Yeah, that's cool. You can have that. I'll put my badge on this side. Only if you have a reasonable suspicion of a crime, I'll give it to you. That's it. >> A routine check that seemed ordinary quickly turned into a concerning situation when officers tried to force someone to provide identification without any valid reason. Listen, if you don't want an internal affairs investigation done by Mark Seckley, Okay. I think you need to back off, kick rocks. But yeah, like the AS1 line on here is basically it's just a tiny bit right below there. What's your chief's chief's name? I can't remember. Sorry. When power is misused, the consequences may not come immediately, but they will come. A man stands quietly on the sidewalk filming. Everything begins to change when a seemingly simple question turns into a tense confrontation. Hey, what's going on? What's up, man? Before you try to violate my rights, man. You're on YouTube. >> Just trying to find out why you know you're filming the parking lot back here. >> Cuz chapter 119 allows me to my first amendment right allows me. I haven't committed a crime. I'm not answering any questions. I need my lawyer present. O- Okay, sir. His name is Nick Chodos from Hand and Law. That's it. You don't have a news crew that you're working for? Doesn't matter. You ever heard of a private eye? Sure, I've heard of private eyes. Are you licensed and licensed? >> That's fine. I don't know the exact law. >> Now, what law Hey, what's your What's your name and badge number since you're approaching me? My name and badge number? Uh yes. My name is Ryan. My badge number is 149. >> 149. Thank you. Listen, if you don't want an internal affairs investigation done by Mark Seckley, Okay. I think you need to back off, kick rocks. I mean, it depends, sir. You can do whatever you want. I know I can. I know I can. And you can ask questions all you want. >> want to give your name at all by any chance or ID? Yeah, I don't have to. I haven't committed a crime. That's fine. You got any drugs or weapons on you? Why would I have drugs or weapons on me? I don't Oh, you don't have a weapon? Illegal weapon? >> Yeah. Yes, sir. I mean, I think I smell marijuana coming out of that car, young man. I'm ready to violate your rights. See where I'm going with this? Sure. You understand where I'm going with this? >> yes, sir. So, I don't know That's fine. Well, you're two armed men that approached me on the sidewalk. Well, you're The confrontation has just reached its limit, but clearly, this is not the end. When the initial demands fail to get results, the atmosphere begins to shift, more tense, more intense, and something is slowly slipping out of control. We're filming a restricted area of law >> No, and I'm but I'm not in that restricted area. >> filming it, so It doesn't matter. It's not illegal. All right. That's it. That's it. I'm going to go inside. I'm going to have them email a complaint Go ahead. if you don't back off. No, I'm not leaving. I'm on a public sidewalk. >> I'm on an area where I'm legally allowed to be as well, sir. I'm on a public I'm on a public sidewalk. >> We have the freedom to stand here. Oh, yeah, that's fine. We can stay here all day. I have the freedom to stand on a public sidewalk. We're going to Thank you. Make that a public record. I'm going to FOIA request it. What's your name and badge number since you're using your phone? 639. Badge number 639. Pistol master. Let's see if he uh Let's see if he identifies. What's your name and badge number? It's your policy. Mark Seckley. I don't know. All right. How do you say your last name? Officer Krieger. That's fine. Is that what you tell the judge? My judge? Any judge. Is that what you would tell the judge if you're in a courtroom? Listen. I need you to just back off, okay? I got your badge number. Now, I'm going to FOIA request that phone because you used it for public record. Please don't go in there and make your complaint. I No, you can't. I have to go downtown. That's what I do, okay? You obviously don't know who I am. All right, guys. I appreciate being here. Okay? I'm going to stand on this sidewalk. I'm going to continue for a few hours doing my my story, doing my documentary. Okay. You're ruining my shot. I don't appreciate it. You're trying to violate my first amendment right. >> It's a little concerning when you're filming where all the police are going Oh, why is that? Is Is it a gun or Is it a gun or a cell phone? It's the way that society's going right now filming things like you're trying to scope it out. >> Oh, so like So, basically, what you're saying is this day and age ideology. No, there's a lot of people that try to ambush cops. >> Oh, they try to ambush them? >> when you're when you're filming an area that's restricted. >> With a cell