What do you mean by what they want done? What >> you come in quarter 4? >> Because it's a constitutional right. You're not even willing to go down an avenue that I've given. What >> time I get off work? 4:00 4:16. >> My point exactly. >> Am I free to go, sir? >> You are not free to go. >> Say >> that's why the lights are on. >> No, he detained me, sir. >> Right in the heart of Salem, Illinois, a citizen dared to stand against [music] the entire system when police tried to strangle constitutional rights. I mean, unless the secretary of state wants you trespass, that's why I'm [music] trying to get your name. >> Okay. >> And ban threats of arrest. But when the law is questioned, who is truly at fault? >> As of right now, you're not being trespassed. >> The moment he walked in, just one sentence. Sir, you can't record in here. Could this be the beginning of a tense confrontation? >> Like I sergeant, that's all that's all I need to call. and I provided you documentation uh from our legal counsel as far as a >> would either one of you be willing to call. >> The police show up asking him to step outside to talk, but the real question is was this an invitation or a disguised order? How >> you going, sir? >> I'm doing good. How are you? >> Not too bad. You >> mind if I start with your name and badge number? >> Yep. Officer McMeene and 214 is my badge number. >> Can you say your last name? I don't want >> McMan. >> Mcme. >> Yep. And what was the number again? >> 214. >> 214. >> You want to go outside and we'll talk real quick and we'll figure out what's going on. >> Respectfully, I don't Am I being ordered to go outside? >> Yeah, we're going to go outside. >> So, I'm being detained right now >> just until we figure out what they want done. >> What do you mean by what they want done? >> What' you come in record for? >> Cuz it's a constitutional right. >> Doing anything other than that or >> Yeah, I'm going to file a foyer request before I leave. >> Yeah, more than welcome to, man. Yeah, appreciate that. No problem. >> You want to hang outside and we'll talk though? >> If I'm not being ordered to go outside, I would rather not because I do have the right to be in here. So, unless I'm >> under the threat of arrest, >> we would have Yeah. The >> citizen firmly demands, "Show me the law I've broken." Sparking a fiery legal showdown right on the spot. >> Investigate a rhyme better with the Illinois Secretary of State Police. >> Yes, sir. >> Uh, are you a First Amendment auditor? Is that what you're doing? >> I'm just a citizen exercising constitutional rights today. That's >> true. So, as you know, there's a sign there that says, "Notice recording or photography of any type is not allowed." >> Okay. >> Yep. So, we can't have you videotaping inside the facility. And there's that. Say case law favors. State of Illinois asked to not allow the recording or photography of any type in Secretary of State facilities. All inquiries should be directed to the Secretary of State Office of the General Counsel 217-7853094 and ask for pay. Do you have any case law attached with this that you'd be willing to provide me or >> contact the general counsel and they'll be able to get it to you. So, you have your ID on you? >> No, I don't actually. >> Okay. What's your name, partner? >> Am I being detained right now? >> I mean, unless Secretary of State wants you trespass. That's why I'm trying to get your name. >> Okay. Uh, what statute would that be trespassing under? State supported land. >> You disregarded a sign that says recording of any type is not allowed. So, you violated that sign. So, you are suspecting me of trespassing. >> I'm saying if we want to trespass you, I would need your name. So, as I amass as of right now, you're not being trespassed. >> Okay. So, as of right now, I'm not under suspicion of a crime. >> Okay. Here's the thing, though. If you show back up and you cause issues, then what's your name? >> Nobody even asked me to leave. >> Okay. Okay. Well, they're asking you to leave. >> Okay. Well, respectfully, I'm going to decline. >> Okay. >> Are you Are you refusing to leave the property? Will I be arrested if I don't leave? >> You'll be cited. >> Yeah, >> I'll be cited with what sighting? >> Criminal trespass to property. Actually, it's criminal trespass to state supported property because you're refusing. >> Look that statute up and it will be in plain text why I am not in violation of that statute. I've just been through this. I I'm doing you a favor. Me, >> officer Mad. >> You got the name right? And uh >> when threats of arrest and the failure to identify are brought up, will the situation erupt into a controversial arrest? >> Well, normally I would just write you a ticket and send you on your way for criminal trespass. Okay. >> But because I'm being so defiant, it's going to escalate. >> What it is that's failure to identify. So I have to write a name on that ticket. >> So you suspect me of a crime? >> I do. >> So I've been detained this whole time >> right now. You are cuz you're refusing to leave the property. So, if I leave, >> so if I just walk away right now, then what? >> Then I'm gonna let you walk away because I don't want to write you a ticket. I don't want to take you to jail. >> Okay. >> Stay on this property any longer. Then I am going to have to put handcuffs on you and take you to the jail. I don't want that either because >> it seems like you do. >> No, I don't. >> You're not even willing to go down an avenue that I've >> What time I get off work? >> 4:00 4:16. >> I Nobody's forcing you to violate my rights right now, sir. >> I'm sorry. already feel that way. >> You don't even do yourself the favor of calling him though. Like I >> call my sergeant. That's all that's all I need to call. And I provided you documentation uh from our legal counsel as far as a >> Would either one of you be willing to call Tim Hudsmith. >> This is Secretary of State property. Secretary of State is >> and I just read you the statute that he was trying to >> site me with. So nobody's willing to even save yourselves the qualified immunity. From what I'm gathering, we're kind of at an impass, right? >> Well, yeah, because I'm exercising rights and you're violating rights. That's the impass. >> I'm sorry you feel that way. So, right now, you are on state property. Okay. So, and I am asking you to leave. If you fail if you fail to leave, then you will be charged for criminal trespass. >> What is that? A book and release or is it down to the jail? You hold me for the weekend or >> As of right now, you're failing to identify. >> Okay. >> So, if you >> So, we're stacking charges. Yes. >> For exercising rights. So, so if you fail to identify, then you're going to be taken in a fingerprinted so I can get your identity. So, then I can write you the ticket and then you can be >> How does that work? You