Fine. >> Hey, let me ask you a question. When you When you come out at people When you come out at people automatically [music] aggressively and stand real close like this >> Standing outside the doorway, never stepping into the courtroom, yet the citizen [music] was accused of obstruction and faced the threat of handcuffs. Could such a reason truly stand in court? [music] >> If you really want to go to jail today, it's not worth it. >> How are you going to take me to jail for standing outside recording? You said we couldn't record. I'm not in there. >> Okay, would you like to listen to me? >> No, not really. I'm very I'm very productive. I just want to see change with the police. I don't want police like [music] you coming up smashing on people like you just tried to and then threatening to arrest us, threatening [music] to arrest us cuz we're standing outside recording now. Tell me what law I violated. Tell me what law I violated. Yeah? I'm violating the rules of the court standing outside recording. I'm standing outside recording. I'm violating the rules of the court. How? How am I interfering? People are coming and going. People are coming and going. [music] You think that's going to hold up in court? Come on. My lawyers will smash that. That's not going to hold up. People are coming and going. There's a gap. [music] You were blocking the doorway. I was not. Why are you even still here talking to me? You should go. Go back to work. All right, you're dismissed. You're good. You're good. It's your It's your first day. It's your first day. You want to get fired on your first [music] day? You should stop. You should You should be smart. >> The citizen struck back forcefully, forcing the rookie officer to face an uncomfortable truth. Public servants are not [music] the masters. >> Take away the badge, take away the gun, and you're probably a coward. All right? [music] So, knock the tough guy [ __ ] off. You should have You should have came out just [music] asked us respectfully to leave. You should have came out asked us respectfully to leave. We probably would have left. We just had questions, and you're over here trying to run us out the door. But, that's what you're here for. That's what you're here for. If we don't see it, we didn't see it, we didn't notice it. That's what you're here for. You got to answer those questions, right? You're [music] not just to be a dick. What's your highest grade education? Come on, Mr. Mr. First Day. This is This is This What's your name? Douchebag? What is it? Did you Did you All right, guys. This is This is the little mini cop tough guy >> [music] >> something d e b first day Kern County. [music] This guy is just wild, guys. All right? I don't know why he acts like this. Why act like this? Why not just Why not just talk with [music] us? You're like a little kid. How old are you? Are you old enough to be a cop? Are you a real cop? >> [music] >> Be honest. Come on, man. It's like automatic. You try [music] to use that fear factor, but you're not going to scare anybody. Nobody's afraid of you. >> I am just trying to get you to comply with the law. Get out of here. >> [music] >> Exactly. I'm trying to talk to this guy. This guy's ego is huge. >> [music] >> Hey, hey, you're blocking the doorway, bud. Let people out. >> What's wrong with you? >> Yeah, yeah. >> If you were my son, if you were my son, I'd smack your ass. >> Only when the demand for a higher supervisor was met did the truth come to light. This was not just a minor clash, but a lesson in [music] arrogance, power, and the cost of ignorance of the law. >> Eric, can you call for a supervisor? Go get me that. Go >> There you go. 5 minutes [ __ ] later. Jesus Christ. [music] >> You finally understand that you know I'm right. >> Now, what we're going to do with your sergeant is address your behavior. Holy [ __ ] I knew what was going on when he said it was his first [music] day. Holy [ __ ] All right, guys. That was a Kern County Sheriff, man. Uh interesting day out here in Kern County. [music] It's crazy. I mean, it was like a simple question, and he was ready to [ __ ] tackle me, bro. I'm just asking you a question. [music] Is it in the hallways or is it everywhere? >> a simple question. >> We got a little first day on the job cop who's talking about going to jail [music] and all kind of stuff. Um you know, we had a couple questions for him. >> [music] >> It was no problem to go outside. Gladly go outside, but you're not going to be an [ __ ] Up. You guys see the San [music] Joaquin Valley going in to ask um where the sergeant is, you know. Where is the sergeant at? >> [music] >> Well, that was a That was a wild video right there, guys. That guy was immediate. You couldn't [music] even get a word out. Ask a question, he start freaking out. Talking about [music] going to jail and wanting to arrest people. He got about uh I don't know, 3 in from [music] me. >> In the state of California, police officers who threaten baseless arrests and obstruct [music] the right to record in public may face internal complaints, administrative discipline, civil lawsuits under 42 U.S.C. [music] S 1983, and even criminal prosecution in cases of serious [music] violations. Acts of threatening baseless arrests, abusing power, and obstructing the right to record in public can lead to internal complaints and civil lawsuits under 42 U.S.C. SS 1983. Up next, an officer suddenly stepped in, blocking the camera's view. Is this protecting security or an attempt [music] to conceal the truth? >> You're moving in front of my camera as much as you as possible. Are you trying to block my pictures? Answer me. Trying to block me from taking pictures. That license plate. Hey, don't block me. Don't block me. Don't block me. You can't block me. It's against the law. You know that's against the law. >> All right. >> You two You two pushed me. >> I'll ask you again, I'll place you >> I didn't touch you. >> That's the one who >> I didn't touch you. Quit pushing me. He's pushing me. He's pushing me. I don't have >> That's it. You're going to jail. >> No, you're so close to me. >> That's the time you touched me. >> I have all this on video. You ain't going to take nobody to jail. You walked up too close to me. You walked up too close to me. Be quiet. I ain't standing right here. I'll move wherever I want. Right back to the fence. So, this guy moved so close to me, guys, when I tried to turn, my arm bumped him, and then he started pushing me. So, guess what? Take me to jail, [ __ ] Take