You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. You can decide at any time to exercise each right to not answer any questions or make any statements. Yes, sir. Bryce, I've explained to you. Do you understand them? Okay. Having that in mind, do you wish to answer questions? >> Yes, sir. >> Okay. Your car is the same one you drank? >> Uh, no sir. >> That's an older one. >> That That one's old. >> It's actually older. >> Yes. >> Okay. Uh, this one happened back in February. >> When the boss shows up, the biggest question is no longer what happened, but how he will get out of this mess. have these off. >> I can't, man. I'm telling you. It's our policy. >> I understand you're a police officer, but our policy. Anyone in the back of our car has got to be handcuffed. Okay. >> You what? >> I have to go to jail. >> We're figuring everything out right now. Okay. >> We're figuring everything out right now. My captain just got here and your uh sergeant's on his way. Okay. I know. No one wants to go to jail. I I understand that, man. Whatever happens today, I believe we just saved your life. >> Yeah. All right, take a seat. Take a seat. The other side over here on this side. All right. Just don't touch your mouth, okay? For the next 20 minutes. Just don't touch your mouth. All right. Uh, do you want to use >> I have to wait 20 minutes. Okay. After we do the breath test. >> He was arrested for DUI and could face disciplinary action or termination. One officer said bluntly, "You're probably going to lose your job." but also hinted at the possibility of rehiring, raising questions about transparency and fairness in dealing with police officers who violate the law. Next, a deadly crash in the middle of the night and the person in the eye of the storm is an offduty copy. No. All through D1 or DUI2, they had DUI for the for the injury. >> He admitted to [music] drinking, but his testimony and the way his colleagues treated him left viewers with big questions. >> She's coming northbound inside lanes both times. I don't know where we cross. >> Okay, you're going south. She's going north. Just going north inside lanes on both equal lanes traffic. Good >> talked to over here. Where you coming from? Friend's house. Okay. I'm feeling okay. >> Anything in the car? You got a weapon there or anything? >> No. Off duty. I got not carrying >> Okay. My uh holster at home. >> Okay. All right. Stay here. Okay. >> All right, man. All I'm looking for is honesty. Okay. I know I know you're in a tough dick right now. It's like that. Okay. I'm looking for is honesty compliance and that's all I'm asking for. Okay. >> Roughly today about 6 hours. >> Okay. >> What where exactly where you calling from? >> Roughly around Greenwood Acres. >> Where you heading to where was your destination? >> Uh off of Best Avenue. >> Okay. So right down there. >> Yeah. Okay. I listen. >> Listen to I can tell you drinking. I'm just being honest to you. I I know me and you go way back, but we're here right now. Okay. >> You got that? >> Okay. You're fine? >> Yes. >> Okay. You still feel like there's alcohol in your system? >> No, I can perform harm tests. >> Okay. All right. So, anything else in general health besides any surgery before 16? >> Okay. Do you have any contacts in right now? >> No. >> Yeah, we can. >> Okay. Put the feet together, hands to your sides. Okay. >> Three times. >> The on-site test begins. But is this a standard procedure or a special preferred version? >> All right, man. No, no, no other dis physical problems besides that knee. >> Besides the right knee. >> Okay. All right. Imaginary line right here. >> Okay. All right. What I want you to do, place your left foot on the line. Yes. [snorts] >> Maintain this position until I've completed the instructions. Do not start to walk until I tell you to do so. Do you understand? >> Do you understand? >> Awesome. >> Okay. Can you get back in that starting position, please? Yes. >> Do you feel more comfortable this on the sidewalk, James? >> I do. >> Okay. Let's go on the sidewalk then. >> Just feel all the cracks. >> I got check here. away from any cracks. You get that thing, James, go back here. All right, get back in that starting position. Right foot, head of left foot. Okay, arms at your sides. Okay, go ahead and begin, James. 20001 200023 2004 2005 2006 2007 2008 2009 2010 2011 2012 2013 14 >> 15 16 2017 2018 2019 2020 22 23 >> Even when handcuffed he was [music] allowed to negotiate make demands and was constantly placated by his colleagues >> is that uh is one too tight Take some gyms over there. Out with the 95 to KCH. Can you let them know I'm coming from this crash? Not sure if they got a helicopter coming in. Why? >> We'll figure it out once we get inside. Can you shut off my uh dash cam, please? Can I walk through? >> Okay. I I I know. I know. I know. I know. You got to do it. Okay. Well, you got to read the warning tomorrow. I get it. >> Yeah, I got it. treatment or >> concerning, but I got to just going to do the normal process. >> Okay, it's okay. >> Can you ask them if they got a room or anything? >> Yep. >> Dispatch should have called you for a sec. Just >> I'm not I'm not I know how the process goes. Eventually, a DUI causing serious injury [music] charge was filed. But was justice really served in this story? >> Okay. So, right now, so D1 or DUI A2, they DUI for the for the injuries. And then two are the traffic citations. >> Sorry, the injuries. Nothing in life. >> It's a serious serious medical injury. So, I'm going to say okay. All right. So, this this is detainable. Okay. So, so be sure you're going to be in there till Monday, okay? Listen, you're not a bad guy, okay? Everyone here, no one in here thinks you're a bad guy, okay? I'll call the jail. Let them know who you are and and what's going on, okay? But that's a that's that's >> I don't mean listen like I said I'm treating like everybody else what everybody else like I'm saying it's this how the statute reads permanent bodily injury great great bodily harm okay how the [music] statute reads >> under Illinois law 625 ILCS [music] 5/1151 DUI causing serious injury is a class 4 felony penalties include [music] 1 to 12 years in prison prison, a maximum fine of up to $25,000, [music] 0, driver's license revocation for at least 2 years, required to pay restitution to the victim. James was charged