Michael genovesi observed a vehicle speeding and followed the driver Cody and his girlfriend Kayla noticing the deputy immediately threw a cup of ALC out the window stopped and attempted to switch places leading to the following incident hey show me your hands a lot of movement in the vehicle I got one show me your hands roll down the windows and show me your hands that can work that way for City tell the driver roll down the window and I saw you were driving roll down the window and stick her hands out the window you in the driver's seat hands out the window what did you throw I saw you throw out the window right there don't lie to me you do not lie to me what's your name Cody okay I'm just waiting for another Squad to get here and then we'll talk things out nope I you guys are moving around in the car you're doing weird not putting my down not until I get you out of the car and in hand cops that's when I'll put my gun away Kayla I'm going to have you get out walk slowly out a bag go right out the window on the corner over there okay they pull in here and I can see them climbing around I saw him driving when they were coming so you need us to go find whatever's yes that right at as they turn the corner here so on the west side of uh F should be on that southwest corner this is yeah it's booze is it yeah it's all W what up quick thing for you yes sir anything that's in that car is mine okay I appreciate that you understand that I understand she did nothing wrong okay okay why did you guys switch seats dude I saw on the other way on 11 doesn't matter what you say okay I know I didn't I don't drive for a reason same way I'm telling you everything that're checking further but okay yeah you can smell boo in a car it's like beer I'm on probation too so you guys can't hold me unless I'm okay well we're investigating a crime so we can absolutely detain you he's on probation so we can't hold him ohly yeah heard that before uh what are you do beond switcher right now we just switch each but she doesn't deserve whatever in that car I'll tell you that right now you've all been drinking I definitely have I've been drinking more than she has as why she was don't take her for obstructing they' both been drinking so oh oh I would say I would say obstructing all day for playing the game of jumping around and trying to find you know okay so I'll just need we're going to go do some standardized field sobriety tests does matter I'm not running so if you weren't driving believe it or not you have it on dash cam footage I have it on body cam footage we don't have dasham body footage to my car and I was I love body go ahead what you chargeing tell me now while we're on camera in your car right now I understand it right now for sure okay never mind yeah never mind I'm trying to tell you to keep talking over tell me because you just put me in a bad spot didn't you same when you're taking both of us to jail and if it hurts DUI aren't you it's a tracking violation dude get the out of here with that we got five kids together you're going to ruin her [ __ ] but am I being arrested for or uh operating after revocation driver's license alcohol related offense I know all wasn't sit in the driver's seat so tell me differently CU you didn't catch me in driver SE we're not fight you with this dud I win all day long we're not coming to an agreement here so it's what agreement you want other than she was driving everything in that car is mine and I'm on probation now take the hit for that she doesn't need to take a hit for having to drive me home that's my you're putting her in a [ __ ] spot I'll take the hit from everything but I wasn't driving dude that's what I'm trying to tell you unless you're charging me I have to be released so what are you charging me for operating on probation I give you a fair warning before you even asked the state of Wisconsin you're supposed to good new cop right you're being arrested for operating after rication of a huh you're being charged with operating after reation driver's license we're going to go back to the jail I'm going to ask you if you want to participate in standardize field sobriety test you can't cuz I wasn't drive so then you'll be placed under arrest for implied consent so I'm placed under arrest anyways unless I'm sitting here in custody which is different cuz I'm driving to a destination that is sent to me which is different from custody than being in custody I'm going to jail for what why am I going to jail officer I've explained it to you s investigation that you have to figure out on your own not something that has to do with me and I'm on probation I'm not in trouble cuz I didn't break no laws did I correct I didn't unless you charge me what am I cont is it you need to tell me while we're on dash cam footage I've told you about 18 times on body cam tell operating after revocation of driver's license due to an alcohol what you say operating after I wasn't D passeng yourh related it doesn't show anything I also suspect that you're impaired right that's weird eyes are different from a camera aren't they you can only say so much you until soon as I called him tried to tell him dude in the car told me no and then he swapped my phone from me fast I could say swap bro that's like and my voicemail you know what I'm saying first thing I want to do is call my cuz you know I'm not like that no more dude I don't want problems I want [ __ ] like this I got five kids now dude I got no problems in the world no more other than those kids bro I was just trying to take my girl out to do some fix show her some good times good here you know what I mean mhm they got no problems man there's too many kids I have to worry about my own problems like I was trying to say man I know for a fact I can't be charged with anything unless I'm actually charged from the officer that arrested me so what am I being charged with again drinking and driving I think so yeah how how is that though body footage right so his was then drawn and he was booked into wallworth County Jail however Cody was found guilty of fourth offense OE resisting an officer and keeping open intoxicants in a motor vehicle he was sentenced to 2 years in state prison and 60 days in the local jail having an ignition interlock for 3 years and a lifetime revocation of
