But you are being trespassed. So you do have to leave >> from this public street. >> No, this isn't a public street. This is state property. This whole thing, the fire academy and the prison is state property. Okay. >> Right. >> Now, we need to shut the cameras off. >> Well, that's not the way it works. >> You're a law enforcement. >> But here's the deal. >> Their policy is that they don't speak to the media unless >> I'm not a member of the media. >> Police don't always understand or apply the law correctly. And sometimes that alone pushes [music] situations too far. This is a state facility. So, if you don't leave, I'm sure you know what happens. Okay? I don't want to get to that point. Um, but I'm asking you to leave. Okay? >> That's not [music] the onus is not I'm not HIPPA certified. The onus is on them to protect their privacy, not me. This is a public lobby, and anything I can see with my eyes, I can record. >> Today, we explore how moments that seem harmless can suddenly turn into a legal nightmare. A law-abiding individual is stopped on shaky legal grounds. [music] Commands grow increasingly rigid and a legal storm begins. >> Okay. You're not videaping. >> What are you doing? >> Just talking to you. >> Okay. >> Are you good? Are you all set? >> Yeah, I'm good. I'm I'm perfectly fine. >> Where's your vehicle? Is it >> You stopped. You stopped here. >> Yeah. Yeah. No, I just want to make sure you're all right. >> Yeah, I'm good. >> Good. >> What's your name? >> My name? >> Yeah. >> I don't have to give you my name. >> What? Why wouldn't you give me your name? >> Is your vehicle here? >> Why wouldn't you give me your name? >> Is your vehicle here? >> I'm asking you a question. And I'm asking you a question. I >> I asked you first, right? I'm just asking what's your name. I mean, >> you're an armed individual who's stopping me on the side of a street. >> So, I would like to know your name. >> Yeah. I don't have to give you my name. >> Okay. So, then you could go. Okay. So, then you can go, >> right? But are you all set? Do you have >> You can go. I mean, if if it's not the law to give me your name, I think it's just common professionalism. >> Um, when speaking with a member of the public >> Mhm. >> and pulling over on the side of the road to speak to them, I think it would be common courtesy. And >> Do you have an ID on you? >> Do I have an ID on me? I do. Yeah. >> Yeah. I do. >> But are you walking out? >> Well, I I'm just walking. It's a nice day. It's a little cold, but it's nice. >> All right. >> All right. Do Do you have an ID on you or anything? >> Carry on. >> You sure you don't want to give me your name? I wonder who I spoke to. >> I'm positive. >> I'm sorry. >> I'm positive. >> You're positive? >> Yeah. >> Okay. Do you have like a badge number or something or No. >> But do you think that your superior be like okay with you just completely being >> You you can file the complaint >> uncooperative with a member of the public just asking for your name? >> Yeah. No, you you have the right to file for you know file the complaint. See how it goes. >> Well, how do I know who to file a complaint against? >> I'm the only one out here. >> Yeah. Yeah, sure. No problem. The right is acknowledged. An order follows and in an instant a public road becomes the thin line between freedom and handcuffs >> on here. >> All right. Without authorization is a statute community. It's a statute within the Massachusetts Department of Corrections. Yes. >> Okay. So, what what is it? So, I can look it up. >> You can go contact headquarters and you get >> Are you a law enforcement officer or correction officer? >> I am a correctional officer. >> Okay. So, why don't you just call a law enforcement officer? >> I'm sorry, sir. Why don't you call a law enforcement officer then? >> I'm a correctional officer here at Massachusetts, >> right? But you're not a law enforcement officer. So if if there's a conflict or a misinterpretation of the law, shouldn't we get a law enforcement officer out here to to settle it? >> See, >> yeah, no problem. Hey guys, how you doing? How are you? How are you today, sir? How are you? >> I'm doing well, sir. Thank you for asking. >> Would you mind if I got your name and badge number, sir? >> Trooperina 5532. >> Okay. Trooperina. Thank you. >> Hey buddy. >> Hey. How are you, sir? >> Good. I'm Trooper Lamro with the state police tomorrow. Yeah. This is Trooper Pina. >> Yeah. >> They want you trespassed here. Okay. Um we get it. It's your right to film. It's your first amendment right, but you're going to be trespassed here. Okay. Um do you want to give us your ID? >> Well, isn't this a public road here? >> This is a state property and we're asking you to leave. So, I'm going to give you >> this. This road is state prop. I just want to be cl I just want to clarify, sir. >> This is state property, right? I'm asking you very politely. I don't want to make this anything that it has to doesn't have to be. Um, but you are being trespassed, so you do have to leave >> from this public street. >> No, this isn't a public street. This is state property. This whole thing, the fire academy, I mean, the prison is state property. Okay. >> Right. So, without breaking any laws, I can be trespassed from publicly accessible areas of state >> for anything. But really, >> so the public street ends up there on Route 18. Okay. Um, this is a state facility. So, if you don't leave, I'm sure you know what happens. Okay? I don't want to get to that point. Um, but I ask you to leave. Okay? All