with DUI causing serious [music] injury along with two other traffic tickets. He was told he would be held until Monday. His co-workers stressed that no one thought he was a bad person and promised to notify the jail so they could find out who he was. But the lenient, friendly treatment and the many exceptions to the [music] procedure raised questions of favoritism and possible violations of the principle of equality before the law. >> Write me a ticket. >> Stop right there. >> There's nothing you can do. >> I'm a I'm a police officer. >> I'm not doing anything to anyone. >> Stop. Stop. >> Couple went for an evening walk and because of a mask, both almost lost their freedom. >> I will put the face mask on. Can I put the face mask up? Put your hands behind your back. >> I told you multiple times to stop you. >> I'll give you a civil citation for not having your face mask after I told you to put it on. You not following verbal commands from a police officer. That's an a chargeable offense. >> A mask and a few words of argument. But seconds later, this man found himself handcuffed in the middle of the street like a dangerous criminal. What made the police so mad? >> We are hear me out. Hear me out. >> Put your mask on. I don't want to talk to his right. >> Sir, put your mask on. If they are going to arrest him, then yes. >> Um, it's in my backpack. Leah, >> they can decide what they want. >> I didn't put on a mask. >> Come on, guys. >> I served in the freaking Marine Corps. I fought the hell out for this country. >> The wife intended to intervene gently, but that harmless touch turned into a serious crime that led to something no one could have expected after 5 days. Hear me out. Hear me out. >> We are educating people and getting here. >> I'll just take a ticket. >> Okay. All right. Your ID. >> I don't have it on me. >> Okay. >> ID. >> I'll do it. >> Did I tell you to go away? >> You can't write me a ticket. >> Stop right there. >> There's nothing you can do. >> I'm a I'm a police officer. You are being detained. Stop. >> Why? For what? When am I being detained? Listen, sir. I'm not doing anything to anybody. >> Stop. Stop. >> I will put the face mask. >> Can I put the face mask up? I'll just do that for the gun. >> I don't I don't really care what you have to say. >> I don't really care. >> There's no need for that. >> Listen. >> Okay. >> Put your mask on. >> I don't want to talk. It's not right. >> Sir, put your mask. >> I'll put your mask. >> Ma'am, put your mask on. The last time you take it, take off the back. I can't take it off. >> Your ignorance is >> really Yes. Really? Really? Really? Your ignorance. Put your hand behind your back. >> Put your hands behind your back. >> I told you multiple times to stop. You decided to walk away from a police officer. >> That's resistant without violence. >> I was not resisting. >> Stop. You don't even know what you're talking about. >> I've already asked you for your ID. I was not resist. I've already asked you for your ID. [music] >> 500 block. >> It's a city ordinance. WHY DON'T YOU UNDERSTAND? >> There's there's no law. There's no legislation. >> It was supposed to be just a civil ticket, but then an unexpected decision turned their vacation into a legal nightmare that lasted for more than 2 years. >> Listen, man. >> Is a respect to an officer. >> I love you guys. You guys do everything for us. >> Went from one to 10 and then went from 10 to one. Now, >> I respect you guys totally with all my heart. You guys do a lot for us. I apologize about the mask in this in their town. >> Okay. All I'm asking for on vacation. I didn't mean to disrespect you. >> Listen, it's not about the disrespect. Do I do I really want to do that to somebody who is here on vacation? No. I have no intention whatsoever. But you demeanor, your your actions are putting you on the spot right now. Not mine. I was trying to educate you about the city ordinance and you decided to walk away. Actually, >> if they are going to arrest him then yes. >> Um, it's in my backpack. Leah, >> they can decide what they want. I'll take care of you, sir. >> Okay. So, this is what I'm going to do right now. I will give you a civil citation for not having your face mask after I told you to put it on. I am not going to take you to jail for resisting without violence because I gave you multiple verbal commands. So that's what I'm going to >> A sworn statement, a criminal charge, but the camera reveals the complete opposite. So who is really breaking the law here? >> He's the police officer. >> 815. >> You fooling with me? That's not going to get you anywhere but jail. >> Was frustrated, man. >> Do you understand? I fought for this country and I have to wear a face mask. No, I wasn't being that way. >> No, I didn't mean it that way. >> Oh my god. You look >> selfie. Are you done here? >> What am I going to jail for? for resisting without violence. >> I didn't resist anything, guys. >> Are seriously? >> Yeah. Arrest them. >> Come on, guys. Arrest. You can't arrest. >> Come on. >> I didn't touch her. >> Don't you put your hands ON THIS OFFICER BECAUSE you will go to jail and that's a felony. Don't you touch her. >> Don't you touch her. Don't you do that. She's a code enforcement officer and you can go to jail. >> Okay. >> My arm. I'm not doing anything. have his ID. >> No, I can't touch him. >> Stay away. >> The case was repeatedly postponed. Leah Hops carried a felony conviction for 2 years before prosecutors quietly dropped the charges in December 2022. Throughout the [music] case, there were clear signs that the police abused their power, exaggerated the situation, and used the legal process as a tool to punish people for their defiance. >> This isn't right to me. >> I'm not doing anything wrong. I give you a huge opportunity. It's a face. You threw it away. You threw it away. I've never been arrested for anything in my life. I serve this country with all my heart and soul. At least officer, >> understand that I'm not going to do anything. I don't earn any. I would never hurt you. I would never do anything to you >> ever. Especially an officer of the law. I respect every officer I've ever met. >> You continue carrying that attitude, that demeanor. I was trying to help you out, but you did not want to follow my verbal commands. Crazy thing is I'm walking through the streets without a mask