I'm not going to put. I'm going to start tomorrow. Let's go. Well, then I'm not going. You put cuffs on me and I came back out here. I ain't going nowhere. A citizen dares to challenge power and the unexpected ending right in front of the Central Bank. Why you have a mask on? Why not have the right to have a mask? Am I not on the public easement? You are. So, why do I need to vacate the public sidewalk? When the cameras are on, the police lose control. Is this a blatant abuse of power in the middle of the street? A normal man stands on the sidewalk with a camera, but just minutes later, he is surrounded by police for making others feel nervous. What is really going on here? Absolutely, but what are you doing filming the bank? I'm giving you a lawful order that you need to vacate in front of the area. I've not committed a crime. The police ordered him to leave the public area without giving a valid reason. When he asked back, "What law am I breaking?" the bad things started. Mom, you asked him. Is your body cam on? It is. Okay. Why do you have your gloves on? Why you have a mask on? Why not have the right to have a mask? >> Absolutely, but what are you doing filming the bank? Exactly what it seems like. For what? Is there not a First Amendment? There is a First Amendment, but you've got people concerned, so I'm just asking what you're doing. So, my right to record has people concerned. Huh? No. I'm just asking what you're doing. Why don't you enforce the law? >> hands out of your pockets. Okay. It's It's pretty cold, so I understand. I like to have my hands in here. You got any ID on you? Why would I need that? I'm just wanting to find out who you are. You got a mask on. I can't see your face. Exactly. We're in public. But, you need to You need to vacate in front of the bank. And where am I at? You're in Lake Ozark, Missouri. Am I not on the public easement? You are. So, why do I need to vacate the public sidewalk? >> Because you've got people nervous and they're wanting to know what you're doing. >> me a lawful order? I am giving you a lawful order. You need to You need to move the area. I'm not going to play this game with you. I'm not going to play this game with you. You need to step You need to get stepping. You need to get the stepping. I'm Sergeant Myers. I'm Sergeant Myers. I don't have to do that. Get Sergeant Myers. I'm asking you to get a sergeant here. You don't know the law. Yeah, I know the law. >> You're a dangerous man. 29 years I've been doing it. I'm not going to put my hands on you. My hands are on my vest. You gave me a unlawful order to vacate when I'm on a public sidewalk. >> You are on a public sidewalk. >> So, why would I need to leave? >> I'm giving you a lawful order that you need to vacate in front of the area. Yeah, you're free to go. I'm free to stay. Thank You need to vacate the area. I'm not vacating. Yeah, you are. No. Then, you're going with me then. So, you're going to put your hands on me? I have probable cause to arrest you. I'm not going to put. I've asked you to move. I've asked you to move. I sure did. I sure did. Why'd you do that? He was thrown to the ground. Handcuffs were tightened around his hands, but no charges were ever filed. Is this a slap in the face to the freedom to film? I'm asking you Do Do you not want to get Sergeant Myers out here? >> No. I'll take you to it. Why not? Even better, huh? You're going to You're going to unlawfully You're going to I'm not arresting you. I'm just detaining you. Okay. So, what crime? For what crime? For what crime? I did use my First Amendment to record. Do not turn my phone off. Do not turn my phone off. Do not So, how do I turn it off? He stole my phone off. How do I turn your phone off? >> it on the ground. All right, the screen won't stay off. That's fine. I'm asking you to get Sergeant Myers out here. You're making a mistake. What's your name? I'm not telling you my name. Well, you're failing to identify yourself, so that's why you're getting arrested. >> have I committed? You're failing to identify yourself. >> or articulable suspicion I committed a crime? Because you are failing to identify yourself. 708 702 He'll never answer his radio. Hey, can you come to Central Bank and see if you can identify this subject? He's been asking for you for the last 5 minutes. We gave him a lawful order to move out in front of the bank. He's got people nervous. And he's failing to identify himself, so There's my reason. The officer admitted this man did not commit a crime, but why was he still detained, injured a shoulder, and asked for medical help? The answer will make you angry. What am I doing in the club? >> Uh I'm familiar with him. I don't remember your name right off my head, but Well, he detained you for his investigation. He couldn't tell me what crime I committed. You failed to comply with a lawful order. I done told you. I told you to get moving. What crime have I committed? >> I just told you. Before you were here on the scene, what crime have I committed? So, why do I have to identify myself? >> Because I gave you a lawful order to do so. Because I'm investigating on why you're standing out here in front. You cannot reasonably You cannot Once you tell me who you are, you're going. That is the uh I I I I can figure his name out. Because what he was doing, he was down here He wasn't breaking any laws by being on the sidewalk. Would you mind stepping down the road for me? He goes, "Am I on a public easement?" And I'm like, "Yeah." He goes, "Why is your gloves on?" I said, "I wear them all the time when I deal with people." I said, "I'm giving you an order to get the stepping and identify yourself and pull your mask off." He goes, "I ain't got to do that either." I said, "Okay, if you're not going to identify yourself, you're going in the back of my car till you identify yourself." But, he wasn't breaking any laws. He's allowed to film all day long. Did they ever tell him to leave or anything? Or was he ever on Cuz if he was on this portion of the grass, that's technically theirs. That portion's not. I said, "When I got here, he was standing on the sidewalk filming, which he's allowed to do." Well, he's he's done some video requests before. He's I I know I can get his name. I know that. We haven't been able to record it to you. I just can't think of it right off my head. >> Wolf did a traffic stop on him here a while back. But, he's he's trying He's trying to find his name and he can't find it. Finally, after nearly 20 minutes of unreasonable detention, he was released, but the consequences are not easily erased. A typical confrontation between law-abiding citizens and abusive police. Okay, so how long am I going to sit here? I'm going to talk to him. He went in to talk to them and then we're going to figure this out. Give me another minute. Yes, it is. Don't mute and don't mute and don't mute. Do not mute. Is there Is there a crime here? Are they trying Are they wanting to trespass? There's They got nothing. Okay. I'm out. So, you you you messed up. Put your hands on me like that. And I'm on a public easement. I broke no law. Couldn't articulate any kind of law that I broken and you put me in handcuffs. I sure did. Well, you're going to be free to go. No, I need I need medical attention cuz you done messed my shoulder up. Look at him. Look how he's