Here. I don't know. >> Well, you had problems with this guy before. >> And I'm I'm handcuffed. The black guy. >> You don't have to wait. >> Don't worry. >> Where's the car? Where's the crack that you said was in our car? Calm down. >> Where is it? >> Do a job. >> Come on. Show me. Hillbilly. >> All this is is I have insurance on my car. I'm got a valid driver's license. And this is supposed to be a traffic stop. >> You know, we got a lawsuit against him. During a routine traffic stop for alleged speeding, officers immediately escalated by ordering both the driver and passenger out of the car so a K9 could sniff the exterior, then use that as a springboard to search the interior and the people themselves. The United States Supreme Court has explicitly ruled that police may order the driver and passengers to get out of the car during a lawful traffic stop without violating the Fourth Amendment. Pennsylvania fees Gebert Mims 1977 for drivers. Marilyn vers Wilson 1997 for passengers. However, the officers here went far beyond that narrow permission. They detained everyone for an extended period, conducted full searches of pockets, shoes, socks, and even threatened a roadside strip cavity search, none of which is authorized by Mims or Wilson without independent probable cause or reasonable suspicion of a crime. The video clearly shows the occupants repeatedly and correctly stating they do not consent to any search of the vehicle's interior. Yet, the officers proceeded anyway. >> What are you having to get out the car for? You can't get in my car. You can't search the inside of my car. So why are you having him get out? You can walk the K9 around the car without him without them being in there. You didn't find it in the car. Did you? >> DID YOU FIND IT IN THE CAR? Did you find it in the car? Say it again. >> NO, YOU DID NOT FIND IT in that car. You found it where? On him. You lying sack of [ __ ] >> Yeah. Let him get you in trouble, TOO, BECAUSE HE DON'T GOT THE RIGHT TO SEARCH THAT CAR. An ounce of crack. Yes. >> You're lying. We got it all on recording. >> Every bit of it's on recording, buddy. >> Okay. My sergeant's here and you're under you're under arrest. >> You're under arrest. >> Okay. Sergeant's here. Sergeant, will you tell me to get out? >> Because I'm going to run my K9. You're not going in the car. I don't give you consent. >> And now I'll remind you, I do not give these guys cassette to search my car. And they have not found anything in my car ever. >> They have no probable cause to search inside my car. >> Because I wanted to We only had a bad problem with you. Hold on, bro. Hold on. >> No. Hold on, bro. I'm not on that. I'm not on that, bro. >> Why? Watch how they do this. >> I'm not on that. >> Watch how they all do this. >> I'm not on that. >> I love this. This going to help my lawsuit even more. >> I'm not on that >> cuz we already know. We already seen the uh the evidence that you don't have on [ __ ] video from the first time you did this. >> I'm not only I do not know what you're talking about, bro. I have a lighter in my hand. That's it. What am I going to search for? Did I search him? Let's go back here. >> He's illegally searching my my my passengers. >> I haven't searched him once yet. >> Yeah. >> What is really going on here? >> Right there. >> He's ready to go on my car. Ain't that the other guy who we got on video? >> Yes. >> Oh my goodness. >> All three of them. Even the >> Can you Can you leave my phone alone? >> No. Can you leave it there, please? Thank you. Thank you. Thank you. Thank you. >> Thank you. >> All this was is I have insurance on my car. I'm got a valid driver's license and this is supposed to be a traffic stop. >> You know, we got a lawsuit against him. >> What is your name? >> I'll be right. This >> ain't a dollar this time. This ain't >> Well, if you want to look, go ahead. >> Ain't no Pennsylvania [ __ ] We got We KNOW OUR LAW ALREADY. WE KNEW OUR LAW. >> We already know he had his video cameras off. We already know everything. We're already in the middle of >> I'm just telling you the case law. You can I don't even KNOW IF YOU GOT to search our [ __ ] car if we don't give you permission. What's the reason? A traffic stop. >> That's why he was taken out of our area. We have a traffic stop. >> Search the car for a traffic. Y I already talked to a lawyer about all this. Yeah, you go right ahead so I can add a listen. >> Mhm. >> We know the >> We have a legal right to ask any and anybody out of a car. Pennsylvania versus Memphis. It's gone