Next time you come out to where you Yeah. >> Thank you. >> Want to have a conversation with you. That's why >> we had a conversation with my friend. >> Just for holding a phone, [music] he was instantly shouted at with, "Shut up." Tensions erupted outside Kensington Police Station. >> I have to look at your phone. >> You're not going to look at nothing. Why? >> Cuz I said so. >> In the heart of London, a citizen is surrounded by police. Right at [music] the station's doorstep, rights or abuse of power. >> Why are you filming on the phone? >> Who says I'm filming? >> I just saw you filming. I've seen the phone. >> What do you mean? >> I've seen the phone. And [music] he's basically watching me as well. >> Right outside the police station, a citizen was surrounded and forced to give an answer to something he had no obligation to. >> Trying to bully me like this and trying to intimidate me. He tried to intimidate me. >> A tense moment erupted. Just for standing on the street, he was immediately ordered to leave. But was that order even lawful? >> Are you filming? >> Who are you? >> Are you taking a picture? >> No. >> Are you taking any pictures? >> Why are you filming on your phone? >> Who says I'm filming? >> I just saw you filming. I've seen the phone. What do you mean? >> I've seen the phone and he's basically watching it as well. >> I can see a live screen on your phone. >> Live. >> Are you filming? Right. >> Who says? >> I can see you filming. Are you filming? >> He is filming it. >> Yeah. >> What's the reason for you coming around here and filming the station? >> What? >> Why are you filming the buildings? >> I was looking. >> Why are you filming the building? >> Can I show you? >> I'm sorry. >> I don't like being surrounded. >> No, no, it's okay. >> Don't surround me. >> Why are you filming the building? >> I'm just asking you a question. Why you filming in this building? >> Do you show you or >> Yeah. Why you filming in this building? >> Would you like me to show you? >> Yes. Yes, sir. >> Come with me. >> Show me. Show me your phone. Show me your phone. Why you Why you filming this building? >> What do you want me to show you? >> Why are you filming this building? For what reason? >> I said I would show you. >> Yeah, show me. >> Let's go. >> Go where? >> Show you why I was filming. >> Show me your phone. If I was you, >> why you show me in your phone why you why you're in the building? >> What's the purpose of you being here today? Why are you here? >> Why are you filming the building? >> Why am I here? >> Why are you here today? >> Here. >> Yes. Why are you here? What are you doing in the area? Do you live in the area? >> No. >> Okay. So, what you doing around the area? What's your purpose of being here today? >> Can I not be here or something? I >> was asking a question. Why? Why are you You've come here and you're all you're doing the police building. >> Why are you here? When the police threatened to check the phone, a serious question arose. Could this be an act of exceeding their authority? >> Get away from me, man. >> I'm not going to be intimidated. Get away from me. >> No, I can be what I want. >> I can be what I want. So get away from me then. >> Because Because look at you surrounding me like weird. >> Join us on the pavement. >> I said no. I want to be there. I will be there. >> You tell us why you filming the >> All right. Get away from me. You're too close. You're too close for me. Do you get it? >> Yeah, you can move on to the pavement. And there's tons of space over there. >> No, >> do you want me to show you? >> You can easily tell us why you're filming, >> but I don't have to tell you anything. >> Is there a safety concern cuz you're filming? >> I said to this guy, I will show him so many times, but then you're coming too close to me and I don't like it. And you're surrounding me. I said I don't like being surrounded. >> You going to show us on your phone? You going to show us what you were filming? >> All right. If I don't show you, then what happens? >> You going to show us? >> Yeah. going to be a concern for us because of the sea that perhaps we have to look at your phone and see >> you're not going to look at nothing. >> Why? >> Cuz I said so. >> Why? What is the sole reason for you filming? >> Well, I wanted to show you, but every time you just keep coming close to me. >> Yeah. >> Right. >> You're not communicating in the right way. You're not asking nicely. You're surrounding me. You're coming too close. Get off the road. >> All right. I will come down. >> Yeah. Go on. >> What's the reason you're here today? >> I don't have to tell you anything. >> Okay. So, what's the reason you filming this building today? >> Well, I saw something funny. So, I took picture of it. >> Why is funny, man? >> What do you mean? >> What is funny? >> I saw something funny over there. Was it? >> So, I took a picture of it. >> Why are you filming? You're not taking picture. You film me. >> I'm filming when you guys came out. >> You'd be filming before you come in. >> Okay, sir. >> A female officer suddenly snapped with a rude, "Shut up." While the citizen fiercely fought back, "This is public land. I have the right to stay here all day." You >> going to be You're going to insult me now? Are you going to insult me now? Are you going to insult me now because you keep aggravating me? >> No, I don't have to listen. >> I don't have to listen. I don't have to reply to you. I kept saying to this guy, I will show you what I filmed. I thought it was funny. Not film. Take a picture of it. I thought it was funny and I took it. That's the end of the story. And then I have you guys trying to bully me like this and trying to intimidate me. He tried to intimidate me. >> You try