me. Take me. Do it. Take me. I'll file the fattest lawsuit. I'll own your [ __ ] house, your wife, your family, I'll own your whole family. Take me to jail. Do it. Do it. Here. Cuff me. Come on, cuff me. That's what I thought. Coward. All [ __ ] I do this [ __ ] for a living, you [ __ ] clown. You don't scare me. Don't you understand that? You got so close to me, and I have it on cameras, body cams, everything, that when I moved and simply turned around, I bumped you. That's your fault, you [ __ ] idiot. It's called personal boundaries. Do you understand that? Again, it's against against [music] your policy. This is how close he is to me again, guys. So, when I bump him again, and he tries to take me to jail, >> Take me to jail, the citizen challenged as he was shoved and threatened with handcuffs. [music] But, what legal basis justified this action? >> What's wrong with these [ __ ] clowns, guys? I know they're all following me. He was trying to jump back Shut up. Shut up. I don't want Hey, we're done. We're done with the nicely [ __ ] Be quiet. You can keep being nice all you want. We're done with that. Once your sergeant showed how much of a piece of trash he was, >> [music] >> on top of that Shut up. Do you I know it's a red line. I can see it, and I haven't crossed it. I haven't crossed it. I haven't crossed it. Have I? Have I crossed it? I'm about to get your body cam, his, his. You're done, bro. Do you understand that? You're done. You're done. You put your hands on a on a private citizen and pushed me back because you were so close that you got bumped because you walked so close to me. It's all on camera, you dummy. You can't do stuff like that. Use your brain. If you're going to be corrupt, at least be able to get away with it, you [ __ ] idiot. What's wrong with you? Are you that stupid? Tell me, are you that stupid? Seriously, I'm trying to teach you, [ __ ] lame. Look at the clown. All of you guys probably learned from this clown ass sergeant, guys. Try to put his hands on me, got so close. Have you ever heard of the Bane Act? Know what that is? That means if you're trying to prevent me and I'm going to teach you even though I shouldn't cuz you're probably going to do it some more. If you're trying to prevent me from [music] being able to do something that's part of my civil rights to do, like take pictures, and you're trying to jump and stand in front [music] of my camera, guess what? Bane Act violation, 25 grand for the city and all of it is paperwork, not even a real lawsuit. >> With only a few inches [music] apart, tension exploded. A minor bump suddenly became the excuse for police to threaten arrest. Who was truly crossing the line? >> I'm going to send that to recording to Martinez now. That's it. >> Martinez is on something here. >> Martinez? No, I've never been to Martinez. >> All right. So, obviously it's a public building. >> You can't cross here because that's the >> Ooh. >> All right. >> You got a complaint form? And just be be aware, I'm going to end up filing a suit against this guy for shoving me back, trying to block my [music] camera from recording. Car's coming in, right? It's a Bane Act violation. I'm sure you know what that is. Are you lieutenant? >> Yeah. >> Okay, so. And then he got so close [music] to me that I moved and my elbow hit him and now he's shoving me back telling I'm going to jail. You know that's a violation of my civil rights, right? Well, what? Is it not? Is it not a violation of my civil rights? Is Well, you should. Is it Is it okay for him to do that? Are they learning from you? Are they learning from you? Are they learning from you? I want answers. I want answers. Did they learn from you? Is it okay to do that? Is it okay to do that? You came out okay and you're lieutenant. Act a little more professional than these clowns you have trained. Is it okay for him to put his hands on me like that? Of course, yeah, he doesn't want to answer. Yeah, well, it's all it's going to be on his body cam. >> Yeah. >> Yeah, and he He's He's within inches from me. >> discussion now because you say you want to file a complaint. So, just like you have a process to go through, he has a process to go through in the complaint process. >> Well, it's not going to be a complaint. That's what you don't get. It's going to be a Bane Act. No, it's going to be a Bane Act. >> Did you want a complaint form? Is that what you wanted? >> Yeah, for sure. Go get one. >> Once I get you that, you're going to be on your way or >> Negative. I'm going to stay right here. >> Okay, is there any particular reason you are >> Yep. Yep, there is. There is. Cuz uh I want to. >> All right. >> I'm not going to I'm not going to tell you guys why I'm doing this. I want to do it. >> Um exactly. >> When the citizen mentioned the Bane Act, the atmosphere suddenly quieted because if the violation is proven, the price could be tens of thousands of dollars for the city of [music] Richmond. >> So, now he's standing back cuz he realized he messed up there, ladies and gentlemen. So, this is what happens when all you're doing is just standing taking a couple pictures. You get a young rookie cop who pulls up on you. It's really impressive. He alerts other police because he's, you know, excited. So, he goes over the radio, he sounds urgent. These other guys come out, they have their testosterone pumping, and rather than being level-headed and following [music] their training, they act like the sergeant right here who's probably trained them to be like this, and then this happens. And this is how we get lawsuits against the city, and this is why there's such a big gap between law [music] enforcement and citizens because people like this, this sergeant. He wants to get close, [music] he wants to act tough, he's trying to prove how tough he is, but there's no point in doing that. I would have remained very professional if this guy did, but instead, he put his hands on me, and I have it on camera. I actually have it on four four body cams, five body cams. So, at this point, um this guy's through. I'm going to go ahead and push all the paperwork on him, file [music] a pain act suit, and all that good stuff. Especially for trying to block the camera and pushing me when it's definitely my right to stand here by the fence trying to block the camera by standing close to him. So, maybe this was actually a good thing that it happened, Bay Fam, because now all these rest of these three officers and maybe some more officers are in there are going to learn how not