Deputy Duckworth was dispatched to see about a disabled vehicle in wallworth County Wisconsin she saw a vehicle in the middle of the road with the engine and lights off when she approached the vehicle she saw a man who was lat identified as Travis asleep in the driver's seat Travis seemed to be pretty dazed at the time and the officer immediately began investigating the peculiar situation hi can you roll down the window I'll come around okay oh you found your keys okay okay yep awesome all right hi Deputy duckor from our County Sheriff's Office the reason I'm stopping out with you is you're in the middle of the road hi hi you got your license on you sir I do where are you headed today hey Travis yep where are you headed today um to work where is work um here where's here um BL Wisconsin BL okay what do you do for work um I'm a milre you're a what a MBR a mill right yes what is that what is that um I I work on Machinery okay Travis you still live I do okay what's your phone number for you okay uh what are you doing in Belo here um we're going on a solar farm a solar farm do you know where that do you know the address of the solar farm I do not you don't okay where are you coming from um I I I don't know you don't know no okay you don't know where you were a couple hours ago no okay how much have you had to drink tonight um I don't know you don't know okay well I can definitely smell it so can I get your keys sure and take them out of the ignition they're not in it how do you how do you start your car uh push button okay you don't have so the keys are somewhere in think it is right now um I don't know you don't know you don't know anything or you don't want to answer any of my questions nope no okay cool if you want to step out with me then we're going to wait for my partner I'm going to run you through some tests um I don't want to do any tests you're refusing everything mm okay cool then you can step out with me sure all right you can step to the back of your truck yep all right Fe since you're uh refusing to do any of my testing put your hands behind your back you're under a rest Ro I'm going to take off your watch cuz I don't want to no it's fine you can leave it on want to take it off yeah having a hard time fitting the handcuffs around the forearm I'm just going to use two cuffs just cuz it's uh your shoulders are a little broad so it's more comfortable for you okay all right how's that are they too tight or anything no okay 577 Travis was very clearly Under the Influence so the deputy placed him under arrest after this she waited for her partner so that he could search Travis before they transported him to wallworth county jail all right TR so I'm going to have you sit back here by my car going to have my partner search you and then um we'll go from there can you just search him for me I love to so this is Travis you you have an envelope or something you f s um yeah it's in my car [Music] y yeah [Music] do you need anything from your truck it's going to get told [Music] otherwise take another okay I got you your phone watch and keys Travis was then transported to Aurora Lakeland Medical Center for a legal blood draw hey Travis I have a warrant for your so I don't consent to any Searcher seizures no it's a warrant so you don't have a choice so you can either do it willingly or easily or I will get a couple of my deputies over here and we'll force it nope 577 I'll need a couple more units it's going to be a force it's illegal what you're doing it's not I have a warrant signed by a judge it's illegal no it's not yes it is despite the warrant Travis wasn't at all willing to allow a sample of his to be taken in case of resistance from Travis Deputy Duckworth called two other officers so that Travis could be easily subdued I'm going to make this very clear to you if we have to hold you down in order to get this from you you are going to get another charge obstru obstructing or resistant right y I don't consent to any searches or seizur you don't I don't need your consent I got it sign by a judge you'll get your copy when we're over at the jail so are you going to do this the easy way or kind of the hard way do you want a second charge or just the one charge right arm or left arm or are you going to make us choose no okay absolutely not well it's not up to you anymore why are you pressing against my here oh because I've been bitten many times before and I don't feel like getting bit because you don't want to am I biting you I didn't say that I said I've been bitten many times before you've like an adult exactly and let's go you had a choice and you made one so we had to force it Force what the blood draw the blood draw I don't consent to any search and need need your consent that's what the judge was for mhm where are my glasses at they're in the front seat watch your head getting in [Applause] after the blood test it was confirmed that Travis had been operating with prohibited alcohol concentration in Wisconsin alcohol concentration needs to be less than 0.08% for someone to be allowed to drive Travis was charged with a third offence operating while intoxicated and a third offence operating with prohibited alcohol concentration with a general alcohol concentration enhancer Travis was found guilty of operating while intoxicated while the other charge was dismissed but
