Thank you. I'm going to need your ID so I can trespass Oh, you're going to need my ID? Oh, okay. So, what happens if I go walk back over there? I'm still going to trespass you. Exactly. Yeah. I'm not I don't I'm not going to give you my name. Okay. So, I'm going to explain how this is going to work because I have to identify you. You do not. What's the crime? Not committing a crime, yet still being asked for ID. Is this law enforcement or blatant abuse of power? So, am I being detained? At this point, yeah. At this point I am being detained. Am I allowed to leave the property? >> No, because I need to >> Now I'm not allowed to leave the property. >> to But at this point, you're being lawfully detained. Okay. Which therefore you do need to identify yourself. Okay. The price for officers who don't understand the law today can be million-dollar lawsuits and the collapse of their careers. A man simply stood on a sidewalk in Fort Mill filming a public area, but what happened next turned the entire scene into chaos. How's it going, man? All right. What you doing? Just videoing. Videoing? Just wondering what you're doing. Just wondering what I'm doing? Yes. Mhm. Just videoing. Why? Why? Yep. What Now, the answer to that question, what exactly does that change for you? I'm just wondering what you're doing standing outside the store video taping people. Yes, sir. I'm out here I'm stress testing our First Amendment right to the freedom of press in public. That answer wasn't very strong. You're trying to identify the officer. I just don't want you to tell me why you're standing out here video I just told you. Why are you standing I just told you. Maybe it Maybe your ears weren't open. You were too busy talking. You were too busy talking. I'm stress testing our First Amendment right to the freedom of press in public. Okay. Now I understand what you're All right. Have a good one. After what seemed like normal questions, the atmosphere began to shift as tension slowly rose, but that was only the beginning. Moments later, another person stepped in with a completely different approach and the situation quickly escalated in a way no one expected. What's up? You got a problem? Do I have a problem? No, do you have a problem? >> seen you filming everybody. Oh, you seem really entitled. There you go. Oh, you know what curiosity did? It killed the cat. Oh, there you go. There you go. You think I think you think I'm going to give you any answers now with the attitude you just pulled up with? I just said what's going on. Oh, oh that's how you did just with that tone? With that same tone? >> With that exact same tone which you fired right back. Oh, there you go. Fired right back at you. There you go. You know why? Because you you started with it. >> You're the only Absolutely. >> People want to know why they're being filmed. >> Oh, well people can come and talk to me. But as of right now, your attitude sucks and I'm not giving you a goddamn answer. Oh, okay. All right, buddy. Okay. I'm not going to tell you. I'm not going to tell you. Huh? Why you pulled up and stopped and got my attention? Oh yeah, it is. Oh, it is? Oh. Oh, then go and tell somebody. You seem to be really really worried about what everybody else is thinking and what everybody else is doing. Oh, like I said, if everybody wants to come and talk to me, they're more than welcome. Oh, okay, buddy. I'm terrified. Oh, I know. I know, cuz if you would have done something, you'd already done it. No, okay. What? You could have You could have came with a better tone and I might have answered you. I might answered you. All right. Well, if that's what you believe, then you can carry on and believe it. I will. Uh millions of people will. Oh, no. The confrontation had now gone far beyond a normal conversation with tensions escalating through increasingly heated exchanges. But just as things seemed on the verge of spiraling out of control, the arrival of law enforcement introduced a completely new dynamic, sending the situation in an unpredictable direction. Hey, what's going on? How come How can I help you? Oh, yeah, I hear you. I'm David Richard, York County Sheriff's Office. Sweet. Can I get badge number as well? My call sign's 449. We don't really have badge number. I'm Twardowski, 446. How do you spell it? How How do you say it? Twardowski. Twardowski, okay. Sweet. How can I help you guys today? Of course, we got a call. You were out here with the camera. As long as you're not on their property, you're good. >> Oh, okay. Just so you know that. Of course. Of course, I know that. But we had to come out here and do our due diligence. >> Hey, I understand and I appreciate you guys coming up very respectful and very knowledgeable. I wish we had some more some more of that here. Okay. Okay. I got you. I got you. Okay, so it's not illegal for him to film. I got you. I got you. You know, and it's funny because the conversation came to, you know, just "Why don't you just touch my truck and then we'll put it in public?" This guy's really good at circular conversations, by the way. That's number two. That's the second time he said that same sentence. There's number three. There's number three. Like I said, you can ask. He doesn't have to answer and he's perfectly within his right to As long as he's in in public. I got you, man. Okay. What? I got you. Is there Is there anything else I can help you with? I was just curious why he was filming me. All right, man. Well, like I said, he doesn't I got you. He doesn't have to give you an answer, so You want to go ahead and head on out of here. If there's anything else we can help you with, just let us know, okay? All right. I