right. If you if you want to give us your ID, you can. If you don't, in Massachusetts, you're not required to. Um, it would help me out, but if you don't want to, you don't have to. Okay. Kindly, >> I just All right. I just want to make it very clear. I'm not going to go back and forth with you. >> Yeah. Yeah. >> This is state property that's open to the public to >> They leave [music] in silence, but behind the station doors, questions are dodged and the truth slowly fades into the void. >> Sir. >> Hey, how are you, sir? Hi, my name is Sean, sir. Um, I just wanted your supervisor. Just want to clarify? >> Yeah, I'm a lieutenant. your lieutenant and your [snorts] name is >> Anthony Fabiano. >> Anthony Fabiano. >> Lieutenant Fabiona, you know, I have a little bit of an issue. That's why I wanted to come here and address it with you guys. I was on a public [music] road >> um outside of the correctional facility here and I was recording. Uh I'm a constitutional activist. I got some reports about the jail administrating inmates. So, I just went there, walked up and down the public road there. Um not on the property and on the easement. And they didn't like that. >> You mean not on the property? Well, I'm on the easement, a public easement of the road of the road of the public road. So, uh, some of your troopers came and responded because of the, [music] uh, the correctional facility had called them, uh, Lamborro and and Peina. They, they arrived on scene and they told me that I would be arrested if [music] I didn't leave the public road immediately because apparently, in their words, I could be trespassed for any given reason from the public road because it's owned by the state. >> Okay. So, I'm just looking to get clarification on that situation being >> It just depends if you're on their property, >> right? But you would agree that a public >> public I'm not going to agree with anything with you. Okay? >> Do you have >> All right. Listen, don't there's no need to be disrespectful. Listen to me. Listen. No, no, no. You listen to me. Calm down. >> No, I won't listen to you cuz I am speaking right now. >> No, no, no. You are being disrespectful. Let me tell you what I'm going to tell you. >> Okay. If you have a complaint, you can fill out the SP340 and you can send it in. You can do it online. All right? >> That's what I'm going to tell you right now. >> No handcuffs, no report. But when words become [music] evidence, the consequences begin to surface. >> 3 years ago, I would have taken the ride and I've been sitting right back here in the back of the troop. I would have gone through court, eventually beat the charges, gotten a high bail like groten. It's just becoming too to taxing, you know, just on mental health alone. Like these people need to get educated. This is 2025. How many federal lawsuits do I need to file? How many complaints do I need to file to get some accountability here? The only Even if I don't even if I take the ride, I don't get accountability. [laughter] They get away with it every time. It's like fee just like utter I would have killed you 20 years ago. You'd be dead. Your teeth would have been missing. It's so the lack of accountability is extremely concerning for law enforcement throughout this country. Whether we're in Massachusetts now, California, Florida, whatever the case may be, it is extremely concerning the lack of accountability in law enforcement. 2025. Law enforcement officers don't know that you could film on a public easement of a public road funded by taxpayers. It is a traditional public forum. I mean, I'm not an attorney. I'm not a law enforcement officer, but these are easy concepts to understand. And the lieutenant wants to try and bully me. I'm not going to tolerate it. I'm not going to tolerate it. Why don't you own up to what your officers did, your troopers did? They violated my rights. own up to it. Maybe even apologize. Maybe say, "Mr. Reyes, we're sorry we violated your rights. We were ignorant of constitutional law of our first amend of your first amendment rights. We were completely ignorant." Citizens can sue police officers under SS1, 1983. When their rights are violated, officers who break the [music] law may be required to pay damages and face disciplinary action or termination. Police may face federal civil [music] lawsuits under 42 USC says 1,983 internal disciplinary action and the loss of qualified immunity. Up next, a single camera switches on and the atmosphere inside the public building instantly shifts, triggering a chain of unpredictable reactions. >> Type of services you My name is Jason. Can I ask what your first name is? >> I'll get someone that can help you. >> Okay, thank you. Be great. She was asking if anybody knew that we were here filming. >> Uhhuh. >> I would have said, "Yeah, you >> application for economic assistance benefits form in English and in Spanish. Some envelopes that you can mail your forms in. There's not a lot of uh public information stuff out here on what they do. >> Yeah. All services. >> Yeah. But I mean, you know how they usually have like pamphlets and information you can take with you. >> And then the girl at the front desk wasn't interested in giving us any information either. The information is hard to come by here so far, but uh we'll see if that changes. >> No shouting, [music] no confrontation. Yet each evasive response quietly pushes the situation beyond the [music] bounds of normaly. >> Now we need to shut the cameras. >> Well, that's not the way it works. Well, that's