on March 10th 2023 in Marshfield Wisconsin officers received a dispatch call to a local residence concerning a reported disturbance between two adults the complainant informed them that their parents were engaged in a dispute with items being thrown inside the residents sounds like f Mr your hands man hold on stop keep your hands out of your pocket stop I'm fine hey hey he no when I say stop your hands pocket your pockets calm down you don't put your hands in your pockets after I told you to F I am fine I don't know what you're reaching for now roll I was trying to over hey calm down you're entertained well for what because you won't keep your hands out of your pocket fine hey I just watch my hand all right please please please let go over this hand just relax your hand but I said you keep walking at me and then you put your hands back in your pockets and I have to push you away from me you're going to go to the ground because I don't know if you're trying to hurt me well I them in your pocket weon is that's why you get I told you twice yeah in in the matter of two seconds but it does matter when I told you to stop and had to push you what's not trying to create when you find him can you for yeah because I'm trying to explain what I'm saying obviously you don't because you're still detaining me because I was trying to light up a cigarette deal you're in handcuff right now for our safety when you can calm down and show us that you're going to be reasonable shut the up and I will be reasonable we're just going to get a return making sure warrants or anything like that if that's the case and you going to keep saying like this we'll take those cuffs off okay do you have any weapons Kyle nope knives nothing like that nope I have my cigarettes I have my that with absolute sobriety as a bond condition due to an incident 3 months prior understand your guys' point of view put your hands up okay I it was very Bang Bang we're just deal with an intoxicated guy who's kind of we're saying I'm not intoxicated and I'm fine you are absolutely intoxicated smell it on you well just because you can smell alcohol on me doesn't mean I'm intoxicated you're also having trouble standing and slurring your speech so no it's stress of the situ PBT for us I no because there's no reason for I'm get a very strong order of alcohol coming off your BL well yeah I just had a drink but that doesn't mean I'm intoxicated last time I was put in cffs was because I was having a seizure and there's a current criminal judge lawsuit going on because of that and then eventually he started throwing stuff so okay you're on felony bonded with an absolute sobriety restriction and I am absolutely sober so you're not I am so whether you believe that or not is on you but I am sober this has nothing to do with me so I really don't understand why I'm in cuffs you have a felony case that requires you to be absolutely sober which I am you admitted to drinking clearly you can debate your side um but you're currently handcuffs for the for the bail jumping violation you were initially in handcuffs for our safety however that is now have evolved into US finding that you are violating you you're looking for loopholes you put me in handcuffs there's no reason to continue to detain me so except for probable cause for the bail jumping violation for what I don't know how else to explain it to you like I have have twice now take me out of these handcuffs am I under arrest yes you are for what bail jumping I am absolutely sober so okay every time you speak to me and that waft of alcohol comes off your breath into my face I don't know what you're talking about like I said you're under us for the tail jump not under arrest for anything I did not do anything wrong what and resisting at the hospital he was charged with felony bail jumping resisting or obstructing an officer and disorderly conduct he was later found guilty of resisting and disorderly conduct and sentenced to 2 years probation as well as 30 days in jail