to intimidate me. Yes, you don't. You're not going to intimidate me. I will tell you that right now. Do you have a seat? But but you need to understand one thing before I show you. I need to explain something something to you. I don't have to. >> Are we clear on that? >> Are we clear on that? Once you you say yes then I will show you. >> I will show you. But >> I need to come to understanding that I don't have to. >> Correct. >> It's okay to show you. >> No. No. >> Do we have an understanding that I don't have to? >> Just it simplifies. All right, I will show you. Listen to my words. Listen to my words. >> Just listen. >> But he's not responding. >> But we can't help you. I do have to respond to you. You know what I'm saying? And just want >> So I have to respond to you. >> Just simple question. I said >> I ask you a question. >> What you was doing here? So you took a picture. Show me >> the funny picture. >> Show you. >> I will show you the picture that I thought it was funny to take. >> Show me. >> But if I don't show you, do you understand that I don't have to? >> Why you don't answer the question? >> We're not going like back and forth. >> Just go outside. This guy start >> just answer the question. You understand that? >> Look, I'm not going to understand you because it's like it's difficult. Okay. >> The garage door stood wide open. The citizen took a single step inside to expose the paradox. If it's really forbidden, then why is there no warning sign? >> You just come out to give me like >> I have, mate, because at the end of the day, you're stopping him from >> How did you stop him? He stopped me. Ask him. No, you were in the garage. >> Ah, don't. You're not going to lie now, are you? You're not going to lie, are you? >> Do me a favor. Just make sure you're not in the garage. Okay. You're not allowed to go inside the garage. I'm not saying you have gone in the garage. You're not allowed to go inside. >> Well, you better close the doors then. >> Okay. Well, no, we don't have to close the doors. >> Well, then I can go in the garage. >> No, you can't. >> Of course you can. >> No, you can't. >> Why not? >> Because it's not there's no public. >> What are you going to do about it? >> Why do you even want to go in there? >> Who says I want in there? Who said I want to go? >> Who says I want to go in? >> Tell them we need to close the doors. Well, if you don't want somebody to go in there, >> because if you got them open, somebody really >> Because everybody knows that they're not allowed to go into the police car garage. >> Says who? >> It's just common sense. >> Leave the comment. >> But if I did go, what you going to do? Not much. >> Well, I mean, then you'll be trespassing. >> Then then that's a civil, so don't enter. >> Then that's a civil matter, isn't it? >> That's all I'm saying. >> Yeah. Yeah. Yeah. >> You'll be trespassing, so don't enter the police. >> Don't It's a civil matter, my friend. >> You guys, you got to get your act together, man. Seriously, you can't just come around and bike orders all the time and think people will just do what you say. Don't do this. Do this. Don't do that. >> Oh, he's getting naked now. >> He's not getting naked. He's getting changed into his over. >> Why do you keep talking for him? >> I mean, you directly spoke to me saying he's getting naked. >> I was talking to the camera. You're not directing the conversation. >> I was talking to the camera. In the UK, police officers who act aggressively, show ignorance of the law or abuse their power can be reported to the IOPC, face disciplinary action, dismissal, civil compensation, and even criminal prosecution with a permanent ban from policing. No arrest took place, but the incident clearly reflects the police's lack of legal knowledge, aggressive behavior, and disrespect. Up next, right outside the police station, a simple question about ID turned into a tense confrontation. >> Came running like crazy. >> We just want to check what's going on. >> What do you mean what's going on? Every time somebody walks past, what's going on? Just know from them gates. >> Where's your shoulder numbers, my friend? >> You don't have shoulder numbers. That's not shoulder numbers. >> Clearly visible in the front. >> That's not issue by the force, is it? >> Okay. Like I said, >> where's your shoulder numbers? >> And my name. Okay. >> Okay. You wanted questions. Now we'll ask you questions. Where's your shoulder numbers? Where is your shoulder numbers? >> You're trying to get >> Where's yours? Right here. >> No. No. Shoulder numbers. Where are they? >> Epileps. Epileps. They called epileps. >> My name my number there. >> That's not issued by the force. I don't know if that's legit. >> Okay. Is 135. >> That's not issued by the force though, is it? So, where's your epileps? Where is your epilepsy? >> Yeah. Well, you are getting into an argument with your hands in your pockets. No epips. Can you come out here and give me rubbish just because somebody called? There you go. She's got epips. No public access. Oh, that's a shame. >> Hey, listen. Next time you come out to wear your rabbits. Yeah. Thank you. Just say yes, sir. Say yes, sir. Dude, just arrived here and they just came out in force. And look at them. They're all staring. Get back to work. >> Several officers suddenly rushed out at once, using security risk as an excuse. But could this simply be a cover for abuse of power? >> You doing? My name's Martin Green. I'm a detective from here. Can Can you see that? >> Yeah. >> Not really. >> No. I was just wondering what you were doing. We've just noticed you're wandering around with that filming everything. And obviously with today's heightened security levels, we're just a bit concerned about what's