phone? With a cell phone? Oh, they ambush them? I think if you go in Listen, if you go inside and get your sergeant and My officer over here made a public record with his phone. [music] He took a picture of him. Identify me. Run my name, but you're not getting it from me. I haven't committed a crime. I didn't say you have committed a crime. Just saying you're acting a little weird. Oh, weird? Yes, sir. >> Okay. I'm a journalist. All right. What just happened is no longer a simple exchange between a citizen and the police. The atmosphere has completely changed, tense, [music] confrontational, and filled with suspicion. Will the situation de-escalate or is it about to enter an entirely new phase where everything could go far beyond initial expectations? You don't know who I am. I'd like to know who you are, but you're not telling me. It doesn't matter. He just made a public record. You can facially recognize that. It's simple. I've been Listen. >> I wish technology was that good. We don't You think this is the first time You think this is the first time I've been approached as a journalist outside of a police station like this? You think this is the first time? I highly doubt it, but obviously something's going on. You're doing something strange up like >> No, no, no, no, no. All right, I'm not going to talk. Now you Now you act like I'm being investigated for a crime or something like that. There's probably about 300 officers in and out of Tampa Police within the past 2 years that do know who I am. Well, I'm sure. Okay? It's my first amendment right. Okay? I'm out here. It's my first amendment right to dress how I want. If I want to put this over my face because I'm allergic to the You're actually not allowed to cover your face in public walkways. Yeah, I'm not allowed to cover it the whole way, okay? My nose and my mouth is not covered. >> you're denying your identity and you're not allowed to do that. Oh, but you'd have to prove that I'm trying to conceal my identity for a crime that you suspect me of. Please, stop quoting false All this stuff that you're telling me, if you go in if you go in there and try to look up the Florida statutes, it's not going to be there. Okay? I'm on a public sidewalk. Okay. If you want to violate my first amendment right, Well, I'm not trying to I know you're shaking I didn't No, I Yeah, I just drank a Venom. Hell yeah, bro. >> asking what you're doing and why you're filming Oh, nobody's nervous. Nobody's nervous. I do this all the time. Just relax around us. We're here to help you, you know? All right, guys. So, I'm going to flip this around. You're an idiot. Yeah, you're an idiot. You're an idiot. Kick rocks. Kick rocks, [ __ ] Get out of here. Nobody wants you around. These guys These guys don't know who I am. That's why I'm over here because they switched District 3 cops and sergeants over here. 28 officers, guys, came from District 3 over here. So, now you guys A couple of you requested me to do North Tampa, so I'm out here in North Tampa conducting First Amendment constitutionally protected activity. I got two [ __ ] over here trying to At this point, it's clear the officers are starting to lose control after failing to achieve their objective while the man stands firm. But it doesn't end there. Suddenly, the situation takes a turn when he decides to act, and that's when things become even more intense. Violate my [music] rights. Hey, guys. Hey, sir. What's your name and badge number, sir? They're trying to violate my rights on a public sidewalk. They don't know who I am. I don't know if you know who I am. Okay? I'm an independent journalist. All right, guys. These guys do not know about the First Amendment of the Constitution. What do you think about that, guys? Leave a comment below about these jerks that made made a public record. Ride of shame. Get to work. My tax dollars don't pay for this, guys. I'm on a public sidewalk. You guys need to get back to work, okay? You're lucky you didn't violate my rights. Mark Seckley would have had something to say about that, guys. Get out of here. I'm not paying you for this. >> [music] >> My tax dollars are way too important for this. You guys messed with the wrong guy. Kick rocks. You're a tyrant. Tyrant. SHORT NUMBER 5159. TYRANT. All right, guys. So, let's go inside. Hi. How are you doing? Um I was wondering if you could do me a favor. I'm not even going to bother them cuz I I I think they're just going to say that they're busy. But if you could write down the corporal and the shift commander that is on duty right now, cuz when I go downtown to Internal Affairs to file complaints on some of your officers that tried to violate my first amendment right outside, I need to know the shift commander and the corporal. You need to know their name? Yeah, because