handling me. Just let him get the cuffs on. I'm I'm I'm relaxing. You got his hand on me. Once he gets the cuffs on No, I need medical attention. I can't even feel my hand, bro. Call for a medical. I can't even feel my hand, bro. He's calling for an ambulance. You're free to go. But, I can't even feel my hand. I need I need Here you go. Here's your [ __ ] I need an ambulance, bro. He's calling for one. What am I doing wrong? You put me on their public on their property now. I have not stepped on their property at all. You're free to go. But, I've always been free to go. >> You were detained until he could investigate what they What crime have I committed? That's why he was investigating. >> What crime have I committed? That's what he was investigating. And they said there was no crime. You're free to go. You're out of cuffs. You can go. He But, What's your badge number and name? I'm not doing this. That is Officer 708. Unreasonable detention, use of unnecessary force, violation of the First and Fourth Amendments. This is a clear sign of abuse of power, ignorance of the law by the police, and can potentially lead to civil litigation for violation of civil rights. Next, as soon as the police asked for his address, the man suddenly admitted to carrying a gun and being a public employee. But, what he did next really sent things spiraling out of control. Are you going to stop making a scene? I want my phone. I'm an inmate. Yep. That's what it's like. Hey, call the police. My gun is in my car. And I'm an officer. The car suddenly drove away from the scene. A psychological chase began as the person stopped wanted to decide the rules with the police. Well, couple of things. Number one, you're speeding. Number two, you have a license plate cover. Okay. It's going to stay there. I can't understand you. What? It's going to stay there, so you want What's going to stay there? That. The license plate cover. Do you have insurance for the vehicle? No, I'm going to have to take it. I'm not going You don't have insurance for the car? I got insurance, but I ain't got it here. It's at home. Okay. Is this your current address? No. No? Okay. What's your current Hold on. Hold on. I'm an officer and I'm armed. My gun is right here, so you don't go crazy. Here you go. So, get the ticket on or let me go home. I got you. I don't understand why you're acting like this. Because I asked you You I don't know cuz I'm I'm irritated today. Okay. And I'm just ready to go home. I'm tired. Okay, so what is your actual address then? The What The address that this car comes back to is what you just wrote down. That's the only one you need. Okay, is that what town is that in? That's Naperville. Cuz I stay over here I got an apartment over here. >> in Naperville? >> And down You know that that's downtown Naperville. Okay. There's no other Main Streets? Hold on. Why did you jump out the car so quick? Stay in the car for me. The two sides were locked in a bizarre conversation. I manipulated the situation to make her follow me. A shocking statement from someone who knows the law well. What do you need? I want to talk to you. Yeah, and I was told you I'm trying TO RUN ALL THE WAY UNPROFESSIONAL. You you doing things wrong. What? Now, do you want me to talk on your taser and tell me everything tell you everything Why don't you go back in your car? >> going in the house. You got my ID. You the place come back to with the at the address. But go get a supervisor. Write the ticket, but number one, number two, I don't know your taser. I asked you what are you pulling me over for. I said I said speeding. Oh. And the plate cover. No. She don't know. She got it on her taser camera. I showed her my taser camera. And both of them [ __ ] standing. Okay. I got pulled over for possibly speeding. I don't know. And the plate though. The only reason she seen the plate cover because I was speeding. Correct? When she pulled me over when she come to the car you could read my plate. I know I ain't I ain't no patrol. I know she supposed to run my plate and and send it in. I give her my license. She asked me is this the correct address? I said no. This car comes back to another address. She would have known that should she had a read the plate. >> She might not have read it yet. I don't know. I haven't read it. I know, but she coming to the car now. Okay. So now I'm like, oh [ __ ] She standing here. She see my gun. Let me show her my officer. And she still ain't giving me the You know what I'm saying? Or whatever she going to do. Okay. That's what I'm tripping on. A traffic infraction. And I told her I'm a officer. I say hey, can I talk to you cuz I want to ask you something. I forgot what it was. Cuz I can't come over there. I drive the buses. I drive the big buses. I drive the inmates to court to other counties. I'm in the process of retiring. 17 years. I'm currently on the job. So you left then, is that right? Yeah. Things escalated to a head when the handcuffs were tightened, but that was just the beginning of a dramatic standoff and threats to sue the entire police department. >> So what the [ __ ] she standing there for? And she know I'm a officer. So what what what is we we talking about? >> the thing though. If you're an officer, you should know that you need to stay there, right? What did I do? You left the scene. Oh, that sound like a [ __ ] report. You left the traffic stop. >> I Did I try to get your attention to come to Yes, and I was in the middle of doing something. >> Okay. Okay, who do you work for? Who do you work for? Cuz in this capacity, you work for me. And so I'm You told me not to get out the car. That means come here. You asked me what. I said I needed to talk to you. We have kind of a way we do things, right? We get the information, whatever we go back, make sure everything's cool. And I got the protocol. And I'm trying to give her a big up. Just cuz you call her up doesn't mean she can drive everything come right back, right? >> I can't come to her. That's true. I followed the rules. I asked her to come here and she said she was too busy to do it. But she wasn't doing nothing when she stepped out the car halfway and said, "What do you want?" I asked you, man. >> I respect you. She acknowledged that you waved at her, right? She can't just stop and come back and forth through you That's not how it works. And you I mean, you kind of know that, right? >> a [ __ ] because she was being who she was. All I did was work within the rules. I didn't break no rules. I asked her to come here. I pulled off. She got my license. What the [ __ ] I'm going to do? I I told Here go my other address. Right. I understand. >> Here go They can run the plates and all that. What address is that? Who's it belong to? Me. My company. Okay. Why would you leave? Because she wouldn't come, so I had to make her come to me. >> to me. That makes no sense. >> I had to make her come to me. I was doing what I needed to do to control the situation. But you left the scene. You don't control it. You don't control it. >> Hey, I do this. I do this. >> control I know. So you should know at that point you don't control it. From a simple traffic violation, he is facing a series of serious criminal charges. But is there anything wrong with the way the police handled this case? You did great on that. But then don't just