going on. Would you mind telling me what your purpose is for filming us and everything? >> Who are you again? >> My name is Martin Green. I'm a detective and I'm based with Northampton Chip Police here at Ketering. We've just noticed you're wandering around the outskirts of the building and you're doing some filming and we thought you had binoculars and a camera and obviously with today's heightened security risks. Yeah. >> Yeah. We're just wondering what you're doing. Could you just explain to me what why you're doing it? >> Yeah. I'm not that concerned about the high security. >> We are though. >> I know you are. >> Yeah. So that that's why I'm asking. >> So Mr. Martin, was it >> Martin? >> Mr. Martin, that is your problem, I'm afraid. >> Sorry. >> That's your problem, not mine. >> It's No, it's not my problem. It is. Okay. This building contains a lot of confidential information. Okay. And when people use highowered lenses to look through windows, then that becomes that does become our >> Oh, so now I've used high power and I look through the windows. >> I can see it now. >> Have I Have I done that though? >> Sorry. Have you seen me looking through windows? Yeah, we were in the top. We in our office. >> Stop telling lies, Martin. >> Okay, I'll come through. I'll come around and I'll speak face to face. >> Stop telling lies. I said >> I'm not telling lies. >> You're not telling lies. Looking through windows and all that. >> Okay. Shall I come around and have a word with him face to face? >> Yeah, sure. Yeah, you go. Okay. >> They even made up a story accusing the citizen of using a zoom lens to spy through the windows. But was that really the case? >> Uh, now you're pushing it a little bit too. >> I'm not. You just you said >> with that comment you're pushing it a little near the >> I can I can I can I can say anything I like my friend. >> Can you >> pretty much >> right almost. >> I'll tell you what then. >> Yeah. >> I will I'll just walk around and then we'll see how we go. All right. When you come out with comments like that. I'm being perfectly nice to >> You're not arresting me, are you for that? >> No, I'm not going to arrest you for that. >> All right. So, what do you want to meet again? >> Sorry. >> Do you want to meet someone else again? >> Yeah, just I'll just walk around. >> Where too? >> Where? Well, if you walk that way, we'll meet up the top there. How's that? >> Where's your wife? >> Because I want to have a conversation with you. That's why >> we had a conversation, my friend. >> Yeah. >> All right. Come on. >> So, yeah. Okay. >> Yeah, sure. Let's go. Where do you want to meet? Somewhere at the front. >> Yeah. There's a there's gap up the top. >> It sounds like you want to arrest me. >> I'm not going to arrest you. >> You sure? >> I think he likes me. >> Oh dear. Hey, hey, hey, hey, Martin. You can come through here. Look, >> that's a that's not very good for security. Look, anybody can go through there. >> Yeah. Been through here. >> See, you I think you might want to report that. >> Yeah, I will do actually. >> Yeah. Yeah. >> No, that's >> But to be honest, uh >> Yeah, >> I'm not under arrest. There you go. >> Yeah, I know you're not under arrest. >> Oh god, look. He used to look pretty cool. >> Okay. Yeah, that's [laughter] back in my younger days when I had some hair. >> I know. >> Yeah. >> I used to be black as well and I've gone white. What's happened? >> Well, look, >> all it is is, as I've explained to you a couple of times, >> regardless of whether you think it's something to be concerned about, we are concerned. >> When the citizens sneered, let your wife satisfy you, not me, the atmosphere exploded. Tensions reached their peak. >> It's like, are you calm and everything? I can have a conversation. Earlier you were like a bit >> bit bossy kind of thing. >> So I need to bring you down >> to low level. >> I'm definitely not honestly. >> Yeah, I know. But I don't know you, do I? >> Yeah. >> So I need to bring you down to the normal level. >> Thank you for bringing me >> below the public kind of thing. Once you understand that the public is above you, then I can speak to you. >> Okay, >> that's it. >> Yeah, that's fine. >> Does that make sense? >> Yes. I work for the public. >> Exactly. >> Exactly. And I am the public right here. You're looking at it. >> Work for the public by protecting them. Yeah. >> Correct. >> As far as I'm concerned, me asking you questions and coming out to challenge you. >> Fine. Fine. >> Is is part of my job. >> Just don't don't overprotect if you know me. >> I'm just here filming. >> It's all cool. >> All you needed to do was just tell me straight away. >> I didn't need to do do anything. >> Well, yeah. I know. But it would stop all of this, wouldn't it? >> Look, I came out of my way. I walked all the way back here for you. And you're still not happy, man. >> I am. I've just said I'm >> You still not satis >> I am happy >> satisfied. >> Look. Anyway, I'm going to call. >> Are you satisfied now? >> I am very satisfied. I won't need to go home now, will I? Really? >> I'll go home nice and relaxed now. Thanks for having the conversation with you. >> That's all right then. >> It's good to have a chat with you. All right. Yeah, >> you too. >> Take care of yourself. Yeah, >> take care. >> Good. See you later. >> Take care. >> He probably still watches BBC. He doesn't have a He hasn't heard of YouTube yet, Mr. Marty. Anyway, I think uh I'm pretty much done here. I always wonder I always drive fast here. And uh >> the final question rang out defiantly. Who holds the higher ground? The citizen or the police? The answer left everyone speechless. The incident did not lead to an arrest, but it raised a troubling issue. The police