Marshfield Police Department officers Josh and Brian were dispatched to the scene of a domestic disturbance upon arrival the officers located a woman identified as Tony walking away from the [Music] scene police officer stop police officer stop turn around for me please hello he what's going on nothing don't say nothing well I'm walking I mean what else okay well you're noticeably upset we got a call I'm upset I got pushed in the wall by my ex so when I say what happened and you tell me nothing that's why I say well don't tell me nothing okay well I'm not trying to not tell you nothing where's your ex right now I'm scared I'm scared that's why I'm going home okay well I went to go see Jim he was up at 1:5 te uh West daggy he lives upstairs and I was there for him we went to the bar last night and he was feeling he died like 3 days ago like for 2 minutes and he came back and then he was at the bar I saw him at the bar and I just wanted to go check on him again okay and then where is he right now where's the individual that shoved you right now he's at 1:5 West Dy that's my ex and what's his name Z I do not want to go to J right now I'm just trying to uh if you want to make despite initially denying any incident Tony revealed her account of a heated altercation with her ex-boyfriend which escalated into a physical confrontation involving multiple parties okay so let's start from the beginning here okay you went over there at about what time today about an hour ago an hour ago okay and you went upstairs okay and and walked me through what happened I okay first off I had no contact with them like I did not knock on the door I did not say okay my baby daddy and his friend that's his name Nelson he shoved me temp So when you say you had no contact with them are you referring to physical right but who was all there when you went upstairs it was me and Jim the the man that what's Jim's last name I don't know his name is just Jim okay okay so you're there just answer it answers it and then that's when they when you say they they busted in the door who's who's they uh Zach and Nelson okay Nelson's standing at the bottom and Zach comes up and he was like what's going on and then he wants a cigarette from Jim because Zach's broke he doesn't have job okay so when you say he busted in the door clarifi did he actually like kick the door in or forc the door in just open it and kind of he he he came in on his own okay so he didn't break anything or kick the door down he still entered without sure permission okay okay so he's wanting a cigarette yeah and so he comes up and he starts with me with Jim being like why is she here and stuff it's like it's not of their business sure like I care about Jim like Jim is technically my son's Grand you know yep grandson so like I was out at the spot with him uh you know last night and I was like Jim what the are you doing here like you just like you shouldn't be drinking smoking and so I just came over tonight like honestly I'm lonely in there okay so let's let's get back to he's stting with Jim about why you're there how did it turn physical what happened there it turned physical because I got in I got in Zach's face like this and then he pushed me okay and then there's a hole in the wall okay so when you got into his face wh why did you do that I got into his face because he was he was approaching Jim saying why do you have her here d d da and then I just felt like I needed to stick up for myself okay so when you got in his face did you make any physical contact with him at all did you chest bump him did you nope I just got up in his face I squared up and I was like this I was like you don't have right to be in here you don't have right to just walk in his house like Jim is just a doormat okay so I just felt like I needed to step up and be like like why are you even making this an issue okay all right so he shoved you and then what happened he shoved me I honestly don't know I just know he [ __ ] did you did you get physical back towards him no was there a lot of yelling and screaming going on there was a lot of yelling there was a lot of screaming I have a mouth on me you know I I I hurt people's feelings okay um so let me ask you this you guys have a child in common correct yes we how old's your child he's Bor okay you guys ever lived together yes when's when when was the like when did you move out I want to say four years ago four years ago okay okay all right and have you guys had much contact with each other between the time you moved out and now yes uh mostly court ordered and uh through you know we can talk to each other e did you guys ever get back into a relationship after you moved out like a romantic or like structured relationship no okay what's your phone number 715 okay and when you guys lived together where was that at is it here in town right there right there okay Cleveland up and you said that was about four years ago though that you guys moved out yes sir okay um so would you how would you describe your relationship with him prior to this prior to this happening I mean did you guys get along did you guys spend time together did you guys hang out spend the night at each other's houses anything like that I was just there yesterday okay you know we had like twice like yesterday you did I think I think it's it's a thing sure you know I I guess I'm just trying to establish what your relationship with him is at this point turbulent is it just friends is it more than friends but maybe not boyfriend girlfriend it makes a difference on potential charges that could come from this what I'm trying to establish is if this was a domestic incident okay you guys share a child in common which fits the criteria for domestic but there's also a bunch of other criteria that goes into this okay and it makes a huge difference on whether I'm mandated to make an arrest or not if I issue a citation if we just let bygones be bygones it makes a huge difference so I have to gather all that information and that's why I'm asking I'm not trying to pry into your personal life okay get a bit so um let's let me ask you this in the last four years There's No Label I guess yeah in the last four years have you guys kind of off and on been with each other is there any time where you guys have like spent long periods of time like spending the night at it one another's houses like maybe you you crash at his pad for a couple weeks in a row and then go back to your place nothing like that no okay no do would you uh does he have any possessions at your place or do you have any personal possessions at his place like toiletries toothbrush anything like that no no okay all right and what what was your apartment number you said uh upon further investigation it turned out that Tony and Zach were in an argument and Tony slapped Zach in the face and pushed Zack when Tony again lunged at Zach he defended himself by pushing Tony away police clearly showed Tony as primary aggressor her false claims quickly unraveled under the weight of the evidence leading to her immediate arrest for her actions okay you're under arrest for domestic DC domestic battery and possibly disorderly conduct as well um she's not she's not being cooperative at all uh do you want to take a glass of water first and then maybe well when you stop please okay you've been arrested for a domestic abuse incident unless the victim signs a written waiver during the 72 hours immediately following the arrest you're required by law to avoid the victim's residence Andor the residence temporarily occupied by the victim to avoid contacting or causing any person other than a part's attorney to contact the victim contact includes contact at work school public places by phone or in writing if you intentionally violate these requirements and Provisions you are subject to a forfeiture of up to $1,000 if you commit an act of domestic abuse during the 72-hour period and the ACT cons constitutes the commission of a crime the penalty increases from a misdemeanor to a felony your release is conditioned upon your signed acknowledgement that you have received and understand these requirements and the consequences of violating these requirements it is also conditioned upon your posting the required bond for the offense of which you are being charged if you refuse to sign this notice you will not be released from custody until 72 hours after the arrest the victim has not presented assigned waiver to the agency prior to the time of release battery disorderly conduct misdemeanor B and resisting or obstructing an officer misdemeanor a with a repeater modifier the first two charges resulted in guilty verdicts due to no contest pleas while