to act when all this is brought to light. And they're going to do it on this guy's back. Unfortunately, we're going to push for him to definitely be pushed off the force and [music] out of the out of the police officer's union. We'll see how far we get with that, but it didn't have to happen. That's the whole thing. They could have just let me do my thing. They know it's perfectly legal. And instead of just letting me do my thing and and just stand back watching me if they had to, you had every right to make contact. You just didn't have a right to put your hands on me. >> Instead of addressing them [music] as conduct, the superior evaded and covered it up, leaving a painful question. Does justice [music] still exist when those entrusted to uphold the law are the very ones trampling it? The incident exposes systemic abuse of power, internal cover-ups, and the severe financial risks facing the city of Richmond. A hasty decision, a cursory glance at the file, and an innocent man was almost brought in as a criminal. >> Step on out for me. And >> From the very beginning of the peaceful police stop, Darius cooperated. Everything went smoothly until confusion began to surface. >> Are you Darius? Okay. So, you got to knock out the warrant. >> I got to have a warrant? >> Yeah, you do. Once you unbuckle your seat belt, then step on out for me. And Once you unbuckle your seat belt Yeah, Yeah, on out here and face car once you get out. Yeah. We'll call them and make sure that make sure that they cuz they still want you for that and that they're not going to just give you a new court date or something. You don't have any weapons on you or anything, do you, sir? Okay. All right, can you move your feet apart for me, please? I got to check you. Okay, I'll grab your stuff out of the car and we'll get that figured out here. I'm assuming >> The police explained the procedure [music] and Darius, bewildered, insisted that he was innocent. Questions of mistaken identity began to arise. >> No, actually we were sitting there because we're doing speed up. [music] She got super unlucky and um you know, you're speeding so that's kind of a poor choice when you got warrants. I'm sorry, with the window open it's really difficult to hear you. I'm not ignoring you. I just can't hear you at all. >> Got it. >> Uh-huh. >> The process with the warrant, I've never had one before. >> Uh-huh, right. >> So, like does that mean I go to jail today? >> Most likely, yeah. They're going to [music] call the >> The Hennepin County police requested an arrest warrant and Darius was arrested. He protested, claiming he had been mistaken for the wrong person. Despite his suspicions, >> [music] >> the police proceeded anyway, opening up the possibility of serious procedural errors. >> County and see if that's something where they want you now or if they just want to issue you a no court date. Usually, they want you, but with COVID, it's kind of a weird situation. >> Okay. >> Um but we'll >> You guys can go. >> I'm going to call them right now to get that figured out. >> Okay. I'm all right. Thanks. >> Thank you. I'm going to go call the doctor and see if he needs to call the doctor back and ask questions about >> [music] >> possibly sending out a patient for driving on the >> Do you know about how long he's going >> 10 4 minutes and [music] we're going to try to get the name of the other party here on search button. >> There he has provided ID, police discovered the birth date did not match. The error was cleared up, but the late verification exposed a procedural [music] flaw. >> Do you take that seriously? >> My dad, are you serious? I told you I was right. I don't even know about the four of us and the chicks. >> [music] >> Let me write you a check. Where you saw right? >> They transferred me the wrong guy. >> [music] >> I'm good, Jackie. So, they told me I was just going to say another guy had a warrant out for his arrest. He had to kill me a little bit. >> Yeah. [music] >> I thought you >> Let me know. >> Sure. I told you I could be the master. I'll bring [music] my stuff up. >> Thank you. >> Yeah, I'm sorry you didn't work. Um but it's got your date [music] of birth on there as well. And your name there as well. >> I told you that. >> [music] >> I said check the top different there. >> He admitted to mistaken [music] identity, apologized, and blamed the multi-areas file. Darius was cleared, but confusion and systemic [music] mistrust remained, the result of an avoidable mistake. >> [music] [music] [music] [music] [music] [music] >> There's a lot of APAs on warrants. >> I believe that too. And because you did that, you're not getting a ticket cuz that's Make sure to get your license taken care Cuz if you don't go to court >> 35 >> Yeah, it was before 10:00 before you hit that stoplight. That's when he got your speed. >> In Minnesota, abuse of power or defamation [music] of a citizen can be criminally prosecuted with jail time and fines, as well as civil [music] litigation and claims for damages. Arrest without proper verification from the beginning show shortcomings in the legal process >> [music] >> which can lead to abuse of power, damage to citizens honor, and the risk of human rights violations if not properly resolved. Police demanded [music] he stop filming and asked for his ID while the cameraman kept questioning, [music] "What law am I breaking?" Sparking a heated clash over civil rights and police [music] power. >> Yeah, I got that. I mean, I see the fence. >> [music] [music] >> That's interesting. No, I I mean, I didn't think so. Not really. You guys have been attacked here? That's crazy. [music] Okay. Well, inside [music] of the jail I mean, it's a jail, all right? You That's why I asked, is it a jail or something? Yeah, it should should be nothing wrong. I mean, it's just a police department. I don't understand what the problem is. >> [snorts] >> Well, I don't think [music] I'm jeopardizing the safety of your officers. Oh, got you. I mean, do I have to I don't know how that stuff works. I have >> [music] >> Like if I have to give you my ID, I don't I don't know anything about that. I'm just running around taking [music] pictures. I've been I took pictures out here and of the geese and all kind of stuff. Well, it's not true. I'm Okay. I It is true, but >> [music] >> Amid the heated exchange, a surprising [music] detail emerged. The camera had captured everything and what it revealed [music] might leave some people ashamed. >> I'm free to reach my camera up, right? I'm