not the law. >> Okay, but >> that's not the law. You're a law enforcement officer. >> But here's the deal. >> Their policy is that they don't speak to the media unless >> I'm not a member of the media. Okay. And they don't need to talk to you. >> I'm sure they do. I'm a member of the public health office. >> They said that if you leave your information, they will call you and contact you. >> Yeah, but I'm here now. >> Okay. >> I'm here now and I'm looking for >> I'm telling you I can't force them to do anything. >> No, you can't. I understand that. But you you listen, you're failing to identify yourself as well. I just asked your name and I just said Mike. >> Mike Horton. My bad. 217. >> Thank you very much. Is that so difficult? >> It's not. >> No. What is the animosity going on here? >> There is none. is. >> But you're asking us all these questions, but you don't identify who you are. >> Sure. And I told the young lady my name. >> Who are you with then? >> I'm not with anybody. I'm with this gentleman sitting next to me. I'm not >> What platform are you going to post this this story you're working on? >> What makes you think it's being posted to a platform? >> Cuz you told me it was. >> No, I did not. >> You said you're working on a story together. >> I said I'm working on a story. I never said anything about a platform. Never. That word never came out of my mouth. I never said posted or platform. said you're >> so you guys come in here with preconceived notions about what's going on and you need to shelf that because that might not be what the case is because that's not a good idea for you either. You learned better than that academy. >> You don't need to tell me my job. Great. >> Well, you don't have to tell me how to do my >> I'm not but what you should be doing is telling these public employees how to do their job. >> It's not my job to do that. >> Well, but it's their job to perform in the capacity that they were hired to perform in. And when a member of the public comes in asking questions related to here, anything you were or in the corner videotaping inside, >> we were looking at the construction that's going on in the next building, which is a completely empty building. >> But they said that you were videotaping from the inside >> through the window >> of the building next door where the construction of this place >> never happened. Well, >> everything I This is the reason I video. >> I'm just telling you. This is the reason I don't shut my camera off because once I shut the camera off, anybody can say anything happened and I What do I do? >> I'm just telling you what they told me. >> Well, anybody can tell you anything. You know that as a >> Well, you can tell me anything, too. I >> Well, I've been completely forthright with you since I since you walked in the door. >> So, why why would I think they're lying to me? And why would I think you have no reason to lie to me? So, why would I think they have any reason? >> Attention peaks. No handcuffs, no paperwork, only words, attitudes, and actions. Quietly marking their own record. >> Are provided here. >> There it is. These are the services that are provided here. Why did I have to get this from a police officer? I don't want the woman standing around the counter. I don't know. Okay. But then you're almost jumping on their banan telling me I can't be filming in here. What is that all about? >> Of course I can film in here. Where does it say I can't film in here? Show me a law or statute or >> It's against their policy. >> Where is that written? Show me the policy. >> I don't know. >> It's not their policy. I did my homework very well before I got here. How are you? >> It's not their policy. I can't show you that. >> So, what do we got to do to get you to leave the building? ask nicely and maybe I'll go outside and continue the conversation with you. >> Okay. >> But, you know, when you tell me I have to leave, that's an unlawful order and that's not something I'm going to, you know, I don't I follow 100% follow lawful orders. I completely ignore >> Well, you said to shut the cameras off. >> Well, well, when you have someone coming in that >> that's not the onus is I'm not HIPPA certified. The onus is on them to protect their privacy, not me. This is a public lobby and anything I can see with my eyes, I can record. >> Yeah. >> Okay. That's the way it works. Audio and video. >> Okay. Well, if that person doesn't want a ripped face on video, then >> Well, that's you know, I as a human being, I would respect that if he asked me that. But I actually just had a little quick conversation with him. He was being pleasant, smiling, >> no issues. Didn't ask me to turn my camera off. I had no issues with. >> So, I don't want to assume he's got issues that he doesn't have. You know what I mean? And I'm not looking to give you a hard time. I'm just looking to walk in here, ask a question, get the answer, and leave. I would have had in 30 seconds. >> Did you get to ask the question? >> I'm What? >> Did you get to ask your question? Oh, I got to ask my question, but it it was not answered. >> What was your question? >> I we came inside. Okay. >> Asked them what I said, "My name is Jason, and I'm here to find out what services you provide here at the health department." So, the young lady, >> they wouldn't answer that question. >> I'm trying to explain to you. So, the lady with the blonde hair right there said to me, "I'll go get somebody that'll speak to you." >> Okay. So then another lady came out with uh brunette