leave. Man, I told you why I left. And I did a slow speed leave. But you understand how it works, right? >> I understand. I got you. I got you. >> And you can't just You can't just do it. You can't do that. We're going to place you under arrest for leaving the scene of a traffic stop. Yeah. For fleeing, right? So if you don't mind, just turn around for me. Hold on. Can you lock up my house cuz I got [ __ ] in there? Okay. Come on. First of all, um is this is this locked? Do Do I swear Do everything right? Can I get a I need my phone though. Okay, where's that at? You got me handcuffed. Can I walk with you inside my house? Let her Let her finish. Let her finish. Just so it doesn't tighten up on you, okay? No, this is the first time I got handcuffs on. Let me make a scene. No, dog. Hey, hey. Let's not make a scene. I'm an officer. I'm a Cook County Sheriff. >> Okay, let's You want to get your phone out of your No, we going to make this No, we going to make a scene. Y'all want to put THE CUFFS ON? HEY! LET ME GET YOUR PHONE. OKAY, if I don't get my phone, I'm not going in that place. >> Well, yes, you are. You going to give me my phone. Okay, y'all going to pick me up. Are you going to leave Are you going to stop making a scene? Are you going to stop making a scene? Yeah, if I get my phone. >> your phone. All right. Okay, well then we're not getting your phone. Let's go. Well, then I'm not going. Hold on. Y'all put cuffs on me and I came back out here. Y'all going to All right. Do your job. I'm a inmate now. Yep. That's what it's like. Call somebody. Not going to leave my house unsecured. My weapon right there. >> We'll get it. We'll get it for you. We'll get it. We got to get people involved. HEY! HEY! 10-33. HEY! HEY! MY GUN IN MY CAR! And I'm a officer. Come on, Chris. They know I'm a officer. No, ain't no ain't no prison. Let's go. No. Ain't no go. Chris, come on, buddy. >> Come on. Y'all want to play inmate? >> Oh, I saw that. I'm an officer. I saw it. How you What you see? Come on, man. I'm in handcuffs. In the state of Illinois under 720 ILCS 5/24 1.6, unlawful possession of a weapon, first offense, class 4 felony, fine up to $25,000.00. Stay down. No. Okay, you want to You want to go down? No. Oh, [ __ ] YOU BROKE MY LEG. NO. You want to do that? That's where we're going to stay and we're going to wait. Okay. This is on you, buddy. >> Why did you do that? You could have broke my leg. We didn't though. You know what? So we're going to get you in the car now. >> I hope y'all don't tase cuz I'm sweating. Okay. All right. We got to get him in the car. Okay. Hold on. Hold on. I get up. All right. I get up cuz I'm not sure my leg going to go. My leg broke. My leg is broke. My leg is broke. The right one. This right one. I can't move it. Yell all you want, man. >> We're going to sit you up on your body, is that Okay, I can't No, I need to keep it like this. Look at the kneecap. Got you. Stay right there. >> move it. Okay. Okay, we got the ambulance coming. We're going to keep you right here. You want to put your head down, that's fine. Hey, make sure you film it. He is. Don't worry. So where are we? Broke my [ __ ] leg. Let me bring the paperwork. Yes, let's get him here. Hey, and they know I'm an officer. Hold on. Hold on. You act like I was about to punch. You scary than them. You shouldn't even be in this job. >> You You've been elevated the whole time. The whole reason why cuz it's your ego. Your ego got me on the ground. You shouldn't even be in this job. You [ __ ] You going to kill somebody. Naperville got enough and you up here exciting it. You knew I was an officer. Pribble was charged with several counts, class 1 felony, 4 to 15 years in prison, class 2 felony, 3 to 7 years in prison, fleeing from arrest, resisting arrest, operating a motor vehicle without insurance, concealing license plates, and speeding. Up next, a traffic stop for a minor offense, but the way the police handled it makes one wonder how far is their authority. Hey buddy, it's Officer Wilson Police. How are you? Hey bro. Officer Wilson Police. What's up? Um license, registration, proof of insurance. We'll get into all that afterwards. What is it? License, registration, proof of insurance, please. Then we'll get into everything afterwards. Why though? Once I get your license, registration, proof of insurance, we'll get all that out of Well, it's completely legal. You're being recorded. You're going to hand me that and/or it's going to go a completely different way. I don't want to go that way. I'll tell you how what we stopped for afterwards just so I can identify you. I think I got a right So to be completely honest, it's a courtesy. We don't have to tell you, but I do I will tell you. No problem at all. But I'm going to need that license. So let me get that license for you, probably, sir. Okay, I'm getting pulled over. I think I have a right. >> Sure. Let me Let me get your license. I don't want to make this anything that doesn't have to be. I'm going to take your license now. Otherwise, we're going to have issues. I've asked three times. Thank you. Stopped for a minor signal error, the driver asked for the reason, but the police delayed and immediately asked for his papers. When he hesitated, he was warned, "If you don't give it, we'll take another direction." But that was just the beginning. The reason for the stop is you didn't use your turn signal 100 ft prior twice. I gave you whatever I saw the first time, not a big deal. You got to signal 100 ft prior to a turn. It's not a demand. It's a request when you turn on that turn signal. So it's just one thing I'm going to you know, not the end of the world or anything. I just want to stop make you aware of it. And uh is the vehicle registered to you, sir? Yeah. Okay, I got you. And do you have proof of insurance? I paid. All righty. May be a good Do you by chance have it on your phone, maybe? Uh no, I guess not. Are you carrying any insurance? Uh let me see if I can uh What happened to the window? Remember that uh that windstorm that came through about a week ago? Yeah, there was a bunch of people who ended up getting So sir, let me ask you this while I'm standing here. Do you have anything inside of the vehicle that we need to know about? Anything illegal in any way? >> Uh I'm going to plead the fifth. That's uh That's my right, you know. Would you mind if we checked to make sure you don't have anything illegal? Of course I mind. Because, you know, it's my right, you That's why we're asking. I'm not pulling you out searching. I was just wondering if you sent me for Despite only being reminded of a minor violation, the police continued to question and request to search the car. The driver clearly refused. But things did not stop there. Here you are, sir. So, I'm just verbal on those turns and violations. No big deal. Make sure you do signal 100 ft prior to any Sorry about that. Sorry about that, bud. This is I like checking out this guy's channel. He goes over a lot of things. He I appreciate your uh Absolutely. I appreciate you not in you know, going over top of my rights. This is I've learned a lot from this guy. A lot of people think that he's a little bit of a dick. You know, because he don't really like because cops they do they they invade people's rights and stuff like that. We take that stuff very seriously. And