Well, we're doing a filming a video for YouTube. >> You guys are on the sidewalk or on businesses? >> Uh, do you guys have your IDs on you guys? >> I don't. >> You don't? Do you have a Utah ID? >> No, I don't. Sir, see that see that pole down there? That pole has a no parking sign on it. >> Okay. >> This pole has no parking There's no parking in there to there. >> Okay. >> So. >> Can I take a picture of >> What's your name? >> Just because of a camera on the sidewalk, the police showed up and immediately demanded ID. But they didn't realize the man standing in front of them understood the law better than they expected. >> Okay. Do you have any form of ID on you? >> I don't. Nope. What would you need ID for? >> This is just so I can interact with you guys as I'm figuring stuff out. >> you. Well, I'm happy to >> Have I broken any laws? >> You're fine. I'm just asking. >> Am I being detained? >> No. >> Okay. I don't I don't choose to answer. >> Okay. I don't even know who you are. >> I'm in a public space. >> When police demand identification without a lawful reason, the situation can quickly turn into a costly lesson about civil rights and the responsibilities of law enforcement. Simply standing on the sidewalk recording video, the two men had no idea that just minutes later the entire bank would be in an uproar. An employee stepped outside citing a no filming policy, but what happened next quickly pushed the situation out of control. >> There's a show Secret Lives of Mormon Wives. I don't know if you've ever heard of that. >> I have. >> Well, one of the girls that just moved in the house across from me, and so I was I thought maybe she was going to come out of that lingerie and I thought maybe she >> Oh, I got you. Right on. >> for the bank? Okay. Yeah, we just can't have you video in the bank and the customers. You don't have a shooting in the bank? >> Yeah. We just have a policy against photography that's not produced by our bank. >> I'm just walking to you have a What was the issue? >> So, I just can't >> I'm just going to go over here so I don't I can hear you. >> like filming our our branch. >> There's an issue with us filming the branch? >> Yeah, cuz we have customers pulling up. So, we can't have you like filming >> I'll be honest with you. I was just saying to him it's Friday afternoon. I haven't seen one customer pull up. >> Yeah. >> You figure that would the place you know people cashing their checks and >> Yeah. >> Haven't seen one Well, actually when we first got here there was a lady at the last aisle, [music] the last lane. She left and I haven't seen another person since. >> Yeah, a lot of people get direct deposit now. >> I figured. Yeah, yeah, that's what it is. So, you got to come up with a better one than the customer excuse then that means. >> we just have a policy against photography that isn't direct marketing. >> Sure, inside the bank. >> Well, and just outside where we have people coming up. So, I can't >> So, you have a I just want to be clear. I'm trying to understand. So, you have a policy the bank has a policy >> Uh-huh. >> that we're not allowed to film the bank from outside from the sidewalk? >> Not where our customers are coming in. >> How do How do you enforce that? >> We just do our best to try to stop it. Yeah. So, I can give you the name of our marketing director if you want to call him. >> Well, I don't want to do any marketing for the bank. Yeah, no, I'm not. I don't want to do that. But I mean I understand I'm not I have zero intention to go inside. >> The arguments about filming outside the bank seemed to calm down for a moment, but the tension was still there. When another person stepped out from inside with a much firmer attitude, the atmosphere immediately changed. >> Hello. >> Hello. >> What are you guys doing? You're just filming? >> Just filming. >> Okay. >> Same as you. >> I know. >> Yeah. >> But >> Here, you want to show me Yeah, yeah, let me give you a show without my sunglasses. You to the full face. That way the facial recognition will work for you. >> Yes. >> What seriously? Well, I'm just giving you a hard time. What's the issue with being out here filming? >> I don't know. Just >> I mean, is there one I should ask? I just because the other lady said there was, maybe there's not. I don't know. >> I I guess there is. They're They're just checking and >> And just to be sure you work for the bank, right? >> I I I >> want to be talking to a customer here. >> No, I work for the bank. >> Okay, yeah. >> They're just, you know, they don't want customers to feel uncomfortable and I don't know what policy >> Well, see, we're we're we're we're we're reaching for the same goal on opposite sides of the fence. I don't want your customer customers to feel uncomfortable, either. >> Okay. >> But, not at the cost of my ability to be out in public taking