And this is an office I decided to stop by. I'm taking some pictures of it. Probably going to grab some forms. >> Well, I don't think you have that option cuz this is a public office, right? >> Okay. Can I ask why you're filming me? >> Oh, I'm just documenting today. I documented all my interactions with um you know, public public entities. So, um that's >> a single camera walks in and the entire office instantly erupts into chaos. Let's go talk outside because uh the employees don't want you here. >> Is this public? >> Uh this is uh >> public. >> This is private business. >> And did I just hear that right that the school has been placed on lockdown? >> Yes. >> Wow. >> From a simple visit, everything suddenly escalates into an unprecedented confrontation. From someone just taking a few photos, the entire office panicked to the point of calling 911. All because of a camera recording everything. What kind of pictures you take? What kind of phones do you have? >> Uh, I don't know. Some of the stuff up here, but pictures. Just pictures. Regular pictures >> for just for the sake of having >> Yeah. >> Just curious. Just taking photos of inside the office. >> Yeah. >> Just just just for having them. Just for me at this point. Yeah. >> And who are you? >> Who are you? >> I'm Carrie. I'm secretary here. >> Awesome. I'm Jay. Yep. Good to meet you. Are you a parent or >> Huh? >> Are you a parent? >> We don't know. >> Uh I I do have children. Yes. >> Are you a parent? >> No, I'm not I'm not even from here. Nope. Not not even from out here. Just driving through. >> Okay. Well, I'm not sure that I'm not allowed to do that. >> Why is that? >> Cuz you just can't come in here and take Yeah. I'm sorry. And you're going to have to >> Let me get out of this guy's way. Unless you can be more specific and not so vague about what you're doing and why you're doing this, you're going to have to you're going to have to leave. >> Well, why do I have to be more specific? It's pictures. I mean, I I don't know how much more specific to >> take pictures. So, >> well, it's not other people's offices, though, right? >> It's an office, >> but it's a public office, right? >> But there's reason for you to be here. I'm sorry. >> There is pictures. Yeah. And I'm going to grab some for taking the pictures. Please stop being evasive. Why? >> I'm not being evasive. I just don't I'm I'm taking them for me right now. I don't know exactly what they're going to be for. >> You're interrupting me. You're asking me a question to answer you. I'm trying to answer you and then you're interrupting me and you're being aggressive and I'm not just we're concerned. >> Well, like I said, I'm taking pictures at this point. I don't know exactly what I'm going to use them for. I'm going through town. I'm looking at the what whatever I want basically. And this is an office I decided to stop by. I'm taking some pictures of it. >> Probably gonna grab some forms. >> You cannot come in here and just take photo. >> Well, I don't think you have that option >> cuz this is a public office, right? >> I'd be happy. >> Who Who are you, by the way? >> I work here. >> And what's your name? >> My name is Jennifer. >> Police stormed into the public building and immediately ordered me out just as the camera captured the very first moment of their abuse of authority. >> How you doing today, sir? >> All right. How about you? >> Very good. Hey, can you go talk outside? >> No, I think I'm good here. >> Uh, okay. Do you work here? >> Uh, do you work here? I am working right now. Correct. Okay. >> Is your body cam on? >> Yes, sir. >> Cool. >> So, let's go talk outside because uh the employees don't want you here. >> Is this public? >> Okay. >> Uh, this is uh >> public. >> This is private business. >> No, no, this is school district. It's public. >> Okay, let's go outside and talk. >> I'm in public, sir. Taking pictures in public. >> What can I help you with today? >> Don't need help. I'm just going to take some pictures, get the forms I need, be on my way. >> Okay. >> But right now I'm in public and so they don't have the choice to not want me here and neither do you, unfortunately. >> Okay. >> So, do you have ID on you? >> I do. Yeah. >> Can I see it, please? >> Do I have to give it to you? >> Well, I'd like to know who I'm talking to just to make sure everything's all right. >> Yeah. Do I have to give it to you? >> Uh, you're not required to. >> Oh, okay. No, I'm good. >> Okay. >> Awesome. >> So, >> what's your name and badge number? >> Uh, Officer Drifus. So, the staff here advised that they would like you to leave. Mhm. >> Okay. So, why don't you grab the forms that you need and head out? >> I'll be here for about another hour. >> Why is that? >> Cuz I'm going to take pictures, get the videos and pictures I