I'm I'm literally just asking you to get out of the car so I can assess some things. We're not even at that point. So, your brother's advice is good. I would exit the vehicle. If you want to FaceTime him, that's totally fine. All right. Come back here, please. Thank you. Come back to the front of my car. Okay. You can FaceTime your brother Ryan if you want to stand right here. Oh, I don't know who it is, but you can FaceTime while I ask you some questions. No. Okay, you understand that Wisconsin driver's license with a driver's license you're required implied consent as part of your driver's license. You understand that refusing field sobriety tests I just want to make sure you understand that you you are refusing standard field sobriety tests for an OWI investigation. Yes? Is that a yes? So I'm only talking to you or what? You would tell him that you're not answering any questions that I'll allow. I'm not talking to you. Okay, face the car, please. I'm going to get arrested then, baby. please. Place your hands behind your back. You can put the phone right on the hood. Don't resist. Just let him do what he's got to do. I love you, though. Thank you. I love you, too. Place your hands behind your back. Okay, have the officer tell me where he's taking you so I can get you. He can still hear you, though. Yeah, I'll talk to you in a second here, sir, if you want. Okay. Okay. Do you have anything illegal on your person? I'm going to search you. You're in the custody. I just want to make sure I'm not going to get pricked, poked, or stabbed by a needle or you have something that you're not supposed to have. You bring it inside to a jail or anything like that, it's another felony, so. Okay. I'm going to take that as a no. Yeah. Oh, he hung up on you. Maybe not. I don't know. He's fine. He's Regardless, he's fine. Put it at the bar. I just need to know where you Throw it away for all you care. I was never telling you to smuggle this. I'm trying to go home. Yeah. Ooh. Guess what? I showed up with money. Yeah. I never do. Okay. I never leave the bar with money. No. All right. Nothing stuffed in your bra, then? No. Okay. Uh try to click on your brother here so he can see you. Or your boyfriend, sorry. Can you not put labels on I think you said boo, so I'm just going to assume that's boyfriend. No. Okay. That's an assumption gone wrong. get your screen on, so as as at this point she's been placed under arrest for operating while intoxicated. We'll do some paperwork, and then at the end, if you're willing to be a responsible party, she'll be able to be picked up. Um I assume she has your phone number saved, so we can probably call you when we have a responsible party portion figured out. As long as she continues to cooperate, she will not go to the jail. All right. she can't I guess he can't hear her so. Who's done? All right, well we'll go over here. Brooke, I'm going to search your car as well. I just want to make sure there's nothing illegal in there in your vehicle besides what you had on you. 35 and over. Brooke's car was searched, but nothing of evidentiary value was located. Hey, is your address on your driver's license correct? Nope. No, what's your address now? Oh, that's my boo. That's boyfriend? No, that's my boo. Boo, okay. I'm assuming you're Yeah. Let's listen in on the road, yeah. Yeah. I appreciate you talking her some sense into her so we didn't have to drag her out. That was very very much appreciated. She's been placed under arrest for operating while intoxicated. I'll do my process um and as long as she stays cooperative at this point, she is going to be released to a responsible party depending the results or depending the the end of it. to the police station and do that if to go we I have to do some forms and potentially go up to the hospital. One thing though before we actually get the tow in route, do you want to move her vehicle off of the roadway? Yeah, she literally just Do you want to take care of that? Yeah, I We'll have you actually move the vehicle right off the roadway over and then um she has your phone number, we'll give you a call when ready, okay? Okay. So I could move the car right now? Yes, and I'll tell you she's being placed under arrest at this point right now for operating while intoxicated and she's either going to be arrested criminally for the uh um resist or obstructing or just cited for it, just depends on on the end. So we're on record that she asked for an attorney. Cuz I Yeah, I'm not questioning her at this point, yeah. just I'm just making sure we're all on the same page here that she asked for an attorney or sure. Yeah. Okay. You've been her you've been her legal advice since she's been on the phone with her so her been on the phone with you so I don't know where her phone is, but it's still alive right now. It's right here. Do you want to take that? Do you should I ask her if you want to grab that? I think she'll need it if she wants to call you from Yeah, she can have it. Okay. All right, then we should be good. We're actually probably going to go right to the Tomah Health here depending on how long this process takes and then from there she'll probably be released from there. From the hospital? Yeah. Okay. From Tomah Health. All right, then I'll do something. I'll wait for the phone. Okay, sounds good. Thank you. see you. Brooke was taken to a nearby hospital for an evidentiary blood draw. The results indicated her BAC was 0.163 at the time of arrest, over double the legal limit. Half an hour. All right. Citation. I should print you one more thing off so that you it in there. I got to I got to explain this with the law. So, June 21st is court date. Yes, you do have to go. It's on via Zoom. 500 bucks. All right. There's a statute for operating with a restricted controlled substance. There is also the 341 15 3B, the illegible license plate. That's all in there. Also, sorry. Are you having fun? Do you want me to explain this? Yeah. Okay. Here's the notice of intent to revoke your operating privilege. That's all explains everything you need to do and the process going forward with that. Also, here's a copy of the warrant signed by the judge just so you have that for your records. I'm going to print you off the citation explanation sheet just so you know where you need to go for the court dates cuz it's on via Zoom and I think it They don't have a court house in Tomah. No, it's not. It's via Zoom. COVID messed everything up with that. So, here's all that stuff. You want to put in this bag? I'm going to print you off one more sheet. Otherwise, Otherwise, Hold on. Jeez Louise. Hold on. Oh, oh it's fine. All right. Last one, this just explains where you need to go in regards for the court date whether or not it's mandatory, which this one is. It kind of shows you the Zoom address and stuff. If you want to refer to that citation in regards to the statutes, please look those up so that way you know. Do you have any questions for me? Do you have any questions for me? Uh once you saw the registration, was it still a legal traffic stop after that? For sure. You can still identify and ask for I I asked for the information and then when she showed the signs of impairment, it's still a valid. All right. Those are That's a fight for a different day.