guys beat me into oblivion until I'm willing to until you can forcefully I mean because So, if I'm >> Why would you say beat you into oblivion? Why would you use terminology? >> Well, because I'm not willing to uh identify. So, I'm not going to be willing to fingerprint. Right. So just because you put me in handcuffs and put me in a car and take me somewhere, I'm supposed to just be willing to >> Well, the problem that we have >> wave my rights now >> is so criminal trespass is just a ticket. That's all it is, >> right? >> In the end, one phone call changed everything. The police quietly retreated in a drive of shame. But why were they forced to back down? >> State attorney, he advised me that it's public place. One can be in here. We cannot trespass. >> Thank you. So >> Swaggler, Detective Swaggler, >> Detective Swaggler, >> appreciate it. It took long enough, but >> Salem Police Department to be on our way. >> Yeah, you're not going to unfort. So >> speak with you for just a minute. >> Are you guys body cam's not muted, right? >> Body cam is on. >> Not muted. >> Appreciate that, sir. >> Go inside and show that. >> Okay. >> Appreciate it, sir. I'm going to come inside with you since I do have the right to. As long as you stay in the public area, obviously. >> Yeah, of course. That's all I had been doing. Didn't bother anybody. >> I spoke with secretary or with the uh state's attorney and he advised me at this point that he was able to be your social county attorney. So, >> I mean, as long as they're happy from Salem PD, from our standpoint, there's nothing that we can do. Okay. No broken >> as far as SOS. >> Not this week. >> That's going to be up to here. >> Yeah, he's still out there. >> We're going to go ahead and grab it later. >> Okay. Yeah. Whatever. >> I'm just doing what? I'm still not that ter. In the state of Illinois, if police unlawfully detain a citizen for filming in public, they can lose qualified immunity, face civil lawsuits under 42 USCS1,983, and be forced to pay substantial financial damages along with internal disciplinary actions. The citizen prevailed while the police now faced the risk of civil litigation for violating constitutional rights if the detention was unlawful. Up next, the moment the camera started rolling, the officer suddenly rushed in, using a sensitive excuse to stop the citizen in his tracks. >> Your contact is non-consensual, sir. >> Um, do you see those lights? This isn't consensual. So, I'm stopping you because you're filming the kid. Okay. I understand that you have an issue with law enforcement. I understand that you're trying to film me, but in the process of you filming, >> do you understand that this is public? >> Let me finish real quick. in the process of me filming. >> Am I being detained? >> You filming me? >> Am I being detained? >> Did you see these lights? >> So, does that mean I'm being detained? You >> are being detained right now. Why are >> reasonable suspicion articles? >> Filming a child. That is why. And I was trying to explain that to you, but you want to interrupt me just to ask. >> So, am I under arrest? Are you going to arrest me for filming a child, sir? All right. >> In public? >> Listen, >> I don't need to listen to your [ __ ] Your contact is non-consensual. >> You can't ask me a question and then not allow me to answer it. Like how why would you ask the question if you're not going to let me answer? Why? Why even ask the question then? Does that make sense? Does that make sense to ask a question and then not allow anybody to answer? Okay. So, just so you understand since I didn't get to say it when I initially started talking to you, I understand that you are filming. You are free to film. I have no issue with that. We are on public property. I have no issue with that. Just so you know, I am filming as well. Okay. body cam for video and audio. All right. So, the reason I'm coming over to talk with you is because you are filming a child. I understand that you like to film us and make sure that we are doing our job correctly and proficiently. I understand that. I have no issue with that. But in the process of you filming me, you're filming a child. Okay? Of all the different interactions that you've had with law enforcement, that was that is the reason I came over here to speak with you. Okay? The citizen kept [music] pressing for answers while the officer insisted on holding him without giving a convincing reason. A confrontation clouded in legal ambiguity. >> I plead the fifth, sir. >> Okay. >> Your contact is non-consensual. >> It is It isn't consensual. This is not a consensual encounter. You are detained. This is not a >> For what? What crime am I being detained for? >> Explain that to me. >> For filming a child. >> For filming a child? Yes. >> Are you [ __ ] for real, dude? In public? >> Filming a child? Were you not filming me talking to that child? >> My point exactly. >> Am I free to go, sir? >> You are not free to go. >> Am I under arrest, sir? >> Supervisor on his way. >> Who is your supervisor? >> More than welcome to speak with him. His name is uh Sparkman. >> Officer Sparkman. >> So, outside of the legality of this, while we're waiting for my supervisor and you pleading the fit, >> out of curiosity, were you in the military? >> Just out of curiosity. Has nothing to do with this stop. I'm just wondering because you're wearing the hat you're wearing. >> You're not in trouble by answering. I'm a veteran myself. I just wanted to thank you for your service if you were. That's that is the only reason I'm asking. If you still feel the fit of that, that is that's fine. >> But if you were military, I appreciate your service and thank you. Okay. >> Outside of this interaction. All right. Okay. Good talk. So, >> why are we filming a child? >> Your name and badge number, sir. >> I'm I know that you can see it, but it's officer Horton, badge number Z4629. >> Anything else I can answer for you before I go back to my >> While the law should have been clear, it was the enforcer who appeared uncertain, leaving many to wonder, was this law enforcement or blatant abuse [music] of power >> of a crime have I committed that made you detain me, sir? >> Why? Why do I continue to answer that question specifically if I've already made >> because you haven't stated a law that says I can't film a child in public. >> It is illegal to film a child. >> Are you ridiculous, dude? >> It is illegal to film children. >> It is. Do you have that parent's consent to film that child? Do you have that parents consent to film their child? I didn't think so. >> Okay. So this is my supervisor. >> So I stepped out with him because he's filming a juvenile. >> Say what? >> I stepped out with him because he's filming a juvenile. >> He detained me is what he meant to say. >> That's why the lights are on. >> No, he detained me, sir. >> I'm