on. >> Ladies, please put your mask on. >> I wish I had that cool mask like that. I might have worn them. Like I said, >> I know. I know. You guys got to do your job, too. Can you to the other side? >> Apparently in Illinois, even if you're a cop, alcohol [music] can still land you in jail. Hey guys, what do you think about this situation? [music] If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. As soon as they arrived at the base gate, a staff and police rushed in demanding the identity of the cameraman. But after just one cold response, the whole situation suddenly took an unexpected turn. >> Are you photographed? >> That is none of your business. The way you came at me asking me who I am, it's none of your business, man. Who are you? >> Do you work here? >> I do. >> Okay. What's your name? >> Never mind. >> Oh, exactly. My point on why I wouldn't give you my name either. Hey, kick rocks, dude. Don't come over here asking me and demanding my information. Then you won't give me your own. >> What the is that? >> That is a called a badge. Have you read it? >> Yeah. It says shiny badges don't grant extra rights, dude. Goodbye. Cam back. Cam back. I uh literally just got here 3 minutes ago and uh this guy came over here and demanding who I am and in return they never give their information. So why would I? That's why on top of my Fourth Amendment, I don't give that information cuz I know damn well they usually typically don't. Without even setting foot on the base, the police's firm orders sounded as if they had already been charged with a crime. A few seconds later, a cold retort turned the situation around. >> Yeah. Why you following me? >> I'm about to walk out here. >> I'm just asking you. What's your name and badge number again? >> Ken. I'm officer Mullen. Badge number 123. >> Mullen. >> Yep. >> Awesome. You with uh the township. >> Cool, man. All right. All right. >> Any chance you want to give me your name? Yeah, it's right here. >> Okay. Then I >> I don't need to listen to you, man. Go talk to the party and go about your day. >> Okay. Well, I can stand here and talk. >> Yeah, you can. But I'm not going to listen to you. >> You don't have to. >> I know. >> Just letting the whole world know I don't mind what you're doing out here as long as you actually step on the Navy property >> like you. >> I'm allowed on the Navy property. >> Oh, you are? You have jurisdiction here, huh? >> Get the off the property. >> I don't have >> Yeah, you should probably get off the property, buddy. You have no jurisdiction on that property? No. >> Okay. >> You don't have mutual aid. >> That's fine. They do have preparatory jurisdiction here. >> You don't? >> I do. >> No, you don't. I don't think I don't believe you do. >> As long as you stay on the public property over there, feel free. >> As long as you don't kick your dog and beat your wife, I'm okay with that, too. >> I couldn't hear you. >> As long as you don't kick your dog and beat your dog beat your wife. Make sure when you cross the street, you look both ways. Right. Piss in the toilet, not on the floor. >> Don't eat yellow snow. Like I said, long as you don't go in the Navy, >> like I said, don't eat yellow snow. Don't kick a dog. Don't beat your wife. >> Okay. >> Right. Don't, you know, use a crosswalk. Look both ways. >> You want to hold my hand, buddy? >> Are you my dad? >> I don't think so. >> All right. So, stop telling me what to do. I'm a grown man, dude. >> I just know what to do. >> Yeah, you do. You telling me not to go on property [music] that is private, >> correct? >> It's It's actually not private. It's public, but there's no public access. Okay. Have they said I stepped on the property? >> Nope. Then why the are you telling me not to? >> I'm just advising you not. >> I don't need to be advised. Why do you feel the need to be advising me to not go on property I'm not allowed to be on when I haven't even been on it? >> The police made the request to search right in the middle of the street [music] as if a crime had just occurred. The citizen's blunt response made the whole situation more tense than ever. >> Consent to a search? >> No. >> Why not? Do you have anything illegal on you? >> No. >> Do you have any other weapons or >> phones? burn or No, I just want to scan you for uh citizen safety, that's all. N >> is that all right? >> Watch out for those acorns, man. They're killer, dude. >> I appreciate >> Yeah. I don't want to get shot, you know. >> Hey, you have a blessed morning. All right. >> Hey, go talk to him, dude. Go talk to him. >> Why? >> Because he's the one who called you. I don't need to be told that I can't do what I'm doing. He does. >> I didn't say you can't do what? >> He did. So go tell them I can go do your job. Came back. Came back. Sir. Hey. What did you think they were going to do, bud? Kick rocks, buddy. Bye. All right. You got another PDF. Hey, you got backup coming. You got backup. >> I don't need backup. >> I know you don't. >> Patrol cars lined up. Support forces appeared in a big way as if preparing for a major arrest. However, just a few minutes later, the entire [music] team quietly withdrew. >> What? Are they going to go hide in the bushes over there? Yeah, they're hiding behind that. That's all right. I'll wait them out. I usually do. Jeez. Another one, huh? Hello. Ah, heat. I think uh he went to go join the paw. >> How you doing? >> Good. How are you? >> Good. Are you leaving? >> I can't hear you. >> Are you leaving? >> Leaving where >> are you leaving here? >> Here? >> Yes. Here. >> Not here. >> You're not here? >> No. Do you know who you are? No. >> Do you want me to call mental health for you? >> Yeah. Would you? >> Yeah, I could. What's your name? >> What's your name? >> I'll call him right now. >> What a goofball. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US code SS1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The case ended without an arrest warrant, but the baseless warrant, illegal search request, and emotional pressure showed abuse of power and lack of training. Up next, a seemingly innocuous request has sparked a heated debate about civil rights and constitutional freedoms. >> Do you think that your behavior of keeping a citizen out of a building is going to be looked upon in a positive way? >> You can take a picture of that sign. It says, "Please have a picture ID." Ready? >> You're enforcing an unconstitutional sign. rules and regulations, signs, urgent orders. But when residents [music] asked for legal evidence, the entire building fell into an unprecedented dilemma. >> Falling away, please. You're not allowed to video. >> I'm sorry. >> Nobody's pulled away. >> Why? Why can't >> you nicer? Because there's a sign posted outside. I bet you can't do that video. >> Why can't I record in here? >> Who are you here to see? The county clerk. >> I'm here to see the county clerk. I have business to conduct. I have to do a public records request. >> Okay. I don't Okay, that's what I'm trying to do. >> Here to see anyone to >> I'm just here to see the county clerk to do a open records request. >> It's [music] a law. It's called Freedom of Information Act. >> Absolutely. >> As a member of the public, I'm coming in here. I don't have an ID. >> Yep. So, yeah. Okay. So, I'm going to um escort you cuz you have no ID on you. >> Sure. You can do whatever you'd like. You >> have ID on you? >> No. >> So, these are government buildings moving forward. >> Yeah. >> You need ID to get in government buildings? Well, I don't need an ID to pay for this government building, >> sir. >> Right. >> As an officer, I can deny you to come into our government. >> That would be a very big mistake, though. That would be a big mistake on your part. >> I'm telling you, >> I have nothing on you. Now, >> I just want to make sure I get your name. >> Officer Heman. >> Officer Heman. >> So, now if you fall down and get hurt and we have to put you in back of an ambulance, we don't know who you are. Nobody knows who you are. So, that's for your safety. No, >> let's get off of that. >> It's not It's not for your It's not for my safety at all. >> So, what are we going to do here? >> My name is not going to change me being me being hurt. >> Do you have anything on you? >> I have >> that you can show us your name. >> So, we can let you in. >> I don't have anything with my name. I don't have I want >> Please just stay here. >> Yeah, no problem. No problem. Ridiculous. Police were there to enforce a controversial policy, but when citizens openly demanded to see if [music] it was constitutional, all eyes turned to law enforcement. >> What's going on? >> Can I just get your name and badge? >> My name and badge. >> Yeah. Officer. >> Um, you have to be outside though cuz there is that's another rule. You cannot video or do anything in >> We have We have freedom of press in this country. >> We have freedom of press in this country, man. >> No ID. The signs are all over that say you need to have ID in order to come in the building license. This other thing and that's that's what it is. >> Hey sir, can I just get your name and badge number two? >> Ramos 453. >> Thank you sir. >> What are you here for today? >> I'm here to see the county clerk and because I don't have because I don't have ID and I won't show ID. They're denying me public services. [music] >> Okay. >> And at that point I feel like my my constitutional rights are being violated by the public safety here. I'm trying to This is a public building. There shouldn't be any special conditions on on entering a public building. If if they want me to go through the mag, that's fine for security purposes, but my ID doesn't it doesn't help anything. And they're not showing me any type of policy that would state that I need ID to enter in a building cuz right now they're preventing me from from conducting business. I'm trying to get services and open records request to be specific from the county clerk here. >> Okay. >> And by them denying me access to the building. >> No, no. They just need >> It's ridiculous. You need to show ID. But you don't need ID to vote. >> You can even manually say >> I could just tell you my name. I could just tell you. >> And it's a procedure. It's been a procedure. >> It's an unconstitutional procedure, ma'am. >> And signs are all over that. >> It's an just because, ma'am, just just because it's been a policy for a long time, that means nobody's come here to challenge that policy. And that's what I'm doing here today. That's exactly what I'm doing here. I'm challenging that policy because it's unconstitutional. That's what it is. No one's ever challenged it before, but I know it's unconstitutional. >> No types of uh formal ID on you. >> No, nothing at all. >> No. >> Unfortunately, you just have to wait. >> And I know you're trying to set up an appointment. You know, this >> I'm not trying to set up an appointment. I'm trying to conduct business. >> Okay. >> So, are you telling me that >> you don't have your ID with you? >> I don't need I I shouldn't I don't need an ID. >> There's a whole policy that they got going on. So, >> they're not even showing me that policy. They're not showing me the policy. The police threatened to arrest, but when the citizen asked for legal documents, all the police had was a sign hanging on the wall. >> Yes. >> Um, all right. So, you get it. >> Are you Are you Are you ordering me to leave the building, sir? Yeah. Under threat of under threat of arrest, sir. >> No. If they want if they if you even got to have you on the trespass form, you could be getting arrested for trespass. >> Okay. So, are you going to give me a trespass? Am I being trespassed in the building? >> We got a trespass form. You have to sign that. Say if you have Okay, great. I'll do that. No problem. So, we we'll go ahead and do that route. Big mistake. You guys are opening yourself up to civil litigation here. Big mistake. But I'll take that trespass form. >> Big big mistake you guys are making here. No idea. Unconstitutional. You guys swore an oath to the Constitution. Do you think Do you think that your behavior of keeping a citizen out of a building is going to be looked upon in a positive way? >> You can a picture of that sign. says at least have a picture ID right here. >> You're enforcing an unconstitutional sign. >> You're enforcing an unconstitutional sign. The public's not going to look too uh favorably on >> on on your actions here today, ma'am. And then you call the police. You call the police to enforce your policy. These are law enforcement officers. >> They're not policy enforcement officers. Ma'am, >> it's it's not our policy. It's the county's policy. So, they're going to take it up to somebody