can distort and fabricate stories to exert pressure. Next, a simple traffic stop because the windows were too dark. But when the female driver decided to remain silent under the fifth amendment, the officer counted down like he was threatening a hostage. >> You just roll up. Let me call my daddy. >> Once everyone gets overhead, we'll go through this freaking >> What are you calling him for? When the police say roll your window up or go to jail, you won't believe why they call it a legal order when there is no law requiring it. >> Did you have your driver's license? >> What happened? >> Well, yeah. >> Your tent is illegal. So, I want to test it and let you know for sure. >> Oh, well, I'm not letting you test it. So, you >> can write it. >> Okay. So, you're not going to let me test your tent? >> No, sir. You can go ahead and write it. Um, I'm not sure if I have it and I don't just want to be formulating around in it, but I do have my um, registration and everything. >> You don't have your driver's license with you? >> I don't I'm not sure. >> Where y'all headed? >> I was going to get my baby. It's always a problem. Like, I always think I'm a male. I'm not. >> Here you go. Actually, >> a male. I'm going to have to test your tent. I mean, I'd rather do that than have to take it further than that. So, >> I think that's going to be >> You just roll up. Yes, sir. Let me call my daddy. Once everyone gets overhead, we're good. >> What are you calling him for? >> Property. >> You can write the tickets. >> No, I have to test it to know where it's at. >> Daddy, I got pulled over. I GOT PULLED OVER IN HIS ALL THE WAY BLACK. DADDY, I just got pulled over. This officer literally waited. He literally went in a neighborhood to pull like he now he's talking about my team, but I told him I don't want him to test my team. Just right. >> Sir, if she doesn't let me test it, she'll go to jail. This is ridiculous. I'm just >> He say if I don't let him test my uh tent, then I'm going to jail. But this man is literally targeting me. He literally PURPOSELY DROPPED. THAT'S WHAT I THOUGHT. I KNOW YOU can't go to jail for it. >> Right now, she's resisting this investigation. So, if she can't roll the window up, >> sir, I have to cooperate. >> Daddy, can you please come here? >> Okay. You have to Where you at? >> You have to cooperate. >> I'm at THE SAME STORE WHERE I JUST GOT A ME. THIS MAN GOT ME at the same spot where I just got >> Is that an order? Yes, it's an order. It's a lawful order for you to roll your window up a little bit so I can test it. >> I'm not trying to do that. >> What if she don't want to let you test? You can't take it to jail. >> That she'll be resisting the whole investigation. >> That's not Yes, it is. Cuz you're not allowing me to do my job. >> One decision to not roll up her window and now risk losing her career because she was still wearing her correctional officer uniform while handcuffed. >> I see you're a correctional officer. If you get arrested, I'm pretty sure you won't be anymore. >> So, here's the thing. For win tent, you have to roll the window up. It's a lawful command. We need to be arrested off. Then I need to pull my window up. >> Well, no. As a citizen, you need to do that. I'm just saying you have a significantly more powerful consequence of getting arrested. >> I understand. Most people don't. >> That's why I called them out because I know that that's how they window if they if they know you. Why would they sell you the car and they know the windows? You could get arrested. >> Well, I don't I have a right also, right? I have a right to not permanate myself, right? Yes, sir. What? >> I I plead the field. I don't want to get my tickets. >> That's No, that's not an option. By driving, you forfeit certain rights. I.e., you can't say when you pull you over for a traffic, let's say you're speeding, you can't say, "I'm not giving you a driver's license." Cuz once you drive, you basically have implied consent that I agree to the rules. Well, you got the driver's license. She say nothing about the driver license. >> That's not even the same. >> It is the same thing. It's a traffic violation. >> Well, T, they just want to test you. That's not >> They just want to test your tent, baby. Just let them test it. >> Worst case scenario, the tent deal with it later. >> Yeah, the tent's a ticket. >> That's the worst. >> Yeah, you don't want a ticket. >> You don't get arrested for that. >> However, fail off of the man is a chargeable fixing sale. >> Yeah, he's going to give you a warning. So, just let him >> No, we're not giving a warning now. I don't if it is a violation then it's a ticket but if it's not a violation then it's >> but then >> we cannot sit here all day and wait >> but then with the ticket you can >> you think of course yes absolutely >> well Tina let him go ahead and test it so you'll know what you're dealing with >> can always fight it you know >> cuz you probably have to get a lawyer >> yeah you want to go ahead and you want to go ahead and let him test it >> ma'am I've explained the situation to you quite clearly I've explained that this is a lawful man I explained that failing to be a lawful man will lead to your arrest. So, one more time, are you going to roll the window up so you can test it or are you going to get arrested? >> I'm going to lead to my arrest. >> Yes, I am. >> Tina, who you talking to? >> I'm her grandmother. >> Okay, >> but I'm just saying who you talking to? Who you asking? >> I will give you 30 seconds to make her to either get arrested or make a decision. >> Tina, who are you talking? >> 25 seconds. After a tense 25minut standoff, [music] the police finally measured the windshield and the shocking result was that it was completely