free to I'm free to look wherever my camera can [music] see. No, no, no. No, I I was talking I was talking [music] when you interrupted me, brother. And I don't understand why an officer would still come out and do this. Raise it up, right? I got it on camera. You're lying. What's your name? And I got it on camera. [music] What's your name? It's right here. What you tell the judge, sir? What's your name? There you go. I can read. [music] I can read. Well, you when you're when you're about 6 ft like I am and not 5 2 like you reaching up like [music] this much of a defense, you're full of [ __ ] My camera doesn't lie. So. Anyways, camera don't lie. So, anyways. Like I said, I don't understand why you guys still do this. You see somebody recording, >> [music] >> leave them the [ __ ] alone. It's that simple. >> [music] >> That's it's the issue. There's no it's no issue. [music] Then we've answered the question. Then we're good, right? That's a [music] private dwelling with a private citizen. Public service. Big difference, but come on. Come on, think. That's ridiculous. [music] Why would you even say that? I'm not the one messing with somebody for for just for just recording us. Please, all you guys, go inside. >> [music] >> I just don't understand why you guys still do this. If somebody reached up [music] over the fence, that's not private. It's fenced off. Build your fence 20 ft, you don't want somebody to go look over it. Later, I'm going to fly a drone all over your whole building. I'm going to take aerial photos of everything. >> Faced with a series of pressing ID requests, [music] citizens are resolutely resisting, questioning legal authority, and demanding transparent explanations. Will the truth be [music] revealed? >> No, no, no, over the fence. I have it recorded. I have it recorded. [music] You're lying. Why would you lie? What was that? You sure? We're all sending it to you after I get it all done. There's no need to prove that I'm not lying. I can easily reach my phone. There's nothing illegal about that. You'll see it. You'll [music] see it when cuz I ain't going to quit recording. I'd be a fool to >> quit recording you. >> I would be a fool to quit recording cuz you have >> [music] >> dangerous people on you, too. This guy comes out and lies and so you guys mess with is ridiculous. >> [music] >> What's your name? I'll send it right to you. You got an email address? What is it? Yeah, well, what's your You got [music] an email? Somewhere you want me to send it? I'll send it right to you. No problem. What was that? Because I have [music] no reason to lie about it. Recording when you got dangerous people. I got three guys with guns, five guys with guns around me. Why would I quit recording? That'd be foolish, bud. Especially when you got a guy lying like blatantly. [music] I'm definitely going to record over the especially cuz [music] of now I was actually leaving when you guys stopped me. >> The command to detain rang out in the middle of a public building, [music] but it was all being broadcast live as evidence. Whose side will the truth fall? >> I forget his name, [music] anyways. Well, now we're just going to continue to record here just to just to just cuz they told me I can't and to prove a point is kind of ridiculous, [music] but so he said he saw me stick it right up over the fence and this is not sticking it up over the fence. This is sticking it right at the fence. That's the camera he claims he was watching [music] me on news, and he claims that I stuck it over the fence, which this fence is pretty big. I mean, I can stick my hand up all day. That doesn't mean I'm going over the fence like that. So, this guy is [music] ridiculous. Okay, so it looks like there's two vehicles. And a call was obviously sent out already as far as a [music] guy out here recording. This guy was cool so far, I would say. >> Citizens [music] may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. >> [music] >> Individual/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, [music] have their licenses suspended, fired, or expelled, depending on the policy [music] of the agency/police chief. The video captured the entire incident, a [music] public record of abuse of power, lies, and obstruction of press freedom. Up next, a man with a small camera, and within minutes, 12 police officers with blaring lights and sirens swarmed the scene. >> Allegedly racist using racial slurs >> He didn't break into the house, didn't threaten anyone. He simply asked a [music] question about corruption allegations, and then the entire system of power began to move. >> I'm wondering if you have any comment on the allegations that your husband is having an affair with Laura Curran. >> He's having an affair with Laura Curran? >> He's having an affair with Laura Curran, the former Nassau County Executive. >> Trying to get to the bottom of it. Trying to investigate. >> Please get off the property. >> Just wondering if she had any comment. I have an inside source that is telling me that there's much more than a fair going on here with the Nassau County Police [music] Commissioner. He is allegedly racist, using racial slurs. I have an inside source in the police department that is how the Nassau County Police Commissioner is using asset forfeiture to steal people's property and use it for his own benefit. And we we're going to get to the bottom of it. Hey, how are you doing, sir? Can I get your name and badge number? Just taking a walk around the block here on the publicly accessible area, sir. Can I get your name and badge number? You came in you almost hit me, sir. You're very close. Why are you speeding? I'm not a danger to anybody. >> [music] >> I was asking some questions of Mrs. Ryder here. Because I'm working on a story, and I left. That's why I'm here. She did. And I left. That's why I'm here in the public on the public park. Yeah, exactly. No, officer. That's [music] fine. I mean, does does everybody get special treatment like this? Figure. She's a figure of the police department. She didn't seem worried. She was She was taking pictures [music] of me and Yeah. I was um preferential treatment like this, sir. Ordered to leave, ordered to show ID. Yet the man stood firm on his right to remain silent and keep filming. Will he withstand the overwhelming pressure? Can you let her know that I'm not a danger to her in any way? Like I don't know if she's worried about that. But you know who I am. There's no need to worry here. >> [music] >> Oh, I don't have to hand over ID unless I've committed a crime, sir. So, this law enforcement officer [music] here arrived really fast. Car 4211, lights and sirens. Look at that. Look at all these officers arriving here for a man with a camera. Asking questions. 