I did not run your plate. >> Okay, you can run the plate. >> Yeah, I I know I can run your plate because I have a legal right to do so. >> Is this [music] a traffic stop? >> We can talk, but you have to get stuff out of the office. >> Why? >> Because I'm asking you to and because it's not private public. >> An unwarranted encounter erupts into a tense showdown as the officer pushes the law [music] to its limits. >> I'm not trying to violate his rights. I'm just simply trying to conduct investigation because >> since since you're chief deputy, commerce places, right? Never have I ever walked into a city building where there was an office that was not open to the public. In >> just minutes, civil rights are bent out of shape and the officer [music] faces the risk of paying a heavy price. From a harmless encounter, the officer suddenly escalates the tension, forcing an unfounded [music] investigation and threatening, hindering simply because the citizen chose to remain silent. >> Name is officer Weaver with Key Police Department. >> Okay. What's your badge number? Uh, my badge number is 304. What's your name, please? >> I don't answer questions. You ran my plate already. >> I did not run your plate. >> Okay, you can run the plate. >> Yeah, I I know I can run your plate because I have a legal right to do so. >> Is this a traffic stop? >> This is I'm conducting an investigation. >> Okay. So, I don't need to answer your questions. >> Well, if you hinder my investigation, you can be cited for that. >> Okay. >> Okay. That's the way that it is in Kentucky. When I went through the academy, that's the way that I was trained is that if I'm conducting an investigation, have the right to temporarily detain. >> Okay. What's your investigation? >> My investigation was that there was an approximate 12year-old juvenile >> running around this specific area naked. That's a very serious complaint. >> Okay. >> Okay. It's not just a hey, how are you? Why are you here? This is a very serious complaint. >> Gotcha. Who made the complaint? >> I received that call in public service and I do not have to tell you that. >> Okay. So call the uh the complainant and figure out >> you know where this child went. We have nothing to do with that. >> Okay. All right. Do you have your identification on you? >> No, sir. I don't need to identify myself. >> You you don't have to identify yourself. >> Okay. >> You have reasonable articular suspicion that I have committed a crime. >> I do not think Okay. >> That you have committed a crime. >> You have a body camera? >> I have my body camera on. >> Okay. Very good. >> This time so it's recording. And do you have an incident number for this >> or a CAD number or anything like that? >> We'll have a CAD number because I just radio. >> Gotcha. So this is not a traffic stop. You're just doing an investigation, right? >> I am conducting an investigation in reference to the safety of a juvenile. >> The officer declares a detention only to admit moments later there's no crime. An alarming contradiction that drives the tension to its peak. Right. >> Okay. Did you create the rules or >> do you suspect me of committing a crime? >> I suspect here's since you're since I don't have to interrogate you and I don't have to read you your rights cuz we're just talking. You're not under arrest. I think that you are being very suspicious >> in the sense that you do not want to identify. You're creating a certain amount of suspicion about yourself. >> Is suspicious a misdemeanor or a felony? >> Nope. That is not a crime. >> Okay. >> You're not committing a crime. >> Am I being detained right now? You are being detained. >> Okay. >> That's right. So I can conduct >> For what crime am I being detained? >> You do not [music] have to be committing a crime to be detained. I'm conducting an investigation. I don't know if you understand what I'm saying to you. >> I mean I I said you haven't committed a crime. >> I said but I'm conducting an investigation. >> Okay. So do your investigation. >> May I have your name and your identification? >> No, sir. >> Okay. May I have the child's name? >> No. Those are my kids and they're minors. >> Okay. All right. Okay. And so you're refusing to answer my questions? >> Yes. >> So if I if I write you a ticket for hindering my investigation, >> you'll be violating my civil rights and you'll be in civil litigation. >> Okay. For doing what? >> Am I being detained? >> You're being detained because I'm conducting an investigation. >> I'm requesting your supervisor now. >> Oh. Um if he is still around, I'll be more than glad to get him for you. I tell you what, I'll try to call him on the phone to have >> No, I >> I don't want to speak on the phone. >> Okay. All right. >> When the higherups arrive, the officer's radio unexpectedly exposes cracks in the legal basis, revealing growing signs of abuse of authority. >> Has operational control the vehicle, and he's refusing to identify himself or anyone else in the vehicle. And like I said, I'm not trying >> I'm not trying to violate his rights. I'm just simply