legal. So why was he still arrested? >> Go get what? >> He has it right here. >> You have to roll the window up, man. >> You roll it up. >> All right. Time's up. >> I want to test it. >> I'm going to roll it up. >> Roll it up. Roll in. Hold up. >> Last chance. Roll it up. Roll it up and go to jail. Take her to jail. All right, we're done with this. >> You're under arrest. >> Yes, sir. This is Sergeant Ru, Tal Police Department. We just arrested one of your uh correctional officers. >> Sergeant Rudd? >> Yes, sir. R U DD. >> Okay. Um what? U press some charges on her. >> Yeah, it's um she's getting arrested for resisting without violence. >> All right. Is there anything else you wish to share with me? >> I I'll gladly [music] tell you exactly what happened. She got pulled over for a window tint violation and she wouldn't roll her window up so we could test it. And after 25 minutes of trying to convince her that just [music] roll the window up so we can test it and you can be on your way with at worst a ticket. She refused to [music] comply. At that point, we gave her the option like, "All right, you can either roll the window up and let us test it or we can arrest you and then roll the window up and test it." And she went with uh she didn't want to roll the window up. So, we arrested her and we tested the window and it wasn't legal tent, but so she's getting a ticket and [music] charged with resist arrest. >> She's having a bad day, ain't she? >> She is. And the worst part is she's still wearing her uniform. So, I'm assuming she didn't go into work. >> No, sir. She did not. >> Okay. Yeah, she's she's still [music] she was still in her uniform, which is why I begged and explain to her like you get arrested, it's probably going to not be good for your career. And uh she she wasn't didn't really seem to take that to heart. So, >> oh my gosh. >> Yeah. >> Now, I got a question. Did she ask you to contact me or >> No, sir. >> Nope. >> Okay. >> Nope. But because she's like, she's still in uniform contacting you guys. Give you heads up. >> Yes, sir. I appre I do appreciate you calling me, sir. >> That was no problem. >> I really do. And I'm disappointed in the conduct of our staff. >> Yeah. Yeah. It it I'm guessing y'all got a pretty big pretty large amount of staff, so it happens. I understand. Trust me. I've I've worked with enough dumb idiot cops to understand that they can't all make good decisions. In the United States, police officers who violate the fifth amendment right to freedom from prosecution may face administrative [music] disciplinary action, including reprimand or suspension, dismissal, [music] or loss of license to practice. The officer falsely suggested that the citizen was compelled to cooperate [music] by raising his or her glasses. Arresting an off-duty law enforcement officer for failing to facilitate a minor search is careerthreatening [music] and may violate the right to freedom from indictment. The case could be the basis for [music] a civil rights lawsuit under 42 US code SS1983 if it is proven that the violation of the citizens constitutional [music] rights was commit. A sergeant appeared his cold stare and defiant tone setting the stage for a storm about to erupt. >> So I'm trying to figure out what's going on. Right. Right. Right. Not on the property. Inside the building. We're on the property. Public property. >> Well, you I'm going to go out there, but you could write the ticket anyway. Come on. You can write the ticket. >> A barrage of baseless orders kept coming, driving the tension in the building to its peak. >> But why would I need to leave? >> Because it's a state building and you're videotaping. You don't have permission to videotape here. We don't even allow people to videotape here. >> Oh, who do I get the permission from? >> External affairs. >> They give me permission to videotape. >> That's what I was directed to tell you. >> I don't need permission from anybody, ma'am. Unfortunately for you. the paper. I think you >> here. She gave me this card. State of Connecticut judicial branch. Just everybody gets on a power trip when they want to tell you to stop exercising your constitutional rights. Doesn't make any sense. Where's the transparency? Hopefully, they're educated on our constitutional rights and they're not like tyrant Sergeant Brian Fehee. Oh, no. I'm taking some pictures of video. >> Huh? >> No, I'm just taking some pictures of video on the phone. >> Oh, >> yeah. So, you just heard the probation officer. He says, "Well, you can do that. It's a public place. I just wanted to know or I just didn't know." He said, "In the narrow hallway, every glance, every gesture became a spark, fueling the confrontation with each passing second." >> Is that what you mentioned? >> No, that's not what I said. and I'll get back to you as soon as I'm ready to get back to you. You understand? >> No, I'm just >> I get I get it right. So, I'm trying to figure out what's going on. >> Having a conversation with you back to you, >> sir. Deescalate. >> Deescalate. >> I guess I'm just not going to talk to you, engage you because you're asking me a question. You're not going to get an answer to question. >> You could say that. Sure. Why are you being so aggressive? I have I've been very respectful towards you. There's no need for you to make faces and act like a child. >> You're a sergeant of the Connecticut State Police. Don't act like a petulant child, sir. You got to grow up. Seriously, conduct yourself with decorum, professionalism. But you think you're above the public. You think you could talk to people the way you want because you got that shiny badge and the gun on your waist. You think you could just say and talk to people and give people childish