don't appreciate what I I understand that. >> anybody does, but he's even said that he's too scared to go in there and ask me. I got you. Dude, I'm terrified. I'm terrified. >> you, boss. Have a good day. See you later, buddy. All right, man. Like I said, as long as you're not going into their private property, >> I have no intention to do that whatsoever. And I mean, nobody's even told me to leave anyway. So, if they if they want to tell me to leave, I don't I don't want to make it like a hearsay situation or anything. If they If they want me trespass, just have somebody come out and tell me. I haven't talked to them yet. We just seen you out here, so we thought we'd make uh contact with you first, okay? After law enforcement arrived and the situation seemed to be under control, things started to become clearer. But, just moments later, an unexpected decision was made, quickly shifting the conversation into a more tense direction and sparking arguments no one saw coming. We know what the caller wants. >> Oh, so So, they want They want me trespassed. Is that what I'm hearing? >> They just called talking about a suspicious person. Okay, so I'm still allowed to go in there, then, right? >> far as I'm concerned right now, yeah. >> Oh, okay. I am going to go in there and talk to them and see what they want to do. So, your body cam is rolling, right? So, are you going to go in there? You're going to ask them if they want me to leave or be trespassed from the building? Like, you're going to go 100% I'm going to ask if they care that you're out here if you go onto their property. >> Oh, so so, you're going to go solicit a trespass, 100%. Okay, sounds good. Awesome. All right. And uh just make sure you have that CAD number for me as soon as you come back. Thanks. No problem. But understand if he's down there on the road, he's filming you. He's 100% within his rights. That is a public area and he can film. Okay, we're clear on that. You want a trespass. There it is, solicitation. Actually, she brought it up first cuz you walked over here on into the parking lot. >> okay. Thank you. I'm going to need your ID so I can trespass >> Oh, you're going to need my ID? >> Yes, I am. Oh, okay. So, what happens if I go walk back over there? I'm still going to trespass you. I Exactly. Yeah. Yes. So, I need your ID. >> So, am I being detained? At this point, yeah. >> At this point, I am being detained. So, am I allowed to >> Would you like a supply Am I allowed to leave the property? No, because I need No, I'm not allowed to leave the property. >> your information >> So, so you're not going to give me ample time to leave, right? Is this Is this what you're saying? They don't want you to come back. Okay. So, what you're saying is if they if they want me to leave, right? They want you to leave. >> Right. Okay. So, now what I'm going to do is go step back onto the public property, right? >> And I'm going to come over there and I'm going to get your ID from And I'm going to tell you you're trespassing not to come back to this property And then if you do, you're going to be arrested for trespass. Okay. Cool. All right. Let's walk over here. I'll get your ID from you. At this point, the arguments went far beyond a normal dispute as each side began pushing their limits further. But just as the situation seemed ready to explode at any moment, the arrival of a new figure shifted the entire dynamic, opening the door to a completely unexpected turn. Oh, we got Mr. Gloves in the back here. Yes, sir. He's excited. What's going on? Not too much. What's What's going on today? I I got no answers for any of your questions other than the fact that uh I just want to know if I'm right, if I get told that I'm trespassed and I'm no longer allowed to go to what's called a verbal trespass and I'm standing right here off the property. I just want What was your name? Timothy Richard. Richard. Oh, Richard. Yeah, that makes sense. Um so, Mr. Richard here said that uh if I'm standing on a public easement that he still needs to get my ID. He still needs to get my ID. So, I get it what you're telling me. I just want to make sure that I'm under the correct understanding that I can identify as good citizen and as long as I'm not on the property then if I don't return nothing's going on. Okay. Well, if you don't want to identify yourself, don't go back on the property, okay? Will do. See you later, Richard. Take it easy, bro. Hey, thanks for the free education, man. He's not upset, he's just disappointed. It's okay. Hey, thanks, man. You take care. Free education. You can take your gloves off now though, guys. No touching people today. You're all good. Hey, does this guy get made fun of for having the name Richard often or is that is that a one-time thing? After all the tension and arguments, the situation ultimately came to an end in a way no one expected. But what just happened still leaves major questions about how everything was handled and whether it was truly the right approach. Up next, just standing on the sidewalk with a camera, the man was quickly labeled as suspicious. What seemed like a harmless act suddenly drew the attention of the police. You okay? Say it again. Are you okay? We just got a phone call about you out here with the camera. I just want to make sure that you're okay cuz they're saying that asking weird, suspicious questions and I just want to make sure that you're okay. Well, can I just get your name and badge number? For what? You're a cert public servant, right? Okay. Can I get your name and badge number? Is it in your pocket? >> 149. Okay. All right. Can I have your driver's license, please? No, ma'am. Why? Well, you're