so it's called the standardville sobriety test okay so we do a horizontal gaze in the Stag M and then we move on from there to give you the full opportunity to make sure that you're all right to drive if you are all right to drive I'm just going to find you for speeding and not having your driver's license and you'll be on your way okay so I just I I have two there they're by nit okay scientifically appren test that we that we have to do in a certain order yes sir to make sure that everything's all right okay y okay so go ahead and step on my light and face your vehicle on your toe and your hands at your side so right foot in front of your left and your hands at your side right foot in front of my left yep just like the way I am and then yeah and then your hands at your side okay so you're going to stay in that position Gabriel tell you tell you do otherwise okay so when I tell you you're going to take nine heel toe steps from where you are towards your vehicle okay all right yes sir you're going to keep your hands at your side you're going to look down at your feet you're going to count every step as you take it yes sir once you reach that ninth step you're going to plant that foot whatever one you land on you're going to turn around in a series s small steps and return back in the same manner okay look at me ear this is the way it's going to look okay watch me this next part Gabriel you're going to take a foot of your choosing either your right ear left foot whichever one you want you're going to hold it parallel to ground 6 in the size of a coat can okay at your side top one corner okay I'm going to show you how to do it okay you're going to keep your hands at your side both legs straight St at the tip of that foot that you rais you're going to count out so I can hear you okay 1001 1,2 13 1004 1005 until I tie you to stop okay so you stay you stay counting like that it's going to look like this okay so whatever foot you choose to plant and then both legs straight just like this hands at your side stare at the tip of that foot and count aloud 1,1 1,2 13 1,4 1,5 1006 before we start this that um I do flooring for a living uhhuh this kneecap is shifted over this uh ACL or MCL one of them is torn okay okay so I just need to try it and then we'll move on from this okay I got to do I got to do things in a certain order figured okay that' be better before I going do this one though because this this me I asked you before you started you said you were good remember to drive no not I didn't ask you if you were good to I walk turn this okay well I did that before okay go ahead and start whenever you're ready that one I I like I do think this one's okay whenever do you need any more exclanation or anything like that absolutely Yes actually I need you to um okay so both legs straight hands at your side you're going to hold that foot six in parallel to the ground like that and count loud and count in 1000s 1,1 1,002 1,003 continuously until I tell you to stop okay any questions no go ahead and start whenever you're ready this one the best one 1 1,000 2 1,000 3 1,000 4 1,000 5 1000 6 1000 7 1,000 8 1000 9 1000 10 1000 11 1000 12 1000 13 1,000 14 1,000 15 1000 16 1000 17 100000 18 1000 19 1000 20 21 1000 22 1000 23 1,000 24 50006 okay go to theide come over here real quick okay so you said go to the side right there face me face me okay so you said like your knees are messed up or whatever okay so I want to give you the benefit of doubt you're an educated man right you had high school right I'm not trying to assult you yes sir okay appreciate so you know your ABCs and your numbers correct yes sir okay so I want you to see your ABC is not sing them in order from the letter D to the letter s okay whenever you're ready D E F G H I J K L QRS okay I want you to count back first from number 79 to the number 64 79 64 7965 sorry 7965 64% 65 79 78 76 75 74 73 72 71 70 69 68 67 um 665 okay and then this is a finger dexterity test okay this is the last one all right so either you're right or left hand whichever one you're more comfortable with okay I'm going to show you I'm explain are you asking I'm right or left hand it doesn't matter whichever one you're comfortable with it doesn't matter if you're right or left-handed okay I'm going to demonstrate for you my right it doesn't it doesn't so either right or your left hand all right you're going to you're going to do it just like this one 2 3 4 yeah 4 3 2 1 that's one pass so 1 2 3 4 4 3 2 1 so I did two passes start with that so just like this 1 2 3 4 4 3 2 1 okay you that's a really tough one so I want you to do that three passes all right you want me to show you one more time yes sir so 1 2 3 4 4 3 2 1 that's one pass all right I want you to do that three times 1 2 3 4 4 3 2 1 1 2 3 4 4 3 2 1 1 2 3 4 3 2 1 yeah third one was that last one okay goad and turn around and B my vehicle put your hands under your back real quick okay so you're being placed under AR rest when driving one under the influence of intoxicating drug under liquor just hold your hand there you're a little bit bigger guy so I'm going to give you two cffs okay all [Music] right okay I'm going to read some more stuff to you and I got you have more [Music] opportun done that oh I know why got double I'll loosen it okay don't know how that oh my CS it double lock like on its own it's a so like right there it's a double lock so that it doesn't