faces, right? Got to grow up. Really? It's ridiculous. How'd you become sergeant being so unprofessional? I know another unprofessional sergeant. You must be friends with Sergeant Brian Fee. That's exactly what it is. >> That must be your best friend, isn't it? >> The promised ticket seemed like the end, but in reality, it opened the door to a fierce legal battle. >> You said property and then you said building. >> Inside the building. On the property. >> Inside the building. >> Okay. >> Not on the property. Inside the building. We're on the property. Public property. So, you're saying in the inside the building, which is also public property. I cannot film. Are you going to comply with what I'm telling you? Yes, sir. >> You can write the ticket. Come on. You can write it anyway. I'm going to go out here, though, and you can write the ticket. Come on, let's go. Where you say I can't film or I can film anyway. Your unlawful order violated my constitutional rights, and I want the ticket so I can take you to court and hold you accountable. You can give it to me. Big mistake here. Big mistake here, fellas. There's no reason for this that that you guys are violating my constitutional rights. You think it's funny? >> No, I'm not. I have no criminal convictions during my activism. I mean, we are 9 and0. But the issue is is that this is corrupticate. We all know how corruptic it is. >> Corruptic. you know, the ticket scandal that they're going through right now, writing false tickets to thousands, tens of thousands of false tickets written by the Connecticut State Police while he acted that way like a child. You saw his face and you saw his mannerisms and the way he was speaking to me. That's the problem. People think that I'm trying to disrespect law enforcement. So um that's what we're going to be doing today, guys, or that's what I did today and that's what I'm going to be working on. So, >> um, we'll get after it, guys. And like I said, there is no notice here. So, they do have, um, a a notice stamped by the judge. It is a judge's order, right? This is the judge's a standing order, right? Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The cameraman announced he would file an official complaint against the police and request all body cam footage as evidence. Up next, a small sign ignited a tense standoff between the citizens and the police. >> She explained to me it's cuz they have personal records, vital information. Problem is is that they're the duty holder for those records. You have to keep people from filming, so they can't obtain records. >> It's a city hall unless it's unless it's employee designated. here. Seven police officers showed up. Orders were [music] shouted. Threats of arrest echoed. Yet one question remained unanswered. What law forbids citizens [music] from filming? You >> know, we're interested in some of the uh the signs that say, "Hi, Lieutenant. How you doing?" >> Good. >> We're interested in some of the signs that say no filming. There's no filming, no videography. She explained to me it's cuz they have personal records, vital information. [music] Problem is is that they're the duty holder for those records. It's not a limited public forum because they have regular access to the public. So >> it's only in the spaces [music] that are administrative administratively protected. >> Correct. But so I mean it's also an person's eyes can't be trusted. >> You can use your camera to see farther than your eye can see. So that's why they restrict that. >> But audio about birth records of adopted children >> adopted. like trying to make it seem like it's something where like listen >> ma'am attorney I'm I'm explaining >> what legal authority do you have let's take this down just a little bit >> see this is perfect so so he's a supervisor he was speaking to us cordially you're interrupting us >> and this is interrupting let's >> Well then listen public free speech can't be converted into a crime or disorderly conduct we're not being disorderly so I'm going to stand right here >> I'm not I'm not interrupting anything Because I'm not being disorderly. I'm not being disorient. >> It's about when it comes to birth records for for adopted children. That's not open to the puzzle. >> So whose job is it to keep those records private? Is it my job or is it the city's job? Fair question. [music] >> Well, it's >> of course, right? >> When citizens invoked the Constitution, the police suddenly became hesitant. A moment when even those [music] enforcing the law weren't sure about the law itself. I'm going to I'm going to go in that room recording [music] with this because there's no law that restricts me from doing it. Okay? When I talk to you about public form, there's the reason I'm agitated because of certain reasonable, right? It's it has so many vital records that no reasonable person could think that privacy could simply be created. Places like that, social security offices, [music] so much private information, there's no way that you could protect it all. So, you have to keep people from filming so they can't obtain records. applies to >> it's a city hall unless it's unless it's employee designated area on a limited public forum. You can't allow members of the public in. For example, if this said if this said um authorized personnel only, right? Very clear that I cannot walk in there because it's it's not open to the public. >> So, hear me out though. Do you know what would happen even if that said if that said authorized personnel only and the person in there saw a citizen and said, "Oh, hey, nice to see you." That citizen goes in there. Is that now a public forum that's open to any member of the public at that time? It is worked. You can [music] you can't change