need. >> Okay. Well, >> do you have that? >> No. No. Like I said, it's going to take me about another hour. >> Okay. >> Maybe 30 minutes. Something like that. >> Okay. What do we step outside? >> I'm just talking to him. Same thing. This is public. I'm in public. There's nothing I'm doing wrong. This is a first amendment, right? Gathering content for a story and there's nothing you can do about it. What's your name? >> It's actually an office here in >> Right. And it's a public office. >> No, it's not. >> Yeah, it is. Paid for by tax dollars. Open to the public. >> What's your name? What's your name and badge number, sir? >> Right here. >> What is it? >> Right here. Can you read? >> What if What if I can't read it? What if I'm not good at reading, sir? Why are you being Why are you being aggressive and mean for that? Is there >> And what's your badge number? >> Officer Chief intimidate. >> There you go. >> There you go. Wh why was that so hard? >> Mhm. >> You're kind of >> from being accused of disturbing the peace just for recording. The confrontation instantly shifted when I cited case law one by one exposing the line between constitutional rights and their routine commands. >> This is the Ninth Circuit Court which covers California, right? Ford Ice versus Seattle. Their feelings do not trump my first amendment right. I can give you many many cases that that that allow me to do this. This the staff has asked you to leave because they're not they're not comfortable with you filming in here. >> It doesn't matter. >> It's public. >> Okay. >> It's public office open to the public. >> So just like a library or a post office or >> and you can film there, too. >> These are the laws. It it it shouldn't be an issue and you shouldn't have had this response. You should not have tried to be aggressive and kick me out and closed the gap between us and this guy came in acting like a >> I I appreciate your perspective but I also don't appreciate you how telling me how to do my job. >> But sir, you don't know how to do your job. So I am telling you how to do your job. >> Great. >> If you knew how to do your job, let me let me ask you a question. What did the call say? >> So the call came out as a suspicious subject. >> Doing what? >> That's it. >> No, no, no, no. They I heard her tell your dispatch that I was here taking. Just because >> Hold on. You're record. You're You're interrupting, sir. I heard her tell your dispatch that I was recording. >> I got the whole dispatch phone call on camera. All she said was he's in here recording taking pictures of us. >> So you Why would you come in high and and get ready to be hands-on and all that stuff for somebody taking pictures? Does it Does it have no idea what's going on? Don't seem legitimate. >> Don't Don't you think I I treat every every situation? >> Well, when I'm here in the window and you can see my camera and I'm like, "Hey, how you how you doing?" You could have walked in and said, "Are you just taking pictures? Do you know I'm allowed to do this or not?" >> Yeah. Well, >> not allowed. Not allowed. I have a right to do this. >> Well, and and that's what you're talking >> a first amendment right that can't be trampled. Right. So, when you saw that and you came in and there was no issue, you should have stood down. >> Again, I don't I don't know what to expect. Just because I get >> No, I understand that. But when you come in and see it and talk to me, you should have easily Ma'am, I don't I don't care. You can go in the back or get another job not in the public sector. After the police left, an employee still rushed over to block me, loudly forbidding audio recording under advice from a lawyer, unintentionally turning herself into a perfect example for the internet. >> Without my permission, and I don't give you permission to record my voice. >> It's illegal to record your voice. >> Yes, it is. >> Really? What law is that? >> It is illegal. You cannot record me without my permission. And it is illegal. Do you know the law or >> I don't I can't quote it to you right now, but I was just talking to a lawyer on the phone and he said it's illegal. >> No. Well, you should call him call him back and I would gladly have a conversation with him cuz it's not >> you're in you're in Listen, you're in you've already told me so I have it on camera but you're in public and the way it works is you have no reasonable expectation of privacy in public and that's the United States Supreme Court. Tell him to go look up cats versus US and he'll see it. Oh, plenty of plenty of laws. >> Stay on that side. >> Oh, no. I can be back here. Yeah, I can be right here. Ma'am, don't touch me. >> Said I'm not touching you. >> They said I can be right here. >> No, he said you have to stay. I just talked to the the >> Good. You need to