1 2 3 4 Oh, nothing. I'm just I'm a journalist. I'm working [music] on a story. I'm a freelance writer here regarding some corruption that's happening with the commissioner. I just had any comment on the allegations that he was having an affair with the former Nassau County Executive. Oh, that's all. I just asked a question. That's why I'm recording. And then she told me that she didn't want to talk to me. She said "No soliciting." I told her I wasn't soliciting. She said to get off her property and that's why I'm on the public easement here. I don't want to break any laws. Do you mind if [music] I get your name and badge number, sir? Just so I know who came here. Right here? H 3 R? >> Shocking [music] accusations erupted from asset abuse and racism to hidden violence. Yet, no one in uniform dared to respond directly. >> Oh, yeah. I'm just asking questions. I've I've heard there's a lot of corruption. I have an inside source inside the Nassau County Police Department who has been feeding me information and honest anonymously regarding New York Police Commissioner Patrick Ryder. That's my first amendment right, sir. I'm working on a story here. That's all. Nothing nefarious going on. Yeah, we have allegations that as you can see there's no people of color that are right here, that he's hired that have 2,300 I believe applicants of color. He's only hired 30 of them in the last 6 years. And that he uses the N-word regarding to some employees. A lot of different corruption and allegations that's going on [music] here. So, just wanted to see if his wife or anyone else had any comment. That's all. Hey, how are you, sir? Doing well. I'm not a danger to anybody. I don't have any weapons. I'm just a journalist asking questions like any other journalist would do of this government. That's all. Nothing nefarious going on here. Um I don't consent, but Oh, I'm sure. There's nothing in that pocket. >> It looks empty. >> [music] >> This is the pocket with something in it, by the way. >> All right. This one's empty. >> How do you see something in an empty pocket? >> What seemed like a simple encounter [music] could spark a wave of investigations, lawsuits, and a scandal many are trying to hide. Shawn was not arrested because he had committed no crime. >> And I left. >> Okay. You still need Do you have video you leaving the house? >> Well, she has a ring camera, sir. >> She doesn't. I I just looked at it. >> How does it not capture that? >> I don't know. Do you have video footage? >> Did she tell you that I left? >> She didn't say. >> She didn't say? I don't have to prove anything. I didn't break any laws. >> You were possibly trespassing. >> Possibly trespassing? But you know who I am. >> I don't know who you are. I have no idea who you are. >> Okay. >> So, I need an ID. >> I don't I don't have any You've arrested me. You've arrested me a couple weeks ago. I'm not breaking any laws. Well, you Well, you arrested me I don't identify myself. >> I'm not going to arrest you. >> I want to remain silent. I want to exercise my Fifth Amendment right to remain silent. I really You didn't answer my question. You got here really quick. I'm on my way. I'm on my way. >> I was asking a question based on the allegations of corruption. >> Sir, I don't and I don't give it up unless I break any laws. I haven't broken any laws. I'm here exercising in a constitutionally protected activity. I'm asking questions of my government. That's all. There's some serious allegations against your police commissioner. Serious allegations that I'm getting from a reliable source inside of your department. They're going to come forward as a whistleblower, I'm just asking questions. Well, I was asking questions to I was asking for advice and she opened the door. So, I asked her a question. She said no soliciting. She said leave the property and I came out to the sidewalk and she was very aggressive here telling me when I was in the driveway. Seconds later I just said I'm on my way. I have nothing I have nothing else here. No one's going to speak to me. Oh, yeah. Do you mind if I get you in the back of the car? I I want to speak with Commissioner and his wife and his daughter and I talked to her and I got All right. So, I'm going to be going. >> A society is truly [music] civilized only when the government is transparent, citizens' rights are respected, and every abuse of [music] power is brought to light. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. Next. A bizarre accident, a man staggering [music] away from the scene, and his true identity leaves the entire police force speechless. >> revving the [ __ ] out of it and he's trying to push it. >> So, about that time I rolled my window down cuz uh >> When witnesses pointed to a car revving wildly, few would have guessed that the person behind [music] the wheel was once a law enforcement officer. >> No, he's So, like I come to the intersection and he's he's trying to push the vehicle and he's revving the [ __ ] out of it. And so, I pulled behind him and then some people tell me he's been he he ran up on the street. He ran and then he ran. >> You were watching him? >> Yeah, we were watching him for a second. >> Yeah. >> Okay. Hey, sir. What's your name? >> Hugo. >> Hugo? >> Mhm. >> Were you sleeping with him on Tuesday? No, last Sunday, I'm sorry. Where do you live? >> Uh just down the road here on McKenzie. >> Okay. What's your last name? >> Diaz. >> Hugo what? >> Diaz. >> Diaz? Okay. Do you know if he was sleeping with you on Sunday, Diaz? You think you were out with him on Sunday? One of our guys was out. I don't think he's actually looking for him. >> Oh, you don't think he's a >> No, I I heard his name on Sunday. I think he claims he's one of the family. Did he say where he was? >> No, I didn't ask him, did you? >> Okay. >> You You kind of want to can this cuz my K9 doesn't want to handle >> Yeah, because he thinks it's the 34. >> No, we we can handle it. He was like this and he's he's trying to get [music] the vehicle moving. Grabbing the [ __ ] out of him. He's trying to push it. So So I said, "Okay, thank [music] you." So I called it out and then >> We made contact with him. He can't even stand. It's weird, dude, cuz when he sits there, he talks, he's fine. But when he gets up, he's the