else. But why would you call the police and now under threat of arrest I have to leave a public building that I help pay for? You call the police to enforce a policy. That's what you did. Even though they're law enforcement, not policy enforcement. Ridiculous. >> After a tense standoff, [music] residents vowed to take the case to court. Could this be the turning point that forces the government to change? The case opens up the possibility of an investigation into the constitutionality of the policy of requiring ID in [music] public buildings. >> All right, guys. So, we're just getting out of the county building here in Minnola, New York, the Nassau County building. Wow. So, I've never had an audit go quite like that where I was trespassed from a building, let back in a building. Um, didn't have to show my ID to get in the building, but the policy is still there and it exists. You can see the sign right here. Please have picture ID ready to show. So, we have all the officers [music] leaving. Bunch of officers came and responded. Um, all of them were very professional and courteous except for officer check your camera. But the sergeant was good, very respectable man. Honored his oath, respected me exercising my constitutional rights here. Definitely a whirlwind of an audit. We got to get this uh sign taken down over here. Please have picture ID ready to show. You shouldn't need to show government ID to enter in a public building for public services. completely ridiculous. We've been here for a while, though. We'll reach out to the county attorney. You know, we the people, we got to stick together. We can affect change little by little. If you've been watching my channel for a while now, there's a lot of little victories that we've had together as a community, as we the people. And uh feeling I have a feeling that this one is going to be our next victory. We're going to get this sign taken down. When power is given without oversight, the line between protecting security and violating civil rights becomes thinner than ever. Hey everyone, what do you think about this situation? Watch this." What caused the city's police force to explode right in front of the prison gate? >> I mean, this is beyond my control. I don't have this, so don't yell at me. >> Don't talk to me. >> I try to get through and they immediately halfway open and shut it on me. >> While being refused [music] entry, one officer said in a stunned voice, "I'm about to have a stroke because of the injustice. Was this the beginning of an uncontrollable confrontation? >> Hey, Snipes, they're still denying us." >> God bless America. They won't let us in. They won't let you in. They won't let me in. >> Ain't that right? >> No. I'm going to file I'm going to file a complaint. A legitimate mean go at home. >> Lieutenant about to get a complaint 100%. >> That is the most unprofessional thing I've ever seen in my life. >> Hey, what do you think? Got my legs. It smell like you said >> cuz I'm about to have I'm about to have a stroke. >> This is a failure of justice >> and the jail does not like us. So we have five people sitting here outside. >> A man shouts, "I will not be disarmed [music] at the prison gates. What is really going on behind closed iron doors?" and he runs the jail. So >> goddamn supervisor can >> I understand that. >> All right. So So I got a call to go to. I can't go to the car cuz y'all want to play stupid ass childish game. Sorry. I got nothing do with that. It ain't my goddamn car. It's between the sheriff and the guy that works over there. It ain't got nothing to do with me. >> How you going to move it? Move it. >> Move the goddamn car, man. Wow. >> Huh? >> Y'all acting like a bunch of goddamn kids, man. >> Uh, I'm going to go get my stuff because this is getting stupid. I'm not going to be dearmed outside of the jail so I can get out. They want to play games. Y'all ain't letting them in. So, they don't want to let me in. And I hope I don't see you getting your ass whooped on your street cuz I'm going to drive the by and you can tell your goddamn sweet. >> I'm seeing a car cuz I got a goddamn car to go to. You don't want TO MOVE THE GODDAMN CAR, >> HUH? Don't stop for me. Don't stop for me. >> This is so stupid. >> Back at us so we don't have to bring his hand. >> Listen, man. I'm only doing what my supervisor told me. I >> No one was fighting, but everyone was ready to explode. When the police chief spoke, the fight between law enforcement forces was no longer an internal affair. We got to stop playing these. >> This is >> This is [ __ ] >> Yes. >> Don't get [ __ ] Hey, he's with the chief. Sergeant with the chief. He's with the chief. >> Sorry. >> Hey, fair mates. No, you stay right there, man. >> Hey. Oh, sorry. Sorry. Now you're sergeant over here. Tell him not to move. >> There is. She said he's not moving. We got to get somebody over here. We got to put this anybody. >> This ain't respectful. >> I got locked in. What I got to do with this [ __ ] I don't want to fight. Everybody in. Everybody in. >> And I hear through the there's a deputy sentence behind the radio. That female officer is trying to get get into the door. Do not let her in that door. Do not let any officer through that door >> from PD >> from from the jailer. The jailer screamed at us to move our vehicles. They won't even let any of our guys in. They won't book any of our guys. >> The arrest [music] took place quietly amid chaos. A man was charged with a series of crimes, but what shocked [music] viewers the most was how it was all handled. >> This is as bad as it can get. >> But we can't principle someone's crime, man. >> Yeah, this is as bad as it's pretty bad >> cuz this guy's got a call, but then my sergeant's telling me not to move. >> Right. >> I have What about arrested all them for not doing their job? >> All right. So >> Oh, yeah. >> So, I mean, >> he's going to pass right by us if he ever sees us getting our ass beat on the street. >> A CPD officer threatened to arrest someone for obstructing official duty, even threatening to ram his car into the person if they were not let in. These actions show signs of abuse of power and intimidation that went beyond the limits of what is acceptable. The relationship between CPD and the prison has been severely disrupted, affecting the ability to coordinate official duties. >> Their office is