trying to conduct investigation because >> since since you're chief deputy >> Yeah. I that I'm aware of that. Yeah. Yeah. Yeah. Yeah. That's I should have a little backup here in just a second. So, um, we'll we'll get we'll get to that and make sure that we stay within within his rights. But I was pretty sure that he has to identify himself or otherwise he's hindering my investigation like I've plainly stated. Thank you very much. See, that was uh that was our chief deputy here with the Jackson County Sheriff's Office. He was concerned about my call. Well, what's his name? >> Uh, his name is Deputy Daniel Isis. >> Okay. >> Yeah. He was concerned about the nature of the call and what what's going on. Um, like like I said, I don't want to violate your rights, but at all and I'm not going to violate your rights. Um, but I do have the right to conduct an investigation. After consulting with colleagues, the officer abruptly shifts his attitude, hurriedly ends the investigation and walks away, leaving behind clear signs [music] of an abuse of authority that nearly spiraled out of control. >> Okay, so I have spoke with uh Deputy Bobby Edwards with the Jackson County Sheriff's Office and I conferred with him and asked him, you know, I don't want to violate your rights. I am conducting an investigation. Okay. And I I feel like I do have reasonable suspicion that that something could be a miss here. Okay. >> Mhm. >> But >> like what? >> But you have two juveniles in your home. >> In the area that the complaint >> I've I've already clarified that these are my children. >> Yes. >> And you're scaring them. >> Well, you know, the only thing that I know to tell you is something I learned a long time ago. I can't provide security, which is part of being a police officer, without some form of um what was the word with a little without a little bit of discomfort. That just comes with the nature of this. And I don't mean it. I really don't. I'm simply trying to conduct an investigation. Um, but from after [snorts] speaking uh with Deputy Edwards um and gaining some some wisdom from him, okay, I'm not going to step on your rights. And I do not think at this time, okay, from what the sum of everything that I've gathered, I do not think that you've committed a crime, okay? And I don't want to overstep my bounds as an officer by trying to force you to do something or try to force you to do something that is in direct violation of your rights. I have rights, you have rights. That's the way that I police. I want to be fair, firm, but fair within the law. And at this time, after speaking with Deputy Edwards, I do not feel like that I have enough evidence or uh probable cause to make you try to force you to identify yourself. Okay. Citizens can sue police officers under SS1,983 when their rights are violated. Officers who break the law may be required to pay damages and face disciplinary action or termination. The officer may face civil lawsuits for unlawful detention along with internal investigations, disciplinary action, or even termination. Up next, an open unmarked door turns into a fierce confrontation as a city hall employee rushes in to block and lay hands on the auditor. >> Hello. >> Said she called the police, but just like except for she almost assaulted him, [music] but >> she touched my but I'm good right here. >> No, I'm good right here. I'm free to stand. >> There's a [music] sign in there that says no one unauthorized access. Like it says you can't enter. So of course you wouldn't enter there. >> You're actually breaking the law. So it's just please step over here. I'm breaking the law. >> If you pass that doorway, there's no trust. >> It says one way. Go this way. >> Ma'am, you're you're in an office. You're in actual office of an employee of the city. That is not public space. Okay. >> It It was public space. >> It's not was it's not. >> It [music] was. It is. >> What? >> So, we can talk, but you're going to have to get stuff out of the office. >> Why? >> Because I'm asking you to. And because it's not private, it's not public. Are you trespassing? >> If you want, I can. You want me to arrest you? >> I'm asking. Excuse You want me to arrest you for trespass? >> Trespass is not an arrest. >> This is an office. This is not public space. Why are >> you touching me? >> Yes. And you're about to get arrested. >> It is a lawful command to step out of this private space. >> This is an employer. We'll wait for your supervisor. I am supervisor. >> So why did you put your hands on me? >> So if you want to stay what's considered public to this woman, >> why did you put your hands on me? >> No, that's you making it up. >> He's not allowed to put his hands on me. No, he is not. is like don't under arrest. What does this say? >> Why are you guys so upset? >> Because you're giving me demands. Says one >> I'm upset they have to stop at a green light. >> Says it's not public. >> Is there a sign on the door? >> This was a public office until they decided to say it was private. >> No, this is closed. >> No, I was here to take pictures. >> She decided