pictures. >> It's true public. I don't know if this >> Like I wouldn't go inside the bank, sure. I'm standing on the sidewalk. It's a public sidewalk. >> It is public sidewalk. >> So, and you remember when we were kids, you're a lot younger than I am, but [laughter] people used to jump in front of the camera and say, "Hi, Mom." and wave, "I want to be on the TV." and all that kind of stuff. >> Yes. >> I I want to get back to that, man. What's the It's not a dangerous thing. It can't hurt you. The only way the camera can hurt you is if you do something foolish to hurt yourself. >> That's true. >> Right? Or you can make yourself look fantastic. >> That's true. >> It's completely up to you. >> Yeah. >> Right? And I don't know. I haven't This is only the second customer I've seen since we've been here. Which is uh surprising on a Friday afternoon. >> Yes. >> You figure they'd be coming in and uh looking at cashing those checks, you know? >> [laughter] >> I can The one thing I can assure you is there's nothing nefarious going on. >> Okay. >> We're not looking to cause any problems for the bank. But, like I said, I don't want to inconvenience anybody else, but I don't want to be inconvenienced, either. >> True. True. I get it. You don't >> Yeah, we just all get along type of thing. >> Right. And I don't know what security things it all involves and >> You know, all I can tell you is there's a lot of things that people do out on the street without getting specific that I'm not really a fan of, but I don't ask them not to do it, you know, they can you know, it is what it is. >> Me, too. >> So. >> The argument outside the bank grew increasingly tense as the manager became impatient with the camera. The back and forth turned sharper and it was clear this was no longer just a simple disagreement. Just minutes later, a new development unfolded as the police were called to the scene. >> Hello. >> Oh, no, you're good. You're not interrupting at all. I can tell from your smile we were in good shape when you got here. >> I was the one that called. >> Oh, I'm in the middle of a conversation. If you could just give us a second, please. >> See, this is the ass that I'm dealing with. >> So, all right. Can I ask what you guys are >> Well, we're doing a filming a video for YouTube. >> Okay. >> Filming a travel video for YouTube. >> You guys are on the sidewalk or on businesses? >> Yes, ma'am. >> Okay. Uh, do you guys have your IDs on you by chance? >> You don't? Do you have a Utah ID? >> No, I don't. >> Okay. Do you have any form of ID on you? >> I don't. Nope. What would you need ID for? >> This is just so I can interact with you guys as I'm figuring out >> I got you. Well, I'm happy to talk to you and I'm happy to tell you whatever you need to know. >> Okay. >> feel like I've broken the law or even given any indication that I've broken the law. So, I don't know. >> Yeah. So, you're you're totally able to film on the sidewalk? >> Up at the corner. Yeah, like I said, I don't want to give you a hard time. I just you know >> that. >> If I'm I'll follow any lawful directives you give me. >> Thank you. If you guys would mind just hanging out here for a second, I'll just go chat with him inside. >> Absolutely. >> I'll be right back with >> it. Yeah. How do you do, Officer Savage? >> Howdy. >> Howdy. Right on. How you doing today? >> Doing well. Busy. How about you? >> Not busy. It's a very quiet town. I'm surprised for a Friday afternoon. Friday evening, I guess, at this point. >> This is quiet? >> It seems like it. There's not really a lot going on, you know, not a lot of customers in and out of We're making a travel video for YouTube. >> Okay. >> So, I like to get people coming in and out of the businesses and you know, it just makes it more more interesting than a building sitting there by itself with nothing going on. >> Yeah? >> So. That's what I mean by quiet. Not a lot of in and out going on. >> Not a lot of foot traffic. >> Not a lot of foot traffic. That's the word, yep. >> Sure. >> That's why I keep him around. He's smarter, younger, and better looking. >> How long you guys been doing this? >> Today or in general? >> Both. >> Uh 6 years. >> Do you like it? >> I love it. Yeah, yeah. This is my son. >> Okay, nice. >> And we get to travel around the country. We travel full-time. We go to different towns and cities and places all across the country, make videos, and make >> The conversation with the police seemed fairly routine as the cameraman explained why they were there. But when the discussion shifted to what had happened earlier with the bank staff, the atmosphere quickly changed. Just minutes later, a statement from the police made the situation even more tense. >> Carry your camera around long enough, somebody gets upset that you're filming. >> Yeah. I don't know if anything else has happened, but >> That's it. That's the whole big exciting story. They just didn't want I don't know what they're We walked up and he came out and said, "Can I help you with anything?" And I said, "No, I'm good." He said, "Oh, okay." And he went back in the store. >> Okay. Well, it sounds like earlier you guys were over by Alta Bank and they asked you to leave and you guys refused to. >> They asked me to leave where? >> To leave their premises. >> We weren't on their property. Never Never stepped foot on their property. Like I said, I've been doing this for 6 years. I'm not looking to get myself in trouble. Just making a little YouTube making videos >> for YouTube, yeah. >> Okay. >> But we never went on their property. >> Okay. Well, we're going to look into everything and make sure that everything's good before we get everybody out of here. >> Sounds good. >> You guys want You're welcome to take a seat. >> I don't know. So, what am I being detained? >> Right now, yes. >> Oh, I am? I'm being detained? Oh, okay. >> Yes, you guys are both detained. >> Okay. Nobody told me that. >> Okay. Well, logically when the cops come up and start chatting with you, >> No, I have plenty of very nice conversations with cops where I'm not being detained. >> Okay. And well, hopefully this stays a nice conversation, right? I don't intend >> I don't know, that's up to you. That's up to you. >> It's also up to you though. >> No, it's not. I'm I've been very cordial and respectful with you in the second you got here. That's not That's not going to change. >> Okay, perfect. That's all I'm asking. >> I haven't broken the law. >> And we'll find that out. >> Yeah. Did So what, did Outback tell you I was on their property? >> We She's looking into this. I'm just here to back her up. >> Okay. >> So. Where'd you guys get your drinks from? Anyway, we're good? >> I'm being detained, so you now you made it kind of difficult to have a conversation with you, you >> It's just a conversation, man. >> So how we doing? >> We're doing good. As I explained to him, you guys are able to film on the sidewalk, but his only concern was just like it's his business. He don't know why you guys were getting close up to the mirrors, so that's what he was trying to figure out. But they're going to keep doing their own thing. They've just asked that you don't touch their glass anymore. >> I haven't touched their glass once. >> Okay. Well, yeah, so you're going to be on the sidewalk, but they just don't want you coming into the building. >> Oh no, I wouldn't go inside without permission. I wouldn't go go in there. >> [music] >> Everything seemed to be slowly clearing up as the police reviewed the entire situation, but as the truth began to emerge and everyone started to understand what had really happened, the situation quickly shifted in another direction and the reactions that followed were what truly caught people's attention. >> Did they tell you that I was on their property? >> Honestly, I talked to them for 2 seconds. They said that you guys had called by that time and then that's when we got the second call from here. >> I'm just concerned if they told you we're on the property because I was not. And I start filming the second I get out of my vehicle and I don't turn it off till I get back in my vehicle. >> Okay. >> So it's just It's concern Like I understand if somebody's got a legitimate concern about something and you feel like you need to call law enforcement, you do that because that's what you're there for and you Um but if you have to start embellishing and making things up to make the story more interesting to law enforcement, you might want to start questioning why you're calling them. >> Yeah. >> You know what I mean? Cuz it wastes your time, it's a waste of resources. There's an accident up the street, there's other things going on, and couple of guys out on the sidewalk taking pictures. You know, I'm from another world, man. I'm 55 years old. >> Yeah. >> And this is a new thing that people are afraid of cameras. You know, last 10, 15, 20 years, whatever it is. >> It's the same thing. People see these fancy cameras and they freak out. >> But now, you know, it's a good thing. I don't like people to call the cops on me. But now, you've had the conversation with him. He understands that what I'm doing is lawful. He I'm sure in his own mind realizes he embellished the story to you a little bit. Which Is your body cam on? >> [music] >> Yes, sir. >> Okay. Cuz I'm going to request a copy of it so I can get to see what he told you. I'm just curious because part of what I'm doing out here is trying to acclimate people to the fact that some people are out taking pictures and just enjoying their lives on nefarious intent, just enjoying a beautiful day. You know? So, if he gets that now, I feel like I did something today. And I really do appreciate you