CLM down on your wrist anymore than it is yeah so I'm going to loosen this one for you cuz it is a little bit tight okay okay so it's a double lock so it doesn't crimp anymore you know what I mean all right can you tell me how I felt so it's not pass your fails perform well perform uh poorly okay so you perform poorly with everything that's going on on there so everything will be on the report on there okay you can't tell me so we don't go over it on the side of the road it's no offense to you but yeah we don't horrible stuff that sounds so horrible man okay then need to give we're not completely done all right listen to me I'm about to tell you something important sir you're under arrest you're driving under the influence of intoxicating drugs and or liquor the New Mexico implied consent act requires you to submit to a breath test to determine the alcoholic content of your blood after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to a reasonable opportunity to arrange for a physician a licensed nurse laboratory technician or technologist who's employed by a hostile or of your own choice to perform an additional chemical test the cost of this additional test will be paid for by a law enforcement agency do you agree to take our test no I cannot force you to take our test but if you refuse you'll lose your New Mexico driver's license or nonresident operating privilege for one year if you are convicted in the cour driver you may also receive a greater sentence because you refuse to be tested do you understand actually I need to ask me more questions okay your right to speak to your attorney or remain silent does not apply to the requirement of New Mexico law that you take a breath test you now agree to be tested did it okay I actually want to ask you more questions what else you got um I'm my obviously somewhere I but I take care of my niece and nephew and I actually have [ __ ] was FD at 11: a.m. how old are is there any uh 13 and 15 is there any way I could [ __ ] get out of this and be at that [ __ ] so sorry about that but unfortunately you made the wrong choice you're not you're not no no no you're not and and you're and you're right about that so this is what okay so drinking and driving I'm not for it okay so I'm not sorry about that part but that decision but I am sorry that you're trying to take care of your your niece and nephew okay cuz I think that is adorable but you should taking the over or something okay you know what I mean yeah all right cuz you're you have responsibilities now right you're trying to take care of them right yeah so it comes with other stuff then see IFD wants to see everything else cuz obviously they weren't in a good spot to begin with right that's why you're trying to get up so you need to make sure that you you provide an even better spot it might slow down the process I don't know but I think I think you'll you'll still be all right in the long run family it dude they're all for family okay I didn't ask for all that okay I just thank okay go ahead and face I got to check your okay so your phone's going to go with you I'll let you use it like in an hour or so okay W matter and then also cigarette butts can I yeah this change back in your car um or do you want to take it with you honestly I don't want Mone all my car at all so unfortunately we do uh inventory this I all what videos you seen and all that stuff so it's not it's not like a search or warless search or anything like that it's just an inventory all that that's yours I'd rather not take all that change up to uh MDC but we can I don't that's fine but I can just put it in your cup [Music] but either way I I don't open your mouth okay so unfortunately when you get arrested we don't you don't have like certain choices okay so it's just inventory to make sure that your your valuables are there when you get back okay it's not for extra charges or anything like that if you have something so worrisome that's that is illegal no I just thought that my car was like sental person so once you get arrested you start you start using uh certain Privileges and rights okay so on there we're not searching it like pursuant to your arrest it's not for your arrest it's but if you already have me I just don't understand so it's for your valuable so we have we've had people say that certain things are missing from their vehicles after they get them back so we so all we do is we do we do like a a check over to anything that's worth anything that's of good value we note it on the tow sheet so that it's there when you get it back that's all we do that for okay it's not it's not for investigation to put more charges none of that stuff I don't want no one well I'm just let you come just us no yeah come on we'll just us notied yeah that's fine cuz I'm pretty sure okay now find back up a little bit more yeah we're going to take it with us we we'll take the change with us [ __ ] P my up slightly yeah just slightly whole thing you all that go and get in here godamn this is so [ __ ] hard yo so much easier ones in the front but I do appreciate the two cuups yeah it's uh yeah unfortunately it's our policy so some effort yeah no I appreciate it D you do God damn it see my glasses on this oh you good you got him on yeah okay push him push him up a little bit I'm going reach across here back a little bit so I can are they going to tell me more when I get there po finding