I know the proper way to make a complaint. You guys don't have complaint forms. I have to go downtown, which I know that. I do that. So, when I go to talk to Mark Seckley in Internal Affairs and I go complain, I'd like to know who was working today. The man begins shifting toward a formal course of action, no longer just confronting, but preparing to file a complaint. And right after that, the story moves into a more critical phase, where the facts, accountability, and consequences start to come to light. Hey, how are you doing, sir? I just need the watch commander and the corporal that's working. Are you the corporal on duty, sir? Um shift commander. You're the shift commander, even better, man. Um I don't know if you know what's going on. Um now that you guys have failed I was conducting First Amendment constitutionally protected activity on the on the sidewalk. Your officers made contact. One of your officers made a public record. So, I'm letting you know I have to file an internal affairs investigation on them with Mark Seckley. And that's what I need. I need this shift commander and the corporal that's on duty. I did see you. I videotaped you out there. I appreciate you kind of getting them to chill out a little bit, but um that's what it is. So, if you could write that down for me. That's my name. That's my badge. Okay. Now, I want to confirm something while I'm here. I saw the sign out there that says this is a safe place. If I If I was actually come conducting business and wanted to sit here and wait for somebody to like make an eBay transaction, I wouldn't feel safe with these officers the way they treated me out there. I'm just letting you know that. I don't know the circumstances that led to the interaction like this with the officers. Okay. >> But it's our intention for you to feel safe. All right. Yeah, I know cuz you're a public servant and you're here to serve the people and not just act like Nazis and always arrest people, you know, um or violate the rights like Antoine Nelson was he did to Rachel Stockwell. That wasn't right. Body slamming her on Cass Street making her brain bleed. She was a University of Tampa student. She was 18 years old with a fake ID. That's what one of your officers did. That's one of the officers that we exposed. I exposed them. This is a very minor infraction that you guys committed. It will just be like a little slap like just a little mark on their paperwork. That's it. Nothing major. Can you help us out with anything? Uh no, that's that's it, man. I'm going to sit here and you know, maybe make some phone calls. All right, guys. So, this is [music] the watch commander and the corporal. This is the number. You guys want to let them know how their customer service was today. Feel free to do so. The man achieves his goal by documenting the entire incident and preparing to file a complaint. However, what happened raises a bigger question. Is this just an isolated case or a widespread issue in how authority is exercised? Up next What seemed like a simple check quickly turned into a confusing situation when an officer started asking questions. And everything stopped following the usual script. What's going on? Uh some guy was riding a motorcycle riding a four-wheeler up and down here. Oh, really? That's always where it goes with HOAs, man. They're funny. I hope you don't live in an HOA place. Oh, that's crazy. Hey, I was going to ask you a question. I noticed that your tint is below your AS1 line right on your car. And I was going to see if you mind if I check your tint on your window real quick just to make sure it's legal in the state of Florida. Is that cool if I do that? Why? You don't have any problem, right? If it's if it's unlawful. I got a tint meter here I can do it with, so. I mean what what's the purpose? Well, you're in violation of Florida state statute right now for the tint being over the AS1 line. I think most of the equipment is actually valid. I think you can actually Anything with emergency equipment as far as like a police car, paramedic, or firefighter, I think it I believe it's legal actually. I think we're exempt. Yeah, so the only ones that are exempt are unmarked police cars, uh private investigators, and um uh and some of the emergency vehicles like the fire departments and stuff like that. So, but since we have that probable cause that shows that one is, you care if I just take it out and see what your tint's at? You don't have any problem. But you have any If you have one, you put yours on there as well. Okay, but what's Are you videoing me, Officer? Yeah, yeah. Okay, but what's the what's the issue? I just want to make sure you're you're in compliance with the Florida state statute. That's all. I know it's not your car. You're not technically responsible