being professional and knowing the way things work and going that route, and I thank you for that. >> Well, it was a pleasure to meet you both. >> Same here. >> I hope you enjoy the rest of your filming. Please stay safe. I guess >> So, am I Am I no longer I'm sorry, am I no longer being detained? >> Oh, yeah, of course. You're free to leave at any time. >> Okay. >> Um I just my biggest recommendation to avoid us being called out again, I I don't know if they asked you to leave. I don't think the bank asked you to >> Oh, he definitely asked me to leave. He asked me to leave the sidewalk. >> Oh. >> But then he said he was calling you, so I figured I might as well stick around and watch you have to leave. >> No crime had been committed, and the call from the bank was simply the result of a misunderstanding and unnecessary concern. The earlier tense confrontation gradually came to an end as the police left, and the two cameramen continued with their filming. Up next, a man was simply standing outside the post office, and a car blocking the handicap access ramp prompted the cameraman to start recording the situation. But just minutes later, that simple act of filming began to attract attention from people around him. >> What do you think? You're parked in a crosswalk. I'm handicapped. I can't even use the ramp. I have two hip replacements. And and and and what You just want to park in a handicap? Thank you. I appreciate it. Now the handicap wheelchairs can use the ramp. You want to smile? We can take one together. Okay. Thank you, ma'am. >> The presence of the camera quickly caught the attention of people inside the building. Just minutes later, someone from the post office stepped outside to question the filming, beginning a conversation that soon started to grow more tense. >> What are you doing here? What am I doing here? I'm filming. What are you doing today? I'm in public. What? I said I'm in public sidewalk. You're not allowed to stop people and film them right now. No. No, sir. I can I can record anything I want from a public space and I map says this is public space. He's been all the way to here, so I do not have to stop recording. All right, are you >> today? I'm a I'm law enforcement. >> That's okay. >> So, what's your purpose today? >> Filming. >> For >> What's your name? >> To what? >> What's your name? >> I'm not giving my name, sir. >> It's right there, Mark. >> Oh, good. You got it. >> Do you have a badge number? If you say you're law enforcement, I'd like a badge number. It's policy. That that that Okay? >> Here's a badge. >> So, you're you're postal inspector. >> Correct. >> Okay, well, go inspect me if I get on postal property. Other than that, I'm on public property. >> property. >> So, what? >> So >> I'm asking you, so what? I mean, what is there a law against it? >> I'm asking you what you're doing. >> I'm I'm just I'm filming. >> You're scaring our employees with what you're doing. >> Well, actually, I came down here to get all these violators. No parking from there to there and here we are. >> Okay. >> Postal property's right here. >> Okay. >> Show me show show So, show me where I can't film postal property or postal employee. I can show you where I can. >> I didn't say you couldn't film. >> Are you armed? >> Huh? >> Are you armed? >> I'm going to reach in my back pocket. I don't want keys, shot from a distance, shot from close range, or tackled. Okay? I'm going to reach in my pocket and get a piece of paper, all right? >> Okay, sure. >> Back pocket. Department of Homeland Security issued this in 2010. >> Mhm. >> Said I can take pictures of any federal building from public property and I believe I'm on public property. Do you want to see it? Or do you know it? >> I don't need to see it. >> Do you know it? >> I don't need to see it. >> Do you know the policy? >> I don't I'm not under Homeland Security. >> It doesn't matter. It says I can record any federal building. >> Okay. >> Okay. So, thank you very much for your time. You're dismissed. >> After being questioned about filming, the man immediately stated that he was standing in a public area and had every right to record. However, the conversation didn't end there as more people began paying attention to the situation and the atmosphere outside the post office gradually grew more tense. >> How you doing? >> Good. How are you doing? >> Very good. >> I got a call from a concerned citizen. Just wondering what you're doing. >> Filming the post office. And actually, if you come with me for a second, see this this step right here on this block. These cars here are illegally parked. That one was actually blocking the crosswalk. I'm a handicap, and I couldn't even use the ramp to get across the street. >> Um >> The Cadillac. I've got it all on digital recording. It's not now. It moved. >> blocking >> It was until they