I will let you know just for future reference, an officer there's no ORC, no case law, no anything that states an officer has to tell you why we pull you over. Obviously we do as a courtesy. If I was pulled over I'd surely want to know what it's about. But also I would not immediately say, "Hey, you got to tell me this that and the other." If you don't give the ID or don't give the ID they ask you to tell them your name. So, obviously we didn't take that route. Glad we didn't didn't feel the need. Um Yeah, just make sure you hand over the ID. The place to fight anything is going to be in the courts. That's for sure. But again, I'm here to protect people's rights. So, we'll let you off with a warning. I'm going to block traffic so you can get back on the roadway. Have a good rest of your day, sir. Finding no violations, the police returned the papers and issued only a warning. Before leaving, they insisted that there was no need to state a reason for stopping the vehicle. A controversial statement. In the United States, police brutality can be sued under federal law if it violates a citizen's constitutional rights. Police show signs of soft power abuse, stopping cars for minor offenses, indirect threats and psychological pressure. A self-proclaimed police station owner brazenly asked citizens to leave. But was this really his right? This is public parking over here. Okay. All right, you just told me you're the owner. You're telling me to leave. When the police started asking for IDs, the situation immediately changed. Was there a legal basis or was it just a blatant abuse of power? This is private property, sir. I'm going to have to ask you to leave, okay? I'm just taking pictures. I know, but it's private property. Well, I'm I'm letting you know. I'm the city manager, so Oh, you're the city manager? What's the What's not pri- What's Where is it not private? >> are you taking pictures for? I've already told him I'm just taking pictures for stuff that I use for other like stories or whatever that people do they buy them from you. Well, the issue is that part of half of this stuff is city property. >> a little close. Do you want to back up? Sure. Got you. And you know, it's authorized personnel only. And to the best of my knowledge you haven't been authorized to be here. Okay. So, I'm going to have to ask you >> don't have to pay attention to what you say. If it was a if there was a legal issue, then I'm sure the officer Well, it is authorized personnel property only, so that's why So, I'm the owner Technically I'm in charge of You're the owner? I'm the owner. Got you. Okay. Well, [ __ ] I didn't know. So, why not Appreciate your cooperation. Is this parking lot that's private or What's not private? Everything down to the river and this way is is city property. This is public parking over here. Okay. The park across the river is public. But you know, I guess my question is by you taking pictures it makes a lot of people uncomfortable. And especially you know, with everybody being masked up because of COVID The back and forth was tense. The request for name and number was avoided. Were they trying to hide something? You have an ID on you? I do have an ID on me. I don't understand what the issue is. Again This This is You shouldn't be taking pictures inside a police vehicle. No, and that's You don't have access to that. You're not allowed to see that. It's confidential information. It's off. It doesn't matter. So, do you have an ID on you so I can just know your name? I do have an I do have an ID. Okay. Can we see it, please? Wha- Why are you not a cop? Why would I have to show you my ID? They're asking for your ID. Now, you're guiding them to ask for my >> I'm their boss. You're their boss? You're the chief of police? Yeah, I [ __ ] Get educated real quick. Why don't you back up? I ain't giving you nothing. >> Okay. Then I'm going to ask you to step out. >> leaving. I'm not moving at all. Yeah, stand stand down. This isn't private property. This is public property. How long you've been a cop? I'm not saying that. How long you've been a cop? You're too dumb to A sudden push from the police sparked a fierce confrontation in the middle of a public area. No. It's on my uniform. It's So, it's right there? So, you don't know how to identify either? What's your name and badge number? Officer Paniagua. Badge number 812. So, what's your name and badge number now? Let's start with that. Name and badge number. Officer Arlin. There you go. Badge number. >> 178. There you go. Learn something. No, I'm not. I'm not moving. No. No. How about that? No. You're nobody. You're a city manager. You're the city manager of Calistoga? You're the city manager of Calistoga? You need to get educated on the laws. You even said You were even dumb enough to say you were the owner of this property. You don't own public property. What's wrong with you? What's wrong with you? It says no vehicle. Does this In that code say people can't be here? Cuz I can bet you it didn't. I can bet you the code doesn't say that cuz I looked it up. I looked up the code. If there's no law to back it up, there's nothing you can do. So, what's your name as a matter of fact? What's your name? You're a pu- You were just 1 ft from me. I can get close. I can get closer. You're You're a public servant. What's your name? Mike. Let me ask you that. Why would you think you're the owner of public property? Yes, you are. You just told me you're the owner. You're telling me to leave. You're not a chief of police. You're a city manager. You There You ever heard of a separation? You don't tell them what to do. Their chief does. And you think you're the owner of public property? You're lucky there was an educated cop here who who knew to call because if if if this officer would have mistakenly touched me or something, your city manager would have cost the city of Calistoga a [ __ ] ton of money. So, learn the law before you try to enforce the law, right? This is public property. This is not your property. So, we have an ignorant city manager here that does not know the law and another ignorant officer that was willing to enforce laws that don't matter based off of this man's word. As a series of officers were called to account, the atmosphere turned into a public manhunt right at the scene. You're touching me again. I can walk wherever I want. Look at all these piece of trash Sacramento cops, dude. This dude thinks he can touch me and push me whenever he wants. Straight piece of garbage, dude. Fine, I'll back out if you're going to move the vehicle. I got no problem with that. Straight piece of trash. I need everybody's name and badge number real quick. I got most of them, but now they're not identifying. What's your name and badge number? Name and badge number. See? They won't identify none of them. I need everybody's name and badge numbers for the record so I can file complaints. Need you all name and badge numbers so I can file complaints. It's in your guys' policy to give that to me. Okay, name and badge number. What's your name and badge number in the back? Name and badge number. Get your funky ass out of here. Name and badge numbers now. They're just going to drive away as well. Yo, I need your name and badge number. It's in your policy. Okay, I'll get the car. That's the vehicle. I don't know if