upstairs and they they let me in and when they found out I was recording, they closed the door on me. >> I'm clear. I don't want you to put me in a dungeon like you did last time. >> An ordinary citizen carrying only a camera suddenly became the center of tension in the government building. Can you explain why you're doing that? >> Sure. Yeah. I'm I'm an independent journalist. My new is this like a general sheriff's office or >> they do civil enforcement? >> And I just want to make it very clear that if I'm told to leave under threat of arrest, >> harsh words rang out. I'm here asking questions about my government. >> I'm going to call you back in a second. >> Coming and asking questions about your government. >> Illegal. >> There's nothing illegal about recording, ma'am. Wow. So, this situation escalated very quickly here. This is what happens when you come to the Nassau County. How you doing? >> Nice to see you. >> You, too. >> Um, I just wanted to know what what services do you offer to the public here? >> Um, >> is this like a general sheriff's office or >> we do civil enforcement? We go to uh evictions, warrants of arrest, whatever needs to be done. >> Thank you. I appreciate the support. You know, I'm just here for government transparent. Thank you, sir. >> The officer who had ordered the arrest earlier returned. The entire building held its breath. Would history repeat itself or would the truth be revealed this time? I'm just trying to peacefully Hold on. I just want to >> Okay. >> get get everybody in the uh the video here. Sergeant, um I know you ordered my arrest last time, but I'm hoping that you you know do a little bit of thinking before you act this [music] time and not arrest me just for engaging in >> Did you just want to hang out and record? >> Well, I'm what I'm really trying to do is [music] record, but I'm trying to also do this foil request to me. Let me figure that out. >> So, I'm not I'm not detained or >> uh not as of now. Give me a minute. >> Okay, great. I just don't want you to make the same mistake you made last time, Sergeant, cuz you arrested me last time. Numbers, officers, please. >> Sure. Good. >> The day that you put me in a cell wasn't too enjoyable for me. >> I wouldn't go that far. I don't think that's a fair assessment of what happened. >> I am now you put me in a jail cell. >> I was recording in public and you threw me in a cell. I was asking questions like >> of my government. Sounds like something out of straight out of like North Korea or something. >> That's a discussion for a later date. right now >> throwing somebody a journalist into a cell because they're asking questions about the government, you know. >> So, that's the woman we spoke to before who kicked us out of the office. >> Tensions peak when the legal process drags on unreasonably. Ambiguous rules, shadowy threats, and a system that seems to be working against transparency. giving you your opportunity, sir, to tell to say if you if I don't leave here, you're going to arrest me and then I'll leave. >> It's going to be dependent on what how they want to proceed with this. Okay? >> All right. >> So, I'm going to wait in line like everybody said here as soon as you tell me. So, I want to be clear. I don't want you to put me in a dungeon like you did last time. >> I'm just saying the minute I want to make it clear, officer, I'm being nice as well. I just want to wait in line like everybody else every and hand in my document. That's all. And I just want to make it very clear that if I'm told to leave under threat of arrest, I will leave. going to actually bring [clears throat] the clerk outside here to help you finish all your paperwork. And I'm going to sit back. >> Sir, do you see do you see how many cameras are in this? >> 1 2 3 4 5 6 7 8 in this direction. >> Those are cameras that you go into like any other building. But it's different when there's someone put a camera in your face. I think it just makes people >> Well, I don't want to put it in anybody's face. I'm not in a restricted area. >> Trying to be really nice with you. Hold on one second. >> I'm just trying to stand up for my rights. The same rights that you swore an oath to uphold, sir. That's clerk's here and been done with it. >> First, >> yeah, correct, sir. >> YouTube channel. >> Excuse me. >> Just report on what's going on in our government buildings and, you know, try and hold them accountable. Do open records requests. You've seen videos like that before. >> Yeah. Who wouldn't be for transparency, right? It just doesn't make any sense. Why wouldn't you be for transparency? >> When the government's not for transparency, that's when things are going to go down rope, right? And they going to take control of what we're doing and, you know, hide things from from us. >> After 2 hours of confrontation, an unexpected turn of events occurred. But the story does not end there. A promise of further investigation has just been made. What truth is about to be revealed? Your hand is shaking. Are you okay, sir? Y >> that's your right to record me. We're in public, >> bro. I watch you guys on YouTube. You're in a You're in public, bro. Then you can film. I know you [ __ ] >> It's like you We're filming right now, right? Does that make Does that make you an auditor? >> So, I can I can protect myself and snuff you. >> But you won't. >> You think so? >> I know. So, you won't like you to get snuffed out yet. >> It's a matter. >> Still waiting for that day. Still waiting. Didn't happen. >> Wait till I walk back to my car. Is that a threat? >> That's a threat, huh? >> Yeah. >> Why can't you do it here? Let me put down my uh my folder. >> What? Do you hate transparency in the government? Is that that what this is about? >> I'm good luck making it home tonight. >> Good luck making it home tonight. >> This what I did. Half of that stuff is going to send a little package. >> Excuse me, ma'am. >> If you're filming me, I'm not helping you, sir. Sorry. >> If I'm filming, you're not helping me. I'm just >> I'm here to submit a foil request, ma'am. I was told that the foil officer >> Are you taping me? >> I'm recording the >> citizens may sue public officials for violating their constitutional rights. Pursuant to 42 US Code SS1983, individuals/organizations are required to pay damages to the injured party, violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The