I live in a big ass house on my mom lives downstairs and me and my girl live upstairs. >> What's your address? Okay, this interaction took a completely different turn. Ma'am, the deputy asked where you were coming from. Not for the director's cut [music] of your autobiography. And that top was definitely not helping the situation. Listen, if you're so drunk, you can't control your swimsuit top. You can't control vehicle. >> Okay. Which direction is that in? >> That way. It's the last one to the right. I live on a lake. We live on a lake view. >> Miss, can you fix the top? I well I can I >> say 1012 Austin please. >> Yes sir. >> Just stand right there for me for a second please. I'm guessing alcohol was probably the least of her problems at that point. She was just acting sloppy, reckless, and completely out of control. You're that person. Can I call my lawyer? His name's uh David. He's the biggest boy in bokeh. Can I call him, please? >> Not right now, miss. >> Okay. Is that against my will or is that against your recommendation? Mhm. >> I am hurt about it because I have a daughter. >> Mhm. >> I have to go to all the football games. >> Mhm. >> And I'm scared. >> Officers may look at a person's coordination, speech, behavior, and other signs when checking for possible impairment or deciding if someone needs medical help. They may also ask about alcohol, or [music] other substances as part of that assessment. Okay. So, did you have any alcoholic beverages today? Did you consume anything? >> No. >> Nothing? >> Yesterday? Yeah. >> Yeah. What did you drink yesterday? >> Stop drinking wine 7 months ago. So, I had about four trillies. >> Porch release. What time was that at? >> 11 or 12? Like late at night. >> Okay. All right. >> I'm just being honest. >> Mhm. Okay. Um, >> if you're going to arrest me, I want to promise you one thing. >> Dit is my lawyer, and I promise you this isn't going to go well for anybody. >> Well, nobody said that you were being arrested. >> And it's not going to go well for me, but it it sure won't look good for you. So, I have some suspicion that you might be under the influence of alcoholic beverages. Okay. While operating your vehicle, so with that being said, are you willing to do some field sobriety tests? >> Yeah. >> Okay. All right. >> Are you going to arrest me? >> Well, are you going to perform the tests? Are you willing to? >> Well, there's Well, yeah, cuz I know I can pass them. But if I don't pass them, I am I going to jail? Well, we'll get there. Okay. >> Yes, I will. But I can't wear this. And I have a bait. >> Okay. Can you fix your >> Let's go through here. >> You can stay right there. >> Can we go to my house? >> No. Can you stay right there? >> All right. What do you want me to do? >> Say 10:12. Can you tell me where a shirt is in your vehicle? >> Um, no. Cuz I cleaned up my vehicle yesterday. So, I have shoes. A lot of shoes. >> She had been up all night drinking. Yikes. [music] This was embarrassing on several levels. And honestly, that was just nasty. The deputy was trying to keep one simple investigation on track while she kept starting five completely different conversations at once. The beach trip is looking less calming by the minute. >> There's no top in your vehicle at all. Okay, guys. I'm saying >> I don't know. Do you want me to walk straight? You want me to do cartwheels? What do you want me to do? >> Okay, >> I can do all of it. >> Just hang out right there for a second. >> You want to see a cartwheel? >> Miss, no. You want to arrest me and I promise you it's not in your best of trust. >> Okay? >> Cuz David is my layer. >> Okay? >> And all you cops, which I have a high respect for, um, he won't respect anymore. So, when it comes down to you needing him, yeah, that's not going to happen. So, what do you mind if you want me to walk straight? >> I would like for you to stand still. That would be great. You have a car? >> Yeah, like an FSFT card. >> Yeah. >> You're making a big mistake. >> Okay. >> You want to grab them? >> What would you like me to do to pretend I'm sober? >> Well, I would like >> You want me to walk? You want me to do cotwels? What do you want me to do? >> So, I'd like you to perform some tasks, but I'm just I'm just getting the card so we can read it out. All right. So, just stand by for a moment. Okay. >> Can I get my vape? >> Thank you, >> sir. >> Yes, ma'am. >> Is it okay if I get my vape? >> Uh, just stand right here for a minute. Miss, right? Is that your last name? >> My last name is And I think it would be respectful for me to get my vape. >> It would be what? During field sobriety tests, officers usually give clear instructions to check for possible signs of impairment. If following those instructions is important because extra movements or distractions can make the test harder to assess properly. This [music] exact conflict over roadside testing ties directly into landmark Supreme Court DUI proceedings like South Dakota versus Neville. You know, in those cases, drivers stopped under suspected impairment argued in court that refusing breath tests or ignoring field sobriety test directions was a protected constitutional right that couldn't be used against them. But the Supreme Court completely shut that argument down. The justices established that driving on public roadways comes with a [music] statutory obligation under implied consent laws to submit to lawful impairment