not free to leave. I'm not? So, I'm detained? Correct. So, I commit What crime have I committed? You don't have to commit a crime to be detained. You have to commit a suspicion of a crime. So what's what's the suspicion of a crime? We do We got a call out here. Okay. One I want to make sure that you're okay. I haven't made it into the bank. Okay. Okay. I'm literally just asking for your ID. I I cannot provide it. May I ask why? Cuz I haven't committed a crime. But at this point, you're being lawfully detained. Okay. Which therefore you do need to identify yourself. Okay, at this point. >> Otherwise, that can be obstruction. Okay. Of a law enforcement officer, which I am, which is a crime. Okay. So at this point I request the sergeant. He's a liar. I'm watching the camera. That's why I said that. Okay. Thank you. What seemed like a simple exchange began to show signs of something unusual as the approach and subsequent demands gradually made the atmosphere more tense. And shortly after, the situation was suddenly pushed to an entirely different level with words and actions going far beyond the limits of a routine encounter. And what would be the crime? I already explained it to you, sir. You haven't though. Are you aware Do you know what free press the first amendment is? I do. Am I on Am I on the public sidewalk? This is the bank. But am I on the public sidewalk? There's no concern and I'm just out here talking to you. Okay. If you're good and they're good, you're free to leave. But if you're not you're not free to leave. Okay. So we we can both stand here. We can both wait. Okay. So I can I can't walk? No, sir. All right. And if I walk you you're going to arrest me? I'm going to detain you with a handcuff. Yes, sir. Okay. That's a that's a bad parking job. Is there a reason why I'm here, sir? Other than walking around the bank. Out here, I'm not talking about that. I'm talking about the bank. And I say that because we got a call about a male matching your description to a T asking about the vault. And that's going to raise suspicion. That's why I'm asking. Just asking. How long was your training? I'm sorry? How long was your training? How long was my training? >> Yeah. I've been a police officer for almost 6 years, sir. Really? Yes, sir. Okay. So, would you like to answer my question? What's the question again? Again. I'm just conducting a constitutionally protected activity. That's all I'm doing. Okay. But again, they called us. Okay. We're here for a call. Okay. We got to identify. You don't have to identify. I do have to identify, sir. You actually don't. >> I do. Okay. We'll wait for a supervisor. Now, if you force me to identify, that'll be something different. Like I said, I haven't committed a crime. Okay, sir. Haven't spoken to anyone unless they spoke to me. Did they speak to you? They did. What did they say? Um what am I doing? Came out here and we had a good conversation. Okay. Did you ask about the vault? I did ask what side was the vault located. I did. And I only say that because that's going to make anybody raise suspicion, right? Right. But if I walk into the bank, will I be able to see what side the vault is on? I don't know. I I don't This is not my bank. Most banks Most banks have have their vault outside in the lobby though, right? Every bank is going to be different, sir. Okay. And I say that cuz I This is not my bank. Right. I don't use them for my bank. Mhm. So, I'm not I can't give you an answer that I don't know, right? Cuz that wouldn't be fair to you. Right. Mhm. It's also not fair to me to detain me and restrict my my movement out on a public sidewalk. We just had someone come up behind you just so you know. >> Okay. That's all. I just don't want you to be startled or anything like that. Yeah, no. So, you So, you under the impression that you can just detain anyone? I have to have a reason to detain someone right now, sir. So, what's the reason? We have a phone call here. They're concerned about why you were asking about the ball. The tension had moved beyond a simple argument as the tone became more forceful and the situation was pushed further. But soon after, a new development emerged shifting the story in an unpredictable direction and changing everything. So, I'm going to be detained for the whole time. Unless you would like to identify yourself and we can go in there and figure out what's going on because right now you're being detained because you >> You see it. You see what's going on. No, I haven't gone in there, sir. I have not gone in there. But you see what I'm doing, right? I just don't want You see what I'm doing, all right? Okay. So, is it against the law to do what I'm doing right now? That's all I need to know. I understand they might be concerned. Can I get your name and badge number, sir? Johnson 121. 