world's spinning on him. >> He said he didn't drink. He said he didn't do drugs. But the results of the tests made the entire patrol team frown. It seems the police's handling [music] of accidents is not like other cases. >> Are you familiar? >> Familiar? >> Any alcohol today? >> No. No. >> Why are you trying to leave? >> I'm trying to get home. I don't have insurance, though. >> Is that why you're trying to leave? >> Yeah. >> 190, I have one suspect in custody or not custody. He's going to be sitting on Sit down. Sit down. I'm out with a cell. I have the mail. We'll be taking this crash. Uh they just stopped the crash. Are you injured? Do you need any ambulance, anything like that? Sir, we thought you were a police officer. >> [music] >> You have a license at your house? You look What do you do for work? >> I work at a speech >> You work at a speech therapist? We're going to get a tow truck for you, sir, okay? No alcohol, though? >> No. >> Did you get in two crashes or was it just one? >> It's one crash. >> Okay. Can you tell me how that one occurred? Were you leaving a parking lot or Uh So you said just one crash? >> Uh back one? >> Well, the one that happened today. >> Oh, just the front. >> Yeah, so how did that happen? >> Uh you hit it on the other car. >> Okay. Over what? >> Stumbled through every step of the investigation, refused to cooperate [music] at the last minute, and then quietly admitted to what should have been confessed from the beginning. >> So you got a hook in here? >> Why would I hook you? Do you want to be honest with me? >> DWI. >> Is there a reason why [music] I I would arrest you? Why? >> No, cuz I didn't want to do the test. >> If you have nothing to drink or nothing to do, then why would why would I arrest you? >> a driving. You could bring your PBT. >> But is there's other things that can impair your ability to drive other than alcohol, correct? There's drugs. Okay. So, what kind of drugs have you been using today? >> I take cyclobenzaprine. [music] >> Cyclo, okay. >> Cyclobenzaprine, but I took it last night. >> Okay. How much of it did you take? >> Uh 100 mg. >> 100 mg? Okay. How much are you supposed to take? >> 100. >> That was last night? >> Yeah. >> Okay. What [music] about this morning? I don't know. What do you take that for? >> Uh for my back pain. >> Your back pain? Okay. Um So, why didn't you tell me in the beginning, right? I asked you if you take prescription medication. I asked if you take any prescription. >> Cuz I took it last night. >> [music] >> Yes, but that's the only prescription drug I take. >> Okay. Um I appreciate your honesty, my man. No other drugs with your system? >> No, you can check the drug test. >> An evening that [music] seemed like just a traffic accident, but the truth behind the wheel revealed disappointing things about the very industry he once served. >> Cyclo benzaprine. >> Cyclobenzaprine. >> [music] >> Cyclobenzaprine. >> And you don't take anything else? >> That's it. >> Okay. Have you been sick lately? >> Uh >> Have you had like a stomach? >> Yeah. >> Runny nose, coughing, like that? >> No. >> Okay. Why is there so much stuff in your nose? >> Uh weird. >> Like it's really caked. Your nose is super super caked. [music] Is that allergies or something? >> It's like a copper taste. >> I'll be honest with you. Your test were not good. You did not perform well. Okay, everything's pointing to me right now that you're impaired. >> Okay. >> Again, I Like I said, alcohol isn't the only thing that can impair your ability to drive. Drugs can Drugs can Drugs can impair your ability. So, everything's pointing to me right now. Your eyes are bouncing like crazy. So, you're You're a cop, right? You know what I'm talking about. And my cell phone too. >> In the state of New Mexico, under NMSA SS 66-14-3, a first conviction for driving under the influence of drugs carries a maximum penalty of 90 days in jail or a maximum [music] fine of $500.00, mandatory participation in a screening program, and DWI school, possible license suspension [music] or restriction, and mandatory installation of an IID locking device for 1 [music] year. Diaz blew a zero breathalyzer, but police still took his blood to test for other substances. He was charged with reckless driving, leaving the [music] scene, and driving under the influence. Demands to leave and defiant stares as the citizen stood firm on his constitutional [music] rights while the authorities chose confrontation over dialogue. >> You know, I don't I don't ask you guys to turn off your cameras every time I walk [music] in here, right? >> My camera's definitely on. >> Exactly, and I'm sure all the cameras in here are on. I don't see >> So, what is it that you're doing? What are you gathering information >> It's for my story. >> Your story? >> That I'm working on. >> Right. >> Sorry about playing people's private Yeah, basically [music] everything. You know, doing open records requests, you know, people in city hall. That's all. Officer Detective Franklin. Because that's how I'm getting documents for my story. >> Oh, yeah? You've been working here a long time, Franklin? All your life? >> See, never seen the building before. Wanted to check it take a look at the building. That's all. Just peacefully. Public area. I'm not going anywhere I'm not supposed to. >> Listen, listen. We we passed that. What is it that you want to know? >> I'm gathering my content. >> What I'm saying, you want to know want to know how old the building is? You want to know [music] >> Look, yeah. Well, I'm basically looking for the inside layout of the building. That's all I'm looking for at this point. >> [music] >> I appreciate you offering your help to me. Thank Thank you. >> Well, I'mma just say this to you. You know, you're allowed to film everything, but this is a government building, okay? So, that's why I said maybe you should have said something to me. >> Uh no. >> You know what I mean? >> I don't I don't normally announce myself. >> If you go around filming government buildings, that could be misconstrued. >> Can the feelings [music] of a few outweigh the law itself when the words "I don't want to be filmed" suddenly [music] become the excuse to suppress freedom of the press? >> You're filming employees. You're You're not asking them for their permission. >> need that. I don't need their permission. >> Yeah, you do. >> I do [music] not. You're mistaken. Sorry, but you're mistaken. I I already I've filmed many employees. >> If you're doing an independent film, you