through the Supreme Court. You can look it up if you don't. >> I don't have to. I already talk to a lawyer. That's fine. That's fine. That's already gone through the Supreme Court. >> We're not dumb. >> No, I'm not. >> And we were told that on a simple traffic stop, it's not it's against our right for you to make me get out my car. It's against my safety for you to make me to get out my car for a reason. Chill out. >> Chill the [ __ ] out. >> I I just got here. I don't >> We had problems with this guy before. >> You don't And I'm I'm handcuffed. A black guy. >> You don't have to wait. >> Don't worry about it. We good. We good, man. We good. much. >> We good? >> Cuz he he's been harassing him the whole [ __ ] time. >> We got an online video, too. >> This man right here should not be an officer. >> He just told me to back up over here. >> Wait about this [ __ ] paperwork, man. >> Right. >> The dog. >> The dog. You worried about the dog. >> He tells me go stand over there. You tell me to stand over here. None of you guys make any sense. >> No sense. >> The dog is going to hit on something. Get the [ __ ] out of here. to walk around like three times on my side. Look at my side. [laughter] >> If dog would just walk past me twice with no [ __ ] Look. Look. Don't put the dog on. >> Probably the crack cocaine that was in the video. >> Hear that? Hear that? >> Go look. See if there's crack cocaine, dumbass. >> We appreciate that. Appreciate that. >> Go ahead. Go look. Go look. >> The [ __ ] >> Matter of fact, how about you go help him look so he don't plant something like >> We don't want him in our car, man. >> Cuz he planted something on my boyfriend the first time. We got all this [ __ ] recorded, man. >> No, you don't. >> No, you don't because we already I go here already asked FOR THE VIDEOS. >> THE FIRST TIME THEY WEREN'T RUNNING >> THIS TIME. >> But I mine were. >> Let me sir. >> We got your stupid ass on video, man. You just don't know, man. You just don't know. And I got it on video how he walked past the wife pass the car three times. >> That car cleaner than a [ __ ] Check it out, man. You can eat off the floor. >> He walks [ __ ] that dog across that door three times and didn't hit. That's the third time he when he holds him there >> and throw the thing. Good thing we got a lawyer. We good. >> That's okay. I got it all on video this time. >> There's nothing in there. >> Just like last time they searched and find nothing. This is what he want. Wow. >> He was waiting for us to come in Grundy County to stalk us cuz he chased me from work the other night. >> Wow. This is crazy, man. >> For us in the house and everything. >> Yep. This has been going on for days. >> You should really look to your officers is what you need to do. >> Yep. >> Look at who you're hiring. >> So, here's their cannabis. I've heard a lot about this cannabis that [ __ ] bro. >> It doesn't matter, bro. We We We weren't smoking that. That was There's a trade, bro. >> It was an astray. Thank you for the admission. >> It's an ashtray. It's not even We the smoking that only smoke that. That's legal, bro. >> That's all it is is a ticket. >> I had to be an ass, man. Get your hand off me, man. >> The K9 walked past the driver's door multiple times with zero reaction. Yet on the final pass, the handler physically held the dog's head to the seam until the dog finally sat the universal alert signal that magically gave them probable cause to tear the car apart. Federal courts have repeatedly held that a dog alert that is prompted or manipulated by the handler rather than a natural response to odor does not constitute probable cause. United States versus Flores, 10th Circuit, 2020. See also Florida versus Harris 568 US 237 2013 requiring reliable unmanipulated alerts. Passengers openly accuse the same officer of planting evidence during a prior stop, an accusation they claim is already in litigation. And the dog's blatantly coached behavior on camera only fuels that belief. No drugs were ever found inside the car, only a tiny amount of cannabis shake in an ashtray that the occupants immediately admitted was legal marijuana residue. >> We the one smoking that only smoke that. That's legal, bro. >> That's all it is is a ticket. Had >> to be in the ass, man. Get your hand off, man. >> All it is is a ticket. >> Are you kidding me? Is that officer? Is that not just a ticket? >> That's not mine, bro. But that's what this is. That's not my car. Put my money in my pocket, bro. That pocket, bro. >> Y'all got to be kidding me, man. >> Y'all