investigating trying to find out why he is filming a child. >> And you're his supervisor? >> He's not. >> And is filming a child in public illegal, sir? >> Filming a child? Why are you filming a child? I was filming your [ __ ] officer here. But he claims that I was filming a child. >> All right. I said that. I stated that. >> What do you mean just be gone? He [ __ ] detained me illegally. Sir, >> you're not detained. You can go. >> He detained me, sir. Am I Am I being detained, Mr. Horton? >> He's undetaining you? >> Yes. So, I don't understand why. >> Okay. >> The tension peaked when the officer invoked a hidden law that never existed. From that moment, the dispute turned into a battle of wits and legal arguments right in the middle of the street. >> [ __ ] you just illegally detained me. Do you understand what you did, sir? >> You scumbag blue line thug [ __ ] Do you understand what you [music] just did? You illegally detained me for filming a child. Sir, what the [ __ ] is wrong with you? >> How long have you been a police officer? Sir, >> how long have you been a police officer, sir? >> You look it up on your little paychart. You're a real dise disrespectful pig, sir. >> Am I? >> You certainly are. >> How? >> Tell me how I am. >> [ __ ] detaining me for filming in public, you stupid son of a [ __ ] >> No, that was not. >> What's your name and badge number, sir? >> Officer Sparkman CH469. You're free to go. You're free to go, sir. >> I sure hope you're going to speak to this gentleman about what he just did to me. >> We're good for >> What do you mean we're good? I'm not [ __ ] good. I was just illegally detained. The [ __ ] is wrong with y'all, man? And then when the superior arrived, everything suddenly flipped 180°. But what's the truth behind this sudden turnaround? Up next, a routine check turns into a show of power. The question is, are the police keeping order or overstepping their authority? Man, you not good. You're not good. Step on out here with me. Come back here with me. Hey, where >> you're in terrible shape, >> huh? You're in terrible shape, >> Dav. You're drunk. You're really drunk. Well, if you got somebody coming right in your face, chest to chest, you know, you sh, you know, I'm glad I do what I do. If it means me losing my job, you know, I just don't understand. Somebody could come in. I have to do what I have to do though. I understand how somebody I'm playing a rock and a hard place. >> It's [ __ ] Like I said, as far like I said, we were supposed to have forms and he could have gone. I I wasn't going to let him go and start the shenanigans again until he fell. So, just like I said out there, you know, you're a security guard here. You have a right to maintain order in the building and walking around in a public place >> is is not disruptive to the point where it would require physical force to restrain him in the building. That is the issue. >> I know, but I mean there forms that they're going to make and I didn't want to let him go until I >> But so next time just call us immediately. Don't even talk to him. >> We called name, date of birth, age, address, phone number. Instructions echo. Write [music] it this way. Make sure to stress that part. Could someone be trying to twist the truth? >> And now be mindful that there is a video of the entire thing. >> What should we say? It was 2 weeks ago when he was here or 3 weeks. I don't I don't know. >> It doesn't It's not It's not important. >> Yeah. I'll I can stand out here. Let's make sure no one else. >> Can we Can we keep this closed? >> Can we keep this closed? We need some privacy here. We got to work on this. This is more important. I mean, if you want to call, put your hands off and try to keep it up. You call that to me. I don't >> It's a discon. It's a disorderly condom. >> Think's different to my guy 25, 30 years ago. Look, what am I going to do? I thought I did the right thing. >> Well, the the the if um >> so be [music] it. If that's the way it's going to be, you know, I can't, you know, I just thought I was doing the right thing. No, it's not. It is disruptive. It's disruptive. It's invasive. I don't like having a camera. I did all my >> What does this say? Take a I know. We'll get >> I explained to him that he had to give me his name and take a courtesy card. That's what the cards say to the department of his choice. He refused to do so. >> Getting all into what happened last time. That's not that's not pertinent to today. >> I thought it would be >> today, Thursday, July 15th. The time I began to enter the stairwell and I blocked from heading upstairs. Sean Bes kept chest to chest with me and held my hand. >> All right, continue on the back. It's not finished. First, >> the camera captures everything. [music] The man filming was neither violent nor disruptive. Yet, one unexpected decision ignited public outrage. >> This is your statement. >> Yeah. And you know, you need to articulate here what's going on >> cuz he he's not he wasn't acting aggressively around. He's just filming. >> But he kept getting >> I know, but at the end of the day, it's just filming. This is what these people are trying to do and and you you fall right into their trap when you when you when you act like this. He's just filming. It's all he's doing. He's not hurting anybody. It might be a nuisance, but there's a difference between a nuisance and being disrupt people comes in here and starts screaming and throwing stuff around. That is disruptive. This guy filming, it's not a safety issue. [music] >> It's a nuisance. It is not a safety issue. That's that's the problem we have. So, two prongs. Ready? Just take a break for a second and just hear me out and then articulate it. I was instructed by my bosses X and Y >> that I'm supposed to provide >> a form to anyone that comes in the films. >> I was told this last night. >> Listen. Yep. I was not given those forms yet. He came in today. I was simply trying to get him to sign the forms. Now you have to say you're supposed to do this, this, that, and the third. >> He refused all that. Proceeded around me and went to go up the stairs. Now, all that is well and good until you start to use force against somebody. >> They told me >> this isn't someone whiling out at the hospital. You know what I mean? This is a completely different arena. >> In the end, the one who used force wasn't arrested. Instead, the man with the camera became the accused. What is really happening behind the scenes? This incident shows freedom of the press was violated and the legal process was twisted to protect the police from within. >> You got physical with somebody that for the most part you really had no reason to be physical with. I didn't want I know, but for what? For what? He's filming. What is he doing? Like I said, if I would give those forms, >> you know, that's the problem. It's