be off the force. >> No, girl. I can be right here all I want. >> Yes. Yes. Yes. This is public. >> So, this is public, sir. Not back here. >> This is too. I'm not going back there. I'm right in public. >> Okay. No. >> Yeah, I can be right here. >> Ma'am, don't touch me. >> Said I'm not touching you. >> They said I could be right here. No, he said you have to stay. I just talked to the the the chief out there and he said you need to stay at the front of the desk. >> That's not true. >> Sir, can you just give her some space? >> She walked towards me. I have it on camera. >> No, you walked towards me. >> No, no, you stepped at me when I walked forward to stand her. >> Please move. >> You're not controlling this, lady. >> You're not. I'm sorry, Jennifer. You're not controlling this cuz I'm Cuz I'm your boss. >> And your name? You're not my boss. >> I am. We pay taxes. You don't understand this. I just told your superintendent the same thing. If we come through and spend money here, we pay taxes here. >> Citizens can sue police officers under SS1,983 when their rights are violated. Officers who break the law may be required to pay damages and face disciplinary action or termination. No arrest occurred, but the police showed signs of abuse of authority and violations of the First Amendment. Up next, just minutes after the man simply tried to submit a foyer request, the school staff suddenly disappeared and police showed up immediately. >> What's going on, officer? >> You know what? It's ra like I was just saying, it's rather I feel that it's rather disingenuous that they would give us a call. Give you guys a call. Uh the lady told me to wait right here. She would be back to help and never came back when you guys showed up. What's your name and badge number, sir? My name is 498. >> 498. >> Give you any trouble. Trying to figure out what's going on. >> Yeah, I'm just like I was How you doing today, officer? What's your name and pass number, sir? >> 442. Appreciate that. Uh, like I was just explaining to your partner here. Um, actually here to file foyer request. As you can see, signs all over the place, uh, telling us that this is the administrative center. So, I'm here to follow foyer. I conveyed that to the young lady that works here. I guess she say she's the principal. She told me a few moments ago and I'll be right back to help you and you guys showed up. So I think that was rather disingenuous that she was trying to say that she was going to help. >> You need a foyer request. >> That's that's it. >> You're looking for the admin area. >> Well, yeah. Well, I just see that this >> this is the early education center. >> Okay. >> The admin section is actually >> in the back back there. Yeah. But the reason she said you can't access it cuz it's I guess it's blocked off of construction. So, I don't even know how to get back there. >> Yeah. Yeah. >> Okay. Is that something you can if you want like a phone number to um >> Well, I just want to be able to just document it, you know, just write it write it write the uh foyer out right quick. Hand it back to her and good to go. >> I got to see if they can do that right here cuz this is the school. >> I know it's the I get it's the same building. >> Yeah. >> And then the unexpected happened. While he was still waiting for a response, the school secretly called the police. But the biggest shock was yet to come. >> Body cam on. >> Okay. >> The school was on lock down. >> I'll do that. >> So, real quick, officer, is your body cam on? >> Yes, ma'am. >> Okay. And and and did I just hear that right? The school has been placed on lockdown. >> Yes. >> Wow. That that's I think that's >> uh said that they couldn't identify you as a parent and you didn't look familiar. So they were >> concerned for whatever reason. I'll let them know to lift that >> for you on the foyer request. Okay. >> You don't take foyer requests here. You have to contact the superintendent. Her name is Heather. This is her phone number. She will give you all the information. >> Yeah. What? See, and what I was trying to tell her as well that uh we have cuz she didn't even know anything about foyer. The the young lady, I guess she's the principal. So, I was trying to tell her that we have a right to file it in person. >> Okay. >> So, so, so that's my thing. That might be like this young lady name that you're holding in your hand might be the foyer officer, but I I want to I have a right to fill it out in person. And then I was talking to officer Cheney here that the administration officer is actually behind this building. We're just trying to figure out how do we access back there. >> So, to my understanding, they do not have any for paperwork. The principal told me that they don't have the forms in there. They have nothing to do for your