story shows abuse of power in public agencies when illegally banning filming, procedural corruption when deliberately delaying foil rights. Up next, in the middle of a seemingly peaceful street with just a camera, a tense confrontation with the police suddenly erupted. >> No, it's my rights. I know. >> No, no, no. I know that like you could take pictures in public. It is publicly accessible to walk up and down this road all day long as long as I don't go on their physical properties. And I'm not even committing a crime. I mean, I'm not doing anything except recording. >> In the middle of a seemingly peaceful filming session, suddenly a police call rang out. Illegal entry, refusing to leave. But is the truth as simple as what has just been reported? >> What do you mean? Who are you? >> Who am I? >> Yeah. >> Just regular press and watch. >> Oh, me too. >> I've seen you guys before, that's why. >> Oh, all right. >> Are you guys Press New Hampshire or you someone else? >> What is it? >> You look similar to people that do Press New Hampshire. >> Press New Hampshire. What the hell is that? >> The same thing. They go around auditing, >> getting a reaction of people. >> No, we just we we >> were you guys hoping I was a cop or hoping I would? >> Yeah. No, I mean, we're just taking pictures. I mean, just we have uh we have like a blog. I I'm not going to give you that right now. Yeah. I sorry. >> No, >> you're good, man. You're good. >> What the Where the hell did you come from? You didn't come from >> I walked all the way down the road, man. This is my walk on exercise right now. >> I'm like these guys must be trying to look for an audit right now. >> No. >> No. What? >> I was just showing signs >> like auditors like like tax not auditors like >> to leave. Are you going to leave? >> Well, I I do know like >> Exactly. No, it's my rights. I know. >> No, no. I know that like you could take pictures in public. You shouldn't be bothered for it. >> Confused. Can you take pictures and videos on private property though? >> Yeah, I mean as long as you I guess. Yeah, I mean I asked them if I can go on the property. You know what I mean? But no, I mean they didn't answer me which is fine. I mean but no I mean we're just >> they haven't really talked about >> we're not we're not an auditor. >> Yeah. I mean that's kind of why I'm like oh happen. >> People can I mean they people are allowed to take pictures. I mean people do it every day. You know what I mean? I just don't see that. There's cameras on >> buildings. You guys are doing the audit. >> Yeah. >> All right, man. Keep >> up. Thank you, man. Appreciate it. >> Four officers, including a sergeant, rushed to the scene based on a single report. Is this a normal reaction or is a power play about to unfold? >> Copy. >> I think he is the caller and I think he's acting stupid. So, you got a sergeant right there. >> Another unit. Three units. Four officers. That's crazy. At least they all parked correctly. That's nice. Then again, he may not be the caller. >> Yeah, there's a lot of private drives and private ways in Mass. Uh but they are open to the public and to be accessible to walk through. Um the only difference between private way and private drive and private property um and public property is the fact that they take care of the roads and the utilities and gas lines. Um that would be their responsibility of uh private property or private business on this road. Uh if that's even the case. It is Red Cliff Road in Tukesberry. It also goes all the way from up there and all the way down there to another public street. So, it does attach and that's what you would call a private way or private drive. >> The debate rages. Is this a public or private road? Who has the right to stay? A fine legal line between liberty and coercive order. >> How you doing? What's up? >> Um, can I just get your names and badge numbers, please? >> Yep. My name is Lauren Strong. Badge number 34. >> 34. Okay. And who's that? Who's that? >> Markman. >> What is it? >> McMahon. >> McMahon. >> Why are there four officers here for cameras? Are you a field training? Yes. >> Nice, man. >> Yeah. So, consider three. >> Yeah. Yeah. All right. >> Three and a half. >> Yeah. >> All right. We're not on the property. >> Okay. >> There's no trespassing signs, but that's irrelevant. I know where the property lines are. >> Okay. That's a false police report. All right. And three, they never asked us to leave. All right. And I think you guys need to do something about that. >> False police report or something. All right. Because now you guys are coming with three, four officers. Okay. You're being lied to. They're wasting resources and I'm not even committing a crime. I mean, I'm not doing anything except recording. I heard the radio. First Amendment auditors, but I don't see what the issue is here. I don't know what they told you inside, but from what I'm telling you, I have everything on on on camera. >> I'm going to be the owners. You can stand over there, but I'll talk to you. >> Yeah. So, McMahon, right? Is that McMahon? Okay. Sorry. I mean, we're not doing anything illegal, are we? >> So, we're talking to them. This is all private property, including >> Yeah. which is publicly accessible to walk through 100%. I'm not strong. I'm not in the building. Look, okay, I know the laws. I know the rights, okay? This is a publicly accessible road. I understand that. But there's public access from each end of the road that does not say private property. And it doesn't say private drive. The other difference between public property and a private drive, okay, is that they are to take care of the gas lines and utilities on the road, not the city. >> So, I totally understand where you're coming from. Yeah. >> Correct. But what I the information I'm getting from them that this is a private road. >> I'm not on their property. I'm not on their property. >> You guys are going to have to leave. >> We're going to have to get off this road, this public road. >> It's not a public road. >> It's this private drive. >> Auditors bluntly challenged. If we are wrong, arrest us now. A tense moment when neither side would back down. >> You know who would have it? Is uh town hall or city hall. They'd have the GIS. >> How you doing? I got the name from them, but can I have it from you, please? >> McMahon. >> And