it's it's a public place. These guys right now, they're allowed to >> that's just that's [laughter] just a BS rule. That's not against the rule. >> That's what I was told when I came here. >> I know. Sign of the door. Look at the sign of the door. Okay. All visitors must sign in. It's everywhere. We're going to have stickers soon. Anybody recording must fill out a form. >> I know. Well, they they I'm glad they did that so quickly since the last in that they told you that you're supposed to stop anybody. Don't >> I'm sorry. >> You know, and and not for nothing. >> Like it's it's not against the law. This woman walk around this counter, start filming, and go upstairs. It's not against the law. You can't That's where the issue guys came to me the other day. >> I'm not siding with him. I'm just telling you what the facts are, how this works. So, these two fellas came in. >> Yeah, they came in last week. One guy, they had they gave me the card. One guy's last name, he went by Lee Austin. >> They fil they gave me their name. They took a card. >> Society can only be truly civilized when the laws applied fairly with no exemptions for anyone, not even law enforcement. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. Next, a peaceful fishing trip turns into an action-packed situation. >> Fishery stuff. Did you guys possess any fish today or anything? >> No, we we didn't even get to We didn't even get to catch any fish. >> Somebody called in on you. Is that what happened? How >> When the police show up with guns drawn, is justice really served or is it just a misunderstanding that leads to serious mistakes? Okay, that you know I'm allowed to record. >> All right, guys. So, I'm I'm being told by law enforcement to tone turn my phone off. >> Uh I have ID, but have I committed a crime? >> I need I'm just trying to find out what you're doing out here in the public park. >> Okay. Well, um I'm out here fishing and if I'm not mistaken, uh what is it under Florida statute 790.25 section 3 subsection H. I'm allowed to do this. And we're allowed to ident. >> Uh if I'm committing a crime, >> you got fishing license. >> Yes, sir. >> Okay. You want to show that, too? >> Uh I'd rather you grab it. It's in my pocket. I This one. >> Yeah. You see that like rectangle? >> I appreciate you doing that. Uh practicing your Second Amendment and stuff. So, where's that in here? >> It's It's in there. Can >> I just take your concealed license for now? Make valid? >> Yeah, that's that's fine. Am I Do I got to keep my hands up still? You said, "Yeah, keep my hands up still." >> Yeah, I would. Okay. Now, you good with that? >> Yeah. >> I have no ill will, just so you know. It's just kind of tiring keeping my hands up like that. Want to rest from here? >> Huh? >> From here. >> Yeah. Yeah. I'll go like this. And that feels a lot better than having a bump in the air. >> Where you from? You don't ask. >> From here? No, from Florida. >> Okay. >> We literally just got here. >> Okay. >> Yeah, we we just got here. Uh, I grabbed my stuff, grabbed some bait, and we was about to start casting out and then I look behind me and you guys are all here. I I understand, but if if exercising my rights freaks people out, that's not really my problem. >> The law is clear, but not everyone understands it. When citizens have to teach law enforcement who really holds the power badge number, sir, name and badge number, sir, do you not hear me? You must not like the public, huh? It's a shame. What about you, sir? Would you tell me your name and badge number like this gentleman here? No, you neither. Would you identify to me, sir? A member of the public's asking you to identify. You guys made contact with me. No. Want to identify neither? What about you, sir? Name and badge number, please. No. Just going to smirk at me. So this is what the police act like to the public as you see here in the Florida State Statute 790 section 3 subsection H. Now after seeing that I had a lawful concealed weapons license >> who's holding their hands up for an excessive amount of time will realize that this is a bit uncomfortable. So for exercising your rights you get treated like a criminal forced to do things against your will. Now, just so you guys know, things like this, this is unlawful under US code 18 subsection 242 and 241. This would be considered under the deprivation of civil rights while under the color of law. It's a federal offense. >> A lieutenant from the Fish and Wildlife Conservation Commission was on the scene. Will it change the outcome and clarify who broke the law? >> This is the rights of the people, right? You swore to protect this the same way you swore to protect my right to film. And the first thing you asked me was turn off my camera. What's your name? Get to cast my line out. I started getting ready to cast my line out and then I got freaking >> vehicles right over here. >> Yeah, it's uh >> Is this guy with you, too? >> Huh? Yes. Yes, he he's with me. >> Okay. >> Um before you guys leave, can I get business cards with him? And uh I still got paperwork for you to sign. >> All right. I appreciate it. >> Fishery stuff. Did you guys possess any fish today or anything? >> No, we we didn't even get to We didn't even get to catch any fish. >> Somebody called in on you. Is that what happened? Hi, how are you? >> Well, they didn't they didn't say if anyone called in. >> Are you okay? >> They didn't say if anyone >> state police I'm fishing wildlife just doing fisheries check. >> Did you guys have any luck today or you never got started? >> Yeah, we we literally put the hooks on the lines and as we were getting ready to um cast the line. I I look over my shoulder and then I see all these guys over here with their rifles and I'm like, "What the you know, I I study the law and I I know it's legal to do this." So, >> no problem. I understand that, too. I just said I guess they were just trying to verify things. So, they called us over, which is no problem. >> Mhm. >> All right. Good stuff. So, >> I got the fishing license if you if you >> No, it's for fishing weekend. You don't even need a fishing license. >> Oh, well, I I didn't know that. I I got a saltwater and a freshwater license. >> Sounds good. Yeah, you don't even need a fishing license and stuff. All right. So, what else do they need? What else do you guys need? There's really nothing here. If he's got fishing poles, it's nothing. It's not going to be a problem. >> Okay. >> I appreciate it. >> Trespass. >> Huh? >> Okay. They might want to trespass. That that can be different than >> now. How can they trespass me off of a public place? >> I don't know. Ask them. >> That That's illegal. That That's super illegal. >> Call my lawyer. >> No, that's okay. You can handle it. You You have a right. You're innocent till proven guilty. So, just you know what I mean? Do do what you got