got to be Put my money in my pocket, bro. It's going to blow away like that, man. >> I regret it. >> Stop, bro. I'm not. >> Wait. Just [ __ ] let him do what they're doing. >> Bro, I'm not doing nothing, man. >> You know he's doing this on purpose. >> He's doing that. I'm not doing anything. Just like he [ __ ] ripped [ __ ] my wrist. >> Get Man, I'm >> My wrist is still [ __ ] up from him. >> I know. I didn't do [ __ ] Godamn. >> That's also do, man. >> I got I got hospital [ __ ] records from the last time he grabbed me. >> It's all he wanted to do, man. He could have asked us, man. >> Got you, dude. You broke his head. We got you, bro. >> Yep. They ain't searching me. I ain't give a percent. >> It doesn't matter. >> It doesn't matter. >> Kick off your shoes, >> dude. That's a search. >> Yep. That's against the law, too. >> But hold on, baby. Hold on. Keep your shoes on. >> Keep the video. >> I'm watching. Look. >> I got it, too. >> Yep. There you go. That the lawyer said that's against the law, too. Especially on the side of the road on the road. Look at that. >> Yep. Look. >> And all these officers are letting it happen. See it? >> He's a sign. >> They don't know. That's why. >> See that? >> Dumb ass don't know who's hiding. >> Yep. >> Cuz I already know my lawyer already said this is against law. >> There you go. Hold on. I got another back up. Bro, I don't even need a lawyer to know that you're not under. >> You know this is against law, right? >> Don't worry about it, babe. It's all good. >> Law be safe, man. >> Bro, you ain't got to take my sock off, bro. You don't do Oh, man. This is good. >> Yeah. Look it. I'm watching every bit of it. >> This is good. >> You want to make a barefooted on the side of the road? >> You want to humiliate people even more? >> This is good. You [ __ ] redneck. >> Are you kidding me? This is good. >> Come in. His [ __ ] parent. >> This is good. Calm down, baby. Calm down. We ain't going to slam his calm down. >> Where's the car? Where's the crack that you said was in our car? >> Calm down. >> Where is it? >> Let him do his job. >> Come on. Show me. Hillbilly. >> Get up. He search you guys. >> You can't search me, [ __ ] >> Yeah, absolutely. We're going to >> Yeah, we'll see. >> This is crazy, bro. >> [ __ ] Hillbilly. What's >> in car now, man? and breads. Swear. >> Okay, you can go right ahead and put those iPhone case. >> Are you going to break it? >> You're really going to break it. How did I break it? >> Right. >> Wow. Now, did he just swear there was crack cocaine? Where's the crack cocaine, officer? >> Don't say nothing. We got a lawyer. Don't say nothing. >> The reason why he stopped while he was swear up and down there's crack cocaine. Where is it? >> That's why he searched the car. >> Yeah. >> For the last time. >> Did you put my money back in my pocket? >> No, we're holding on to that. >> Why are you holding on to that? >> So he don't blow away. I told him to grab it. >> Can I have my money back now, sir? >> I'll put it back in your pocket for now. >> For now? >> You're taking you to jail. You >> What am I doing to jail for? >> Oh, I'll make up my mind. Yeah, he's going to make up [ __ ] like he did the first time. >> Don't worry about it. >> If you weren't out of the car when the sergeant >> they're going to make up [ __ ] like they did on me problem with you. I got a lawsuit going to have a lawsuit. I got to make sure I'm safe. I didn't do nothing wrong. >> Yep. >> But it's cool. >> So you got to go search my car again. Did he just search my car? >> 113 status. >> Officer, didn't he just search my car? >> Maybe don't even say we're good. We're good. We're good. We're good. >> That's all right. I got it on video. This is crazy, man. This is really crazy. >> They're waiting on a female officer. I want to know what's the reason to search me. >> K91, man. Did you see? We got them on video. These things right on this. >> This is all over a supposedly speeding ticket. >> You can't see the loud, bro. >> See this? >> We got to wait for this [ __ ] man. You got to study playing with >> Is there a reason why you got my door open so you can get hit by a car? We even got but we even got him on video doing some bokeh [ __ ] >> Y'all are tripping, man. We got video. We downtown when y first did this [ __ ] >> I got I got this. I got at least this is helping us out though. >> Listen, I got at least 15 videos of your officers breaking the law. >> Bro, you just don't know what's coming. >> That my lawyer's got already. And then I'm that >> we