to put her hands on him >> and then she called the police and that's >> Yes, of course. I will do that when I'm ready. Thank you. >> Chambers is is now so now this is public. It's private as well. City council hall chambers. >> Is it common for you to put your hands on citizens? >> Yes. If I have to ask him if I'm going to arrest him. It is very common. >> You were going to arrest. >> Yes, I was. For trespass. I said for what? >> For trespassing. >> The sergeant arrives and instantly escalates the situation, threatening trespassing and putting hands on a citizen before giving any lawful reason. That's not That's not a >> He touched me He touched me unlawfully. So, I'm good. >> No, I'm telling you. So, I have probably been in, and this is not an exaggeration, on over 1,000 city or town halls across the country, Chamber of Commerce places, right? Never have I ever walked into a city building where there was an office that was not open to the public, that was not marked, that it was unauthorized access, no trespassing. Second, if we went into one of those offices, which we've had, and I have a pending case going on against a police officer right now who is currently suspended for doing exactly what you did, the law is very, very clear and upheld in Supreme Court, that you can give a trespass notice. However, we need to first be trespassing. And by stepping into an office that's not clearly marked, that has clear verbiage towards an egress, that is not grounds for trust. Had I grabbed [music] you the way that he grabbed me a few minutes ago, I would be in cuffs. grabbed my arm just like this. I did >> didn't wasn't under arrest at the time. Nothing. >> Step out of the >> unlawful command. Unlawful. That is that at that point. That's what we talk about law. Like to be perfectly honest with you, you need to read the supreme the Supreme Court's ruling on this. >> But that still doesn't change the fact you sound ignorant. >> It is. It's an er. The way it's not first of all, it's not it's not marked. So we have component number one. >> Again, private homes are not marked. Ignorant. This is this is a public building. So, as far as the Supreme Court has ruled on this issue, right? >> The auditor fires back hard, dismantling the trespass law claims and pushing the officer's entire justification to the brink of collapse. >> Was yours been kind enough to Okay, so >> thank you for having a conversation with us. >> Yeah. So, I got the the other side of the story. I got your guys right. So, here here's basically what's happening. That door should be identified and it's not. That's a mistake on the city. That's going to be rectified. >> All right. Thank you for correcting that. >> It's all good. But I would ask that if an officer just asked you to leave an office that you guys would respect it and then we could deal with it like we're dealing with it now. >> Chief, you know, you're absolutely right. And and I was just explaining to to the g to the lieutenant, excuse me, the bars, my eyes. Um is that I I don't want the conception to be here that we hate police. I have police in my family. We know what you guys are doing. It's just it's it's the approach, right? Like if if I can guarantee you he's been doing it a long time. If LT comes into the office and says, "Hey guys, listen. We can figure out for this for debate later. The city attorney for issues like this. Chief is on his way. Let's step out and have a conversation till he gets here. We're not saying you can't do it. I just don't want you to have to go to jail." Conversation like that, then [music] I mean, we have a non-issue. Then I'm speaking just because I've not been rude to any of the officers except he comes in, grabs her by the arm, and he's telling her that she's going to be arrested. I'm just trying to explain as we've kind of figured out here together that Supreme Court has ruled that if it's an open egress component one that's not been clearly marked as no trespassing unauthorized asset access number two or it's a a flowing I would think I forget the word a free flowing egress or something like that which you would think there's gre there's arrows pointing to the door there's no signage it's open and the office is open so I thought that it was an extension of here right so >> that's what I'm trying to explain so understanding that that in that aspect of understanding trespassing, we're right. Right. So when he comes in and starts putting hands on when we know we're right now, now what do we do? Do we stand our ground because we know we're right and we let him keep assaulting her or do we forcefully allow oursel to be vacated from a place that we have every legal ability to assault because we don't want to get put in handcuffs. >> No, I get it. But I think there's a third option and that's politely step outside of that door. >> The commanding officer admits the door wasn't marked at all. unintentionally confirming that the initial use of force had no legal basis >> from an office that at this point we've understood was not marked as private and at the time was