to do there. But I I can't speak for them. I don't know anything about that part. I was just going to do the fishery check. I'm done. You have anything else for me? >> Uh uh question. What was your name, sir? >> Uh Lieutenant Riley. All right. >> Lieutenant Riley. I appreciate it. You're very professional. Thank you. >> All right. Thank you. Nothing really wrong. I mean, he's got the fishing poles. um says he's fishing free fishing weekend. He asked fishing license, but he doesn't really have to produce them and doesn't need to show us that. So, >> two months later, he returned to the scene, not to confront, but to prove truth if persisted in can prevail. >> To make sure that when I go back to where it is that I'm going to be fishing at that I don't end up going to jail. >> I know. Yes, they uh I guess parks and Rex called yesterday and they uh decided to just go ahead and wave all the passes that issued on that whatever day >> on all four individuals. >> Yeah, there was a couple a couple of them. I think it was like four of them. >> All right, perfect. Perfect. >> And um is Lieutenant Ride and all the other officers who were misinformed of the law going to be educated on that law? >> Well, I [snorts] I was not there, so I have no idea what you're talking about. I I spoke with this gentleman before. Again, I was not there, >> so I don't know. I know that you can have a weapon when you're fishing. So, do they know that? I have not spoken to them about that. >> Okay. Are you like their immediate supervisor? >> No, we're same rank. >> Same rank. Okay. >> The one that's above that is commanders, deputy chief, and chief. >> All right. Perfect. >> I'm the lieutenant for the squad that are working. >> And and if I wanted to speak to the person who is their immediate supervisor, what would their name be so I can uh try to contact them? >> Hutch. He's the deputy chief. >> And also uh Lieutenant I mean commander >> commander. All right. Perfect. Do you understand not providing paperwork that shows that the gentleman's trespass is being resent can cause a lot of problems out there? It won't work. >> It won't cause any problems because if somebody runs your name, it'll show that there is no trespass. >> Okay. >> So, >> well, they had me with my hands up for about 30 something minutes. >> I mean, why would they? Because they're probably tyrants. I mean, do you have any coordinator? >> I am not going to get into those type of question. I'm going to answer the questions that he's asking and we'll just stick to. >> All right. Well, yeah, that that that's all I wanted to know cuz in the end of the day, he was misinformed of the law. And you know what? If what if I couldn't keep my hands up for as long as they made me keep my hands up and I got tired and my hands dropped, will they have shot me because I had a firearm legally? So, I just want to make sure that they get trained properly. >> And again, what you can do is if you if you feel like you need to talk to somebody else, they are below us. >> All right. No problem. I appreciate you being cordial with me. Thank you, sir. In Florida, police abuse can result in a variety of penalties, including civil penalties of up to $10,000, restitution of illegally obtained benefits, public warnings, and suspension or dismissal under section 122.317. 2 months later, OBT visited the Titusville Police Department and confirmed the trespassing warrant had been revoked. He sought assurances that officers would be educated on the relevant laws. The heated exchange was as tense as a tightroppe. And then the sergeant's hand suddenly appeared, triggering a controversial turning point in this story. >> Let's deescalate. We're >> deescalating on private property. >> Don't touch me. >> Okay. No problem. >> Don't touch me. >> I'm going to touch you if you don't cooperate. You're on private property. Don't touch me. >> You're in the police stationed lot. >> Don't touch me. >> Let's go. Let's go. >> Don't touch me. >> Okay, let's go. >> Don't touch me. >> I'm not touching. I'm escorting you. won't touch me. >> Do you want to get placed under arrest? That's the next option. Trespassing. You don't need to touch me. >> Multiple signs dictating this property. Can you just walk past right over here? Right over there. Continue on. Let's go. I'm more than willing to walk with you. >> Don't touch me. >> I'm going to touch you. No, you're not. No, I can walk. >> Okay. So, walk. More than willing to walk with you. >> Don't touch me. I can walk. >> Let's go. Please. >> I can walk. >> What's wrong with you? >> I can walk. >> G. Martin. Sergeant. >> Sergeant 434. >> 434. >> You are in closed parking. No, I am not supposed to say otherwise. No, it's not. Let's take a walk. >> We're going to walk. Just don't touch me. What's wrong with you, man? >> What? What's wrong with me? What's wrong with you? Why are you back here? >> You think you could just Do you think that you could just touch people like you? No, you cannot. >> Take your hand out of your pocket. >> I'll put my hand right in my pocket. >> Take your hands out of your pocket. That's a safety issue. What's in your pocket? >> Nothing is in my pocket. I'm not reaching for anything. It's cold outside. >> Take your hand out of your pocket. It's >> cold outside. >> Please take your hand out of your pocket. >> Listen, you got to stop. >> Do you want to escalate this or do you want to continue? >> We got to stop. We're walking. We're walking. We're [music] walking. We're walking. We're walking. We're walking. If you want to go right past the sidewalk, you're more than welcome to hang out there. This is enclosed. >> No, it's not. >> Yes, it is. >> No, it's not private property. >> No, it's not. This is public property. >> No, it's not. >> This is public property. >> Until these post is signed. >> Go get a lieutenant. Go get a lieutenant. Go get somebody. >> Go get somebody higher than you. >> What do you need? >> Who would Where's their enclosed Where's their enclosed property? Where is it? Enclosed [music] right >> right there. Continue on. >> Where? >> Continue on. >> No signs, no fences. Yet the order to leave thundered like a storm. Is this the enforcement of the law or is something else going on? >> Come on, man. >> Please put your mask on. >> I'm outside. You're the one coming up to me touching me. If you're worried about private property, >> if you were worried about Corona virus private property, >> if you No, it's not. >> Yes, it is. >> This is public property, sir. >> Posted private property. >> Let me ask you a question, Sergeant. Let me ask you a question. >> As long as you get over here, you got to stop touching me. You got to stop touching me. >> That's not going to happen to you. You got to stop. You're breaking the law. >> No, I'm not. >> Yes, you are. You're going to be It's going to be showing No, I am not. I'm