checks. The court ruled that refusing testing or deliberately disrupting field evaluations triggers automatic administrative penalties and prosecutors are fully permitted to present that refusal in court as direct evidence of consciousness [music] of guilt. >> What respectful of you to let me get my vape? Cuz it's not breaking any laws. >> I go get my but as of right now we're conducting an investigation. you want to invest in investigation while I'm under stress. >> So, I find that to be, as my lawyer would say, >> not liable. >> Okay. >> I think that a beep is not a big deal. It's not illegal. >> For my safety, I would not like you to go back to that vehicle. >> Do you want to go get it for me? >> No, thank you. And there's case law that protects it. Okay. >> I'm calling my layer. >> No, no, no, no. You're not going. >> No, I am. I am. I'm >> You're not going back to your car. >> I am calling my lawyer right now. >> Okay. All right. >> I want to Now you're not listening to lawful command. Okay. >> Why? What am I doing? Cuz I >> I asked you not to go back to that vehicle. There's case law that protects that. And you're right to call my lawyer. >> You're disobeying a lawful command. All right. >> Cuz I have the right to call my lawyer. >> Not right now. You going >> Well, well, nobody explained that to me. >> Okay. We told you to hang out right there and you didn't. Oh, and now you're >> Oh, okay. >> leaning back to your vehicle. >> Do you know Officer Reie? >> I'm not sure what you're going to get from your vehicle. >> Do you know Officer Reinie? Can I call him? >> Can you stop? Okay. Lean against your car, please. Okay. Cuz you're falling over. >> I will doing over. >> Yes, you are falling over. >> I will do anything you want me to do. But what I would like you to do is I would like you to call my >> All right. Come back to my my vehicle, Miss. >> Absolutely. >> Thank you. Do you have anything on you whatsoever? Any weapons, any drugs, paraphernalia, anything? >> I have a phone that I need to call my lawyer. >> Oh, >> I I'm going to resist arrest. >> Okay. You're you're you're falling over. So, >> I'm falling over. Okay. >> Yes, you are falling over. >> All right. Officer Weenie, can we call him? >> No. >> Yeah, we are. >> Sit down for me. >> No, we're going to call Officer Weenie. I need you to sit down, David. >> I need you to sit down. >> And my mother. >> Okay. >> I will sue the out of you. >> Okay. Sit down, miss. >> Thank you. Watch your head. >> Hey, miss. What's mom's phone number? >> Who? >> Your mom's phone number. Watch. >> Um, no. I want to call my lawyer. >> Okay. What's your mom's phone number? >> I don't know. >> Okay. Do you have your daughter's phone number? >> It's my phone in my car. The vape [music] had officially become more important to her than following the officer's instructions. Your dad must have been so proud. Honestly, watching the body cam footage can show just how the whole situation played out. What a waste of a situation that could have been handled so much better. >> Okay, I'm going to grab that. Where is your phone? >> Um, in the front seat. >> Okay. Who has a 1015? >> Hi. >> Who has a 1015? >> Me. >> She's in this car. So, um, she is exposed right now. I have a shirt that is uh on the thing. If you could just put it on top of her, fix her. And >> I ain't fixing her. >> Not fix her. Put her shirt. I'll get your shirt. >> Hello. Good morning. >> Good morning. >> Good morning. >> It's a stranger. >> Call my lawyer. This is how they left me. I'm sorry that this isn't appropriate. >> Well, this is how you left yourself. No, I did not come in here like this. [clears throat] I did not come in here like this. Okay. >> When you sit down, your bandit rises up when you can't move your arms. >> Okay. >> Don't be disrespectful. What sign are you? >> She got a shirt on. When someone's being detained or taken to jail, officers still have a responsibility to protect their safety and basic dignity. If someone's exposed or not properly dressed, officers may provide something to cover them while handling the situation safely. After being arrested, the driver was taken to jail for the required observation period and was later charged with DUI, refusal to submit to testing, and resisting arrest. A judge found probable cause and set her bond at $2,250. Her release conditions included pre-trial supervision, monthly drug and alcohol testing, and an order to stay away from all substances. She's pleaded not guilty to all charges, and because the case is still open, these charges remain allegations. She is presumed innocent unless proven guilty in court. A DUI investigation can involve several steps, including observing the driver's behavior, conducting field sobriety tests, and requesting chemical testing. Refusing a breath test can also have separate legal consequences depending on the state's implied consent laws. Alcohol can affect judgment, attention, coordination, and impulse [music] control. It can also make it harder for someone to stay focused during a stressful conversation. Now, that may help explain some of the unusual behavior that we're seeing here, but it does not remove responsibility for the choices a person makes. What do you think about the situation? Do you think refusing the breath test made things worse for her or do you think she had the right to refuse it? Share your answer in the comment section below.