request in here, >> which makes sense. The district probably handles all that stuff. >> Yeah. So, she said she doesn't know what building you have to go to. She just knows you contact the superintendent and then she will direct you. >> She could probably allow you to do it in person. It's just you got to figure out where you >> When the police arrived, an officer revealed a shocking fact. The school is on lockdown. Could a simple act of recording in public really lead to a code red? >> Yeah, I was direct. How you doing today? Uh guys, I was directed to come to the administrative office. Me and Officer Cheney here were seeing that the building is located behind this building. Uh the young lady that we spoke to, I guess the principal, uh she was acting like she was going to help, but then she called the laws. So, >> very disingenuous. >> What What's your name, sir? >> I'm Kurt Rolling. I'm superendent. >> Okay. Assistant super. And you, sir? >> Eric Agar, assistant superintendent. >> All right. Appreciate you guys. So, yeah, >> we can direct you over to the the right person. We with some of our personnel. >> Okay. >> So, if you want what's the address over there? 442 North Cedar Lake Road. >> North Cedar Lake Road. >> You know where Hall is? >> Village Hall. Uh I'm kind of familiar. Is it right down >> Cedar Lake and Heart? >> Okay. See Cedar Lake and Heart. Okay. Um and and is it this young lady's name here that was on >> Heather Bennett? >> She's there. Okay. >> Okay. Cuz so real quick, the building that's behind this building is the administration center, right? >> It used to be. >> It used to be. We're going to be we're going to be renovating it to expand our early childhood. >> Oh, okay. Okay. >> Okay. Okay. So, Heather Bennett is at that location. Can you if you guys can if one of you officers I really definitely appreciate. Can you write just the address down for me just so I can remember? I appreciate that. Thanks a lot. >> Your name? >> Okay. Appreciate it. >> You want to give me your name? >> I really don't really want to, you know, provide names, you know. >> I mean, you know, I mean, you would you you've been pretty good. So, I give you my first name as James. So, James, Heather Bennett handles all of our foyer requests, okay? >> So, she'll be happy to help you. >> Okay. >> When the district administrators were forced to come out, the truth about the administrative office and about how the school staff handled the situation began to crack open. >> From the top, TTA family. From the top. Um, came out here today to go to the school district, Round Lake School District. file for you and uh going to document while we do so. So we was able to encounter I think her name was Sarah when we first got there seen us outside explain to her what happened what we was trying to do. She went in say she was going to help us. She went in she came back out second time and then she went back to see again if she can get us some help. Well that's what was told to us at least. Um but the cop showed up. the cops showed up. So, uh, and they came to say, you know, basically we've been called out here. We already know that routine been called out here. Someone's out here heling things of that nature. My thing was the administration office is was behind well actually in the same building. It's just you could walk through them doors obviously and access. We we seen that the building was attached to the uh in in the back parking lot back there. So, it's like like even uh Officer Cheney said, it's like the same building. So we seen that basically where we needed to go was behind the first building. I was trying to explain it to Sarah in terms of foyer. She didn't she was unfamiliar uh didn't have any knowledge of even what foyer was. But the superintendent guy I guess she must have talked to him called over whatever and he said that he the one who told them to call uh the non emergency number. I find that I don't really let me see how can I say this. I don't really believe that in its entirety. uh you know, two officers showed up and a sergeant. You know, the sergeant was cool at, you know, we we we have we we got some run-ins with him already, so he was he was cool. But the reason why I say I don't believe that because the school went on a lockdown. So, uh if it's non-emergency, I don't think that they would have locked the school down. That's just me, you know. Uh but the superintendents did take my foyer outside right there. They went in, gave me a Xerox copy, and they're going to forward it over to their appropriate foyer officer. I think Sarah could have did that, but uh she called and spoke to the superintendent and he the one said call the cops. The one that actually came out there and talked to us when the cops was there. In the end, everything led him