of my testing is who getting take you or anyone I'm going to note it in the report that you you're more than welcome to request and read over [ __ ] so that's as Loose as I can get them but we we'll be at the office here short dude I'm going to get you in the office okay shortly so we can uh fix those okay just the office is just literally around the corner thanks dude yes you have one yeah I got you I'll bring the keys back to that other one did the same thing it was double locked it SLI yeah that's so weird i' never have never done that dude thanks dude yeah I appreciate you what's your name dude Allington than man hey nice to me we'll see you brother Ron you appreciate it [Music] 554 thank [Music] 54 71 1015 1047 by my watch of i s red at 005 uh verine okay [Music] [Applause] so there's just a tripod and like clothes there's just a bunch of trash in there dude and then he has like two packs of cigarettes I care deeply about um yeah um yeah we I didn't uh want to get in there and scratch up stuff will you tell the co up just the windows thanks brother good to see Meely not a lie r i don't make stuff up what I'm saying sir you got to help me what do you what do you need me to do brother tell me that's the arm Bas bam thank you sir yeah yeah I'm not trying to be a [ __ ] all right I got it I got my back got it got it no I'm not doing that I'm just saying SC the back just a little it's so [ __ ] weird you whatever so I'm not saying whatever I don't do that stuff I don't I don't don't don't make stuff up cuz I can't do that no I'm saying I don't you're saying you felt what you felt I'm saying I feel what I felt correct that's all I'm not there's no an I'm feeling no anos I know I [ __ ] up I know I was driving [Applause] stupid have a seat they do man but so like I take everything consideration look look look at my clothing now that I'm full you're hard work all day yes sir you're yes sir I was upset yes sir but that has nothing to do with I get that I get that that's all honestly I guess I'm I'm thirsty sir okay I'll let you whenever we're done with this yeah so I know you I mean I mean no animosity I mean not nothing towards you but I I this system is [ __ ] D but I was driving [ __ ] stupid so I'm not even disagreeing I deserve to be here I'm disagreeing with your assessment okay but I don't it [ __ ] me and my family and that's something I got to live with well I can't guarantee it but uh I don't even NBC they do do um like early morning ones too none of that matters so we'll get things done I won't I won't have you here very long so I'm already here bro yeah but I won't have you here very long maybe I I can't guarantee it again but maybe they'll they'll get see it's [ __ ] even worse it's [ __ ] yeah but uh maybe they'll get everything done quick you know no they won't sometimes they surprise you you know surprise would have been you let me go yeah but I can't do that unfortunately yeah cuz you have qu no no quota no I I you know your driver's license is expired yes sir October dang expired for a long time dude why because why the [ __ ] should I have to pay for driving these [ __ ] streets that I my tax pay for realistically really think about that asn't matter cuz driving is a privilege it's not a right no it is a right this [ __ ] country with driving is not a right traveling it's state laws orus federal laws which one do you uphold no sir no sir you don't no sir that was the wrong [Applause] answer yeah we have charges that can goap my hair we have charges that can goed swap my hair sir you uphold federal laws I want to be here sir I was traving on the road you have no right to no but you have every right [Applause] that's just I mean that's no I mean you're wrong it is okay I mean that's just me talking I already know I [ __ ] up so I mean kind of horrible I hear cop with that [Applause] have to all other things you the I already have no you haven't you actually haven't went over it so I perform partly describe yeah you want you want exact details but that's a I'm asking you was man what did I Dr yeah so I've already spoken drunk yeah so you have your niece and nephew that I'm sure care about you and they wouldn't want you to be wrecking hurting yourself or anybody else so that's why I CU I've had don't do that don't my story don't do that please I don't know your story but yeah that's it's tell good assumtion to make it's good assum I'm not assuming anything on your life you just did okay so I I do it so that the drivers themselves don't hurt themselves or anybody else anyone else I give [ __ ] about so that's where you're right other people absolutely wouldn't want to so but there people that care about you no sir you're telling me your niece and nephew don't care about you I do with all the time and they [ __ ] love their [ __ ] methhead mom and I [ __ ] have to spend thousands of dollars on them maybe they don't verbalize all the time te I [ __ ] I believe in that so much like one day and I [ __ ] always come to the conclusion like Rob resent them by the time they come to that conclusion I don't know it's weird it's weird it's weird you don't have any kids of your own no sir so having kids of my own I don't know I I I think uh I don't I I think that yeah my it's wearing and taxing but when they finally come to that conclusion I I think you'll difference is though they're yours yeah and I and I fight with people I fight with