I feel like a terrible person I feel like a piece of crap I hate move your car stay back I never wanted to take an innocent person's life I never in a million years thought a train was going to come plowing through my scene you didn't run down the street and try to save Dante Wright's life did you no it was wrong circumstances at the wrong time cops losing a lawsuit can bring embarrassment both themselves as well as their police departments today we delve into different incidents where female officers found them losing their cases and facing prison in today's first clip we go over to the case of a police officer named Amber Gyer who made the terrible mistake of killing a 26-year-old man named Botham Jean in his own apartment thinking was her own I it was my apartment I [Music] top left top left hey can you hear me the footage we saw shows chaotic moments shortly after Amber Gyer killed Botham Jean in his apartment she had just shot an innocent man who was sitting peacefully in his apartment a man whose only Misfortune was being black and her neighbor would you send provocative photographs of yourself Amber dier uh yes should you be giving 100% of your attention to the person who's dying in front of you if you can yes you should should you be sending text messages no on the first day of trial Amber geer's partner Martin Rivera took the stand he attested for the racy messages they exchanged and deleted from their phones that night including the messages Amber sent him right after shooting Jean instead of giving Jean the attention and treatment he needed Amber became self-absorbed the moment she shot him and realized she was in the wrong apartment instead of giving Jean proper treatment and complete Focus Amber was busy worrying about herself and texting her partner could you please repeat [Applause] your I was scared whoever was inside my apartment was going to kill me and I'm sorry I have to live with that every single day that I shot in how do you feel about that no police officer ever want to Hur an innocent person how do you feel what you did for Mr John I feel like a terrible person I feel like a piece of crap I ha I hate it every I hate that I have to live with this every single day of my life and I ask God for forgiveness and I hate myself every single day I feel like I don't deserve the chance to be with my family and friends I wish he was the one with the gun that killed me I never wanted to take an innocent person's life and I am so sorry this is not about hate it's about being scared that night Amber Gyer when asked why she shot the guy went on to cry and told the court it was a mistake an important concern over here is how a police officer can make such a mistake a mistake of entering someone else's apartment and thinking it was their own then quickly choosing to open fire and aiming to kill instead of searching for a plausible explanation or assessment of the situation you said I put the key in and I hear moving around as the door begin began to open I wanted to find the threat as the door was open fully that's when you saw the silhouette yes sir so you knew from outside that door with the protection of that door between you that there was a something inside that was making noise yes sir okay so here were your options that your options were at this point to go in and find the threat or your option would have been I'm going to back off I'm going to take a position of cover and concealment and I'm going to get some help out here those are options right and they are okay but you chose option A which was I'm going in to find the threat that was it was the only option that went through my head I was at home and I ma'am will you answer my questions yes sir you chose to go in and find the threat even though you were in a position to have taken cover and concealment right no sir your training which you've told this jury several times now that you revert to you've told them that right yes I have you rely on that training is what you've said yes I do that's why you pulled the gun when you pulled the gun right yes sir that's why you keep your right hand empty yes sir that's why you backed your truck in correct yes sir because that's what police do right yes sir but you're telling me at the most critical moment of the entire thing your training just abandoned you no sir no because your training says that when you're at this point here for officer safety to maximize your safety do not go inside that apartment on a call ma'am your general orders indicate that you are on duty 247 they do and you know that that training is designed for your safety first and foremost yes sir and that's not only what your orders are that's how you guys are trained yes sir so for your safety you should have taken a position of cover and concealment and got help and instead you decided to go in yes I did go in you had a police radio on you didn't you I did did it work it did you live two blocks away from police headquarters yes sir you know that when you call out as a as a police officer the number one thing for every other police officer is to come and help you if you say that you need help yes sir you know that the response time on this call was about two minutes and bodies were at the apartment yes sir so you could have taken a position of cover and concealment you could have called for help on your radio and you could have had the calvary there in two minutes I could have and had you done any one of those things Mr Jean would probably be alive today ending the long cross examination the prosecutor made her realize that she didn't indeed follow procedure or try to save Jean or else he would have been alive and she wouldn't be in this condition which is absolutely right she also seemed concerned about herself and didn't give him the right treatment but what she did do was text her partner when an