for it and then probably someone else installed it, but um I was just going to double check to see if that's good. Okay. Yeah, that's fine. I got my supervisor real quick. Yeah, that's fine. You want me You want some You want to I don't have a problem with it, but I just want to, you know, talk talk about it real quick. I just want to make sure I'm not messing up on my part. >> Right, like a policy and stuff like that. >> Correct. Yes. Just out of respect. I mean, you want ID or anything like that? >> Sure, yeah. I'll get out the paperwork. Okay. Can I see your ID real quick? Yeah, that's cool. You can have it. I'll put my license on the seat. >> Only if you're under suspicion of a crime I'll give it to you. That's it. So Well, you actually voluntarily gave your ID. Is that okay? No, no, it's good. I'm going to say I'm going to say no. But yeah, like the AS1 line on here is basically it's just a tiny bit um right below there. What's your chief's chief's name? I can't remember. Sorry. Sandfor. I have a The man remains calm, but clearly isn't accepting everything so easily. And as the situation unfolds, new details begin to emerge, pushing the interaction in a completely different direction. Sorry. So, we're at Officer Preston here. This is uh Winter Springs. But yeah, uh what's your chief's name? I don't remember. Uh Chief Eiser. Eisler? Yes, sir. I'm trying to think if that's the one that uh that I talked to. Um and I was telling him the only thing you got to do is just take literally take a razor and just go so it's above that AS1 line and then you guys are in compliance right here, so. Well, honestly, I'm ignorant when it comes I'm ignorant when it comes to this, but I have a supervisor, you know, confirm it because honestly, I don't know the for sure answer to it, but I believe emergency vehicles are exempt, but don't hold me to it. >> It's only unmarked. That's the only ones that are. Like regular police cars, no, they're not. Cool. Um Let me wait till I got some backup coming just to make sure. He might know a lot a lot more about this than me. That's cool. So, yeah. You sound like you're from Georgia or Tennessee. Alabama? All right. That's cool. Very nice. Yeah, I was going to say that's on there. But yeah, you have a tint meter in your car, right? Yeah, I believe I should. >> Okay. Yeah, if you don't, I mean, sometimes >> till Absolutely. What I was going to say is some policies indicate on the policy cuz I helped write some policy before that says that you can't let anybody install something on your car other than what, you know, your supervisor approved. So, he might be able to let you check it just to make sure you're in compliance like that. And that's all we do cuz you can see my car right there is um is all tinted out. I've got the front windshield tinted. I've got that, but I have a medical exemption. Okay. So, that's what it is. But yeah, I appreciate it, man. I'm going to hopefully I don't hear any four-wheelers. We're down here circling around for a while and I didn't hear any. >> to stick around like it's a mall for me? Yeah, I'm just going to I'm just going to open up the trunk real quick. I'm not doing anything. I just so you can't read my tag. I'm just sneaky like that. >> [laughter] >> It's called the Jeff Gray. What's a Jeff Gray? Uh basically, if you go over there and push that uh trunk down and get the tag on it or anything like that, you're actually doing an unlawful search. Yeah, absolutely. I can't do that cuz you're you're not underneath criminal violation right now. Except for I'm standing in the damn road. Damn, we got me now. There's PC. Yeah. I'm just kidding, so. I'm not much on pedestrian violations really. Yeah, my friend just got arrested in um in South Florida for crossing at a uh at a not at a crosswalk and uh it just got dismissed. So, I was like, "Man, I'll be doing that." The explanations become inconsistent, forcing them to call for backup, showing the situation is starting to slip beyond their initial control. But it doesn't stop there. Right after this, a seemingly simple request is made and the situation suddenly takes a completely different turn. How are you, sir? Hey, good. I've already had a practic uh you know, a prostate exam. I don't want any of that again. Oh, you just have the gloves on normally? Yeah, I I was just at another call and I had I came here from right from another call. >> Yeah, no Hey, it's no problem. Um Can I take Do you mind if I take this off here? Oh, yeah, you're cool. I don't mind. And the governor already exempted it, so you know what I mean? So, anyway, I I think he might be right. They're exempt. I just want to see what the tint is on there and um and see what the darkness is. That's all. Um I think our vehicles are at about 16%. I have a tint