telling you you are. No, I'm not. You can fight it in court. You can fight it in court. I'm telling you right now, you're breaking the law. >> I'm telling you I'm not. >> I'm telling you, you are. >> What you say does not matter. >> This is a public building. This is a public building. >> What it's becoming ongoing construction work. You walk right past your hands. This is a public building. This is a public building. >> Correct. >> Funded by taxpayers. [music] Correct. Okay. So, that means this is public area and it's publicly accessible. If you want to put Sergeant, if you want to put a fence, [music] put a fence up there. >> Why would we put a fence and we can't gain access? >> Oh, you can open the fence. >> That makes no sense. How about a sign? >> A a sign where? Right there. Let's go. There is no There is no sign. Let's go look at it. >> There is no sign. >> You want to film it cuz you're not showing. >> There is no sign. >> You can show anything you like. There is no sign here. Okay. >> There is no sign. >> You're on video surveillance. I can care less if you're surveilling us. >> See, you're okay right here. >> I'm okay wherever I want to be. I'm okay. Where? Go get it. >> I'm not going. Why would I get anything? >> Go get it. >> Absolutely not. >> Go get it. >> I'm telling you right now. >> What's wrong with you, guys? What's wrong with you? >> What's wrong with you? >> Do you need to make a report? >> What's wrong with you? >> There's absolutely nothing wrong with you. >> I want to make a complaint. I want to make a complaint against you now. I have business here. >> Be more happy to get my senior official to come out here and talk to my supervisor. >> Let's Let's get him out here. >> When the request to meet a superior was granted, the man refused to back down. He wanted to uncover a truth. A truth that could shake the entire command room. Give >> or take. >> Okay. So, 14 years you've been a police officer. Correct. >> I'm telling you right now, you're not going to want to arrest me [music] >> for not breaking the law. If there is no sign and if there is nothing saying Hold on, let me finish and then you can talk. That's how this works. Go ahead. >> Okay. So, if there is no sign saying that I [music] can't be here, this is a public >> facility. I'm telling you, I've done this at Suffach County Police Headquarters. I've done it in places much bigger. Great. Much bigger than this department I've been at. >> And they have not arrested me. Do you know why, Sergeant? >> I have no idea. I don't know. Police Department. >> Okay. But can I tell you why they didn't arrest me? Please do. >> Because I'm not breaking the law. And you'd be making a very big mistake, Sergeant. I'm like, big mistake. Okay. >> Second of all, >> touching me was your first big mistake. >> You weren't cooperating. And you were breaking the law. >> No, I was not. You're again, you're lying. I'm not breaking the law. I can walk wherever I want. >> Not if I advise you otherwise. I'm the author figure of this property. And I'm telling you, unless right now, this is private property past this point, which I explained to you over there. Correct. Thank you cuz I did the same to you. >> Okay. >> Right. Now, I told you this area entrance to this area is open to all public. >> Correct. Did I not tell you that? >> Okay. >> We can review the film if you'd like. Over there is not. I advise you multiple times of that. You were not cooperating. And then you're interfering >> with an aided investigation where somebody >> I'm not inter I'm not interfering with any investigation. No, I was not in private. Yes, you are. >> No, I wasn't. This is permitted there. You were not. Very simple. Sir, I'm I'm gonna tell you I'm gonna tell you right now before you make a mistake. I'm performing a first being arrested. What I'm telling you is what happened. >> Okay? I'm gonna tell you why I'm here. Ready? I'm performing a first I'm telling you I'm here. >> I'm performing a First Amendment >> protected activity. An internal report that outraged the community and a statement that left thousands of viewers furious. What really happened behind closed doors? >> Sign there, whatever. And you can't physically remove, you can't touch, you can't touch a private citizen. You can say, "Hey, listen. You're not supposed to be back here. I don't know if you saw the sign, sir, but you're not supposed to be back here. I need you to leave." And then if I refuse to leave, then okay, you can use it. You can trespass me and arrest me and do whatever you need to do. But the first action of a police officer, a public servant, should not be to physically remove a journalist from the property who's working on a story which is protected by the First Amendment. So, this is exactly what I'm trying to explain to you that the signs really doesn't mean anything to me. I mean, I'm sure you're going to put up signs. I'm sure you're going to put up a bunch of signs now. Great. But that doesn't mean anything to me. What's important to me is the officer's actions here today, which were completely unacceptable. >> Sergeants, [music] and he's a supervisor as well. He should know better. So, >> I'll look into your complaint, Mr. >> Great. >> I'll get back to you. >> Great. Thank you. I'll be following back up with you. >> Have a good day. See me again soon. >> You can do the flow request online if you want. >> Great. No, I'm going to actually go grab the uh I'm going to go grab the uh >> I'll give you the form >> the form and I could just bring it to this records window here. >> Yeah. I want to right now. >> Okay. I'll come back. >> Now, can I is is there going to be a incident number or a um is there is there going to be something associated with this so that >> Okay. And how am I going to get that? You can give me a ring and you're going to let me know. >> Okay. I'll be back. So, you know, maybe you can give it to me then, but I'm going to need that number. Yeah. >> So, so I can across the uh the actual complaint and what you're putting in it and stuff like that. Like I said, you'll see the video. If not, I'll come back with it, but I'm pretty sure you'll see it. So, I I appreciate you looking into this for me and um doing your job and upholding your to the Constitution. >> All right. Have a good day. >> Thanks. You too. >> Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The journalist asserts that this is a case of lack of transparency, abuse of power, and corruption in the internal investigations of the police force. Up next, just minutes after stepping into the post office, a fiery confrontation erupted. What caused everything to spiral into chaos. >> Mistake, you should call your supervisor. >> Stop. But there are certain things we're allowed to do in the federal building. But we have the video cuz we have people's personal information. You know, we of