Inside of vehicles, there is. God, if you can see it from public, sir, you know better than that. >> When the citizen refused to bow to unreasonable orders, a tense battle [music] of wits erupted in broad daylight. >> Am I being detained? >> So, I guess that's a no. >> You're being detained. >> I'm being detained. This is an illegal entertainment. I'm starting the clock. Illegal detainment. I'm starting the clock. >> Right in the parking lot of the Bristol Police Department, a citizen with a camera shook the entire area. >> So, you're you're saying that you're saying that people don't have a reasonable expectation of privacy inside their vehicle? No sir. >> When the law was brought up for clarification instead of listening, the police tried to impose a vague notion of privacy. But is that really the truth or just an excuse for suppression? >> Are you looking into the some of the Commonwealth attorney's cars and things like that? >> I'm just places where they have a reasonable expectation of privacy. >> Uh, you know, there's no reasonable expectation of privacy in public, sir. >> There is, inside of vehicles, there is. >> Now, if you can see it from public, sir, you know better than that. >> No, that's not entirely accurate. >> Is that right? Yet, when asked to point it out, the officer fumbled, unable to show a single sign of prohibition. >> Sir, you don't know what you know what plain view doctrine is, do you? >> Are you the attorney? >> How do you know I'm not an attorney? >> Are you the attorney? >> How do you know I'm not an attorney? How do you know I'm not an attorney? >> I don't know. That's why I'm >> All right. They have to, the onus is on them to create that privacy. Just like in your squad car. I can walk up to your squad car right now and film everything I can see in here because it's called plain view doctrine. You've left your computer on which is not a good thing. >> Is it not? >> Cuz that's on you to create that privacy on that computer. >> Me to create that privacy? Am I the one that's supposed to shut it? Are >> are you schooled with the police department policy or anything? >> I am, sir. And and normal constitutional law as well. >> Okay. Yes, sir. So, then you stopped me. So, don't say you didn't. >> The next excuse was thrown out. Someone reported you had a gun and wore a mask. But the truth behind this justification only fueled even more public outrage and controversy. >> If I'm breaking a law, >> we come down here to make >> Raise your voice to me, sir. You're the servant. Understand that >> that you are safe and everyone else is safe and don't talk over. >> Have a nice day. I ain't wasting my breath with your done. Keep stepping. Are you that stupid? >> Are you? >> No, I'm not. Cuz I'm standing there. If it was identity theft, you'd be hooking me the >> The tension exploded when the citizen pushed back. Was this the turning point leading to an unlawful arrest or merely an exposure of blatant ignorance and abuse of power >> in a disorderly? You stupid. God, y'all are [music] [ __ ] >> Am I wrong? >> Yeah, you're wrong. I you can be the complaint in the disturbance call. You are [ __ ] Then hook me off then. How stupid. Bristol's finest right there. And I thought I wasn't going to get nothing today. >> Sorry for the pacing back and forth and turning around all the time. He had me fired up, guys. I was tore up. >> What a bunch of retards. The police. Police. Cops. Bad cops. Bad cops. Bad cops. Bad cops. Bad cops. Well, boys and girls, that's how you do it. You can ask me whatever you want, but I don't want to be detained. >> I was trying to be very suspect respectful, man. >> Really? >> The supervisor's arrival shifted the entire situation and the officer's eyes no longer held the same certainty. >> You're going to get a complaint. Add to the list, huh? I'm sure I'm sure you've had >> I'm sure you've had a lot. >> Where is the supervisor I'm responding to? >> Oh, he's he's in he's in route. Okay. Hey, hey, listen. Okay. >> That they both said he didn't say anything but the these two guys they said I'm free to leave. I mean I'm not free to leave. >> Okay. >> And I would like to make a complaint. >> Okay. Well, at that moment right then and there, they were responding to a 911 call. All right. And so they were in the middle of an investigation. Okay. But in order in order to detain somebody so you have to have reasonable articulable suspicion that a crime has been committed is being committed. >> Exactly. However, they were in the middle of an investigation. That's what they were trying to figure out. >> They can't detain they can't detain free citizens in >> investigation. That's that's they would they were doing an investigation. Absolutely. >> So So Sergeant, you're saying you're saying while they're doing an investigation, I just want to make this clear. While they're doing an investigation, they can detain a nonlawbreaking citizen. Well, they didn't know if at that point they didn't know if you were breaking the law, not breaking