badge number >> 41. Thank you. So, you can go to the police station if I report. That's something that you want to do. >> What kind of report am I filing? I don't have anything to report. >> You just said you want to talk to >> Well, yeah, but I'm not going to be pushed off of this today. We're driving up and down this road. >> Why are they Why are they allowed to? >> 6 going to be in the lobby stating that somebody stole his wallet out of this room last night from 207, but he is in the lobby with your pleasure. >> Look, I'm not here to take any more of your resources, okay? But you got to understand one thing. >> Okay? And they don't work here either. >> Listen, I'm just trying to be the middle. >> But do you understand what I'm saying? >> Nope. And I do. I'm just trying. >> So, am I allowed to drive down this road? >> Nope. You are. >> Come on. I mean, think about it. >> No. And I completely understand where you're coming from, right? >> It's a It's a right away. >> Nope. And I get that. >> Oh, you get that. Okay. >> So, like I said, I'm talking talking to the owners of this building. They're saying obviously >> private property. >> I'm not going on it. I'm not I haven't even touched the grass. No. >> So, this is me asking you, can you please leave for that? >> Are you asking me? >> I'm asking you, can you please? >> No. I'm going to if you're asking me and not giving me a lawful order, I'm going to respectfully decline. >> Okay, >> but I will be out of here in a few minutes. >> Okay, that's fine. That's fine. Like I said, just don't go near the building, please. >> Look strong. Don't Okay, I mean, come on. You guys know what I'm doing here. >> Like I said, I just wanted to be a voice for them and see if you guys wanted to leave. You guys stand over here like you guys were. >> You need to understand you got called out here, okay, for a false call. They said that they asked us to leave. Never asked us to leave. The standoff ended in silence as those who had given the orders quietly withdrew. The incident exposed potential abuses of power when police easily believed one-sided information and lacked transparency in handling civilian reports. >> Incredible. >> Still lying. >> Incredible. That was a fail. That's a walk of shame and a half. >> I ain't walking shame. They are. >> Wow. That's how you challenge a private drive. >> Holy [ __ ] >> That's how you challenge a private drive, bro. >> You have to know your [ __ ] bro. Do not let power prevail over the law, for then today's silence will be tomorrow's regret. Hey everyone, what do you think about this situation? Next, a former cop was banned from carrying a gun, but still brazenly approached a victim. And this time, nothing was overlooked. Once I get statements from the people who saw him up here, we're going to take a warrant for aggravated stalking. Okay. Probably end up taking a aggravated stalking warrant out on you, man. >> On camera. So, we're going to go from here with the warrants on them. All right. Is that okay? All right. Um, >> right in front of cameras and witness testimony, the former officer stomped on his protective order and the local police were ready to take action. >> I got me in all this mess with him in the burger. you ain't really going to be able. >> So, what uh what we're doing is my sergeant's getting the uh proof that he's been served and then another copy and I'm going have you follow me down there once I get statements from the people who saw him up here. We're going to take a warrant for aggravated stalking. >> Did you see him up here? >> Yes, he was up here. He was meeting with my executive director and then she called me down to her office whenever um he was there cuz she was trying to hire him for and um he was here for a little while cuz he did his TOEFL test and it was something else. And this is this is her manager or Harrier supervisor. >> So you didn't see him up here? >> Did you see Billy up here? No. >> Will you fill out a statement just stating you know what you saw and put about approximate time that you saw it? I just need your name, address, you can put your work address, work telephone. Uh, your date of birth. >> I didn't know she worked there. An excuse too late when he admitted everything right on camera. >> Hey, how how you doing? >> Good. So, uh, what was your reason for being up here at Resare today? >> I got called for a job interview. >> Okay. And you do know that lives works here, correct? >> Uh, no sir, she works at a She doesn't work at the main office. This is her employer. This is the main office. Your protection order says approaching within 200 yards of petitioner's immediate family residence or place of employment. This is [music] her place of employment or school. >> But okay. Well, she wasn't there at the time. >> It does not matter. It says within 200 yards of her, her family residence or place of employment. It does not say her and her place of employment at the same time. >> Okay. You were served this paperwork, were you not? >> Yes, I was. >> Okay. All right, Crib. So, I'm going to tell you right now what's going to happen, man. We're going to get all the paperwork from the courts as well. We'll probably end up taking a uh aggravated stalking warrant out on you, man. I'll be in touch with you. I'll let you know what happens and when you need to turn yourself in on that warrant. All right. >> Okay. You you do aware of I'm the victim in this whole matter. That the district attorney has called me and said I was the victim in this whole thing. I don't understand how I'm getting charges. >> Okay. Maybe does not matter. The petitioner is it was placed by the >> facing charges of aggravated stalking. He stayed close to his victim every night. Was the law strong enough to protect her? >> And he knows he knew how to get me in trouble. He's getting me back for him getting fired. But he lied. See, back in September, him, you know, I had to deal with that before when he lied in April and said that. He told admitted the cops that never happened. So, I don't know what happened cuz all the cops admitted it, talked to me about it, got messages with the cops, everything. But he's friends with the sheriff. They're in the middle of dealing with it right now. I have arranged it for today. But I got But my son and I had to tell the cops, so I thought that'd be enough.