innocent man was dying right in front of her her failure to follow procedure and act on poor judgment resulted in the death of Botham Gene we the jury unanimously find the defendant Amber Gyer guilty of murder as charged in the indictment no Outburst we can hear the gasps in the courtroom as Jean's family get a sense of relief after after Amber's conviction Amber gger was convicted and sentenced to 10 years in prison for fatally shooting her neighbor in this incident Amber's appeals to reduce the sentence were denied and she is currently serving her time Behind Bars next we take you to Colorado where Officer Vasquez approached Yen Rios who was driving recklessly and pulled her over he unknowingly parked his own car on rail tracks and soon the other officer on scene officer steiny took the lady in the cruiser their lack of attention resulted in the cruiser being hit by a train we'll now Deep dive into the incident lift your hands up okay turn around turn around turn around put your hands up higher I want you to set your phone down a there new drug you don't need it you can leave it on come on come back keep coming back keep your hands up keep coming back keep coming back to the sound of my voice keep coming back keep coming back keep coming back keep coming back stop right there get down on one knee and then the other I got CL good good keep your hands above your head don't move what's going on why am I being we'll explain everything in a second can I get my cell phone please no one else is in the truck sir can I please get my cell phone we'll get it for you wor about please where are you taking me we're taking you to the car come on why we'll get your cell phone in a second is there any weapons in the car ready no ma'am there's nothing on there's no weapons in the car no ma' okay car what's going on ma'am what's going on I'll tell you in a second take a seat I'm so confused can I get I will get your cell phone for you take a seat check oh my God oh my God move your car stay [Music] back was she in there was she in there oh my God yes she was over here we can clearly see that the officers were distracted and searching the suspect's truck they failed to notice the incoming train until it was too late the train struck the cruiser with a suspect still inside severely injuring her Yen Rios suffered serious injuries with multiple broken bones next we'll see Officer Vasquez account of how things transpired so the the medicine happened in the county prior to forlon and forlon tried to catch up they couldn't catch up they gave gave me the information I was in the office I jumped on it and I saw her second and Grand cuz they described the vehicle and I lit her up and it took her a long time to pull over I I almost I almost thought she threw the gun out you know cuz it was dark it's really dark and so she just stopped right right with the like right in front of the tracks and my car was still on the tracks we're letting them know right now I'll let you know when they are in and um so we did a family stop on her and we I had I did the verbal commands and the left officer Rec her and put her in my car cuffed her MH and um I didn't think the L officer was going to put her in my car I just didn't and she did she put her in my car Officer Vasquez can be seen trying to shift the blame on officer steiny although officer steiny should have been more Vigilant about placing the suspect in a cruiser on the road Officer Vasquez as an officer on the scene should have been more aware of what was going on especially in the use of his own Cruiser we cleared the truck okay and then we cleared the back and then as it was clear we just started going back and then the the mail officer for the glasses train train train then I hear I hear that and then I start moving this way and she was in there you know but you know the the one good thing is the female officer put that's my chief calling me um put her on the wrong side which was saving grace because if she would have put her where the prison go on the on the on the passenger side okay we're we're we're working with a gun here you know and we're working with you know we don't want to just go up to I don't know we just it was just it was just it was wrong circumstances at the wrong time just once again we've got Officer Vasquez trying to shift the blame to poor timing and cir circumstances completely disregarding the ignorance of the officers including his own on the scene she's breathing she's saying ow ow ow so that's that's kind of promising you know in hindsight why do you think you did not notice the train tracks here's a few reasons it was incredibly dark I was Miles outside of my jurisdiction I was fairly certain that that particular stop was going to end in a gunfight I never in a million years thought a train was going to come plowing through my scene Jordan steiny tries to justify her failure to assess the complete situation at the scene that night but let's hear the judge's final thoughts on the matter when she testified to that I wrote down what does that mean and then I thought about that uh and frankly this is what it means to the court it's the equivalent of acknowledging that she was aware of the signs and information that this was a rarro trct but didn't appreciate the risk Jordan stiny was found guilty of two misdemeanors reckless endangerment and third degree assault she was also charged with criminal attempt to commit manslaughter it comes to no surprise that she lost her job with the police department in Colorado and was sentenced to 30 months unsupervised probation for our last video today we take you to a courtroom where the trial of Miss Potter was held Miss Potter was accused of murdering a man named Dante on April 11th we'll go over the courtroom footage for this case below um Miss Miss Potter could you take the stand again after the judge