the law. What would you like to do? >> Well, I'll take care of that. I'll speak to the deputy and I'll I'll file. >> Just one question. [clears throat] Suspicious isn't a crime. And the entire force was left stunned. No charges, no evidence. Or was it nothing more than blatant abuse of power? A routine traffic stop, but the police turned it into a violent display of power. >> I DIDN'T DO NOTHING. I GOT HIS HAND. >> STOP RESISTING. >> STOP RESISTING. >> Grand Rapids police approached the car and ordered everyone out. Hood was initially uncooperative, but when he exited the car and raised his hands, he was immediately handcuffed for reasons that were never explained, setting off a controversial scene that followed. Hello. How you doing? >> Uh, I can't tell. Scott Cam turned the car off. >> Hey man, what's your first name? What's your first name? >> I know. I'm talking to you though. What's your first name? >> All right. I want to have you step out of the car and talk to me back here. All right. Well, take your seatelt off. Take your seatelt off, man. Doesn't mean you're going to jail. Okay. Give me your right hand. Keep your left hand on top of your head for me. >> Turn the car off, man. >> Give me the other hand. >> You're good. It's for littering, man. It's not a big deal. This is a rust fence. Despite claiming he was not carrying any illegal substances, Hood was still searched and placed in a patrol car while the officers quickly moved on to check the rest of the group. >> Do you have anything illegal on anybody? >> No, sir. >> No. No. We or anything like any contraband at all? >> No, sir. >> No. Okay. Just relax. Okay. >> You were just coming from 110, right? >> 110? >> Yeah. >> Paul Street. Don't move. That's all I'm saying. >> How much cash you got on you? >> You on probation or parole or anything like that? >> No. Is there anything illegal in the car that you're worried about? >> What's up? >> Okay. All right. Like I said, doesn't mean you're going to jail or anything like that. All right. >> We're going to finish with your buddies up here at the card. >> Oh god. >> I don't know what's going on. >> Don't do it. >> All right, buddy. You watch out. >> After placing Hood in the car, police continued to drag the remaining men out. One man was pinned to the ground and repeatedly punched in the head despite repeatedly complaining of difficulty breathing. But officers believed he was faking it. >> I didn't do nothing. >> I got his hand. >> Stop resisting. >> Stop resisting. >> I'm not resisting. >> Stop grabbing grabbing at him. >> Stop grabbing me. >> Guys doing all right. >> Yep. Yep. Stop, man. Stop, bro. >> He busted me. >> I GOT PEPPER SPRAY PEPPER. [groaning] I can't breathe. >> Breathing right here, bro. >> I can't breathe. >> You're breathing right here. I'm looking at you. >> I CAN'T BREATHE. >> I'M WATCHING YOU. >> I can't breathe. >> You're good. >> I CAN'T BREATHE. I CAN'T BREATHE. It's good. >> Got another gun in the back seat. >> Okay. >> All right. >> Police asked the driver to get out of the car because he was not wearing a seat belt [music] despite showing his identification. After an argument, they warned him they were going to arrest him and quickly subdued him. >> Hey, can you turn the car off for me? >> What? >> Just cuz that's how we do traffic stops. >> Thanks. >> Hey, keep the car off. Go on. >> I said keep the car off. >> It's off. Y'all don't >> You just You just turned it back on. >> Because y'all y'all just trying to open the door and >> I'm going to have you step out of the car. Okay. >> For what? >> Because I told you to. Don't do your seatelt. Have you step out of the car and put your hands on top of your head >> for what? I ain't do nothing. >> Okay. I told you step out of the car. >> That's a walking away from this and get out of that car. That's your job. You'll be out of here. Okay. >> I'm for what? >> Because I gave you a lawful orders. Step out. >> I'm on my way to somewhere. I got >> Okay. So, get out of the car. That's where where does it say that in the law? >> So, if you're not going to get out of the car, then you're going to be resistance. Okay? And that's an arrestable offense. >> Where does it say that in law? >> Hands on top of your head. Hands on top of your head. >> Up here for me. All right. >> Hands on top of your head. Just drop that. Put your hands on top of your head. >> Where does it say that in the law book? >> Can I make a call first? >> Put your hands on top of your head. >> No, cuz I I don't know WHERE WHERE'S ALL THIS COMING FROM? >> Because I just asked you to step out the car. I just want to talk to you outside the car. Step out of the car before I put you before I place you under [music] arrest. >> I didn't do nothing. >> Okay, sir. I'm going to put you under arrest if you don't step out of out of the car. >> After arresting the driver, the police threatened the passenger sitting behind, forcing him to give up his phone and name, then restrained and arrested him because they found a gun