I'm just asking you what's for, that's all. There's a hundred feet. >> our that's that's our information. We don't we're not privy to sharing any information, would you? Can you see it? You want to trade IDs? I mean, you've got my ID. No, your your ID. Okay. So, you're going to be trespassed from here? The police thought this was just a simple check, but they didn't expect the man holding the camera to know the law so well. Nope. What is that? >> [music] >> It just me by good citizen. Good citizen? Absolutely. Okay. They don't want you to come back. Well, let them know if you go back. >> what I need from you >> If you can go back in there let them know I trespassed them as well. I never stepped on their property. >> you is your ID. Can we get a supervisor out here, please? Sure. Yeah. When police abuse their authority, the consequences don't just end with a confrontation on the street. They can end in a courtroom. Just seconds after the camera starts rolling, two men begin filming around a gas facility in Apex, North Carolina, but when employees notice they're recording, the situation quickly becomes tense, and a call to the police is made immediately. Is NC Tire owner? Jordan LP propane Yeah. Just asking. What? Is there something I can help you all with? No, we didn't ask for no help. Okay, well, you're on private property. I was just curious. Really? Yeah. >> to park here? No, it's not. It's not a parking space. Let me call the Apex police and see if they'll come. Yeah, that's cool. I I think you need to learn where your property lines are at, though. Well, it's just we're a hazardous materials facility. >> I know what y'all are. I can I can see the gas tank. We're required by the federal government to have somebody on our property to see what they're doing. >> Well, that's that's the thing. We're not on your property. So, what what applies to being off of your property? No comment? That's what I thought. Required by the federal government to alert people that's on their property, but we're not on their property. That's the thing. Look at that big old smiley face. That's pretty cool, huh? Yeah. That's pretty cool. Damn, that was fast. Look behind you. Wow. Here they are, guys. That was like 2 minutes. Not even 2 minutes. That's crazy. Just minutes after the gas facility employee called the police, the situation quickly began to heat up. The two men filming insisted they were standing on public property and had not violated any laws. Then, an unexpected statement stunned everyone present. They claimed the FBI had already been called. Supervisor. How you doing, gentlemen? What's up, man? Beautiful today. All right, it is. Oh, what brings y'all out here? Just doing some free recording. Okay, what are you what are you recording exactly? Well, you at the moment. Uh we was recording everything that we can see. Okay. There's a demand for video. And we try to try to collect as much videos as we can. Burrow, is that how you pronounce that? Uh it's Burrow. Huh? Burrow. Burrow. Yeah. You got a number? Huh? You got a number? Uh >> Badge number? ID number? Call number. Huh? Your uh 166. >> to figure out like what's what's going on out here. What what what's to figure out? We We just told you we was filming. Okay. What else is there to figure out? What for? I'm just asking you what for. What It's It's our That's That's our information. We don't We're not privy to share that information with you. Yeah, we can't really say. What is that? Why would we? I don't know. Just general conversation. Well, I'm not having a cordial conversation with you right now. If we let out our secret, you may start doing it and take all the profits. Ah, so it's for profit. >> No, But didn't say He said it. >> Okay. Okay. All right. All right. We tried to anyway. Do you gentlemen have ID on you at Absolutely, we got ID. Okay. Can I take a look at it? Absolutely not. So I can't know who I'm talking to? Nope. Why is that? Address me by good citizen. Good citizen? Absolutely. All right. I've already called the FBI field office. Okay. Okay. All right. Is this your office vehicle right there? Yep. Okay. All right. So, I mean, obviously you realize you're not allowed to be on private property. Who said who said who said that? You said it, man. Okay. I like that the choo-choo train going by. That's That's when the train's out here. Uh under the Homeland Security Act, we called in Homeland Security and they were about to tell us to get off their property. Ain't allowed to film at their property. After the police approached and began asking basic questions, the conversation quickly became tense as the two men filming repeatedly refused to provide their identities. But instead of calming down, the situation escalated further when one of them accused the officers of deliberately trying to provoke them. Listen. Don't instigate. I'm not Who's instigating? I'm just walking around like a free American, dude. Okay. Stop Stop trying to trouble. All right. Stop You stop trying to escalate. >> No, we're not doing that. Stop trying to escalate. All we doing is walking around like free Americans. We We able to do that. We are free Americans. There ain't nothing against the law that we're doing. Absolutely. All right. Then stop. Then stop then. Okay. I don't know I'm not sure why you're hostile. >> I'm not Who's hostile? I'm telling you to stop instigating yourself because I wasn't doing anything but