officer continued to treat him as if he were a criminal excessive force is prohibited under the Fourth Amendment when there is no probable cause according to Graham V's Connor this disregard for basic rights paired with the officer's attempt to turn an innocent situation into an unnecessary confrontation shows how corrupt cops often overstep their bounds and harass citizens simply because they feel they can treating the man as a suspect without justification the officer's actions in this case reflected not just a misuse of authority but a clear example of racial profiling just like in this stolen vehicle despite there being no direct evidence linking him to the crime the officer demanded identification to verify his name implying that he might be connected to the stolen vehicle simply due to his presence in the area under the Fourth Amendment the law requires police officers to have a valid reason for stopping and questioning individuals and in this case the mere Act of walking through a neighborhood is not a sufficient reason to suspect someone of being involved in a crime even after the man provided his name the officers continued to question him aggressively and even suggested that he could be involved in a stolen vehicle case according to Terry versus Ohio a brief stop and frisk may be justified if the officer has reasonable suspicion that a person is was or will be involved in criminal activity however the law was clearly misapplied here as there was no legitimate basis to suspect the man of any criminal activity let alone detain him well I'm looking for your