should be asking them for their permission. >> I No. I don't need their permission. >> [music] >> This is a public building, sir. There is no expectation. Did you ask my permission before you turned on that camera that you have? >> didn't because this right now this is a police investigation. >> So, while you're consensual with >> So, all right. So, while you're filming, okay? I'm just asking you to respect that. >> Yeah. >> [music] >> But, when an officer don't feel like you're handling the business in the office, you're going to be filming somebody. >> That's correct. I'm thinking like she knew exactly what was going on. >> Because when I went in there >> Did you know her? >> When I went in there >> No. >> I have no idea. Why would I ask for her name if I knew >> you went in there when? >> When I went [music] in there >> Okay. >> I asked what office it was cuz there's no signs on the office. >> Right. >> I said, "Turn off your camera now." I said, "Well, unfortunately for you, I'm not going to do that. If you would just tell me which office this is." >> So tell me Let me ask you a question. What gives you the right to walk into somebody's office? >> Yeah, I know. >> It's your fault. >> Listen, we can go back and forth with this, but you're making people uncomfortable. >> I'm not That's my right. >> Therefore, listen, so therefore you're starting to cause a >> [music] >> a breach of the peace. >> No, that's not true. >> Yes, sir. >> That's not true. >> to have the intent. If I get a >> So you know the law. >> cameras in in someone's face. >> That's That's not That's a constitutionally protected activity. This is the government. >> They won't listen. [music] >> Blue uniforms appear, threats of arrest echo, but where is the line between maintaining order and abusing [music] power? >> You're trying to sensationalize it by saying I'm sticking cameras in their face. >> into your office and you tell me I come on your job and I'm like "Hey, I want to talk to you." >> Yeah. >> What are you going to say? >> [music] >> I I mean I mean, yeah, it's your job. >> You're bothering You're bothering folks. If you're filming people on their job and they say I don't want to be filmed, this is a public This is a public building. >> Sir, this is a public building. >> Just answer my question. >> If I didn't want to be recorded, I would accept that that happened [music] to me and I worked for the public. If I worked for the people, I would accept that I worked for the people and they have the right to hold me accountable. >> I'm listening. You film me somewhere and they say to you, I don't want to be recorded. >> I'm not there to [music] keep recording them. I'm there conducting business. >> So you would stop recording them? Is that what you're saying? >> No, no one can tell me to stop recording. >> No, I'm asking you. Should you stop recording them? Would you keep on recording them? If I should you do? Yeah, I'm just holding them accountable. There's no expectation of privacy in public and that's why I wanted to speak with you, [music] sergeant, just because I wanted your detective is kind of conflating the two. Is that But they're government employees. [music] This is a public building. That's all I'm doing here and I'm not just standing in front of somebody recording them until [music] they get upset. I'm asking questions. You know, I'm not doing anything. >> In the end, everything [music] closes with a troubling question. Is the government truly being transparent or merely hiding something behind the mask of power? >> [music] >> Yeah, if I go ask her right now, when you walked in the office, is that what you said? >> I did walk into the office. >> You walked in the office with your camera like that. >> Like you talk how you are. What's normal to you is not [music and singing] normal to me. >> Yes or no? >> What's normal to you is not normal to me, sir? >> Is that normal? >> Sir, what's normal >> Is that a normal thing to do? Isn't Isn't that kind of disrespectful to someone? >> You're recording me right [music] now, sir. >> You're a journalist? >> That's what I said. You're recording me right now. >> Are you You're a journalist? >> That's correct. >> You're a journalist, you say? Peacefully, I'm not trying to [music] start But normal to you is not normal to me, sir. Then why are you out here filming me? Why are you out here filming? I don't even want to >> City clerk, yeah. >> I don't even want to start That's correct. This I wanted to finish [music] my business here and then I'll hand it in, you can stamp it for me and uh that's it. Thank you. Appreciate that. I'm just going to get the rest [music] of my my shots here and this this is a freedom of press activity, constitutionally protected activity. Hey, please calm down. Please calm down. Please calm down. Please calm down. Yeah, calm So, you're you're from You're not from my You don't you you obviously you're the one escalating, sergeant. >> [music] >> There you go. >> [music] >> It is very nice. The citizen declared he would preserve the video evidence for a formal complaint and potentially pursue [music] civil litigation over the abuse of power and obstruction of press freedom. Up next, right in front of Washington Correctional Facility, a single camera sent both the National Guard and prison staff into complete chaos. >> codify it into our statutes. The First Amendment and the right to record law enforcement [music] >> security officers. >> And I'm here just to make it clear. I'm here I'm exercising the New York State right [music] to monitor out. >> Hey, don't go running out into traffic. >> And you know, that's if you're becoming a aggressive. >> Relentless orders, threats to leave the area, yet this citizen stood firm defending every single one of his constitutional rights. [music] >> Wow, ladies and gentlemen, that's just no cell phones. Okay? In New York State, [music] we have a constitutional and statutory right to record correctional [music] officers in the course of their duty as well as law enforcement officers codify it into our statutes. The First Amendment [music] and the right to record law enforcement security officers, peace officers [music] in the course of their duty. I don't know why they think [music] that this is somehow private property. It makes zero sense. Hey, how are you? I'm just taking some pictures and video. What are you doing? That's like a There goes another correctional officer. Excuse me? Why can't I be here? >> Are you a state employee? >> No, I'm not a state