officially starts the hearing again the prosecution starts asking Miss Potter about the series of conversations that happened on April 11th and Things She Said to Sergeant Johnson and and Dr Miller most of which she seemed not to remember Council you may continue thank you honor Miss Potter before we left for the break we were walking through what happened on April 11th uh you'd agree that for a large part of the interaction at the side of the car with Mr Wright you were standing behind officer lucky right I was next to him at some point okay and you testified on Direct that after you saw a a scared look in Sergeant Johnson's face that's why you decided to use the taser that was your testimony yes but you also told Dr Miller that you don't know why you decided to use the taser right I haven't seen his report would a refresh a recollection to see his report yes please may approach you may do you have a chance to look at that Miss Potter yes and did you see the portion where it explains when asked by this examiner why she decided to draw her taser officer Potter States I don't have an answer my brain said grab the taser you recall that I don't recall it but it's in his paperwork so on April 11th you reached down and Drew your weapon right yes and you said Taser Taser Taser so officer lucky and Sergeant Johnson would disengage right yes and they did disengage didn't they they let go of Dante Wright and step back according to the video and after you shot Dante Wright you said I just shot him I grabbed the wrong gun and I shot him I'm going to go to prison and I killed a boy you said all those things right I don't remember Us in the video that's what you said right yes and you said that there are a lot of things that you don't remember and that on Direct you testify that your memory came back when you saw your husband that day but didn't you tell Dr Miller that you remember seeing the gun in your right hand you said that right I don't remember my interview with him I was distraught I wasn't in a good place after you shot Dante Wright you didn't behave like someone who had just saved Sergeant Johnson's life did you I was very distraught I I just shot somebody I've never done that well you never asked our Johnson if he was okay right I don't remember the conversations you didn't check in on him at all right I don't know well you saw the video when Sergeant Johnson fed you the line that guy was trying to take off with me you didn't bite right you didn't respond to that at all did you the video I was crying I was in shock and he was trying to make you feel better wasn't he well he didn't remember saying saying it right you heard that testimony yes and you don't remember him saying that right no and you didn't say anything like thank God I shot that guy and saved your life you didn't say anything like that right you didn't say that right no and you didn't ask Sergeant Johnson anything except to call Chuck right I don't remember what I asked him that would be on the video right yes you'd agree that as a police officer you have the duty to render Aid and communicate information to other officers right yes and it's part of your job to assist those who are hurt or injured true yes and to communicate to other officers what you know about a particular scene right yes give them whatever information you can to help them do their jobs to help render assistance things like that right yes but you didn't do any of those things on April 11th did you no you stopped doing your job completely you didn't communicate what happened over the radio right no you didn't make sure any officers knew what you had just done right no you didn't run down the street and try to save Dante Wright's life did you no he didn't check on the other car that had been hit did you that all happened just down the road from you yes you were focused on what you had done cuz you had just killed somebody I'm sorry it happened I'm so sorry Miss Potter from your reaction today and from reaction on your video you didn't plan to use deadly force that day did you no you didn't want to use deadly force did you no no cuz you knew that deadly force was unreasonable and unwarranted in those circumstances I didn't want to hurt anybody you didn't want to hurt anybody and you that's why you said I'm going to go to prison I don't miss Potter you know the difference between left and right don't you she that before it's AR it's not been asked the objection is sustained in the next clip before completing the Court's procedures Miss Potter is addressing the court okay Miss Potter would you like to address the court please go to the podium and you may remove your mask to the family of Dante right Miss Potter addresses the court and talks to the family of Dante the boy who was killed she apologizes for her mistake and is seen to be drowning in emotions of Sorrow grief and guilt she goes on to express herself to his family telling them how broke she is over this incident I am so sorry that I brought the death of your son father brother Uncle grandson nephew and the rest of your family to your home Katie I understand a mother's love and I am sorry I broke your heart my heart is broken for all of you earlier when you said that I didn't look at you during the trial I don't believe I had a right to I didn't even have a right to be in the same room with you miss Potter continued while weeping and told the family of Dante that she is guilty of what she has done and she prays for The Departed soul and his family and hope for forgiveness as forgiveness is the path of kind-hearted people I am so sorry that I hurt you so badly my heart is broken and devastated for all of you I pray for Dante and all of you many many times a day he is not more than one thought away from my heart and I have no right for that for him to be in my heart I do pray that one day you