walking. >> Well, unfortunately still instigation is occurring, okay? Well, the same with you. How about that? >> non-confrontational individual. I'm not trying to be confrontational. >> I live and let live, so I'm not trying to be confrontational. I'm I'm a a law-abiding citizen. Okay. Would you do me a favor? Can you do me a favor? >> Have you ever done me one? Huh? Have you ever done anybody a favor? Can you just be like uh just be like civil with me? Cuz you said you're a good citizen, right? I'm absolutely. I'm a law-abiding citizen. >> good citizen? I don't break the law. >> Okay, can you be a good citizen and and show a little respect towards her talking to her? Yeah, man, this is this a free country here, right? >> Huh? I'm just asking if you would show the same respect to somebody else that you would want. That's all. I I don't mind if somebody talks beside me, man. Well, people are different. But you already know you should there's no expectation of privacy when you're in public, right? Okay, I'm not asking for privacy. >> Do you understand that? I'm asking for respect to another human. Respect, I haven't disrespected her. Okay. Not one bit. >> I didn't say you did. I'm asking if you would show her the respect of I Why would I not do that now? Cuz I hadn't disrespected her yet. Thank you. While the police tried to keep the conversation calm and under control, the two men filming insisted they were simply exercising their legal rights. The atmosphere at the scene began to grow unpredictable as the back-and-forth between both sides became increasingly heated, and just minutes later an unexpected situation unfolded that caught everyone's attention. Look. Can I get your name and uh phone number? You got uh what, 324? 324, yep. Officer Myers. Myers, what's up, Myers? What's going on, man? How What's your name? Uh good citizen. Citizen, all right, man. Yeah, man. That's fine. How are you doing today? I'm great. Enjoying this beautiful day as a free American. It's too hot for me. No. >> That's why I was in the shade. No, I I mean it ain't too hot yet. I mean, we chose the one spot where there's no shade, right? Wait till Wait till it gets 100, what you going to do then, cuz? I'm going to go back to >> I'm not worried. [laughter] I don't know, right? Man, 2 minutes, dude. That was like, what the freak? He was probably at the He was probably at the police department. They've been doing some vehicle stuff over there, so. Right. Where are you guys from the area or Uh yeah, we not going to tell you where we at, man. Come on. Where Stop fishing. No, I'm No, I'm just trying to get to know you a little bit. We're not going to do anything. No, we're we're we're we're just filming clearly. We're all about it. We're all about it. Citizens. This young lady here thinks that we was, you know, she's got some kind of obligation to uh, call the police when we just out here enjoying this beautiful day. >> She thinks we're on her property or not. I think she's trying to find proof that we can't film on her >> Right. She good luck. I mean, if she wants to do that, that's upon her. I'd like to see it. Good luck with that one. >> Because, you know, if I was a if I was an officer No doubt. You'd be a supervisor. But, you know what? I've I've met some supervisors that didn't know uh, and shouldn't be supervisors. But, hopefully, uh, you know, he sounds like he seems like he knows what he's doing, what he's talking about so far. Yeah, I mean, you know, we we both just operate under what we understand as the law and stuff like that, so We do, too. That's the boss. How are you? Yeah. That's my boss. >> [laughter] >> Yeah. No one here to protect us anyway, you know that. Yeah. I got I got Mason in my pocket. I can take care of myself. Well, I just do do me a favor, just keep it in your pocket. It'll stay there long as it long as they don't come over here, I'm good. The police continued trying to keep the conversation under control while the two men filming firmly stood their ground about their right to record in public. But, just a few minutes later, the situation began to take a completely different turn. Probably 60, maybe 60, I don't know. All right, gentlemen. Y'all want to move in the shade a little bit? I don't know. As long as you get my As long as you get my good side. Right. You got a bad side, that ain't good, man. >> know. That side of the shows me the a little bit more slimming. Right. All right. So, listen, do us a favor. You don't owe me a favor. I'm not asking you for a favor favor. If you if All right. I'm just asking you to >> asking it, though. You keep saying do me a favor. >> you were a good citizen, so I'm I'm going to take you on that word, okay? >> We haven't I don't break the law. Okay, good. Let me just I I you being a good citizen. And being a good citizen, I'm going to ask you if you'll stay off their property. We haven't been Stop. Stop. Don't give us directives. We We're grown. We're grown. Listen, we're two grown men, though. Okay. Why would you give us directives? We know not to go on the property cuz we haven't been on there yet, right? All I'm asking you is if you'll stay off >> all means. All I'm asking you is just to stay off their >> man. We know the law. >> Okay, good. Okay, then you don't have to say it. We We're grown men. We know this. We do this for a living. >> We're just saying it because they're recording. We do this for a