employee. What's your name, sir? Sir, can I get your name? You too. Take care. So, we're going to record correctional officer in the course of his duty. So, are you part of the beat down squad? I have no idea why these National Guard guards are here. So, the National Guard came in to the correctional facilities when all of the correctional officers went on strike conveniently [music] when their brothers in blue were charged with the murder of [music] Robert Brooks. They went on strike protesting, quote, their working conditions. >> Behind those iron [music] doors lies an illegal strike, a shocking case ending with a 15-year prison sentence and the baffling silence [music] of those in uniform. >> Well, how are you? Just enjoying the day. Just that's just trying to ask [music] some questions to the correctional officers here. >> Okay, are you getting any answers? >> Honestly, not too many. You know, I just I I'm trying to ex- They just saying [music] this is private property where I'm at right now and I'm trying to understand who owns it. And uh I'm here just to make it clear. I'm here uh I'm exercising the New York [music] State right to monitor act. I got I got the right to film law enforcement, peace officers, correctional officers from public spaces. They don't make exceptions for correctional facilities. So, that's all I'm [music] doing. I'm not going to restricted areas. I want to be clear. You know, not a restricted place. I just say keep the body camera [music] on for transparency. >> [laughter] >> So, this uh law enforcement officer here seems like a good guy. Seems like a good guy. We'll see if he honors his oath to uphold the United States Constitution. >> Hey guys, why do you guys have National Guardsmen here? >> I don't know the difference, but >> Why Why is there National Guardsmen here? I'm just curious. I thought you guys were done with the strike situation, the illegal strike. So, people are still on strike still? Like you guys still need help [music] from the Guardsmen to run the facilities? I'm just curious. I mean, there was a probably like 20 of them out here before. So, I just wanted to know. So, lieutenant, you guys have a beat down squad here? At W Clinton Correctional Facility? You guys have like a what's called a beat down squad? You can't even answer that? I mean, I think the answer would be no, right? You're smiling. Are you part of the beat down squad? You look like you'd be a good candidate. >> I really am not talking to you, so I'd appreciate it if you'd stop talking to me. How's that? >> No, I'm good. I'm going [music] to keep asking questions, sir. Yeah, you're definitely part of the beat down squad, aren't you? What's so hard about answering the question, is there a beat down squad? I really don't understand. The answer is no. I mean, it's supposed to be, but I don't think they want State police arrive. Will they uphold the Constitution or follow the controversial orders [music] from the prison and National Guard? >> You were running out in the traffic. >> [laughter] >> I Listen, I follow the law. I comply with all laws. There is a law, like I said, it's [music] a statutory right in New York State. I do appreciate laws that codify my statutory [music] my constitutional rights. >> So, there's certain There's certain limits to to within that, right? And it And it does require um like the superintendent's approval if you're going to be doing filming, photographing in certain areas. Out here, but once you crossed over that, right? Cuz you're right by the officer. >> Right. >> into the area with the >> No cell phones. Right. Right. >> They're letting it go. >> I I don't think that that [music] sign is a is a law. I don't think that cuz if I If this wasn't a cell phone and it I I only use a cell phone just to just >> [music] >> because I want to come off as every day citizen journalist, right? So, if So, if I brought a camera, an actual camera, you're saying >> It's the same. It's uh >> No, cuz it says no cell phones, right? >> But within the building, right? Within there. Look, they they said you're welcome to, you know, read the read the portion of it there. >> Right. >> Since the the superintendent's approval. That that says [music] photo or video. >> Well, listen, I'm just going to continue to engage my statutory right and that's it. >> Yeah, okay. The public has So, our understanding >> in that area is fine. And then So, yeah, it's it's >> Doesn't [music] seem like they want to answer any of my questions anyway. >> within the roadway there. >> I understand that. >> I have a I have a pretty good idea that you don't wish to provide me any information, but >> I'm sure you look like you're an intelligent officer. I think you can figure it out. >> The confrontation [music] ends, yet questions about transparency, civil rights, and abuse of power continue to echo throughout Washington Correctional Facility. The video exposes the National Guard's aggression and the prison's silence when pressed about violence, strikes, and accountability. >> That was not at all what so ever. >> point of view right here. >> Right. Right. >> Let's let's just consider they're thrown into this situation. >> Yeah, I was just curious. >> Right. I understand, but they may they may interpret these things. >> Right. I had no [music] idea that that was the policy in place, so that's good. I wanted to That's good to know. You know, I'm I'm I'm working on a story on the big picture of But the big picture, as you know from the news, there's a lot of, you know, murders happening inside these walls, inside the fence here, uh you know, strikes, illegal strikes, [music] and things like that. Yeah, no problem. No problem. Okay. I'll within the law. >> Got you. >> I just wanted to know who was here. Do you mind if I get your name and badge number? >> Sure. Student Cadnar, 334. >> Thank you. I appreciate it. Officer Cadnar, thank you. I'm doing well, man. Doing well. >> So, don't stand in the middle of the roadway here cuz they [music] don't want to hit me by a vehicle and obey this no cell phone sign. Take care, Trooper. >> You're good. Drive safe. >> No problem. Thank you. You, too. All right. >> [laughter] >> Every act of abuse of power, [music] every order that crosses the line of the law, not only violates citizens' rights, but also erodes society's trust in justice. [music] Hey, everyone. What do you think about this situation? If you enjoyed [music] the video, don't forget to like, subscribe, and support us with a donation. Thank you so much.