moved. >> Okay. >> So so and then But you're in a no parking zone. >> I'm down there. That's why I'm here. >> Okay, if you go to >> The parking zone is right here by this sign that says that >> Okay, sir. Sir, see that see that pole down there? That pole has a no parking sign on it. This pole has no parking It's no parking from there to there. So Am I required by law to give you my name? Have I broken any laws? >> I'm just asking. >> Am I being detained? >> No. >> Okay. I don't I don't choose to answer. >> I don't even know who you are. >> I'm in a public space, ma'am. >> And you don't need to be taking my picture. >> It doesn't matter. You're in a public space. It doesn't matter. I'm in a I'm in a public space. That's right. You're getting educated today. >> If I get something from the mail >> Well, he has no way at this point to have any other information from your driver from your license plate. He is in a public place. He is not doing anything illegal. So as concerning as it may be, he's legally allowed to do it. >> Yeah, I'm I'm a handicap, too. What's the difference? See? You had to come here to take my >> I didn't say anything about you. I said this lady was blocking Actually, she actually came out and moved while you were sitting there. >> Yeah, I see that. >> Okay, if lady was blocking Actually, she actually came out and moved while you were sitting there. Okay, if lady was blocking Actually, she actually came out and moved while you were sitting there. >> Yeah, I see that. >> Okay, it's because she was blocking the crosswalk. >> I know what I do. But I know that sign says no parking. That's why I parked there. But but there's another no parking sign strapped to it. There there it's I'll check with IMAP. This is all public sidewalk and there's no parking from there to there. But but yet there's two park There were actually three, the other gentleman left. So I mean I mean if you can get out your ticket book and take care of this. I mean as a concerned citizen, I don't understand why I can't park here but other people feel that they can. I I I really would appreciate it cuz you see it now. So if you got a ticket book, I I would appreciate you doing your job. >> As questions kept coming about the purpose of the filming, the man maintained that he was simply exercising his rights in a public space. But the presence of the camera made many people uneasy and just minutes later the situation began to draw the attention of the police. We're talking about a parking violation. >> Correct. >> It is not a through street. >> For who? For the For the postal employees? Yeah, for for I mean but they're my employees. >> Well, that's understandable but they're not the ones who are complaining about it. >> Right, I am. I'm complaining for them. They don't want to lose their jobs. But you know, there was another guy who double parked out here and then there were postal employees who couldn't even get to work. >> I understand that and that would be more of an issue. >> Well, he was he was >> people who are picking up kids from the school >> Right. >> and they do not have adequate parking [music] to facilitate all of the vehicles. So it's a very temporary issue right now. >> But you can tell that to the meter maid that works downtown. She'll ticket you for anything. >> Just do your job. >> Good citizen? >> Good citizen. What we're talking about [music] in the grand scheme of things a very a very small issue, correct? >> Correct. >> That you are creating a very big deal about. >> No, I didn't create any You came to me. I didn't call you. I I ask you to come out. But now that you're here I'm addressing issues with you. >> Would you have been the attention of at least two if not three different citizens >> Okay. >> who were alarmed by your presence and your activity >> But >> that have called us, which is why now I'm here. >> But but my rights don't end where their fears begin. >> Well, I understand. >> Okay. >> And I've explained that. >> Okay. >> But I'm just saying that's the reason why I'm here. But as you have created a spectacle >> No, you showed up to me. He came out to me. She came up to me. Right? I'm [music] just sitting here doing what I need to do. >> But they're not normal. >> No, they're they're perfectly constitutional. [music] >> They're constitutional, but they're beyond normal. >> But they're const- >> No violation was found and the cameraman continued with his work. But this brief confrontation made many people reflect on the right to film in public. Citizens can sue police under Section [music] 1983 when their rights are violated. Officers who break the law may face financial liability, [music] disciplinary action, or even termination. A civilized society is built not only on laws, but also on understanding, mutual respect, and a willingness to engage in dialogue rather than confrontation.