are supposed to told every time you guys do this. >> Every time you see me, bro, you harass me. We don't do [ __ ] man. I got videos of him chasing me home. >> We got videos of this [ __ ] bro. You see them cameras in the car? >> Front and back. We got videos of this [ __ ] man. >> Non-stop record. >> Non-stop. That's a gigabyte going up, man. A terabyte. I mean, y'all tripping, bro. You know, I ain't putting my shoes back on. I'm cool with that. >> The man took my shoes and socks off. >> So, he just sit here and searches my car as much as he wants. >> That's a cavity search, bro. >> Yeah. Yeah. And you don't know that's a cavity search. >> You guys want tools to start You guys want tools to start taking [ __ ] apart too? >> Huh? What you guys going to see? Tools to start taking [ __ ] apart too on the side of the road. >> He wants to. >> Yeah. Okay, >> babe. Calm down. [ __ ] Ain't nothing. Calm down. >> Just calm down. What are you saying on the road? >> Cuz he's a hillbilly. >> Don't say nothing else. Calm down. >> Look at him. Be cold. Damn. What are you going to do? >> I know, man. Catch all that [ __ ] >> No, I know the lawyers in [ __ ] co city told me about him, too. >> I know somebody knew him from before he was a cop. >> Don't worry about it. We're good. >> He's an inbred. That's why. Quit talking [ __ ] man. >> More than that. [ __ ] pervert. >> Yeah, I know. >> And he said he going to give me my money for now. He already stole $400 the first time he pulled this. Remember, he he only documented so much. Like, we didn't know what our rent bills were. >> I wonder why we don't trust him in our car. He's a thief. >> And then I'm the passenger because I I don't want to keep going to jail. Does that make sense? >> He should not be a cop. >> That's what I said. That don't make sense. >> I don't know about the rest of you, but I know I was born. He should >> That don't look like harassment. I'm the only one to keep going to jail. catch me up. >> And then he has his mommy and then when you post the videos on his ass listen. >> Yeah. And then he said he's going to make up something. You did not just hear him say that. I got it on recording. You don't let him break. >> Make them screws, bro. Them are different type of screws, bro. The [ __ ] is you doing? >> I know you ain't taking our [ __ ] apart. >> Put them my speakers. >> This [ __ ] jackass, bro. >> You're taking You're letting him take our [ __ ] apart now. >> I'm taking it apart. >> Is he What are you taking screws out for? >> Taking it apart. You're taking >> Do you know my R2? Oh yeah. You know how big the [ __ ] stickers are? >> Not. You're definitely going to get in trouble for this. You're really going to let him do that. >> Do you know how big R2 is damaging >> damn near the whole box? >> Screws out is damaging. >> Sir, the mag be in the back of that. You can't put [ __ ] in that box. >> He's not putting anything in there. >> What is he screwing them for? >> I don't know what he's doing. >> Should you know that? Isn't that your job to know what >> worry about it? Don't even worry about it. Be cool, baby. Be cool. >> No, you just stand on the side of the road. Let do whatever they want like tyrants. That is illegal. >> You know, he he just unscrewed my box. That's nailed down to the damn thing. >> Cuz he can't find nothing else in the car cuz he can't do that now. >> Just be quiet so we can get out of here. >> So, how long is you going to let him >> leave him halfway? >> How long are you going to let him destroy my car before you're going to let us go? >> Well, as soon as the female gets here, >> she just did. >> Pay attention. >> There. >> Exactly. Cuz he we GOT HIM ON VIDEO. GUARANTEEING IT'S in there. >> Now he looks dumb. >> Cuz he just like the first time. Dumb ass. >> No excuse for pulling his dog out >> because you had it last time. There was drugs in there last time >> for something that ain't even in there. >> They got me on the side of the road with no shoes on and handcuffs. >> Dog didn't even hit. >> And I'm the pastor. >> And we got work, dog. We got it all on video. All of it's on video. This is all no rac. >> I just want to know how long you let him. How far are you going to let him go before you to let us go? >> I'm saying like he already bent this on me though. >> Wait wait wait wait. He went through the car three times. >> Yep. Got it on video. >> Can we go like or give him his search? So what else are we sitting here? >> Like we said we have somebody at home and we have things to find. daughter's at