public. >> It would be nice to get an apology that absolutely would do a world of difference especially for where he's going to be posting that. Okay. But uh the complaint I would like to pursue because I don't want him thinking that this is okay to do to somebody else. If there's no lesson learned, he'll do it again. >> Okay. So your name is >> I gave him my name because he had a nice cordial conversation with me. You I haven't really had a conversation with you. So >> I I need your information >> because I'm the complaintant. Okay. Anna, >> actually just so you know, two ends or one? Um you you can fill out a complaint um without any personal personal details as long as the police can can confirm that you're the complaining party, which is part of the reason I didn't want to turn out a paper. So you can give him your name as Anna, last name can be citizen, and then he already has our email address, so he has no way to contact us. That's really the only information if you don't want to give anyone that you need. >> Okay. >> Well, I mean, I already gave him my name, so they were going to write it down anyway. >> I I heard it, but for some reason, Ashley stuck in my head. So anyways, >> all right. >> All right. Is that Anna all you want to give me? >> Yes. >> Okay. >> And I had >> I just got assaulted. I mean, I've I've given >> I got, >> you know, pe [music] city employees and officers my name before who've met me with [music] respect. I feel completely violated. I can still feel his fingers on my arm and he's walked away for 30 minutes. >> What type of people Thank you. If you look at my channel, the last three videos that we posted are us like hanging out and having a good good time with cops. Yeah, I'm going to let you find out. >> You're going to find out. >> Make me search for it. >> No, people will call you. >> You're going to find out. >> People are going to call. >> They're gonna They're gonna But just so you know, we do ask um that people if they feel to red address their grievances, they do not call business or 911 or >> Right. We don't have them do that >> because my channel is so big that if they were to do that, that's the only thing we could be doing. >> They'll want to redress with the city and the people. >> We don't put like phone numbers or addresses either. Just let them know the name of the department. If they want to reach out on their own, that's on them. And there's probably going to be a couple compliments as well because High Tower and you yourself seem to be doing the >> The victim files a formal complaint and requests the body cam footage, pushing the sergeant into an abuse of authority investigation. Stuart may now face fourth amendment violations, abuse of power, and a full internal review. Next, a man with no license plate or ID turned on his hazard lights on the highway and signaled a driver to stop. But the person he stopped was no stranger. The argument quickly turned into an arrest between two men. One a real cop and the other a faulty copy. >> I'm in charge. >> Okay. >> What's your name, sir? >> Sergeant. >> Okay, sir. I was told that you were using your car like you were a police officer. >> No, you're in my truck. I told you to show it in your truck. You're on private property right now. >> You have your driver's license, sir. No, >> I'm not giving it. You have that. >> Okay. Well, >> I'm in charge of this right now. Okay, >> you're in charge of what? >> I'm charging this property and other property. >> And that's fine. But over there on the highway where you lit up cars and you were using your car like a police car, >> there's no proof. >> Okay. >> I'm investigating something, right? And if you refuse to give me your driver's license, I can detain you and arrest you. >> Okay. Detain me then. Okay. >> Turn around. >> No. No. >> Don't resist, man. >> Hey, knock it off. Go. Anything wrong? >> Hey, don't man. >> Don't do it. Knock it off. >> Well, then why are you resist? Now you're resisting arrest. >> Now you're resisting. Could have just gave me your ID. >> I gave you ID. >> Could have given me your driver's license. >> I understand that. >> All right. >> Do me a favor. You have any other weapons on you? >> Well, mains. >> Okay. Good. Mag. >> Any other weapons, sir? >> Maze. Is that recording? >> Yes. >> Excellent. >> It's recording on the highway. >> No. >> All right. >> I get to hear my post. Okay. >> Don't move. >> Hold on. There's nothing in there. >> There's nothing else. >> I still got to check it >> without gloves. >> I don't care. >> What do you got in there? >> Where do you keep your cuff keys? >> You got cuffs. Where you got the cupcies? >> They're all my checkers. >> I mean, this could have gone a lot easier. >> It was easier. I gave you my ID and that's who I was. I am a senior security officer, but have no license plate, no authority. So why is he turning on his lights on the highway and acting like a police officer? >> It's in my wallet. >> Where's your wallet? >> Yeah, I got it. >> On the floor. >> All right, have a seat. >> I don't know why you want to argue with