that's Sacramento or Calistoga. But it looks like Sacramento and Calistoga are about to go uh raid somebody. The video ends with the police leaving and the citizen affirms that he will pursue responsibility to the end. The incident exposed the abuse of power and ignorance of the law by both the city manager and some officers. The potential damage to the agency's reputation, high litigation costs, and increased public pressure on abuse of power in law enforcement. Next. In the heart of Jacksonville, a man simply holds up a camera but is immediately warned. This is the law. You could go to jail. You doing what now? I'm going to keep on taking pictures. I appreciate your concern. This is a public public sidewalk. That's public. It's true. So, am I being detained? Yes. At this point you are being detained. When the police showed up, they admitted he had done nothing wrong, but still forced him to show his ID threatening to arrest him if he refused. I'm sorry, I can't hear you. I'm sorry, I can't hear you. Yeah, you can't take pictures of the building. This building right It's policy. You can make sure your stairs are checked in here. I'm going to take your picture of the building. Cuz of what? Cuz of 9/11? 9/11. Is that Is that law or policy? It's law. If I keep taking pictures, what's going to happen? We're going to have to have to come put you in jail. I'm just saying. We just left him right there. You don't want to get yourself in no trouble for nothing like that. >> Well, well, I know Now, you can go across that street over there. You can do anything over there you want to. Okay, what's the difference between this public sidewalk and that public Right. And you're not allowed to take no pictures downtown of no building. Really? No buildings at all? None at all. Okay. Well, I'm going to keep on doing it. You doing what now? I'm going to keep on taking pictures. I appreciate your concern. You can't do that, sir. Are you going to call up there? You call whoever you want to. It's It's perfectly legal. You can take pictures of whatever you want to. You do the base, not the building. Sure. You have a gentleman wanting to take pictures of the base. What street you on, bud? Monroe and Georgia streets, sir. What is he wearing? He's got a black vest on, gray pants. He's got black caps. Now, by our call, JSO. Okay. Okay. You can't take pictures. Go ahead. The situation suddenly took a turn. Initially told to go free, but just seconds later he was declared under arrest. A chilling turn of events in the middle of a crowded street. private property What? This is a Say. public public sidewalk That's That's public. That's true. Just because you're standing on public property >> Where does the private I mean you can take pictures of a private property. Where does the private property begin? I want I'm walking. taking pictures of the All right. Okay. Do you have any ID on you, sir? Uh yeah, but I don't I need to see it. For what? What am I doing wrong? You're not doing anything. Okay, then why I also have the right to ask for your identification. Okay. And if you refuse to identify yourself, you can be arrested today. I'm not doing anything wrong. That's what >> being detained or I'm not being here. You are the one that contacted me. So you Okay, so if you want to leave, you can leave. But if you're going to give me trouble, then I'll give you trouble. >> giving you trouble. I'm just You either. You want my opinion, I just gave it to you. Okay. Okay. Are you video taping me? I'm going. Bye. Sir. Have a nice day. You said I'm free to go? No, you're not. Okay. Put the camera down. Okay. Uh I'm video taping for video recording, sir. All I wanted to do was ask you about it cuz I'm in a public space. You are. Yes, sir. And you're a public official. >> Yes, sir. That's right. That's correct. I have not done anything wrong. And if I'm not being detained, I'm leaving. So am I being detained? Yes, at this point you are being detained. Okay, am I being detained? Can you tell me why I'm You do see my 13. Can you tell me why I'm being detained? Well, now you are. You tell me I'm being detained. That's the law. If I'm not being detained, I don't have to show it to you. Okay. But I would like to know what legal reason you're detaining me. Okay. By no way in Put that that camera away. I'm not turning it away. That's my right. Are you going to give me your ID or not? Yeah, if you're if you're detaining me, I think it's an illegal detainment, but I'll go ahead and give it to you. I'm investigating a suspicious circumstance at this point. Investigation of suspicious What is suspicious about what I'm doing? Police justified the incident as a suspicious situation, but can taking a few photos turn a citizen into a suspect? Or is it just an excuse? My opinion on what was? I was out here. Uh he's real nice to me right now. Okay. They came out and told me I couldn't take pictures of the building. They told you you could? Officer told me I could not take pictures of the building. All right, so I told him that they're misinformed. This is a public space. There's no expectation of privacy in public. I'm on a public sidewalk. You And you're right. You can take pictures. You can video tape me if you wish to, but I have the right also to contact you. >> can I go ahead and go then? You got to run my ID for what reason? Now, that's If you run my ID I didn't say that I was going to run your ID. Okay, then what do you have If you have If you run my ID, that's illegal because I'm not suspected of a crime. I'd like to be free to go as soon as possible, sir. Thank I'd like your name and badge number, too. This is all because I'm taking pictures in public. All this. An imminent danger of being arrested. I'm surrounded by three JSO officers. I'm at the EverBank building. All I was doing was taking pictures of the EverBank building. I have three JSO officers down here. I'm being illegally detained cuz I haven't done anything wrong. He demanded my identification. He never told me what he's being what I'm being detained for. He said something about a suspicious person. I told him that I'm only down here taking pictures of the building. And now he's detaining me. And then because of the camera, three policemen surrounded him, took his papers, while he had to call for a lawyer on the spot. This is a chilling example of how legal rights can disappear in the blink of an eye. Okay. Would you guys like to speak to my attorney? about something I don't know what's going on. I just got out. Okay. Uh this this guy in the car, he's he's running my ID. He's on the radio. So uh He He took my ID. He took my ID because he said I was being detained. At that point when he said I was being detained, I gave it to him because, you know, at least He said he was detaining me because I was a suspicious person. Even though I I did. I asked him I asked him repeatedly and he just doesn't answer. I'm reporting right now. Yes, sir. Uh yeah, that would be great. That would be great. I'll get his name and badge number. If I don't get arrested, I'll get his name and badge number before I leave. Okay. Thank you, sir. All right, I'll keep in touch with you. Okay, thank you, Mr. Hey, sir. I have a 12-minute parking meter. If I could go ahead and get out of here before that thing's expired. All I'm doing is taking pictures. That's all I'm doing. Where you got Where you got your car? I'm right over here. On this street right here? Uh over there. Yes, sir. Next to you or the second one? Up there to the right. What kind of corner of that one. What kind of car? Uh Ford Freestyle. Babe, Ford Freestyle. You're free to go now. Okay, can I get your name and badge number, please? Sure. You got a pen? I'll just go ahead and say it. I got it on camera. I don't know. Sir, you can write it down if you wish. So you're not going to give me your name and badge number. Yes, I do. Write it down, I'll give it to you. Okay, if you could just say it. No. Okay, it's on the car. All right. Can I step out here and look get it? Is that okay? Well, hopefully you don't get run over. Okay. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/police chief. The incident demonstrates the potential for police to abuse their power using vague suspicion to lawfully detain citizens. This could lead to civil claims for first and fourth amendment violations, reputational damage to JSO if publicized online, risk of litigation for unlawful detention and forced ID without specific charges. A tough guy called 911 to report the police, but unexpectedly got arrested right after. So you're refusing to exit the vehicle? You're under arrest. What am I under arrest for? What am I under arrest for? You know this is wrong, bro. You know this is wrong. I don't have your driver's license. Confronted by a tough trooper, a distress call turns into incriminating evidence against him. A seemingly normal traffic stop, but why did the man immediately call 911 to ask for help from another police officer? I'm in fear for my life. You can't do that. No. I quit. I QUIT. I QUIT. I quit. He screamed in desperation, "My hip hurts. Don't break my arm." But the officer insisted on dragging him from the car. Was that response lawful or an abuse of power? He blew me up for no reason at all. He's intimidating me. All right. Is it the state police Yes, it is. He's on the program now, court. Hey. What I need from you right now What I need from you right now is a license. Sir, so you're refusing to exit the vehicle? You're refusing to identify yourself? He's trying to take me out of my car now. I'm coming with you. You ain't got to pull me. I'm getting down. You ain't got to pull me. He's going to pull me down. He's going to pull me down. Trust me. He's going to pull me down. I got a messed up hip. If you [ __ ] my hip He won't pull you down. It won't. If you [ __ ] my hip, you will get a lawsuit. I want to look at your car. If you're arresting me right now, for no reason at all. I can't do that. I know that. I know that. I'm free. He's going to break my [ __ ] You got to put your hands up. Sir, I need my phone. You're holding my wrist. You pulled me over just cuz of authority of badge. You had no reason to pull me over. All because you wanted to be a a prick. If you hang up You cannot do that. I'm in fear for my life. You can't do that. I can't breathe, man. You got me on the side of the road. I'm in fear for my life. Now, what is the reason why I'm being detained? In the middle of the highway, people denounce, "I was was because I am black." Is this racist behavior or a panicked excuse? As he was handcuffed, he warned, "I will take this to court. I have full evidence from the camera and the doctor. What lawsuit awaits Officer Fortune ahead?" He was going to plant drugs in my car. A serious accusation amid the climax, leaving the audience asking, "Where is the truth?" No. The arrested man said he would hire a lawyer, request body cam video, photos of his injuries from a doctor, and file a lawsuit against the police for wrongful arrest, unnecessary injury, and civil rights violation. As soon as we entered the Dublin School District Headquarters, everything seemed normal, but just a few minutes later, tension exploded when the cameras appeared. I'm just taking pictures of the building. Okay, have you checked in with the secretary? But you're not able to walk throughout the building without signing in and having somebody escort you. Well, confirm. Any public areas I can be in and be around, so. The assistant director asked for a signature, asked for an escort, but the cameraman flatly refused. Just because of that, the police were called? I'm just taking pictures around the area. Okay, do you work here? No. Do you? I do. Awesome. I'm the assistant superintendent and we don't usually have people take pictures of our boards. Um, so I'm going to ask that you not do that unless we have another conversation about what you need the photos for. Well, I mean, these are kind of up out in the open. I would put them in the back or something if you don't want people to take pictures of them. But I still don't understand why you need the photos for. Uh, I'm just taking pictures of the building. Okay, have you checked in with the secretary? Okay, so let me have you sign in. Uh, no, I don't typically sign in. Well, then I'm sorry, but you don't have permission to be in the building without signing in. Why is that? You check in at the office and you identify who you are to visit the building. Without doing that, um, we need to know why you're here so we can support you and help you get in touch with the person that you need. >> Got you. No, um, no, I'm just going to walk around. I don't need any help, so I don't need anything from you guys, so. And I understand that, but you're not able to walk throughout the building without signing in and having somebody escort you. I don't understand why that is. I mean, I don't want to sign in. If you want you guys want to follow me around, you can. Do you have students in our school district? Without being able to understand how to support you, um, you're you're not able to just walk through the building. Uh, so again, I don't need any support from you at all. Um, he said Think she's like the boss or something. Then suddenly, the superintendent appeared and instead of being calm, he dropped a shocking sentence. "I'll put you down." Was that a real threat? Oh, cool. We're trying to understand why somebody we don't know is in the building taking pictures without explanation. Well, if I don't want to disclose that. I think if you're going to be here in our space taking pictures of our building and possibly people if I saw you taking pictures of Well, because this is a place of business. And anytime, even though it is a public place, we do have rules that govern who comes in and and what they do when they're in here. Is that you guys' policy? I didn't understand that when she said it at first. Um No, I don't I don't I don't need to sign in cuz I don't need help from you guys specifically, so. Funny part is nobody asked to sign in. Nobody said they were going to escort me as Heather said, so. I don't understand what the issue is. Yeah, and I went and used it. And that was awesome. anytime you come into our office, you need to check in and you need to be here for a reason, not just Well, taking pictures is a reason. You have to have permission for that, sir, from the superintendent. From So, is there So, is is there is there other offices back there that people the public can get assistance from or I mean, I saw I saw them back there. They come in for an appointment and it's and if they don't have an appointment and