near him. >> identified him as DF. >> Okay. He doesn't He hasn't told you. >> No, we'll just give him that charge, too. Sir, I have a couple questions to ask you. Can you answer me? Can you at least acknowledge I'm here, please? All right, sir. Due to our policy, just cuz we did use force on you, need to ask you how you're feeling from this incident. Are you willing to speak with me about the incident, sir? Sir, do you have a CPL, sir? Just so you know, you are going to jail tonight. Okay. Do you not want to speak with me? Okay. I can see you're breathing just fine. Do you have anything else on you shouldn't have, sir? Do you want to see an ambulance, sir? No. Um, I do kind of want to get a better search on him. >> Are you going to give us trouble if we have you stand out? I want to make sure you don't have anything on you. Do you have any more drugs on you, sir? >> I never had any drugs. >> Okay. I'm going to have you stop out. You're not going to give us any more trouble, are you? >> I don't need >> Except for the gun that fell off, sir. >> Okay, sir. It fell off your person. Stop mine. >> Grabbing at their gun. >> I didn't grab nobody's gun. >> The police approached the man who had just been beaten. Pressed him to give his name and asked for his CL license. Although he denied grabbing the gun, the police insisted he did. Right in the middle of the public area, sudden demands erupted. Identification papers became the center of tension, setting off a chain of unpredictable events. >> Hi, how are you guys? >> Mind if I get your names and badge numbers? >> You're a public servant and I'm just asking you to identify yourself. >> I want you to identify you. What is your name? >> No, I know your chief has taught you that you have to demand ID in the state of Illinois. >> First of all, I'm not saying demand, but let me say this to you. Listen, >> I listen to you, ma'am. Said I'm I'm just I'm asking you a question. >> But I'm asking you a question first. You're not innocent. I question it. So, you all don't want to hear about the volatile, dangerous situation that you all are putting these officers in. >> Oh, I'm not doing that, ma'am. >> But yes, you are. I'm not. >> Because if we ask you for your identification, give it to us. I don't know who you are. >> I don't know who you are. >> You can have a bomb on you. And so I made sure their qualified immunity is stripped. >> My head before, not here, but back in Bay Area. >> Yeah. I saw a lot of stuff like >> when power crosses the boundaries of the law, our silence becomes the fertile ground where injustice takes root. Hey everyone, what do you think about this situation? If you enjoy the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. >> Don't cause us to come back out here. I would stay away from this guy. >> Power in the hands of the abuser is like a double-edged sword, cutting oneself and harming others. >> You got any ID on you? >> I do. >> You're next. >> A public meeting, a phone on the line, and a lawyer who didn't expect to leave that day in handcuffs. What really happened outside that building? All right. >> Violation of the open meetings act. >> You need any help? >> You're not doing that. I think the violence against you for dereliction of duty then. >> All right. >> When people demand their right to participate, the police show up not to protect that right, but to silence [music] those who dare to speak out. But one man does not back down >> for the fire marshals. And they limited it to half of those 49 were employees. So only half of those were really the community was allowed. So, all these people are being denied the ability to attend a public meeting. So, I need to file a report. >> Okay. What do you What do you do? What What do you have to do with >> I'm a I'm an Oklahoma citizen that pays taxes and I need to file a report because all these people are being denied access. >> Okay. I'll talk to you in just a second. All right. Let's talk. >> I saw a part-time job today, buddy. I walked into this. I have no idea what's going on. >> All right. We're turning this off. >> We appreciate you. >> Oh, yeah. I'm writing up >> press to select. All right. So, >> so this guy Dur, he's an attorney. He comes up here and he uh because we're just disrupt pretty much his argument today that they want to um come into this open this meeting and they're supposed to be required to come in and they need to accommodate the group, but it's such a large group. They went into a room before this whole side. Okay. and he says uh you know well they they could just live live stream this since they don't have the can't accommodate the size group with the size of the rooms avail charges and he will cuz he's going to citizens arrest on them because I miss so I told him I'm not doing any of that. He said that uh he would um he sue me he's going to sue now you're probably going to be in it. >> Okay, good luck. Yeah, these people out of the lobby. Uh the people in the lobby. Um these two have signed into the deal, but if