people over that all the time like they're not mine and I'm steal your blood I got my life to live my mom didn't give a [ __ ] about my dad didn't give a [ __ ] about no one give a [ __ ] about it nah that don't mean [ __ ] but having people it doesn't matter if they're blood just having people that care about you agreed matters agreed so it's it's tough and and I was out there J all thing tonight I know that I know that my only story was to fight for them I don't give a [ __ ] about me you lock me I give a [ __ ] is what it is you do painting or like drywall stuff I do tile flooring all the hard [ __ ] nothing remodels I just I just dude you got me [ __ ] up cuz I just finished a whole [ __ ] house St charged 20,000 for and the [ __ ] contractor said let me check my bank account and then call me back and I called me and that's my [ __ ] so I a lot of people lot of money and this happening so that's [ __ ] great dude get everything signed though like before you did the work yep yes sir yeah contractor I was there I'm my own business all this that but it's not like he want me the money the second I'm done you know but I will people so I'm [ __ ] that's so it usually works though to get paid when the job done that's the whole [ __ ] point I was ask that it's whole thing emotions that's why I don't agree with your assessment was emotions bro I [ __ ] up I mean I'll learn better from emotions alcohol ain't [ __ ] dude I told you what I drank the second I got off the car you made your decision the second I told you that come on let's be real netive no no sir people told me they drink before you say that all day I know the numbers I put my foot down on this that come on you get mad that I put it down on 9 and 13 I told you my knees were [ __ ] up that's why we did Alternatives you're mad at my eyes I look at my lenses look at my prescription I couldn't follow your [ __ ] eye I told you you kept putting light light M I told you that light I told you come on man I did not put it directly yes sir you put you've held your fingure by the life pretty [ __ ] long dude it's not nicing T I know I know it's human being test I know that they it's it's anagas test once once a human being test okay I'm showing you who I am show who you are I appreciate I there and also you said I get smoke I really appreciate that really really appreciate that and don't let me forget that I I probably I won't but we'll get that done like so when we're when I'm done here with the paperwork and we're heading out I'll let you smoke okay it's a long time dude it's not going to be that I'm going get stuff done quick long I these cops up once I'm done with this I'll let you use the restroom we and then you'll be one I got I still got to let the machine go through its thing okay it won't take much longer for this n no I appreciate you putting two G on you recognize that right appreciate that [ __ ] hurts dude yeah it's not comfortable but I'm not obviously yeah I think you're nice gu all that but your badge number all that will be on the report everything yeah I think you're nice and all that that but I 100% think [Music] you're unfortunately I'm one of those guys who has nothing but time beinged take I sped I [ __ ] up can you take we'll go up to MDC what's the paperwork um everything pertaining to your rest the what is that criminal complaint the citations the criminal complaint what uh so it's a legal document to book you into jail and that pertains of uh everything to your arrest the charges and what are the charges so drinking while driving speeding uh failure to maintain traffic that you were going when to catch up to you and you passed me too uh you you passed me at 92 fast were you going just be limit now what I ask 65 [Music] [Music] [Music] so as this is done I'll let you use the restroom and then uh get some work spaces yeah Clos work with i a lot of trash bro everywhere so I I didn't go digging around I just in sight point is my life there and you don't want to blow correct nope on the street what's that the way you've already been unfair with me why would I want to do that I'm not unfair at all not what I ask I treat treat not what I asked yeah so I mean I ask if you've been onfair with me I stated you have been and I asked if you already have been why would I want to do that that's what I asked you going to answer that yourself that's I already know the answer you can't T that's your own answer up I answered your questions assumption I know that no assumptions I ran through my investigation like I've done that's fine hundreds of times fine and you feel you do that as a cop but as a man you'll have to answer me to God I have no CLS with that I like that [ __ ] yeah I like that won't be all these little guys that matters all the little sins you did not the White lives the big ones won't be able to L it won't benefit us at all man let's not do that do we won't be able to at all think about it yeah you know but right now in life we're able to all day you're lying to me right now I mean I'm not lying to you but you we have our beliefs right I know [ __ ] you know what's going on but you're not able to admit it when you just admit it the same the same results going to happen it's very odd very odd this is always struck me as odd this whole thing you're civil servant you're here to serve me you think you're so we and and you're not my bad you're not that high you're not