someone who they want to see is not available, then you'll have to make an appointment. But you don't get to just wander any public office. Yeah, cuz it's public. Yeah. Yeah. So, sir, if you can't state who you are and what you're here for, I'm going to have to ask you to leave. >> What was your name again? My name is Chris Vaughn. Yeah, it's I don't disclose who I am. There's really no need for me to disclose that, so. Well, then I'm going to ask you to leave, sir. Okay, yeah. >> Make sure you wear a jacket. No, you're going to leave, sir. Oh, I thought you guys wanted to go outside. No, it's cold. That's too cold out there for me. I don't want to leave. Dublin police arrived. Initially, they sided with the school authorities, even mentioning trespassing, but the truth about publicity laws made them embarrassed and had to call in higher-ups. You you guys called them, you can talk to them. This person won't identify who he is. He is trespassing. Mhm. And he will not leave. I'm trespassing in public. So, I've asked him to leave and he refuses to leave. So, sir, this is private property and they don't want you here. It's private property? Yes. Are you sure about that? They've said several times it's public. This is a public building. Do you want me to call my You you might want to cuz you're you're being dumb right now. You're doing something dumb. Un- until you're till you're done with that, let me know. I'm going to go about my business and take my pictures. This is a this is a public area and you can't be trespassed from public. And the next time you threaten me, if I feel like you're going to attack me, I'm going to defend myself, so don't do it again. This guy laughs, skinny little twig over there. So, the superintendent said he's going to put me down if I get rude. And then we got the twig laughing about me saying defend I'm going to defend myself. This funny as all hell. So, you got the Dublin Police Department officer calling his sergeant because he's way out of his And uh, I'm walking around the public areas. These are the public bathrooms, as you can see. So, you clearly have access back here. Now, if you need to come educational services, special education, you have access to this office. So, now they're closing this uh, public building. Here goes educational student services. You have access to this as well. Here, this is a lobby for people who need help from the public. >> This is not a public >> is simple. Yes. >> This is people who walk in. People Public doesn't come in here for stuff? In the end, no handcuffs appeared, but the threats and heated arguments left a big question mark. Who really understood the law and who was the one overstepping their authority? I've been respectful the whole time, right? Stop talking to So, I can talk to you all I want. What's your name and badge number? Gerber, 1384. Okay, I'll talk to you all I want. Think it's professional to be chewing while you're on duty like that? Is that professional of you, sir? This guy here. Mouthful of chew talking to people. I can smell that [ __ ] from 4 ft away from him. Anyways, so yeah, I can walk the public building and wander around the police department like you asked earlier and I'm still there. They'll confirm. Any uh public areas I can be in and be around. Sure. That's it. Let me see you for a second. Cool, man. See, did you learn that? I hope you learned something, bud. And we got Gerber who's uh You take testosterone or something? Steroids? Be professional. All right. Got it? Yes, sir. That's what I want to hear from now on. He starts laughing. What a clown. He doesn't know who he works for either, apparently. He You know, you come in, you're talking to people trying to explain your rights and he says, "I don't need to talk to you." You don't talk to me like that. I was just trying to explain to these dudes. It would have been better if you guys would have came in and said, "Hey, he can be here." And then my old lady explained that to him. I understand. I hear you. I understand. Yeah, all these publicly accessible areas, the halls and stuff. I thought I did that. Yeah. Funny how that works, huh? At 4:30 our office is closed like you know how the business is Mhm. Yeah, if it's closed, I can't be here. It's not open to the public at that point. But right now it is. And you threatened to put me down. Does that sound like a good idea? Or professional from a superintendent of schools? >> Why why are you even here if >> No. Nope. Nope. I got some business I'm conducting. Okay. And what I was going to ask you a second ago as he was giving an example and I'm just I was really trying to educate them. It would have been better to approach a different way from you guys. I wish you were already educated on this. It didn't seem like you were. So, luckily we could help you out with that today. But then I was trying to get you to confirm that yeah, you absolutely can. Yeah. So. Public building, public servants, all you guys. You guys work for the public. >> The superintendent was heavily criticized for his put you down remarks, which were considered a threat of violence and unbecoming of an educational leader. The incident showed a lack of understanding of civil rights in public officials and local police. The person filming the video warned that he would appeal to the community, which could lead to disciplinary action or the loss of Funk's position. Next. In the middle of a public building, a staff member loudly announces, "No filming allowed here." But is it the law or just an unfounded ban? I'm absolutely allowed to film you. You can call the police. I implore you if you feel that you need to do that. >> were confused. They thought that there was some sort of consent in a public place. >> That's why I had no and I showed the officer the video. The people strongly protested. The law of mutual consent has been abolished. This counterattack silenced the whole room. I'm just getting a duplicate license. We're filming just cuz it's a public building and there's no expectation of privacy in public. So, there is actually in the state of Massachusetts this two two consent authorization and I'm not consenting you filming me. Well, here's the thing. You're absolutely wrong. I've done this at the DEA, Secret Service, and the Billerica Police Department right up the street. You're more than welcome to call them. They're going to let you know that as long as I'm in public, I have business to conduct here today. This is a constitutionally protected activity. But you're a public official in a public place. I'm absolutely allowed to film me. You can call the police. I implore you if you feel that you need to do that, but they're going to explain to you the same thing. >> I mean, sir, we all have cameras here at all times. You know what I'm saying? I I should be allowed to have him film me conducting my business. But there's also there's also customers in this building that are not consenting. But the common mistake people make is you don't need like paparazzi who make make no money if you have to like get a consent. You don't need any consent. The moment you step foot in public, there's zero expectation of privacy. And I actually have a video from the police department saying thing. You can call them if you want. This is a constitutionally protected activity. We're not here and