home. Are you going to arrest us? Are you going to What are you going to do? >> You could have left one of the two at home. >> No, you could get the [ __ ] done. >> No, just stop and let him do what he going to do, man. >> One of them at HOME. I PICKED HIM UP. YOU DON'T KNOW WHAT THE [ __ ] going on. >> Olivia, just shut the [ __ ] up. CALM DOWN. GIVE MY TICKET. LET US GO. >> CAN YOU CALM DOWN? >> I DON'T want to give you a ticket. >> THEN LET US GO. >> YOU GUYS ARE BEING NOTHING BUT COOL AND YOU calm down. >> I'm willing to resp. Either he's going to arrest us or he's not. So, he needs to >> look at this. They're all letting this happen. Every one of these call officers. >> Every one of them. They're not arresting us, but they don't want to let us go. >> So, he can tell us what the [ __ ] he's going to do so we can go. >> He can run his mouth, >> man. If you be cool, man. >> I mean, you're both going back and forth [ __ ] doing it. So, just both of you guys shut the [ __ ] up. >> See their names? God, I already got their names on my video cuz they don't like to get sick with their cars, their badge numbers. Yeah, I've been through that before. >> Some racist [ __ ] >> I heard this all the time. Well, let's see. Well, you'll see this one cuz this is going on YouTube as soon as I get home. >> Some racist [ __ ] man. You >> should keep it. Give it to first. smartly and I'm the first. >> I'm going to do both just like I did the first time. That's why he's harassing us like he is cuz I put his ass on YouTube and his mom and daddy got in and was talking [ __ ] and I got them too. >> Just be cool, man. Be cool. My arm is going numb. This is crazy. >> That's what I'm saying. Shut up both of you guys so he can just do what he's got to do so we can see. >> I just want to know how long he's going to let him go with this. He's done searched the car like six times. The other officers done searched it. He's been on that side right there eight times. Not even joking. Like >> what is he going to go plant something like he did the first time? >> He already found what he was going to find on that side. Like the weed. That That's it, buddy. That's it. >> Even your other officer gave up. Look, HE EVEN GAVE UP. >> CUZ there's nothing in there. Like wrap it up. He's just pissed cuz he knows he's [ __ ] stupid. >> Freaking as [ __ ] >> He knows he's [ __ ] wrong. >> Yeah, that's one shitty ass officer right there. You guys really seriously need to either transfer him out or get him some go get rid of him. >> Look, he's the problem. >> So, I'll take your cannabis. I'll take your corner tight bags in here with the powder that's in them. Okay. >> Whatever. >> Going to test them. I'm not going to >> you listening to this, right? >> I'm not going to take you to jail over it. All right. Because you guys are being cool and play with us. So, I am going to give you your written warning >> and then you're going to be out of here. >> Guys, go ahead. in the car. >> Well, Dwayne's going to want to stay here so we can get out of handcuffs. >> Talking to my daughter. >> Hey, Miss Hamilton, here's your driver's license back. Here's your red warning. >> [ __ ] you. Thanks for breaking my door, dumbass. >> After finding nothing in the car, officers forced the male passenger to remove his shoes and socks on the side of a busy highway, then began aggressively patting him down while waiting for a female officer, strongly implying they intended a full strip or cavity search right there in public view. The Supreme Court has ruled that a roadside strip search, particularly when conducted in public view, is unconstitutional absent exigent circumstances and specific justification that less intrusive means will not suffice. See Florence versus Board of Chosen Freeholders 566 US 318 2012 distinguishing jail intake strip searches from traffic stops. See also Bird vers Nevada, 9th Circuit, 2018. Finding roadside strip searches presumptively unreasonable. Making a man stand barefoot on the asphalt while officers dig through his clothing and threaten further invasive searches all over a speeding ticket and a manipulated dog alert is textbook humiliation and a blatant Fourth Amendment violation. The passenger's girlfriend captured every second, repeatedly pointing out the illegality while officers ignored her. This stop was never about a traffic infraction. It was targeted retaliation, a fishing expedition, and a disgusting display of authority run a muck. All documented in real time for the inevitable federal lawsuit that is coming.