121, thank you. Yeah, so He's refusing to identify himself. I immediately requested a supervisor. I called him and he just hung up. Wait. Okay. Yeah, I guess she's under the impression that I have to identify myself. I mean, considering there's an investigation going on, yes, sir. But Reasonable articulable suspicion of a crime. Of a crime. We can wait for a supervisor. So, we will wait for a supervisor. Okay. That's for your request. Yeah, so she uh she's under the impression that she can detain me, restrict my movement. Yeah. They were up there doing something. >> know how much longer he's going to be tied up in there. He's bringing it up. Is there anything I can do about that? Do you agree with her uh restricting my movement? She's saying if I walk, she's going to arrest me. I did not say I was going to arrest you, sir. I said I was going to detain you via handcuffs, sir. All right, that's arresting. No, it's not. It is. It is not. >> All right. I ain't going to have a debate with y'all. Where are you from, man? Where am I from? Yeah. You ask us questions, why can't we ask you? So, ask Well, you public service. Uh-huh. You You guys are public service. Okay. So, I'm asking the public, Mhm. where are you from? I'm not required to answer any question. Okay. I'm from Earth, though. I'm from Earth. Okay. I hope so. If I wasn't, you would have said otherwise. I could tell you I don't really know, man. Say it again. >> If the rock says otherwise, I mean, I don't really know. It's not a rock, it's a crystal. Okay. This from Earth. After minutes of tense back and forth, it seemed the situation would remain at a standstill, but then a new factor emerged, triggering a completely different chain of events, and shifting the dynamic in a way no one expected. How you doing, sir? I'm good. Yourself? Say it again. Good. Yeah, yeah, I'm good. I just want to know your badge number. Huh? >> All right. 146. 146. Um I was verbally detained by your officer. Yes. They're They're investigating a suspicious person, and we're finding out the rest of it, and if we're good, have a good day. So, she could just detain me on the public sidewalk for nothing? No, I I just told you we got a call for a suspicious person. Suspicious of crime, though. We have to investigate. And that's what we're doing. Nothing more, nothing less. All right, but you can't just detain anyone for nothing. It's really it's nothing. Y'all see what I'm doing? I'm doing the same thing y'all doing. We're just waiting to find out what they got to say in the bank, and then we'll be done. You see that? She should have did that first, man. So, tell me if I If I If I If I walk down the sidewalk, she's going to arrest me? She's going to physically arrest me with the handcuffs. I don't know what's going on yet. We're trying to find that out. >> I've been I've been doing this the whole time, sir. You just saw me pull up. I just got here. Okay. I mean I'm I'm pretty sure they told y'all what I was doing, just filming the bank from the What they said in the bank is all I know. Okay. I haven't spoken to you. So, you don't see no problem with what she told me. You don't. How many other officers have you talked to? How many off Yeah. Uh Quite a few. Not a lot, but quite a few. How many? I I figured cuz you said the word CAD Say again? So, I figured cuz you said the word CAD number. Yeah. That's not just common knowledge. Yeah, it's not. >> You talked to enough of us to ask for that. Right, right. So, that's why I'm asking cuz I've been here the whole time. Yes, sir. I've never met you, man, so I don't believe he has, either. I don't know. Although the exchanges at this point seem to clarify the situation, they actually revealed even more contradictions, and soon after, the next move reignited the tension, pushing everything closer to a critical decision. Sir, may I see your driver's license? And I say that because I don't I don't I don't have my driver's license. I'm not I don't I'm not going to give you my name. Okay. So, I'm going to explain how this is going to work because I have to identify you. You do not. What's the crime? Can I get the sergeant back out here, please? Can you just call him back over here before you guys make a mistake? I already did. This is crazy, man. Y'all There's no crime afoot, man. They want you to be criminally trespassed. That's on them. They can take a picture, put a picture of me up. I don't have Hey, hey. Well, if you're going to arrest me, go ahead and do what you got to do. I'm trying to arrest you. If that's what you want I'm not going to give you my identification, man. I haven't committed a crime. That's it. You do you reasonable articulable suspicion of a crime. It's simple. So, at this point at this point I'm going to I'm going to I'm going to invoke my fifth amendment. And if you're going to arrest me, you can do so. I'm not going to fight back. You can do so. But I I I do want your sergeant to come aid you guys before you make a mistake. But that's all that's all I'm going to say. Huh? So, they can be stopping you for the LT. It's literally just a piece of paper. And the end. That's all it is. Then then you do get to walk away from me. Say it again. I I just need your identification. You don't need it, though. >> Let me finish, please. >> Go ahead. I'd let you I'd let you speak. Go ahead. Keep talking. >> for the same respect. Okay? It's literally >> You're not giving me my respect. It's literally just a piece of paper. Right. That's it. So, I just need to identify you so I can put your name on this piece of paper saying you can't come back here for 1 year, and then you get to go on your merry way. And then you do get to walk down I don't have to provoke my fourth amendment right, surrender my fourth amendment right. She is so frustrated right now. She's definitely not used to being spoken to like this. identification After all the tension and arguments, everything ultimately came to an end in a way no one expected. But what just unfolded still raises serious questions about how it was handled and whether the line between law enforcement [music] and citizens' rights was truly respected. Citizens may file a lawsuit against police under section 1983 if [music] their rights are violated. Officers who violate those rights could face financial liability and may also be subject to discipline or termination. A civilized society [music] is not one without conflict, but one where every conflict is resolved through knowledge, respect, and professional ethics.