a public form to a limited public forum, but you certainly can change limited public to public the moment you let public in. There's no there's no restrictions. You want to take me to jail? Take me to jail. >> Let me explain to you. You can't go beyond the counter with an electronic device or your physical body. >> It's it's like you're >> electronic. You know, these cameras can zoom in and that's the dude. Listen, I don't have to. Anytime, and I edit these videos heavily, if there was any private information, even people's cell phone numbers, birth records, social security numbers, these are >> the door slammed shut, public access cut off. Could this be how free speech is being silenced right in the heart of the city? >> If you want to have all of this circus, [music] have it like in the foyer over there. Can you get away from my personal space? Thank you. >> No, she's the boss. >> She's not my boss. The box is not my shut the door, please. Shut the door. >> You are law enforcement. >> You can't just keep people out of a public building. >> You know what you want to do that? That's fine. You want to create privacy. You just created privacy. Now the door is barred. I can't enter. >> We're not interested. >> You're trying to arrest somebody without knowing what the law is. >> I told what the law is. Respect the birth. This isn't trespassable. This is a public office that's open to the public. >> Which law? Show it to me. Should I prove you wrong right now? And I'm going to go in justio, which is the Supreme Court's ruling. >> But I prove you wrong right now. Let me let me let me put this down. In fact, I don't even have a feeling. I know that I'm 100% right cuz I speak with attorneys before I do this. >> Maybe we'll all learn something then. That would be great. >> This is strange. This is a whole other thing. You're disturbing the piece. >> No one's there. We close the door what we did. We're speaking up because you guys are speaking over us. You deserve to be able to say our >> ready. I'm going to read you this directly to Justin. The wire. >> We're not talking about why it's happening. >> This goes all No, it absolutely does not. >> An unexpected ending, arrests, [music] lawsuits, or a historic counter strike. Everything will be revealed when the truth behind the no filming signs is exposed. [music] The incident reflects the abuse of power and lack of training on civil rights within certain law enforcement agencies. >> You're going to get mad. You got to turn around and put your hands on me, bro. Where's my need to back up? >> I'm walking on a public sidewalk. I have the right to record [music] police in the capacity of their official duties. That's what you're doing and that's what I'm doing. So, God forbid there was an acorn out here. Everyone would be going crazy. >> Acorn, >> I think. So, I don't want to Vasquez is on the phone, so I'm being quiet so Vasquez can have his phone call. Bunch of college. >> Someone that's afraid of an acorn. >> No, he's someone that's afraid of us. He's still on the phone trying to figure this out. I'll give him that. >> You are. You're still on the phone trying to figure this out, aren't you? >> No, I'm taking phone calls and I miss >> I know you're trying. Hey, do you need a Do you need a secretary? >> Yeah, I got a I was >> I want to know why he's >> I was waiting to talk to you. >> You're not going to come back. >> You know what you guys >> My dad told me he was going to come back once, too. I ain't seen him since scared to death. These cops are scared of death. So brave. >> Super brave, man. >> Look, man. >> Freedom is never a given. It exists only when the people dare to stand up to protect it and when the government dares to confront its [music] mistakes and make changes. Hey everyone, what do you think about this situation? Next, we dive into an investigation where the police's unbelievable blunders are brought to light one by one. >> Today is the 20th. All right, I'll make sure you get a copy of this before we leave today. All right, so today's date is October 20th, 2022. The time according to my watch is currently 6:10 p.m. I will recording I will be recording this interview to ensure the accuracy of information we discuss. Uh this interview is being recorded. >> I do aware. >> Okay. Before we start, I want to uh read you your investigating warnings. I wish to advise you that you are being questioned as part of an official internal administrative investigation of the Malipan Police Department. You will be asked questions specifically directed and narrowly related to the performance of your official duties or fitness for duty. >> Officer David George faces a serious probe after his statements in the Manalapan beach incident embarrassed the entire department. >> Why did you make contact? >> The jet ski was there in front of bunch of swimmers. I thought it was abandoned. So I did not know I didn't see anyone near it. I saw a family of four uh two children, mother and father, and I just wanted to know where the jet ski owner was and if they were close to the vessel or if it was abandoned. So I put over the radio saying that it was abandoned and till I could find the contact or make contact with the owner. >> So you put over the radio and then what happened? >> So I went looking around, you know, for the um one person said it could be that male. So I went over there to go and make contact with him. So as I went over there to make contact with him, you know, he had some type of stance that he's about to like fight me, but I said something to get him off track. So what I said to him, you know, was uh hey, are you a citizen? And he's like, yeah. And then so then his buddies also got distracted by the statement I said. So my concern