this. >> I'm not, man. I didn't light up [ __ ] >> He has no proof. >> I didn't light up anything. Okay. >> I was coming to work. Every time I come to work, I [ __ ] clock in right here. >> 516. >> That's all I do. >> Watching. >> Yep. >> Don't move. There's no camera sh >> the card the card you presented us. >> What What powers does that give you? >> I'm a PO which gives me I'm not a level three security officer. I'm above a level three. So you're not considered a police officer, right? >> I am not. No. Okay. You understand? You understand that by we were asking for your ID. We're you're under investigation. You were asking for your ID. >> Under investigation if I committed >> that's what we're investigating which is why we asked your ID. You refuse to give it that. >> Can you just >> We'll adjust a minute. This is why you're in cuff. So >> Oh, it's my watch. >> Can I take your watch off? >> Yeah. Turn around. >> There you go. >> That's much better. >> Oh yeah, that's >> So I didn't light up anybody. Turn. Make sure I >> So are they locked? No. No. >> Let me put it Let me lock them so they don't actually double tighten on you. >> Don't light anybody up. All right. Hold on. live in Edgewood. They come here >> from former special agent to community order keeper. He makes all kinds of excuses to avoid responsibility and let's see how the real police will handle it >> because you're minimizing your actions in your felony to own what they did. That's going to change the outcome of this completely. Okay? Because you continue to lie and you continue to say. So what's going to happen? So what do you want me to say? I turn on the lights and then we're done. I want you to be I don't know I turn on the lights because because I have [ __ ] all on there. It's no different than sometimes my mic coming on by me. So you know what? I'm not playing any mind game. I'm not playing any game like you. >> I'm not playing any games. Exactly. I wouldn't lie. I I wouldn't lie >> at all. Well, actually I do have a lot to lose if I lied. You do? But yeah, you know you're impersonating a police officer. But then you understand whenever you take your oats and whenever you can you take it off. It's obviously making me extremely uncomfortable. I don't >> put this hand on your head when I take it off. >> If it came on then I apologize but a lot of times I don't know that it's coming out because the problem is how all this is going to go is it determines on where this report goes. Okay, if we deal with an officer, okay, and that officer owns his mistake, he's truthful, he's honest, no matter what he does, then it's dealt with, we discipline him, and we move on with life. >> But I'm trying. >> If he lies, >> if he lies, >> then what we do is we go forward or what I do is I go forward, I pull all the documentation that I possibly can to show that he is a liar, right? Because what I do once I determine that he's he is a liar and that is his character then I go to the law enforcement board and I in >> I can in the canyon >> in the state of New Mexico he's position you're in right now >> what started as a righteous mission ended up in a police car but not in the driver's seat but in the back seat. >> However, we are charging you for impersonating a police officer. We're going to write you a citation. There's going to be a report. You have a court date. All that stuff. He'll bring it to you and he'll explain it to you in a minute. It is a full misdemeanor just so you're aware. >> And just to clarify, you can use your lights and your authority here in the parking lot. Wherever your private property that you're contracted to be. >> If you're on the highway, you're in the city of Albuquerque, you're somewhere you're not supposed to be. You are not a police officer. >> You cannot do that. If you would like to become a police officer, great. >> But until then, you need to use your authority correctly. Also, I have a question. Why'd your license plate in your door? I don't know. >> I don't know. >> Not my vehicle. >> Not my vehicle. >> I mean, >> I I understand what you're saying, but >> you know the I just got the vehicle. >> So, I'm the one I'm the one. >> So, they gave it to me to take it home because I have >> When did they give it to you? >> Two weeks ago. >> Two weeks ago. >> No, there was a license plate. >> It was in the trunk when I put my gear in. So, I put it in there and I haven't put it in. >> Where did I go? If it's going to be on the road. >> Yeah, I know. So, you knowingly moved your license plate from the trunk to your door. When did you do that? >> Been dragging on it a week on the interstate. You ever been a zombie? >> I do. >> He's been driving around on the interstate for >> no charges for resisting or failing to produce ID, but a citation for impersonation was issued. He received a court appearance, a possible fine, [music] and a record. We need a law enforcement system that exercises restraint, listens, [music] and understands that civil rights are not privileges to be granted, but the ethical [music] foundation every democracy must protect.