they're not going to go up to the uh if they're not going to go up to the room. Yeah. Out. >> Okay. We want them off the property. >> Do you believe that just [music] standing on the sidewalk can get you handcuffed? Don't touch me. >> Don't tell me what to do. >> Do you want to come out here and listen to this or >> Hey, be be quiet. >> Be quiet. I that's my constitutional right to exercise my right protected. >> Okay. So, here's the deal. As long as No one's getting out here is getting up to the meeting. Meeting's closed. As long as everybody wants to uh behave and act orderly and not get out of control and be disruptive. All right. You're welcome to stay right here at one some point you become disruptive and disorderly then that becomes different. Does that make sense? >> Good. I totally explained myself. All right. Don't cause us to come back out here. I would stay away from this guy because he's probably going to get you guys all in trouble if you listen to him. >> You need any help? >> You're not doing that. I think if I complaint against you for their duty, then >> take I'll let you take care of that. All right, we're getting out of here. You're going to not perform your duty. >> We'll walk back to my car and when we get back to my car, we'll get some ID on you. See if you see if you got any warrants. All right. Sound good? >> I I really don't. >> That's okay. Thank you. I just wanted >> Why did you touch me? >> All right. You follow me to my car. You're going to sit in the backseat of my car. I'm going to make sure you don't get any warrants. >> Arrest. >> No, it's a your chance to leave. Okay. >> Arrested. No, >> I'm going to check you for warrants. >> You don't have the right to send me for warrants. Do I have a reasonable articulable suspicion that I'm committing a crime? You do understand an attorney, right? >> All right. >> You just made me a ton of money, said a man after being pulled over by police in broad daylight. But why? And who was really breaking the law? >> You going to walk away or what are we going to do? >> I'm going to stay right here. >> Okay. We're going to check make sure you don't have any warrants. Come on. >> Okay. Wherever you go. >> You got any ID on you? >> I do. >> You're next. You're next as well. >> Why am I arrested? >> You're not arrested. I'm going to make see who you are since you're uh being disrupted. >> I don't have any weapons. >> After I handcuff him, I'm going to each one of you guys are going to come over and sit in my car. We're going to make sure you don't have any warrants. Okay. >> So, uh this is your chance to walk away just like I told you. >> Walk further back. Walk further back. >> Slide this way. >> Yes, sir. Stay right there. >> You're having a really bad day. I >> was having a pretty good day. >> Hope your body came. >> Have a seat. >> Not sure I'm going to be able to fit, but >> it's all right. >> When the body cam is turned on, not [music] only is the truth recorded, but also actions that could land a police department in federal [music] court. >> The minute you start causing problems, all right, that's when we're going to have an issue. Do you understand what I'm saying? >> I I understand. I understand what you said. You don't have to you don't have to agree. [music] That's why that's why you have a court date when you get arrested for disobeying a lawful order. I have to come out here >> and you're the one that's causing the biggest disturbance. You're the first one I'm going to come to just like right now. >> All right. You're just going to go straight to jail for being disorderly. Understand? >> I That's fine. >> You don't step out and turn around. >> And I suggest you tell your friends that are all standing around here the exact same thing. This is not a game. This is real life. >> Oh, no. You're right. It's not. >> You lost your qualified immunity when you put your hands on me. So, >> it's a beautiful day for me. >> All right. >> You just made me a lot of money. >> Yeah. >> A lot of money. >> Okay. >> I give that money to charity, though. So, >> all right. >> It'll go to a good cause. >> Okay. >> All right. >> I'd like my phone back where I was. >> It's up there on the front of the car and your license. >> I didn't get a hug. >> He had no arrest warrant. He stressed that the police had lost their immunity for using unjustified force, [music] opening the door to a federal lawsuit for violating his constitutional rights. The police failed to file a report, refused to take responsibility, and showed signs of a lack of transparency [music] and cover up. Rusty continued protesting peacefully without any violations recorded. After clarifying Rusty's rights and reminding him of the sensitivity of the location near the hospital, the police departed. Rusty faced no legal or negative consequences from this incident. These incidents remind us that knowing the law is not just a right, but a shield against abuse. Stay calm, stand firm, and never let power override justice and human dignity. [music]
