the car you stepped it up not me while driving home from dinner with his family a man noticed an officer speeding past without Hazard or caution lights switching lanes recklessly and without signaling under California vehicle code section 22350 drivers must not exceed safe speeds or operate their vehicles unsafely shocked by the officer's blatant disregard for the law the man yelled out of his must not turn or move a vehicle from a direct course until such movement can be made with reasonable safety and an appropriate signal has been given as he pulled off the road the officer activated his red and blue lights initiating a formal stop the man stepped out of his vehicle phone recording only to find himself staring down the barrel of the officer's drawn gun his hands were clearly visible but the officer's aggressive stance terrified the Man's children this is what I do on a regular I keep you guys accountable okay okay you know why I stopped you today I know why you stopped me but do pull over he flips on his red and whites and then pulls me over now he's requiring that I give him identification for a traffic stop that I personally initiated that I asked him to pull over now we're interaction here your officer tried to place hands on me three different accounts I do have this on video and I'm asking him to just leave me alone um so what I'm asking him for is just to leave me approached the man with aggression using force in a situation where it was not necessary according to California Penal Code code section 835a an officer is permitted to use reasonable Force when making an arrest but only when necessary and within the bounds of law the officer escalated the situation by pulling out his weapon creating an unsafe environment for the man and his family the officer actions were a blatant overuse of force violating the standard for what constitutes a reasonable arrest this Behavior was entirely disproportionate to the situation and went beyond the legal misconduct under California government code section 3304 supervisors are responsible for reviewing their officers actions especially in cases where excessive force or misconduct may have occurred the supervisor's inaction signified a lack of accountability allowing the officer's overreach to continue unchecked the failure to hold the officer accountable perpetuates corruption and undermines the Integrity of the department this lack of oversight Fosters an environment where officers can act without fear of consequences now it's conspiracy what the hell oh my God there's so many 241 and 242 there's so many you're going to [ __ ] know dude I'm not a threat I'm a minor I'm not telling you nothing we want a supervisor you dud I'm not telling you nothing somebody H this [ __ ] I want them his right to free speech under the First Amendment individuals that have the right to express their opinions even if those opinions are critical of law enforcement as the man was arrested and transported to the station his wife approached the supervisor questioning the officer's conduct the supervisor however failed to provide any satisfactory explanation or take action allowing the officer's abuse of power to go unchecked so I'm going to jail now because I wouldn't listen this is now kid when it was a registration thing really I guess I'll see you guys tomorrow what are we doing came after us okay looking for a reason to pull us over dad signaled for him to pull over and he flipped on his lights okay okay I again I came after obviously okay so why is he being detained no he was arrested well right why is he beinged the reason the officer gave was obstruction of justice okay so that's the reason the officer gave and again I don't know the reason to stop she just explained the reason to stop because I wasn't here you know I wasn't here we responded after right so the officer said hey I got a person that's was not agreeing with me so request another unit so that's what it was okay so you have the vehicle vehicle wasn't stored toad imp pound anyway right you have that vehicle he's going to go to the county jail Amor County Jail we called a supervisor as well um over the fact that his officer was not behaving correctly okay so we don't have a supervisor working I'm the the officer in charge I guess you could say okay so and that's just kind of the way it works all right if you don't have a supervisor working you just you get to talk to the OIC it's called OIC officer in charge okay so we just all three our aren't working all the car for because when dispatch centers our Dispatch Center is in Stockton and when they say hey I've got an officer that's requesting a second unit saying hey just in case there's a fight I don't want anybody to get hurt just in case there cuz obviously we have emotions that are up elevated saying hey bring me another unit because I need to deescalate this I'm going to help I'm I need somebody to help me deescalate it if if you listen to me but if you listen to me okay so if if that officer and that person is not they're not working for whatever reason the personalities aren't messing well and he's obviously upset your family member right sometimes other officers can help deescalate that okay so okay so obviously you saw his his demeanor in the car and we just the officers soon as the other officers got here the deputies in fact the sheriff's department they left right once we knew that everything was stabilized you guys were over here because you're right on top of a troll car in between the officer and that person you were right on top of it basically what we can do is separate everybody out talk to you as we're doing right now and try to deescalate and stabiliz okay that's kind of how it works all right and what's going to happen your officer was very out of code and rude very rude he reached he reached for the car's door handle our car's door handle with no consent okay and was telling him that you need to get back in your vehicle when Dad was the one that had done a a citizen's what was it citizens not arrest um he was just pulling him over to war him bre the law he was breaking the law he wanted to inform him that he was breaking the law the officer got out of hand and the officer stepped out of his are you saying that the that your family memb I'm sorry her dad dad was essentially stopping the officer yes so your dad was doing a traffic stop on a marked unit he's done it before he done it before he has we caught a sheriff one time the bumper was kind of half hanging there and he was feeding it was dangerous so he had do you think do you think that's normal it's normal when he's trying to have officers years I'm telling you it's not normal okay so yeah but that's not the that's not the job of anybody to say hey I'm going to pull over a marked patrol car and just do that okay because your your car has to be marked specifically there has to be laws and author behind that cops are only upheld by the citizens okay they are only held accountable by the citizens how old are you I'm 14 almost 15 you're 14 years old okay under California penal code section 837 PR private individuals may perform a citizen's arrest for a public offense committed in their presence in the end the officer issued a ticket for the alleged expired registration the original reason for the stop but the man's arrest was unwarranted according to California penal code section 849b a person arrested for a misdemeanor offense that does not involve violence must be released after a reasonable period the man's arrest which was based on an unjustified escalation of a routine traffic stop resulted in unnecessary charge and further distress this case highlights the need for greater accountability and transparency in law enforcement as the officer's misconduct went unchecked the incident ultimately left the man facing charges for obstructing an officer even though his only