course they have our machines here out there. A couple of the customers basically told him like, you know, stop, stop filming, get away. He's like, he's like, I have the right. Because you don't have is when you're in public because you have to make sure you know that he's one of these live stream people's personal information packages. So >> sir, who do I have the luxury of talking with today? >> Oh, my name is Sean. Sean what? >> He was uh >> just just Sean. >> No, you don't have a last name. >> It's just Sean. >> So, no one gave you a surname when you were born? >> It's just Sean. >> It's just Sean. So, you want to know my information, but you don't want to share yours with me? >> Okay. So, um >> yeah, in a minute. I'm busy right now. >> Crowd's 3834. >> Okay. >> All right. All right, we'll deal with you in a minute. >> So, did he did you deal with him as well? >> Is he dealing with him? >> Heated arguments and repeated orders to leave echoed through the air. And then the appearance of the police marked the beginning of a highly controversial turn of events. >> Going to arrest me if I don't leave. >> Yes. >> Can I speak to a supervisor, please? >> You're under arrest. We should have supervised her, please. >> You put in my pocket. >> You're making a big mistake here. Sorry. >> Yeah. You're making a big mistake here. >> You were told to leave several times. >> No, this is federal property. >> You were told to leave. >> You have no jurisdiction. >> You have no jurisdiction here. >> I just got You want me to show you the case law I just made? You have no jurisdiction here. Big mistake. Just hang a lot of money. Should have worked for a supervisor. Been smart. Supervisor told me to watch now. Okay. So now what? Well, then he's stupid as well. >> Ma'am, you should look at your rules and regulations governing conduct on Facebook. You should look at it and newspapers are permitted in the lobby's voyage. >> You put these cuffs on tight. >> Can you get her information? >> What am I being arrested for? >> What am I being arrested for? >> Failure to failure to obey. >> Yep. Sorry to b the call disturbance. >> Calls a disturbance. >> There was nobody in there. You removed everybody. What am I being arrested for since you put the handcuffs on me? >> So, you don't even know who put the handcuffs on. >> What What are you What am I being arrested for, sir? >> Actually, >> maybe it's right. Maybe it's trespassing. That's right. Cuz he told you. >> Do you not know? Do you not know what you're right? >> I'll know. And you'll know when you get your charging documents. Try not to see. >> Can you listen to these? Well, if you hadn't resisted when we put them on. >> Resisted. >> You did. >> The fateful moment arrived. The cold clink of handcuffs echoed. But was this truly a lawful action? >> And everyone in there, all three of them told him to stop. And the lady in the corner would slam the door on. She didn't stop. everybody. >> I'm going to get uh the male's name in there and just give this to you. >> Okay, that's why and right things that they >> So came in probably around maybe 1:00 110 somewhere in that range >> came in. Oh, >> I started videotaping. So, you know, I know there are certain parameters they are allowed to do certain things. So, at first it didn't really say anything. Came around the corner with the lady who does the uh passports came out and she was like and she was doing something. He was videaping signs and signage. She's like, "Are you can I help you doing this?" She's like, "No." He was she need to stop cuz I don't know I don't want to be on your video or be whatever else. She's like, "I have the right." He started trying to quote the whole federal law about that. We've all seen her on YouTube or anywhere else. You know, wants wants attention. Look at me. >> Stop. So he wouldn't stop. Of course I know I saw a couple of ladies, the customers did go away and even they came to me and were like, "Yeah, we told him stop or like go away." And um that's kind of what he asked me earlier. Did anybody I said, "Yeah, dude." I was like, you know, people came up, the customers were asking me to stop. They're like, you know, and um for me it wasn't an issue cuz I've seen certain things and they try to point what they can do. Once he came up here though, of course, we have people's packages. We have the change of addresses that we have, other information plus our pin pads, and so on so forth. unexpected testimonies from the witnesses, but there was something contradictory in the story that few noticed at the time. >> And this is supervisor. She called the police to tell him to leave. So they all three told him to leave. >> Okay. So is she here or is she not here? >> She's here. >> She's here. So she was there and she advised the supervisor advised these three employees to tell them to leave. Okay. So they each told him to leave and he advised and what did he say? >> He just he has the right to be here. going in the malls. >> So my question to you is that what do I got him for? Trespassing. >> Trespassing. >> And this lady was putting in passports like put them in boxes. >> Uhhuh. >> And he was still videoing. She's like, "You need to leave." Because at that point he was crossing the line because it's people's information. >> Oh, okay. >> On video cuz they didn't know his capability of >> the question is was he video and audio? So, you know, hit him with uh wiretapping. Well, you know he was because he was asking us questions to get us answering. So, you know, >> so I don't know if he used his phone as evidence or not. >> I don't know. >> So, um, what's this number? >> These are numbers that we have to get a hold of them. >> Okay. So, this is their So, these are the witnesses and the address here is 20 whatever it is. Okay. And what's this? >> You can 1300 video. >> Okay. And as the truth slowly came to light, the accusations collapsed, leading to a federal lawsuit that could shake the entire police department. The incident became evidence of abuse of power, ignorance of the law by some officers, and even witnesses voluntarily giving false testimony. Next, a man is pulled over by the police in the middle of the night. He refuses to answer a few simple questions, and things start to escalate. what causes both sides to almost explode. >> But more or less, you're here because of the failure to maintain lane and he's not answering if he drank. >> You have the right to remain silent. But what happens when you actually exercise that right? In this video, a routine traffic stop turns into a legal battle right on the street. >> Officer Adams, Holly Springs. Uh the reason I'm out here is because of the observed driving behavior and everything else. Uh, I I specialize in in doing DUI investigations. So, I got a couple of questions for you. >> Okay. I'm not going to answer any of them. >> Okay. So, do