paperwork down Park Rage or they just have to get them cleared you just got to meally clear them so you can give the paperwork to the jail stand yeah they'll they'll give you something just just discharge paperwork just discharge um yeah to do that I'm going to run over this robbery see what we have over there and then [Applause] do appre can [Applause] parid say it again say what are you charging them with so I can tell the the wife when she get here she going to be asking question uh disorderly and resisting and if FZ can help me with make anything else but that's what I have right now is disorderly resisting I didn't figure out do you do you have going flip [ __ ] once we leave too the officers charged the man with disorderly conduct and resisting arrest then drove him to the station for further processing meanwhile the real suspect got away