living, though. We already know. Do y'all got body cams? Yes. Well, they got cameras up there, okay? So, No, I ain't worried about that Man, we I know See, we already know where the property lines are at, right? They don't even I don't even think they know where they are. >> Okay. Well, they're they're going to leave you alone. We're going to leave you guys alone, all right? Don't Should we leave the same time they do? Call that guy >> No, I ain't worried about that guy right there. He He threatened to beat us. I got I got something for him. >> Just tell him to stay away from us. >> something for him. We told We told them all to leave like once he gets in their car, they're going to leave, too. I know. All right. I know what they're saying. Just stay off their property. Uh And then he he just couldn't help giving directives, could he? Huh? That's what they do, man. They just couldn't help it. No, he's going to Yeah. After nearly an hour of tension, the situation finally began to calm down as the officers decided to leave the scene. No arrests were made, and the two men filming remained in the area they believed to be public space. Up next, a man with a camera walks along a sidewalk in Kansas City with the goal of testing whether people respect the right to record in public. But just minutes after the camera starts rolling, an unexpected encounter takes place. What they doing? You know, I'm kind of thirsty. Hello. Is she going to go? See how she handles this. Hey, can I help you with anything? >> Yes, how you doing? I'm just recording. >> You just recording? Yeah. You just recording? >> I'm just shooting a video, I promise. >> a video? Well, what you shooting a video in here? >> Okay, I can come in. >> Yeah, we not busy right now. It's perfect time. That's what's up. What's your name? Moses. You are what? I Moses. Moses? I'm Tia, nice to meet you. >> Hey, how you doing, Tia? I'm good. This is nice. Thank you. I was kind of thirsty. Well, why don't you take a look at the menu here? We got energy drinks and we got protein shakes and smoothies. Give you a little second to look over it. Okay. I was a little worried this morning. It was cold. >> so I went with uh Is he You know, I'm ready for it. Okay, guys. Hey guys, I'm trying to act She got the big straws. Hey. It's my first drink. Oh, it is? Yeah, so I I told her something with pineapple in it. How do What do you think about the drinks here? I love them. You love them? Okay. Well, let me be the judge. Mhm. >> [clears throat] >> That was good. I must say. Yeah. It's a blackberry cobbler. A blackberry cobbler. That was good. Can you do me a favor and let me have a Google? After a fairly friendly encounter at a drink shop, the cameraman continues his walk along the sidewalk, recording everything around him as usual. But just a few minutes later, the situation quickly escalates when a call is made and local police arrive at the scene. I can't I can't I can't hear. Can I help you? Excuse me? Sir, may I help you? Do you have a bottle of water and a sucker? No, I don't. Oh. But you can't be videoing our building. What's she I can't I can't even hear you. I'm sorry. What did you say? You can't be videoing our building. I I am record I can't hear you, but I'm record I guess I'm recording if that's what you said. You can't Why? I'm sorry. Why are you recording our building? I was working on something. Okay, but you can't be doing that. That's not secure. We can't have you recording this building. Can you scoot a little closer? I can I can barely hear what You cannot be recording our building. Oh, I'm not going to go inside or I'm not going to go on your property. I'm not going to go in there. Can I ask you something? Man, I wanted her to come a little closer. She's yelling across the parking lot. Well, okay. And here we go. Officer, man. How you doing? We got called here cuz you're recording the building and the employees. I'm doing what? Recording the building, record recording the employees. How would I be able to What's your name and your badge number? >> Clint Albright. Yep. Clint, badge number 2205. Okay, now say that one more time what you just said. So, got called here because you're standing outside of the bank recording and recording employees. They've asked you to stop, they've asked you to leave. They did not They didn't say neither the of those. Well, what what >> And why would And how would I be able to record the employees if they inside their bank? I'm not sure. But >> Yeah, that's a good question. What exactly are you doing? Oh. What what exactly what you see. Which is? What am I doing? I mean you're recording the building for sure. >> I'm recording that. We're recording the birds. As soon as the police arrived, the first questions were asked to understand what was happening in front of the bank building. But then the cameraman began asking the officers a completely different set of questions. Within seconds, the atmosphere of the scene became more uncomfortable as questions about legal knowledge were brought up. I mean, let me ask you a question since you actually standing right here. Um Uh what's 550 divided by 2? 