you just want to go to Joe? >> No. >> Okay. So, >> I just don't have any obligation to answer any questions. >> So, I'm going to ask you anyway. Have you been drinking tonight? >> I'm not going to answer any of your questions. >> Okay. Uh, are you willing to do some field sobriety evaluations? >> Absolutely not. Most people fail those sober. >> All right. So, you know what we're getting ready to do? >> No. I'm getting ready to place you under arrest for DUI and I'm going to read your implied consent. We'll just go ahead and take you on up and get a blood drawn. >> I'll do a breathalyzer. >> You want to do do a breathalyzer? >> Yeah, I'll do that. >> Okay. >> But I'm just not doing the test because most people fail those sober. >> I've tried them sober. >> Actually, you want to know something? I just did a set not uh right down the street and uh dude didn't go to jail. They're scientifically proven. And you know why you can't prove them? Because you can't control one of them. I know people I I know people Oh, thanks. Are you recording me? Yes, sir. Okay. Thank you. I know pe I'm recording you, so it's fine. I know people believe that they know what they're talking about, but they're not. If you haven't been drinking, there should be absolutely no problem. Uh, >> all right. So, you're going to step out for me >> to do breathalyzer? >> Yeah. If that's the one that you want to do, sure. >> Yeah. I'm not going to do the put up. >> Polite, cooperative driver was still forced into a situation that could have led to an arrest. This is a prime example of the fine line between civil rights and police power. >> Got any weapons on you? >> No, sir. >> Go ahead and step toward the front of his vehicle and just shut your door so nobody takes off your door. >> Turn around and face your vehicle. Have you ever done one of these before? So, you're not familiar with the procedure? All right. So, what you're going to do is you're going to take a deep breath, going to put your lips around the tube like, you know, and seal it. You're going to blow out like you're trying to blow up a balloon. Strong and steady. Blow, blow, blow, blow, blow, blow, blow, blow, blow, blow, blow, blow. You definitely have had a little bit of alcohol tonight, but we already know that, don't we? Are you uh where you shouldn't be driving? Probably not. >> I know that. Otherwise, I wouldn't be driving. >> Well, I'm glad that you know that. But with the presence of alcohol and the observed driving behaviors, we can't recommend that you continue driving your vehicle. You see what I'm saying? This is not about you going to jail. This is making sure that you're safe. According to the uh observed behavior that Officer Stabber saw, you almost ended up in a ditch. >> Would you like me to go pull the video? >> Sure, we can go. Can a simple decision to refuse a few checks get you charged with a crime? The story below raises big questions about the process and ethics of law enforcement. >> Happy to do the breathalyzer. And I mean, yeah, I agree. >> So, based on what you know about everything else, you should also know that this isn't admissible. It's not admissible in court. This value doesn't stand up. You know why? >> Because it there there's factors that uh can create problem. The only real way to find out what your alcohol content is is to do the statement. You see what I'm saying? >> Yeah. >> So, what I'm telling you is is is there's more to it than what you believe. Okay. >> Right now, I'm just trying to be informed. >> Okay. Uh uh whatever officer Saber wants to do at this point, especially I can tell you that you are close enough to the legal limit for me to warrant not allowing you to drive. But I can't >> I wouldn't drive if I wasn't. I'm I'm glad that you believe that, but your insistence to me, I'm sorry, isn't enough to make me feel better about that. Your abilities that you believe aren't good enough for me. I need physical proof. It's like what you're talking about yourself. See what I'm saying? >> Yeah. >> So, what you believe is irrelevant. What I can prove is I can prove that you're capable, but your behavior does. You see what I'm saying? That's what Okay. So, But as long as he's good with it, you can hop back in your vehicle. Uh, and I'm sure he's going to have to pay for it for you. >> When the cameras turn on, the truth gradually comes out. But what shocks you is not how people behave, but how the police handle this incident. >> On the bottom are going to be your two copies. >> My name, my badge number is on the actual citation. And >> Adam's put on the wrong I can rewrite his name and badge number on your copy. I don't know why he put it on my copy >> cuz he's the one who came up with nothing. >> I'm glad you guys are body cam. >> I mean, a lot of the stuff is not only to protect us or not to protect you, but protect us. It goes both ways. So, yeah, >> people say some crazy stuff like they're getting hit or something. It's like, nope. >> I hear you. Here you are, brother. I mean, and in all honesty, none of this crap is personal and and having him involved with this, it's just it's there's indicators. So, first and foremost, the failure to maintain lane is one of the biggest red flags of, "Hey, [music] this guy could be drinking." Number two, if someone comes around and says, "When I ask, have you been drinking?" It's your right. You don't have to answer him 100%. And I get that. >> No, nobody should answer questions. In my personal opinion, you got your job. >> No, that's that's 100% fair. It's it's the the the balance of authority and power and the person who's here is scared or intimidated >> and and you know that that is what it is to where we we are authority to where our presence alone gives fear to some people and some people abuse that and I'm not going to lie. Um I would hope to say I don't and I I don't want anybody to do that but >> No, that's never a personal thing. It's just the the lights and the bad. I got you. And it's just people. >> It's just sometimes in a combination of the stop and the questions, it raises red flags. In >> the US state of Georgia, police abuse of power can be dealt with in several legal forms. Abuse of public office OCPSS November 4th 45 can be charged as a misdemeanor and result in removal from office if convicted. In the end, the driver was given his papers and was only issued a ticket for failing to keep in his lane. The license plate light was verbally warned because it was present but too dim. No arrests or prosecutions were made. The case illustrates a legal reality that needs to be monitored. The right to remain silent and to refuse [music] to cooperate cannot be assumed to be suspect. This is a wake-up call for society. Freedom and human dignity can be violated at any moment if we remain indifferent. Hey everyone, what do you think about this situation?