straight to the police department to request the body cam footage to uncover exactly what was said behind those closed doors. A sudden push in the middle of a Jersey summer night, but the one who caused it was not a drunk, but the so-called protector of justice himself. causing an issue going to get locked off you sir. Listen to me. >> No. Don't even >> Are you a cop? >> Yes. >> Please. I'm not said. Sir, sorry. Just take me off this block and I'm I'm not affiliated. I am affiliated with those guys. I don't have nothing on me. I don't have a gun on me or nothing. And I said just take me off this block and we can speak and >> All right. We got to get in here now. We got to get out of here. Just take me to >> When power doesn't come with responsibility, the result is a woman on the ground and a camera filming it all. Stay back. Stay back. >> Keep the cup. KEEP THE CUP. >> IT DOESN'T MATTER. IT DOESN'T MATTER. STAY BACK. BACK UP. BACK UP. I DON'T GIVE a B up. Back up. Back up now. Yo, you guys NEED TO BACK. >> BACK UP. >> STAY HERE. >> I DON'T want you going to do What are you going to do? Go ahead. Lock me for what? For standing here. >> You need to calm down. >> You need to calm down. Is that police officer? You need to >> Yeah, he jumped the fence and then push her in the guys need to back up. Let me tell you something. >> Listen, if you guys in the back listen, do me a favor. Please back up. >> I'm saying that hear me what I'm saying. Listen. >> Yo, you guys back up to the ground. Back up. >> That's not crazy. >> Sir, you need to back up. >> How am I crazy? POLICE OFFICER. I KNOW WHAT IS CRAVING A SEAT. That is not craving a seat. >> I'm standing here not causing an issue. Get locked up. Sir, sir, listen. Listen to me. >> Not in uniform. Not on duty. But the shouting echoed like an order to the whole neighborhood. Who is the real victim? >> You're a second away. >> I'm not stopping. I don't care. You need to back up. I don't care. >> You guys are making >> take them out of here, please. >> Hey, I did nothing wrong, bro. Sir, listen. Just get out. I don't care. You need to leave. Just leave. That's it. I don't care. I don't I don't care. I don't care. You need to leave. >> You're making it work. >> You're amazing. >> Thank you, sir. I appreciate that. >> Yeah. We don't want no chop. >> No. Absolutely. I hear you. >> Listen, man. We hear you, man. >> Listen, it's different in towns like this. You can't raise your voice. You can't scream. Especially officers. >> Listen, man. I'm not I'm Dude, we're really not trying to be >> dude's a good I don't know what over here. We'll talk to you right over here. What's going on? >> Listen. There's so many. >> He jumped wherever he is. Jumped the fence. >> Jumped the fence out of ran after the one the black hair struggling the ground and then dude honestly we would >> it would be a ruin. It would be a problem for you guys if we wanted to pay. Yo, stay over there. >> You trying to get a job? That's okay. Can we continue to talk or No. >> Yeah, I'm listening. >> All right. Well, then Well, I don't want to talk. Well, I know. Like, what are you doing with your camera? Like, >> I'm just I want an incident here. So, >> domestic. Yeah. Camera's on. >> So, so listen. So, now like >> So, now you're mad at me cuz I'm telling her to do the right thing. >> You're telling a victim not to cooperate? >> I don't want to like >> Is that Is that how we're going to go right now? >> Listen, we're not asking for arrest. >> It doesn't matter though. It's like if nobody called, it doesn't matter. It doesn't matter. >> No, we're good. So, we got to we got to get >> What's behind the badge? An offduty officer accused of using force, abusing power, and trying to spin the story to his own advantage. >> Get a real shot. >> Yeah. Yeah. Real tough when you're walking back to your buddies. Yeah. I tried to talk to you. >> No. Whenever that don't even >> Are you a cop? >> Yes. Please, I'm not. I said, "Sir, sorry, just take me off this block and I am familiar with those guys. I don't have nothing on me. I don't have a gun on me or nothing." >> And I said, "Just take me off this block and we can speak and >> All right, we got to get in here now. We got to get out of here. >> Just take me a couple more minutes. All right. Till we get inside. >> Shut. >> You ain't going to get that hard time for me. >> I know. I just like I said, I got the street. >> I got I got right through this door. I know. I'll get those off. >> What's that? >> I got to watch your step. Take a left. Have a seat bench. I'll get them right off you. Society is only truly safe when those entrusted with authority know how to show restraint, understand the law, and respect the public instead of overreacting and turning citizens rights into an excuse to misuse power.