dark hair older lady probably around my age came out and said uh can I help you gentlemen? I asked her the same question. I said I'd like to know what can you please tell me what your name is. My name's Jason. Can you give me your first name and tell me what services you provide here at the health department. >> Okay. >> She said let me go in the back and find somebody else that will speak to you. That was the second time. >> Okay. >> She disappeared in the back for about 10 minutes. Came back out like I'd never spoken to her before with a huge smile on her face and said, "Hey guys, how can I help you?" Okay. >> There is no immediate conclusion, but everything that matters is already captured in the frame and the consequences are only a matter of time. >> So, so here's the thing. >> You guys do what you guys want to do here until 5. That's what time they closed. >> Okay. >> Oh, I'm not going to be here till 5. I'm going to be out of here after you guys leave. I'm going to be out of here in a few minutes. >> You guys know, you know, keep it down. You know, >> I'm not interested in speaking to anybody because as far as something to tell you. >> Yeah. No, no. I'm agreeing with you. I'm I'm I'm telling you that I accept what you're saying and I agree with you. Keep your voice down. You know, >> I'm not going to even speak. We weren't even speaking to each other. >> So, 5:00 is what time it closes. Okay. So, >> well, I'm obviously not interested in staying here. Closing time. Closing time. >> Any other questions? >> Name and badge number. Officer TR. >> Officer TR. Batch 216. >> 216. Thank you very much. >> Any other questions? >> Do I have any other questions? I would love to know what services are provided here, but all I know about now is EBT and some phone numbers, but I guess I'm not going to get that information. >> They said if you leave your name and number, you can get all the information you want if you call back. Okay. >> So, at the end of the day, what you're telling me is is we can stay here. As long as we don't cause as as long as we don't break the law. Break the law. Just make a disturbance. >> As long as we don't break the law. >> As long as I'm within the confines of the law. You guys have no issues. You're going to leave and you're going to let us stay here. >> We're leaving right now. >> Okay. So, then what I'm going to tell you is this was a first amendment audit and these women just failed miserably. And this is going on YouTube. And I have the largest >> we assumed it >> first amendment audit channel on YouTube. Okay. And I have, let me tell you something. I have exceptional. We've been to 28 states in the past year and a half defending the Constitution of the United States and we have exceptional conversations with law enforcement all over the country. Wonderful, productive, educational conversations. But then once in a while we run into this and based on the fact that these two just left, I can understand now that you guys are the ones that really care about what's going on and they don't. And we're here for you as well. That's what you don't know. Okay? Because like I said before, there's a lot of bad officers out there in this country who are getting good officers killed. >> Okay? And I think that's disgusting. >> As tensions [music] subside, the final words reveal more than the initial conflict ever did. No one is detained. But what is acknowledged may linger long afterward. Next, when a car was stopped by the police, no one expected that the first person to appear would be a powerful commissioner with an unexpected attitude. >> With two kids who went through the school system, what the problem is. And that's shocking. It's shocking that you can't even give me a sentence. >> I think this I will for safety reason the high speed road. >> She said she was the mayor's friend, a highranking commissioner, but the police didn't budge an inch. The most tense encounter on the highway began here. >> Mayor, I'm a resident. Here you go. >> It's fine. We don't I don't I don't need that. >> Okay, fine. I'm here. >> You're just here. You're just here as a rider, right? I'm here as a concerned citizen and friend of the mayor and been in Tenny for 20 years. I take full responsibility for them. And what is the reason they were pulled over? >> If the driver has all the information, he'll tell you. No, you don't need to know. >> Okay. >> You are not involved. >> No, I'm involved. Trust me. >> I'm not going to tell you. He's the driver of the automobile. That's all you need to know. >> Um, we don't need to see credentials. >> Okay. We need you need >> if you can give me a little bit of space here. No. >> Are you a commissioner? >> Commissioner. I am the commissioner. >> One of the commissioners and I'm heading up. Do >> you have an ID with that? >> That is my ID and that is my business card. I am the commissioner of the port authority and I'm heading up over 4,000 police off. Okay. So, if there's a problem, I think I have >> There's no problem. >> Well, I think there is a problem. >> Registered vehicle. >> Why were they pulled over? First of all, >> miss. >> Now, don't call me miss. I'm commissioner. Thank you, >> commissioner. All due respect, >> why were they pulled over? >> All due respect. >> Yep. >> The driver will tell you. >> No, no, no. I need to know. >> The car is getting towed now. >> Why is the car getting told? >> No. No. I'm asking. You're the person who's ordered it. And trust me, >> miss. This is not involved in 1%. >> Yeah, it does. It does. It does