was officer safety that I did not want them to ambush me. So cuz it's had prior situations that on the beach that if not if I'm not watching what's going on, someone could ambush me or I've had people try to throw stuff while I'm operating an ATV. So I said something like that which I didn't think was offensive or anything like that in any shape or manner and just so I could get him off his toes because it's not something you would act you know personal watercraft was close to swimmers. I explained that you know from my viewpoint. So my thing was that you know I told them my point of view of explaining to him this is not technically a swim zone. And you know and the thing is that >> on September 18th, 2022, Officer George spotted a suspicious jet ski in a crowded swimming area. He quickly approached a nearby family and alerted over the radio about a potential looming threat. So he was using the bottom of that jet ski to moore it. >> Okay. What is the definition of mooring? >> Well, on this definition, >> no, no, no. What is not this definition? What is the definition of mooring? >> It's parking the boat. >> You sure about that? >> It's mostly parking the boat. >> You sure about that? >> Yeah. Using the boat as a parking. >> Okay. >> Using a boat. They're saying the mooring is using that is using something to tie it down. What state statute were you giving him or were you quoting when you told him it's against the law? >> 327. Uh, hold on. 327.4109. There's a subsection of it. >> Okay. Without uh Well, my question is this. Do you know what subsection that is? >> So, how I interpret it was that the bottom was used as a more to park. That's really what it comes down to. That's why I thought it's park is moing because you're parking the boat. You're stopping movement of it. But on the vessel side of what other people say is mooring is you use a toe and it has to be towed in for it. So everyone looks at Yeah. You have to have a hook to toe. That's what they're saying. But how I look at mooring is you're using the bottom [snorts] or any portion of the boat to stop movement from, you know, the wake of it coming in. Is there an ordinance in the town saying that any personal watercrafts cannot uh cannot be in that fashion of of how you found that uh that that that jet ski? >> No, there's no ordinance up there. >> But you're telling me there's a state law >> stating that they >> Yeah. State >> state law state law, state statute, state law. >> Yeah. saying that they cannot that it's actually against the law to have your warden craft on the sand and you you're telling me it's 3274109. >> Yeah. >> But afterwards after I talked to my sergeant he's saying no. So now >> in future references would you? >> George cited statute 3 2 7 4 1 09 but couldn't explain it then told the citizen to Google it. In the end he admitted he had misunderstood the law himself. Do you understand um once you're speaking of an incident, you've called it on a radio and again it's it's no longer a consensual encounter and per policy that BWC was supposed to be on. >> Also, where was your BWC at the time of contact prior to patrol? Did you check your BWC? >> Yeah, I do a check. >> Okay. And did you advise that it was wasn't working? It wasn't charged? >> No, it was charged when I started shift. But as the shift goes on, it depletes battery. So I >> What time did you start shift? >> Uh 7:00 in the morning. >> 7:00 in the morning. What time did this call come up? What time did you make contact with him? >> At 12:00, like around 12 uh around 12:40. So, you're informing me currently that 7 8 9 10 11 12 within 5 hours of your shift that your VWC battery just goes dead. >> Yeah, I >> have you informed anyone that 5 hours in your shift that your BWC battery goes dead? >> Yeah, I told Larry. Yeah, cuz I he told you that they shut off restarted. I >> We have documentation of that. misquing the law was serious enough, but George didn't even activate his body cam, claiming it was just a voluntary conversation. And the camera left charging in the car, coincidence or calculated. >> Earlier that day, well, the reason why I also said that is to get him off his toes because even earlier that day, I had to do a traffic stop. And that day, I did a traffic stop. Was a normal traffic stop. When the guy did the traffic stop, he ended up doing something different. whether he backed in and a lot of pe and you know I was worried that because the way he did the traffic stop it was just from that aspect from earlier trapping stop I was thinking of officer safety and that's why when I went to him I just said let me blurt it out so this way get him off his toes this way he's not going to you know because when I saw when I walked up to him I just went no I not call back >> how many subjects was there a lot of people on the beach >> there was a lot of people on the beach >> and you felt as if this guy >> made fight you correct It's him and three other but the thing is that yes but the thing is that I wanted to ease him out where that I could mentally draw you know but the thing is that once I moved him aside hey can I talk to you privately then his friends walked away but they kept coming back so then as I was telling him some stuff and then it's a consensual thing and then down but the thing is that he was agitated and I could see that he was angry and he was agitated Um, in Florida, officers who abuse power, misapply the law, give false information, or fail to use body cams may face discipline, descertification, criminal charges, or civil lawsuits based on the severity. The officer's actions show signs of minor abuse of power, misinterpretation of the law, providing misleading information, and violating body cam recording protocols.