225 or 275? Okay. And just uh hypothetically speaking, um if you was at home like sleep and your best friend came like beating on your door ringing your doorbell for breakfast. Mhm. All you got to eat is cookies, cereal, and milk. What do you open first? I would the door. Okay. And if I can get two more out of you, uh what is the third and fourth letter in alphabet? Third and fourth? Yeah. C and D. Okay. And uh the last question I can ask you is um What's the first amendment? First amendment? Yeah, the five elements of the first amendment. Oh man, it's so long. So long? What do you mean by that? >> since I've like studied that. Studied studied that specific amendment. The first. It's the first. Free speech. Mhm. Religion. Mhm. Uh You tell me. How long was academy? The academy? Yeah. Mine was a year. A year? Yeah, that was like 8 years ago. 8 years ago? I'm not saying that you're doing anything >> No, you're fine. I'm going to let you try to redeem yourself. What is the fourth amendment? Fourth amendment? Yeah. You're giving me hard ones today, man. You know the fifth? What's the fifth? Hey, Aguayo. Do you mind if I stay with him for a minute? >> You know the fifth amendment? Yeah, he's just recording. You know the fifth? After a series of unexpected questions about constitutional rights, the atmosphere between both sides began to grow more tense. However, the situation quickly shifted to another stage when the issue of identification was suddenly brought up. From that moment on, the exchange between the two sides became much more heated. What's the first? And all of that. Well, what is what is the rest of the all of that? It's five elements. Yeah, it's five elements. Do you Can you Can you Do you know the five? No, not off the top of my head. I'm going to let you redeem yourself. How about the fourth amendment? You got any ID on you? Huh? You have any ID on you? Uh, sure. Can I see it, please? Can you see it? You want to trade IDs? I mean, you've got my ID. No, your your ID. Okay. So, you're going to be trespassed from here. I wasn't on their property, though. Okay, they don't want you to come back. Well, let them know if you can go back >> So, what I need from you >> can go back in there, let them know I trespassed them as well. I never stepped on their property. >> from you is your ID. Can we get a supervisor out here, please? >> Sure. Yeah. I'm going to scoot on this side just so I won't be so close to the curb over here. >> [snorts] >> Yes, you guys. So, we got Officer Glenn. Um He's actually demanding ID from the sidewalk. And you never went on their property? And when we request his body cam footage, I'm sure he asked the bank do he want them to trespass me. I bet. Cuz we going to the we going to we going to request the body cam footage. And I um I don't even I'm not even shocked that he asked me for my ID because he don't know the first or the fourth amendment. And the fourth amendment is exactly what he just did. Oh man. After the request for identification was refused, the conversation between both sides continued with growing arguments about civil rights and the limits of the law. Just minutes later, when a police sergeant arrived at the scene, the discussion finally moved into a completely new phase. It's coming up. Yeah. How's it going, man? How you doing, man? What's your name and badge number? >> Sergeant Rippy, 0315. >> How you doing, Mr. Rippy? >> I'm not too bad. How about yourself? What you got for me? I I don't have anything. I was told you wanted to talk to me. >> Am I detained or free to go? >> No, you're free to go. You haven't done anything wrong. Okay. I mean, that's all? Okay. Did the bank want to talk to me about anything? Nope. Okay. He just requested you, so. Yeah, yeah, because Mr. Quinn, he said by law I have to give him my ID. Uh I mean, yes. By law? And I'm on the sidewalk, minus no crime. They want you warned for trespass, so we want to know who you are so that we can give you the trespass warning. Yes, I've never been on their property, though. You don't have to be on their property for them to tell you that they don't want you to come on their property. But the reality of it is is we know who you are, we'll recognize we've been dealing with you for the last several days. So if you show up on their property, we'll find out the rest of the information that we need, we'll go about it that way. Exactly, Mr. Rippy. So I'm not worried about If you can do me a favor, can you go back in there and let them know I want them trespass uh from mines as well. From yours where? My property. What property where? Can you just tell them that not to come on my property as well? >> They have to know what property they cannot go on. You just tell them he don't want you on his property as well. But they have no way of knowing what property that is. >> Well, tell them I don't want them on The whole point of trespass warning is you know where you're not supposed to go. All right, tell them I don't want You're here, so you know that you can't come here. >> Okay, tell them I don't want them on the sidewalk. You can't do that. That's public property. Okay. Just like nobody's telling you that you can't be on the sidewalk. Perfectly legal for you to be here. Okay. All right. That makes sense. So. That makes sense. All right. Good. So. Hey, one more thing. Oh, oh, oh, oh, oh. Real quick. I'm This is This is something so serious, Mr. Rippy. Can you help him out with something? >> This is all your follow-up nonsense questions. It wasn't It wasn't The first amendment When the supervisor arrived, things quickly became clear. No violations were identified, and the tense encounter ended with no one being arrested.