because I'm picking them up and I'm offering to take responsibility for them and you can't even tell me the charges are also when it's hurting. Why is it such a difficult thing to say why they're being pulled over and why they're trying to stay home? Because everything has already been explained. >> A power list and a graduation ceremony. [music] The confrontation between a high-ranking mother and disobedient policeman caused a stir on social media. >> I know, but I know why. >> Why do you need to know? >> Because this is impacting me. I got four people who are coming back to my house, including people who live in New Haven, attending Yale Graduate School, a PhD student on Easter Sunday. I got to take four people back to New Be I want to know what the problem is. >> It's more of the way you just approached me and the I'm I'm being honest with you. >> I want to know why. >> I just don't appreciate your demeanor. You're being very demanding with me. >> No, I'm asking you a question which is not being answered. >> But it doesn't need to be answered. It's irrelevant. >> You know what? >> If you'd like to read my report, >> you can come down to the police department records on Monday. You can get a copy of it. >> And you can't >> I am under >> there is no You have no right to know what's going on. >> This is No, I do. >> Explain to me why. >> Because these are four people that I have responsibility. >> Why do you have to take They're all adults. >> That's my daughter >> and she has she's a backseat passenger. She's a backseat passenger. And there's a problem with you describing it because you don't feel confident why these people are being called. >> Your daughter has not been summoned. She was not the driver. This is not her vehicle. It's not your vehicle. >> If you have a problem explaining what the problem is and why their car is being confiscated, then we have a problem. And trust me, I will be in with the commissioner of police of Tennifly. When you think you have enough power to make the police bow their heads but are met with laws and absolute coldness who cross the line. >> I was there for your graduation when you guys came in in the town and it wasn't that long ago. >> What graduation? What are you talking about? >> What graduation? >> Thank you very much and thank you for your information and help. You know what? I hope you have a really nice holiday weekend, too, because you just ruined it for a lot of people without even the decency. >> I didn't ruin anything. I'm just doing my job. Yeah, you did. >> I would just hope you being a commissioner. This is their path. >> That's the job police officers have to do. But >> there is no explanation. How can I understand? >> You didn't even ask the asking you because you're the one that's making the report a problem stating it. I'm going to >> I don't appreciate the way you approached me. The way you demanded information, the way you're >> demanding your position, I'm asking >> in another agency. I'm asking >> whatever it may be. I mean, you have a business card with credentials. You I just met you a minute ago. You have no official identification. >> You know, Lewis, what's it? >> What does that have to do with anything? >> Well, I'm just telling you who I am. I've been in the town for 20 years and as a courtesy I would like to understand the rationale for their being pulled over in their car complicated. I don't know why >> I believe you should ask your daughter and the driver of the motorcycle. >> My daughter is a backseat passenger as you've said you're making the accusation. I would like to know >> what accusation >> the accusation of I don't know what because you haven't told me you're telling me to go Monday and read the report. >> He said ask them. the book. It's not they, it's not them. >> A committee card was not enough to cover up the arrogance. And when the cameras recorded it all, the career of a seemingly untouchable man fell freely before the public eye. >> I'm very disappointed in the way the two of you are acting. You cannot even tell me a mother living in tennis play for 20 years with two kids who went through the school system and that's shocking. It's shocking that you can't even give me a sentence this will just for safety reasons. This is a high-speed road. I think we should all get off of the road. It is dangerous for us being out here. >> Thank you for your concern with my safety. >> I don't need it. You can't put a sentence together. Sorry. >> Okay. Then you are a disappointment and you are just following him. So you are also a disappointment. You can't put together a schedule of what the problem now. >> Are you finished, ma'am? >> I'm shocked. I'm shocked and very disappointed. >> You may take them. You may take them now. >> You may not tell me when to take my child. You may shut the up and not tell me when I may take my kids and her friends, these students from MIT and Yale. You may tell me nothing because you told me nothing. Shame on both of you. I will be talking to the chief of police and I will be speaking to the mayor. >> Number 54. >> I got your name. I got your name. >> Just to make sure there's no discretion. As long as you got all the information right. >> I got all your information, sweetheart. You can't put a sentence together. That's shameful. >> Have a pleasant weekend. >> You have a wonderful weekend. You're going to >> After the video went viral and was criticized for using power to exert inappropriate pressure, Karen Turner submitted her resignation from the Port Authority.