just so you do know, we could film the patrons, no private information. We're just here to document the process of what he's doing today. All right. All right. Appreciate it, man. Thank you so much. Your hair's looking phenomenal, bro. And I don't know where you're going, but looks good. That guy looks like 10 lbs of [ __ ] in a 2-lb bag. Like so, you don't sign consent. Oh, that's a request. That's a request, ma'am. That's a request. We just talked to him. He understands. Instead of protecting citizens, the building security guard shouted, "What do you want?" A tense question sparking the confrontation. So, guys, what you just missed is I came outside. I didn't hit the cam record button in time, but that security guard right there, I come out and these folks are talking. He goes, "What do you want?" That's not very nice. Sticks and stones, I guess. Sticks and stones may break my bones, but cameras never hurt me. Go outside and I thought I hit the film button. I didn't. It was only a but second I walk out and the guy that's just helping you says, "Yeah, and they're filming. We don't want to be on film." Then the security guard says, "What do you want?" A valued member of the public on a public easement conducting constitutionally protected activity with business at a publicly funded place. That's the problem because I don't normally blame exactly the employees, but it rolls downhill. They're They can only you know, it's leadership by example. Well, the wiretap laws were repealed, but filming a consensual conversation in a public place wasn't covered under wiretap anyways. And that security guard How much you want to bet that security guard applied to the police force and he did not make it? Cuz you can tell he really wants to use his firearm. I wonder how many people he was wishing he could shoot just today. How many you think? 12 or 13. Police appear making a shocking request. "You need to show two forms of identification to film." But is there really such a law? Police. Officer Foley, badge number 211. Thanks, Officer Foley. We're My friend's in here getting a duplicate copy of his license. >> Okay. I'm filming. I think they were confused. They thought that there was some sort of consent in a public place. >> Okay. And that's all it was. Am I being detained? No, you're not. All right, so I can refuse to answer that question. You certainly can. Thank you. So, is there a problem filming in a public place? So. >> that you are not You are allowed to do what you're doing. I am. Perfect. So, that's the whole point. Okay. What you're doing is you're causing people inside to have an issue. I actually have the film if you'd like to review it. Not one person has an issue. You know why? Cuz not one consumer has been on this film. Four people. My friend, security guard, this gentleman, and the other woman. Most of the video is going towards the ceiling because we're not here for consumers. You can't say that there's been any loud words. There's been no interaction with anyone else in here. So, their Their issue is The issue is that they think that it's not okay to film. Okay. So, we're just letting them know that it's not a two-party consent. It's It's public. >> Right down there with the hat. this. Like right down in this last row. Right here, yeah. Oh, see there they know. It's the guy that comes to film the PEDs. It's Josh. Officer Foley, badge number 211. We've established there is. How can I help you? Um You can make your way this way, Mike. He's filming cuz I told him to do that. No, I understand. I have no problem with you guys filming. Like you guys can do that. Yeah. So, is there a Is there a law that we can't film in here? This is what I'm trying to understand. So, what is your what is your business doing here? Yeah, I'm getting a duplicate of my Okay. So, I have official business here and I brought him so he In the end, when the truth is revealed, who is the one who really learned the valuable lesson in the battle between freedom and the imposition of power? I don't even have to answer questions to why I'm filming cuz right now I'm doing a constitutionally protected activity. I could stay here all day if I want. I have business here. Okay. Can I Can I ask you to not have the phone at the counter cuz there's privacy I didn't plan to bring Not because there's any laws prohibiting me from doing it cuz if you want privacy, you have to create it. But when someone goes up to the window, they have the expectation that that's a private encounter. So, I had no >> Okay. And I showed the officer the video. I'm here with somebody here to get a duplicate license, okay? We're cooperating. You said you weren't going to film up there. You're not going to film up there, right? I'm not going to. If I wanted to, I could. So, if we ask anybody I'm not going to go up there. Now, if you film me, all I'm going to do is watch you, buddy. So, would you please, Officer Foley, understand I I do believe that you're doing a a good job. I understand that you have to take the facts that they're reported and investigate and and they use the term this day and age, but I don't mind You know what? I don't mind doing that. I think life is all about equal balance and measures. While I'm doing that, it's like a soft yes. No, you don't have to do that. I'm actually going to help I'm going to If you get me some paper towels, I'll do that. I'll throw some paper towels on there. Cuz accountability for all of us here for anything, we're here to serve the public. And the RMV employees learned a valuable lesson today that it's all right to film in a public place. I don't think this guy is super happy about it, but Do you mind having a seat for me? Yep, that's fine. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals {slash} organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/police chief. They proved that filming in a public building was legal. There were no actual arrests, but the fact that the police asked for two pieces of ID and initially sided with the RMV employee shows ignorance and potential abuse of power. Next, a man riding an electric bike was stopped in the middle of the road, but the reason left viewers gasping. No hand signals? This is a traffic stop. For what? You need to see your driver's license, registration, proof of insurance. You didn't use your hand signals right here when you made a turn. I need He's arresting me for riding an electric bike. When the citizen asserted his right to remain silent and called 911, the police officer responded with a sentence that made everyone's blood run cold. I'm going to take you to jail. Hello. I don't want to stop talking to you. I want to leave. Okay, this is a traffic stop. You need to see your driver's license, registration, proof of insurance. No, none of that. I I don't have to give any of that. This is an electric bike. It doesn't matter. You still have to obey all the rules of the road. Buddy You have to obey the rules of the road. What what's the rules of the road You didn't use your hand signals right here when you made a turn. >> No, you don't have You're swerving on both sides of the roadway. >> Because I'm avoiding things. Buddy, I'm not going to give you any information if you're I'm being detained. Okay, I refuse to talk to you. I plead the fifth. Okay, and if I'm being detained, you have to tell me.
