go down with the fight what did I get hit with on October 22nd 2023 in barbou Wisconsin officer Nick was on a night Patrol when he noticed a car without any rear lights on and decided to pull the driver Dustin over and what should have been a small issue soon turned into something much worse and it's my grandma's car and the lights here I'm used to a 30-year-old truck where it's pull out and out you know this one yeah you know it's real uh real tail lights right where y that was that was the problem yeah so um okay where do you still live at terton Road uh no it's 304 Hill Street is that what you're heading to Hill Street yep uh Rock Spring wisc Rock Springs okay what's that uh package of cook is that just a regular package of cookies or that like can I look at that oh no it's okay I didn't know if it was like the Delta eight stuff whatever where where you coming from uh I just coming down uh from my sister's house here uh what was it West Street okay how much have you had to drink today nothing I can smell alcohol how much have you had to drink today I need you to be honest with me right now nothing okay can I have you step out of the car then for me no this is where we're at right now okay I'm I'm I'm detecting the odor of alcohol your eyes are watery all right you were driving without your lights on also epilepsy I'm asking you to step out of the car now no okay you refusing to step out of the car then I need you to step out of the car refusing to step out of the car you're refusing to uh can I have your keys to the car uh yes you can it's not too late to salvage this you can step out of the car and end this now ni close Okay that's that's the right move man okay do you have any or anything on you actually let me check quick no nigh Pock no no can I smoke cigarette or no just we can do that a little bit here can I take your your can you turn around for me can I just verify you have no weapons on you can I search you real quick yeah you're fine actually coming from coming from my sister's house and where we're at is I wanted just verify that you're safe to drive the car I can list out the reasons again why I think that is reasonable to do that well the only reason you had was for the lights which it's my grandma's car I'm they used to it I you drive a 92 Ford Ranger you can check my insurance on my phone if you let me grab it I'm not I'm not doubting that but this there's no lights right your eyes are looking bloodshot and watery to me I'm I'm smelling alcohol coming from you I want to give you the benefit of the doubt and make sure that you're safe to drive the car okay I would like to do some exercise out here to to verify that is that something you're willing to do no if you're not impaired you'd be on the way on your way in about 15 minutes I don't trust the impairment test at all unfortunately would you be willing to do a breath lizer then no okay I'm going to place you under rest for no I will not do that either not place your hands behind your back actually I'll do the I'll do the walk put your hands behind your back good flip over hold up you switch sides actually no 229 suck we have one resist I'd rather walk that's fun shut up roll over sorry a we going my head get his hands that's a felony buddy at this point due to the scuffle Dustin had managed to injure officer Jon who now had a gash and was bleeding from the forehead something noticed by Sergeant Scott good I got H you just make sure taser batons heavy step it up you see what did I get hit with I don't know him I think let's give him up a little bit you injur bud you injured anymore make sure we got it Nick you got your taser everything taser for radio loose keep them there till find just uh put my glasses in someone's car sit up to your butt move up to your butt right there all right man holy what happened to you I think you know you smash your face on the ground that wasn't me that was him stand up stand up can you least turn the lights off my grandma's car it's not my car it's my grandma's car you don't care whose car it is let's have them sit in the car until EMS gets here to take the pros though I'm not sure they actually went into them anyways no they didn't hang on hang on hang on both probes are out I did three knee strikes to him at least I think I broke his knee yeah not good crack so when I went down to the ground to control his legs sit down no I'm good sit down we're going to make you sit down I'm good actually God how back down down Mak me see down down take down the lights down the lights are making me see thinkk he season I don't know if he's faking or not position not set him up a little bit R over position roll in the recover the officers then waited for paramedics to arrive and find out whether Dustin really was in a seizure or not okay huh all right you all right okay I'm not cop me and you okay I don't got a problem with you don't have a problem with me okay okay you want to go up to the hospital all right right now take a seat right there we're going to go get our C okay spin around towards the door all right okay get I was going to try to say we should do oh that word I couldn't think cuz I was I was about to go wrap his arm my arms around him and then start pulling him back like that but he just went down in front and then he had a really good platform that we weren't able to break have I don't know where it went I got it once detained Officer Nick would drive Dustin to a hospital where he would be submitted for a blood test meanwhile after being granted a warrant from the judge Sergeant Scott searched Dustin's vehicle where he managed to locate three Bud Light cans under the passenger seat still with some liquid left at the bottom indicating that they were relatively fresh and that Dustin had obviously been lying he wasn't tasting I I drive stunned him I think that's going to um my thing is he's been super combative I think if we take him out the handcuffs he's going to attack us possibly you guys too maybe you cuz you pull me out of the car [ __ ] is there any way you can we just can't we have to be able to do an AKG to clear them and that's all the stickers and on the chest and can you let um Sergeant Smith know that it's going to be [Applause] can you secure that arm let's take the hoodie off lean forward just take one out you do that arm in there young man there you go thank you yep that was pretty tight I'll put it on a little looser I appreciate that right there once the blood sample was obtained the alcohol concentration was found to be above the legal limit of 0.08 coming in at1 183 G per 100 millit Dustin would be issued citations of ow resisting arrest and Battery to an officer and finally driving without proper lights