meter. I do, too. Oh. Um Yeah, yours is the same. I mean, if I could just check yours, I'm not going to I'm not going to write you a ticket or anything like that. Just I know it's 16%. Law enforcement vehicles are are exempt from the tint code. Law enforcement vehicles and private investigators. That's right. Yeah, do you mind if I just check it just look? Can you have Can you do your And that's halfway? I see. Half halfway? Cool. Oh, you keep Oh, thanks, sir. I appreciate it. So, Haddaway right there and that's Officer Operations Bureau. Got his email at mhaddaway@winterspringsflorida.org. There we go. Oh, there it is. There you can see it. You have a YouTube channel? I do. What is it called? Do you want me to ask you? >> Madison Audits. Oh, that's you. Nah. I'm I'm from You You travel, don't you? >> I do. But yeah, here's my ID if you want that. Oh, yeah. I don't want you to suspect me of a crime. I'm just kidding. The viewers will love it. Oh, you have the big giant one here. I got the small one. Same company. >> I had that one on my last shift and uh and they they keep them specific to the squad. So, when I change shifts, now I got a new one. Sorry. So, Haddaway's here doing the proper thing. You want to make sure the calibration test work out good first and it's going to show the two different tints on there and that's going to be it. He's got a good valid read on both of them. It's showing reading good. You mind if I just step over here and All right, thanks, sir. It's 18. So, it's 2 off. We got 18% in Florida right here. That is in violation of the law. I don't know if Officer Preston will write you a warning. Well, I know he's not going to write you a ticket, but in Florida, the uh the actual statute only exempts unmarked police The tension isn't as intense as before, but a new, more notable issue begins to emerge. And just when everything seems clear, the situation unfolds in a completely different direction, where the real explanations and true intentions start to come to light. Not another name? Um and also in Florida, the tint installer is supposed to put a placard on the inside of the door right there and when you open it, I didn't see one on there, so. That's right there, so. And your channel again, I'm sorry. James You're going to forget it? What? Yeah. you have a business card? >> I will. Hell no, I don't have a business card. Yeah, they going to my fingerprints. James Madison audit. It's like the founding father. So Oh, yeah, I'm going to post it. I have a question for you. You don't have to answer it. Do you know his name or his channel? Oh, yeah, yeah, I know who he is. Yeah, so he is. I don't answer questions. Have a good night, guys. Thank you. I'm just kidding. I'm joking. I'm joking. That's So my mission So going to There's a I have a website that's called jmaudits.com. So 10-13 is code four like here. So that's what it is. So I have a I have a website called jmaudits.com. And if you can't remember that, I got your email. I'll send you an email. The uh The reason why I did this is a cop in my local town threatened to arrest me for filming in my driveway, but my wife was filming. She was about this far She was about this far away filming. And we were trying to document a stalking issue with my neighbor. Anyway, long story short, he says, "If you film me, I'm going to take you to jail." And I said, "Well, I guess do it." So he says 2000 What did I say? 2009 10? Yeah, 2010. And Smithy coming that court case has already been out. And I had to work the next morning and I had to fly I actually had to fly to Dayton, Ohio. And it was like I could not miss that. So if they get you on a stupid felony wiretapping, they'll be like, "It was the law enforcement. No bond." And it just be It'll be a a headache. So he did that. Threatened to arrest me. And long story short, that was Yeah, the felony wiretapping statute. Yeah. Yeah. For recording. Yep. No, recording the officer while he was on my property. Yeah. So that's what started. He said, "Go ahead Go ahead and turn around put your hands behind your back." And I was like, "Whoa, he affected an arrest." That wasn't an arrest. So I said I said, "What?" I said, "All right." I told my wife, "Shut it off cuz I couldn't take the arrest." But she was filming, not me. She was. But he was arrested. The situation ends in a rather unexpected way. No citation, no arrest, but it exposes several concerning issues in how the law is enforced. A citizen may file a lawsuit under Section 1983 [music] if their rights are violated. And officers who commit misconduct can face damages, disciplinary action, or even termination. A civilized society requires not only a strong law enforcement system, but also transparency, fairness, and respect for human rights in even the smallest actions.
